within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prevent a fiscal crisis by enacting legislation to balance the Federal budget through reductions of discretionary and mandatory spending, and for other purposes.</official-title></form><legis-body id="HC25DCE8BF87A4293B8F821A6120E0CB3" style="OLC"><section id="H1CA68C0AEF5840B38D05A5AF685EE74B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nickel Plan Act</short-title></quote>.</text></section><section id="H9C26D88511CA4FB9A29C362BDC9DE521"><enum>2.</enum><header>Establishment and enforcement of spending caps</header><subsection id="H120BBA829E3F400AB6B2CA81554F592E"><enum>(a)</enum><header>Outlay caps</header><text display-inline="yes-display-inline">The Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900</external-xref> et seq.) is amended by inserting after section 253 the following:</text><quoted-block display-inline="no-display-inline" id="H0F8D0DF94C66423BB081DB82CD9B0D8E" style="OLC"><section id="HE55EB3B03B7E49C3A8CAD07F78D10ED1"><enum>253A.</enum><header>Establishing outlay caps</header><subsection id="H60DFAF90656F44D2A1A77B89FE9A3B76"><enum>(a)</enum><header>Outlay caps</header><text display-inline="yes-display-inline">In this section, the term <term>outlay cap</term> means:</text><paragraph id="H803E63D1B0FE486D9E8B803CD182F565"><enum>(1)</enum><header>Fiscal year 2022</header><text display-inline="yes-display-inline">For fiscal year 2022, total outlays (less net interest payments) shall be not more than $4,298,244,000,000, less 5 percent.</text></paragraph><paragraph id="HB870B65854104EC19B61317F4AB85CAA"><enum>(2)</enum><header>Fiscal year 2023</header><text display-inline="yes-display-inline">For fiscal year 2023, total outlays (less net interest payments) shall be not more than the amount computed under paragraph (1), less 5 percent.</text></paragraph><paragraph id="H7A4E92746CC64F67AF2B4CDD80DDC415"><enum>(3)</enum><header>Fiscal year 2024</header><text display-inline="yes-display-inline">For fiscal year 2024, total outlays (less net interest payments) shall be not more than the amount computed under paragraph (2), less 5 percent.</text></paragraph><paragraph id="H2B91173BA5BE4F339D57A7761266B463"><enum>(4)</enum><header>Fiscal year 2025</header><text display-inline="yes-display-inline">For fiscal year 2025, total outlays (less net interest payments) shall be not more than the amount computed under paragraph (3), less 5 percent.</text></paragraph><paragraph id="HCF59B69B9557450097FDFD6CFC67584F"><enum>(5)</enum><header>Fiscal year 2026</header><text display-inline="yes-display-inline">For fiscal year 2026, total outlays (less net interest payments) shall be not more than the amount computed under paragraph (4), less 5 percent.</text></paragraph><paragraph id="H41D573B84E6049ED9A18F37AA864BA9D"><enum>(6)</enum><header>Fiscal year 2027 and subsequent fiscal years</header><subparagraph id="H98C1ACE796BE411BAC6D255C70B5F49A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For fiscal year 2027 and each fiscal year thereafter, total outlays shall be not more than 18 percent of the gross domestic product for that fiscal year, as estimated by the Office of Management and Budget prior to March of the previous fiscal year.</text></subparagraph><subparagraph id="H322756110CA34B8AB2C022B0C21CCA17"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), for any fiscal year beginning with fiscal year 2028, total projected outlays may not be less than total projected outlays for the preceding fiscal year.</text></subparagraph></paragraph></subsection><subsection id="HD511FF3BF5C640C792ABF9965DE7A7F1"><enum>(b)</enum><header>Sequestration</header><paragraph id="H0B94663D0B4141699806B5BF1CCE8F3C"><enum>(1)</enum><header>In general</header><subparagraph id="H7FFC0B64164C4FF695D1B6491FCB0F4A"><enum>(A)</enum><header>Excess spending</header><text>Not later than 45 calendar days after the beginning of a fiscal year, the Office of Management and Budget shall prepare and the President shall order a sequestration to eliminate any excess outlay amount.</text></subparagraph><subparagraph id="H3327624DF70C467BA325E0FD82E9C45A"><enum>(B)</enum><header>Definitions</header><clause id="H84078A854250440CBA042D04FF7144F7"><enum>(i)</enum><header>Fiscal years 2022 through 2026</header><text>For each of fiscal years 2022 through 2026 and for purposes of this subsection, the term <term>excess outlay amount</term> means the amount by which total projected Federal outlays (less net interest payments) for a fiscal year exceeds the outlay cap for that fiscal year.</text></clause><clause id="H80976630D2E64A198986CB4662E3D21A"><enum>(ii)</enum><header>Fiscal year 2027 and subsequent fiscal years</header><text>For fiscal year 2027 and each fiscal year thereafter and for purposes of this subsection, the term <term>excess outlay amount</term> means the amount by which total projected Federal outlays for a fiscal year exceeds the outlay cap for that fiscal year.</text></clause></subparagraph></paragraph><paragraph id="H5E690562DC034BFEBCB2A04BBE741473"><enum>(2)</enum><header>Sequestration</header><subparagraph id="H618E929A26C14B118C7CC3FC886C3197"><enum>(A)</enum><header>CBO preview report</header><text>On August 15 of each year, the Congressional Budget Office shall issue a sequestration preview report as described in section 254(c)(4).</text></subparagraph><subparagraph id="H90DD9C52E2324FEB8CECCE5DE3D29905"><enum>(B)</enum><header>OMB preview report</header><text>On August 20 of each year, the Office of Management and Budget shall issue a sequestration preview report as described in section 254(c)(4).</text></subparagraph><subparagraph id="H4A0A1B5CF21C4F84AA4F436EF1CEBB5B"><enum>(C)</enum><header>Final report</header><text display-inline="yes-display-inline">On October 31 of each year, the Office of Management and Budget shall issue a final sequestration report as described in section 254(f)(3), which shall be accompanied by a Presidential order detailing spending reductions equal to the excess outlay amount.</text></subparagraph><subparagraph id="HC2CBA2B1B3BD4B5A99F30590EEA8D15F"><enum>(D)</enum><header>Process</header><text>The reductions shall generally follow the process set forth in sections 253 and 254, except as provided in this section.</text></subparagraph></paragraph><paragraph id="HB4169143D2DF49D892D7E6BC4E0C87F1"><enum>(3)</enum><header>Congressional action</header><text>If the August 20 report by the Office of Management and Budget projects a sequestration, the Committee on the Budget of the Senate and the Committee on the Budget of the House of Representatives may report a resolution directing committees of their House to change the existing law to achieve the spending reductions outlined in the August 20 report necessary to meet the outlay limits.</text></paragraph></subsection><subsection id="HFEB839C63F2F4835900FE16622360447"><enum>(c)</enum><header>No exempt programs</header><text display-inline="yes-display-inline">Section 255 and section 256 shall not apply to this section or any sequestration order issued under this section.</text></subsection><subsection id="H6F6D03B218A34660A85710EFA9273D65"><enum>(d)</enum><header>Look back</header><text>If, after November 14, a bill resulting in outlays for the fiscal year in progress is enacted that causes excess outlays, the excess outlay amount for the next fiscal year shall be increased by the amount or amounts of that breach.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HD7B09E1C0CA248E3849D5369AF019F25"><enum>(b)</enum><header>Conforming amendments to BBEDCA</header><paragraph commented="no" id="HB3DFDCE5E20A43A29978FBD92FC27AE1"><enum>(1)</enum><header>Sequestration preview reports</header><text>Section 254(c)(4) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/904">2 U.S.C. 904(c)(4)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H1FDD2E80D07D4B3C9A883CD01BABBBBC" style="OLC"><paragraph commented="no" id="H79CB2CB4C9AC49CA9FC0D0C52F3FEE63"><enum>(4)</enum><header>Outlay cap sequestration reports</header><text display-inline="yes-display-inline">The preview reports shall set forth for the budget year estimates for the following:</text><subparagraph commented="no" id="H135EA5D4E6474F8C9A6E440C4EC3EAC3"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H35BEDC04020247AC9A6BB965AC6265A7"><enum>(i)</enum><text>For each of budget years 2022 through 2026, total projected outlays (less net interest payments), less one percent.</text></clause><clause commented="no" id="HAEE5384EEA184F5295E3D9FB1386E445" indent="up1"><enum>(ii)</enum><text>For budget year 2027 and each subsequent budget year, the estimated gross domestic product for that budget year.</text></clause></subparagraph><subparagraph commented="no" id="HEC2C8C5579A94A7A9EEFF5C2065329E0"><enum>(B)</enum><text>The amount of reductions required under section 253A.</text></subparagraph><subparagraph commented="no" id="HA2FB818F8F58485B884D7224AF8C050A"><enum>(C)</enum><text>The sequestration percentage necessary to achieve the required reduction under section 253A.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H8D6863C64A504A0B9A146DB854103738"><enum>(2)</enum><header>Final sequestration reports</header><text>Section 254(f)(3) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/904">2 U.S.C. 904(f)(3)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H2C6A7A44177F49FB97F960117D3F0719" style="OLC"><paragraph commented="no" id="HA0B88BA388B0442E80409D1DAC440E9C"><enum>(3)</enum><header>Outlay caps sequestration reports</header><text display-inline="yes-display-inline">The final reports shall contain all the information required in the outlay cap sequestration preview reports. In addition, these reports shall contain, for the budget year, for each account to be sequestered, estimates of the baseline level of sequestrable budgetary resources and resulting outlays and the amount of budgetary sources to be sequestered and result in outlay reductions. The reports shall also contain estimates of the effects on outlays on the sequestration of each outyear for direct spending programs.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5B03C3A3E5944EB89B4022EF112047F1"><enum>(c)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Title III of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/631">2 U.S.C. 631</external-xref> et seq.) is amended by adding after section 315 the following:</text><quoted-block display-inline="no-display-inline" id="H69F3C690826041C3B6BA2E033864C60C" style="OLC"><section id="HEF02CA8D8F46472690F413C0BAF7E1F9"><enum>316.</enum><header>Enforcement procedures</header><subsection id="H75CACF39F63A4AD58FB7800CF4EC0433"><enum>(a)</enum><header>Outlay caps</header><text display-inline="yes-display-inline">It shall not be in order in the House of Representatives or the Senate to consider any bill, joint resolution, amendment, amendment between the Houses, or conference report that includes any provision that would cause the most recently reported, current outlay cap set forth in section 253A of the Balanced Budget and Emergency Deficit Control Act of 1985 to be breached or increased.</text></subsection><subsection id="H3589DAD960FE4FA793EC16E5FBE03A6E"><enum>(b)</enum><header>Waiver or suspension</header><paragraph id="H08113E6BB1C54C90BC3203A44136C096"><enum>(1)</enum><header>In the Senate</header><text>The provisions of this section may be waived or suspended in the Senate only by the affirmative vote of two-thirds of the Members, duly chosen and sworn.</text></paragraph><paragraph id="H03DD2C1A0C35487ABCE1E36A5C4085D8"><enum>(2)</enum><header>In the House</header><text>The provisions of this section may be waived or suspended in the House of Representatives only by a rule or order proposing only to waive such provisions by an affirmative vote of two-thirds of the Members, duly chosen and sworn.</text></paragraph></subsection><subsection id="HC29A1B3C3943470BA60D110BBBF0672F"><enum>(c)</enum><header>Point of order protection</header><text>In the House, it shall not be in order to consider a rule or order that waives the application of paragraph (2) of subsection (b).</text></subsection><subsection id="H6CD724A8890442FF804CA73C174676AD"><enum>(d)</enum><header>Motion To suspend</header><text>It shall not be in order for the Speaker to entertain a motion to suspend the application of this section under clause 1 of rule XV.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HA7751EA1DF3946B88DC4EDE8EA447BD8"><enum>3.</enum><header>Conforming amendments</header><text display-inline="no-display-inline">The table of contents set forth in—</text><paragraph id="HDFE225AAA37E49F3A3EEE6717CCC4F96"><enum>(1)</enum><text>section 1(b) of the Congressional Budget and Impoundment Control Act of 1974 is amended by inserting after the item relating to section 315 the following new item:</text><quoted-block display-inline="no-display-inline" id="H8C023A88F7004792B77BD4A9BD7F0691" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 316. Enforcement procedures.</toc-entry></toc><after-quoted-block>;</after-quoted-block></quoted-block><continuation-text continuation-text-level="paragraph">and </continuation-text></paragraph><paragraph id="HF5F3D91AC8FE47C7AE49DD391F055571"><enum>(2)</enum><text display-inline="yes-display-inline">section 250(a) of the Balanced Budget and Emergency Deficit Control Act of 1985 is amended by inserting after the item relating to section 253 the following new item:</text><quoted-block display-inline="no-display-inline" id="H24A4A90B5C7C44A49791B3BB1D27C8FD" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 253A. Establishing outlay caps.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H33E51FA256294E04A969322462320EF9"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall apply to fiscal year 2022 and each fiscal year thereafter, including any reports and calculations required for implementation in fiscal year 2022.</text></section></legis-body></bill>
