which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to provide for coverage under the Medicare program of pharmacist services.</official-title></form><legis-body id="HA6C35B21774F4BFBA4D4351A0483F444" style="OLC"><section id="HDADDF4238E5846568CCF5C4D137C6202" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pharmacy and Medically Underserved Areas Enhancement Act</short-title></quote>.</text></section><section id="HAE7EDD9D9B104EF3B56E8DA54B1677D4" section-type="subsequent-section"><enum>2.</enum><header>Medicare coverage of pharmacist services</header><subsection id="HDD7A6FD591E5432E9698785D5F215270"><enum>(a)</enum><header>Coverage</header><text display-inline="yes-display-inline">Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text><paragraph id="H2A215F538318495187E028D79E961836"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of subparagraph (GG);</text></paragraph><paragraph id="H5A3B0DC3B5684240A7051A1B84317D6F"><enum>(2)</enum><text>by striking the period at the end and inserting <quote>; and</quote> at the end of subparagraph (HH); and</text></paragraph><paragraph id="H3F7CD8A973EA40B2BA09541818D32662"><enum>(3)</enum><text>by inserting after subparagraph (HH) the following new subparagraph at the end:</text><quoted-block display-inline="no-display-inline" id="HEC9ED0240E3C4AD8AF5247FBC0E48408" style="OLC"><subparagraph id="H4AAE7F1E7D8D4F32BAC5BC967B8197C7"><enum>(II)</enum><text display-inline="yes-display-inline">pharmacist services furnished by a pharmacist, as licensed by State law, individually or on behalf of a pharmacy provider—</text><clause id="H7133EFFD989A43F8AC0C04B23C128ACE"><enum>(i)</enum><text>which the pharmacist is legally authorized to perform in the State in which the individual performs such services;</text></clause><clause id="H577FB8A74999492CA95B88B7D32A4BDF"><enum>(ii)</enum><text>as would otherwise be covered under this part if furnished by a physician, or as an incident to a physician’s service; and</text></clause><clause id="HA52329F9D96C410DB13CCAEDFCD372D2"><enum>(iii)</enum><text>in a setting located in a health professional shortage area (as defined in section 332(a)(1)(A) of the Public Health Service Act), medically underserved area, or medically underserved population (as defined in section 330(b)(3) of such Act).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC99852C3FC594EB4B6ED64050E43EFD4"><enum>(b)</enum><header>Payment</header><text>Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text><paragraph id="HC7B6A1576CE3432482048FA351EB4F91"><enum>(1)</enum><text>by striking <quote>and (DD)</quote> and inserting <quote>(DD)</quote>; and</text></paragraph><paragraph id="HC166C1460E694A619F9A4209BD0BF24C"><enum>(2)</enum><text>by inserting before the semicolon at the end the following: <quote>and (EE) with respect to pharmacist services (as defined in section 1861(s)(2)(II)), the amounts paid shall be equal to 80 percent of the lesser of the actual charge or 85 percent of the fee schedule amount provided under section 1848 if such services had been furnished by a physician</quote>. </text></paragraph></subsection><subsection id="H6EE098AF39034F199833554867DA4723"><enum>(c)</enum><header>Effective date; Pharmacist specific codes</header><paragraph id="H0D11A129B5C3461392BF0BE610FD0B0B"><enum>(1)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsections (a) and (b) shall apply with respect to services furnished on or after January 1, 2022.</text></paragraph><paragraph id="HEBF119FCBBA14A91B21B7A6FF4081482"><enum>(2)</enum><header>Pharmacist specific codes</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall develop pharmacist specific codes, as necessary, under the physician fee schedule under section 1848 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
