<official-title display="yes">To provide for a coordinated Federal program to accelerate plastics waste reduction and support recycling research and development for the economic and national security of the United States, and for other purposes.</official-title>

<section id="H4FDDC6A5CE794912B2015FFE7F3EEAF1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Plastic Waste Reduction and Recycling Research Act</short-title></quote>. </text></section> <section id="H5DF07D0D9ED04B06A14D417F71F10C44"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text>
<paragraph id="H36E54E3F88784BDBAA2AAEEE4ABB3D9C"><enum>(1)</enum><text>It is estimated that global production of plastic has increased from 2,000,000 tons of plastic per year in 1950 to 400,000,000 tons per year today, and of the 8.3 billion metric tons of plastic ever produced globally, 6.3 billion metric tons has become plastic waste.</text></paragraph> <paragraph id="HD55AC8E7348341EEB5537159ECC0C641"><enum>(2)</enum><text>The United States has failed to invest in the development of domestic recycling markets, technology and materials to make the recycling process more available and efficient, and as a result, the United States recycles only 9 percent of its plastic waste.</text></paragraph>
<paragraph id="HB4C003C558314924947AF97498B04077"><enum>(3)</enum><text>For more than 2 decades, the United States and other developed nations sold and exported 106,000,000 metric tons of recyclable plastics to China, but in 2018 China issued a ban on contaminated United States plastics.</text></paragraph> <paragraph id="H11C4D5C9F6E641389C87A671B76E6E43"><enum>(4)</enum><text>Following the 2018 China ban, more and more United States communities are sending recyclable items to landfills or incinerators.</text></paragraph>
<paragraph id="H76EBDCE99C5C4A4C96B417E5EE5507F7"><enum>(5)</enum><text>As recycling programs have moved toward single-stream curbside recycling, more recyclable items are mixed with non-recyclable items, resulting in fewer potentially recyclable items actually being recycled and turned into new, valuable products.</text></paragraph> <paragraph id="HD8CC087704604240803BABAD02AD3730"><enum>(6)</enum><text>The resin identification coding system in use today has not been substantially updated since its creation in 1988.</text></paragraph>
<paragraph id="H10E603CBBBD84EF982A252170ADB027E"><enum>(7)</enum><text display-inline="yes-display-inline">Characterizing the type and recyclability of different types of plastics in use today requires updated standards.</text></paragraph> <paragraph id="HE47D22AC02E24914A106EAF86AEF5611"><enum>(8)</enum><text display-inline="yes-display-inline">Separating and processing the many different types of plastics as well as the heterogenous materials containing multiple layers of different plastic types commonly in use today will require new sorting and recycling technologies.</text></paragraph>
<paragraph id="HBEED3CD2B93F43A383F1F4972E869B94"><enum>(9)</enum><text>There are currently limited private or public investments in research and development to improve plastic waste reduction, recycling technologies, or other technologies and processes to reduce the amount and impact of plastic waste.</text></paragraph> <paragraph id="H2276022CCE314FB18C41B28B1CC6F0DF"><enum>(10)</enum><text>The Federal Government can play an important role in supporting research and development and facilitating standards, tools, and technologies needed across the different stages of the plastics production and recycling ecosystem.</text></paragraph></section>
<section id="HA09966149BE84FC298FA6FB96DB03009"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H2ED8275BFA7F4AA993D0CBBB71257916"><enum>(1)</enum><header>Committee</header><text>The term <term>Committee</term> means the Interagency Committee established or designated under section 5.</text></paragraph>
<paragraph id="H5F23D27A4E1749C3807BC87521D601DB"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Science and Technology Policy.</text></paragraph> <paragraph id="H4749D0490BA94F0D9157714987BB86EF"><enum>(3)</enum><header>Participating agencies</header><text>The term <term>participating agencies</term> means the agencies under section 5(c).</text></paragraph>
<paragraph id="HE5CFF76EA5EF44B1ACA7C7411AF3F005"><enum>(4)</enum><header>Program</header><text>The term <term>Program</term> means the Plastic Waste Reduction and Recycling Research Program established under section 4.</text></paragraph> <paragraph id="H42990EBCC1234A13A9FDD653314BA587"><enum>(5)</enum><header>Marine debris</header><text>The term <term>marine debris</term> has the meaning provided in the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1956">33 U.S.C. 1956</external-xref>).</text></paragraph></section>
<section id="H6AA530AB5B044524AF32BF3D6FD967DD"><enum>4.</enum><header>Plastic Waste Reduction and Recycling Research Program</header>
<subsection id="H821A79A351A949C7A8C626C9D1506D13"><enum>(a)</enum><header>Establishment; purposes</header><text>The Director, acting through the Committee and each of the participating agencies, shall establish and implement a program to be known as the <quote>Plastic Waste Reduction and Recycling Research Program</quote>. The purposes of the Program shall be to—</text> <paragraph id="HE375B73EFF0C401595570F9C1B469338"><enum>(1)</enum><text display-inline="yes-display-inline">improve the global competitiveness of the United States plastics recycling industry;</text></paragraph>
<paragraph id="HC706D4E328874267A86380C8330873DA"><enum>(2)</enum><text>ensure United States leadership in plastic waste reduction, reuse, and recycling research and innovation;</text></paragraph> <paragraph id="H79465BD63D914E1EB13D8E874975CE43"><enum>(3)</enum><text display-inline="yes-display-inline">support United States leadership in the development of national and international standards for sustainable plastics design and plastic recycling infrastructure, technologies and processes; and</text></paragraph>
<paragraph id="H94370872721647D59EFD379BEA2BED84"><enum>(4)</enum><text display-inline="yes-display-inline">mitigate any harmful effects of plastic waste and plastic waste recycling on the environment.</text></paragraph></subsection> <subsection id="HA8DEB26D588D4A95A9B1FDB46F3893FA"><enum>(b)</enum><header>Program activities</header><text>In carrying out the Program, the Director, acting through the Committee and each of the participating agencies, shall carry out activities that include the following:</text>
<paragraph id="H8E06CA72932A424F9D835CCF52426973"><enum>(1)</enum><text display-inline="yes-display-inline">Supporting research, development, and demonstration of plastics technologies optimized for recyclability, plastics recycling technologies, plastic reusability, bio-based plastics, biodegradable plastics, remediation, including bioremediation of plastic waste, recyclability and remediation of plastic-based textiles, and environmental impacts of plastic waste.</text></paragraph> <paragraph id="HBBB1395ADA0C47FDA1A4038A4CEEE48D"><enum>(2)</enum><text display-inline="yes-display-inline">Supporting and facilitating public-private partnerships to leverage knowledge and resources to accelerate research, development, and demonstration in plastic waste reduction, including plastics recycling, plastics reusability, plastic waste remediation and other areas consistent with the purposes of this Act.</text></paragraph>
<paragraph id="HD5002DDF71214C0F8CAAE54D6122E2D1"><enum>(3)</enum><text>Interagency planning and coordination of Federal research and development of plastic waste reduction and recycling technologies and plastic waste remediation.</text></paragraph> <paragraph id="H564C3A81A5A64BC2AC19852E46268C96"><enum>(4)</enum><text>Promoting research collaboration with international partners, as appropriate. </text></paragraph></subsection></section>
<section id="H06F230053E6F4A6C81DD5612F93F80D0"><enum>5.</enum><header>Coordination by Interagency Committee</header>
<subsection id="HF610BFEDB3F245E880D7F8D23EF0DF0B"><enum>(a)</enum><header>Interagency Committee</header><text>Not later than 180 days after the date of enactment of this Act, the Director, acting through the National Science and Technology Council, shall establish or designate an Interagency Committee to coordinate Federal programs and activities in support of plastic waste reduction and recycling and plastic waste remediation research and development under the Program.</text></subsection> <subsection id="H68AF6099469A42F299CE6F6050EEE9BA"><enum>(b)</enum><header>Co-Chairs</header><text>The Committee shall be co-chaired by the Director of the Office of Science and Technology Policy or designee and a representative from an agency participating in the Committee, as selected by the Director of the Office of Science and Technology Policy.</text></subsection>
<subsection id="H744CB38ED7E745E48F68D03A3639C02D"><enum>(c)</enum><header>Agency participation</header><text>The Committee shall include representatives from—</text> <paragraph id="H59BB791E4B62471DBE864477FF9FEEC9"><enum>(1)</enum><text>the National Institute of Standards and Technology;</text></paragraph>
<paragraph id="H76BAF32C106A4053908E4E4AB24ACDA4"><enum>(2)</enum><text>the National Science Foundation;</text></paragraph> <paragraph id="HC698BDC619924A2890325A49D0D95068"><enum>(3)</enum><text>the Department of Energy;</text></paragraph>
<paragraph id="HA2CCBEADFF4040BC8333789C9E5A4AC5"><enum>(4)</enum><text>the Environmental Protection Agency;</text></paragraph> <paragraph id="H1969C4BBA6B64486A8DAADCF7CB016AE"><enum>(5)</enum><text>the Department of Transportation;</text></paragraph>
<paragraph id="H9C2542D01578429EA03DD0A0A20AAE6B"><enum>(6)</enum><text>the National Oceanic and Atmospheric Administration;</text></paragraph> <paragraph id="H1D12DC515AC847748427C2FF56F864BB"><enum>(7)</enum><text>the Department of Agriculture; and </text></paragraph>
<paragraph id="H1222E75BC17C4E9A96A9183A8E25EDCE"><enum>(8)</enum><text>any other Federal agency as considered appropriate by the Director of the Office of Science and Technology Policy.</text></paragraph></subsection> <subsection id="HDAC1B02EA7544C819470CA304433C0F2"><enum>(d)</enum><header>Responsibilities</header><text>The Committee shall—</text>
<paragraph id="H93CF1848B88848228A796B73DEA6D62A"><enum>(1)</enum><text>provide for interagency coordination of Federal plastics reduction and recycling and plastic waste remediation research, development, and demonstration, standards development, and education and training activities and programs of Federal departments and agencies undertaken pursuant to the Program;</text></paragraph> <paragraph id="HAD3431CD47644D7CB1EF6FBF40AC0CA8"><enum>(2)</enum><text>develop definitions for the following terms to guide the activities of the Program—</text>
<subparagraph id="H5AD36E1F1E8346358E64F862FE6A1437"><enum>(A)</enum><text>recycle;</text></subparagraph> <subparagraph id="HBACC1C9ABDDE492592BCDD5C9FA14796"><enum>(B)</enum><text>recyclability;</text></subparagraph>
<subparagraph id="HA798410F88F64D008316C73C9CD90F6A"><enum>(C)</enum><text>remediation;</text></subparagraph> <subparagraph id="H758CC16781E54561AFC0F2C9E7C15C9E"><enum>(D)</enum><text>advanced recycling;</text></subparagraph>
<subparagraph id="HFB1141657B3D48468BE70234721BA7D0"><enum>(E)</enum><text>advanced plastics;</text></subparagraph> <subparagraph id="H1FAD2747BC624CA0BBF429CEAE067D95"><enum>(F)</enum><text>biobased plastics;</text></subparagraph>
<subparagraph id="HF09F25101EC749159E1EF48DDC99DB47"><enum>(G)</enum><text>biodegradable plastics;</text></subparagraph> <subparagraph id="H5DD949F0F37B4699A411031E58B00F6F"><enum>(H)</enum><text>microplastic;</text></subparagraph>
<subparagraph id="H089BECCDF1124776B3EAB9326E32F911"><enum>(I)</enum><text>nanoplastic; and</text></subparagraph> <subparagraph id="H141532D2D25C47B1BC3385A82CF41C51"><enum>(J)</enum><text>pyroplastic;</text></subparagraph></paragraph>
<paragraph id="HA8B2D285C7F244CB8681CB78F7E4BB86"><enum>(3)</enum><text>develop and update every 3 years a strategic plan, to be made publicly available, for plastic waste reduction and recycling and plastic waste remediation that—</text> <subparagraph id="H68E7698B5CD841CE83038A2367D8D0DE"><enum>(A)</enum><text>establishes goals, priorities, and metrics for guiding and evaluating the activities of the Program; and</text></subparagraph>
<subparagraph id="HBCCF4BF55B534F299C79D0EE4E7FEC97"><enum>(B)</enum><text>describes—</text> <clause id="HE138DFD2241B43B9A8677A737BA45CD0"><enum>(i)</enum><text>how the Program will determine and prioritize areas of plastic waste reduction and recycling and plastic waste remediation for Federal research investments;</text></clause>
<clause id="H9468E9EEC7EA4387876BBD5893A52AAC"><enum>(ii)</enum><text>the Program’s support for long-term funding for interdisciplinary plastic waste reduction and recycling research, development, demonstration, standards development, education, and public outreach activities;</text></clause> <clause id="H9739746820294BF08707ABDE1C215EE1"><enum>(iii)</enum><text>how Federal agencies participating in the Program will collaborate with industry and with local governments, as appropriate; and</text></clause>
<clause id="H288789A41AB349B0AD573C9B6BC6476C"><enum>(iv)</enum><text>how the program will help move the results of research out of the laboratory and into commercial or municipal application; and</text></clause></subparagraph> <subparagraph id="H6A6413FDAC414A069421E433FBBA005D"><enum>(C)</enum><text>with respect to the previous 3 years, provides a summary of—</text>
<clause id="H0F2177041FC94000AC2573AE2A75A13B"><enum>(i)</enum><text>federally funded plastic waste reduction and recycling and plastic waste remediation research, development, and demonstration;</text></clause> <clause id="H7D24A944A9E643BE8337128DFBB76611"><enum>(ii)</enum><text>the adoption of improved plastic waste reduction and recycling technologies by Federal, State, and local governments and private entities; and</text></clause>
<clause id="HE351003C496A478F9C2DF473CCA8433F"><enum>(iii)</enum><text>other related activities for the previous 3 years; and</text></clause></subparagraph></paragraph> <paragraph id="HAE3C4E137F3F4EB3B29759AC6BD0B752"><enum>(4)</enum><text>consider input from universities, State and local governments, scientific societies, and public, private and nonprofit plastic recycling manufacturers and organizations in the development of the goals, priorities and metrics required under paragraph (3)(A).</text></paragraph></subsection>
<subsection id="H57D3D49B59CF476C9E88256A4BA4FE3A"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">The Interagency Committee shall terminate 10 years after the date on which the Committee is established under subsection (a).</text></subsection></section> <section id="H99490CB128B748BEAD37EFA6064001B4"><enum>6.</enum><header>National Institute of Standards and Technology</header><text display-inline="no-display-inline">As part of the Program, the Director of National Institute of Standards and Technology shall—</text>
<paragraph id="HCCA2615B38D84661A6600598BBC33DCB"><enum>(1)</enum><text display-inline="yes-display-inline">establish a science program for characterization of plastic properties before, during, and after recycling and manufacturing, development of classification systems, and creation of new data tools, techniques, and processes to advance plastics engineering and post-consumer plastic recycling and manufacturing;</text></paragraph> <paragraph id="HC937D190CF8B4085B27D77E245DB3741"><enum>(2)</enum><text display-inline="yes-display-inline">develop innovations for effective and efficient measures for processing plastics, including films and textiles, collected for recycling, while considering existing waste streams and future new materials;</text></paragraph>
<paragraph id="H82D5B20CC61C433EB6BAA52AF9E9D5A8"><enum>(3)</enum><text display-inline="yes-display-inline">provide the metrology basis for standards development for plastic sorting infrastructure, processing technologies, classification systems, including for biobased plastics, and recycling by design;</text></paragraph> <paragraph id="H115AC6792F704028B0B59B04E32C1E06"><enum>(4)</enum><text>develop a clearinghouse to collect and support dissemination of tools, guidelines and standards developed under this section;</text></paragraph>
<paragraph id="HAA6FDC5EF6B44A4F8A8161C0A1628776"><enum>(5)</enum><text>consult with appropriate stakeholder groups to promote adoption and implementation of such guidelines and standards, including diverse manufacturing and industry groups, such as packaging, including food packaging, agriculture, transportation, textile and fashion; </text></paragraph> <paragraph id="H70DACDCC6C9E40A4827D97CFAE66D2EC"><enum>(6)</enum><text>support plastics recycling research collaboration and coordinate standards development, as appropriate, with other agencies, State and local governments, nonprofit organizations, academia, private sector, and international partners; and</text></paragraph>
<paragraph id="H7368A1846F654F8D96F6B4DDBDFC5A1D"><enum>(7)</enum><text display-inline="yes-display-inline">establish a program for measurements, methods and standards to assess the environmental impacts of plastics waste, including marine debris, and plastic particles and fibers.</text></paragraph></section> <section id="H2BB30F656D0C4E9C89134F2EAF1F0310"><enum>7.</enum><header>National Science Foundation</header><text display-inline="no-display-inline">As part of the Program, the National Science Foundation shall—</text>
<paragraph id="H7E8B6E6A20DB4B46835D07E2E955F78D"><enum>(1)</enum><text>support multidisciplinary basic research on advanced plastics that are designed for recyclability or biodegradation, on plastic waste remediation, on improving recycling technologies for different plastics, and on composting and compostable plastics, and on plastic waste valorization;</text></paragraph> <paragraph id="H64E598A3404B46CB883A6717CA7F0076"><enum>(2)</enum><text>support multidisciplinary research on the environmental and biological effects of plastic waste, and particularly the formation, transport and bioaccumulation of nano- and micro-plastics relevant to plastics recycling and plastic waste remediation;</text></paragraph>
<paragraph id="HFA30E1C8817F4240A6D426CAF2FDECFC"><enum>(3)</enum><text display-inline="yes-display-inline">support research on social, behavioral, and economic barriers to the plastic recycling system and development, adoption, and expansion of plastic recycling;</text></paragraph> <paragraph id="H615942C4BF61449EB150407E8A12CBA8"><enum>(4)</enum><text>support, as appropriate, development of interdisciplinary undergraduate and graduate curriculum and instructional materials relevant to plastics recycling and plastic waste remediation;</text></paragraph>
<paragraph id="H97AA6057A4084569872ADBF0C175B339"><enum>(5)</enum><text>support research experiences for undergraduate students relevant to plastics recycling and plastic waste remediation; and</text></paragraph> <paragraph id="HB4F38B69E78B4245AA14522155B14351"><enum>(6)</enum><text>support plastics recycling research collaborations, as appropriate, with other agencies, State and local governments, nonprofit organizations, academia, private sector, and international partners.</text></paragraph></section>
<section id="HE5FA73B34549456C8CE26AE405CC7F48"><enum>8.</enum><header>Department of Energy</header><text display-inline="no-display-inline">As part of the Program, the Secretary of Energy shall—</text> <paragraph id="HE7C0250BAD8246E2949D2337ADD42386"><enum>(1)</enum><text>support integrated research, development, and demonstration of—</text>
<subparagraph id="H8605D738A67F4DF2B848D05A41552BF7"><enum>(A)</enum><text>chemical and bio-inspired plastic recycling, including research on the potential environmental impact of chemical recycling technologies; </text></subparagraph> <subparagraph id="H8171C264972F4E729282465C79923AF0"><enum>(B)</enum><text>advanced plastic synthesis;</text></subparagraph>
<subparagraph id="H2569DF6AE3054CCDAC0B8427A389412E"><enum>(C)</enum><text>plastic waste remediation;</text></subparagraph> <subparagraph id="HACA15A4E0C9940AC822D52D778BD6891"><enum>(D)</enum><text>recyclability-by-design;</text></subparagraph>
<subparagraph id="H849DE021752D4ADB82CADD5C517C9D53"><enum>(E)</enum><text>systems-level strategies for improved plastics separation and recovery; and</text></subparagraph> <subparagraph id="H919E8B21F8BE4D7C9155DB2D637EB425"><enum>(F)</enum><text>upcycling of recycled plastics into new high-value plastics, including for food-grade packaging and advanced manufacturing applications;</text></subparagraph></paragraph>
<paragraph id="H42FD612672464C3DAFF6CDB6C1FC90DB"><enum>(2)</enum><text>coordinate research efforts funded through existing programs across the Department of Energy, including the National Laboratories and relevant Manufacturing USA Institutes under section 34 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s</external-xref>); and</text></paragraph> <paragraph id="H2D050EA4AD43466388B9090265ABEE8B"><enum>(3)</enum><text display-inline="yes-display-inline">support plastics recycling research collaborations, as appropriate, with other agencies, State and local governments, nonprofit organizations, academia, private sector, and international partners.</text></paragraph></section>
<section id="HB27A85A0C11042FE86A944877F62BD6A"><enum>9.</enum><header>Environmental Protection Agency</header><text display-inline="no-display-inline">As part of the Program, the Administrator of the Environmental Protection Agency shall—</text> <paragraph id="H917BE98A5590491E85983A20D5BBD5BC"><enum>(1)</enum><text display-inline="yes-display-inline">conduct and support research, development, and demonstration of innovative plastic waste management solutions, including reduction, reuse, recycling, recovery, composting infrastructure for bio-based plastics, composting infrastructure for separation and removal of contamination from plastic waste, and prevention of plastics, including microplastics, nanoplastics, and pyroplastics, from entering the air, soil, oceans, and waterways;</text></paragraph>
<paragraph id="HA144F47854C146EDB241DD4DAB252927"><enum>(2)</enum><text display-inline="yes-display-inline">support and conduct research and analysis on the public health impacts of airborne and waterborne microplastics, nanoplastics, and pyroplastics, including research on routes of exposure, estimates of exposure in different populations, and toxicity assessments on animal and aquatic health, including the food chain; and</text></paragraph> <paragraph id="HB77DC76DD8564300A25F6A604831B709"><enum>(3)</enum><text>support plastics recycling research collaborations, as appropriate, with other agencies, State and local governments, nonprofit organizations, academia, private sector, and international partners.</text></paragraph></section>
<section id="HB574813010C844D1996A58CA20F75246"><enum>10.</enum><header>National Oceanic and Atmospheric Administration</header><text display-inline="no-display-inline">As part of the Program, the Administrator of the National Oceanic and Atmospheric Administration shall—</text> <paragraph id="H1853D16149074BD2970A3535C36CFE90"><enum>(1)</enum><text>conduct and support research, data collection, and analysis of plastic marine debris and ocean plastic pollution generation and sources, including microplastics, nanoplastics, and pyroplastics;</text></paragraph>
