R. 2796</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210422">April 22, 2021</action-date><action-desc><sponsor name-id="P000613">Mr. Panetta</sponsor> (for himself and <cosponsor name-id="A000375">Mr. Arrington</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc" parsable-cite="usc/26/414">section 414</external-xref> of the Internal Revenue Code of 1986 to update the family attribution rule.</official-title></form><legis-body id="H37A4F0D9542141C09DC5DE5A6FA1E8FD" style="OLC"><section id="HE386EE29D830476B8BDDB8FB8FF62E8E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Family Attribution Modernization Act</short-title></quote>. </text></section><section id="H607F4EFB328A438FBC0FCA016F91FE03"><enum>2.</enum><header>Reform of family attribution rule</header><subsection id="HC21B7ECD223E41EEA441A8A3852114BA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/414">Section 414</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H26C21A0BBC494EC3B8E008DC0B1E4B1A"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H50CBE0E53C41415787FC4526C320CFD0"><enum>(A)</enum><text>by striking <quote>For purposes of</quote> and inserting the following: </text><quoted-block style="OLC" id="HC987C0A9959A4D93B1018707FBC9F6CD" display-inline="no-display-inline"><paragraph id="H769647059263473193109652CB791FCE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of</text></paragraph><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H1BB694D29D6F4E51AC477CAAEFCAC3A0"><enum>(B)</enum><text>by adding at the end the following new paragraphs: </text><quoted-block style="OLC" id="HF2725FCF1E4143D9BA0A2669FC585D4B" display-inline="no-display-inline"><paragraph id="H9744CBBF15474FE292A935BC16609C18"><enum>(2)</enum><header>Special rules for applying family attribution</header><text display-inline="yes-display-inline">For purposes of applying the attribution rules under section 1563 with respect to paragraph (1), the following rules apply:</text><subparagraph id="H4AA5B29350994D1C949FA2BB025107A2"><enum>(A)</enum><text>Community property laws shall be disregarded for purposes of determining ownership.</text></subparagraph><subparagraph id="H1DC6AF926C5E4A99A49472223967A8F6"><enum>(B)</enum><text display-inline="yes-display-inline">Any ownership that is not attributed to a spouse by reason of section 1563(e)(5) shall also not be attributed to the minor children of the owner and the attribution rule in paragraph (6)(A) shall not apply to such ownership.</text></subparagraph></paragraph><paragraph id="HB37FF4838CF64E1C9E485A3DAA063A85"><enum>(3)</enum><header>Plan shall not fail to be treated as satisfying this section</header><text display-inline="yes-display-inline">If application of paragraph (2) causes two or more entities to be a controlled group, or an affiliated service group, or to no longer be in a controlled group or an affiliated service group, such change shall be treated as a transaction to which section 410(b)(6)(C) applies.</text></paragraph><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H1C9F021BD8784152A730D7365D928AAD"><enum>(2)</enum><text>in subsection (m)(6)(B), by striking <quote>apply</quote> and inserting <quote>apply, except that community property laws shall be disregarded for purposes of determining ownership</quote>.</text></paragraph></subsection><subsection id="H8D45D351FBD94EFFAF2B1156CDF94E45"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to plan years beginning on or after the date of the enactment of this section. </text></subsection></section></legis-body></bill>
