which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Child Abuse Prevention and Treatment Act to provide for better protections for children raised in kinship families outside of the foster care system.</official-title></form><legis-body id="H0DBF72470D4541FF95722B992A1B0191" style="OLC"><section id="H0DB34213589C41719A0A87D7E870DD6D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Help Grandfamilies Prevent Child Abuse Act</short-title></quote>.</text></section><section id="H26A7062FFC154FDB9CAA393E5CBF6413"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text><paragraph id="H978F8A7D9C5A4FFE8EED78515949E2FE"><enum>(1)</enum><text display-inline="yes-display-inline">Nearly 2,700,000 children are being raised in kinship families or <quote>grandfamilies</quote> by relatives or close family friends without their parents in the home, and the vast majority of such children are raised outside of the foster care system.</text></paragraph><paragraph id="H5782A6E0B664431C8D507305C82071DD"><enum>(2)</enum><text>The majority of kinship caregivers are grandparents.</text></paragraph><paragraph id="H1D3BB0AC9BA040E4944CD993760276C9"><enum>(3)</enum><text>For every child in foster care living with relatives, there are 19 being raised by relatives outside of the foster care system.</text></paragraph><paragraph id="H33B082113484492EA505BB4715304B68"><enum>(4)</enum><text>More than one-third of all children placed in foster care because of parental drug or alcohol use are placed with relatives.</text></paragraph><paragraph id="H2C0FDDE4A67B4A51B4109C99AF9EF390"><enum>(5)</enum><text>Children who have been exposed to substance misuse in the home may also experience abuse and neglect, and research indicates that children in family foster care because of substance use are more likely to be placed with relatives than with nonrelatives.</text></paragraph></section><section id="HA55710E3117D4AFAAE6F6119D1814FA1"><enum>3.</enum><header>Amendments to CAPTA</header><subsection id="H62EA8D09661743BF8FAD076D2644F156"><enum>(a)</enum><header>Advisory board on child abuse and neglect</header><text>Section 102(c) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5102">42 U.S.C. 5102(c)</external-xref>) is amended—</text><paragraph id="H449E1166D3494F499564024A4F265D33"><enum>(1)</enum><text>in paragraph (13), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="H110B5E8E1F2E40CAA3A26BD43E50606E"><enum>(2)</enum><text>in paragraph (14), by striking the period and inserting a semicolon; and</text></paragraph><paragraph id="H5AD14ED31C574F16816B5EADFF7C1A43"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HFD88D8A741AC44C99FE427052799DECF" style="OLC"><paragraph id="H4399ED62EB5A4F329E9B970FFA6539EF"><enum>(15)</enum><text>organizations providing services to kinship families; and</text></paragraph><paragraph id="HF610D0D79C8A44BDAEC2BEB1ED1F10AE"><enum>(16)</enum><text>birth parents, kinship caregivers, and foster care alumni.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H356CA5CF94E24E16B147353319B61355"><enum>(b)</enum><header>National clearinghouse for information relating to child abuse</header><text>Section 103(b) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5104">42 U.S.C. 5104(b)</external-xref>) is amended—</text><paragraph id="H1CFA593DD55F43629C1CF86CBE1877A2"><enum>(1)</enum><text>in paragraph (8)(B), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="HEBB5067B569F4B7BB6D8568B63417969"><enum>(2)</enum><text>in paragraph (9), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HAF9D70DB711B4504B49D57BDC7F73A1F"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H062FA8288F604EA1B3AB3B74F3B7C815" style="OLC"><paragraph id="HF638B1CD9671424AA27EFA97D824860F"><enum>(10)</enum><text display-inline="yes-display-inline">coordinate with the National Technical Assistance Center on Grandfamilies and Kinship Families to disseminate information about evidence-based, evidence-informed and exemplary practices used to support children being raised in kinship families within, or outside of, the child welfare system.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H698E6557C9654AF1B57FFD31F6E0BF5F"><enum>(c)</enum><header>Grants to States, Indian Tribes or Tribal organizations, and public or private agencies and organizations</header><text>Section 105(a)(4) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106">42 U.S.C. 5106(a)(4)</external-xref>) is amended by adding at the end the following: <quote>Such procedures used by recipients of a grant pursuant to this paragraph shall reflect equity for children placed with kin, recognize their unique circumstance, and include plans for prioritizing placement with kin as the first placement, identifying and engaging kin as supports for children throughout the child’s involvement with the child welfare system, making it a priority to license kin as foster parents, supporting permanent families for children placed with kin, and creating a strong community network to support kin families.</quote>.</text></subsection><subsection id="HE8CA8AEBFC664CF3BB7B47EBE11616D1"><enum>(d)</enum><header>Grants to States for child abuse or neglect prevention and treatment programs</header><text>Section 106 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106a">42 U.S.C. 5106a</external-xref>) is amended—</text><paragraph id="H7F60ECA9748A49CEB13CBE0077275363"><enum>(1)</enum><text>in subsection (b)(2)—</text><subparagraph id="H0B44965FF4A8453AA86E7EB3F765DE8A"><enum>(A)</enum><text>in subparagraph (B)(iv), by inserting <quote>, and for how kinship placements will be prioritized</quote> before the semicolon; and</text></subparagraph><subparagraph id="H678079937DF6427DBD4D4EE5F2BBD9EF"><enum>(B)</enum><text>in subparagraph (D)(v), by inserting <quote>kinship navigators,</quote> after <quote>substance abuse treatment agencies,</quote>; and</text></subparagraph></paragraph><paragraph id="HE2F4CDCC31B94B98B191E3EA3165748F"><enum>(2)</enum><text>in subsection (d)(3)—</text><subparagraph id="HD4A14182BEB74396AEE6AAB25DE49DFA"><enum>(A)</enum><text>by redesignating subparagraphs (B) and (C) as subparagraphs (C) and (D), respectively;</text></subparagraph><subparagraph id="HAD2030E13580408CA8F8A8A0CB157BE2"><enum>(B)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block display-inline="no-display-inline" id="HEE182BF59BDE4D87859D1022417946C6" style="OLC"><subparagraph id="H074C11D3C41F46228FD315D3513D3D1B"><enum>(B)</enum><text>the number that did not receive services during the year under the State program funded under this section or an equivalent State program because the child was diverted from the child welfare system to live with kin outside of the foster care system;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HC6CC706D2FEA4736AFF46F8E80EAA650"><enum>(C)</enum><text>in subparagraph (D), as so redesignated, by striking <quote>families</quote> and inserting <quote>parents</quote>.</text></subparagraph></paragraph></subsection><subsection id="HD10567D9D99B46B39C436885A70439E5"><enum>(e)</enum><header>Community-Based grants for the prevention of child abuse and neglect</header><paragraph id="H2A245685B0BD442DBDBE25C96374975E"><enum>(1)</enum><header>Purpose</header><text>Section 201(b)(1) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5116">42 U.S.C. 5116(b)(1)</external-xref>) is amended—</text><subparagraph id="H8BF52598126342ADBCE9560FE6432D7E"><enum>(A)</enum><text>in subparagraph (G), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="HC18961FF55C4445C9460A5C8074158F4"><enum>(B)</enum><text>in subparagraph (H), by adding <quote>and</quote> after the semicolon; and</text></subparagraph><subparagraph id="HB88CEF465DF540F1AA59E6507E0E49EA"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H99A3D196B16E426AAD0D496983883926" style="OLC"><subparagraph id="HE2DEB34491F24DFBBE9021C78E9A6039"><enum>(I)</enum><text>support the unique needs of kinship families raising children inside or outside the foster care system;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H52562F416EDE44108EC839DE15CDE624"><enum>(2)</enum><header>Local program requirements</header><text>Section 205(a) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5116e">42 U.S.C. 5116e(a)</external-xref>) is amended—</text><subparagraph id="H6BC55A09718D40CABC8A9CDE5F78EB29"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and to parents who are adult former victims of domestic violence or child abuse or neglect</quote> and inserting <quote>to parents who are adult former victims of domestic violence or child abuse or neglect, and to families where children are being raised by kin because their parents cannot raise them</quote>;</text></subparagraph><subparagraph id="H75BB934399E94F159A056D35A186BF32"><enum>(B)</enum><text>in paragraph (3)(B)—</text><clause id="H458DA70876FC4A4CA8D48F9AC283C5DF"><enum>(i)</enum><text>in clause (viii), by striking <quote>and</quote>;</text></clause><clause id="H6A008CA5329B49BE8D63C3ADD96627CA"><enum>(ii)</enum><text>in clause (ix), by striking the period and inserting a semicolon; and</text></clause><clause id="H34EF7E55BDEC492BA388525D56ABE8C4"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H6D555E8480BE4E8CA5C96ABE59155E60" style="OLC"><clause id="H74D3B728037A4F78839FBC0968FF751C"><enum>(x)</enum><text>training to meet the specific needs of kinship caregivers, including training on caring for children with behavioral or mental health challenges and how to access services for which such caregivers may be eligible; and</text></clause><clause id="H0F33658DA94D4A828951D6D36C801A5F"><enum>(xi)</enum><text>training on understanding substance use disorders and the impact of trauma on children.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H2A02B17638C74178B6DF398804E6E16F"><enum>(C)</enum><text>in paragraph (4), by inserting <quote>, kinship caregivers, and foster care alumni</quote> after <quote>parents</quote>.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
