which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the integration of climate-resilience considerations into all development work of the United States, and for other purposes.</official-title></form><legis-body id="HED4EDAC20DF6455780D601B225F5F072" style="OLC"><section id="H77AFC8C0E4E04FB6A17D460BB0C0D8C2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Climate-Resilient International Development Optimization Act</short-title></quote>.</text></section><section id="H0450996642754A09946611256D94BD38"><enum>2.</enum><header>Climate-resilient international development</header><subsection id="H27DE5E4B2DC840EEB4E72E0687600557"><enum>(a)</enum><header>Incorporating climate resilience into international development</header><paragraph id="H7A88DD7663824C9CA8081230D88A25EB"><enum>(1)</enum><header>Direct international development programs and investments</header><text>The head of each agency with direct international development programs and investments shall carry out the following:</text><subparagraph id="H441D520554A74A5CA093E3B3AB923E79"><enum>(A)</enum><text display-inline="yes-display-inline">Incorporate climate resilience considerations into agency decision making to—</text><clause id="HEA5281AD489C4D75B0FF632CE1E3D246"><enum>(i)</enum><text display-inline="yes-display-inline">assess and evaluate climate-related risks to and vulnerabilities in agency strategies, planning, programs, projects, investments, overseas facilities, and related funding decisions, using best-available climate-change data, tools, and information, including such data, tools, and information identified or developed by the Working Group established under subsection (b)(1); and </text></clause><clause id="H9ADC49564B6E4DB0A70F949BA4E846E4"><enum>(ii)</enum><text display-inline="yes-display-inline">adjust strategies, planning, programs, projects, investments, and related funding decisions of the agency, including the planning for and management of overseas facilities, based on the assessments and evaluations referred to in clause (i).</text></clause></subparagraph><subparagraph id="H4E2461785C9D4D04878B086D853BAE25"><enum>(B)</enum><text display-inline="yes-display-inline">Collaborate with the heads of other agencies with direct international development programs and investments, as appropriate, to share knowledge, data, tools, information, frameworks, and lessons learned in incorporating climate-resilience considerations into agency strategy, planning, programs, projects, investments, and related funding decisions, including the planning for and management of overseas facilities.</text></subparagraph><subparagraph id="HD9B728FBC4EB49EEAA099E7ED53E63A6"><enum>(C)</enum><text display-inline="yes-display-inline">Work with other countries, as appropriate, to—</text><clause id="HDFCA1C965D0849F3B6176C2722E8606D"><enum>(i)</enum><text>identify climate-related risks; </text></clause><clause id="H6563967ABD55425BA667C366DEA52B6F"><enum>(ii)</enum><text>incorporate climate-resilience considerations into international development assistance efforts performed by the agency; and</text></clause><clause id="HD5D9DAB5869A4CCABC0B2381437DC9BE"><enum>(iii)</enum><text display-inline="yes-display-inline">identify knowledge, practices, tools, and data of such other countries and multilateral organizations that can be used by the United States to improve the activities described in clauses (i) and (ii).</text></clause></subparagraph><subparagraph id="HCF95C1EA2E3645E8A4D9722E0B1A19D9"><enum>(D)</enum><text display-inline="yes-display-inline">Support the efforts of countries that are recipients of international development assistance, especially those vulnerable to climatic, weather, and other forms of disruption caused by global climate change, to integrate climate-resilience considerations regarding how to use resources (including the countries’ own national resources and those provided by the United States, other countries, and multilateral entities) into national, regional, and sectoral development planning and action.</text></subparagraph><subparagraph id="H5931F11CE1CC4191BB128809CB6EFB49"><enum>(E)</enum><text display-inline="yes-display-inline">Support the efforts of multilateral entities and other countries in developing and receiving access to knowledge, practices, tools, and data related to identifying climate-related risks and incorporating climate-resilience considerations into development programs.</text></subparagraph><subparagraph id="H2E5EBCA55E6646AC9714941AEA6C774C"><enum>(F)</enum><text display-inline="yes-display-inline">Monitor the implementation of subparagraphs (A) through (E).</text></subparagraph></paragraph><paragraph id="HA6FC230BD8C64CF68BE0FFAC8D46AACB"><enum>(2)</enum><header>Development through multilateral entity participation or representation</header><text display-inline="yes-display-inline">The head of each agency that participates in a multilateral entity shall, as appropriate, carry out the following:</text><subparagraph id="H6064A890E6954625AFC897458F5A8AFF"><enum>(A)</enum><text display-inline="yes-display-inline">Encourage the multilateral entity to—</text><clause id="H00DBE79E82B44478976871CD4826B85A"><enum>(i)</enum><text display-inline="yes-display-inline">assess and evaluate climate-related risks to and vulnerabilities in the strategies, planning, programs, projects, investments, and related funding decisions of the entity, using best-available climate-change data, tools, and information, including such data, tools, and information identified or developed by the Working Group; and</text></clause><clause id="H638EBFB8712D4E9FB6167F455361005E"><enum>(ii)</enum><text>adjust the strategies, planning, programs, projects, investments, and related funding decisions of the entity, as appropriate, based on the assessments and evaluations referred to in clause (i).</text></clause></subparagraph><subparagraph id="H6C2B0CB6138E4BA6AECB3FFEE4FC5792"><enum>(B)</enum><text display-inline="yes-display-inline">Collaborate with the multilateral entity and share with the agencies represented on the Working Group under subsection (b)(3)(B) and other stakeholders the knowledge, data, tools, information, frameworks, and lessons learned from the entity in incorporating the climate-resilience considerations into strategies, planning, programs, projects, investments, and related funding decisions.</text></subparagraph><subparagraph id="HD28F701187744FDABC30F616BC94812A" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">Encourage the multilateral entity—</text><clause id="H80F40C3135134B45A3DDF4B9DA2D6F36"><enum>(i)</enum><text>to support the efforts of countries to integrate climate-resilience considerations into national, regional, and sectoral development planning and actions; and</text></clause><clause id="H79E62A10F1494BF9B3D6E2B77A73B6E5"><enum>(ii)</enum><text>to promote the development of and access to knowledge, practices, tools, and data needed for such efforts.</text></clause></subparagraph><subparagraph id="H3F13404C395841319F5CE16426559FB1"><enum>(D)</enum><text display-inline="yes-display-inline">Learn from the skills, practices, data, and tools of the multilateral entity and other countries and incorporate such lessons into United States-led development missions.</text></subparagraph><subparagraph id="H970F42F8B3EC4E91A71702E2E92BE6B7"><enum>(E)</enum><text display-inline="yes-display-inline">Monitor the implementation of subparagraphs (A) through (D).</text></subparagraph></paragraph></subsection><subsection id="H96BA7B30D67946608F44C0B7F5D18A0F"><enum>(b)</enum><header>Working Group on climate-Resilient international development</header><paragraph id="H5D3F262BBC3A42B8BF9B701ABE3F5AF1"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Department of the Treasury a Working Group on Climate-Resilient International Development (in this section referred to as <quote>Working Group</quote>).</text></paragraph><paragraph id="HE75CDF018C2646B196645399181F3472"><enum>(2)</enum><header>Mission and duties</header><text display-inline="yes-display-inline">The Working Group shall carry out the following:</text><subparagraph id="H3EB940E2B8E649088A41EF029A7274A8" display-inline="no-display-inline"><enum>(A)</enum><text>Support each agency with direct international development programs and investments by—</text><clause id="HD53F32FBA9784798912E5B99CB01310D"><enum>(i)</enum><text display-inline="yes-display-inline">identifying, as appropriate, the need for new data, tools, and information from the data, tools, and information described in subsection (a)(1)(A)(i) to be developed by the agency working with a science and security agency or entity to advance the development of such agency;</text></clause><clause id="H5C0A246759474990AE5AD7AEEB860CDB" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">identifying approaches for adjusting strategies, planning, programs, projects, investments, and related funding decisions described in clause (ii) of subsection (a)(1)(A) in response to the findings of climate-risk assessments described in clause (i) of such subsection;</text></clause><clause id="H983EBAF4A7FB4F1387C1012D8DCB8C05" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">facilitating the exchange of knowledge, data, tools, information, frameworks, and lessons learned in assessing climate risks to and incorporating climate-resilience considerations into strategies, planning, programs, projects, investments, and related funding decisions of the agency described in subsection (a)(1)(A); and</text></clause><clause id="HBA4E0C5ABA0342059F027225B64E8840" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">developing methods for tracking and reporting on actions to institutionalize climate-resilient development approaches, including performance metrics and methodologies for assessing climate-related risks and making cost-benefit analysis.</text></clause></subparagraph><subparagraph id="H5AF28CEB30214D898DF883B41506FCF2"><enum>(B)</enum><text display-inline="yes-display-inline">Support each agency with direct international development programs and investments by identifying ways each such agency may work with multilateral entities and other countries to receive, share, and review best practices to facilitate advancement of climate-resilient development policies. </text></subparagraph><subparagraph id="H9EEA64B7867247499861E1374046EE71" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">Support each agency with direct international development programs and investments by identifying ways each such agency may share with multilateral entities and other countries, as appropriate, and make publicly available to the extent possible, data, tools, and information used pursuant to subsection (a)(2)(A)(i).</text></subparagraph><subparagraph id="H51099483413B457B90F6E25905B65833"><enum>(D)</enum><text display-inline="yes-display-inline">Promote interagency collaboration, including through joint training.</text></subparagraph><subparagraph id="H28539312A2DB4AAFB21554BAEBF32D9E"><enum>(E)</enum><text>Identify and develop, as appropriate, guidelines for incorporating considerations of climate-change risks and climate resilience into agency strategies, plans, programs, projects, investments, and related funding decisions described in subsection (a)(1)(A).</text></subparagraph><subparagraph id="H1217C8B4E4E94A2F8611956A07CE779C"><enum>(F)</enum><text>Identify and assess, as appropriate, existing climate-change data, decision-support tools, and information described in subsection (a)(1)(A)(i) to—</text><clause id="HB0F9FE9AB7264F738147DCA374434AB0"><enum>(i)</enum><text display-inline="yes-display-inline">help the Working Group assess climate risks and make decisions that incorporate climate-resilience considerations, including project screening; and</text></clause><clause id="H2736996DAB534A6A935D3B8FFC1537E0"><enum>(ii)</enum><text display-inline="yes-display-inline">allow the screening for and incorporation of considerations of climate-change risks and vulnerabilities by the Working Group in strategies, plans, programs, projects, investments, and related funding decisions.</text></clause></subparagraph><subparagraph id="HACA0F43D073642F990AADCAFFB630C2D" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">Coordinate efforts, including efforts pursuant to Executive Order 13653 (78 Fed. Reg. 66817) as in effect on November 1, 2013, between representatives of the Working Group with decision makers in multilateral entities, donor countries, and recipient countries to—</text><clause id="H838A8408D51847E8BE0929AC43CC18C1"><enum>(i)</enum><text display-inline="yes-display-inline">share data, tools, and information described in subparagraph (F); and</text></clause><clause id="H41080E44EFA34B32A62168D234663429"><enum>(ii)</enum><text display-inline="yes-display-inline">increase information on climate-change impacts for providers and users.</text></clause></subparagraph><subparagraph id="HB42DE5E5EA9241F58D36A90D0D636B8E"><enum>(H)</enum><text display-inline="yes-display-inline">Work with the heads of agencies with direct international development programs and investments and the heads of agencies that participate in a multilateral entities to provide, not later than 2 years after the date of the enactment of this Act, training for personnel of such agencies with respect to integrating climate-resilience considerations into international development assistance efforts performed by such agencies (and the heads of such agencies shall cooperate with the Working Group in providing such training). </text></subparagraph></paragraph><paragraph id="H65013E79F76B4422B4ED544E8120C9C3" display-inline="no-display-inline"><enum>(3)</enum><header>Membership</header><subparagraph id="HB4361C05E55B4044BAEC7D112E69504A"><enum>(A)</enum><header>Co-chairs</header><text>The Working Group shall be co-chaired by the following:</text><clause id="H44431E49016A4393BA60231EA367538D"><enum>(i)</enum><text>The Secretary of the Treasury, or the Secretary’s designee.</text></clause><clause id="HAF213715E5184FF5872C22DBEFB48449"><enum>(ii)</enum><text display-inline="yes-display-inline">The Administrator of the United States Agency for International Development, or the Administrator’s designee.</text></clause></subparagraph><subparagraph id="H239873A42B834EA1BD1F5B2B2FB22AB6"><enum>(B)</enum><header>Representatives</header><clause id="HBF54EFB4DE444A42B60B9B70D163E697"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Working Group shall be composed of one representative from—</text><subclause id="HB8CEFF3BE5D340B18801CA4197557D55"><enum>(I)</enum><text display-inline="yes-display-inline">each agency that participates in a multilateral entity, including each agency or entity determined by the co-chairs of the Working Group pursuant to subsection (f)(2)(C);</text></subclause><subclause id="HEC2D5AF6F8614AF6B1BB0024C13D4964"><enum>(II)</enum><text display-inline="yes-display-inline">each agency with direct international development programs and investments, including each agency or entity determined by the co-chairs of the Working Group pursuant to subsection (f)(3)(H);</text></subclause><subclause id="H07BEAC036EB74D418CECFB1AD774A78D" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">each science and security agency or entity, including each agency or entity determined by the co-chairs of the Working Group pursuant to subsection (f)(7)(H); and</text></subclause><subclause id="HADC7428975984A79B8D4A9D5047FBC4B"><enum>(IV)</enum><text>the Council on Environmental Quality or another agency or office in the Executive Office of the President, as determined by the President.</text></subclause></clause><clause id="H40561459D4F5407EAEE193631F586B30"><enum>(ii)</enum><header>Agencies with multiple placements</header><text display-inline="yes-display-inline">The head of any agency that is represented on the Working Group as described in more than one category listed in clause (i) may decide—</text><subclause id="HD53BEF43E475467EA775838DE22A27C6"><enum>(I)</enum><text>to be represented by a separate representative for each such category; or</text></subclause><subclause id="H866157EF1B1143FF9B5AC09E56352FC3"><enum>(II)</enum><text>to be represented by a single representative for two or more such categories.</text></subclause></clause><clause id="H24341E0B22704768B2502B724BEFE7AA"><enum>(iii)</enum><header>Qualification and appointment</header><text display-inline="yes-display-inline">Each representative of an agency or office under clause (i) shall be a senior official of such agency or office, to be appointed by the head of the agency or office.</text></clause></subparagraph></paragraph></subsection><subsection id="H9890CADFC46F4535AD2E447EBFEB92F6"><enum>(c)</enum><header>Implementation and reporting of progress</header><paragraph id="H4D9EC5A7E5CC423ABD5FB75D708A3A05"><enum>(1)</enum><header>Implementation</header><text display-inline="yes-display-inline">To promote implementation by each agency or entity with representation in the Working Group, the Working Group shall carry out the following:</text><subparagraph id="H4B1893BEBE2D49B68E6F5CAC4A66487C"><enum>(A)</enum><text>Establish a 2-year timeline to implement subsection (b)(2), including biannual objectives for each agency or entity.</text></subparagraph><subparagraph id="H2A2604131A8645F2AAC422677FC33F8E"><enum>(B)</enum><text display-inline="yes-display-inline">Analyze, at least annually, the Working Group’s progress in implementing this section and provide recommendations for priority areas for further implementation to the following:</text><clause id="HB722620F62A9475391C00E3D0F9D4D1C"><enum>(i)</enum><text>The Office of Management and Budget.</text></clause><clause id="H2A462665CA0C4973A34EB700B9E5F438"><enum>(ii)</enum><text>The National Security Council.</text></clause><clause id="H84AE77E06D9841839FF3E6106BB7D404"><enum>(iii)</enum><text>The Council on Environmental Quality.</text></clause><clause id="HCF7B42C3CD14463EB7AA845B4C431C43"><enum>(iv)</enum><text>The Office of Science and Technology Policy.</text></clause><clause id="HEB1F5364E4DE48448BA3AD730F99B3DA"><enum>(v)</enum><text display-inline="yes-display-inline">Other agencies, offices, and entities, as the Working Group determines appropriate.</text></clause></subparagraph></paragraph><paragraph id="H51655F9528DC4917BE91D0C78534DA2D"><enum>(2)</enum><header>Reporting</header><subparagraph id="HC36424AC63164A0F8FA76777F952A44A"><enum>(A)</enum><header>Agency with direct international development programs and investments</header><clause id="H6F45D1C083494500BB8761069FACF4EE"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the head of each agency with direct international development programs and investments shall submit to the Working Group a report that includes the following information:</text><subclause id="H7FABE779BB7E49B1AE80B9F8A13BE334"><enum>(I)</enum><text>The progress of the agency in achieving the requirements specified in subparagraphs (A) through (E) of subsection (a)(1).</text></subclause><subclause id="H8D82D9EBEC4F411EA2D908EAEB60FCCD"><enum>(II)</enum><text display-inline="yes-display-inline">The planned and accomplished biennial objectives referred to in paragraph (1)(A) for the agency with direct international development programs and investments. </text></subclause></clause><clause id="H0E953A9AE0144D959AC36FD8B1B91647" display-inline="no-display-inline"><enum>(ii)</enum><header>Metrics</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Working Group develops methods as required by subsection (b)(2)(A)(iv), the head of each agency with direct international development programs and investments shall include in the report under clause (i) an estimate of the following:</text><subclause id="H31B3B9DB051D4350927DF2624E54FA66"><enum>(I)</enum><text>The proportion of the direct international development programs and investments for which the agency conducted climate-risk assessments.</text></subclause><subclause id="H68762E87F9374875AAF50D9D09F5C29B"><enum>(II)</enum><text>The proportion of the programs and investments for which climate risk was identified and acted upon.</text></subclause><subclause id="HC0C3C76894D44F0090E7F18F6A84FC47"><enum>(III)</enum><text display-inline="yes-display-inline">Any other metrics the co-chairs determine to be relevant.</text></subclause></clause></subparagraph><subparagraph id="H6A509DD8A2D5485F889A56C53BBFAC61" display-inline="no-display-inline"><enum>(B)</enum><header>Agency that participates in a multilateral entity</header><clause id="HC99185AD9E9F4C06AD12627ED59C7C38"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, and annually thereafter, and except as provided in clause (ii), the head of each agency that participates in a multilateral entity shall submit to the Working Group a report on the progress of the agency achieving the requirements of subparagraphs (A) through (D) of subsection (a)(2).</text></clause><clause id="HFED6E893830C46EAB030B69884F99EA6"><enum>(ii)</enum><header>Multiple agencies</header><text display-inline="yes-display-inline">In the case in which more than one agency participates in a multilateral entity, the co-chairs of the Working Group shall designate one agency to be responsible for submitting the report required by clause (i).</text></clause></subparagraph><subparagraph id="H68FEFB757AAF4AB68E6B5503963AEF7F" display-inline="no-display-inline"><enum>(C)</enum><header>Federal agency planning process</header><text display-inline="yes-display-inline">An agency described in subparagraphs (A) and (B) shall report through the Federal Agency Planning process under section 5 of Executive Order 13653 (78 Fed. Reg. 66817) as in effect on November 1, 2013.</text></subparagraph></paragraph><paragraph id="H74FBC32FB6504EB0A181E762775F92DC"><enum>(3)</enum><header>Working group reporting</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Working Group shall submit to Congress and make publicly available a report on its mission and duties under subsection (b)(2) and which includes a summary and analysis of all reports submitted to the Working Group under subparagraphs (A) and (B) of paragraph (2). </text></paragraph></subsection><subsection id="H7A8A1DBACB374EBDACE661E4AE1B1664"><enum>(d)</enum><header>Rule of construction</header><text>This Act shall be implemented consistent with the obligations of the United States under international agreements and applicable United States law.</text></subsection><subsection id="H9CD63CC2F190422DABAC477E959BB42D"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this Act such sums as may be necessary for each of fiscal years 2022 to 2031.</text></subsection><subsection id="HB869FDA3BC7A4BA1890C67CD645377C4"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4F4848222E3746D99F86EFB68FECB29D"><enum>(1)</enum><header>Adaptation</header><text display-inline="yes-display-inline">The term <term>adaption</term> means an adjustment in natural or human systems in anticipation of or response to a changing environment in a way that effectively uses beneficial opportunities or reduces negative effects.</text></paragraph><paragraph id="H5CC26AA0E68E4436811F59F6C620A464" display-inline="no-display-inline"><enum>(2)</enum><header>Agency that participates in a multilateral entity</header><text display-inline="yes-display-inline">The term <term>agency that participates in a multilateral entity</term> means—</text><subparagraph id="HA617CE598FE242D1B749BE2FD7645983"><enum>(A)</enum><text>the Department of State;</text></subparagraph><subparagraph id="H76F7DF1A2305441AA96303B393A632BA"><enum>(B)</enum><text>the Department of the Treasury; and</text></subparagraph><subparagraph id="HFA268B5E90404802B2F6300DC9ED4704"><enum>(H)</enum><text display-inline="yes-display-inline">any other agency or entity with direct international development programs and investments, as determined by the co-chairs of the Working Group.</text></subparagraph></paragraph><paragraph id="H34239A2D961C46E99B6C9EA8D8229485"><enum>(4)</enum><header>Climate resilience</header><subparagraph id="H74E0F7DC21D24D0A9372E72001992741"><enum>(A)</enum><header>In general</header><text>The terms <term>climate resilience</term>, <term>climate-resilience</term>, and <term>climate-resilient</term> refer to policies that promote the resilience of a community to the sudden and gradual impacts associated with climate change that can reasonably be anticipated, using the best available science, to be at risk of occurring over the life of the project or program, including physical and social effects and also direct and compound effects of climate change.</text></subparagraph><subparagraph id="H2CF2DDE80EFF45568EB9C6D1C0A71400" commented="no"><enum>(B)</enum><header>Resilience</header><text display-inline="yes-display-inline">In subparagraph (A), the term <term>resilience</term> means the ability to anticipate, prepare for, and adapt to changing conditions and withstand, respond to, and recover rapidly from disruptions.</text></subparagraph><subparagraph id="HEDDE2DB96809455BA6A780EDD4AA3E1B"><enum>(C)</enum><header>Life of the project or program</header><text>In subparagraph (A), the term <term>life of the project or program</term> means, with respect to any project or program for construction or repair of infrastructure, the expected life of such infrastructure.</text></subparagraph></paragraph><paragraph id="H00A15296BDB64D369D3F2165C05F5F34" display-inline="no-display-inline"><enum>(5)</enum><header>Direct international development programs and investments</header><text>The term <term>direct international development programs and investments</term> means—</text><subparagraph id="H0F9B0F9E2D8246EE867BF0C91E54616E"><enum>(A)</enum><text display-inline="yes-display-inline">bilateral, regional, and multilateral international development programs and investments over which agencies have primary programmatic and financial management responsibilities;
