which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Restoring Neighborhoods and Strengthening Communities Program, and for other purposes.</official-title></form><legis-body id="H2AD8B4872F8D40A5BC6CBEFA5A79337B" style="OLC"><section id="H99B4BE9BC7054D37B1D9BE265782BE0C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Neighborhoods and Strengthening Communities Act</short-title></quote>.</text></section><section id="HEB70C427F3A54EB38E347B2C8AC29BC8"><enum>2.</enum><header>Restoring neighborhoods and strengthening communities program</header><subsection id="H75BF0D7723D34FE69240BFB8C0B4BCAC"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H0616C0A13EB048CFAE0128E8D608ECAF"><enum>(1)</enum><header>Capital construction grant</header><text>The term <term>capital construction grant</term> means a capital construction grant under subsection (e).</text></paragraph><paragraph id="HA7DC71235F21478981DA01B75742C982"><enum>(2)</enum><header>Community engagement, education, and capacity building grant</header><text>The term <term>community engagement, education, and capacity building grant</term> means a community engagement, education, and capacity building grant under subsection (c).</text></paragraph><paragraph id="HE77891F2FB054C30BAE8D1DBE4041791"><enum>(3)</enum><header>Community land trust</header><text>The term <term>community land trust</term> means a nonprofit organization established or with the responsibility, as applicable—</text><subparagraph id="HE40A1F30788E44EDB423FAEDEA503DAD"><enum>(A)</enum><text>to develop the real estate created by the removal or capping of an infrastructural barrier; and</text></subparagraph><subparagraph id="H4B3E6F152F0244CB8C4D0117EB0F4292"><enum>(B)</enum><text>to carry out anti-displacement or community development strategies, including—</text><clause id="HF06517094EAB420CA340C5EC78EF14AC"><enum>(i)</enum><text>affordable housing preservation and development;</text></clause><clause id="HD333EFA238454751A1562B199D6D1086"><enum>(ii)</enum><text>homeownership and property improvement programs;</text></clause><clause id="HD2F658D701044BE39E7C643B4EBA756E"><enum>(iii)</enum><text>the development or rehabilitation of park space or recreation facilities; and</text></clause><clause id="HF58ABB0778D4438D97AC20993AD13548"><enum>(iv)</enum><text>community revitalization and economic development projects.</text></clause></subparagraph></paragraph><paragraph id="HF1DF414088C3485FB69B5083FF020811"><enum>(4)</enum><header>Environmental justice community</header><text>The term <term>environmental justice community</term> means a community with significant representation of communities of color, low-income communities, or Tribal and indigenous populations that experiences, or is at risk of experiencing, higher or more adverse human health or environmental effects, as compared to other communities.</text></paragraph><paragraph id="HC85312D83AEF42248394CEE4321306A6"><enum>(5)</enum><header>Infrastructural barrier</header><text>The term <term>infrastructural barrier</term> means a highway (including a limited access highway), a railway, a viaduct, a principal arterial facility, or any other transportation facility for which the high speeds, grade separation, or other design factors contribute to negative health impacts on adjacent communities or create an obstacle to connectivity, including—</text><subparagraph id="H82848FF075244295A4FA11C7C561328B"><enum>(A)</enum><text>obstacles to walking, biking, and mobility;</text></subparagraph><subparagraph id="H8F80B35162C8434E94DCA353018CB24F"><enum>(B)</enum><text>diminished access to destinations across the infrastructural barrier; or</text></subparagraph><subparagraph id="H72DE9B362FB44B808CA28FB6422C42FF"><enum>(C)</enum><text>barriers to the economic development of the surrounding neighborhood.</text></subparagraph></paragraph><paragraph id="H4699FCB75144430CB53200F6AE357939"><enum>(6)</enum><header>Planning and feasibility study grant</header><text>The term <term>planning and feasibility study grant</term> means a planning and feasibility study grant under subsection (e).</text></paragraph><paragraph id="HBF93AD9E19F4451D88607CA5AD718367"><enum>(7)</enum><header>Program</header><text>The term <term>program</term> means the program established under subsection (b).</text></paragraph><paragraph id="H9CA8C56E8483464FA96D1C03AFE12267"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph id="H6A371CBEE1A248F78AC747A1717A786A"><enum>(9)</enum><header>Tribal government</header><text>The term <term>Tribal government</term> means the recognized governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published most recently as of the date of enactment of this Act pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph></subsection><subsection id="HC7D8B4D38BC242B3A83DAA0DC335B463"><enum>(b)</enum><header>Establishment</header><paragraph id="HF0EBF5B4F29942A19F477AE88FFAD0DA"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a program to help communities—</text><subparagraph id="H0D5BE0C90B504585AFFBEE2A3E620049"><enum>(A)</enum><text>identify infrastructural barriers within the community that—</text><clause id="H7249822D91284F2E818F4BE519D54E0D"><enum>(i)</enum><text>create obstacles to mobility or economic development; or</text></clause><clause id="H0BAF6E2B4E7A44C8B91C34F4BC25914A"><enum>(ii)</enum><text>expose the community to high levels of particulate matter, noise pollution, and other public health and safety risks;</text></clause></subparagraph><subparagraph id="HE00A13B558A543CE8F93A51D44793E7C"><enum>(B)</enum><text>study the feasibility of improving, and develop plans to improve, community connectivity, including through—</text><clause id="H7536FDE50993418FA8ECA37C4EC66901"><enum>(i)</enum><text>removal or retrofit of an infrastructural barrier; or</text></clause><clause id="HD549AF2C01124E7992ABED2943269C3D"><enum>(ii)</enum><text>construction or adaptive reuse of facilities to mitigate the obstacle created by the infrastructural barrier by enhancing connectivity across the infrastructural barrier;</text></clause></subparagraph><subparagraph id="HE09B68CEDBA34699B825318BD56B5B61"><enum>(C)</enum><text>plan the redevelopment of any land made available by the removal or retrofit of the infrastructural barrier, with a focus on improvements that will benefit the populations impacted by or previously displaced by the infrastructural barrier;</text></subparagraph><subparagraph id="H5963B70401E94E9497F6F9E8B88DFBC7"><enum>(D)</enum><text>access funding to carry out the activities described in subparagraphs (B) and (C); and</text></subparagraph><subparagraph id="HACA331E301A34376A1F9BD14E0D6B380"><enum>(E)</enum><text>require the equity of any activities carried out under the program, including by garnering community engagement, avoiding displacement, and ensuring local participation in jobs created through those activities.</text></subparagraph></paragraph><paragraph id="HF78761E3F5D644118923DE71B352EE5B"><enum>(2)</enum><header>Types of grants</header><text>Under the program, the Secretary shall award the following types of grants:</text><subparagraph id="H72EF5BDA68184F2E91FE2B63C7153BE0"><enum>(A)</enum><text>Community engagement, education, and capacity building grants.</text></subparagraph><subparagraph id="H0531EF9235C142B09256AE15CEAAF311"><enum>(B)</enum><text>Planning and feasibility study grants.</text></subparagraph><subparagraph id="HAF1F37AAE0A34924B623D5866E2A5142"><enum>(C)</enum><text>Capital construction grants.</text></subparagraph></paragraph><paragraph id="HC412D94EADDE47D1BCAD47AC891A445B"><enum>(3)</enum><header>Multiple grants permitted</header><text>An eligible entity may apply for and receive funding from more than 1 type of grant described in paragraph (2). </text></paragraph></subsection><subsection id="HBCB597652EC245CF9B2B5EF9D897C103"><enum>(c)</enum><header>Community engagement, education, and capacity building grants</header><paragraph id="HD219AA55A66046029BCE9B2B8CA0EA4D"><enum>(1)</enum><header>Eligible entities</header><text>The Secretary may award a community engagement, education, and capacity building grant to carry out community engagement, education, and capacity building activities described in paragraph (2) to—</text><subparagraph id="H1E84FAA5E0D14FC9A04074562EAD84A1"><enum>(A)</enum><text>a unit of local government, a metropolitan planning organization, or a group of local governments;</text></subparagraph><subparagraph id="H6C2DDEBAA33A4169872A310F1EE159EA"><enum>(B)</enum><text>a Tribal government or a consortium of Tribal governments;</text></subparagraph><subparagraph id="H704F66C111A74EF3A6F4329976B7EDDC"><enum>(C)</enum><text>a political subdivision of a State or local government;</text></subparagraph><subparagraph id="H6BF324B9BB8E4245B7BC54EA79B0CBF5"><enum>(D)</enum><text>a special purpose district or a public authority with a transportation function; and</text></subparagraph><subparagraph id="HD96BF5373CA94BB08D7B9025DAACB17D"><enum>(E)</enum><text>a nonprofit organization.</text></subparagraph></paragraph><paragraph id="H4B3FAF76F04447D3841971B9937B59C9"><enum>(2)</enum><header>Eligible activities</header><text>A community engagement and capacity building activity referred to in paragraph (1) includes an activity—</text><subparagraph id="H905E6B2F553F4FAEB508A99E93FF6485"><enum>(A)</enum><text>to educate community members about opportunities to affect transportation and economic development planning and investment decisions;</text></subparagraph><subparagraph id="H757888AF68C34AEDB28B4A13D389DA31"><enum>(B)</enum><text>to build organizational or community capacity to engage in transportation and economic development planning;</text></subparagraph><subparagraph id="H1B813EF3B138404A9E95B25E40907244"><enum>(C)</enum><text>to identify community needs and desires for community improvements;</text></subparagraph><subparagraph id="H14A2AA9D13A14EC5B23603F9966C8D9D"><enum>(D)</enum><text>to develop community-driven solutions to local challenges;</text></subparagraph><subparagraph id="H97A558D9BF69474DAFE1D9E1D834E453"><enum>(E)</enum><text>to conduct assessments of equity, mobility and access, environmental justice, affordability, economic opportunity, health outcomes, and other local goals; </text></subparagraph><subparagraph id="H11F98027D2E0401CAE308962337C227B"><enum>(F)</enum><text>to form a Community Advisory Board in accordance with subsection (f); and</text></subparagraph><subparagraph id="H5B638DB37DED420BB81759D928729764"><enum>(G)</enum><text>to engage community members in scenario planning.</text></subparagraph></paragraph><paragraph id="HD43FC10388564F54A27CE5953E57F9E4"><enum>(3)</enum><header>Federal share</header><text>The Federal share of the cost of an activity carried out with funds from a community engagement, education, and capacity building grant may be up to 100 percent, at the discretion of the eligible entity.</text></paragraph><paragraph id="HB9EA63A8BA6E49DB83926DB88C4D7012"><enum>(4)</enum><header>Limitation</header><text>Of the amounts made available to carry out this section each fiscal year, the Secretary may use not more than 20 percent to award community engagement, education, and capacity building grants.</text></paragraph></subsection><subsection id="H548BF468A91B41E8B82E5980BB352DDF"><enum>(d)</enum><header>Planning and feasibility study grants</header><paragraph id="HC01B10D5FE1B4042AE9654F5B2B09054"><enum>(1)</enum><header>Eligible entities</header><subparagraph id="H814CF7DCACEB40E68283661503D19479"><enum>(A)</enum><header>In general</header><text>The Secretary may award a planning and feasibility study grant to carry out planning activities described in paragraph (2) to—</text><clause id="H6FCE14ED8ABB4FD3913B04706C852007"><enum>(i)</enum><text>a State or group of States;</text></clause><clause id="H93CFE1D6DD704C259B293B458858C319"><enum>(ii)</enum><text>a unit of local government, a metropolitan planning organization, or a group of local governments;</text></clause><clause id="H8A0439D9EA7F426DA345ACBE6537724F"><enum>(iii)</enum><text>a Tribal government or a consortium of Tribal governments;</text></clause><clause id="H9F44141F515E457E8CD78E65A2FAE96E"><enum>(iv)</enum><text>a political subdivision of a State or local government;</text></clause><clause id="H4ADFAD8C241842319163BCA48DB0ECEB"><enum>(v)</enum><text>a special purpose district or a public authority with a transportation function;</text></clause><clause id="H24725CF3F6604AA4B619F4D7E2F477BD"><enum>(vi)</enum><text>a multi-State or multijurisdictional group of public entities; and</text></clause><clause id="H3C1DF8533B5B48348A9D406256679F58"><enum>(vii)</enum><text>a nonprofit organization.</text></clause></subparagraph><subparagraph id="H3573153103BE49F4AE9D1E1AFE69BDCE"><enum>(B)</enum><header>Partnerships</header><text>In the case of an eligible entity that is not the owner of the infrastructural barrier that is the subject of the planning and feasibility study grant, the eligible entity shall demonstrate the existence of a partnership with the owner of the infrastructural barrier.</text></subparagraph></paragraph><paragraph id="H673F9C436CB14A4A8655EE7AA910884E"><enum>(2)</enum><header>Eligible activities</header><text>A planning activity referred to in paragraph (1)(A) includes—</text><subparagraph id="H06B007275158422F8DAC23D8A1F38724"><enum>(A)</enum><text>development of designs and artistic renderings to facilitate community engagement;</text></subparagraph><subparagraph id="HEFD6F7BA80494309A733CA8763E01258"><enum>(B)</enum><text>traffic studies, nonmotorized accessibility analyses, equity needs analyses, and collection of other relevant data;</text></subparagraph><subparagraph id="HEFC1065759FE470680480D222E0D984E"><enum>(C)</enum><text>planning studies to evaluate the feasibility of removing or retrofitting an infrastructural barrier, or the construction or constructive reuse of facilities to mitigate the obstacle created by the infrastructural barrier by enhancing connectivity across the infrastructural barrier;</text></subparagraph><subparagraph id="H9467A8D748C04C10A0695E7DAC30E12A"><enum>(D)</enum><text>public engagement activities to provide opportunities for public input into a plan to remove, convert, or mitigate an infrastructural barrier; </text></subparagraph><subparagraph id="H5D1C415EA73E4DBEB3EE2EC8AB8104E4"><enum>(E)</enum><text>environmental review, consultation, or other action required under any Federal environmental law relating to the review or approval of a project to remove, retrofit, or mitigate an existing infrastructural barrier;</text></subparagraph><subparagraph id="H6FC56BF1DC6E4CE2AA2A202DAED9AD4E"><enum>(F)</enum><text>establishment of a community land trust; and</text></subparagraph><subparagraph id="H3A73C091838C44DEAE84D8E4A98ADEC2"><enum>(G)</enum><text>other transportation planning activities required in advance of a project to remove, retrofit or mitigate an existing infrastructural barrier, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="H848D091B4D4B49F38700F3909485219E"><enum>(3)</enum><header>Priority</header><text>In selecting eligible entities to receive a planning and feasibility study grant, the Secretary shall give priority to eligible entities that seek to carry out a traffic study that includes consideration of—</text><subparagraph id="H20DBABC70EAC4817939094C980AA5AAB"><enum>(A)</enum><text>safety;</text></subparagraph><subparagraph id="H9196CEFD8CA740FEA7C3DFCE939FAEB2"><enum>(B)</enum><text>health impacts;</text></subparagraph><subparagraph id="HFBEE3C771246415CAE062AF61B2FD5EE"><enum>(C)</enum><text>levels of single-occupancy vehicular travel;</text></subparagraph><subparagraph id="HA857E124D6FE45BC96D03C814D00AD27"><enum>(D)</enum><text>access to jobs and services; and</text></subparagraph><subparagraph id="HF4D774770B6546159F503BE9978CEAAC"><enum>(E)</enum><text>levels of traffic stress.</text></subparagraph></paragraph><paragraph id="HEAAF58D0ED2E4ED9BE0CD55CA2CD572C"><enum>(4)</enum><header>Federal share</header><subparagraph id="H181B6E06706A4718A04876E4A10AC537"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Federal share of the cost of an activity carried out with funds from a planning and feasibility study grant shall be not more than 80 percent.</text></subparagraph><subparagraph id="H5C54305D42924D30A4824F4D74697A10"><enum>(B)</enum><header>Waiver</header><text>The Secretary may waive the non-Federal share requirement under subparagraph (A) if the Secretary determines that the recipient of a grant cannot meet the requirement due to financial hardship.</text></subparagraph></paragraph></subsection><subsection id="H2C07807DBA53429397B5805E359D08A6"><enum>(e)</enum><header>Capital construction grants</header><paragraph id="H56799F474E74484B9A8E5EBD307288D8"><enum>(1)</enum><header>Eligible entities</header><text>The Secretary may award a capital construction grant to the owner of an infrastructural barrier to carry out a project described in paragraph (3) for which all necessary feasibility studies and other planning activities have been completed.</text></paragraph><paragraph id="H6B3B231DE97D44E29ED65A5722A720B0"><enum>(2)</enum><header>Partnerships</header><text>For the purpose of submitting an application for a capital construction grant, an owner of an infrastructural barrier may, if applicable, partner with—</text><subparagraph id="HBED8ECE3D3554230A8F96330880E13D3"><enum>(A)</enum><text>a State or group of States;</text></subparagraph><subparagraph id="H57195D79B1224078A123E62398F22DEF"><enum>(B)</enum><text>a unit of local government, a metropolitan planning organization, or a group of local governments;</text></subparagraph><subparagraph id="H9F281B1D4975481A8656CFC596535BA7"><enum>(C)</enum><text>a Tribal government or a consortium of Tribal governments;</text></subparagraph><subparagraph id="HE7C361C86669468AAD83252DE4178E96"><enum>(D)</enum><text>a political subdivision of a State or local government;</text></subparagraph><subparagraph id="H9C9C1711CD604B0A85631DF4F516066E"><enum>(E)</enum><text>a special purpose district or a public authority with a transportation function;</text></subparagraph><subparagraph id="HBAF3CC5E7513406DBF5D29158AD7C5FB"><enum>(F)</enum><text>a multi-State or multijurisdictional group of public entities; or</text></subparagraph><subparagraph id="H1A2C500182B641738A4BCECC74A3A6B3" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text>a nonprofit organization.</text></subparagraph></paragraph><paragraph id="H81E93C75EF1E4FE3A9ECF485D1B75A3D"><enum>(3)</enum><header>Eligible projects</header><subparagraph id="H10CE20349C084E14BFC557B88635ADEB"><enum>(A)</enum><header>In general</header><text>A project eligible to be carried out with a capital construction grant includes—</text><clause id="HFA56C72DCBD64A6B9FFC92D99309039F"><enum>(i)</enum><text>the removal of an infrastructural barrier;</text></clause><clause id="HC9260A1493AC4F72BFC38FB5DEA9497F"><enum>(ii)</enum><text>the retrofit of an infrastructural barrier in a way that enhances community connectivity and is sensitive to the context of the surrounding community, including retrofits to a highway to cap the facility or replace the facility with an at-grade arterial roadway;</text></clause><clause id="H156AB5BAF7D2425AB9982CB1AF3C7E6E"><enum>(iii)</enum><text>the construction or adaptive reuse of facilities that improve connectivity across the infrastructural barrier; </text></clause><clause id="H4779F7DCC3FE4C12ADF43B0B86EEDBAE"><enum>(iv)</enum><text>the replacement of an infrastructural barrier with a new use or facility that has been identified by members of the community; and</text></clause><clause id="HD5A26F7480514073849E6CB148C3750D"><enum>(v)</enum><text>the construction of other transportation improvements that address the mobility needs of the community.</text></clause></subparagraph><subparagraph id="H1367FFC9D89C4883957AFC056D4C4AF4"><enum>(B)</enum><header>Exclusion</header><text>Funds from a capital construction grant shall not be used on a project that increases net capacity for vehicular travel. </text></subparagraph></paragraph><paragraph commented="no" id="HBF9FB582B86245F898FC62C46AEC6465"><enum>(4)</enum><header>Priority for capital construction grants</header><text>In selecting eligible entities to receive a capital construction grant, the Secretary shall give priority to eligible entities that—</text><subparagraph commented="no" id="HB32AFE48FECF4143925CF5644EC5D59D"><enum>(A)</enum><text>provide the majority of project benefits to 1 or more environmental justice communities;</text></subparagraph><subparagraph commented="no" id="H69D7B80CFF194CD4BBED30E058AD99BD"><enum>(B)</enum><text>have entered into a community benefits agreement with representatives of the community;</text></subparagraph><subparagraph commented="no" id="HCB05A9860B3C42D79E579ADF8EF19081"><enum>(C)</enum><text>have formed a Community Advisory Board under subsection (f); </text></subparagraph><subparagraph commented="no" id="HB30BC50A90C6462D8DAC2FE7C4A65B4C"><enum>(D)</enum><text>have demonstrated a plan for improving transit services, mobility for pedestrians and bicyclists, or enhancing safety features for nonmotorists (as that term is used in the Fatality Analysis Reporting System of the National Highway Traffic Safety Administration); </text></subparagraph><subparagraph commented="no" id="HE5072E9E210C4014AFB2996A5C48040B"><enum>(E)</enum><text>have demonstrated a plan for reducing greenhouse gas emissions or improving air quality; or</text></subparagraph><subparagraph id="HB0B368AD127146DB8F3A8C2BDF036971" commented="no"><enum>(F)</enum><text>have demonstrated a plan for—</text><clause commented="no" id="H9303928FB38E433F99869E76026BCF4A"><enum>(i)</enum><text>employing residents in the area impacted by the activity or project through targeted hiring programs; and</text></clause><clause commented="no" id="H3CB099609A4C44009E76C23917C2EF01"><enum>(ii)</enum><text>contracting and subcontracting with disadvantaged business enterprises. </text></clause></subparagraph></paragraph><paragraph id="H5877AA76D1AF43F0A56559FE549D712C"><enum>(5)</enum><header>Requirements</header><subparagraph id="H25B3178D07704622B7C2421B197AE026"><enum>(A)</enum><header>Community support</header><text>In order to receive a capital construction grant, the owner of the applicable infrastructural barrier shall demonstrate that the project is supported by the community in the immediate vicinity of the project. </text></subparagraph><subparagraph id="H6E09B8FABE8F4319A92D1A686A3E2DF5"><enum>(B)</enum><header>Anti-displacement policy or community land trust required</header><text>In order to receive a capital construction grant, the owner of the applicable infrastructural barrier shall demonstrate that the project serves a community in which an anti-displacement policy or a community land trust is in effect.</text></subparagraph><subparagraph id="HC20656DDF20443E5884F0416901D57E8"><enum>(C)</enum><header>Buy America</header><text>A capital construction grant may not be used to carry out an eligible project unless the project complies with section 313 of title 23, United States Code.</text></subparagraph></paragraph><paragraph id="H21F527A3956F450285DE0591EEFE8EA5"><enum>(6)</enum><header>Federal share</header><subparagraph id="HF05D99C8ABD345ECA413F1DF2905BFB0"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraphs (B) and (C), the Federal share of the cost of a project carried out with a capital construction grant may be not more than 80 percent.</text></subparagraph><subparagraph id="HC558518B2A90494F978DD81E6044B0CF"><enum>(B)</enum><header>Waiver</header><text>The Secretary may waive the non-Federal share requirement under subparagraph (A) if the Secretary determines that the recipient of a grant cannot meet the requirement due to financial hardship. </text></subparagraph><subparagraph id="H3F3043E89B37428D8323CA1ECDE72BE5"><enum>(C)</enum><header>Maximum federal involvement</header><text>Federal assistance other than a capital construction grant may be used to satisfy the non-Federal share of the cost of a project for which the grant is awarded.</text></subparagraph></paragraph></subsection><subsection id="H6893402A7E3D4B50B8C1C595E153EB56"><enum>(f)</enum><header>Community advisory board</header><paragraph id="HC71CA55D968543D0B7606BA56B5CEF58"><enum>(1)</enum><header>In general</header><text>To help achieve inclusive economic development benefits, an eligible entity may form a community advisory board, which shall—</text><subparagraph id="H5A7299AB3E014AC3913BE51D29727279"><enum>(A)</enum><text>facilitate community engagement with respect to the activity or project proposed to be carried out; and</text></subparagraph><subparagraph id="HDC7F46E3616649CBA9B5CD5EDFD5D388"><enum>(B)</enum><text>track progress with respect to commitments of the eligible entity to inclusive employment, contracting, and economic development under the activity or project.</text></subparagraph></paragraph><paragraph id="H99E2F81FE81E4928B8685BFB87C89D9A"><enum>(2)</enum><header>Membership</header><text>If an eligible entity forms a community advisory board under paragraph (1), the community advisory board shall be composed of representatives of—</text><subparagraph id="HF452696B3DDD4DC49D277F8275BB9E26"><enum>(A)</enum><text>residents in the immediate vicinity of the project;</text></subparagraph><subparagraph id="H941D23F4783E48C9900D857537A47D56"><enum>(B)</enum><text>owners of businesses that serve the community;</text></subparagraph><subparagraph id="H5F740FBEA2BE48C5A7F65C53BDB632FF"><enum>(C)</enum><text>labor organizations that represent workers that serve the community; and</text></subparagraph><subparagraph id="H0931980A09EA4A86ADB8669312A7817A"><enum>(D)</enum><text>State and local government. </text></subparagraph></paragraph><paragraph id="H8307BB355EE74115A2856242A4121FB9"><enum>(3)</enum><header>Collection of demographic information</header><subparagraph id="H46DFA3FEDC0B46F4A05A7D0DEB5B9DA8"><enum>(A)</enum><header>Collection</header><text>The Secretary shall provide for the collection of demographic information of the membership of community advisory boards formed under paragraph (1).</text></subparagraph><subparagraph id="H6554C783B0E5488E948C363AD5F075E6"><enum>(B)</enum><header>Access to information</header><text>The Secretary shall establish appropriate procedures—</text><clause id="H2EA50CDE8E20481BA3E1BF4AC7C64D1F"><enum>(i)</enum><text>to protect the personally identifying information submitted under subparagraph (A); and</text></clause><clause id="H007FC9997863417E9F53D7D549A1E1D9"><enum>(ii)</enum><text>to ensure that any information collected under this paragraph is not included when an application for a grant under this section is examined.</text></clause></subparagraph><subparagraph id="HAD6DDEC26EB94446B268011C4EDA1D5E"><enum>(C)</enum><header>Report to Congress</header><text>The Secretary shall, on a biennial basis, submit to Congress a report that—</text><clause id="H27F63F2A37EC4863B18B5D5800ECE1F7"><enum>(i)</enum><text>evaluates the information collected under this paragraph; and</text></clause><clause id="H22D0DA1DA7934119881C80EC96667CAD"><enum>(ii)</enum><text>includes recommendations—</text><subclause id="HA203AC39B7684314A06691171C4002B4"><enum>(I)</enum><text>to improve the diversity of community advisory boards formed under paragraph (1); and</text></subclause><subclause id="H1C7BF0E4E97A434EBED88ACD3A3B419C"><enum>(II)</enum><text>to improve data collection under this paragraph.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H93D7BE2693634901A00DB946ACCFB8D4"><enum>(g)</enum><header>Study on infrastructural barriers</header><paragraph id="H2DE837F9F26742D780AEAEA87758B1F6"><enum>(1)</enum><header>In general</header><text>The Secretary shall conduct a study—</text><subparagraph id="H44749990AE584122BFC29E112066D0DF"><enum>(A)</enum><text>to identify communities across the United States that have infrastructural barriers; and</text></subparagraph><subparagraph id="HC7A337BB23F443488FF277D8BDD87E6B"><enum>(B)</enum><text>to measure the environmental, public health, and economic harm done to the communities identified under subparagraph (A) as a result of those infrastructural barriers.</text></subparagraph></paragraph><paragraph id="H6D568CFE37224E06BECFBA94F040C80D"><enum>(2)</enum><header>Consultation</header><text>In conducting the study under paragraph (1), the Secretary shall consult with—</text><subparagraph id="H4C38C79BD9444F80B8DC460E9FFBFB82"><enum>(A)</enum><text>State departments of transportation;</text></subparagraph><subparagraph id="HB135199E5F51400E94CD832E9CDDD8B3"><enum>(B)</enum><text>units of local government, Tribal governments, and metropolitan planning organizations that represent jurisdictions impacted by infrastructural barriers; and</text></subparagraph><subparagraph id="H2510B547529A431BACC3558B5DEB856A"><enum>(C)</enum><text>special purpose districts and public authorities with a transportation function.</text></subparagraph></paragraph><paragraph id="H72FECE479A3D4CD5B3898DDDFE75D567"><enum>(3)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to Congress and make publicly available a report describing the results of the study conducted under paragraph (1).</text></paragraph><paragraph id="H7DD5645DB22D44AD9F8FDD15C3CC5A53"><enum>(4)</enum><header>Map</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall establish an online tool to map infrastructural barriers identified in the study conducted under paragraph (1).</text></paragraph></subsection><subsection id="HDD6C087A9D4445E6873E06DC58F10CA6"><enum>(h)</enum><header>Davis-Bacon</header><paragraph id="H1B5553C012634327A6C49B1187DFC1A5"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, all laborers and mechanics employed by contractors or subcontractors on projects carried out in whole or in part using a grant under the program shall be paid wages at rates not less than those prevailing on projects of a similar character in the locality as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code (commonly known as the <quote>Davis-Bacon Act</quote>).</text></paragraph><paragraph id="H2AC5EE0DB0DF4BA7B4DEFEDF6998CFB0"><enum>(2)</enum><header>Authority</header><text>With respect to the labor standards specified in paragraph (1), the Secretary of Labor shall have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and section 3145 of title 40, United States Code. </text></paragraph></subsection><subsection id="H72EE918950DA4315A5C640F7AC9F2DB9"><enum>(i)</enum><header>Administrative costs</header><text>For each fiscal year, the Secretary may use not more than 2 percent of the amounts made available for the program for the costs of administering the program.</text></subsection><subsection id="HB1AEB5274C7445F898ED9714986A63C3"><enum>(j)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that—</text><paragraph id="H9334FEAF63DD40B38FB852DC046670F4"><enum>(1)</enum><text>assesses the impacts and benefits of highway removals on congestion, mobility, and safety in the project vicinity, and the extent to which those impacts differ from projected impacts;</text></paragraph><paragraph id="H6D65EA2C0EA2401FA75096BD19F140B5"><enum>(2)</enum><text>includes recommendations for how traffic forecasting should—</text><subparagraph id="HFFAA5A2F32AB4BCEA772FDCE6B726FF2"><enum>(A)</enum><text>consider nonmotorized travel demand; and</text></subparagraph><subparagraph id="HF5ACF060D08D4CB99A8B6923BC8657E7"><enum>(B)</enum><text>track and be updated in response to observed travel behavior responses to changes in transportation capacity and land use; and</text></subparagraph></paragraph><paragraph id="HA7DB2644BF314F959552825BB117E063"><enum>(3)</enum><text>includes recommendations for how environmental reviews for projects funded under the Federal-aid highway program should consider, identify, and quantify, during project development, any diminished access, including nonmotorized access, that will result from the project. </text></paragraph></subsection><subsection id="H1C3A2AE5A28043CD9AE82CED75322820"><enum>(k)</enum><header>Authorization of appropriations</header><paragraph id="H81FA92D3E24C4BA1A54DEB41D66D352B"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out the program $3,000,000,000 for each of fiscal years 2022 through 2026. </text></paragraph><paragraph id="H44D0ABD2B61347CEB03CCDE8A44B5A6B"><enum>(2)</enum><header>Environmental justice communities</header><text>Of the amounts made available under paragraph (1) for each fiscal year, not less than 40 percent shall be directed towards environmental justice communities.</text></paragraph></subsection></section></legis-body></bill>
