<official-title display="yes">To establish a national commission to investigate the seditious attack on the United States Capitol and Congress on January 6, 2021, address the systemic failures in the United States Capitol security and intelligence apparatus to accurately assess outside threats, and study and propose recommendations to realign the mission of the United States Capitol Police, and for other purposes.</official-title>

<section id="H35A08748610E4B7AB6E631D2ED32FFD7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Congressional Oversight of Unjust Policing Act</short-title></quote>.</text></section> <section id="HB124F2D5A5B64CF5ACE7AB5C0F67A02D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="H11A9098B73674F608B14829F88B22EEC"><enum>(1)</enum><text>On January 6, 2021, organized individuals violently attacked the United States Capitol while both chambers of Congress were in session, putting the lives of Members, Congressional staff, and support staff at risk.</text></paragraph> <paragraph id="HE5116A6C73294C5F8DDAC981C2017163"><enum>(2)</enum><text>Various media reports suggest that certain members of rank and file law enforcement officers aided and abetted individuals who breached security at the Capitol on January 6.</text></paragraph>
<paragraph id="H3C189446AE444ABF9A2D3062CE84A938"><enum>(3)</enum><text>Various media reports indicate that neither the Federal Bureau of Investigation (FBI) nor the Department of Homeland Security (DHS) conducted a risk assessment of demonstration activities, nor issued a joint department bulletin as is customary for large and notable public events.</text></paragraph> <paragraph id="HD98CEA073CC046A4936315697EDA7445"><enum>(4)</enum><text display-inline="yes-display-inline">Officers Brian Sicknick and Howard Liebengood died after defending the Capitol Complex and protecting those serving and working there on January 6, 2021.</text></paragraph>
<paragraph id="HB4C9E8806A2B4315A0E045D3C54A4181"><enum>(5)</enum><text display-inline="yes-display-inline">The United States Capitol Police provides limited information to the public about employee misconduct, and the Office of the Inspector General of the United States Capitol Police does not publicly disclose its reports, unlike the vast majority of other Inspectors General.</text></paragraph> <paragraph id="H0852D83B2C3B4EBAA4EDE0A43E6B93CE"><enum>(6)</enum><text>In recent decades, community organizers have formed social justice and criminal reform movements to call for substantive changes in response to various incidents across the country in which law enforcement has used excessive force against civilians, often resulting in the death of those who present or identify as Black or Brown.</text></paragraph>
<paragraph id="H17BDB39FBB4C44479AD49587BBCF0B41"><enum>(7)</enum><text>In the Nation’s Capital, and on the United States Capitol grounds, the disparate treatment of individuals is ever-present, as various Members of Congress and Congressional staff who come from communities of color have documented instances of refusal of entry and mistreatment by United States Capitol Police (USCP) officers.</text></paragraph> <paragraph id="H6BE92B21960E4FF3B7FB7C9E7E295426"><enum>(8)</enum><text>Further, in 2013, agents from the United States Secret Service and United States Capitol Police shot Miriam Carey, an unarmed individual, more than 20 times while she was in her car with her infant, hitting Carey five times and killing her.</text></paragraph>
<paragraph id="H35755CE838EA473D8E97D52BAFACEEEA"><enum>(9)</enum><text>In 2018, United States Secret Service agents took Jessica Ford into custody without excessive force, even though she intentionally rammed a White House checkpoint with a gun in her hand.</text></paragraph> <paragraph id="HE0E3D9D4189347D7A15881A9763005ED"><enum>(10)</enum><text>In 2017, during debates about <external-xref legal-doc="public-law" parsable-cite="pl/115/97">Public Law 115–97</external-xref>, United States Capitol Police officers forcibly dragged peaceful demonstrators from the disability community out of wheelchairs and other supportive medical devices.</text></paragraph>
<paragraph id="H8CA907C1B8A24F849C9BEAF9529D47DD"><enum>(11)</enum><text>In 2020, armed members of the District of Columbia National Guard were dispatched to stand guard on the steps of the Lincoln Memorial amidst peaceful protests.</text></paragraph> <paragraph id="H8EFDE868DA3343A59A5FF3CD55237671"><enum>(12)</enum><text>In 2020, United States Park Police and National Guard troops forced people into unmarked vans and used tear gas and fired rubber bullets to disperse peaceful protestors for the President’s planned visit to St. John’s Episcopal Church.</text></paragraph>
<paragraph id="HF13A6482B687467BA0FD5D8770FF0BF1"><enum>(13)</enum><text>In 2017, the FBI reported that white supremacists posed a <quote>persistent threat of lethal violence</quote> that has produced more fatalities than any other category of domestic terrorists since 2000.</text></paragraph> <paragraph id="H0F963E39578944A182BAEAB66EDEBD5E"><enum>(14)</enum><text>In 2015, the FBI’s Counterterrorism Policy Directive and Policy Guide warned that subjects of <quote>domestic terrorism investigations focused on militia extremists, white supremacist extremists, and sovereign citizen extremists often have identified active links to law enforcement officers</quote>.</text></paragraph>
<paragraph id="H2689A560733F45D0AFC2A1FDC50F7ECB"><enum>(15)</enum><text>A 2006 intelligence assessment, based on FBI investigations and open sources warned of <quote>white supremacist infiltration of law enforcement . . . by organized groups and by self-initiated infiltration by law enforcement personnel sympathetic to white supremacist causes</quote>.</text></paragraph> <paragraph id="H15F6C6121DA54E019DFA3890AB966148"><enum>(16)</enum><text>Since 2000, hundreds of Federal, State, and local law enforcement officials have been caught expressing racist, nativist, and sexist views on social media.</text></paragraph></section>
<section id="H09C828D61CEF4CC3A1DF201B8B8A7FE6"><enum>3.</enum><header>Establishment of U.S. Commission on Unjust Policing</header>
<subsection id="HBF574C8BA179428AA31AE0513BEC4374"><enum>(a)</enum><header>Establishment</header><text>There is established a commission to be known as the <quote>U.S. Commission on Unjust Policing</quote> (in this Act referred to as the <quote>Commission</quote>).</text></subsection> <subsection id="HA6043B3B566C445AAAB9EBCB83BA8D87"><enum>(b)</enum><header>Membership</header> <paragraph id="H9689F41D338048939CEB66039F3FE129"><enum>(1)</enum><header>Composition</header><text>The Commission shall be composed of 19 members appointed as follows:</text>
<subparagraph id="HEF282EBD8FF447159150A621BDEF4C41"><enum>(A)</enum><text>8 members shall be appointed by the leadership of Congress, of whom—</text> <clause id="HB6BD7DD509984FCF8B3ABEEFAE38A85F"><enum>(i)</enum><text>2 shall be appointed by the majority leader of the Senate;</text></clause>
<clause id="HAF74CDE4EBCD4A099C3A35D9E17DCD93"><enum>(ii)</enum><text>2 by the minority leader of the Senate;</text></clause> <clause id="H6CFBB33BA9D947E1B8D250EA5EF06720"><enum>(iii)</enum><text>2 by the Speaker of the House of Representatives; and</text></clause>
<clause id="H071495FDE3094C82AB07C835C7E33E73"><enum>(iv)</enum><text>2 by the minority leader of the House of Representatives.</text></clause></subparagraph> <subparagraph id="H1D75854CF4424BC1A865D964BF372C55"><enum>(B)</enum><text>8 members shall be appointed by the Chairs of the following caucuses—</text>
<clause id="H76FAED5E18F849C48E57B410075951B5"><enum>(i)</enum><text>2 shall be appointed by the Congressional Black Caucus;</text></clause> <clause id="HB5D9777DC0B145BD81CA65FA5DD4BE61"><enum>(ii)</enum><text>2 by the Congressional Hispanic Caucus;</text></clause>
<clause id="HA1EDAFAE15C440428505088A4E7172DB"><enum>(iii)</enum><text>2 by the Congressional Asian Pacific American Caucus; and</text></clause> <clause id="H3F662965210947DEBE5A5E8F4867830A"><enum>(iv)</enum><text>2 by the Congressional Progressive Caucus.</text></clause></subparagraph>
<subparagraph id="HBD189349A1534D74BD305FD5FD2112D6"><enum>(C)</enum><text display-inline="yes-display-inline">3 members shall be appointed by the President, each of whom shall be individuals who are not officers or employees of the Federal Government and who are experts in at least one of the following categories:</text> <clause id="H2646E6EFF39E411F9B2395B557B7DCE5"><enum>(i)</enum><text>Racial equity in law enforcement.</text></clause>
<clause id="HB94F226784BE4A03B8C4569C226180E8"><enum>(ii)</enum><text>Preventing white nationalist extremist violence.</text></clause> <clause id="H9CCA1EB667604336832CAE781FDBB718"><enum>(iii)</enum><text>Large-scale reform of law enforcement agencies.</text></clause></subparagraph></paragraph>
<paragraph id="HD693DC84B8474F56984417B9DED8900E"><enum>(2)</enum><header>Qualifications</header>
<subparagraph id="HFB9ECD7353404CEC8C3BA190C2FA3661"><enum>(A)</enum><header>Areas of expertise</header><text>Each member of the Commission shall have knowledge or expertise, whether by education, experience, training, or activism, in at least one of the following areas: </text> <clause id="H2CD1A0842DBA4886B1C445D4D7F4C28A"><enum>(i)</enum><text>Justice and civil rights.</text></clause>
<clause id="HEEEFEE9D93864D2B8C518C7ED35673AF"><enum>(ii)</enum><text>Law enforcement and intelligence oversight and reform.</text></clause> <clause id="HC735AEC75681420DBF730F8AECA89CC1"><enum>(iii)</enum><text>Diverse and inclusive personnel management.</text></clause>
<clause id="H0E69A6234AB545A3BB50B186CA5DE79F"><enum>(iv)</enum><text>Social and emotional development.</text></clause> <clause id="HCA180A4A08F547D8B221F23D5177F3BF"><enum>(v)</enum><text>Effective education and training methods to combat implicit and unconscious bias.</text></clause>
<clause id="H75B66873A50F4617A20F28C08E33E677"><enum>(vi)</enum><text>Behavioral economics.</text></clause> <clause id="HABF42724B71140FDA1ADCE28056782C5"><enum>(vii)</enum><text display-inline="yes-display-inline">Combating white supremacist, and other extremist groups, movements, and organizing efforts.</text></clause></subparagraph>
<subparagraph id="H42AC10AA14DF43AFB3BCD1E595501C85"><enum>(B)</enum><header>Special rule for members appointed by congressional leadership</header><text>Each of the persons appointing members of the Commission under paragraph (1) shall ensure that one of the members so appointed is an individual who is not an officer or employee of the Federal Government.</text></subparagraph> <subparagraph id="H7784C200748A4D18ABFBF6490863601C"><enum>(C)</enum><header>Civilian representation</header><text>Not fewer than 4 members of the Commission shall be individuals who are not officers of law enforcement agencies.</text></subparagraph>
<subparagraph id="H568A358FD277437995189335DF1728EC"><enum>(D)</enum><header>Diversity</header><text>It is the intent of Congress that persons appointed to the Commission under paragraph (1) be persons who represent diverse economic, professional, and social backgrounds.</text></subparagraph></paragraph> <paragraph id="H6E9FEF2A1A3B409B8B1276A70B551EB6"><enum>(3)</enum><header>Consultation and appointment</header> <subparagraph id="H9BD4686A25C540D9B105D51F4C2DD60D"><enum>(A)</enum><header>In general</header><text>The President, Speaker of the House of Representatives, minority leader of the House of Representatives, majority leader of the Senate, and minority leader of the Senate shall consult among themselves before appointing the members of the Commission in order to achieve, to the maximum extent practicable, representation of various fields of expertise to ensure maximum impact by the Commission.</text></subparagraph>
<subparagraph id="H62449D97B49347FEB497A2C408731FAE"><enum>(B)</enum><header>Completion of appointments</header><text>The President, Speaker of the House of Representatives, minority leader of the House of Representatives, majority leader of the Senate, and minority leader of the Senate shall conduct the consultation under subparagraph (A) and make their respective appointments not later than 60 days after the date of enactment of this Act.</text></subparagraph> <subparagraph id="H6AF56F2B3C3F4A33972B2AC77A219CB8"><enum>(C)</enum><header>Vacancies</header><text>A vacancy in the membership of the Commission shall not affect the powers of the Commission and shall be filled in the same manner as the original appointment not later than 30 days after the vacancy occurs.</text></subparagraph></paragraph>
<paragraph id="HC051F0C6A9A5463DBA8501E91B53B005"><enum>(4)</enum><header>Terms</header><text>Each member of the Commission shall serve for a term of one year, and may be reappointed to additional terms.</text></paragraph> <paragraph id="H7E72CCB58C5D4605BD2D0C2BAC62447E"><enum>(5)</enum><header>Removal</header><text>Subject to the approval of a majority of the members of the Commission, a member of the Commission may be removed for cause at any time by the person who appointed the member if the member fails to meet responsibilities of the commission.</text></paragraph></subsection>
<subsection id="HF1996AD73AF24C7EA96B3E71ED273BBD"><enum>(c)</enum><header>Meetings</header>
<paragraph id="H704FF625B6D24F87A2F898C29F4F5C8A"><enum>(1)</enum><header>Initial meeting</header><text>Not later than 30 days after the date on which all members of the Commission have been appointed, the Commission shall hold its first meeting.</text></paragraph> <paragraph id="HCFF5D5986D7842D08B0FDB34CF19F1D2"><enum>(2)</enum><header>Subsequent meetings</header> <subparagraph id="H6B97EB1D3F7F4FBF9FDB74C27E41E2B5"><enum>(A)</enum><header>In general</header><text>The Commission shall meet at the call of the Chair.</text></subparagraph>
<subparagraph id="H92345ACC8CE143E1BC33E417A05B3828"><enum>(B)</enum><header>Frequency</header><text>The Chair shall call a meeting of the members of the Commission not less frequently than once every 3 months.</text></subparagraph></paragraph> <paragraph id="H75BE2D28E6B144E3AC9153DE05CE2DD3"><enum>(3)</enum><header>Quorum</header><text>Ten members of the Commission shall constitute a quorum, but a lesser number may hold hearings.</text></paragraph>
<paragraph id="HA4382AA5E76A4EFF9FA715B5ADD58680"><enum>(4)</enum><header>Chair and vice chair</header><text>The Commission shall select a Chair and Vice Chair from among its members. The Chair and Vice Chair shall serve in that position for a term of 1 year and may be reappointed for additional terms.</text></paragraph> <paragraph id="H945E22EE9B6B47B1B73AC951A3A19217"><enum>(5)</enum><header>Transparency and public input</header><text>Each meeting of the Commission for which a quorum is present shall be open to the public, either in person or remotely through digital technology, and the Commission shall establish procedures for members of the public to submit testimony at Commission meetings regarding the topics presented during such meetings.</text></paragraph></subsection></section>
<section id="H3449457F935C4B0498B86940516B3B06"><enum>4.</enum><header>Duties of commission</header>
<subsection id="HF2A7D72BC45F48F89A2C001BC5D0CF88"><enum>(a)</enum><header>In general</header><text>The duties of the Commission are as follows:</text> <paragraph id="HA46443CB520A401382139F0148B4DCA3"><enum>(1)</enum><text>To carry out a comprehensive investigation into decisions of leadership at the United States Capitol Police, the Federal Bureau of Investigation, the United States Secret Service, and the Department of Homeland Security, leading up to and during the siege of the United States Capitol on January 6, 2021, including an assessment on whether conscious and unconscious bias was a factor in the gross miscalculation of the risk posed by protestors to Members of Congress and staff on that date.</text></paragraph>
<paragraph id="HAE08E9699542497ABA54FBB91E4C0528"><enum>(2)</enum><text display-inline="yes-display-inline">To carry out a comprehensive investigation in coordination with the Federal Bureau of Investigation and other Federal entities as appropriate into whether current members of the United States Capitol Police have ties to white supremacist and other extremist groups, movements, and organizing efforts; and whether any members of the United States Capitol Police neglected their duty and colluded with protestors or other law enforcement entities.</text></paragraph> <paragraph id="H37BEFDA98A4C4435A60A5A6692696082"><enum>(3)</enum><text display-inline="yes-display-inline">To recommend specific measures and reforms to Congress and other stakeholders on how the United States Capitol Police must realign priorities and practice to address disparate use of force and surveillance targets in and around the Capitol Complex, including changes to existing law, changes to Federal programs, and suggestions for actions the private sector can take.</text></paragraph>
<paragraph id="H185FC5FC3F984C5E9768ABBF0C820619"><enum>(4)</enum><text>To recommend specific measures and reforms to Congress and other stakeholders to realign recruitment, hiring, and retention policies and practices of the United States Capitol Police to address both conscious and unconscious biases, including changes to existing law, changes to Federal programs, and suggestions for actions the private sector can take.</text></paragraph></subsection> <subsection id="H505E794A25314EA293F81DCA4314C064"><enum>(b)</enum><header>Consultation with other departments and agencies</header><text>In carrying out its duties, the Commission shall consult with officials of appropriate departments and agencies of the Federal Government, including each of the following:</text>
<paragraph id="H1BC430E3BEDC43CEAC408CCD5A4B05E7"><enum>(1)</enum><text>The Federal Bureau of Investigation.</text></paragraph> <paragraph id="H79825A23BE8E46339EB7792D97086BCE"><enum>(2)</enum><text>The United States Secret Service.</text></paragraph>
<paragraph id="HC353C9BB37ED4296AA42B5FE2EBE55F6"><enum>(3)</enum><text>The Department of Homeland Security.</text></paragraph> <paragraph id="HFE9B50A2357F45BC853FE225CBB49AAA"><enum>(4)</enum><text>The Department of Justice.</text></paragraph></subsection>
<subsection id="HAA7361125B294BF0AEDEEA803E7EAB66"><enum>(c)</enum><header>Reports</header>
<paragraph id="H09D478C119E642A091E0076CDDB481B2"><enum>(1)</enum><header>Ongoing reports</header><text>Because it is the intent of Congress that the Commission expeditiously and carefully identify and rectify inequities in how law enforcement at the Capitol Complex surveils and protects members of the Congressional community, not later than 9 months after the date of the enactment of this Act, the Commission shall submit to Congress and the President an initial report on the issues described in subsection (a) and related issues.</text></paragraph> <paragraph id="HC0FC85E7C8B74ED59EB1E625898E37A7"><enum>(2)</enum><header>Annual report</header><text>In the year following its first meeting and annually thereafter, the commission shall provide to Congress and the public a report on the status of its work.</text></paragraph>
<paragraph id="HD5A215CB8DA8405ABEBB0C3FD96A3146"><enum>(3)</enum><header>Internet availability</header><text>All reports of the Commission shall be available to the public via a publicly accessible Federal website that is prominently marketed and shared by the Commission.</text></paragraph></subsection></section> <section id="H496E7AFE6E364E1A8E251802F32BDB3A"><enum>5.</enum><header>Powers of commission</header> <subsection id="HB4DE539EA06949DF83EF7D3DFDB926A9"><enum>(a)</enum><header>Hearings</header><text>The Commission may hold such hearings, sit and act at such times and places, take such testimony, and receive such evidence as the Commission considers appropriate to carry out its duties under this Act.</text></subsection>
<subsection id="H744CE914AC954CF1A8DB9CCCC08DE018"><enum>(b)</enum><header>Powers of members and agents</header><text>If authorized by the Commission, any member or agent of the Commission may take any action which the Commission is authorized to take under this Act.</text></subsection> <subsection id="HD1FF4354EE1E43D28BF492211BAE1324"><enum>(c)</enum><header>Information from Federal agencies</header> <paragraph id="H577F28AB4B7543C69C62286208C6ACB2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall secure directly from any Federal department or agency such information as the Commission considers necessary to carry out the provisions of this Act. Upon the request of the Chair of the Commission, the head of such department or agency shall furnish such information to the Commission as expeditiously as practicable.</text></paragraph>
<paragraph id="H34413C1AB5754762B083A74BBD8032E4"><enum>(2)</enum><header>Treatment of classified information</header><text>In the case of information sought by the Commission under paragraph (1) that is classified, the Federal department or agency involved shall provide the Commission with an unclassified summary of the information, except that any Member of the Commission who has received an appropriate security clearance that is commensurate with the sensitivity of the classified information involved may receive such classified information.</text></paragraph></subsection> <subsection id="H67E83D45E3584B26B47DBB5F1E6A75F5"><enum>(d)</enum><header>Administrative support services</header><text>Upon the request of the Commission, the Administrator of the General Services Administration shall provide to the Commission, on a reimbursable basis, administrative support services necessary for the Commission to carry out its responsibilities under this Act.</text></subsection>
<subsection id="H0E5DB4A295FD4EADB221D4A9DC670EE6"><enum>(e)</enum><header>Contract authority</header>
<paragraph id="HA2D8BE731FE346F38C86A9D7D662E552"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Commission is authorized—</text> <subparagraph id="H5F1701656D7E4157954547F12C34863A"><enum>(A)</enum><text>to procure supplies, services, and property; and</text></subparagraph>
<subparagraph id="HDC46D2946CB74227AD6D356944A4FE25"><enum>(B)</enum><text>to make or enter into contracts, leases, or other legal agreements.</text></subparagraph></paragraph> <paragraph id="HFD612EAB49B44FF69C5EFD049C1F0ECC"><enum>(2)</enum><header>Limitation</header><text>The Commission may not enter into any contract, lease, or other legal agreement that extends beyond the date of the termination of the Commission under section 7(a).</text></paragraph></subsection>
<subsection id="HB795EAC2C2974FEEA5B1A61A2B8978D1"><enum>(f)</enum><header>Postal services</header><text>The Commission may use the United States mail in the same manner and under the same conditions as other departments and agencies of the Federal Government.</text></subsection> <subsection id="H5D480790AAC641B7803AF92BA9AD20FD"><enum>(g)</enum><header>Gifts, bequests, and devises</header><text>The Commission is authorized to solicit, accept, use, and dispose of gifts, bequests, or devises of money, services, or property, both real and personal, for the purpose of covering the costs incurred by the Commission to carry out its duties under this Act.</text></subsection></section>
<section id="HF4C59E53429C4793B88A63337AAC0519"><enum>6.</enum><header>Commission personnel matters</header>
<subsection id="H62CBB139FE4D4DEEB100E772C0EEAC8F"><enum>(a)</enum><header>Compensation of members</header><text>Members of the Commission shall serve without compensation for their service, but may receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subsection> <subsection id="H2C5E9A1DC1534A76BBCEB7B9AA43F25B"><enum>(b)</enum><header>Staff</header> <paragraph id="HD09E1D2ECB374DCA9923E50E18868609"><enum>(1)</enum><header>In general</header><text>The Chair of the Commission shall, in consultation with the members Commission, appoint an executive director and such other additional personnel as may be necessary to enable the Commission to perform its duties.</text></paragraph>
<paragraph id="HBCD0E38786784C64977D279ECF2D7AFD"><enum>(2)</enum><header>Compensation</header><text>The Chair of the Commission may appoint the executive director and other personnel without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and may fix their pay without regard to the provisions of chapter 51 and subchapter III of chapter 53 of that title relating to classification and General Schedule pay rates, except that an individual so appointed may not receive pay in excess of the annual rate of pay for level IV of the Executive Schedule under section 5315 of title 5, United States Code.</text></paragraph> <paragraph id="H1CE11C77B41A4D3A9699DD7CF4E00F22"><enum>(3)</enum><header>Application of Congressional Accountability Act of 1995</header><text display-inline="yes-display-inline">For purposes of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref> et seq.)—</text>
<subparagraph id="HA1330E45C15041EDA546D8EA0D400939"><enum>(A)</enum><text>the Commission shall be considered an employing office; and</text></subparagraph> <subparagraph id="HB2874394B7E945CEB8E50B8EEE9AEB58"><enum>(B)</enum><text>the employees of the Commission shall be considered covered employees.</text></subparagraph></paragraph></subsection>
<subsection id="HB2574A60B1DF4F4CAFE4C343D0110CBB"><enum>(c)</enum><header>Detail of government employees</header><text>Upon request of the Commission, the head of any Federal department or agency may detail, on a reimbursable basis, any employee of that department or agency to the Commission to assist it in carrying out its duties under this Act.</text></subsection> <subsection id="H3A564E27C05C4121AA51394EF9A2051A"><enum>(d)</enum><header>Acceptance of voluntary services</header><text>Notwithstanding section 1342 of title 31, United States Code, the Commission may accept and use voluntary and uncompensated services as the Commission deems necessary.</text></subsection></section>
<section id="H1F654B1A36934083A70949D7E1A44757"><enum>7.</enum><header>Termination of commission</header>
<subsection id="H6B817E091D114D2FB38DA9093CFAF941"><enum>(a)</enum><header>In general</header><text>The Commission shall terminate on the earlier of—</text> <paragraph id="HD89684B82A6340AE94EB08263E1FD786"><enum>(1)</enum><text>the date that is 2 calendar years after the initial meeting of the Commission; or</text></paragraph>
<paragraph id="HFEFCA915538C4786A14A020CD7B7062B"><enum>(2)</enum><text>upon completion and presentation of all reports to Congress from the Commission.</text></paragraph></subsection> <subsection id="H5E702F8279AB4E2DA96D9B22044FCB3C"><enum>(b)</enum><header>Application of Federal Advisory Committee Act</header> <paragraph id="HBB11154D390448C3A06CFCBD14DC53DB"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the provisions of the Federal Advisory Committee Act (5 U.S.C. App.) shall apply to the activities of the Commission under this Act.</text></paragraph>
<paragraph id="H67DF04BE0C844B7E8C4A91436D6E729E"><enum>(2)</enum><header>Exception</header><text>Section 14(a)(2) of such Act (5 U.S.C. App.) shall not apply to the Commission.</text></paragraph></subsection></section> <section id="H1D06F1379F914E3B9751E99AD6FF4C8A"><enum>8.</enum><header>Authorization of appropriations</header> <subsection id="H06E15A019E2840A09867E8EAF44516E6"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated to carry out this Act such sums as may be necessary for each of the first 2 fiscal years which begin after the date of the enactment of this Act.</text></subsection>
<subsection id="HD76C1D0A96E6437B9BCCFA9A862CDB41"><enum>(b)</enum><header>Amounts available</header><text>Amounts appropriated in accordance with this section for any fiscal year shall remain available until the termination of the Commission.</text></subsection></section> </legis-body> </bill>
