R. 2823</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210422">April 22, 2021</action-date><action-desc><sponsor name-id="T000472">Mr. Takano</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HSY00">Science, Space, and Technology</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the consideration of energy storage systems by electric utilities as part of a supply side resource process, and for other purposes.</official-title></form><legis-body id="HFA5ECF81FD8A43FEA016962534135AC5" style="OLC"><section id="HF42B10EFBB9F434E8D60281E7BCE459F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Storage Technology for Operational Readiness And Generating Energy Act</short-title></quote> or the <quote><short-title>S.T.O.R.A.G.E. Act</short-title></quote>.</text></section><section id="H593A3B067E254B0C88D795248DC1C02D"><enum>2.</enum><header>Consideration of energy storage systems</header><subsection id="H8FBA963582D948F08E73901AF586C773"><enum>(a)</enum><header>In general</header><text>Section 111(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H40D80FF7164F41D9B5AAD314FF2BA261" style="OLC"><paragraph id="H67C919BBB1D942959B389E89B32A0955"><enum>(20)</enum><header>Consideration of energy storage systems</header><text>Each State shall consider requiring that, as part of a supply side resource planning process, an electric utility of the State demonstrate to the State that the electric utility considered an investment in energy storage systems based on appropriate factors, including—</text><subparagraph id="HD783ED75FD0D4F54913B68F520266DCD"><enum>(A)</enum><text>total costs and normalized life cycle costs;</text></subparagraph><subparagraph id="HE88CA001D7A9453EBB62A1764DAEFC52"><enum>(B)</enum><text>cost effectiveness;</text></subparagraph><subparagraph id="H72ABF3E8821D4F1F89B3E4CDB6500C2E"><enum>(C)</enum><text>improved reliability;</text></subparagraph><subparagraph id="H810371C24D604D89ACE9E2D94A77D2FD"><enum>(D)</enum><text>security; and</text></subparagraph><subparagraph id="H5CE1321A2D614BF8882F377A74103791"><enum>(E)</enum><text>system performance and efficiency.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7FFF87FB1D1845DF8961407FC7074EA8"><enum>(b)</enum><header>Time limitations</header><text>Section 112(b) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HD47CDB1A260B4419B6BB85C73181785B" style="OLC"><paragraph id="HFC40FEBC18274F0DB1829867DFE8B0CC"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H161B6B13ABBE4F53B1287FCB87AAF45E"><enum>(A)</enum><text>Not later than 1 year after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State regulatory authority has ratemaking authority) and each nonregulated electric utility shall commence the consideration referred to in section 111, or set a hearing date for consideration, with respect to the standard established by paragraph (20) of section 111(d).</text></subparagraph><subparagraph id="H71BB36922E7446E6A3DD6704D4A3BAFE" indent="up1"><enum>(B)</enum><text>Not later than 2 years after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State regulatory authority has ratemaking authority), and each nonregulated electric utility, shall complete the consideration, and shall make the determination, referred to in section 111 with respect to the standard established by paragraph (20) of section 111(d).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HBB24E462224449D28141A117BAC75373"><enum>(c)</enum><header>Failure To comply</header><text>Section 112(c) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(c)</external-xref>) is amended—</text><paragraph id="HADE75D5F905F46A8993C93704A3EE8C9"><enum>(1)</enum><text>by striking <quote>subsection (b)(2)</quote> and inserting <quote>subsection (b)</quote>; and</text></paragraph><paragraph id="HB10A18A033584A718752A5BEC6CE5F05"><enum>(2)</enum><text>by adding at the end the following: <quote>In the case of the standard established by paragraph (20) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph.</quote>.</text></paragraph></subsection><subsection id="H9D2D0AA17B0546D6A8DE20600F1FCBEC" commented="no"><enum>(d)</enum><header>Prior State actions</header><text display-inline="yes-display-inline">Section 112 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H82F03B59C5EC401C818CDA6A04E5CFEC" display-inline="no-display-inline"><subsection id="HD833A3F7CA144F15A1F64AF150E32270" commented="no"><enum>(g)</enum><header>Prior State actions</header><text display-inline="yes-display-inline">Subsections (b) and (c) of this section shall not apply to the standard established by paragraph (20) of section 111(d) in the case of any electric utility in a State if, before the enactment of this subsection—</text><paragraph id="H96C7312CB5ED469E99B4C63778B01D31" commented="no"><enum>(1)</enum><text>the State has implemented for such utility the standard concerned (or a comparable standard);</text></paragraph><paragraph id="HDB47F498FA924BCE811438174921AA9D" commented="no"><enum>(2)</enum><text>the State regulatory authority for such State or relevant nonregulated electric utility has conducted a proceeding to consider implementation of the standard concerned (or a comparable standard) for such utility; or</text></paragraph><paragraph id="H882DC378D2854B02A626949CFA0BE8E7" commented="no"><enum>(3)</enum><text>the State legislature has voted on the implementation of such standard (or a comparable standard) for such utility.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3F4A83E893F640A2BF7824101C35D229" commented="no"><enum>(e)</enum><header>Prior and pending proceedings</header><text display-inline="yes-display-inline">Section 124 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2634">16 U.S.C. 2634</external-xref>) is amended by adding at the end the following: <quote>In the case of the standard established by paragraph (20) of section 111(d), the reference contained in this section to the date of the enactment of this Act shall be deemed to be a reference to the date of enactment of such paragraph (20).</quote>.</text></subsection></section><section id="H6EEEB65BC781400787E84666F79A417E"><enum>3.</enum><header>Coordination of programs</header><text display-inline="no-display-inline">To the maximum extent practicable, the Secretary of Energy shall ensure that the funding and administration of the different offices within the Grid Modernization Initiative of the Department of Energy and other programs conducting energy storage research are coordinated and streamlined.</text></section></legis-body></bill>
