R. 2878</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210428">April 28, 2021</action-date><action-desc><sponsor name-id="G000574">Mr. Gallego</sponsor> (for himself, <cosponsor name-id="J000301">Mr. Johnson of South Dakota</cosponsor>, <cosponsor name-id="O000171">Mr. O'Halleran</cosponsor>, and <cosponsor name-id="C001053">Mr. Cole</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Veterans Affairs to carry out a Native VetSuccess at Tribal Colleges and Universities Pilot Program.</official-title></form><legis-body id="H6AABCCA903DC4DA8A27FAAB47082DBF5" style="OLC"><section id="H52F7638D1E294274BD87F75CC455821A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native VetSuccess at Tribal Colleges and Universities Pilot Program Act</short-title></quote>.</text></section><section id="HFB74E92B55434B9EBEAFD9DA5495389C"><enum>2.</enum><header>Native VetSuccess at Tribal Colleges and Universities Pilot Program</header><subsection id="H6A0E2440723A4C879E2D90BEA10876AF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Secretary of Veterans Affairs shall carry out a five-year pilot program, to be known as the <quote>Native VetSuccess at Tribal Colleges and Universities Pilot Program</quote>. Under such pilot program the Secretary shall—</text><paragraph id="HCE57603009ED49F59B1F813F27C5CA80"><enum>(1)</enum><text display-inline="yes-display-inline">identify three regional Native VetSuccess service areas consisting of at least two participating Tribal colleges or universities;</text></paragraph><paragraph id="H7D1E5207EBC94FB8904CDFD6645D5FCF"><enum>(2)</enum><text display-inline="yes-display-inline">assign to each regional Native VetSuccess service area a VetSuccess on Campus counselor and a full-time Vet Center outreach coordinator, both of whom shall be based on one or more of the participating Tribal colleges or universities in the service area; and</text></paragraph><paragraph id="H733F7B628A76482D8785359544E4FD8E"><enum>(3)</enum><text>provide for eligible students at such participating colleges and universities with all services for which such students would be eligible under the VetSuccess on Campus program of the Department of Veterans Affairs.</text></paragraph></subsection><subsection id="H1D852C2E41FF4F5390AE48C926BC648F"><enum>(b)</enum><header>Eligible students</header><text display-inline="yes-display-inline">For purposes of the pilot program, an eligible student is a student who is a veteran, member of the Armed Forces, or dependent of a veteran or member of the Armed Forces who is eligible for any service or benefit under the VetSuccess on Campus program of the Department.</text></subsection><subsection id="HD18F0D9C00724018A700F55C9D9C2CED"><enum>(c)</enum><header>Consultation requirement</header><text display-inline="yes-display-inline">In developing the pilot program under this section, the Secretary, acting through the Veteran Readiness and Employment Program of the Department of Veterans Affairs and in coordination with the Office of Tribal Government Relations of the Department, shall consult with Indian tribes, Tribal organizations, and veterans service organizations regarding each of the following:</text><paragraph id="H1DAC44EA7BC7482C8FF50EE663958534"><enum>(1)</enum><text display-inline="yes-display-inline">The design of the pilot program.</text></paragraph><paragraph id="HBF8AB57DAE2944D1BA136D86827BCFBD"><enum>(2)</enum><text display-inline="yes-display-inline">The selection of the three regional Native VetSuccess service areas and participating Tribal colleges and universities, taking into consideration—</text><subparagraph id="H734C144E237F44ADB4EC422BD82E674F"><enum>(A)</enum><text>the number of eligible students enrolled in the college or university and in the regional service area;</text></subparagraph><subparagraph id="HEAAC3AD2C33845CE865B7F550CD627F9"><enum>(B)</enum><text display-inline="yes-display-inline">the capacity of the colleges and universities in the regional service area to accommodate a full-time VetSuccess on Campus counselor and a full-time Vet Center outreach coordinator;</text></subparagraph><subparagraph id="H1989B654D9764ED6BAE0A36243C9ECDA"><enum>(C)</enum><text display-inline="yes-display-inline">the lack of information available at the colleges and universities in the regional service area about and lack of access to benefits and services under the laws administered by the Secretary; and</text></subparagraph><subparagraph id="H0B96AAB2CD664ABAAD0C16ACFD48B51C"><enum>(D)</enum><text>any other factor that the Secretary or the Indian tribes, Tribal organizations, and veterans service organizations identify as relevant.</text></subparagraph></paragraph><paragraph id="H8D75F881489C4B0FB08AB5BCC80747D3"><enum>(3)</enum><text display-inline="yes-display-inline">The most effective way to provide culturally competent outreach and services to eligible students at Tribal colleges and universities.</text></paragraph></subsection><subsection id="H7A94148464144CEFA3999C2D3BAAAA70"><enum>(d)</enum><header>Outreach to colleges and universities</header><text display-inline="yes-display-inline">The Secretary shall provide notice of the pilot program to all Tribal colleges and universities and encourage all Tribal colleges and universities to coordinate with each other to create regional service areas to participate in the pilot program.</text></subsection><subsection id="H818EE1DC30384438A8D676C98B6C65C6"><enum>(e)</enum><header>Briefings and reports</header><paragraph id="HF9CC0EE825334C8DA5DA01F58070EC14"><enum>(1)</enum><header>Implementation briefing</header><text>Not later than one year after the date of the enactment of this Act, the Secretary shall provide for the Committee on Veterans’ Affairs and the Committee on Natural Resources of the House of Representatives and the Committee on Veterans’ Affairs and the Committee on Indian Affairs of the Senate a briefing on—</text><subparagraph id="H7F49678F464E46239838412CF69C30E5"><enum>(A)</enum><text display-inline="yes-display-inline">the design, structure, and objectives of the pilot program; and</text></subparagraph><subparagraph id="H167E40048D6F4ED09A1631448ACAB6B0"><enum>(B)</enum><text display-inline="yes-display-inline">the three regional Native Vet Success service areas and the Tribal colleges and universities selected for participation in the pilot program and the reason for the selection of such service areas and such colleges and universities.</text></subparagraph></paragraph><paragraph id="H2712B85834B34431BD5D519E0C2F3FBB"><enum>(2)</enum><header>Report</header><text>Not later than four years after the date on which the Secretary establishes the pilot program, the Secretary shall submit to such Committees a report on the pilot program. Such report shall include each of the following:</text><subparagraph id="HCA8D919B0FE54AF9A184F09249BC024D"><enum>(A)</enum><text display-inline="yes-display-inline">The number of eligible students provided services through the pilot program.</text></subparagraph><subparagraph id="H15EAC0B521FE4ED5B0DC1E5A4342BFFF"><enum>(B)</enum><text>The types of services that eligible students received through the pilot program. </text></subparagraph><subparagraph id="H486A41C1C92C40B0A2EF8BD4B96D98B3"><enum>(C)</enum><text>The graduation rate of eligible students who received services through the pilot program.</text></subparagraph><subparagraph id="H16366DBECFD4469A8CCBACA0F7E41C00"><enum>(D)</enum><text>The rate of employment within one year of graduation for eligible students who received services through the pilot program.</text></subparagraph><subparagraph id="H6FDF514FE8C04DC4BD79E2C00BE9039F"><enum>(E)</enum><text>Feedback from each Tribal college or university that participated in the pilot program, including on the regional nature of the program.</text></subparagraph><subparagraph id="H7A691B71794D4415972564F8D5695DDE"><enum>(F)</enum><text display-inline="yes-display-inline">Analysis of the feasibility of expanding a regionally based Native VetSuccess at Tribal Colleges and Universities Program, including an explanation of the challenges of such a model due to issues with distance, communication, and coordination, and to the level of unmet services.</text></subparagraph><subparagraph id="HB4DB907D8A0B4D73B1F88E2EE49BCE19"><enum>(G)</enum><text>A detailed legislative proposal regarding a long-term extension of the pilot program, including a budget, if the Secretary determines that such an extension is appropriate.</text></subparagraph></paragraph></subsection><subsection id="H026772A298DD4AFA959FBBDAC96599C5"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE2AF428E91884EF6BC307BA3EB797413"><enum>(1)</enum><text>The term <quote>Tribal college or university</quote> has the meaning given such term under section 316 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>).</text></paragraph><paragraph id="H2751E6ACFF7A48A78B4F3DE60E8B4513"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>tribal organization</quote> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text></paragraph><paragraph id="HD07E5954AE5A4D22A9666825AB5F50E1"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>culturally competent</quote> means considerate of the unique values, customs, traditions, cultures, and languages of Native American veterans.</text></paragraph></subsection></section></legis-body></bill>
