Maloney of New York</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require sales and leases of assets of public housing projects in connection with solar energy projects to financially benefit the residents of such public housing project and the budget of the public housing agency that owns such public housing project, and for other purposes.</official-title></form><legis-body id="H0D5F3254702B4940B73F653E3847F7FE" style="OLC"><section id="HA3FC7D323C0942E88A4D4478C29A2234" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Housing Solar Equity Act of 2021</short-title></quote>.</text></section><section id="HF3F2E6EBAAA149839A21417225F98CD8"><enum>2.</enum><header>Public housing agency sales or leases of PHA assets in connection with solar energy projects</header><subsection id="H8DCF8672E4494BF487EE1E889261DDD1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 9 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437g">42 U.S.C. 1437g</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H29C59D9010D346249EA3D7DABACF7079" style="OLC"><subsection id="H9DD9FD65BB1A418998B0456676A3E168"><enum>(p)</enum><header>Sale or lease of assets</header><text display-inline="yes-display-inline">If a public housing agency sells or leases any asset (including roof space or parking) of a public housing project owned by such public housing agency in connection with a solar energy project, such public housing agency shall—</text><paragraph id="H436D17931DA4468A9094244E9ED2B880"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that such sale or lease financially benefits, as determined by a cost-benefit analysis that is conducted using generally accepted accounting standards and is made publicly available—</text><subparagraph id="H1C0C7A37587D424DA8D53AEB04CBDBF4"><enum>(A)</enum><text>the residents of such public housing project; and</text></subparagraph><subparagraph id="HDC9BEC8C9F084476A95B29C675BEF109"><enum>(B)</enum><text>the budget of the public housing agency;</text></subparagraph></paragraph><paragraph id="H096380C6A89C400ABF46CEDA37CAE52B"><enum>(2)</enum><text>if the buyer or lessee of such asset intends to derive a product or services from such asset, require the buyer or lessee of such asset to first offer such product or service derived from such asset to the residents of the public housing project, and provide the product or services to those residents who accept the offer before offering the product or service to non-residents;</text></paragraph><paragraph id="H5C444D609F414149B93C5677866A4B44"><enum>(3)</enum><text>make available publicly, not later than 30 days before such sale or lease, information sufficient to demonstrate compliance with paragraphs (1) and (2) of this subsection; and</text></paragraph><paragraph id="HACA279972F654AE198FC2CD16EDBD566"><enum>(4)</enum><text>not later than 1 year after the sale or lease, submit to the Secretary a report that describes how the sale or lease complies with this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD754E63117DB4278A8CA5DA6A37CDA05"><enum>(b)</enum><header>PHA annual plan</header><text>Section 5A(d) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437c-1">42 U.S.C. 1437c–1(d)</external-xref>) is amended—</text><paragraph id="H43745CB19EED409196EA6C3092C1B3BE"><enum>(1)</enum><text>by redesignating paragraph (19) as paragraph (20); and</text></paragraph><paragraph id="HD93F0776490A46F29E56498D51F0A75E"><enum>(2)</enum><text>by inserting after paragraph (18) the following:</text><quoted-block display-inline="no-display-inline" id="HECB340861A8542C4AD58C451FAD52F39" style="OLC"><paragraph id="H5ABCBEF585F540AEA6E00E9E4BB73D92"><enum>(19)</enum><header>Sale or lease of assets</header><text display-inline="yes-display-inline">With regard to any assets of any public housing project owned by the public housing agency that the public housing agency intends to sell or lease in connection with a solar energy project in the upcoming year—</text><subparagraph id="HB7DAC8883B60419080D9D23682C1389A"><enum>(A)</enum><text>a description of the asset;</text></subparagraph><subparagraph id="H1524882A8F4345DFB78FC20A898703CB"><enum>(B)</enum><text>a description of the proposed terms of the sale or lease, if possible; and</text></subparagraph><subparagraph id="H6D56316DA82A4E42A953149275331EE6"><enum>(C)</enum><text display-inline="yes-display-inline">a description of how the lease or sale will comply with section 9(p), including how such sale or lease financially benefits, as determined by a cost-benefit analysis that is conducted using generally accepted accounting standards, the residents of the public housing project and the budget of the public housing agency.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA1ADD6DF6DB54A389A3B924EEAE75675"><enum>(c)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">This section and the amendments made by this section may not be construed to authorize or encourage the sale or lease of any public housing asset.</text></subsection></section></legis-body></bill>
