<section id="HEB01E739319E479F9893F3994B4A8B4C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gun Rights And Marijuana Act</short-title></quote> or the <quote><short-title>GRAM Act</short-title></quote>.</text></section> <section id="H334333E16293417A886B46C3C290D461"><enum>2.</enum><header>Protection of Second Amendment rights of adults whose use of marijuana in accordance with State or tribal law</header><text display-inline="no-display-inline">Section 921(a) of title 18, United States Code, is amended by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="HD307680B1E154499AD3861731CAE67C7">
<paragraph id="HC2AA85DCE8F949A8A23B4EA295789A1C" indent="up1"><enum>(36)</enum><text display-inline="yes-display-inline">The term <term>unlawful user of or addicted to any controlled substance</term> shall not include a person by reason of unlawful use of or addiction to marihuana (as defined in section 102(16) of the Controlled Substances Act) if—</text> <subparagraph id="HB5FF6B3548DF4EF0965652D0673173A1"><enum>(A)</enum><text display-inline="yes-display-inline">the person resides in a State, or on lands under the jurisdiction of an Indian tribe (as defined in section 4 of the Indian-Self Determination and Education Assistance Act), the laws of which permit the use of marihuana by an adult; and</text></subparagraph>
<subparagraph id="H650F2B0594DD4AC2ABD32616DE2C3506"><enum>(B)</enum><text>the use of marihuana by the person in the State or on those lands, as the case may be, does not violate the laws of the State or Indian tribe, as the case may be.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body> </bill>
