which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Energy to establish a program to increase participation in community solar and the receipt of associated benefits, and for other purposes.</official-title></form><legis-body id="H92568E51AFE6497D9011432D61CCCECC" style="OLC"><section id="HE6BF082D893546549332E0F42CBFB157" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community Solar Consumer Choice Act of 2021</short-title></quote>.</text></section><section id="H503D60F344FD4B6787994EA19918CA6D"><enum>2.</enum><header>Community solar consumer choice program; Federal Government participation in community solar</header><subsection id="H53C86C5D065745E590428FAB1F3DC42C"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H7C5A21226C1747128E62B1E929BABDDB"><enum>(1)</enum><header>Community solar</header><text>The term <term>community solar</term> means a solar power plant, the benefits of the electricity produced by which are shared by two or more electricity customers.</text></paragraph><paragraph id="HA52B8EA7949E4FEE8D95EBA5F6B6C2BF"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="HFD929E53CF4C4395AA65A58D1E96F8EE"><enum>(3)</enum><header>Subscriber</header><text>The term <term>subscriber</term> means an electricity customer who receives a benefit associated with the proportional output of the community solar facility of the customer.</text></paragraph></subsection><subsection id="HC80F8C0D13D5446D9555A79D783D9A70"><enum>(b)</enum><header>Establishment of community solar consumer choice program</header><paragraph id="HA9C1E416724A40BFBB1957A020C45B3B"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall establish a program to expand community solar options to—</text><subparagraph id="H2746D65D6FA74EF3A858E0A40CEC3AA3"><enum>(A)</enum><text>individuals, particularly individuals that do not have regular access to onsite solar, including low- and moderate-income individuals;</text></subparagraph><subparagraph id="H2764FB2A2383491F89432FCE64C7AC97"><enum>(B)</enum><text>businesses;</text></subparagraph><subparagraph id="H4277E7B341B74552A3AA886EA7F6872E"><enum>(C)</enum><text>nonprofit organizations; and</text></subparagraph><subparagraph id="H293B453327D94E52A591B4EC4E61125B"><enum>(D)</enum><text>States and local and Tribal governments.</text></subparagraph></paragraph><paragraph id="H315E173EF2F444C0B3463564222C1185"><enum>(2)</enum><header>Alignment with existing Federal programs</header><text>The Secretary shall align the program under paragraph (1) with existing Federal programs that serve low-income communities.</text></paragraph><paragraph id="H8395CA85D4A2414FBAF07AC8C28FCCC1"><enum>(3)</enum><header>Assistance to State and local governments</header><text>In carrying out the program under paragraph (1), the Secretary shall—</text><subparagraph id="HD06EC697EDD64EB5B5875EE26A37D418"><enum>(A)</enum><text>provide technical assistance to States and local and Tribal governments for projects to increase community solar;</text></subparagraph><subparagraph id="HE93C1DAAF40E4F149EB7B32D39536900"><enum>(B)</enum><text>assist States and local and Tribal governments in the development of new and innovative financial and business models that leverage competition in the marketplace in order to serve community solar subscribers; and</text></subparagraph><subparagraph id="H960166C66C474107A1D15CF544B63911"><enum>(C)</enum><text>use National Laboratories (as defined in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>)) to collect and disseminate data to assist private entities in the financing of, subscription to, and operation of community solar projects.</text></subparagraph></paragraph></subsection><subsection id="HF133E21FD94C4FF3B44315D8636F556F"><enum>(c)</enum><header>Federal Government participation in community solar</header><text>The Secretary will expand the existing grant, loan, and financing programs to include community solar projects (as defined in paragraph (20) of section 111(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)</external-xref>), as added pursuant to section 3 of this Act).</text></subsection></section><section id="H1E1672B9A3DB49B8B8EC81C97F584BEF"><enum>3.</enum><header>Establishment of community solar programs</header><subsection id="H7E998377D5FB4EC2AE50453EFD79A714"><enum>(a)</enum><header>In general</header><text>Section 111(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H397937984A3549C7911D48383DD36428" style="OLC"><paragraph id="HBBCC8DCF85FF42AD958CDB2257297E48"><enum>(20)</enum><header>Community solar programs</header><text display-inline="yes-display-inline">Each electric utility shall offer a community solar program that provides all ratepayers, including low-income ratepayers, equitable and demonstrable access to such community solar program. For the purposes of this paragraph, the term <term>community solar program</term> means a service provided to any electric consumer that the electric utility serves through which the value of electricity generated by a community solar facility may be used to offset charges billed to the electric consumer by the electric utility. A <quote>community solar facility</quote> is—</text><subparagraph id="HFFF9DDA5DDEA4C8CB6C2C26326BD13A5"><enum>(A)</enum><text>a solar photovoltaic system that allocates electricity to multiple electric consumers of an electric utility;</text></subparagraph><subparagraph id="H70F55FD05B044EB19A1180591CF71895"><enum>(B)</enum><text>connected to a local distribution of the electric utility;</text></subparagraph><subparagraph id="H08FDA2196B564D5282B873929086F3FA"><enum>(C)</enum><text>located either on or off the property of the electric consumers; and</text></subparagraph><subparagraph id="H9B0B52C8ACA44145AAF691FAA87F074F"><enum>(D)</enum><text>may be owned by an electric utility, an electric consumer, or a third party.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H14819F23E3E5406CB81B1EF8DF926026"><enum>(b)</enum><header>Compliance</header><paragraph id="HBF8B1648E63A4F11B979412306DC6D70"><enum>(1)</enum><header>Time limitations</header><text>Section 112(b) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HC322F5750F7D4154946D50E0C65150C8" style="OLC"><paragraph id="HD1B78E52E4644ADDBCE3B16BDECFB1DA"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H748DEF96EB674862917C028CF56644E4"><enum>(A)</enum><text>Not later than 1 year after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority) and each nonregulated utility shall commence consideration under section 111, or set a hearing date for consideration, with respect to the standard established by paragraph (20) of section 111(d).</text></subparagraph><subparagraph id="H7B7B7E23F571494C99A2C9A5E4B6EAFA" indent="up1"><enum>(B)</enum><text>Not later than 2 years after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority), and each nonregulated electric utility shall complete the consideration and make the determination under section 111 with respect to the standard established by paragraph (20) of section 111(d).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H22C2A233331B41D8A81F26827AEC6027"><enum>(2)</enum><header>Failure to comply</header><subparagraph id="HD559B9803C624980B54E53E3894BA79A"><enum>(A)</enum><header>In general</header><text>Section 112(c) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(c)</external-xref>) is amended—</text><clause id="H60BB7A46E0914AA3AB05DD522736F6A8"><enum>(i)</enum><text>by striking <quote>such paragraph (14)</quote> and all that follows through <quote>paragraphs (16)</quote> and inserting <quote>such paragraph (14). In the case of the standard established by paragraph (15) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (15). In the case of the standards established by paragraphs (16)</quote>; and</text></clause><clause id="H9942F30423184305ADE3DA06EFB2E0E5"><enum>(ii)</enum><text>by adding at the end the following: <quote>In the case of the standard established by paragraph (20) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (20).</quote>.</text></clause></subparagraph><subparagraph id="HE8D8D245903C4A9888E51E48372E3111"><enum>(B)</enum><header>Technical correction</header><clause id="H5C6AC8E31D3A4E9B8ABEE0D8DFBBCCED"><enum>(i)</enum><header>In general</header><text>Section 1254(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 971) is amended—</text><subclause id="H7A96311584CC4C5F808462457523BD07"><enum>(I)</enum><text>by striking paragraph (2); and</text></subclause><subclause id="H749C87C7D6FB4F4EACA7D693D8EF7DDF"><enum>(II)</enum><text>by redesignating paragraph (3) as paragraph (2).</text></subclause></clause><clause id="H5536EFE1C2A34E6C9BD7C89917975CBD"><enum>(ii)</enum><header>Treatment</header><text>The amendment made by paragraph (2) of section 1254(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 971) (as in effect on the day before the date of enactment of this Act) is void, and section 112(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(d)</external-xref>) shall be in effect as if those amendments had not been enacted.</text></clause></subparagraph></paragraph><paragraph id="H9E8D1CBE7DAB4277B322280704EF6961"><enum>(3)</enum><header>Prior State actions</header><subparagraph id="H8BDA923D5E2A4E109B8CEF8359542A75"><enum>(A)</enum><header>In general</header><text>Section 112 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HFE4684E5E2874C6EBC2DF9BBEDDE325C" style="OLC"><subsection id="HB23430DD17FA493CA51866C6FAD84198"><enum>(g)</enum><header>Prior State actions</header><text>Subsections (b) and (c) shall not apply to the standard established by paragraph (20) of section 111(d) in the case of any electric utility in a State if, before the date of enactment of this subsection—</text><paragraph id="H1D7183D665A845C18A443D56F864EA13"><enum>(1)</enum><text>the State has implemented for the electric utility the standard (or a comparable standard);</text></paragraph><paragraph id="HDA7B6BBCFBD442C3AE66E8A21FECE201"><enum>(2)</enum><text>the State regulatory authority for the State or the relevant nonregulated electric utility has conducted a proceeding to consider implementation of the standard (or a comparable standard) for the electric utility; or</text></paragraph><paragraph id="HF29892506A8E464394521BE7EC33B1A0"><enum>(3)</enum><text>the State legislature has voted on the implementation of the standard (or a comparable standard) for the electric utility.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="HB0F0D7BC1A464FA4B8EFE9DF421D7A01"><enum>(B)</enum><header>Cross-reference</header><text>Section 124 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2634">16 U.S.C. 2634</external-xref>) is amended by adding at the end the following: <quote>In the case of the standard established by paragraph (20) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (20).</quote>.</text></subparagraph></paragraph></subsection></section><section id="H670EAD4EABC2418AB1FDCDE28824FE0E"><enum>4.</enum><header>Federal contracts for public utility services</header><text display-inline="no-display-inline">Section 501(b)(1) of title 40, United States Code, is amended by striking subparagraph (B) and inserting the following:</text><quoted-block id="H963347324CA7437298D076A34C20E5A9" style="OLC"><subparagraph id="H46E6CB8074A04E74B7A162618FA9730B"><enum>(B)</enum><header>Public utility contracts</header><text display-inline="yes-display-inline">A contract under this paragraph for public utility services may be for a period of not more than 30 years.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
