Davis of Illinois</sponsor> (for himself, <cosponsor name-id="S001145">Ms. Schakowsky</cosponsor>, and <cosponsor name-id="R000515">Mr. Rush</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Intercity Passenger Rail Trust Fund to ensure a safe, sustainable, convenient transportation option for the people of the United States, and for other purposes.</official-title></form><legis-body id="HEEE9DFC514454A3CB1A9D9CF7AAF1090" style="OLC"><section section-type="section-one" id="H0E1688A303AA440FBE34F133E6F69932"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Intercity Passenger Rail Trust Fund Act</short-title></quote>.</text></section><section id="H2145621EDACF4BEF8761C6FFADEC55BB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="H4FD0D216451A419FA8C7DDA1CDC8C59B"><enum>(1)</enum><text>An effective transportation system for the Nation requires dedicated, predictable Federal funding for various capital and operating expenses, as demonstrated by the Highway Trust Fund, which supports all Federal highway programs, most public transit programs, and many Federal transportation safety programs.</text></paragraph><paragraph id="HFB498E44865248DD932296274C08EF05"><enum>(2)</enum><text>Intercity passenger rail is the only surface transportation mode in the United States that—</text><subparagraph id="H0E1BD5295BC540BE9CDE4FA42DEA69DB"><enum>(A)</enum><text>does not receive any Federal funding through a trust fund for capital investment; and</text></subparagraph><subparagraph id="HA9466A496FA744F89661745E53E47EDA"><enum>(B)</enum><text>is completely dependent on annual discretionary appropriations for both its capital expenses and its operating costs.</text></subparagraph></paragraph><paragraph id="HEC38A49B2EBA4A6694D1630D568CB7AB"><enum>(3)</enum><text>In fiscal year 2019, Amtrak experienced record ridership, a historic low operating loss, and a record capital spend rate.</text></paragraph><paragraph id="H79D0647D7530488983FECF544DF1283C"><enum>(4)</enum><text>In markets with sufficient infrastructure and train frequency, Amtrak has proven to be an effective mode of transportation compared to commercial air and bus service and private automobile use.</text></paragraph><paragraph id="H103247024ECD43D3965572EC376B13ED"><enum>(5)</enum><text>Intercity passenger rail offers substantial safety, energy, and environmental advantages compared to most other transportation modes, but decades of in sufficient capital funding has drastically limited the role that intercity passenger rail can play in the Nation’s overall transportation network.</text></paragraph><paragraph id="H893C8D6DCEFE4B2BA7DA58F399B5F7B8"><enum>(6)</enum><text>There are critical capital needs for the Northeast Corridor and the National Network, including infrastructure, fleet, stations, and facilities.</text></paragraph><paragraph id="H2A53F236CF27425E8654E4C43A34F9BA"><enum>(7)</enum><text>Adding to the urgency of these capital investment needs, due to changing demographics, population growth, urbanization, and changing travel trends, intercity passenger rail will be needed to help move our Nation into the future. </text></paragraph><paragraph id="H6D87000F224A4C35A9ACBD9E7CE98CEF"><enum>(8)</enum><text>For these reasons, an Intercity Passenger Rail Trust Fund is needed now, more than ever, to ensure a safe, sustainable, convenient transportation option for the people of the United States.</text></paragraph></section><section id="HD6ECB2BC3381488B8EB798AFC20A410F"><enum>3.</enum><header>Intercity Passenger Rail Trust Fund</header><subsection id="HA61D069CF6524579861DDEAA0073CAC9"><enum>(a)</enum><header>In general</header><text>Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/98">chapter 98</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9B1DE54E50C44D799A86944A5D693443"><section id="H351236DF9FDC4FF195CEFF41F202044D"><enum>9512.</enum><header>Intercity Passenger Rail Trust Fund</header><subsection id="H8E997810C1E14927A6C2933CC6625E6D"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a trust fund, which shall be known as the <quote>Intercity Passenger Rail Trust Fund</quote>, consisting of such amounts as may be appropriated or credited to the Intercity Passenger Railroad Trust Fund as provided in this section and section 9602(b).</text></subsection><subsection id="H2B4D75960AFD41D9870C5D35357BD7E7"><enum>(b)</enum><header>Transfer to Intercity Passenger Rail Trust Fund</header><paragraph id="H242EFC6C72FD4C348CBEEE95CFC2D424"><enum>(1)</enum><header>In general</header><text>There is hereby appropriated to the Intercity Passenger Rail Trust Fund for fiscal year 2022, and for each fiscal year thereafter, an amount equal to 50 percent of the average annual amounts appropriated to the Highway Trust Fund under section 9503 for fiscal years 2008 through 2020.</text></paragraph><paragraph commented="no" id="HECFA37000DA149248803ED34E0CAA401"><enum>(2)</enum><header>Authorization of appropriation of additional sums</header><text>There are hereby authorized to be appropriated to the Intercity Passenger Rail Trust Fund such additional sums as may be required to make the expenditures referred to in subsection (c).</text></paragraph></subsection><subsection id="H716F159F836A4B16A5242A6256553902"><enum>(c)</enum><header>Expenditures from the Intercity Passenger Rail Trust Fund</header><text>Amounts in the Intercity Passenger Rail Trust Fund shall be available for obligation without further appropriations action for making expenditures to carry out section 24314 of title 49.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0CA36F9DEDA24B0A89807610649B95C0"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subchapter A of chapter 98 of such Code is amended by adding at the end the following new item:</text><quoted-block style="OLC" id="H2E7ACB5FE864466980AE75925EA4370B"><toc><toc-entry level="section" idref="H351236DF9FDC4FF195CEFF41F202044D">Sec. 9512. Intercity Passenger Rail Trust Fund.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H75755E8BF2B7448B9DCEF5353B416FF3"><enum>4.</enum><header>Intercity Passenger Rail Trust Fund expenditures</header><subsection id="HCF9FE47BBC394BE5B7C7BD5049FE66C6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/243">Chapter 243</external-xref> of title 49, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/49/24313">section 24313</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HED5BF3065A4640DC99759965005AE72F"><section id="H844525CC4611454FB4C4FFCFC4D533B0"><enum>24314.</enum><header>Intercity Passenger Rail Trust Fund expenditures</header><subsection id="H33D7174CF1E84E53B2BE57BE7BDEAC7B"><enum>(a)</enum><header>Expenditures from the Intercity Passenger Rail Trust Fund</header><text>Amounts deposited into the Intercity Passenger Rail Trust Fund each fiscal year pursuant to <external-xref legal-doc="usc" parsable-cite="usc/26/9512">section 9512(b)</external-xref> of the Internal Revenue Code of 1986 shall be available for obligation, without further appropriation, in accordance with the ratios set forth in subsection (b). Amounts made available under this section shall remain available until expended.</text></subsection><subsection id="H86D2C050067747E59767618B0058AA35"><enum>(b)</enum><header>Intercity Passenger Rail Trust Fund expenditure ratios</header><text>The Secretary may use amounts deposited into the Intercity Passenger Rail Trust Fund each fiscal year to award grants to Amtrak, in accordance with the process described in section 24319. Of the grant funds awarded pursuant to this subsection—</text><paragraph id="H8984663AB9904045A5B94281A81B6A38"><enum>(1)</enum><text>40 percent shall be used for activities associated with the Northeast Corridor; and</text></paragraph><paragraph id="H4763DD749F9A4258B1998C5B0B3D7F3B"><enum>(2)</enum><text>60 percent shall be used for activities associated with the National Network.</text></paragraph></subsection><subsection id="H42633DFDACEA4370A9A94956971B2659"><enum>(c)</enum><header>Savings provision</header><text>Nothing in this section may be construed as prohibiting discretionary funding from being provided to Amtrak.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0E7A903DBCCF49709BC6ECF2D1351F35"><enum>(b)</enum><header>Conforming amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/243">chapter 243</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/24313">section 24313</external-xref> the following:</text><quoted-block style="USC" id="H58B895529F7B4104A9C880931F3538F5"><toc><toc-entry level="section" idref="H844525CC4611454FB4C4FFCFC4D533B0">24314.
