in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit a covered athletic association and institution of higher education from prohibiting a student athlete from participating in intercollegiate athletics because such student athlete enters into an endorsement contract, and for other purposes.</official-title></form><legis-body id="H7F75F73C3F724ECABFED7F8369547E67" style="OLC"><section id="H5F1BFCD2D25F48D4A5E1ADF6255A7E5D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Student Athlete Level Playing Field Act</short-title></quote>.</text></section><section id="HAD5FF60BFD9F42AEA3A404E27CECDF39"><enum>2.</enum><header>Contracts relating to student athletes and college and university athletic programs</header><subsection id="HE209B9D96EA54F219D849888F84D590C"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Subject to the exceptions in subsection (b), a covered athletic organization or institution of higher education may not prohibit a student athlete from participating in intercollegiate athletics because such student athlete enters into an agency contract or an endorsement contract or otherwise receives consideration for such student athlete’s name, image, or likeness.</text></subsection><subsection id="H09BA7C99FDC649CEAAB923182A9ED3BA"><enum>(b)</enum><header>Exceptions for endorsement contracts</header><text display-inline="yes-display-inline">A covered athletic organization or institution of higher education may prohibit a student athlete from entering into an endorsement contract with the following categories of brands, companies, or types of contracts:</text><paragraph id="HB0372414C38C45908A1E218599EA2284"><enum>(1)</enum><text display-inline="yes-display-inline">A tobacco company or brand, including any vaping device or e-cigarette or related product.</text></paragraph><paragraph id="H892B45042FA644528005952192FE08F1"><enum>(2)</enum><text>Any alcohol company or brand.</text></paragraph><paragraph id="H579C8BEDBCDE4B8C84E6252E720D80CB"><enum>(3)</enum><text>Any seller or dispensary of a controlled substance, including marijuana.</text></paragraph><paragraph id="HF1ECB2DE9EE443378E6859140E2F629F"><enum>(4)</enum><text>Any adult entertainment business.</text></paragraph><paragraph id="H2DAE61421592423D9464E1743CC86D61" commented="no"><enum>(5)</enum><text>Any casino or entity whose primary business is sponsoring or promotion of gambling activities.</text></paragraph></subsection><subsection id="H8BB098453A0D42A7B6167FE0285D6CDE" commented="no"><enum>(c)</enum><header>Permissible prohibitions</header><text display-inline="yes-display-inline">A student athlete may be prohibited by the institution of higher education of the student athlete from wearing any item of clothing or gear with the insignia of any entity during any athletic competition or athletic-related university-sponsored event.</text></subsection><subsection id="H1A920F6D9E824CDC92117B04BCB5171B"><enum>(d)</enum><header>Resultant prohibitions on institutions of higher education from entering into certain sponsorship and endorsement contracts</header><paragraph id="HC2C21D70BAED482DB5CBF48AB90EF474"><enum>(1)</enum><header>From prohibitions on athletes</header><text display-inline="yes-display-inline">If a covered athletic organization or institution of higher education prohibits a student athlete from entering into an endorsement contract pursuant to subsection (b), such covered athletic organization or institution of higher education may not enter into or continue in any sponsorship or endorsement contract for itself with the same category or categories of brands, companies, or types of contracts described in paragraphs (1) through (5) of such subsection.</text></paragraph><paragraph id="HCFC78B36453047F4A1B061AAADDF9E63"><enum>(2)</enum><header>From prohibitions by a covered athletic organization</header><text display-inline="yes-display-inline">If a covered athletic organization prohibits a student athlete from entering into a contract pursuant to subsection (b), any institution of higher education that is a part of that covered athletic organization may not enter into any sponsorship or endorsement contract for itself with the same category or categories of brands, companies, or types of contracts described in paragraphs (1) through (5) of such subsection.</text></paragraph></subsection></section><section id="HEEF8627F9D744E0984828256D13534CB"><enum>3.</enum><header>Enforcement</header><subsection id="H62B238EBD79F4450BD6501FE2A3EE578"><enum>(a)</enum><header>Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of section 2 shall be treated as an unfair and deceptive act or practice in violation of a regulation under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></subsection><subsection id="H0EC84600AF154DB3B9D5F9294B7947DE"><enum>(b)</enum><header>Powers of the FTC</header><text display-inline="yes-display-inline">The Federal Trade Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41</external-xref> et seq.) were incorporated into and made part of this Act. Any person that violates this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41</external-xref> et seq.). Nothing in this Act shall be construed to limit the authority of the Federal Trade Commission under any other provision of law.</text></subsection></section><section id="HC0C5BE05B1B742F0A44FB433F8278910"><enum>4.</enum><header>Covered Athletic Organization Commission</header><subsection id="H203CC2B10CDB4A088698BE804D9F6087"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established the Covered Athletic Organization Commission (in this section referred to as the <quote>Commission</quote>), whose purpose shall be to—</text><paragraph id="H5D994B1B8254410CB2F82208C80BE68A"><enum>(1)</enum><text display-inline="yes-display-inline">make recommendations to Congress and to each covered athletic organization about the implementation of name, image, and likeness rules;</text></paragraph><paragraph id="H40474A621C684A79A0E19827B052B0DD" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">recommend to each covered athletic organization such a process to certify or recognize credentialed athlete agents;</text></paragraph><paragraph id="H3FA5E0BB030E4985BF69985288037B09"><enum>(3)</enum><text display-inline="yes-display-inline">make recommendations for the establishment of an independent dispute resolution process, for any dispute arising between a student athlete and a covered athletic organization or institution of higher education; and</text></paragraph><paragraph id="HF61B5EA60BC64DC1BF49EC36B2BB6BF3" commented="no"><enum>(4)</enum><text>make recommendations for additional categories of endorsement contracts that are excepted under section 2(b).</text></paragraph></subsection><subsection id="H6253FA07161048D69C7469BB34EEB5DD" commented="no"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The Commission shall consist of 13 members appointed in accordance with subsection (c) from among or in accordance with the following:</text><paragraph id="H8F0381889C774E859D935469B590232B" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Institutions of higher education, including athletic directors and coaches.</text></paragraph><paragraph id="HE4491B1ABC524096988F8BE094FC56CB" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">At least two individuals who are current or former student athletes who advocate for the interest of student athletes.</text></paragraph><paragraph id="H7DD133FB077C4F2AA0FF0F1337233C8F" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Administrators of covered athletic organizations.</text></paragraph><paragraph id="H1500AD9024114CEF9DD5100483B87FFE" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">Professionals with expertise in sports marketing, contracting, and public relations.</text></paragraph><paragraph id="H9CC18458F8C64CBEB8FA03AEBC0D00D8" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">Individuals—</text><subparagraph id="H61F214E6364F458CA0381D057ECCD0B9" commented="no"><enum>(A)</enum><text>with expertise in corporate governance; and</text></subparagraph><subparagraph id="HE9DE24AFE636427D8F2D763BF5B10863" commented="no"><enum>(B)</enum><text>who are not associated with any covered athletic association or institution of higher education.</text></subparagraph></paragraph></subsection><subsection id="HC44013FE24B04C8889AE70287E40BC0A"><enum>(c)</enum><header>Appointment</header><paragraph id="H208E7BD93A0241BE855F14874D01CC66"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, members of the Commission shall be appointed as follows:</text><subparagraph id="HFA2F982C831241C285E127D8C7FA96BA"><enum>(A)</enum><text display-inline="yes-display-inline">Three members appointed by the Speaker of the House of Representatives.</text></subparagraph><subparagraph id="HD0C83425B180414EBD8BDA50A12DBD88"><enum>(B)</enum><text display-inline="yes-display-inline">Three members appointed by the minority leader of the House of Representatives.</text></subparagraph><subparagraph id="H2A8031005E83498887769DA79426E46C"><enum>(C)</enum><text display-inline="yes-display-inline">Three members appointed by the majority leader of the Senate. </text></subparagraph><subparagraph id="H87A246AE27284E07B17B46E00AF863F2"><enum>(D)</enum><text display-inline="yes-display-inline">Three members appointed by the minority leader of the Senate.</text></subparagraph><subparagraph id="H619C66B06FDC44B6BD8CC568306FC4C7"><enum>(E)</enum><text display-inline="yes-display-inline">One member, who shall be the chair of the Commission, selected by the members appointed under subparagraphs (A) through (D) not later than 60 days after the appointment of such members, and agreed upon by no fewer than eight of such members. If eight such members are unable to agree on an appointment under this subparagraph within such 60 day period, the Speaker of the House of Representatives shall make the appointment under this subparagraph.</text></subparagraph></paragraph><paragraph id="H655166EF49154B3DB446E6D5CC2A8364"><enum>(2)</enum><header>Diversity</header><text>To the extent practicable, the Speaker and leaders making appointments under paragraph (1) shall coordinate their appointments to ensure that the Commission reflect diversity in gender, race, sport with which they are associated, as applicable, and shall prioritize the appointment of members unaffiliated with divisions or conferences of applicable covered athletic organizations.</text></paragraph></subsection><subsection id="H03A0EDCCBA644D7DAE076CB5DB8061AD"><enum>(d)</enum><header>Meetings and quorum</header><text display-inline="yes-display-inline">Meetings of the Commission shall be held at the call of the chair appointed under subsection (c)(1)(E). A meeting may only be held where there is a quorum of at least 7 members, including not fewer than two members who are current or former student athletes who advocate for the interest of student athletes.</text></subsection><subsection id="H1628DAE3A0EC488FB75AB5D95896EA56"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one, two, and three years, respectively, after the Commission shall be constituted, it shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate annual reports that include the recommendations in paragraphs (1) through (4) of subsection (a). The Commission shall also make such reports available to the public.</text></subsection><subsection id="H7451815E90E1474C98795A766E141DCB"><enum>(f)</enum><header>Sunset</header><text>The Commission shall terminate 60 days after submitting the final report required under subsection (e).</text></subsection></section><section id="H6FEAF44EA4424BBA803C81A394A9481E" commented="no"><enum>5.</enum><header>Institutions of higher education and student athletes who enter into endorsement contracts</header><text display-inline="no-display-inline">Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H0C7FE8C41EAA49A5AF46626C18CB6C26" display-inline="no-display-inline"><paragraph id="H7B87F1B7B0A44F708BDE11C69B686880" commented="no"><enum>(30)</enum><text display-inline="yes-display-inline">In the case of an institution that has a student attending the institution who is an athlete and has entered into an endorsement contract (as defined under section 2 of the Sports Agent Responsibility and Trust Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7801">15 U.S.C. 7801</external-xref>)) or an agency contract (as defined in section 9 of the <short-title>Student Athlete Level Playing Field Act</short-title>), such institution will not—</text><subparagraph id="H61FD9FA106DB4AD58880EEC1A9C62CEF" commented="no"><enum>(A)</enum><text>prohibit such student from entering into such an endorsement contract or an agency contract, including through a rule, standard, or policy that affects the eligibility of such student to receive athletically related student aid (as defined in section 485(e) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(e)</external-xref>)); or</text></subparagraph><subparagraph id="H4A14076FE567473088B2414C3A508587" commented="no"><enum>(B)</enum><text>compensate such student for the name, image, or likeness of such student.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H6F967C764ADE47BFB1B6DD02663329D9"><enum>6.</enum><header>Prohibiting unfair and deceptive practices against student athletes</header><subsection id="HBDEEA4F4399C4BF481BCBFA4591CBBE3"><enum>(a)</enum><header>Prohibiting unfair and deceptive practices by boosters</header><text display-inline="yes-display-inline">The Sports Agent Responsibility and Trust Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7801">15 U.S.C. 7801</external-xref> et seq.) is amended—</text><paragraph id="H8CA26ABCC12144C6A188D73A932E8F51"><enum>(1)</enum><text>in section 2—</text><subparagraph id="H0244D77A4276409999FEA15E2BD4E0E0"><enum>(A)</enum><text>by redesignating paragraphs (4) through (9) as paragraphs (5) through (10), respectively; and</text></subparagraph><subparagraph id="HF6919DE7DF514921A24F774004554962"><enum>(B)</enum><text>by inserting after paragraph (3) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7F7D1BED208644ABABD17C205D8B46F3"><paragraph id="H007B6BF8DF464124896C086D3E61DF5D"><enum>(4)</enum><header>Booster</header><text display-inline="yes-display-inline">The term <term>booster</term> means an individual (other than an individual who is related to a student athlete) or an organization, including a sponsor of an institution’s athletic program, that provides substantial financial assistance or services to the athletic program of an institution of higher education or that promotes a team or athletic program of an institution of higher education for such individual’s or organization’s own substantial financial interest.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H6CAEFC73DB5D45679D74F14973B72AEA"><enum>(2)</enum><text>by inserting after section 3 the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE57FD1169DCB4563B748CEEED365A457"><section id="H5FD312A39B3848FC8DDFFD49860F1722"><enum>3A.</enum><header>Regulation of unfair and deceptive acts and practices in connection with contact between a booster and a student athlete</header><text display-inline="no-display-inline">It is unlawful for a booster to directly or indirectly provide or offer to provide any funds or thing of value as an inducement for a student athlete to enroll or remain at a specific institution or group of institutions.</text></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H9CBA626CE76141B9BB8581544BFBE7FB"><enum>(3)</enum><text>in section 5(a)(1), by inserting <quote>or by the engagement of any booster in a practice that violates section 3A</quote> after <quote>section 3</quote>.</text></paragraph></subsection><subsection id="H5B524A4A51FF4209B5BFD137C35DCC63"><enum>(b)</enum><header>Eligibility To compete as a student athlete after entering into an agency contract</header><text display-inline="yes-display-inline">Section 3(b)(3) of the Sports Agent Responsibility and Trust Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7802">15 U.S.C. 7802(b)(3)</external-xref>) is amended in the quoted part by inserting after <quote>boldface type stating:</quote> the following: <quote><quote>Notice to Student Athlete: If you agree orally or in writing to be represented by an agent now or in the future, both you and the agent by whom you are agreeing to be represented must notify the athletic director of the educational institution at which you are enrolled, or other individual responsible for athletic programs at such educational institution, that you have entered into an agency contract. Such notification must be within 72 hours after entering into this contract or before the next athletic event in which you are eligible to participate, whichever occurs first.</quote></quote>. </text></subsection><subsection id="HC51B9A49967E431FBFE63DCE6B3EF96A"><enum>(c)</enum><header>Report on claims filed pursuant to the Sports Agent Responsibility and Trust Act</header><text display-inline="yes-display-inline">The Sports Agent Responsibility and Trust Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7801">15 U.S.C. 7801</external-xref> et seq.) is further amended by inserting after section 6 the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H793EA57038634CE0B0D6DCC014D4EE3B"><section id="HCDC1C753F6BC40B58D609BFDB1289BD1"><enum>6A.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 6 months after the date of enactment of this section, and annually thereafter, the Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report summarizing any investigation or enforcement action brought by the Commission pursuant to this Act, including the number of complaints filed with the Commission pursuant to this Act.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H111AFBED8A464A51A9A0E33515C68ED0"><enum>7.</enum><header>State preemption</header><text display-inline="no-display-inline">No State may enforce a State law or regulation with respect to permitting or abridging the ability of a student athlete attending an institution of higher education to enter into an endorsement contract or agency contract pursuant to this Act or by an amendment made by this Act.</text></section><section id="H30679AD6367F4E9391EC4A23113C019F"><enum>8.</enum><header>Rules of construction</header><subsection id="HE8B6E3280C51428A93D7B62BA569C5BD" display-inline="no-display-inline"><enum>(a)</enum><header>Tax provisions</header><text display-inline="yes-display-inline">Nothing in this Act or the amendments made by this Act shall affect the treatment of qualified scholarships under <external-xref legal-doc="usc" parsable-cite="usc/26/117">section 117</external-xref> of the Internal Revenue Code of 1986.</text></subsection><subsection id="H5208E027E87D413AB92B5392FC6064E5"><enum>(b)</enum><header>Nondiscrimination of student athletes</header><text display-inline="yes-display-inline">Nothing in this Act or the amendments made by this Act may be construed to affect the rights of student athletes or affect any program funded under title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681</external-xref> et seq.).</text></subsection><subsection id="H8EE4E6AFF2E74486BF87B7D9A31AF4B3"><enum>(c)</enum><header>Antitrust laws</header><text display-inline="yes-display-inline">Nothing in this Act or the amendments made by this Act shall provide a cause of action pursuant to the Sherman Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1">15 U.S.C. 1</external-xref> et seq.). </text></subsection><subsection id="H2A5219BD88554524BF7953893CFAC3C2"><enum>(d)</enum><header>Student athlete not considered an employee</header><text display-inline="yes-display-inline">Nothing in this Act or the amendments made by this Act shall affect the employment status of a student athlete who enters into an endorsement contract with respect to a covered athletic organization or institution of higher education.</text></subsection></section><section id="HC4BECF023B9D40208E90D6CE7CD5549D"><enum>9.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="HA6C1E2994DEC4641A8A4C99C9102A088"><enum>(1)</enum><text>institutions of higher education and covered athletic organizations should develop a course or program to assist student athletes with understanding financial literacy with respect to entering into an endorsement contract; and</text></paragraph><paragraph id="H5C57D6AB6F9E4FFEA5F8767BD0F014CA"><enum>(2)</enum><text display-inline="yes-display-inline">the Federal Trade Commission should investigate each claim filed pursuant to the Sports Agent Responsibility and Trust Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7801">15 U.S.C. 7801</external-xref> et seq.).</text></paragraph></section><section id="H72AA14D0071E4C6F9342F1F9B07D1CFA"><enum>10.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="HEE258C20D8044685A0EB292249BDD01E" commented="no"><enum>(1)</enum><text>the term <term>agency contract</term> means an oral or written agreement in which a student athlete authorizes a person to negotiate or solicit an endorsement contract on behalf of the student athlete;</text></paragraph><paragraph id="HF819AD417F6F424CB3E43E14EEBC0419"><enum>(2)</enum><text display-inline="yes-display-inline">the terms <term>athlete agent</term> and <term>student athlete</term> shall have the same meaning given such terms in section 2 of the Sports Agent Responsibility and Trust Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7801">15 U.S.C. 7801</external-xref>);</text></paragraph><paragraph id="HDA3604A116764C6AB675521D8DAC424C"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>covered athletic organization</term> means an athletic association, conference, or other organization with authority over intercollegiate athletics or that administers intercollegiate athletics;</text></paragraph><paragraph id="HD91281D472A8441987017C933E6C48FD"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>endorsement contract</term> has the meaning given such term in section 2 of the Sports Agent Responsibility and Trust Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7801">15 U.S.C. 7801</external-xref>);
