R. 2809</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210422">April 22, 2021</action-date><action-desc><sponsor name-id="R000603">Mr. Rouzer</sponsor> (for himself and <cosponsor name-id="G000577">Mr. Graves of Louisiana</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize the President to provide disaster assistance to States and Indian Tribes under a major disaster recovery program, and for other purposes.</official-title></form><legis-body id="HB862723D84FC43A3B50C4BE173449DC6" style="OLC"><section id="H757E7E3DBD2042E585B5978F7D55E0C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Natural Disaster Recovery Program Act of 2021</short-title></quote>.</text></section><section id="H77C2CF1202C34EBFB2A90F1CF3FD5974"><enum>2.</enum><header>Natural Disaster Recovery Program</header><text display-inline="no-display-inline">The Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref> et seq.) is amended by adding at the end of title IV the following:</text><quoted-block style="OLC" id="H820369F81FB048669197392F7DDCF017" display-inline="no-display-inline"><section id="H76C081F44A1B451DB27CB8AE883C6FE5"><enum>431.</enum><header>Natural Disaster Recovery Program</header><subsection id="H943F1CF1380E40819A20F3B6847FC01A"><enum>(a)</enum><header>Authority; use</header><text>The President may provide assistance under this section to States and Indian Tribes for unmet need, including necessary expenses for activities related to disaster relief, resiliency, long-term recovery, restoration of infrastructure and housing, mitigation, and economic revitalization after a major disaster is declared under section 401.</text></subsection><subsection id="H5077E3380AFA4EE19ADCB5F97AC04C17"><enum>(b)</enum><header>Coordination of disaster benefits and data with other federal agencies</header><paragraph id="H4A27A9A3C447424D9A303D8B9670B69C" commented="no"><enum>(1)</enum><header>In general</header><text>The President shall coordinate with other agencies to obtain data on recovery needs and unmet need, including the Administrator of the Small Business Administration and other agencies when necessary regarding disaster benefits. Not later than 90 days after a major disaster is declared, the President shall make publicly available all data collected, possessed, or analyzed during the course of a disaster recovery for which assistance is provided under this section, including—</text><subparagraph id="H471364F15FB44995A894FF4640E400C9" commented="no"><enum>(A)</enum><text>all data on damage caused by the disaster;</text></subparagraph><subparagraph id="H39C1BD08F90D4AE5AD5541AAD5704D70" commented="no"><enum>(B)</enum><text>information on how any Federal assistance provided in connection with the disaster is expended; </text></subparagraph><subparagraph id="H79089074513C473AA45666D0FA2B2C2F" commented="no"><enum>(C)</enum><text>information regarding the effect of the disaster on education, transportation capabilities and dependence, housing needs, health care capacity, and displacement of persons; and</text></subparagraph><subparagraph id="HE3226836041749ED883086D26068CE34"><enum>(D)</enum><text>the extent of the unmet need.</text></subparagraph></paragraph><paragraph id="HB84795CDAEAC41728F80DC30482CD1A6"><enum>(2)</enum><header>Protection of personally identifiable information</header><text>In carrying out this subsection, the President and the grantee shall take such actions as may be necessary to ensure that personally identifiable information regarding recipients of assistance provided under this section is not made publicly available by any agency with which information is shared pursuant to this subsection.</text></paragraph></subsection><subsection id="HA4148ECA4BC444B79104007DB2D3D316"><enum>(c)</enum><header>Use of funds</header><paragraph id="HE1E3C915986A4EE7A5BA868F1F6135AE"><enum>(1)</enum><header>Administrative costs</header><subparagraph id="H69749C02EE7541E2B8DDE581A886FCA5"><enum>(A)</enum><header>In general</header><text>A State or Indian Tribe receiving a grant under this section may use not more than 13 percent of the amount of grant funds received, or within such other percentage as may be established pursuant to subparagraph (B), for administrative costs, including costs related to audits, reviews, oversight, evaluation, and investigations. </text></subparagraph><subparagraph id="H698EDC0430164EE299136B76BCE03168"><enum>(B)</enum><header>Discretion to establish sliding scale</header><text>The President may establish a series of percentage limitations on the amount of grant funds received that may be used by a grantee for administrative costs, but only if—</text><clause id="H2AE63E4B57374C0E91AC5B1C95B2AFE1"><enum>(i)</enum><text>such percentage limitations are based on the amount of grant funds received by a grantee; and</text></clause><clause id="H923CD07F5CB34DE7A421608B52F28F14"><enum>(ii)</enum><text>such series provides that the percentage that may be used is lower for grantees receiving a greater amount of grant funds and such percentage that may be used is higher for grantees receiving a lesser amount of grant funds.</text></clause></subparagraph></paragraph><paragraph id="H918359C871D5457F9803DC0E111B5F0B"><enum>(2)</enum><header>Capacity building</header><text>From funds made available for use under this section, the President shall provide necessary technical assistance to grantees to ensure grantees are compliant with Federal law, and capacity building and technical assistance, including assistance regarding contracting and procurement processes, including providing solicitation and contractual templates that conform to Federal requirements for use by grantees.</text></paragraph></subsection><subsection id="HB1E947FCA9BD434BB571B020F9F3360B" display-inline="no-display-inline"><enum>(d)</enum><header>Allocation, process, and procedures; coordination</header><paragraph id="H9C63EF14AD9A4FADBA783C3EB78EB566"><enum>(1)</enum><header>Allocation</header><subparagraph id="H8E0A5A7BA4C941F7B332717725FB47E8"><enum>(A)</enum><header>In general</header><text>The President shall allocate funds under this section proportionally to grantees based on their level of unmet need as determined pursuant to subsection (b).</text></subparagraph><subparagraph id="HC156050C4F8F4E38BC2E850C177EDDCC" commented="no"><enum>(B)</enum><header>Grantee use of funds</header><text display-inline="yes-display-inline">Each grantee, not the President, shall be responsible for determining how funds provided under this section are prioritized and spent and a grantee shall not be required to provide an action or spending plan before or after funds are allocated, except that the grantee shall use a portion of these funds for cleaning and removing debris from rivers, creeks, streams, and ditches.</text></subparagraph><subparagraph id="H288B448541494069B11EB6ADF36B323C"><enum>(C)</enum><header>Limitation</header><text>Notwithstanding section 312, a loan shall not be considered a duplication of benefits or otherwise impact the level of unmet need under this section. </text></subparagraph></paragraph><paragraph id="H957699E114E047F1A59F8600DCB403EC"><enum>(2)</enum><header>Grantee processes and procedures</header><subparagraph id="H7429A10C6F574CEE9B2DA7A39CBBBE4D"><enum>(A)</enum><header>Initial grant funds</header><text display-inline="yes-display-inline">Initially, grantees shall be awarded 50 percent of their total allocation under paragraph (1). After expenditure of such amount, a grantee shall submit a report, detailing how such grant funds were spent, to the Committees on Appropriations of the House of Representatives and the Senate, the Committee on Transportation and Infrastructure of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs of the Senate. Such report shall include a certification from the State Auditor that none of the funds were wasted or used inappropriately.</text></subparagraph><subparagraph id="H9C57757F225748329E8CD8D890EC5CDC"><enum>(B)</enum><header>Congressional approval</header><clause id="HA54B0F9448014CEF9FA9302489F4F44E"><enum>(i)</enum><header>Approval</header><text>Not later than 60 days after receipt of the report under subparagraph (A), Congress shall approve or disapprove the report. If the report is approved, or if 60 days has lapsed and Congress has not commented on the report, the remaining 50 percent of the allocation under paragraph (1) shall be released to the grantee.</text></clause><clause id="H46F9E1A19E554CA9910B80E93221D5D2"><enum>(ii)</enum><header>Disapproval</header><text>If Congress disapproves the report, the grantee shall work with Congress to address any and all concerns regarding how the initial 50 percent of the grant money was expended. Once these concerns are resolved, the remaining funds shall be released to the grantee.</text></clause><clause id="H116095E71BA74A77BD9D70F04A942EBD"><enum>(iii)</enum><header>Fraud or abuse</header><text>If Congress determines that a grantee committed fraud or abuse, Congress shall require the President to recover all funds provided to the grantee under this section. Any amount recovered under this clause shall be redistributed to other grantees with approved reports pursuant to clause (i).</text></clause></subparagraph></paragraph><paragraph id="HFDB174CD72A24C61957D5C90ACD274A5"><enum>(3)</enum><header>Requirements</header><text>Each State and Indian Tribe that receives funds under this section shall establish or adhere to existing guidelines for procurement processes and procedures and require that subgrantees—</text><subparagraph id="H597FE3DC518544C697FF32862454FCC0"><enum>(A)</enum><text>provide for full and open competition and require cost or price analysis;</text></subparagraph><subparagraph id="H52F82742BC164BCAA1C8B16998D6C7F8"><enum>(B)</enum><text>specify methods of procurement and their applicability, but not allow cost-plus-a-percentage-of cost or percentage-of-construction-cost methods of procurement;</text></subparagraph><subparagraph id="HF29D79FFF57E493685217D615C0A0D09"><enum>(C)</enum><text>include standards of conduct governing employees engaged in the award or administration of contracts; and</text></subparagraph><subparagraph id="H84B16D1C314F4E7B84E6980F462C1AA1"><enum>(D)</enum><text>ensure that all purchase orders and contracts include any clauses required by Federal statute, Executive order, or implementing regulation.</text></subparagraph></paragraph></subsection><subsection id="HA025DC65028341BAB96AC868D94E1AC0"><enum>(e)</enum><header>Environmental review</header><text display-inline="yes-display-inline">Recipients of funds received under this section that use funds to supplement funds provided under section 402, 403, 404, 406, 407, 408(c)(4), 428, or 502 may adopt, without review or public comment, any environmental review, approval, or permit performed by a Federal agency.</text></subsection><subsection id="H2A6C327BAE3A47C7BD04920837491C32"><enum>(f)</enum><header>Best practices</header><text display-inline="yes-display-inline">The President shall identify best practices for grantees on issues including developing action plans, establishing financial controls, building grantee technical and administrative capacity, procurement, and use of grant funds as local match for other sources of Federal funding. Not later than 1 year after the date of enactment of this section, the President shall publish a compilation of such identified best practices and share with all relevant grantees to facilitate a more efficient and effective disaster recovery process.</text></subsection><subsection id="H4B83EDBB3C204902B52EBB9ABDDBCFF4"><enum>(g)</enum><header>Natural disaster recovery reserve fund</header><paragraph id="H414C7368339843C2BC0E07DD4F2FE7BA"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury of the United States an account to be known as the Natural Disaster Recovery Reserve Fund (in this section referred to as the <quote>Fund</quote>).</text></paragraph><paragraph id="H9F753FB9F8224A8EA47A33108021CFFE"><enum>(2)</enum><header>Amounts</header><text display-inline="yes-display-inline">The Fund shall consist of any amounts appropriated to or deposited into the Fund, including amounts deposited into the Fund pursuant to paragraph (4).</text></paragraph><paragraph id="H893F21A8143D46BE8C44FAFFF1108EAB"><enum>(3)</enum><header>Use of funds</header><text>Amounts in the Fund shall be available, pursuant to a declaration of a major disaster, only for providing technical assistance and capacity building in connection with subsection (c)(4) for grantees that have been allocated assistance under this section in connection with such disaster to facilitate planning and increase capacity to administer assistance under this section.</text></paragraph><paragraph id="H6367343E07B04B5892F8A737D7254BEB"><enum>(4)</enum><header>Unused amounts</header><text display-inline="yes-display-inline">If any amounts made available for assistance under this section to grantees remain unexpended on the earlier of—</text><subparagraph id="H80610567C1C640AAB4385A63704F83C8"><enum>(A)</enum><text>the date that the grantee of such amounts notifies the President that the grantee has completed all activities; or</text></subparagraph><subparagraph id="H3A07BB93AC8D439F8BAB02AC94F7EDA4"><enum>(B)</enum><text>except as provided in paragraph (5), the expiration of the 6-year period beginning when the President obligates such amounts to the grantee, the President shall transfer such unexpended amounts to the Secretary of the Treasury for deposit into the Fund, except that the President may permit the grantee to retain amounts needed to close out the grant.</text></subparagraph></paragraph><paragraph id="H3E771169FBF84B1AA784A8D18EF0EFB1"><enum>(5)</enum><header>Extension of period for use of funds</header><text display-inline="yes-display-inline">The period under paragraph (4)(B) may be extended by not more than 4 years if, before the expiration of such 6-year period, the President waives this requirement and submits a written justification for such waiver to the Committees on Appropriations of the House of Representatives and the Senate that specifies the period of such extension.</text></paragraph></subsection><subsection id="HB1788E5C29DB4954B46A0FD44F7C15FC"><enum>(h)</enum><header>Waiver authority</header><text>Until such time as the President issues regulations to implement this section, the President may—</text><paragraph id="HD830ED14579A44A2BDF64B48DE2FBCF7"><enum>(1)</enum><text>waive notice and comment rulemaking, if the President determines the waiver is necessary to expeditiously implement the provisions of this section; and</text></paragraph><paragraph id="H93BF05BB85FF407288F9DC8488478ED7"><enum>(2)</enum><text>carry out the grant program under this section as a pilot program.</text></paragraph></subsection><subsection id="H95D83A1560524011B2780957C2574EEC"><enum>(i)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section, the following terms shall apply:</text><paragraph id="H69BA8EF708F74632AC3496049256438E"><enum>(1)</enum><header>State auditor</header><text>The term <quote>State auditor</quote> means the individual selected by each State or the Chief Executive to submit information pursuant to subsection (c)(3) and a certification in accordance with subsection (d)(2)(A).</text></paragraph><paragraph id="H10B9FD791335415AAB34DF20C5B5EDB9"><enum>(2)</enum><header>Unmet need</header><text>The term <quote>unmet need</quote> means any unresourced item, support, or assistance that has been assessed and verified as necessary for a survivor to recover from a major disaster, including food, clothing, shelter, first aid, emotional and spiritual care, household items, home repair, or rebuilding.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
