which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HSY00">Science, Space, and Technology</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Energy to carry out an energy storage research program, loan program, and technical assistance and grant program, and for other purposes.</official-title></form><legis-body id="H004B2689FD3C4F6AB6C88FA2C6610667" style="OLC"><section id="HCECC86C01B3445D9A8487078512A156B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Grid Storage Act of 2021</short-title></quote>.</text></section><section id="HBD35437C88DA4E2EA22F8194DED9F3E5"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H03EDB92E61734B34B67469287AB6162C"><enum>(1)</enum><header>Energy storage system</header><text>The term <term>energy storage system</term> means a system or strategy that improves the ability to shift the dispatch of energy in time, across multiple timescales.</text></paragraph><paragraph id="HF5628B09543B4491B35555AF524B53FD"><enum>(2)</enum><header>Islanding</header><text>The term <term>islanding</term> means a distributed generator or energy storage device continuing to power a location in the absence of electric power from the primary source.</text></paragraph><paragraph id="H0A805DD5F7C742768C6EECE9E6B77590"><enum>(3)</enum><header>Loan</header><text>The term <term>loan</term> has the meaning given the term <term>direct loan</term> in section 502 of the Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a</external-xref>).</text></paragraph><paragraph id="H7597CAFCC88846A1B8BCE35B76E08912"><enum>(4)</enum><header>Microgrid</header><text>The term <term>microgrid</term> means an integrated energy system consisting of interconnected loads and distributed energy resources, including generators and energy storage devices, within clearly defined electrical boundaries that—</text><subparagraph id="H355FAFA265214DBBB8F52BB46431D158"><enum>(A)</enum><text>acts as a single controllable entity with respect to the grid; and</text></subparagraph><subparagraph id="HF9E2D038A7D649F98399E9F69A4F6C6C"><enum>(B)</enum><text>can connect and disconnect from the grid to operate in both grid-connected mode and islanding mode.</text></subparagraph></paragraph><paragraph id="HA31EDDB3E70747E0B54AD28BD004D124"><enum>(5)</enum><header>Renewable energy source</header><text>The term <term>renewable energy source</term> includes—</text><subparagraph id="HB87A34AE11934C43BF51B048B4812E91"><enum>(A)</enum><text>biomass;</text></subparagraph><subparagraph id="HB519A1AF593D4B03B19660C96108046E"><enum>(B)</enum><text>geothermal energy;</text></subparagraph><subparagraph id="H4F9AC317FA4F44E7A48CB2DBE48DEDA7"><enum>(C)</enum><text>hydropower;</text></subparagraph><subparagraph id="HCBD70B5874D148258363741B4AF2603C"><enum>(D)</enum><text>landfill gas;</text></subparagraph><subparagraph id="H19BDCE8A38FC47FCBA2952CAFEC5DFFF"><enum>(E)</enum><text>municipal solid waste;</text></subparagraph><subparagraph id="HB7D9B50ACCA1444E8A7DE3CEBA16389C"><enum>(F)</enum><text>ocean (including tidal, wave, current, and thermal) energy;</text></subparagraph><subparagraph id="H04B391456B4F44AF98E449C6BA7A0880"><enum>(G)</enum><text>organic waste;</text></subparagraph><subparagraph id="H4C03205EF4FC4CD18A7D1FD7AF2F92EC"><enum>(H)</enum><text>photosynthetic processes;</text></subparagraph><subparagraph id="H4B981360D913463CA828DB7ADECA797C"><enum>(I)</enum><text>photovoltaic energy;</text></subparagraph><subparagraph id="H667F104752FB412BB841DF089EFA92F9"><enum>(J)</enum><text>solar energy; and</text></subparagraph><subparagraph id="H3BB3A63EDA934798A0D3989670C45BB6"><enum>(K)</enum><text>wind.</text></subparagraph></paragraph><paragraph id="HBF9ADAE98D8F43BEA23BF8025CDE50D6"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></section><section id="H59856884DA49484B9A1F916CA3F11900"><enum>3.</enum><header>Energy storage research program</header><subsection id="H129E54926A9049C48F80AFC124768BF5"><enum>(a)</enum><header>In general</header><text>The Secretary shall carry out, within the Office of Electricity, a program for the research of energy storage systems.</text></subsection><subsection id="H6A6C8666BB2B4D9F8872AE9F067CCAC8"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $50,000,000.</text></subsection></section><section id="H7FAC1085D7864649B6250DE6409DA5A6"><enum>4.</enum><header>Energy storage system demonstration and deployment loan program</header><subsection id="HA4DD1C03FF134563823FB506C90FAED7"><enum>(a)</enum><header>Loan program</header><paragraph id="HCF4EEAF8E6A64873AB1AE69E6547DD65"><enum>(1)</enum><header>In general</header><text>Subject to the provisions of this subsection and subsections (b) and (c), the Secretary shall carry out a program to provide to eligible entities—</text><subparagraph id="H7FC6E777FAFC41C1B6C56B0B2A7AEF42"><enum>(A)</enum><text>loans for the demonstration and deployment of energy storage systems in a specific project; and</text></subparagraph><subparagraph id="H0E07B3DD52FB4849A014924698BEAD62"><enum>(B)</enum><text>loans to provide funding for programs to finance the demonstration and deployment of multiple energy storage systems through a revolving loan fund, credit enhancement program, or other financial assistance program.</text></subparagraph></paragraph><paragraph id="HBC6BDEBC9E2044E493448C2EAB2F0CA6"><enum>(2)</enum><header>Eligibility</header><text>Entities eligible to receive a loan under paragraph (1) include—</text><subparagraph id="HA2BAF193EFBB47CFB373E0E336EC694F"><enum>(A)</enum><text>a State, territory, or possession of the United States;</text></subparagraph><subparagraph id="H4CB46A57974F45FBA49DEDBC5E0A1201"><enum>(B)</enum><text>a State energy office;</text></subparagraph><subparagraph id="H6E284E1C2E9D47ECB7E144C5AB7EBAC0"><enum>(C)</enum><text>a tribal organization (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>));</text></subparagraph><subparagraph id="HBCBFC206D149459693C74811EBB85CA9"><enum>(D)</enum><text>an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)); and</text></subparagraph><subparagraph id="HD960423D48684DDE850A337F44D7C7AF"><enum>(E)</enum><text>an electric utility, including—</text><clause id="HA95DE981562F44FE8E961F3126EA332D"><enum>(i)</enum><text>a rural electric cooperative;</text></clause><clause id="H8C5D04ED50C24C9DB72157F02833C172"><enum>(ii)</enum><text>a municipally owned electric utility; and</text></clause><clause id="H089E371A67104FB79BF6EE2935B6C98F"><enum>(iii)</enum><text>an investor-owned utility.</text></clause></subparagraph></paragraph><paragraph id="H2B62751CFD9F4D2B9C636D2BF07C074E"><enum>(3)</enum><header>Selection requirements</header><text>In selecting eligible entities to receive a loan under this section, the Secretary shall, to the maximum extent practicable, ensure—</text><subparagraph id="H8C65A212EB244355A01250CA3F43FE8E"><enum>(A)</enum><text>regional diversity among eligible entities that receive the loans, including participation by rural States and small States; and</text></subparagraph><subparagraph id="H25D099EDFFA24409A5A2FD09EB5B76C1"><enum>(B)</enum><text>that specific projects and programs selected for loans—</text><clause id="H6D09C267E09247078B91CFEE13B3F44F"><enum>(i)</enum><text>expand on the existing technology demonstration and deployment programs of the Department of Energy; and</text></clause><clause id="H3E22B22E3D0F484AA238FD6017EFA662"><enum>(ii)</enum><text>are designed to achieve 1 or more of the objectives described in paragraph (4).</text></clause></subparagraph></paragraph><paragraph id="HDD701D9B8AA644E294596C110BD5C024"><enum>(4)</enum><header>Objectives</header><text>Each demonstration and deployment project, and each program, selected for a loan under paragraph (1) shall include 1 or more of the following objectives:</text><subparagraph id="HA76CD03DEC53421EB9AFA44589D07320"><enum>(A)</enum><text>With respect to energy storage systems, the improvement of—</text><clause id="H144E033267A541F2B23EA760D70A2D9A"><enum>(i)</enum><text>the feasibility of microgrids or islanding; or</text></clause><clause id="HA23975CB8BEA4FDAAF905463B2C9E247"><enum>(ii)</enum><text>the transmission and distribution capability to improve reliability in rural areas, including high energy cost rural areas.</text></clause></subparagraph><subparagraph id="HD2EFD7F8AF7B4F2CA9777617C57A80A2"><enum>(B)</enum><text>Use of energy storage systems to improve the security of emergency response infrastructure.</text></subparagraph><subparagraph id="H5367F5846C35493F9C2D7B3235C217A5"><enum>(C)</enum><text>Integration of energy storage systems with a renewable energy source, at the source or away from the source.</text></subparagraph><subparagraph id="H8F92C58F846B4B5481965DE2FFE7BC90"><enum>(D)</enum><text>Use of energy storage systems to provide ancillary services for grid management.</text></subparagraph><subparagraph id="HA221115D51A441A98B3BB622AA19E584"><enum>(E)</enum><text>Advancement of power conversion systems to make the systems smarter, more efficient, able to communicate with other indenters, and able to control voltage.</text></subparagraph><subparagraph id="H6EA15C908C5A4C60910B5A8A034F9469"><enum>(F)</enum><text>Use of energy storage systems to optimize transmission and distribution operation and power quality to address overloaded lines and maintenance of transformers and substations.</text></subparagraph><subparagraph id="HD78E2A79BBEC4E668408FA4336568F42"><enum>(G)</enum><text>Use of energy storage systems for peak load management of homes, businesses, and the grid, particularly to offset investments in new grid capacity.</text></subparagraph><subparagraph id="HFA0BA7E526C94FA1BB429FB2E9A409DE"><enum>(H)</enum><text>Use of energy storage system devices to meet electricity demand during nonpeak generation periods to make better use of existing grid assets.</text></subparagraph></paragraph><paragraph id="H6B9E33669A19444CBF5C791045533A39"><enum>(5)</enum><header>Restriction on use of funds</header><text>Any eligible entity that receives a loan under paragraph (1) may only use the loan to fund projects for, and programs relating to, the demonstration and deployment of energy storage systems in households, businesses, and communities.</text></paragraph></subsection><subsection id="HD6B36DB8927947B4992C8ED6A4AB5664"><enum>(b)</enum><header>Loan terms and conditions</header><paragraph id="H0C3AD61112CD40CFBE153B963A0684A3"><enum>(1)</enum><header>Terms and conditions</header><text>Notwithstanding any other provision of law, in providing a loan under this section, the Secretary shall provide the loan on such terms and conditions as the Secretary determines, after consultation with the Secretary of the Treasury, in accordance with this section.</text></paragraph><paragraph id="H6BA28C69602E48588DEA6892AD854984"><enum>(2)</enum><header>Specific appropriation</header><text>No loan shall be made under this section unless an appropriation for the full amount of the loan has been specifically provided for that purpose.</text></paragraph><paragraph id="H127B588889D14189B25DF81F8E065A0B"><enum>(3)</enum><header>Repayment</header><text>No loan shall be made under this section unless the Secretary determines that there is reasonable prospect of repayment of the principal and interest by the borrower of the loan.</text></paragraph><paragraph id="HA39405D68E964E06979BA05A3EA4A0C0"><enum>(4)</enum><header>Interest rate</header><text>A loan provided under this section shall bear interest at a fixed rate that is equal or approximately equal, in the determination of the Secretary, to the interest rate for Treasury securities of comparable maturity.</text></paragraph><paragraph id="H8271610BB4C042359024A2271EC461F5"><enum>(5)</enum><header>Term</header><text>The term of a loan provided under this section shall require full repayment over a period not to exceed the lesser of—</text><subparagraph id="HF558A11EB7644AB089B5B1DD95A9B905"><enum>(A)</enum><text>20 years; or</text></subparagraph><subparagraph id="HA348581AD8294EA19B7C04405CA40E4B"><enum>(B)</enum><text>90 percent of the projected useful life of the physical asset to be financed by the loan (as determined by the Secretary).</text></subparagraph></paragraph><paragraph id="H13BF4507BE184FBCB71EAFA28545ADA2"><enum>(6)</enum><header>Use of payments</header><text>Payments of principal and interest on a loan provided under this section shall—</text><subparagraph id="H46BBC17773144826B0270EAE5C679600"><enum>(A)</enum><text>be retained by the Secretary to support energy research and development activities; and</text></subparagraph><subparagraph id="H9D3DE7C0A6DC4E1E8C612B10A5FA894D"><enum>(B)</enum><text>remain available until expended, subject to such conditions as are contained in annual appropriations Acts.</text></subparagraph></paragraph><paragraph id="H639E234B86E54AEE96BF7A3A4463C89A"><enum>(7)</enum><header>No penalty on early repayment</header><text>The Secretary may not assess any penalty for early repayment of a loan provided under this section.</text></paragraph><paragraph id="H0F3BB3A4111442AE89FD4CC1707E47EE"><enum>(8)</enum><header>Return of unused portion</header><text>In order to receive a loan under this section, an eligible entity shall agree to return to the general fund of the Treasury any portion of the loan amount that is unused by the eligible entity within a reasonable period of time after the date of the disbursement of the loan, as determined by the Secretary.</text></paragraph><paragraph id="H067EA967F2E1413F97D0283533B920C5"><enum>(9)</enum><header>Comparable wage rates</header><text>Each laborer and mechanic employed by a contractor or subcontractor in performance of construction work financed, in whole or in part, by a loan provided under this section shall be paid wages at rates not less than the rates prevailing on similar construction in the locality as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code.</text></paragraph></subsection><subsection id="H5FD704531470499D844557CEDD30343C"><enum>(c)</enum><header>Rules and procedures; disbursement of loans</header><paragraph id="H634F82DB0C504DD2B85A6E655E634770"><enum>(1)</enum><header>Rules and procedures</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall adopt rules and procedures for carrying out the loan program under subsection (a).</text></paragraph><paragraph id="HD3D91B95AC94457FA11F9D1B409D6A58"><enum>(2)</enum><header>Disbursement of loans</header><text>Not later than 1 year after the date on which the rules and procedures under paragraph (1) are adopted, the Secretary shall disburse the initial loans provided under this section.</text></paragraph></subsection><subsection id="H46C033EED5C4408885CD12AA3DCA7EEF"><enum>(d)</enum><header>Reports</header><text>Not later than 2 years after the date of receipt of the loan and annually thereafter for the term of the loan, an eligible entity that receives a loan under this section shall submit to the Secretary a report describing the performance of each program and activity carried out using the loan, including itemized loan performance data.</text></subsection><subsection id="HC23C635F5120492F979A7A3932DA0C61"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as are necessary.</text></subsection></section><section id="H18A2F0045CED4E61AF2FDC17D6E3FA34"><enum>5.</enum><header>Technical assistance and grant program</header><subsection id="H9F9A879A81D54B6DA9C5A1AC4274FE75"><enum>(a)</enum><header>Program</header><paragraph id="H3C104773FFF94E32B24DB77F7B8E1DAE"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Assistant Secretary, Office of Electricity, shall carry out a technical assistance and grant program (referred to in this section as the <quote>program</quote>)—</text><subparagraph id="HAB026D7EE31D419FB9FA8F0BFFEE6E26"><enum>(A)</enum><text>to disseminate information and provide technical assistance directly to eligible entities so the eligible entities can identify, evaluate, plan, and design energy storage systems; and</text></subparagraph><subparagraph id="HCA8995445CF542E7A62CBD22DA13AE52"><enum>(B)</enum><text>to make grants to eligible entities so that the eligible entities may contract to obtain technical assistance to identify, evaluate, plan, and design energy storage systems.</text></subparagraph></paragraph><paragraph id="HECE1556D9D5440429B6F0A2633C53AB4"><enum>(2)</enum><header>Technical assistance</header><text>The technical assistance described in paragraph (1) shall include assistance with 1 or more of the following activities relating to energy storage systems:</text><subparagraph id="H0DF8B04D27C943F095CDF1A847BAA8FC"><enum>(A)</enum><text>Identification of opportunities to use energy storage systems.</text></subparagraph><subparagraph id="H0D04699EA27A4BCDAB8FDA752DBF7FB4"><enum>(B)</enum><text>Assessment of technical and economic characteristics.</text></subparagraph><subparagraph id="H81D92D1E59424C11AAD1AB335D357F26"><enum>(C)</enum><text>Utility interconnection.</text></subparagraph><subparagraph id="H3F41933BBC47405EAFEB4EEB57F95E5B"><enum>(D)</enum><text>Permitting and siting issues.</text></subparagraph><subparagraph id="H7D153F56B367428582F21860EC7029F1"><enum>(E)</enum><text>Business planning and financial analysis.</text></subparagraph><subparagraph id="HE7E6F79273C94FD697086B26020B5B4E"><enum>(F)</enum><text>Engineering design.</text></subparagraph></paragraph><paragraph id="H06CD35B664B64832A145172275B6BAD5"><enum>(3)</enum><header>Information dissemination</header><text>The information disseminated under paragraph (1)(A) shall include—</text><subparagraph id="H9746DD057F714A5A80326BA0C687CDC2"><enum>(A)</enum><text>information relating to the topics described in paragraph (2), including case studies of successful examples;</text></subparagraph><subparagraph id="H05E6E7F1056D4BDF8459884C41283666"><enum>(B)</enum><text>computer software for assessment, design, and operation and maintenance of energy storage systems; and</text></subparagraph><subparagraph id="H7284ED61D7A34995B44E37E82CCFB2A0"><enum>(C)</enum><text>public databases that track the operation and deployment of existing and planned energy storage systems.</text></subparagraph></paragraph></subsection><subsection id="H14E84D31E9AF45C58FFC546753AB8BC2"><enum>(b)</enum><header>Eligibility</header><text>Any nonprofit or for-profit entity shall be eligible to receive technical assistance and grants under the program.</text></subsection><subsection id="HE076DF4E9278412A901452E68BB606B3"><enum>(c)</enum><header>Applications</header><paragraph id="H3323B05BEF4A4975BB55DFC35A563E1D"><enum>(1)</enum><header>In general</header><text>An eligible entity desiring technical assistance or grants under the program shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph id="HAC408477940246C8A6203A99C5E93B83"><enum>(2)</enum><header>Application process</header><text>The Secretary shall seek applications for technical assistance and grants under the program—</text><subparagraph id="H62FC9AD7BEE149FB85C1E2698D667B77"><enum>(A)</enum><text>on a competitive basis; and</text></subparagraph><subparagraph id="H5D1E8433E8DE4221A4FDA86F2472C388"><enum>(B)</enum><text>on a periodic basis, but not less frequently than once every 12 months.</text></subparagraph></paragraph><paragraph id="H6D5E52A4B467461AADB70B2E37EC1883"><enum>(3)</enum><header>Priorities</header><text>In selecting eligible entities for technical assistance and grants under the program, the Secretary shall give priority to eligible entities with projects that have the greatest potential for—</text><subparagraph id="HB7F039A25D784720A98C8E935E2D0B17"><enum>(A)</enum><text>facilitating the use of renewable energy sources;</text></subparagraph><subparagraph id="H9B630CFA98A242519C821B41258DB9E1"><enum>(B)</enum><text>strengthening the reliability and resiliency of energy infrastructure to the impact of extreme weather events, power grid failures, and interruptions in supply of fossil fuels;</text></subparagraph><subparagraph id="HA833F079F528406C9D27A5D180340B80"><enum>(C)</enum><text>improving the feasibility of microgrids or islanding, particularly in rural areas, including high energy cost rural areas;</text></subparagraph><subparagraph id="H7E6EDAA36D5F4BA0A52EBC78FE2E00E5"><enum>(D)</enum><text>minimizing environmental impact, including regulated air pollutants and greenhouse gas emissions; and</text></subparagraph><subparagraph id="HB9638D6005DB4F8298F2E57573E73254"><enum>(E)</enum><text>maximizing local job creation.</text></subparagraph></paragraph></subsection><subsection id="H1E2ACE7BBAEE43C79475C4F4CD23D2BC"><enum>(d)</enum><header>Grants</header><text>On application by an eligible entity, the Secretary may award grants under the program to the eligible entity to provide funds to cover not more than—</text><paragraph id="H2703C17574BF41469B27A50F11F910FD"><enum>(1)</enum><text>100 percent of the costs of the initial assessment to identify energy storage system opportunities;</text></paragraph><paragraph id="H2A9C5DB1B60C49368A95A465828C0467"><enum>(2)</enum><text>75 percent of the cost of feasibility studies to assess the potential for the implementation of energy storage systems;</text></paragraph><paragraph id="HC8E6B7DCE4AB47BCBBED92C4FBC75017"><enum>(3)</enum><text>60 percent of the cost of guidance on overcoming barriers to the implementation of energy storage systems, including financial, contracting, siting, and permitting issues; and</text></paragraph><paragraph id="HB847A8EB1E7C481AA62AA2EC6C5087CC"><enum>(4)</enum><text>45 percent of the cost of detailed engineering of energy storage systems.</text></paragraph></subsection><subsection id="H35CB3311B8914B7EB6EE9549C900A1F9"><enum>(e)</enum><header>Rules and procedures</header><paragraph id="H265F0255590B499E8EECAC34FB8DE7BB"><enum>(1)</enum><header>Rules</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall adopt rules and procedures for carrying out the program.</text></paragraph><paragraph id="H7D91EE498EA34559A71D9CEF94DE73BE"><enum>(2)</enum><header>Grants</header><text>Not later than 120 days after the date of issuance of the rules and procedures for the program, the Secretary shall issue grants under this section.</text></paragraph></subsection><subsection id="H85D34BD0F9C846B88AD90F4C2A26302C"><enum>(f)</enum><header>Reports</header><text>The Secretary shall submit to Congress and make available to the public—</text><paragraph id="H76F9A468DDFB40458D2606D99DA35DDF"><enum>(1)</enum><text>not less frequently than once every 2 years, a report describing the performance of the program under this section, including a synthesis and analysis of the information provided in the reports submitted to the Secretary under section 4(d); and</text></paragraph><paragraph id="H91FD8B8A67384B2194859B52A4E4AB18"><enum>(2)</enum><text>on termination of the program under this section, an assessment of the success of, and education provided by, the measures carried out by eligible entities under the program.</text></paragraph></subsection><subsection id="H9E02EFEC16004930BB98D6C7EB0E13C3"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $250,000,000 for the period of fiscal years 2022 through 2026, to remain available until expended.</text></subsection></section></legis-body></bill>
