<official-title display="yes">To protect minors from premature waiver of their constitutional rights during a custodial interrogation, and for other purposes.</official-title>

<section id="H8B8485A43770421DBB2B7C42ED28C114" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Miranda Rights for Kids Act</short-title></quote>.</text></section> <section id="HD144702B7F824B4F8257AE783EAA67AB"><enum>2.</enum><header>Waiver of Miranda rights by a minor</header> <subsection id="H73770CF385A145D8AA959E353B7FA623"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/223">Chapter 223</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/3051">section 3051</external-xref> the following:</text>

<section id="HADF00EAD765F466799D52B7F999DC64F"><enum>3501A.</enum><header>Custodial interrogation of a minor</header>
<subsection id="H80464FE06DBE42C1893D004E801DD083"><enum>(a)</enum><header>Notification</header><text display-inline="yes-display-inline">Any law enforcement officer who has arrested a minor for a violation of law shall notify the minor's parent, guardian, or legal custodian that the minor has been arrested and shall provide the location of where the minor is being detained.</text></subsection> <subsection id="H1F673DB1E67146D0BF0889DF9B8DF8FD"><enum>(b)</enum><header>Waiver</header><text>A minor who is subject to a custodial interrogation may only waive the privilege against self-incrimination or the right to assistance of legal counsel if the minor consults with legal counsel in person before such waiver.</text></subsection>
<subsection id="H25A8A611F1DE4183807D5CA674D8E5D4"><enum>(c)</enum><header>Exception</header><text>Subsection (a) shall not apply if—</text> <paragraph id="H3232DCCF062E42DD891698CC55EFC3F7"><enum>(1)</enum><text>custodial interrogation of a minor is necessary to gather information to protect life from an imminent threat; and</text></paragraph>
<paragraph id="H9A74A0D7F34E4B08A1D08EC891C16475"><enum>(2)</enum><text>the questions that were asked during the custodial interrogation were reasonably necessary to obtain such information.</text></paragraph></subsection> <subsection id="H687C06F483334A85A5741B2C4E29DED7"><enum>(d)</enum><header>Assigned counsel</header> <paragraph id="H965750EE24794701A7FDE221A67ABC09"><enum>(1)</enum><header>In general</header><text>A minor who is subject to a custodial interrogation shall have the right to have the legal counsel assigned to the minor’s case physically present during such interrogation.</text></paragraph>
<paragraph id="H6726C97E47AC401AB209FE68BFA4E036"><enum>(2)</enum><header>Violation</header><text>In the case of custodial interrogation of a minor, it shall be a violation of this subsection for the minor to be represented by any substitute counsel temporarily assigned to represent the minor.</text></paragraph></subsection> <subsection id="H6B6860E2C3184806B067B605500EA8B2"><enum>(e)</enum><header>Inadmissible</header><text display-inline="yes-display-inline">In any criminal prosecution brought by the United States, any statement given by a minor during a custodial interrogation that does not comply with this section, and any evidence derived from that statement, shall be inadmissible.</text></subsection>
<subsection id="H8C5C50A88FBA441FA8C13214FBB94570"><enum>(f)</enum><header>Minor defined</header><text>In this section, the term <quote>minor</quote> means an individual who has not attained 18 years of age.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H83350E3A372D4043892FB52369FBD08F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/223">chapter 223</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/3501">section 3501</external-xref> the following item:</text>
