which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for special immigrant status for Syrian Kurds and other Syrians who partnered with the United States Government in Syria, and for other purposes.</official-title></form><legis-body id="H3D543CDA44844FA39E5A50402B6322CD" style="OLC"><section id="H8C1E94407ABC4E1FA6665FC09C41E504" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Syrian Partner Protection Act</short-title></quote>.</text></section><section id="HDA43C5F3020C49C1AB3D6D67D29F8927"><enum>2.</enum><header>Special immigrant status for certain Syrian Kurds and other Syrians who worked for the United States Government in Syria</header><subsection id="HCDDF0674B4544DF89C24B352709BCA7F"><enum>(a)</enum><header>In general</header><text>Subject to subsection (c)(1), and notwithstanding any other provision of law, for purposes of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.), the Secretary of Homeland Security may provide an alien described in subsection (b) with the status of a special immigrant under section 101(a)(27) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)</external-xref>) if—</text><paragraph id="H79F2C84F7D0F46C7B97138589FD62614"><enum>(1)</enum><text>the alien, or an agent acting on behalf of the alien, submits a petition to the Secretary under section 204 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154</external-xref>) for classification under section 203(b)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(4)</external-xref>);</text></paragraph><paragraph id="HE6D72E47F75F46FD8C07F313FB34B4A6"><enum>(2)</enum><text>the alien is otherwise eligible to receive an immigrant visa; and</text></paragraph><paragraph id="H7C7203B435164EF8AF306080E834A0E9"><enum>(3)</enum><text>the alien is otherwise admissible to the United States for permanent residence (excluding the grounds for inadmissibility specified in section 212(a)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(4)</external-xref>)).</text></paragraph></subsection><subsection id="H9F1A4A44F8644D6C8731EF8F1D2B410F"><enum>(b)</enum><header>Aliens described</header><paragraph id="HA630F2A7D5424588A414AB0977A174A0"><enum>(1)</enum><header>In general</header><text>An alien described in this subsection—</text><subparagraph id="H0800C696DEBE40A0A6C288A40663F2F1"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HC32094EA7F934FD9905F003E1908E0E1"><enum>(i)</enum><text>is a citizen or national of Syria or a stateless person who has habitually resided in Syria;</text></clause><clause id="HD0579C42739145EEA9393FC3425AB7D3" indent="up1"><enum>(ii)</enum><text>has partnered with, was employed by, or worked for or directly with the United States Government in Syria as an interpreter, translator, intelligence analyst, or in another sensitive and trusted capacity, on or after January 1, 2014, for an aggregate period of not less than 1 year; and</text></clause><clause id="HFD7F9C32457944719463FD12A522CB3C" indent="up1"><enum>(iii)</enum><text>provided service to the United States efforts against the Islamic State, which has been documented in a positive recommendation or evaluation; or</text></clause></subparagraph><subparagraph id="H8E4DC4CFDB484945813DF4622AAED611"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HA71C2803B9834C8A89BE87EAAEC99035"><enum>(i)</enum><text>is the spouse or child of a principal alien described in subparagraph (A); and</text></clause><clause id="H4917571C00FB4EDE9595D4E59BF7D216" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H949E5EC6DF2145B1B618E3FD7D21479C"><enum>(I)</enum><text>is following or accompanying to join the principal alien in the United States; or</text></subclause><subclause id="H88ACAB07EE90406BBA583864EA6ACEC7" indent="up1"><enum>(II)</enum><text>due to the death of the principal alien, a petition to follow or accompany to joint the principal alien in the United States—</text><item id="H786E32017B264DCEAD5889F6405C93DD"><enum>(aa)</enum><text>was revoked, terminated, or otherwise rendered null; and</text></item><item id="HF2B9304FEDF54937981980E449CD7ECF"><enum>(bb)</enum><text>would have been approved if the principal alien had survived.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="H3B81F3730B564628BF842F5066394A27"><enum>(2)</enum><header>Employment requirements</header><text>An application by a surviving spouse or a child of a principal alien shall be subject to the employment requirements set forth in paragraph (1)(A)—</text><subparagraph id="H17731BF4B34E4C219CCB3F206F89B898"><enum>(A)</enum><text>as of the date on which the principal alien first filed an application for special immigrant status; or</text></subparagraph><subparagraph id="H2A0CFE70957E4678B4CEFAFC900C96DC"><enum>(B)</enum><text>if no such application has been filed, the employment requirements as of the date on which the principal alien died.</text></subparagraph></paragraph></subsection><subsection id="H8F1E16BFFB8A4972853E204052A55E88"><enum>(c)</enum><header>Membership in certain Syrian organizations</header><text display-inline="yes-display-inline">An applicant for admission to the United States under this section may not be deemed inadmissible based on membership in, participation in, or support provided to, the Syrian Democratic Forces or other partner organizations as determined by the Secretary of Defense.</text></subsection><subsection id="H41494710EA7B4F188EF843B2CC0DEFF5"><enum>(d)</enum><header>Numerical limitations</header><paragraph id="H44DD44CB07964FA7B4BD5D1F55993304"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided under this subsection, the total number of principal aliens who may be provided special immigrant status under this section may not exceed 4,000 in any of the 5 fiscal years beginning after the date of the enactment of this Act.</text></paragraph><paragraph id="H754CC74D148F482A8D0D1D06D5DA4C06"><enum>(2)</enum><header>Exclusion from numerical limitations</header><text>Aliens provided special immigrant status under this section shall not be counted against any numerical limitation under section 201(d), 202(a), or 203(b)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(d)</external-xref>, 1152(a), and 1153(b)(4)).</text></paragraph><paragraph id="HE219A901D5E543C892B937FF7B6C0B1E"><enum>(3)</enum><header>Carry forward</header><text>If the numerical limitation set forth in paragraph (1) is not reached during a fiscal year, the numerical limitation under such paragraph for the following fiscal year shall be increased by a number equal to the difference between—</text><subparagraph id="H885B5FA9B3184D60AB05EEC2F2337884"><enum>(A)</enum><text>the number of visas authorized under paragraph (1) for such fiscal year; and</text></subparagraph><subparagraph id="H99F11A4EC39449EABF10A093A7DD7090"><enum>(B)</enum><text>the number of principal aliens provided special immigrant status under this section during such fiscal year.</text></subparagraph></paragraph></subsection><subsection id="H9C11FE8A47194E80A02CB0395A34E6F9"><enum>(e)</enum><header>Visa and passport issuance and fees</header><text>An alien described in subsection (b) may not be charged any fee in connection with an application for, or the issuance of, a special immigrant visa under this section. The Secretary of State shall ensure that aliens who are issued a special immigrant visa under this section are provided with an appropriate passport necessary for admission to the United States.</text></subsection><subsection id="HA8136BDEB5D640658296560FC91130C6"><enum>(f)</enum><header>Protection of aliens</header><text>The Secretary of State, in consultation with other relevant Federal agencies, shall provide an alien described in subsection (b) who is applying for a special immigrant visa with protection or the immediate removal from Syria or other nearby countries if the Secretary determines that such alien is in imminent danger.</text></subsection><subsection id="HEFE81685F6F74504A322676CBC2A5C9A"><enum>(g)</enum><header>Application process</header><paragraph id="H830FCA0CF63449AC96DCEA5D0BAF626B"><enum>(1)</enum><header>Representation</header><text>An alien applying for admission to the United States as a special immigrant under this section may be represented during the application process, including at relevant interviews and examinations, by an attorney or other accredited representative. Such representation shall not be at the expense of the United States Government.</text></paragraph><paragraph id="H62F36BA37B174DFCA45238A6F60831F3"><enum>(2)</enum><header>Completion</header><text>The Secretary of State and the Secretary of Homeland Security, in consultation with the Secretary of Defense, shall ensure that applications for special immigrant visas under this section are processed in such a manner to ensure that all steps under the control of the respective departments incidental to the issuance of such visas, including required screenings and background checks, are completed not later than 9 months after the date on which an eligible alien submits all required materials to apply for such visa.</text></paragraph><paragraph id="HAD00E82010EC4B5DA7BFE55625D0B360"><enum>(3)</enum><header>Rule of construction</header><text>Not­with­stand­ing paragraph (2), any Secretary referred to in paragraph (2) may take longer than 9 months to complete the steps incidental to issuing a visa under this section if the Secretary, or the designee of the Secretary—</text><subparagraph id="H07C2CD802F164DCC86F31224AD862F6D"><enum>(A)</enum><text>determines that the satisfaction of national security concerns requires additional time; and</text></subparagraph><subparagraph id="H08B81376712B42598068703F4A2712AC"><enum>(B)</enum><text>notifies the applicant of such determination.</text></subparagraph></paragraph><paragraph id="H1C2D56CD553C4255A2EEC7CDBFBD7F56"><enum>(4)</enum><header>Appeal</header><text>An alien whose petition for status as a special immigrant is rejected or revoked—</text><subparagraph id="H45B899337AF04FF1A6ADB840E205CF79"><enum>(A)</enum><text>shall receive a written decision that provides, to the maximum extent feasible, information describing the basis for the denial, including the facts and inferences underlying the individual determination; and</text></subparagraph><subparagraph id="H12A6C28642404FCDBC026C4E69781994"><enum>(B)</enum><text>shall be provided not more than 1 written appeal per rejection or denial, which—</text><clause id="HA374F7F7C7454E159D2F706C0509B5BF"><enum>(i)</enum><text>shall be submitted not more than 120 days after the date on which the applicant receives a decision pursuant to subparagraph (A);</text></clause><clause id="H6DBFC05F3E7B4A5CA68B776B340274AD"><enum>(ii)</enum><text>may request the reopening of such decision; and</text></clause><clause id="H66626A0A71A14D14AC22648C8E6C4C9F"><enum>(iii)</enum><text>shall provide additional information, clarify existing information, or explain any unfavorable information.</text></clause></subparagraph></paragraph></subsection><subsection id="H1C4430FC037249CCBCC7BA1A4BE26D53"><enum>(h)</enum><header>Eligibility for other immigrant classification</header><text>An alien may not be denied the opportunity to apply for admission under this section solely because such alien qualifies as an immediate relative of a national of the United States or is eligible for admission to the United States under any other immigrant classification.</text></subsection><subsection id="HEFB3E1FC214B4FC6B19514BBF63BE0A4"><enum>(i)</enum><header>Resettlement support</header><text>An alien who is granted special immigrant status under this section shall be eligible for the same resettlement assistance, entitlement programs, and other benefits as is available to refugees admitted under section 207 of the Immigration and Naturalization Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>).</text></subsection><subsection id="H69E3B97A9EAF4F06860BB5BD1AA7ED40"><enum>(j)</enum><header>Authority To carry out administrative measures</header><text>The Secretary of Homeland Security and the Secretary of State shall implement any additional administrative measures as they consider necessary and appropriate—</text><paragraph id="H245D8284E58A418DB98964397AF4F69B"><enum>(1)</enum><text>to ensure the prompt processing of applications under this section;</text></paragraph><paragraph id="H05847DE23ADF479D83E48BDEF0A89E5C"><enum>(2)</enum><text>to preserve the integrity of the program established under this section; and</text></paragraph><paragraph id="H3C594FBA64CB40F49CA37409BBA8306C"><enum>(3)</enum><text>to protect the national security interests of the United States related to such program.</text></paragraph></subsection><subsection id="HBC93C9B4536A4C9FB3987DFAD3076ADB"><enum>(k)</enum><header>Rulemaking</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Homeland Security shall promulgate regulations to carry out this section, including establishing requirements for background checks.</text></subsection></section><section id="HC90955969810443B9866F94EB3700167"><enum>3.</enum><header>Special immigrant status reporting requirement</header><subsection id="H30349D60D0F24E58A37B189CD8CBCB02"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Inspector General of the Department of State shall submit an annual report described in subsection (b), no later than January 30 of each year, with a classified annex if necessary, to—</text><paragraph id="H5A8FD26EE0AF4C2CAFF63C381EDC37A4"><enum>(1)</enum><text>the Committee on Judiciary, the Committee on Foreign Relations, and the Committee on Armed Services of the Senate; and</text></paragraph><paragraph id="H73C249810BC34724BB8F28493CF21D17"><enum>(2)</enum><text>the Committee on Judiciary, the Committee on Foreign Affairs, and the Committee on Armed Services of the House of Representatives.</text></paragraph></subsection><subsection id="HC4AFAB5E40944233AC1A292F8E19CE9D"><enum>(b)</enum><header>Contents</header><text>The report submitted under subsection (a) shall evaluate the implementation of the Syrian special immigrant status program under section 2, including, for the previous calendar year—</text><paragraph id="HC7352939F27D4226AD6C52C3E97DF7B5"><enum>(1)</enum><text>the number of petitions filed;</text></paragraph><paragraph id="HE55FFF7E35504D258FA4E3BF36B1C5B0"><enum>(2)</enum><text>the number of petitions—</text><subparagraph id="HC76B5D4B6D864C63B8EB85054E625C14"><enum>(A)</enum><text>pending adjudication;</text></subparagraph><subparagraph id="H6BB0675591BD43C3A4478C07F632AAB3"><enum>(B)</enum><text>pending visa interview; and</text></subparagraph><subparagraph id="H4DA374F290D241F58DA745D17DC35357"><enum>(C)</enum><text>pending security checks;</text></subparagraph></paragraph><paragraph id="H29D83DBEB549416D95524FAEB218616B"><enum>(3)</enum><text>the number of petitions that were denied;</text></paragraph><paragraph id="H7094498DF80849DD94F7951A105C78DA"><enum>(4)</enum><text>the number of cases that have exceeded the mandated processing time and relevant case numbers; and</text></paragraph><paragraph id="H5B206D661F3C4BD3A63C5D5A5BDA41A2"><enum>(5)</enum><text>an accounting of any obstacles discovered that would hinder effective implementation of the program.</text></paragraph></subsection><subsection id="H43447AC46EF0497382851EDAF2AEF9B8"><enum>(c)</enum><header>Consultation</header><text>In preparing the report under subsection (a), the Inspector General shall consult with—</text><paragraph id="H9B2FBAA8072041B39ECE1080A9863C7D"><enum>(1)</enum><text>the Department of State, Bureau of Consular Affairs, Visa Office;</text></paragraph><paragraph id="H5E4FC3C609FA492C811D44A733EECCD9"><enum>(2)</enum><text>the Department of State, Bureau of Near Eastern Affairs and South and Central Asian Affairs, Executive Office;</text></paragraph><paragraph id="H8ADA6F72B3C142BE90E022A660BC1D32"><enum>(3)</enum><text>the United States embassy in Kabul, Afghanistan, Consular Section;</text></paragraph><paragraph id="H32E75ACC28FD46E29F23DDD4F3BBF4B6"><enum>(4)</enum><text>the United States embassy in Baghdad, Iraq, Consular Section;</text></paragraph><paragraph id="HB34E1CD902B64ED68E727DFAC8CB92C8"><enum>(5)</enum><text>the Department of Homeland Security, U.S. Citizenship and Immigration Services;</text></paragraph><paragraph id="H44DE41E5813140D1BA72962A27A78D87"><enum>(6)</enum><text>the Department of Defense; and</text></paragraph><paragraph id="H5FD3F8C8504A45AA8BF2E7EB5CDD593D"><enum>(7)</enum><text>nongovernmental organizations providing legal aid in the special immigrant visa application process.</text></paragraph></subsection><subsection id="H1B954A4D63F04D858BD369B3D57C421F"><enum>(d)</enum><header>Publication</header><text>The non-classified portion of the report described in this section shall be published on the website of the Department of State.</text></subsection></section></legis-body></bill>
