which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services to carry out a pilot program to test the feasibility and outcomes of integrating a substance use disorder and behavioral health treatment locator tool into the prescription drug monitoring programs of 5 eligible States.</official-title></form><legis-body id="H603DF9DC39074D56B8B949B417EA8972" style="OLC"><section id="H7E2C4F4C6CA744B4A7614C5A59B6785C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PDMPs Help Patients Act of 2021</short-title></quote>.</text></section><section id="HFB4C71957F7C4B8E94AA756B11C6BCBC"><enum>2.</enum><header>Pilot program for integrating substance use disorder and behavioral health treatment locator tool into State prescription drug monitoring programs</header><subsection id="HF44AB0FA6FFF41AEADF86D054348C7E8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, in consultation with the Assistant Secretary for Mental Health and Substance Use, shall establish and implement a pilot program in which the Secretary awards grants to, or enters into cooperative agreements with, not more than 5 eligible States to test the feasibility and outcomes of integrating a substance use disorder and behavioral health treatment locator tool into the State’s prescription drug monitoring program.</text></subsection><subsection id="H6E5FDC3D9CCE4A2CBAEEB3B1A212DA8E"><enum>(b)</enum><header>Grant establishment and participation</header><paragraph id="H6544CA55DE6943D484EC1A95A1412901"><enum>(1)</enum><header>In general</header><text>In carrying out the pilot program under this section, the Secretary shall, on a competitive basis, award grants to, or enter into cooperative agreements with, not more than 5 eligible States.</text></paragraph><paragraph id="H068745552BEB4501976509E92E25E19A"><enum>(2)</enum><header>Eligibility</header><text>To be eligible for a grant under this section, a State shall demonstrate to the Secretary’s satisfaction that the State is making progress in integrating the State’s PDMP with electronic health records and health information technology infrastructure.</text></paragraph><paragraph id="H0AD3701726C54E10A1B7B88F0A73B5A8"><enum>(3)</enum><header>Preference</header><text>In awarding grants under this section, the Secretary shall give preference to eligible States described in paragraph (2) whose rates of death due to drug overdose per population of 100,000 are in the top quartile according to the most recent data of the Centers for Disease Control and Prevention.</text></paragraph></subsection><subsection id="H85B63A9673434A2C9FBE22FA4D997EE9"><enum>(c)</enum><header>Period of grant</header><text>A grant awarded to an eligible entity under this section shall be for a period of 2 years.</text></subsection><subsection id="H2D93AFA0037A4944B459301E9FEA86D4"><enum>(d)</enum><header>Grant uses</header><paragraph id="HF3D8160901A8416C96611E162CDC1681"><enum>(1)</enum><header>Required uses</header><text>A grant awarded under this section to an eligible State shall be used for both of the following purposes:</text><subparagraph id="HA6B5A2EB84E24DA1B7EE142F55936E42"><enum>(A)</enum><text display-inline="yes-display-inline">To integrate a substance use disorder and behavioral health treatment locator tool into the PDMP.</text></subparagraph><subparagraph id="H889C49FBDF87422F844C2DA82859B73C"><enum>(B)</enum><text display-inline="yes-display-inline">To develop and disseminate guidance for health care providers on how to consult and share information obtained through the substance use disorder and behavioral health treatment locator tool when a patient’s PDMP information indicates possible misuse of a controlled substance.</text></subparagraph></paragraph><paragraph id="H15ECEE1446C445CBB376C14EF0597A65"><enum>(2)</enum><header>Additional permissible uses</header><text>A grant awarded under this section to an eligible State may be used for any of the following additional purposes:</text><subparagraph id="H780E05547D574A3A8317696DE9E081CF"><enum>(A)</enum><text display-inline="yes-display-inline">To integrate a substance use disorder and behavioral health treatment locator tool into the PDMP that incorporates direct referral capabilities that enable the health care provider—</text><clause id="H86A9D02E33044288832DA71A01C4D78B"><enum>(i)</enum><text>to refer a patient to treatment or for an assessment; and</text></clause><clause id="H2C82FEE939D846DFB822366C82691BC4"><enum>(ii)</enum><text display-inline="yes-display-inline">consistent with the protection of information by Federal and State privacy laws and security rules, receive feedback about the patient’s engagement with such treatment or assessment.</text></clause></subparagraph><subparagraph id="H63B83855F3744ABCBF47CCBE073AE206"><enum>(B)</enum><text display-inline="yes-display-inline">To integrate a substance use disorder and behavioral health treatment locator tool into the PDMP that provides information regarding the current capacity of inpatient or outpatient treatment resources of a health care provider.</text></subparagraph></paragraph></subsection><subsection id="H25A4326C759B4EE08DBF6035F492CA91"><enum>(e)</enum><header>Reporting requirements</header><paragraph id="HC69B94702FCE4909B5F7815249707ED9"><enum>(1)</enum><header>Reports by States</header><text>Each eligible State that participates in the pilot program under this section shall submit to the Secretary an annual report for each year of the pilot program that includes information on—</text><subparagraph id="H864D23F73A7641009F93239828C63E0D"><enum>(A)</enum><text display-inline="yes-display-inline">the number of health care providers and health facilities with access to the substance use disorder and behavioral health treatment locator tool;</text></subparagraph><subparagraph id="H7F85BCE88C5742DF8BB54478DE9BF065"><enum>(B)</enum><text>the number of individuals referred to treatment with the assistance of the locator tool;</text></subparagraph><subparagraph id="HB64E47D29977449D81F49F721CCFB4DB"><enum>(C)</enum><text display-inline="yes-display-inline">aggregate, de-identified patient data related to the type of treatment located by the locator tool, how often patients followed through on seeking such treatment, and the average duration of such treatment, to the extent collected by the State;</text></subparagraph><subparagraph id="H4A2E4797E7524BF2BB90386B5F58DB80"><enum>(D)</enum><text>feedback from providers with access to the locator tool on usability and any impact on outcomes;</text></subparagraph><subparagraph id="HDD2E7FE618054FC18A37589FED8665FA"><enum>(E)</enum><text display-inline="yes-display-inline">recommendations to improve the usability and efficacy of a substance use disorder and behavioral health treatment locator tool within the PDMP; and</text></subparagraph><subparagraph id="H29B5A03FA7334DC693BED20B2A9E6392"><enum>(F)</enum><text>additional information and reporting metrics as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="H89D7311AC839454B9ECAE8E1716CF861"><enum>(2)</enum><header>Report by Secretary</header><text>Not less than 180 days after the conclusion of the pilot program under this section, the Secretary shall submit to the Congress a report on the findings of the program, including—</text><subparagraph id="H844B367CA1C44540878D26C3F94FE63E"><enum>(A)</enum><text>outcomes reported by the participating States;</text></subparagraph><subparagraph id="H6543F75EEE7B403CB5F87A88DEAA7987"><enum>(B)</enum><text display-inline="yes-display-inline">findings on the suitability of including a substance use disorder and behavioral health treatment locator tool within State PDMPs; and</text></subparagraph><subparagraph id="H9B7882ADA80344A4B9C5E5C7FE7FE19C"><enum>(C)</enum><text display-inline="yes-display-inline">recommendations on best practices for integrating a substance use disorder and behavioral health treatment locator tool within State PDMPs.</text></subparagraph></paragraph></subsection><subsection id="H29E8A78F40FF4C54B733C896D25A4DA3"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H0AAEAE6583B744B88DA302BF85894A7E"><enum>(1)</enum><text>The term <term>prescription drug monitoring program</term> or <term>PDMP</term> has the meaning given to the term <term>PDMP</term> in section 399O of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-3">42 U.S.C. 280g–3</external-xref>).</text></paragraph><paragraph id="H7D7B7746843E4AE6B0842B25FF67146A"><enum>(2)</enum><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></subsection><subsection id="HDD26BE5C129A42CFA574748A8FEE3571"><enum>(g)</enum><header>Authorization of appropriations</header><text>To carry out this section, there are authorized to be appropriated $2,500,000 for each of fiscal years 2022 and 2023.</text></subsection></section></legis-body></bill>
