which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Natural Gas Act with respect to actions for eminent domain by holders of certificates of public convenience and necessity, and for other purposes.</official-title></form><legis-body id="H69DDF45C58334262A6CAD5C4EA1F844F" style="OLC"><section id="HAEC4DB2F5A634394A2869D973FEEDEDC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness for Landowners Facing Eminent Domain Act</short-title></quote>.</text></section><section id="H1037BDBA239B49DDA2C9DBEFB64D59F6"><enum>2.</enum><header>Modifications to exercise of the right of eminent domain by holder of a certificate of public convenience and necessity</header><subsection id="H8C333C3573BB4D5B8E794C124D6763A2"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Section 7(h) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f(h)</external-xref>) is amended—</text><paragraph id="HA85D4D9A13EC4118857CE28E61AC6549"><enum>(1)</enum><text>by striking <quote>When any holder</quote> and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="H1ABE9731E62741F9B23700BF4F37A85B" style="OLC"><text/><paragraph display-inline="yes-display-inline" id="H8D76D47D1C47417F97B2927FCDD8D3B1"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to paragraph (2), when any holder</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H5EEBC712524E4E08BD53DA3F00AFF62C"><enum>(2)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block display-inline="no-display-inline" id="HD17D12C65AA74AD9B84C5CC180F8D633" style="OLC"><paragraph id="H4866EE132EA94D04819DB2E97E717D69" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A holder of a certificate of public convenience and necessity may not exercise the right of eminent domain under paragraph (1) unless the holder—</text><subparagraph id="HC7B23FC7023547AF831656AEAA9689F3"><enum>(A)</enum><text>obtains all Federal and State permits required by law for the construction and operation of pipeline facilities; </text></subparagraph><subparagraph id="H760B6157138B4E4B9BEBB7E235498337"><enum>(B)</enum><text>complies with all environmental conditions appended to the certificate order; and</text></subparagraph><subparagraph id="HD74412A447544278A62E7B18B2D005D9"><enum>(C)</enum><text display-inline="yes-display-inline">is in compliance with subsection (i)(2).</text></subparagraph></paragraph><paragraph id="HC349838199574D589F40AED572E7311A" indent="up1"><enum>(3)</enum><text>A holder of a certificate of public convenience and necessity shall be suspended from the exercise of the right of eminent domain under paragraph (1)—</text><subparagraph id="HED58004FDAD44682923BD2BBEC471BB7"><enum>(A)</enum><text>if the holder requests a material amendment to the certificate, until such time as the conditions in paragraph (4) are satisfied; or</text></subparagraph><subparagraph id="H25DF06FA252744A8A4669EA67DEE14B3"><enum>(B)</enum><text>if a Federal or State permit held by the holder is vacated or remanded, until such time as—</text><clause id="HA989D377791E4E5E9B88334628968D45"><enum>(i)</enum><text>all vacated or remanded permits are reinstated or reissued to the holder; and</text></clause><clause id="H9BE4A9AC7F1F46779604DBA5B513D791"><enum>(ii)</enum><text>the holder complies with all environmental conditions appended to the certificate order.</text></clause></subparagraph></paragraph><paragraph id="H66C920A54E2245F39431D7320F17EF14" indent="up1"><enum>(4)</enum><text>A holder of a certificate of public convenience and necessity who requests a material amendment to the certificate and has the exercise of the right of eminent domain suspended under paragraph (3)(A) may not commence a new action or proceeding to exercise the right of eminent domain under paragraph (1) until such time as—</text><subparagraph id="H3855BA2937574E86A5B4D9E623474ED2"><enum>(A)</enum><text display-inline="yes-display-inline">the Commission issues an amended certificate of public convenience and necessity; and</text></subparagraph><subparagraph id="HFE139D4FB67C492EBBDEEAD6E90EB764"><enum>(B)</enum><text>the holder—</text><clause id="HE79A14CBCF2D46F4850C54BB152B7D2A"><enum>(i)</enum><text>obtains all additional Federal and State permits required by law pursuant to the amended certificate; and</text></clause><clause id="HC9D409FA21604C2DA9F7503C237BBC41"><enum>(ii)</enum><text display-inline="yes-display-inline">complies with all environmental conditions appended to the amended certificate order.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2D72D9272AF54A5A8AEBA2D9B0721747" display-inline="no-display-inline"><enum>(b)</enum><header>Access for surveys</header><text display-inline="yes-display-inline">Section 7 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f</external-xref>) is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEA0AB5EA3CB148C8A5DFDE75C2728B6C"><subsection id="H4F2FECDB80734315AF5E72EC94C33813"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H2EB3E3D363BE49ADA3131CC0F9CA2BB4"><enum>(1)</enum><text>For purposes of subsection (h), the exercise of the right of eminent domain does not include accessing property for purposes of surveying prior to acquiring the property, except in accordance with paragraph (2).</text></paragraph><paragraph id="H7F3E66A1E45A48778091511C885DF25E" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If a holder of a certificate of public convenience and necessity is unable to agree with the owner of property on access to the property for purposes of surveying, the holder shall enter into the dispute resolution process of the Commission. If dispute resolution fails, or if the property owner refuses to participate in such process, the Commission may, upon a showing by the holder of documented repeated, good faith efforts to work with the property owner to agree on such access, issue an order declaring that, upon a court order, for purposes of the relevant certificate and with respect to the relevant property, the exercise of the right of eminent domain under subsection (h) includes accessing the property, in a limited, non-land-disturbing manner, for purposes of surveying prior to acquiring the property.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB773EEBABD6E4EAAA18F3FA9108588FB"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this Act shall apply—</text><paragraph id="H16BC220FC13F403B9911BA95B04D61C1"><enum>(1)</enum><text>to any action or proceeding for eminent domain under section 7(h)(1) of the Natural Gas Act, as amended by this Act, commencing on or after the date of enactment of this Act; and</text></paragraph><paragraph id="H4BC792088CC74E3DA1694E5FB5A9DDBC"><enum>(2)</enum><text>to any request for a material amendment to a certificate of public convenience and necessity occurring on or after the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
