<section id="HE8DE257B29914EB79F097CD060453BA4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Oversight of Law Enforcement Surveillance Act of 2021</short-title></quote>.</text></section> <section id="HCE15A75BE7A04CA0AA69A99450F67BB9"><enum>2.</enum><header>Reporting on surveillance technology</header> <subsection id="HA5043634088342189D37B1665F161C68"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter, a law enforcement agency of a major metropolitan area receiving any Federal funds from the Department of Homeland Security shall report the use of surveillance technology to:</text>
<paragraph id="HD109E7EB966A47ED85C10B107B071585"><enum>(1)</enum><text>The Secretary of Homeland Security.</text></paragraph> <paragraph id="H4A6AA725CFB6496FA49A9790673B44E3"><enum>(2)</enum><text>The Inspector General of the Department of Homeland Security. </text></paragraph>
<paragraph id="H21B35615A17148319B871DF0801F450A"><enum>(3)</enum><text>The United States Congress. </text></paragraph></subsection> <subsection id="H24FDE7F9013E45F59A04ACAB87A72536"><enum>(b)</enum><header>Report by Inspector General</header><text display-inline="yes-display-inline">Not later than one year after the enactment of this Act, and annually thereafter, the Inspector General of the Department of Homeland Security shall report to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate on the use of surveillance technology and the impact the use of such technology has on civil liberties and privacy.</text></subsection>
<subsection id="H689A96B6A70E4BA088D693A9223BFCE8"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H73313F435DA346688C9A2FEA522F902C"><enum>(1)</enum><header>Law enforcement agency</header><text display-inline="yes-display-inline">The term <quote>law enforcement agency</quote> means a State, local, Indian tribal, or campus public agency engaged in the prevention, detection, investigation, prosecution, or adjudication of violations of criminal laws. </text></paragraph>
<paragraph id="H748FC988FFBE41C29B2E8E91B60162D7"><enum>(2)</enum><header>Major metropolitan area</header><text display-inline="yes-display-inline">The term <quote>major metropolitan area</quote> means an area including 250,000 residents or more. </text></paragraph> <paragraph id="H94D69430321549F59320463112C6A1A5"><enum>(3)</enum><header>Surveillance technology</header><text display-inline="yes-display-inline">The term <quote>surveillance technology</quote> means equipment, software, or system capable of, or used or designed for, collecting, retaining, processing, or sharing audio, video, location, thermal, biometric, or similar information, that is operated by or at the direction of the department. </text></paragraph></subsection></section>
