R. 2802</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210422">April 22, 2021</action-date><action-desc><sponsor name-id="P000048">Mr. Pfluger</sponsor> (for himself, <cosponsor name-id="B001291">Mr. Babin</cosponsor>, <cosponsor name-id="M001157">Mr. McCaul</cosponsor>, <cosponsor name-id="V000133">Mr. Van Drew</cosponsor>, <cosponsor name-id="G000589">Mr. Gooden of Texas</cosponsor>, <cosponsor name-id="J000304">Mr. Jackson</cosponsor>, <cosponsor name-id="G000591">Mr. Guest</cosponsor>, <cosponsor name-id="M001186">Mr. Meijer</cosponsor>, <cosponsor name-id="G000597">Mr. Garbarino</cosponsor>, <cosponsor name-id="A000375">Mr. Arrington</cosponsor>, <cosponsor name-id="V000134">Ms. Van Duyne</cosponsor>, and <cosponsor name-id="G000593">Mr. Gimenez</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To allow amounts made available under the American Rescue Plan Act of 2021 for the Coronavirus State Fiscal Recovery Fund and the Coronavirus Local Fiscal Recovery Fund to be made available to eligible law enforcement agencies for border security, and for other purposes.</official-title></form><legis-body id="H19BB651FFCA247A5B85E8E0749A74C46" style="OLC"><section id="H0A7AAC1B9E93431589D8B352B92AB3D8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Border Rescue Plan Act</short-title></quote>. </text></section><section id="HE5A27EE1A3FC433A9E6E60EE8F27F8E8"><enum>2.</enum><header>Coronavirus relief funds for border security</header><subsection id="H960D419C1CB24674935EAC0C1DAB8E5F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Amounts made available by the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>) for the Coronavirus State Fiscal Recovery Fund and the Coronavirus Local Fiscal Recovery Fund may also be made available to eligible law enforcement agencies for the purposes described in subsection (b).</text></subsection><subsection id="H4C2F94A1CFD54216AFF694C50F113F51"><enum>(b)</enum><header>Purposes</header><text>The purposes in this subsection are the following:</text><paragraph id="H1643409704654E5099AC8AF7944D7FAA"><enum>(1)</enum><text display-inline="yes-display-inline">Equipment, including maintenance and sustainment costs for enhanced border law enforcement activities.</text></paragraph><paragraph id="H0B5B2043AC244B37BE5295D565AC70BC"><enum>(2)</enum><text>Personnel, including overtime and backfill for law enforcement personnel or non-law enforcement personnel who support enhanced border law enforcement activities.</text></paragraph><paragraph id="HF73E3C23AEC14B81B0696EE778227C8C"><enum>(3)</enum><text>Allowable and approved personnel costs, including salaries, fringe benefits, overtime and backfill for dedicated intelligence analysts supporting Operation Stonegarden operations in support of enhanced border law enforcement activities.</text></paragraph><paragraph id="H4D4BCC1F3CEA45EE8AC9E245F294EECF"><enum>(4)</enum><text>Any activity permitted for Operation Stonegarden under—</text><subparagraph id="HBBB91E9444954E9C99B27746BA6AE00D"><enum>(A)</enum><text>the Department of Homeland Security’s most recent Homeland Security Grant Program Notice of Funding Opportunity; or</text></subparagraph><subparagraph id="HA6D9EE366A1A408E8AB4AB29F4923353"><enum>(B)</enum><text>the Federal Emergency Management Agency’s Preparedness Grants Manual.</text></subparagraph></paragraph><paragraph id="HB7FE85667EC246308A0D86695C4488BF"><enum>(5)</enum><text>Any other appropriate activity, as determined by the Secretary.</text></paragraph></subsection><subsection id="H44C7BF58476C40A0AA0367E37C55CAF8"><enum>(c)</enum><header>Eligible law enforcement agencies defined</header><text>The term <term>eligible law enforcement agencies</term> means a law enforcement agency that is—</text><paragraph id="H810D92D636AE4E77B6782BC5980B30F5"><enum>(1)</enum><text>located in—</text><subparagraph id="H296E82E55C5940A6B79FBBD5CF82C692"><enum>(A)</enum><text>a State bordering Canada or Mexico; or</text></subparagraph><subparagraph id="HAD1A985CA1A349DD9C8F46878C841836"><enum>(B)</enum><text>a State or territory with an international maritime border; and</text></subparagraph></paragraph><paragraph id="H0F0E78746B4E4E1E92EBC1B27520520F"><enum>(2)</enum><text>is involved in an active, ongoing, U.S. Customs and Border Protection operation coordinated through a sector office.</text></paragraph></subsection></section></legis-body></bill>
