R. 2816</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210422">April 22, 2021</action-date><action-desc><sponsor name-id="S001216">Ms. Schrier</sponsor> (for herself, <cosponsor name-id="S001148">Mr. Simpson</cosponsor>, <cosponsor name-id="K000381">Mr. Kilmer</cosponsor>, <cosponsor name-id="N000191">Mr. Neguse</cosponsor>, and <cosponsor name-id="N000147">Ms. Norton</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the Forest Service Legacy Roads and Trails Remediation Program.</official-title></form><legis-body id="HD3729696AFF14A37AD1B338BE25A059A" style="OLC"><section id="H15D58C9BF88A47A5953E1053B0BFB0AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Legacy Roads and Trails Act</short-title></quote>. </text></section><section id="HBE0F211C72714C00A07A03E75F959F5D"><enum>2.</enum><header>Forest Service Legacy Roads and Trails Remediation Program</header><text display-inline="no-display-inline">Public Law 88–657 (<external-xref legal-doc="usc" parsable-cite="usc/16/532">16 U.S.C. 532</external-xref> et seq.) (commonly known as the <quote>Forest Roads and Trails Act</quote>) is amended by adding at the end the following:</text><quoted-block id="HDE9E1CEC20FF487CB356C7C10824A451" style="OLC"><section id="H21BF565A0C794A76A58C993FD9AF29BB"><enum>8.</enum><header>Forest Service Legacy Roads and Trails Remediation Program</header><subsection id="H366CAB00E93B481F8013EF969C1E3B54"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish the Forest Service Legacy Roads and Trails Remediation Program (referred to in this section as <quote>the Program</quote>).</text></subsection><subsection id="H1DD95993321D45AF8D9DF628EFDE7730"><enum>(b)</enum><header>Administration</header><text>The Program shall be administered by the Secretary, acting through the Chief of the Forest Service.</text></subsection><subsection id="H0CB38B17F9A54AF9BE7E51EF1A5132F4"><enum>(c)</enum><header>Activities</header><text display-inline="yes-display-inline">In carrying out the Program, the Secretary shall, taking into account predicted changes in weather and hydrology related to global climate change—</text><paragraph id="H66B5D6350FD14FF4809B62B8CD167CB4"><enum>(1)</enum><text>carry out storm damage risk reduction, including deferred maintenance, repairs, road and trail relocation, and associated activities on National Forest System roads, National Forest System trails, and tunnels and bridges under the jurisdiction of the Forest Service;</text></paragraph><paragraph id="H5C0EB34AC1D142BF9E49A3D3141CAC13"><enum>(2)</enum><text>restore waterways and natural migration for fish and other aquatic species by removing, repairing, or replacing culverts or other infrastructure from such waterways; and</text></paragraph><paragraph id="HF1A8827A77364CB0B4009550913929AB"><enum>(3)</enum><text>decommission National Forest System roads and unauthorized roads and trails under National Forest System jurisdiction in accordance with subsections (f) and (g).</text></paragraph></subsection><subsection id="H0481003FBB114451B69FA822B77137B9"><enum>(d)</enum><header>Priority</header><text>In implementing the Program, the Secretary shall give priority to projects that protect or restore—</text><paragraph id="H5F2878C4EE8140AE94D44A6395504672"><enum>(1)</enum><text>water quality and watershed function;</text></paragraph><paragraph id="H7FA76C18B6254CBEBAF2E427EE85A320"><enum>(2)</enum><text>a watershed that supplies a public drinking water system;</text></paragraph><paragraph id="H6768D48F4439455C9DFC36161E653DF4"><enum>(3)</enum><text>the habitat of a threatened, endangered, or sensitive fish or wildlife species, or species of conservation concern; or</text></paragraph><paragraph id="H440AC1E0F08748F7BFC6D6CD3A584D7E"><enum>(4)</enum><text>a watershed for which the Secretary has completed a watershed protection and restoration action plan pursuant to section 304 of the Healthy Forests Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6543">16 U.S.C. 6543</external-xref>).</text></paragraph></subsection><subsection id="H8ECAE80C5C2E4E899A48F5D0B75C3198"><enum>(e)</enum><header>National forest system</header><text display-inline="yes-display-inline">Except with respect to a project carried out on a watershed for which the Secretary has a cooperative agreement under section 323 of the Department of the Interior and Related Agencies Appropriations Act, 1999 (<external-xref legal-doc="usc" parsable-cite="usc/16/1011a">16 U.S.C. 1011a</external-xref>), each project carried out under this section shall be on a National Forest System road, National Forest System trail, or unauthorized roads and trails under National Forest System jurisdiction.</text></subsection><subsection id="H20FADB15FD39467DB943A69BA78C82CA"><enum>(f)</enum><header>Identification of minimum road systems</header><text>Not later than 4 years after the date of the enactment of this section, the Secretary shall identify at the scale of a National Forest System unit or greater, the minimum road system and unneeded roads in accordance with section 212.5(b) of title 36, Code of Federal Regulations (as in effect on the date of enactment of this section).</text></subsection><subsection id="H35C6852DCC924EF881308EC58B3273FB"><enum>(g)</enum><header>Unneeded National Forest System roads</header><text display-inline="yes-display-inline">As soon as practicable after identifying a road as unneeded under subsection (f), the Secretary shall—</text><paragraph id="H3194621925C34F4CA6A05C8A498BA54D"><enum>(1)</enum><text>decommission such road; or</text></paragraph><paragraph id="HB5D7AD9465FD4E8DBE7A12EBA57E0C10"><enum>(2)</enum><text>convert such road to a system trail.</text></paragraph></subsection><subsection id="H65505FEC30FF4BFCBF6C733B7298D57F"><enum>(h)</enum><header>Review; revision</header><text display-inline="yes-display-inline">The Secretary shall review, and may revise, an identification made under subsection (f) in accordance with part 212, subpart A of title 36 Code of Federal Regulations (as in effect on the date of enactment of this section).</text></subsection><subsection id="H857A7E3A0BBD48BDA83EEA3479C1A544"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $100,000,000 for each of fiscal years 2020 through 2030.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
