which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ensure that certain Federal infrastructure programs require the use of materials produced in the United States, and for other purposes.</official-title></form><legis-body id="HE2640B916BAB4DCA849522E38300A1D5" style="OLC"><section section-type="section-one" id="H71CCB0A020C04D349D471DD7C14F41A0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Build America, Buy America Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HF546ADAC2A4D4401B64005A9C9639AC0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HFBAD52672BDF4FBDB52A19CCD0AE14F1"><enum>(1)</enum><text>the United States must make significant investments to install, upgrade, or replace the public works infrastructure of the United States;</text></paragraph><paragraph id="HC9EA776CCB6D42F7B0F7B7EBA5A66D1A"><enum>(2)</enum><text>with respect to investments in the infrastructure of the United States, taxpayers expect that their public works infrastructure will be produced in the United States by American workers;</text></paragraph><paragraph id="H143E958A1C3D4D7D994460150CFCA519"><enum>(3)</enum><text>United States taxpayer dollars invested in public infrastructure should not be used to reward companies that have moved their operations, investment dollars, and jobs to foreign countries or foreign factories, particularly those that do not share or openly flout the commitments of the United States to environmental, worker, and workplace safety protections;</text></paragraph><paragraph id="H056CA7A1D3204576947B95841E68EE29"><enum>(4)</enum><text>in procuring materials for public works projects, entities using taxpayer-financed Federal assistance should give a commonsense procurement preference for the materials and products produced by companies and workers in the United States in accordance with the high ideals embodied in the environmental, worker, workplace safety, and other regulatory requirements of the United States;</text></paragraph><paragraph id="HD9444647EF1A4528BD9F35A5D86E85EE"><enum>(5)</enum><text>the benefits of domestic content preferences extend beyond economics;</text></paragraph><paragraph id="H829B319D22CD4D2DB8A98DD999D80D3A"><enum>(6)</enum><text>by incentivizing domestic manufacturing, domestic content preferences reinvest tax dollars in companies and processes using the highest labor and environmental standards in the world;</text></paragraph><paragraph id="HCC79CC21343741D2926A702987358B16"><enum>(7)</enum><text>strong domestic content preference policies act to prevent shifts in production to countries that rely on production practices that are significantly less energy efficient and far more polluting than those in the United States;</text></paragraph><paragraph id="HD83CAC1AE5CD4FC5845198EE98F97DE9"><enum>(8)</enum><text>for over 75 years, Buy America and other domestic preference laws have been part of the United States procurement policy, ensuring that the United States can build and rebuild the infrastructure of the United States with high-quality American-made materials;</text></paragraph><paragraph id="H43B485957E9D4ECF900AF714D0B3BA73"><enum>(9)</enum><text>Buy America laws create demand for domestically produced goods, helping to sustain and grow domestic manufacturing and the millions of jobs domestic manufacturing supports throughout product supply chains;</text></paragraph><paragraph id="HA072D3B1CA2F4246B0FAE044A858B6E5"><enum>(10)</enum><text>as of the date of enactment of this Act, domestic procurement preference policies apply to all Federal Government procurement and to various Federal-aid infrastructure programs;</text></paragraph><paragraph id="H27A32432A5E34A959F6180F310EBDAAF"><enum>(11)</enum><text>a robust domestic manufacturing sector is a vital component of the national security of the United States;</text></paragraph><paragraph id="HC9AF2A2639C449C8B46483FFCAB17E88"><enum>(12)</enum><text>as more manufacturing operations of the United States have moved offshore, the strength and readiness of the defense industrial base of the United States has been diminished; and</text></paragraph><paragraph id="H608175FBF57744698D06BD4D85F8274D"><enum>(13)</enum><text>domestic procurement preference laws—</text><subparagraph id="H9E891B1099994A109CD72065473E132D"><enum>(A)</enum><text>are fully consistent with the international obligations of the United States; and</text></subparagraph><subparagraph id="H61378362C7084963A163A4939BA32B33"><enum>(B)</enum><text>together with the government procurements to which the laws apply, are important levers for ensuring that United States manufacturers can access the government procurement markets of the trading partners of the United States.</text></subparagraph></paragraph></section><section id="HAD4C9B03F2E04ADD95A919EB641ADF44"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H5B30637A0F0F45E7B5B64192770A23C1"><enum>(1)</enum><header>Deficient program</header><text>The term <term>deficient program</term> means a program identified by the head of a Federal agency under section 4(c).</text></paragraph><paragraph id="H262543BE027B440B9D87FD5A9599C230"><enum>(2)</enum><header>Domestic content procurement preference</header><text>The term <term>domestic content procurement preference</term> means a requirement that no amounts made available through a program for Federal financial assistance may be obligated for a project unless—</text><subparagraph id="H28726594C1804E38BAE00A2F049E59D6"><enum>(A)</enum><text>all iron and steel used in the project are produced in the United States; or</text></subparagraph><subparagraph id="H6072620D0323443EB25862F079E98A06"><enum>(B)</enum><text>the manufactured products used in the project are produced in the United States.</text></subparagraph></paragraph><paragraph commented="no" id="HCF767C9FB68E45879A292FA17A985912"><enum>(3)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> has the meaning given the term <term>agency</term> in section 552(f) of title 5, United States Code.</text></paragraph><paragraph id="H170EC3C421DD4084B5FC4CCD35B1E8C2"><enum>(4)</enum><header>Federal financial assistance</header><subparagraph id="H5D13C83C7CAE43B4BD17E33941EF995C"><enum>(A)</enum><header>In general</header><text>The term <term>Federal financial assistance</term> has the meaning given the term in section 200.40 of title 2, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph id="H4CBFE78630334877A6CEF893BD64352F"><enum>(B)</enum><header>Inclusion</header><text>The term <term>Federal financial assistance</term> includes all expenditures by a Federal agency for an infrastructure project.</text></subparagraph></paragraph><paragraph id="H51722628E1A94CCFB4E3980FBC9B1BC8"><enum>(5)</enum><header>Infrastructure</header><text>The term <term>infrastructure</term> includes, at a minimum, the structures, facilities, and equipment for, in the United States—</text><subparagraph id="HF668A54473734DC6B5E2AFBC164E39EF"><enum>(A)</enum><text>roads, highways, and bridges;</text></subparagraph><subparagraph id="H06EB167D0C954963A3C699A6FBCE39DF"><enum>(B)</enum><text>public transportation;</text></subparagraph><subparagraph id="H71A733B8A6D048499464A5B4E4AEA1B1"><enum>(C)</enum><text>dams, ports, harbors, and other maritime facilities;</text></subparagraph><subparagraph id="H91CC062836084F0EA58C1C97CFFB539A"><enum>(D)</enum><text>intercity passenger and freight railroads;</text></subparagraph><subparagraph id="H119AE89639614917B47F055EF5514AAF"><enum>(E)</enum><text>freight and intermodal facilities;</text></subparagraph><subparagraph id="HFE24967467D744768BF188686CDC3BAF"><enum>(F)</enum><text>airports;</text></subparagraph><subparagraph id="HFD11B3063ED64C0D85EE94ED73402D75"><enum>(G)</enum><text>water systems, including drinking water and wastewater systems;</text></subparagraph><subparagraph id="H0D20F9B582E843D6BA38499BB6ABBFF1"><enum>(H)</enum><text>electrical transmission facilities and systems;</text></subparagraph><subparagraph id="HA8CD2A427A5E474789330628F09AAF61"><enum>(I)</enum><text>utilities;</text></subparagraph><subparagraph id="HB7BF1083CB854F2E9C6CD9E3F2F5A999"><enum>(J)</enum><text>broadband infrastructure; and</text></subparagraph><subparagraph id="HCF743ACCCE9E4EB9B1698D4257875B55"><enum>(K)</enum><text>buildings and real property.</text></subparagraph></paragraph><paragraph id="H3FAE1405CB754EF7BF2978B9900F70B7"><enum>(6)</enum><header>Produced in the United States</header><text>The term <term>produced in the United States</term> means, in the case of iron or steel products, that all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States.</text></paragraph><paragraph id="H7EAE018B52784857A7F9C2004B850CE5"><enum>(7)</enum><header>Project</header><text>The term <term>project</term> means the construction, alteration, maintenance, or repair of infrastructure in the United States.</text></paragraph></section><section id="H3173FEA2E4654D298D9C659DFDC395EC"><enum>4.</enum><header>Identification of deficient programs</header><subsection id="HCD0982E1BD7D44168588AC445B771B7A"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, the head of each Federal agency shall—</text><paragraph id="H0DF5D17550A34CF79F47B6852031D97C"><enum>(1)</enum><text>submit to the Office of Management and Budget and to Congress, including a separate notice to each appropriate congressional committee, a report that identifies each Federal financial assistance program for infrastructure administered by the Federal agency; and</text></paragraph><paragraph id="H2B7A2C361E5A4065A30D729F1402851B"><enum>(2)</enum><text>publish in the Federal Register the report under paragraph (1).</text></paragraph></subsection><subsection id="HAAD675D4C7014617994C464EA1FEC413"><enum>(b)</enum><header>Requirements</header><text>In the report under subsection (a), the head of each Federal agency shall, for each Federal financial assistance program—</text><paragraph id="H69EABBC2BB464B1E984BBCFAF7DCE06E"><enum>(1)</enum><text>identify all domestic content procurement preferences applicable to the Federal financial assistance;</text></paragraph><paragraph id="H22FD1836AAFA4615BD4DC8FBF957F9D9"><enum>(2)</enum><text>assess the applicability of the domestic content procurement preference requirements, including—</text><subparagraph id="H04A47493D5144FA0AE610AD6845BEBB7"><enum>(A)</enum><text>section 313 of title 23, United States Code;</text></subparagraph><subparagraph id="HC26ABBD8D902487E85DA6A168D9BE600"><enum>(B)</enum><text>section 5323(j) of title 49, United States Code;</text></subparagraph><subparagraph id="H69B4D8FA96FA41E4AC9CAF8FAB18B524"><enum>(C)</enum><text>section 22905(a) of title 49, United States Code;</text></subparagraph><subparagraph id="H440147E27C43483B989F9E7C6A10C891"><enum>(D)</enum><text>section 50101 of title 49, United States Code;</text></subparagraph><subparagraph id="H8C9824549C054C1BBA1CEC3EA5DA1ABD"><enum>(E)</enum><text>section 603 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1388">33 U.S.C. 1388</external-xref>);</text></subparagraph><subparagraph commented="no" id="HFE255F2307594407A86A44EBD8FCA25E"><enum>(F)</enum><text>section 1452(a)(4) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(a)(4)</external-xref>);</text></subparagraph><subparagraph id="HB6D2F0B1EFA947E687CAB84CC47BDB6D"><enum>(G)</enum><text>section 5035 of the Water Infrastructure Finance and Innovation Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3914">33 U.S.C. 3914</external-xref>);</text></subparagraph><subparagraph id="HE189B43C1B9D420A81670A3A31227F28"><enum>(H)</enum><text>any domestic content procurement preference included in an appropriations Act; and</text></subparagraph><subparagraph id="H29AEE52D9CC2487F902F1A8D9D41C793"><enum>(I)</enum><text>any other domestic content procurement preference in Federal law (including regulations);</text></subparagraph></paragraph><paragraph id="H3F5810F7675D4003975FE1496D5D6AE8"><enum>(3)</enum><text>provide details on any applicable domestic content procurement preference requirement, including the purpose, scope, applicability, and any exceptions and waivers issued under the requirement; and</text></paragraph><paragraph id="HBCD46712348E41609D4F4FD3CD751CFC"><enum>(4)</enum><text>include a description of the type of infrastructure projects that receive funding under the program, including information relating to—</text><subparagraph id="HBD886E354CED46599B5B841F6D66B417"><enum>(A)</enum><text>the number of entities that are participating in the program;</text></subparagraph><subparagraph id="HE8EFEC5A422B4AA4A5D63BEBEE6B9086"><enum>(B)</enum><text>the amount of Federal funds that are made available for the program for each fiscal year; and</text></subparagraph><subparagraph id="H20B7F9EC4D614A18AEB9ED4F6C837CA2"><enum>(C)</enum><text>any other information the head of the Federal agency determines to be relevant.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HC0C1963895C34D89BB45E1C62670B5E6"><enum>(c)</enum><header>List of deficient programs</header><text>In the report under subsection (a), the head of each Federal agency shall include a list of Federal financial assistance programs for infrastructure identified under that subsection for which a domestic content procurement preference requirement—</text><paragraph commented="no" id="H6981B7022E2642D0A478E5F4A46660A7"><enum>(1)</enum><text>does not apply; or</text></paragraph><paragraph commented="no" id="H42DD7ECF577C4238AABAADB7A1CE1738"><enum>(2)</enum><text>is subject to a waiver of general applicability not limited to the use of specific products for use in a specific project.</text></paragraph></subsection></section><section id="H69EDAC7B7D3D443C88A8C47FBF220CAC"><enum>5.</enum><header>Application of Buy America preference</header><subsection id="H2E8A0867FAFE4731B7BAD2CF073F5CD3"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the head of each Federal agency shall ensure that none of the funds made available for a Federal financial assistance program for infrastructure, including each deficient program, may be used for a project unless all of the iron, steel, and manufactured products used in the project are produced in the United States.</text></subsection><subsection id="H7E3A4C968D5F4ABB8BD938C74C6F74D4"><enum>(b)</enum><header>Waiver</header><text>The head of a Federal agency that applies a domestic content procurement preference under this section may waive the application of that preference in any case in which the head of the Federal agency finds that—</text><paragraph id="H7A7C0FD4732F4DD8AD5C67A278A53224"><enum>(1)</enum><text>applying the domestic content procurement preference would be inconsistent with the public interest;</text></paragraph><paragraph id="H05FE0A73999E49D987688B3D93DD0B77"><enum>(2)</enum><text>types of iron, steel, or manufactured products are not produced in the United States in sufficient and reasonably available quantities or of a satisfactory quality; or</text></paragraph><paragraph id="H442B80898AC04DB4BB62F923BD7AC150"><enum>(3)</enum><text>the inclusion of iron, steel, or manufactured products produced in the United States will increase the cost of the overall project by more than 25 percent.</text></paragraph></subsection><subsection id="H014556A74DA74424BCEB01EA6A2E7C8D"><enum>(c)</enum><header>Written justification</header><text>Before issuing a waiver under subsection (b), the head of the Federal agency shall—</text><paragraph id="H292F6E01B7B54DF6A42E6D106D0FC373"><enum>(1)</enum><text>publish in the Federal Register and make publicly available in an easily accessible location on the website of the Federal agency a detailed written explanation for the proposed determination to issue the waiver; and</text></paragraph><paragraph id="HEAA04A9D0C2342018BAA54BE6B04DC54"><enum>(2)</enum><text>provide a reasonable period for public comment on the proposed waiver.</text></paragraph></subsection><subsection id="H55E43E74FBBD4B6F9399FE1DFBE23115"><enum>(d)</enum><header>Prohibition on waivers of general applicability</header><text>A waiver issued under subsection (b) shall be limited to the use of specific products for use in a specific project.</text></subsection><subsection id="H0D946792B4F24286B7CE4806BAC835E0"><enum>(e)</enum><header>Consistency with international agreements</header><text>This section shall be applied in a manner consistent with United States obligations under international agreements.</text></subsection></section><section id="HBFBD102560F84BF7A4C8E51A731651E7"><enum>6.</enum><header>OMB guidance</header><text display-inline="no-display-inline">The Director of the Office of Management and Budget shall—</text><paragraph id="H121391E592ED40D5994DF43A893B2BAF"><enum>(1)</enum><text>issue guidance to the head of each Federal agency—</text><subparagraph id="H2B1F9A43306A4D00AABF98465B8EE7A5"><enum>(A)</enum><text>to assist in identifying deficient programs under section 4(c); and</text></subparagraph><subparagraph id="HDAE605C95E7A4FA4949E8261424A42ED"><enum>(B)</enum><text>to assist in applying new domestic content procurement preferences under section 5; and</text></subparagraph></paragraph><paragraph id="H05C5F2183A234C17821096072B98FCC1"><enum>(2)</enum><text>if necessary, amend subtitle A of title 2, Code of Federal Regulations (or successor regulations), to ensure that domestic content procurement preference requirements required by this Act or other Federal law are imposed through the terms and conditions of awards of Federal financial assistance.</text></paragraph></section><section commented="no" id="H62863929723745358B03E4EA7DBF8A54"><enum>7.</enum><header>Application</header><subsection commented="no" id="H8DF72E59C17A4754839F5FC5402BB195"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">This Act shall apply to a Federal financial assistance program for infrastructure only to the extent that a domestic content procurement preference as described in section 5 does not already apply to iron, steel, and manufactured products.</text></subsection><subsection commented="no" id="HB890D2444B2D4261923EAE80AB12DBBE"><enum>(b)</enum><header>Savings provision</header><text>Nothing in this Act affects a domestic content procurement preference for a Federal financial assistance program for infrastructure that is in effect and that meets the requirements of section 5.</text></subsection></section></legis-body></bill>
