<section id="H319DF1BF7BA441E98D1C124976B0BFAD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Duplicate PPP Loans Act of 2021</short-title></quote>.</text></section> <section id="HC22BCEC042AE4C06886CEA4ADBA02054"><enum>2.</enum><header>Ineligible duplicate loans under the paycheck protection program</header> <subsection id="H6A659BDFB4124063A0F3B3AABA5D06A1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7A of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636m">15 U.S.C. 636m</external-xref>) is amended by adding to the end the following new subsection:</text>

<subsection id="H284DD7C5E20942CA8DD120A15237DA8E"><enum>(m)</enum><header>Ineligible duplicate loans</header><text display-inline="yes-display-inline">Any borrower that knowingly and willfully submits false information for the purposes of obtaining a covered loan under section 7(a)(36) shall be required to repay any amount of such covered loan.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H72C76E7086E340A3B3303483CC9EE5B7"><enum>(b)</enum><header>Guidance</header><text>Not later than 10 days after the date of the enactment of this Act, the Administrator of the Small Business Administration shall issue guidance to carry out the amendments made by this Act.</text></subsection></section>
<section id="H69C85517EAA24FFA8DD5DD062FC86A24"><enum>3.</enum><header>Report on ineligible duplicate loans</header>
<subsection id="HC04F5769FA1447DEA5270F7B7B01B9C1"><enum>(a)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 1 week after the date of the enactment of this Act, and weekly thereafter until the last day of the covered period (as defined in section 7(a)(36)(A) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)(A)</external-xref>), the Administrator of the Small Business Administration shall submit to the Committees on Banking, Housing, and Urban Affairs and Small Business and Entrepreneurship of the Senate, and the Committees on Financial Services and Small Business of the House of Representatives, a report on ineligible duplicate loans (as described under section 7A(m) of the Small Business Act, as added by this Act) that includes—</text> <paragraph id="H9164BF36817A47A1A67805A19362A806"><enum>(1)</enum><text>the number of attempted applications for such ineligible duplicate loans;</text></paragraph>
<paragraph id="HFA2FAAF35B654378BD82F423AD973030"><enum>(2)</enum><text display-inline="yes-display-inline">the number of processed applications for such ineligible duplicate loans;</text></paragraph> <paragraph id="HD18D6E56B6954096AD72BD307DDB53CA"><enum>(3)</enum><text display-inline="yes-display-inline">dollars disbursed for such ineligible duplicate loans; and</text></paragraph>
<paragraph id="H9880171F10AC40729E71231B172AC61A"><enum>(4)</enum><text>actions taken by the Administrator to—</text> <subparagraph id="H56494883626443F7A3556F2CB6B143EA"><enum>(A)</enum><text display-inline="yes-display-inline">review potential disbursements for such ineligible duplicate loans;</text></subparagraph>
<subparagraph id="HF1ABF4EBD64741508FD870B3571BE1B3"><enum>(B)</enum><text display-inline="yes-display-inline">recover improper disbursements for such ineligible duplicate loans;</text></subparagraph> <subparagraph id="H0E428016B249432D89480B7076B6A273"><enum>(C)</enum><text display-inline="yes-display-inline">strengthen technical systems to ensure the detection of such ineligible duplicate loan applications; and</text></subparagraph>
<subparagraph id="H7BDBEF19421B4C7DB9B1BC752E2CB71C"><enum>(D)</enum><text display-inline="yes-display-inline">provide guidance to lenders on such ineligible duplicate loan applications.</text></subparagraph></paragraph></subsection> <subsection id="HC208FD82F1514BB3A48F30F382FA0A55"><enum>(b)</enum><header>Publication</header><text>Not later than 7 days after the date on which the Administrator submits a report required under subsection (a), the Administrator shall publish such report on a website of the Small Business Administration.</text></subsection></section>
