<official-title display="yes">To establish a new Directorate for Technology and Innovation in the National Science Foundation, to establish a regional technology hub program, to require a strategy and report on economic security, science, research, innovation, manufacturing, and job creation, to establish a critical supply chain resiliency program, and for other purposes.</official-title>

<legis-body id="H527ABABEB8164B7C90148CBA780F0447" style="OLC">
<section section-type="section-one" id="H419F033E7DDC4483843C8745ED4C94F3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Endless Frontier Act</short-title></quote>.</text></section> <section id="HCD21F1358D084F86A1A6A51B84E97D41"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="HAE10A080163D4B6383CB9D8DFF6C5E4A"><enum>(1)</enum><text>For over 70 years, the United States has been the unequivocal global leader in scientific and technological innovation, and as a result the people of the United States have benefitted through good-paying jobs, economic prosperity, and a higher quality of life.</text> <subparagraph id="H11755CB7C5554F76BDBD992FC20BC22B" commented="no"><enum>(A)</enum><text>Today, however, this leadership position is being eroded and challenged by foreign competitors, some of which are stealing intellectual property and trade secrets of the United States and aggressively investing in research and commercialization to dominate the key existing and future technology fields.</text></subparagraph>
<subparagraph id="HAA32AFFCDC6346BC8E75C6BE244C7C45" commented="no"><enum>(B)</enum><text>While the United States once led the world in the share of our economy invested in research, our Nation now ranks 9th globally in total research and development and 12th in publicly financed research and development.</text></subparagraph> <subparagraph id="HEA2B7575E5FB4B7DBFFDA462F7B4BBBB" commented="no"><enum>(C)</enum><text>While wages for American workers rose in parallel with growth in national productivity from the end of World War II through most of the 1970s, since then wage growth has been uneven and labor’s share in national income has declined.</text></subparagraph></paragraph>
<paragraph id="HA7B5DC5F9BC940B0B910BE70072D2F50"><enum>(2)</enum><text>Without a significant increase in investment in research, education, technology transfer, intellectual property, manufacturing, and other core strengths of the United States innovation ecosystem, it is only a matter of time before the global competitors of the United States overtake the United States in terms of technological primacy. The country that wins the race in key technologies—such as artificial intelligence, quantum computing, advanced communications, and advanced manufacturing—and uses technological innovation to support high-quality jobs and incomes will be the superpower of the future.</text></paragraph> <paragraph id="H83976F3D27AA42B1A355742A28EA636D"><enum>(3)</enum><text>The Federal Government must catalyze United States innovation by boosting research investments focused on discovering, creating, commercializing, and demonstrating new technologies and manufacturing those technologies domestically throughout the country to ensure the leadership of the United States in the industries of the future.</text></paragraph>
<paragraph id="H2A822F5F7A2946C1BB8C594C8BD779A4"><enum>(4)</enum><text>The distribution of innovation jobs and investment in the United States has become largely concentrated in just a few locations, while much of the Nation has been left out of growth in the innovation sector. More than 90 percent of the Nation’s innovation sector employment growth in the last 15 years was generated in just 5 major metropolitan areas. The Federal Government must address this imbalance in opportunity by—</text> <subparagraph id="HBF5D250278B44418957B8A62408F736B"><enum>(A)</enum><text>dramatically increasing funding for science and engineering research and expanding partnerships with the private sector to build new technology hubs across the country;</text></subparagraph>
<subparagraph id="H1F5B4545C1C94F2E8A6F8795AA190BCE"><enum>(B)</enum><text>spreading high-quality innovation sector jobs more broadly;</text></subparagraph> <subparagraph id="H276DD993C04B4ACB96D731074FCB36B2"><enum>(C)</enum><text>increasing the participation of underrepresented populations, engaging workers, and collaborating with labor organizations in innovation efforts to tap the talent and potential of the entire Nation to ensure the United States leads the industries of the future; and</text></subparagraph>
<subparagraph id="HBBCB5A356F5C44F3AC9E744F6FBB7DA1"><enum>(D)</enum><text>building regional capacity in such critical areas as entrepreneurship, access to capital and other investment, and supply chain development. </text></subparagraph></paragraph> <paragraph id="HE19683A68137446989FD97C80368D6BF"><enum>(5)</enum><text>As President Franklin D. Roosevelt stated, <quote>[N]ew frontiers of the mind are before us, and if they are pioneered with the same vision, boldness, and drive with which we have waged this war we can create a fuller and more fruitful employment and a fuller and more fruitful life.</quote></text></paragraph>
<paragraph id="HDBE3C3E7A6BE49EAA5D879A497754667"><enum>(6)</enum><text>As Vannevar Bush stated in his 1945 report entitled Science, The Endless Frontier, <quote>New products, new industries, and more jobs require continuous additions to knowledge of the laws of nature, and the application of that knowledge to practical purposes. Similarly, our defense against aggression demands new knowledge so that we can develop new and improved weapons. This essential, new knowledge can be obtained only through basic scientific research.</quote></text></paragraph> <paragraph id="H5F779BD026A74A58BCA4F0E5F8E47C0C" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text>Since their inception, the National Science Foundation and other key Federal agencies, like the Department of Energy, have carried out vital work supporting basic and applied research to create knowledge that is a key driver of the economy of the United States and enhances the Nation’s security.</text></paragraph></section>
<section id="H25E8990EE53B4479B9A977E9300B7EA8"><enum>3.</enum><header>Improving technology and innovation research at the National Science Foundation</header>
<subsection id="H3353CCFA8D66450CA71A924060ED6167" commented="no"><enum>(a)</enum><header>Providing authority To disseminate information</header><text>Section 11 of the National Science Foundation Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/42/1870">42 U.S.C. 1870</external-xref>) is amended—</text> <paragraph id="H72D0EC1C85FC483AA46B91492334A159" commented="no"><enum>(1)</enum><text>in subsection (j), by striking <quote>and</quote> after the semicolon;</text></paragraph>
<paragraph id="H41303682C88743949CA6362CCB19B5FE" commented="no"><enum>(2)</enum><text>in subsection (k), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> <paragraph commented="no" id="HDC1804D84EC14AA588BC98E1108290CC"><enum>(3)</enum><text>by adding at the end the following:</text>

<subsection id="H8F6B8F6432DC4BE7BF24DC1DA0386FE0" commented="no"><enum>(l)</enum><text>provide for the widest practicable and appropriate dissemination of information within the United States concerning the Foundation’s activities and the results thereof.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H8E1B0BBD0A414F8F8153FDDD4E3A50A3"><enum>(b)</enum><header>Establishment of directorate for technology and innovation</header><text>The National Science Foundation Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/42/1861">42 U.S.C. 1861</external-xref> et seq.) is amended—</text>
<paragraph id="HF6A4EA1010E04778A9A5CF45814F2DC5"><enum>(1)</enum><text>in section 8 (<external-xref legal-doc="usc" parsable-cite="usc/42/1866">42 U.S.C. 1866</external-xref>), by inserting at the end the following: <quote>Such divisions shall include the Directorate for Technology and Innovation established under section 8A.</quote>; and</text></paragraph> <paragraph id="HC123F9EFCB1F4B2A8FEBE18CB51387D8"><enum>(2)</enum><text>by inserting after section 8 the following:</text>

<section id="H3C91C3DC69294D659136DA5FFC5B7EBB"><enum>8A.</enum><header>Improving research and establishing Directorate for Technology and Innovation</header>
<subsection id="H448DBDEBA2BE49AE828FD8356B6DB8F6"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H9A240AC6EDF94E588B6490236ACAA3F4"><enum>(1)</enum><header>Community college</header><text>The term <term>community college</term> has the meaning given the term <term>junior or community college</term> in section 312(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058(f)</external-xref>).</text></paragraph>
<paragraph id="HCAFC7D77FDB94757A28D5C27DD9E3528"><enum>(2)</enum><header>Designated country</header><text>The term <term>designated country</term> means a country that has been approved and designated in writing by the President for purposes of this section, after providing—</text> <subparagraph id="H64AC49A162D74232A624E72A5F3FBE9E"><enum>(A)</enum><text>not less than 30 days of advance notification and explanation to the relevant congressional committees before the designation; and </text></subparagraph>
<subparagraph id="H9D07A5E2B7DA4151A8CC961776DF3F50"><enum>(B)</enum><text>in-person briefings to such committees, if requested during the 30-day advance notification period described in subparagraph (A). </text></subparagraph></paragraph> <paragraph id="H90C4C2675F454C708B62579D887EFF25"><enum>(3)</enum><header>Directorate</header><text>The term <term>Directorate</term> means the Directorate for Technology and Innovation established under subsection (b).</text></paragraph>
<paragraph id="H4C87D5FB42CB403C9DACAC5C089B70EE"><enum>(4)</enum><header>Emerging research institution</header><text>The term <term>emerging research institution</term> means an institution of higher education with an established undergraduate student program that has, on average for the 3 years prior to an application for an award under this section, received less than $35,000,000 in Federal research funding. </text></paragraph> <paragraph id="H7C608517D6E747818C1AD5227B239EC7"><enum>(5)</enum><header>Federal research facility</header><text>The term <term>Federal research facility</term> includes a research laboratory of the Department of Agriculture and any other Federally funded research and development center. </text></paragraph>
<paragraph id="HB7B8C5EA77064B63BFA54F039CEFF74C"><enum>(6)</enum><header>Historically Black college or university</header><text>The term <term>historically Black college or university</term> has the meaning given the term <quote>part B institution</quote> in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>)). </text></paragraph> <paragraph id="HE1AC53AC3F584A72A38E4935E8CA68C4"><enum>(7)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph>
<paragraph id="H0C23938E361E4CCC9E3A790EE3F97764"><enum>(8)</enum><header>Key technology focus areas</header><text>The term <term>key technology focus areas</term> means the areas included on the most recent list under subsection (d)(2).</text></paragraph> <paragraph id="HD0C0ECF9B99F4A86A71B5A089799E37C"><enum>(9)</enum><header>Labor organization</header><text>The term <term>labor organization</term> has the meaning given the term in section 2(5) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(5)</external-xref>), except that such term shall also include—</text>
<subparagraph id="HC9AAD5840EB7496AB615850138E3C227"><enum>(A)</enum><text>any organization composed of labor organizations, such as a labor union federation or a State or municipal labor body; and</text></subparagraph> <subparagraph id="HCA060F1A9E6A4D3A915326112E7E7E7A"><enum>(B)</enum><text>any organization which would be included in the definition for such term under such section 2(5) but for the fact that the organization represents—</text>
<clause id="H1640134D41D14734A743EE19DD386D5D"><enum>(i)</enum><text>individuals employed by the United States, any wholly owned Government corporation, any Federal Reserve Bank, or any State or political subdivision thereof;</text></clause> <clause id="H632452454C864D02B5FEF1C9559C4181"><enum>(ii)</enum><text>individuals employed by persons subject to the Railway Labor Act (<external-xref legal-doc="usc" parsable-cite="usc/45/151">45 U.S.C. 151</external-xref> et seq.); or</text></clause>
<clause id="HA4648E8B342D410283DCEFE8A852AA07"><enum>(iii)</enum><text>individuals employed as agricultural laborers. </text></clause></subparagraph></paragraph> <paragraph id="H7B6EAEAF49C243CDAD5384821AE02535"><enum>(10)</enum><header>Minority-serving institution</header><text>The term <term>minority-serving institution</term> means an institution described in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></paragraph>
<paragraph id="HCCDEA7A025FD43B99840DE93E72E56E8"><enum>(11)</enum><header>National laboratory</header><text>The term <term>National Laboratory</term> has the meaning given the term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>). </text></paragraph> <paragraph id="HC429B8365EAF402BA513802287379B6E"><enum>(12)</enum><header>Relevant congressional committees</header><text>The term <term>relevant congressional committees</term> means—</text>
<subparagraph id="HC94DA8FF0E7345B99BB68B071E410201"><enum>(A)</enum><text>the Committee on Armed Services, the Committee on Commerce, Science, and Transportation, the Committee on Energy and Natural Resources, the Committee on Appropriations, the Committee on Foreign Relations, the Committee on Health, Education, Labor, and Pensions, and the Select Committee on Intelligence of the Senate; and </text></subparagraph> <subparagraph id="H97FB9F5F575A4BFEAEEB41C7E80873DA"><enum>(B)</enum><text>the Committee on Armed Services, the Committee on Science, Space, and Technology, the Committee on Appropriations, the Committee on Foreign Affairs, and the Permanent Select Committee on Intelligence of the House of Representatives. </text></subparagraph></paragraph>
<paragraph id="H6DD1AA5AE037437DBD1E268A2B618644"><enum>(13)</enum><header>STEM</header><text>The term <term>STEM</term> has the meaning given such term in section 2 of the America COMPETES Reauthorization Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/358">Public Law 111–358</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/6621">42 U.S.C. 6621</external-xref> note). </text></paragraph> <paragraph id="H6A96222863784CF58F92D2C4916F6BF4"><enum>(14)</enum><header>Tribal college or university</header><text>The term <term>Tribal college or university</term> has the meaning given the term in section 316(b)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)(3)</external-xref>).</text></paragraph>
<paragraph id="H31176C631A4C42A3A5873D69C03C1CB0"><enum>(15)</enum><header>Underrepresented populations</header><text>The term <term>underrepresented populations</term> means women, minorities, veterans, tribal populations, persons with disabilities, and other populations that are underrepresented in STEM. </text></paragraph></subsection> <subsection id="H6202B331EE79451EA46A3316CB6C012B"><enum>(b)</enum><header>Establishment of Directorate for Technology and Innovation</header> <paragraph id="H72F0C0625F6542D5AA42158516DC1348"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of the <short-title>Endless Frontier Act</short-title>, the Director shall establish in the Foundation a Directorate for Technology and Innovation. The Directorate shall carry out the duties and responsibilities described in this section, in order to further the following goals:</text>
<subparagraph id="HFEC6E0156C084F4BBD1A5884F9DAFEE1"><enum>(A)</enum><text>Strengthening the leadership of the United States in critical technologies, as described as a critical national need in section 7018 of the America COMPETES Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1862o-5">42 U.S.C. 1862o–5</external-xref>), through basic research in the key technology focus areas and the commercialization of those technologies to businesses in the United States.</text></subparagraph> <subparagraph id="HE0A2AB8E7CF44410A6C8277323F3DF81"><enum>(B)</enum><text>Addressing and mitigating technology challenges integral to the geostrategic position of the United States through the activities authorized by this section. </text></subparagraph>
<subparagraph id="HF37572DE7ADE45FD86C7F6E0EEE30F21"><enum>(C)</enum><text>Enhancing the competitiveness of the United States in the key technology focus areas by improving education in the key technology focus areas and attracting more students to such areas at all levels of education.</text></subparagraph> <subparagraph id="H4B14D0BD73D24B5A9AF6EBB3A9B85839"><enum>(D)</enum><text>Consistent with the mission and operations of the Foundation, fostering the economic and societal impact of Federally funded research and development through an accelerated translation of basic advances in the key technology focus areas into processes and products, known as technology transfer, that can help achieve national goals related to economic competitiveness, domestic manufacturing, national security, shared prosperity, energy and the environment, health, education and workforce development, and transportation.</text></subparagraph>
<subparagraph id="H2DC6EE76CFE744698941C37343879F2E"><enum>(E)</enum><text>Utilizing the full potential of the United States workforce by encouraging broader participation in key technology focus areas by underrepresented populations.</text></subparagraph> <subparagraph id="HC8BD1DBDF13B4BC3A0C4CCE628BDAD19" commented="no"><enum>(F)</enum><text>Ensuring the programmatic work of the Directorate and Foundation incorporates a workforce perspective from labor organizations and workforce training organizations. </text></subparagraph></paragraph>
<paragraph id="H3F9BC82C079544F5807FA4BD6C8EE101"><enum>(2)</enum><header>Organization and administrative matters</header>
<subparagraph id="H9781E1DCACDB433C8C4E038174AF39D0"><enum>(A)</enum><header>Program managers</header><text>The employees of the Directorate may include program managers for the key technology focus areas, who may perform a role similar to program managers employed by the Defense Advanced Research Projects Agency for the oversight and selection of programs supported by the Directorate.</text></subparagraph> <subparagraph id="HD7FE0314567F4B6BAA13F13C831B5809"><enum>(B)</enum><header>Selection of recipients</header><text>Recipients of support under the programs and activities of the Directorate shall be selected by program managers or other employees of the Directorate and the selection criteria for financial assistance awards shall include intellectual merit and broader impacts, including economic impacts on the advanced technology production system of the United States. The Directorate may use a peer review process or the authorities provided under subsection (c), or some combination of such process and authorities, to inform the selection of award recipients. </text></subparagraph>
<subparagraph id="HD092AD87DD364114B454781BFD9131DC"><enum>(C)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of the <short-title>Endless Frontier Act</short-title>, the Director shall prepare and submit a report to the relevant congressional committees regarding the use of alternative methods for the selection of recipients and the distribution of funding to recipients as compared to the traditional peer review process.</text></subparagraph> <subparagraph id="H982705069F9A4737BE4178782F457AD1"><enum>(D)</enum><header>Assistant directors</header><text>The Director shall appoint an Assistant Director for the Directorate, in the same manner as other Assistant Directors of the Foundation are appointed.</text></subparagraph></paragraph>
<paragraph id="H7D0046D99F184518ADD24F19C300D326"><enum>(3)</enum><header>Report</header><text>Not later than 120 days after the date of enactment of the <short-title>Endless Frontier Act</short-title>, the Director shall prepare and submit a report to the relevant congressional committees regarding the establishment of the Directorate. </text></paragraph></subsection> <subsection id="HD6621A101D5248C991469E41410230D5"><enum>(c)</enum><header>Personnel management authorities for the Foundation</header><text>In addition to the authorities and requirements of section 15, the Director shall have the following authorities:</text>
<paragraph id="H4C17510EBDA04487BE70398B4C76E609"><enum>(1)</enum><header>Experts in science and engineering</header><text>The Director shall have the authority to carry out a program of personnel management authority in the same manner, and subject to the same requirements, as the program of personnel management authority authorized for the Director of the Defense Advanced Research Projects Agency under section 1599h of title 10, United States Code, for the Defense Advanced Research Projects Agency.</text></paragraph> <paragraph id="HB431352D947D4044951885B5DF636381"><enum>(2)</enum><header>Highly qualified experts in needed occupations</header><text>In addition to the authority provided under paragraph (1), the Director shall have the authority to carry out a program of personnel management authority in the same manner, and subject to the same requirements, as the program to attract highly qualified experts carried out by the Secretary of Defense under section 9903 of title 5, United States Code. Individuals hired by the Director through such authority shall include individuals with expertise in business creativity, innovation management, design thinking, entrepreneurship, venture capital, and related fields.</text></paragraph>
<paragraph id="HD28241BF14674961B7C808B3B67C550E"><enum>(3)</enum><header>Additional hiring authority</header><text>To the extent needed to carry out the duties in paragraph (1), the Director is authorized to utilize hiring authorities under section 3372 of title 5, United States Code, to staff the Directorate with employees from other Federal agencies, State and local governments, Indian Tribes and Tribal organizations, institutions of higher education, and other organizations, as described in that section, in the same manner and subject to the same conditions, that apply to such individuals utilized to accomplish other missions of the Foundation.</text></paragraph></subsection> <subsection id="HA9422F95F11D4115AE72E40A732A5254"><enum>(d)</enum><header>Duties and functions of the Directorate</header> <paragraph id="H457E2349D8A145688C2A17B5A8B70FD4"><enum>(1)</enum><header>Development of technology focus of the directorate</header><text>The Director shall—</text>
<subparagraph id="H08A56D51297B4EC7BEB1160594BBDACF"><enum>(A)</enum><text>through the Directorate, advance innovation in the key technology focus areas through basic and translational research and other activities described in this section; </text></subparagraph> <subparagraph id="H42C745EC6B7E46699B1215B820CF8388"><enum>(B)</enum><text>develop and implement strategies to ensure that the activities of the Directorate are directed toward the key technology focus areas in order to accomplish the goals described in subsection (b)(1) consistent with the most recent report conducted under section 5(b) of the <short-title>Endless Frontier Act</short-title>; and</text></subparagraph>

<clause id="H6CA1B437D76E4D668882B84DA9A27DD0"><enum>(i)</enum><text>artificial intelligence, machine learning, and other software advances;</text></clause> <clause id="H940993B945324ECAA74D14ECCF94C538"><enum>(ii)</enum><text>high performance computing, semiconductors, and advanced computer hardware;</text></clause>
<clause id="H608319372360434294D7F7FEE8B9191C"><enum>(iii)</enum><text>quantum computing and information systems;</text></clause> <clause id="H5D341D16CC7B484FB40D96D1C61DFFA7"><enum>(iv)</enum><text>robotics, automation, and advanced manufacturing;</text></clause>
<clause id="H8C3724C593D04166A1E8BF990D2B11E1"><enum>(v)</enum><text>natural and anthropogenic disaster prevention or mitigation;</text></clause> <clause id="H58B8ADB75A2E4A6C9DD9A14C852D2372"><enum>(vi)</enum><text>advanced communications technology;</text></clause>
<clause id="HB4FEE7D216BC4ECEBD491A4202C8C009"><enum>(vii)</enum><text>biotechnology, medical technology, genomics, and synthetic biology;</text></clause> <clause id="HC4781F4962C845C987ED1FC67A3B6172"><enum>(viii)</enum><text>cybersecurity, data storage, and data management technologies;</text></clause>
<clause id="H7F912B1BE274412DADE405FFB2FE0CE7" commented="no"><enum>(ix)</enum><text>advanced energy, batteries, and industrial efficiency; and</text></clause> <clause id="HB9B8C52073534769887F16D4C0568CE7"><enum>(x)</enum><text>advanced materials science, engineering, and exploration relevant to the other key technology focus areas described in this subparagraph. </text></clause></subparagraph>
<subparagraph commented="no" id="H242E8D46487C4BA98766B2B683804E6E"><enum>(B)</enum><header>Review of key technology focus areas and subsequent lists</header>
<clause id="HA1BBDD8B3B6746A8846507C5C3FCB25C"><enum>(i)</enum><header>Adding or deleting key technology focus areas</header><text>Beginning on the date that is 3 years after the date of enactment of the <short-title>Endless Frontier Act</short-title>, and every 3 years thereafter, the Director, in coordination with the Director of the Office of Science and Technology Policy, the Director of National Institute of Standards and Technology, the Secretary of Energy, the Secretary of Defense, the Director of the National Institutes of Health, and, as appropriate, the heads of other departments and agencies— </text> <subclause commented="no" id="HE7914F18EE5F4C129B830B4231899017"><enum>(I)</enum><text>shall review the list of key technology focus areas;</text></subclause>
<subclause commented="no" id="H5E6B9F3ED1E743D7A3B27C29DA5C036D"><enum>(II)</enum><text>may consider the challenges and recommendations identified in the report required by section 11 of the <short-title>Endless Frontier Act</short-title>; and </text></subclause> <subclause commented="no" id="HBC9A7E986763457EAFA1897D8EC911B4"><enum>(III)</enum><text>as part of that review, may add or delete key technology focus areas if societal challenges or the competitive threats to the United States have shifted (whether because the United States or other nations have advanced or fallen behind in a technological area), subject to clause (ii). </text></subclause></clause>
<clause commented="no" id="H3A07F81CB8424300914F3D9228DF4EBE"><enum>(ii)</enum><header>Limit on key technology focus areas</header><text>Not more than 10 key technology focus areas shall be included on the list of key technology focus areas at any time. </text></clause> <clause id="H90E79A74D5CB4597B8F28C3AC30A74BA"><enum>(iii)</enum><header>Updating focus areas and distribution</header><text>Prior to completion of each review under this subparagraph, the Director shall make the list of key technology focus areas readily available to the public and available for public comment, including, at a minimum, by publishing the list in the Federal Register even if no changes are expected to be made to the prior list.</text></clause>
<clause id="H9E8616B00203455FAAD3AABBC7F7742C" commented="no"><enum>(iv)</enum><header>Extraordinary circumstance waiver</header><text>In extraordinary circumstances, the Director of the Office of Science and Technology Policy may grant the Director the ability to add or delete key technology focus areas without acting in coordination as described in clause (i). If such an ability is determined to be necessary by the Director of the Office of Science and Technology Policy, the Director and the Director of the Office of Science and Technology Policy shall not later than 15 days ahead of such a waiver being granted submit a detailed description and justification to the relevant congressional committees. </text></clause></subparagraph></paragraph> <paragraph id="H7FA076CA399A4E6595B201223A794047"><enum>(3)</enum><header>Activities</header> <subparagraph id="H1ECAB061F28D4F02B8DFBFFABAC1B378"><enum>(A)</enum><header>In general</header><text>In carrying out the duties and functions of the Directorate, the Director—</text>
<clause id="H61C18D5A32CA40ED91EB1990E2CE17E1"><enum>(i)</enum><text>may make awards in a technologically-neutral manner for key technology focus areas to—</text> <subclause id="HA4546F7E674B4194ABB30599ED5B5A71"><enum>(I)</enum><text>individual institutions of higher education for work at centers or by individual researchers or teams of researchers;</text></subclause>
<subclause id="H86A1AC4BF3E84A87AB1144B9B02F5355"><enum>(II)</enum><text>not-for-profit entities; and</text></subclause> <subclause id="HDCCEBBA58BD949F1A0494C671AAE1407"><enum>(III)</enum><text>consortia that—</text>
<item id="H75F0DDBD14264A7CB00375E4AFB9790D"><enum>(aa)</enum><text>shall include and be led by an institution of higher education, or by a not-for-profit entity designed to support technology development, and may include 1 or more additional institutions of higher education;</text></item> <item id="H44A27F80785A4204BCBD5C0957C453E7"><enum>(bb)</enum><text>shall include at least one of the following:</text>
<subitem id="H30853D09A2CD453F97012DBE8E4D235E"><enum>(AA)</enum><text>a historically Black college or university;</text></subitem> <subitem id="H75F5DC860FB841F0B6EA041A71BAAAC6"><enum>(BB)</enum><text>a Tribal College or University;</text></subitem>
<subitem id="H29766BB1A05D44E0A162A61CD45D2F01"><enum>(CC)</enum><text>another minority-serving institution;</text></subitem> <subitem id="HEEDA741DE7A34C7D99D7380412DDCCD6"><enum>(DD)</enum><text>an institution that participates in the Established Program to Stimulate Competitive Research under section 113 of the National Science Foundation Authorization Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862g">42 U.S.C. 1862g</external-xref>); </text></subitem>
<subitem id="H86C2FB517A554448927373D2D079D511"><enum>(EE)</enum><text>an emerging research institution that is not classified as a very high research activity by the Carnegie Classification of Institutions of Higher Education and that has an undergraduate enrollment with a majority of students who are from underrepresented populations; or</text></subitem> <subitem id="H8854CD4AF31C449BBAF36E024B705585"><enum>(FF)</enum><text>a community college; and </text></subitem></item>
<item id="H43C1BF92819647EBA4A58ADE64B7E153"><enum>(cc)</enum><text>may include 1 or more— </text> <subitem id="HE528B244C6B5494FA276E15CA39F62A7"><enum>(AA)</enum><text>entities described in subclause (I) or (II) and industries, including startups, small businesses, and public-private partnerships;</text></subitem>
<subitem id="HFBA630594A7346E583FFB84AF3E44EA2"><enum>(BB)</enum><text>economic development organizations or venture development organizations, as such term is defined in section 28(a) of the Stevenson-Wydler Technology Innovation Act of 1980;</text></subitem> <subitem id="HC09CA63FA23C4E1583924130984C0426"><enum>(CC)</enum><text>National Laboratories; </text></subitem>
<subitem id="HF61563EBEEF54CF1B82747AED68536C2"><enum>(DD)</enum><text>Federal laboratories, as defined in section 4 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3703">15 U.S.C. 3703</external-xref>);</text></subitem> <subitem id="H2C050A47F16548AC913D1CE1AFBDD5D2"><enum>(EE)</enum><text>Federal research facilities;</text></subitem>
<subitem id="HEDEEE155969C45FEAE807EC89517CE3E"><enum>(FF)</enum><text>labor organizations; </text></subitem> <subitem id="H3CC11FB618844D5BAD448DAB2305D6E3"><enum>(GG)</enum><text>entities described in subclause (I) or (II) from allied or partner countries; </text></subitem>
<subitem id="HBDA7E7AA69B04F4981E85566B81AF9F4"><enum>(HH)</enum><text>other entities if determined by the Director to be vital to the success of the program; and</text></subitem> <subitem id="H67BF9CE3B2944EE9A4663A400FAF916B"><enum>(II)</enum><text>binational research and development foundations and funds, excluding foreign entities of concern;</text></subitem></item></subclause></clause>
<clause id="HA407A9EE7348472D89E607193973657D"><enum>(ii)</enum><text>may partner with other directorates of the Foundation for projects or research, including—</text> <subclause id="H2B0974F1DDF043B3A5F99CBF32225964"><enum>(I)</enum><text>to pursue basic questions about natural, human, and physical phenomena that could enable advances in the key technology focus areas;</text></subclause>
<subclause id="H890B8D48CDAD49E1B70203B066C589D7"><enum>(II)</enum><text>to study questions that could affect the design (including human interfaces), operation, deployment, or the social and ethical consequences of technologies in the key technology focus areas, including the development of technologies that complement or enhance the abilities of workers and impact of specific innovations on domestic jobs and equitable opportunity; and</text></subclause> <subclause id="H245D77149D794CF4921161F29B51E845"><enum>(III)</enum><text>to further the creation of a domestic workforce capable of advancing, using, and adapting to key technology focus areas and understanding and improving the impact of key technology focus areas on STEM teaching and learning advancing the key technology focus areas, including engaging relevant partners in research and innovation programs;</text></subclause></clause>
<clause id="H2E93C1D160FB4544B24798B116DE3CC3"><enum>(iii)</enum><text>may provide funds to any other Federal agencies for intramural or extramural work in the key technology focus areas through research, manufacturing, or other means; </text></clause> <clause id="HA57077ED4C3D4982A1B9BF5CFAE84E60"><enum>(iv)</enum><text>may make awards under the SBIR and STTR programs (as defined in section 9(e) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(e)</external-xref>); and</text></clause>
<clause id="H0B0D6E7978B840BC86A883FC5D83630F"><enum>(v)</enum><text>may enter into and perform such contracts, other transactions, or other arrangements, or modifications thereof, as may be necessary in the conduct of the work of the Directorate and on such terms as the Director considers appropriate, in furtherance of the purposes of this Act. </text></clause></subparagraph> <subparagraph id="H16B0B6F459C4405E8F2E658BA57847FC"><enum>(B)</enum><header>Reports</header><text>Not later than 180 days after the date of enactment of the <short-title>Endless Frontier Act</short-title>, the Director, in coordination with the Secretary of State and the Director of the Office of Science and Technology Policy, shall prepare and submit to the relevant congressional committees— </text>
<clause id="H4BC73E41827F4BC79C935330426002F3"><enum>(i)</enum><text>a plan to seek out additional investments from— </text> <subclause id="H7916F8ACB6D74E9FAEEEF5BF87BC9EBB"><enum>(I)</enum><text>certain designated countries; and</text></subclause>
<subclause id="H42AC17CF77F34B31B9DACFCF4CEA5BF8"><enum>(II)</enum><text>entities other than institutions of higher education; and </text></subclause></clause> <clause id="H6C2D0B7478A942DAACF6F0F56B82EBB3"><enum>(ii)</enum><text>the planned activities of the Directorate to secure federally funded science and technology pursuant to section 1746 of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>) and section 223 of William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>).</text></clause></subparagraph>
<subparagraph id="HC888F054949D47CE88F23C6A400A04F1"><enum>(C)</enum><header>Annual briefing</header><text>Each year, the Director shall formally request a briefing from the Secretary of Defense, the Secretary of Commerce, the Director of the Federal Bureau of Investigation, the Director of National Intelligence, and as appropriate other department or agency heads regarding their efforts to preserve the United States’ advantages generated by the activity of the Directorate.</text></subparagraph></paragraph> <paragraph id="H67E20DCF6E4D424CBDC4B52BEA6023FA"><enum>(4)</enum><header>Interagency cooperation</header> <subparagraph id="HECDE6496B93D4471AC76DB98ECBA23B7"><enum>(A)</enum><header>In general</header><text>In carrying out this section, the Director and other Federal research agencies, in consultation with the United States Patent and Trademark Office where appropriate, shall work cooperatively with each other to further the goals of this section in the key technology focus areas. </text></subparagraph>
<subparagraph id="HC5E438B2FC7C45EFA45EC72E34609581"><enum>(B)</enum><header>Coordination with NIST and Department of Energy</header><text>In making research awards under this section, the Director shall, as appropriate, work in coordination with the Director of the National Institute of Standards and Technology and the Secretary of Energy. </text></subparagraph> <subparagraph id="H23138596CFE5418BAB17A964A82C52C5"><enum>(C)</enum><header>Comptroller General report</header><text>Each year, the Comptroller General of the United States shall prepare and submit a report to Congress, and shall simultaneously submit the report to the Director and the Director of the Office of Science and Technology Policy, describing the interagency cooperation that occurred during the preceding year pursuant to this paragraph, including a list of—</text>
<clause id="H3EA37C00FF744D23B3C410987ADD452D"><enum>(i)</enum><text>any funds provided under paragraph (3)(A)(ii) to other divisions of the Foundation; and</text></clause> <clause id="H460B595D41FA43998DBBC7B042931287"><enum>(ii)</enum><text>any funds provided under paragraph (3)(A)(iii) to other Federal research agencies.</text></clause></subparagraph></paragraph>
<paragraph id="H5EFFA32924B742C7A30058370EF5083B"><enum>(5)</enum><header>Providing scholarships, fellowships, and other student support</header>
<subparagraph id="H49A1D3D463A54F1EA5A5643748E67952"><enum>(A)</enum><header>In general</header><text>The Director, acting through the Directorate, shall fund undergraduate scholarships (including at community colleges), graduate fellowships and traineeships, and postdoctoral awards in the key technology focus areas.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H020329AEAAB1473F99B8049C70C8AF8A"><enum>(B)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">The Director may carry out subparagraph (A) by providing funds—</text>
<clause commented="no" display-inline="no-display-inline" id="HE646CF9C2CB349099C4FBF417E62C1D0"><enum>(i)</enum><text display-inline="yes-display-inline">for making awards—</text> <subclause display-inline="no-display-inline" commented="no" id="HA963AEE8BB804F06ADF77D74FC9F3FE8"><enum>(I)</enum><text>directly to students; and</text></subclause>
<subclause id="HEE8E8F2D570646B4AC9F3F97CF38A07B"><enum>(II)</enum><text>to institutions of higher education or consortia of institutions of higher education, including those institutions or consortia involved in operating university technology centers established under paragraph (6); and</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H35681C83DA3646C2844F9969186E10DA"><enum>(ii)</enum><text display-inline="yes-display-inline">to programs in Federal research agencies that have experience awarding such scholarships, fellowships, traineeships, or postdoctoral awards.</text></clause></subparagraph>
<subparagraph id="H72DDD7D7E55847949447E94A8D9E1C4A"><enum>(C)</enum><header>Broadening participation</header><text>In carrying out this paragraph, the Director should work to increase the participation of underrepresented populations in fields related to the key technology focus areas. For that purpose, the Director may take such steps as establishing or augmenting programs targeted at underrepresented populations, and supporting traineeships or other relevant programs at institutions of higher education with high enrollments of underrepresented populations.</text></subparagraph> <subparagraph id="HDC2F5F50D7BA4E6BAF315134FB541742"><enum>(D)</enum><header>Innovation</header><text>In carrying out this paragraph, the Director shall encourage innovation in graduate education, including through encouraging institutions of higher education to offer graduate students opportunities to gain experience in industry or government as part of their graduate training, and through support for students in professional masters programs related to the key technology focus areas. </text></subparagraph>
<subparagraph id="H919D693808B54FE4BDF37415439D5252"><enum>(E)</enum><header>Supplement, not supplant</header><text>The Director shall ensure that funds made available under this paragraph shall be used to create additional support for postsecondary students and shall not displace funding for any other available support.</text></subparagraph></paragraph> <paragraph id="HCD2B3E2F41394EE88B7127EB7A223A39"><enum>(6)</enum><header>University technology centers</header> <subparagraph id="HF0722FB9450641A9AA565152AD33067B"><enum>(A)</enum><header>In general</header><text>From amounts made available to the Directorate, the Director shall, through a competitive application and selection process, make awards to institutions of higher education or consortia described in paragraph (3)(A)(i)(III) to establish university technology centers.</text></subparagraph>
<subparagraph id="H96CD60AB1AAA40BD8DD8690CC2D41D72"><enum>(B)</enum><header>Uses of funds</header>
<clause id="HFCE7113BD55947F685D76EFE0649BF18"><enum>(i)</enum><header>In general</header><text>A center established under an award under subparagraph (A)—</text> <subclause id="HF21A54DC9BAC44C1A2AA690D17191B3C"><enum>(I)</enum><text>shall use support provided under such subparagraph—</text>
<item id="H6E869D9C63444F2AAB81DBFB7B728D9F"><enum>(aa)</enum><text>to carry out basic and translational research to advance innovation in the key technology focus areas; and</text></item> <item id="H547C27131FE44A9DB9D62CC0788BF1E3"><enum>(bb)</enum><text>to further the development and commercialization of innovations, including inventions, in the key technology focus areas, including—</text>
<subitem id="H5A8A5649D5944AC3BFA80BD1B9FC04A2"><enum>(AA)</enum><text>innovations derived from research carried out under item (aa), through such activities as translational research, proof-of-concept development, and prototyping, in order to reduce the cost, time, and risk of commercializing new technologies; </text></subitem> <subitem id="H49157D213ACD49E68B7E4BD1D615CB06"><enum>(BB)</enum><text>to promote patenting and commercialization of inventions derived from research carried out under item (aa); and</text></subitem>
<subitem id="H301895C3176844779DDF2EFDB9CA4EB3"><enum>(CC)</enum><text>through the use of public-private partnerships; and</text></subitem></item></subclause> <subclause id="H063AA8C9218045E4A47423D7D4C2A4DA"><enum>(II)</enum><text>may use support provided under such subparagraph—</text>
<item id="H12C0F71F4C56475A83764F71645C004B"><enum>(aa)</enum><text>for the costs of equipment;</text></item> <item id="H2BA614479DA740D495B5B8FBD364F494"><enum>(bb)</enum><text>for the costs associated with technology transfer and commercialization, including patenting and licensing; or</text></item>
<item id="H9DBE50364D044D8A90C15245FF6801EF"><enum>(cc)</enum><text>for other activities or costs necessary to accomplish the purposes of this section, including for operations and staff.</text></item></subclause></clause> <clause id="H409AC2F0DC6B4B058A277A6EFF0C1C1E" commented="no"><enum>(ii)</enum><header>Support of regional technology hubs</header><text>Each center established under subparagraph (A) may support and participate in, as appropriate, the activities of any regional technology hub designated under section 28(b)(1)(A) of the Stevenson-Wydler Technology Innovation Act of 1980.</text></clause></subparagraph>
<subparagraph id="H109624A927034C388BF0D70382FE1936"><enum>(C)</enum><header>Selection process</header><text>In selecting recipients under this paragraph, the Director shall consider—</text> <clause id="HC34FB483F8F1439A9D06E254400EDA64"><enum>(i)</enum><text>the capacity of the applicant to pursue and advance basic and translational research;</text></clause>
<clause id="H2AD7ED7AD9334A2C9270C07E17E9F12F"><enum>(ii)</enum><text>the extent to which the applicant’s proposed research would be likely to advance American competitiveness in 1 or more key technology focus areas;</text></clause> <clause id="H31AC3B54351E4326B03663DE94CC5122"><enum>(iii)</enum><text>the extent to which the applicant's proposal would broaden participation by underrepresented populations in those areas;</text></clause>
<clause id="HE99BE3ED97F54448920393E7A2CBD3AC"><enum>(iv)</enum><text>the capacity of the applicant to engage industry, labor, and other appropriate organizations on any advances;</text></clause> <clause id="H5A5E3D70875441FF9BEDEAE4D052E337"><enum>(v)</enum><text>whether the applicant’s proposed research will, where applicable, contribute to growth in domestic manufacturing capacity and job creation; </text></clause>
<clause id="H406F87829F054AF0938DF24B5EE70882"><enum>(vi)</enum><text>the quality of plans for dissemination of research and technology results, in accordance with relevant export control laws;</text></clause> <clause id="H6241BBA564E14E93977EB2A376BD2364"><enum>(vii)</enum><text>how the applicant will, where applicable, encourage the training and participation of entrepreneurs and the translation of research results to practice, including the development of new businesses;</text></clause>
<clause id="HFA692749B4194E35902E8444033DBCB1"><enum>(viii)</enum><text>how the applicant will encourage the participation of inventors and entrepreneurs and the development of new businesses, where applicable;</text></clause> <clause id="H3750F3D229A44CEB8B9CD53113621587"><enum>(ix)</enum><text>regional and geographic diversity; </text></clause>
<clause id="HAE637207E18F460B8C21C1BED03DCA59"><enum>(x)</enum><text>in the case of a consortium, the extent to which the proposal includes institutions listed in paragraph (3)(A)(i)(III)(bb); and</text></clause> <clause id="H2561DA5F222C48D7813D8AFAE1075650"><enum>(xi)</enum><text>the amount of funds from industry organizations described in subparagraph (D)(ii) the applicant would use towards establishing the center under subparagraph (A).</text></clause></subparagraph>
<subparagraph id="H96542BF05DDF4C3CACBA084FC812BE71"><enum>(D)</enum><header>Requirements</header><text>The Director shall ensure that any institution of higher education or consortium receiving an award under subparagraph (A) has—</text> <clause id="HBB8AB8CE3CB24352B8C8B00DF1CE24A5"><enum>(i)</enum><text>the capacity or the ability to acquire the capacity to advance the goals described in subsection (b)(1); and</text></clause>
<clause id="HF11D0A560C8E4FA2AE7958B786EEA5B9"><enum>(ii)</enum><text>secured contributions for establishing the center under subparagraph (A) from industry organizations in an amount not less than 10 percent of the total amount of the award the institution or consortium would receive under subparagraph (A).</text></clause></subparagraph></paragraph> <paragraph id="H595BB34233AD4138A7420A6AA367684F"><enum>(7)</enum><header>Moving technology from laboratory to market</header> <subparagraph id="H0154372ED4014C66BB5FAE2366841BD8"><enum>(A)</enum><header>Program authorized</header> <clause id="HD2BCDAC064FB4836BAF9D611C70CA032"><enum>(i)</enum><header>In general</header><text>The Director, in coordination with the Director of the National Institute of Standards and Technology, shall establish a program in the Directorate to make awards, on a competitive basis, to institutions of higher education or consortia described in paragraph (3)(A)(i)(III)—</text>
<subclause id="H77EA00975A614FEBA8AB2DA855FE1B96"><enum>(I)</enum><text>to build capacity at an institution of higher education or within the consortium and facilitate collaboration with firms in the key technology focus areas to increase the likelihood that new technologies in the key technology focus areas will succeed in the commercial market; and </text></subclause> <subclause id="H00F90D098E96432AAB547A5147117BFB"><enum>(II)</enum><text>with the goal of promoting experiments with a range of models that institutions of higher education or consortia could use to—</text>
<item id="H17A87DAA0BB24CC0B405470B90777E58"><enum>(aa)</enum><text>enable new technologies and inventions to mature to the point where the technologies are more likely to succeed in the commercial market and promote the creation of high-quality jobs in the United States; and</text></item> <item id="HEFEB3C2DBE9840BE9872B98DD4025125"><enum>(bb)</enum><text>reduce the risks to commercial success for new technologies and inventions earlier in their development.</text></item></subclause></clause>
<clause id="H8044EB2F032B49BD91B831F21DC99CC1"><enum>(ii)</enum><header>Use for training</header><text>An award under this subparagraph for a purpose described in subclause (I) or (II) of clause (i) may also enable the institution of higher education or consortium to provide training and support to scientists, engineers, and inventors who are interested in research, technology transfer, and commercialization, including patenting and licensing, if the use is included in the proposal submitted under subparagraph (B).</text></clause></subparagraph> <subparagraph id="H27D5B6DEF38D405195FA1585CA680AFB"><enum>(B)</enum><header>Proposals</header><text>An institution of higher education or consortium desiring an award under this paragraph shall submit a proposal to the Director at such time, in such manner, and containing such information as the Director may require. The proposal shall include a description of—</text>
<clause id="HC6176F5E5D254C18969EA0C14809A7BA"><enum>(i)</enum><text>the broader impact of the proposal;</text></clause> <clause id="H600D019B703042788DFC6A702E437082"><enum>(ii)</enum><text>the steps the applicant is studying or will take to enable technology transfer to reduce the risks for commercialization for new technologies, including how the applicant will collaborate with firms in the key technology focus areas;</text></clause>
<clause id="H247EC9620D154E9B9C7B783EF93EE4E1"><enum>(iii)</enum><text>why such steps are likely to be effective;</text></clause> <clause id="H93EA4C9002E34611BEF9F7BB54F18AEF"><enum>(iv)</enum><text>how such steps differ from previous efforts to reduce the risks for commercialization for new technologies;</text></clause>
<clause id="H7E9EC2A92EA44178B75F2D5C8FBF5F0F"><enum>(v)</enum><text>whether the commercial viability of any new technologies will promote the creation of high-quality jobs in the United States;</text></clause> <clause id="H3EDD8064DAC8464782A23DD3F086E6F7"><enum>(vi)</enum><text>how the applicant will, where applicable, encourage the participation of inventors and entrepreneurs and the development of new businesses; and</text></clause>
<clause id="H57CCBD52EF044090888871173182BF75"><enum>(vii)</enum><text>how the applicant will, where applicable, encourage the training and participation of entrepreneurs and the translation of research results to practice, including the development of new businesses.</text></clause></subparagraph> <subparagraph id="H9DC2008CA0EE4E0FBF6AFD47751DFB53"><enum>(C)</enum><header>Use of funds</header><text>A recipient of an award under this paragraph shall use award funds to reduce the risks for commercialization for new technologies, which may include—</text>
<clause id="HC9A8F98A33694FC697AE17DE498D6C03"><enum>(i)</enum><text>creating and funding competitions to allow entrepreneurial ideas from institutions of higher education or consortia described in paragraph (3)(A)(i)(III) to illustrate their commercialization potential; </text></clause> <clause id="H5D767C73B0D7450481A659FC722A564D"><enum>(ii)</enum><text>facilitating relationships among local and national business leaders, including investors, and potential entrepreneurs to encourage successful commercialization;</text></clause>
<clause id="H8DC584729F3A47BEAC5C963B97DD88A5"><enum>(iii)</enum><text>creating or supporting entities that could enable researchers to further develop new technology, through patient capital investment, advice, staff support, or other means;</text></clause> <clause id="H2702EF4A1E7B4DD48AA4ACE53F36A4E9"><enum>(iv)</enum><text>providing facilities for start-up companies where technology maturation could occur;</text></clause>
<clause id="HEBA3FD6DA574409AB09ADEBD4BA3B4FD"><enum>(v)</enum><text>covering legal and other fees associated with technology transfer and commercialization, including patenting and licensing; and</text></clause> <clause id="HAF11C216A05A46D5B103262C486F7158"><enum>(vi)</enum><text>revising institution policies, including policies related to intellectual property and faculty entrepreneurship, to accomplish the goals of this paragraph.</text></clause></subparagraph>
<subparagraph id="HF6ECCCC699A94C18B53A36C0FA9B6C01"><enum>(D)</enum><header>Reporting on commercialization based on metrics</header><text>The Director shall establish—</text> <clause id="H0DAD36A2105045AF878044E2539765C3"><enum>(i)</enum><text>metrics related to commercialization for an award under this paragraph; and </text></clause>
<clause id="H4C1BEC5E78FF4176A1D8414E86C53D3E"><enum>(ii)</enum><text>a reporting schedule for recipients of such awards that takes into account both short- and long-term goals of the program under this paragraph. </text></clause></subparagraph></paragraph> <paragraph id="H1829CADB0861411581115B7836E24A06"><enum>(8)</enum><header>Test beds</header> <subparagraph id="HDB0FDD462A6646FB8AAB57C6D535ED9C"><enum>(A)</enum><header>Program authorized</header> <clause id="HE1AB336F2D3741D1B4B978C45EB730D1"><enum>(i)</enum><header>In general</header><text>The Director, in coordination with the Director of the National Institute of Standards and Technology, shall establish a program in the Directorate to make awards, on a competitive basis, to institutions of higher education or consortia described in paragraph (3)(A)(i)(III) to establish and operate test beds and fabrication facilities to advance the operation, integration, deployment, and, as appropriate, manufacturing of new, innovative technologies in the key technology focus areas, which may include hardware or software. The goal of such test beds and facilities shall be to accelerate the movement of innovative technologies into the commercial market through the private sector.</text></clause>
<clause id="H8396FD834D1240429CDDD844A8ABB427"><enum>(ii)</enum><header>Coordination</header><text>In establishing the program under clause (i), the Director shall ensure coordination in establishing new test beds under this paragraph with other test beds supported by the Foundation or established under Manufacturing USA to avoid duplication and maximize the use of Federal resources. </text></clause></subparagraph> <subparagraph id="H4B2ED488A0B240D888F475BB9AFCE1EB"><enum>(B)</enum><header>Proposals</header><text>A proposal submitted under this paragraph shall, at a minimum, describe—</text>
<clause id="H41A0FFECA32A4408A586D1D46845EEFA"><enum>(i)</enum>
<subclause commented="no" display-inline="yes-display-inline" id="HDCAC3C033579423F84C1EE2D461284E4"><enum>(I)</enum><text>the technology or technologies that will be the focus of the test bed or fabrication facility;</text></subclause> <subclause id="HF1C5891DD64F40EF93632E768FF3DE7C" indent="up1"><enum>(II)</enum><text>the goals of the work to be done at the test bed or facility; and</text></subclause>
<subclause indent="up1" id="HEAC81232D9AE4EED91A87DF898546104"><enum>(III)</enum><text> the expected schedule for completing that work;</text></subclause></clause> <clause id="H056126E363CB45DAAE1CC800EB411022"><enum>(ii)</enum><text>how the applicant will assemble a workforce with the skills needed to operate the test bed or facility;</text></clause>
<clause id="H8AB8DAC205B24B019109E3A9A3C7BA43"><enum>(iii)</enum><text>how the applicant will ensure broad access to the facility;</text></clause> <clause id="HD61C7EC2DA86495FA5009D394CDFA924"><enum>(iv)</enum><text>how the applicant will collaborate with firms in the key technology focus areas, including through coordinated research and development and funding, to ensure that work in the test bed or facility will contribute to the commercial viability of any technologies and will include collaboration from industry and labor organizations;</text></clause>
<clause id="HBA578FAF25424804B5B1A4AC98881F45"><enum>(v)</enum><text>how the applicant will encourage the participation of inventors and entrepreneurs and the development of new businesses;</text></clause> <clause id="HB5CB0C1914904F26B943519F276DDE9D"><enum>(vi)</enum><text>how the applicant will increase participation by underrepresented populations;</text></clause>
<clause id="HBC1C9FBB9B2C450ABAE34D5391746035"><enum>(vii)</enum><text>how the applicant will demonstrate that the commercial viability of any new technologies will support the creation of high-quality domestic jobs; </text></clause> <clause id="H2CE94AFA4C994A1C98703ECC12ABB41C"><enum>(viii)</enum><text>how the test bed or facility will operate after Federal funding has ended; and</text></clause>
<clause id="H269CAB524F3744A79A4AE8B54D514EE5"><enum>(ix)</enum><text>how the test bed will disseminate lessons and other technical information to United States firms or allied or partner country firms in the United States. </text></clause></subparagraph> <subparagraph id="H64CC7F3F5EBB4EA2ACA763939399D3FF"><enum>(C)</enum><header>Awards</header><text>Awards made under this paragraph shall be for 7 years, with the possibility of 5-year extensions.</text></subparagraph>
<subparagraph id="H8BA0792219774785900DFF967E1652B2"><enum>(D)</enum><header>Authorized use of funds</header><text>An awardee under this paragraph may, in order to achieve the purposes described in subparagraph (A)(i), use the award for the purchase of equipment, the support of graduate students and postdoctoral researchers, and the salaries of staff. </text></subparagraph> <subparagraph id="H7B36751465DE4CED9750BEA07C4B3514"><enum>(E)</enum><header>Results</header><text>An awardee under this paragraph may publish and share with the public the results of the work conducted under this paragraph.</text></subparagraph>
<subparagraph id="HEAF7DE323F904EF695658275617E6D7D"><enum>(F)</enum><header>Interagency semi-annual meetings</header><text>The Director, the Director of the National Institute of Standards and Technology, and the heads of other departments and agencies, or their designees, with test bed related equities shall hold an annual meeting to coordinate their respective test bed related investments, future years plan, and other appropriate matters, to avoid conflicts and duplication of efforts. Upon request by Congress, Congress shall be briefed on the results of the meetings.</text></subparagraph></paragraph> <paragraph commented="no" id="H44EF59F174414ADC986935BE0E7C0A5A"><enum>(9)</enum><header>Inapplicability</header><text>Section 5(e)(1) shall not apply to grants, contracts, awards, or other arrangements made under this section.</text></paragraph></subsection>
<subsection id="H0974C598C9B64AC4810C75C396EEDC97"><enum>(e)</enum><header>Areas of funding support</header><text>Subject to the availability of funds to carry out this section, the Director shall endeavor, for each fiscal year, to use—</text> <paragraph id="HC73AD0F22A9645D690A9915F0136B18E"><enum>(1)</enum><text>not less than 35 percent of funds provided to the Directorate for such year to carry out subsection (d)(6);</text></paragraph>
<paragraph id="HAAABFE44754C477EA31A4FBBF20BC06A"><enum>(2)</enum><text>not less than 15 percent of such funds to carry out the purpose of subsection (d)(5)—</text> <subparagraph id="HA9943805CDFA4F9B813981A919B56586"><enum>(A)</enum><text>with the goal of awarding, across the key technology focus areas—</text>
<clause id="HB355E46D0DA24697908D2952B74A5125"><enum>(i)</enum><text>not fewer than 1,000 postdoctoral awards;</text></clause> <clause id="H6D022C657ADF4586914565613DB4CF20"><enum>(ii)</enum><text>not fewer than 2,000 graduate fellowships and traineeships; and</text></clause>
<clause id="H4F7939F211DE4D04A0988F7AB2FF5F48"><enum>(iii)</enum><text>not fewer than 1,000 undergraduate scholarships, including scholarships to attend community colleges;</text></clause></subparagraph> <subparagraph id="HB2B7C81595164C949E2E90E3DC89B7E6"><enum>(B)</enum><text>of which not less than 10 percent of the funds designated under this paragraph shall be used to support additional awards to focus on community college training, education, and teaching programs that increase the participation of underrepresented populations in science, technology, engineering, and mathematics, including technical programs through programs such as the Advanced Technological Education program;</text></subparagraph>
<subparagraph id="H299C6FF826D14DD0B5B855E148A3E181"><enum>(C)</enum><text>of which not less than 20 percent of the funds designated under this paragraph shall be used to support awards for post-doctorate fellowships, graduate fellowships and traineeships, and undergraduate scholarships through institutions of higher education, and other institutions, located in jurisdictions that participate in the Established Program to Stimulate Competitive Research under section 113 of the National Science Foundation Authorization Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862g">42 U.S.C. 1862g</external-xref>); and</text></subparagraph> <subparagraph id="H8B8AF0DA0115440DAF8F4E841B0A9393"><enum>(D)</enum><text>if funds remain after carrying out subparagraphs (A), (B), and (C), awards to institutions of higher education to enable the institutions to fund the development and establishment of new or specialized courses of education for graduate, undergraduate, or technical college students; </text></subparagraph></paragraph>
<paragraph id="H14CA400BBFB8428DB48D257884AAE52B"><enum>(3)</enum><text>not less than 5 percent of such funds to carry out subsection (d)(7);</text></paragraph> <paragraph id="H3DD5B4EE68A3456A890F9A8A56EF0CEE"><enum>(4)</enum><text>not less than 10 percent of such funds to carry out subsection (d)(8);</text></paragraph>
<paragraph id="H3B235C3E7E684EBE92DD33AF5AD53455"><enum>(5)</enum><text>not less than 15 percent of such funds to carry out research and related activities pursuant to subclauses (I) and (II) of subsection (d)(3)(A)(ii); and</text></paragraph> <paragraph commented="no" id="H1EAB64AB0DD54C87842DDE8B444AE922"><enum>(6)</enum><text>not less than 20 percent of such funds to support research in the key technology focus areas through the Established Program to Stimulate Competitive Research under section 113 of the National Science Foundation Authorization Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862g">42 U.S.C. 1862g</external-xref>).</text></paragraph></subsection>
<subsection id="H6DD3E6A1A4D5464289D3A9E84EC90444"><enum>(f)</enum><header>Technical assistance for award recipients and applicants</header><text>The Director may—</text> <paragraph id="HF163204E94E94E15A9A11A0819900721"><enum>(1)</enum><text>coordinate with other Federal agencies to establish interagency and multidisciplinary teams to provide technical assistance to recipients of, and prospective applicants for, awards under this section;</text></paragraph>
<paragraph id="HF62EA8D280C54CA99F681248E1EF939D"><enum>(2)</enum><text>by Federal interagency agreement and notwithstanding any other provision of law, transfer funds available to carry out this section to the head of another Federal agency to facilitate and support the provision of such technical assistance; and</text></paragraph> <paragraph id="HE9FC67040B9940F4A7427BF6DB8CF55A"><enum>(3)</enum><text>enter into contracts with third parties to provide such technical assistance. </text></paragraph></subsection>
<subsection id="HA09B97814D39410DBC84A89CB15DC1BD"><enum>(g)</enum><header>Authorization of appropriations and limitations</header>
<paragraph id="HE0D9141E12B94462AEB8C598B2F2FEB9"><enum>(1)</enum><header>Authorization for the Office of Inspector General</header><text>From any amounts appropriated for the Foundation for a fiscal year, there is authorized to be appropriated for necessary expenses of the Office of Inspector General of the Foundation an amount of not less than $10,000,000 in any fiscal year appropriation for the Foundation, for oversight of the programs and activities established under this section in accordance with the Inspector General Act of 1978.</text></paragraph> <paragraph commented="no" id="H30283210D65F45B59DA0CCCF55C66AFE"><enum>(2)</enum><header>Supplement and not supplant</header><text>The amounts authorized to be appropriated to carry out this section shall supplement, and not supplant, any other amounts already appropriated to the Foundation or Office of Inspector General of the Foundation, except with respect to transfers described in paragraph (3). </text></paragraph>
<paragraph id="H9D25F4A92B7948179AEF3EF9478F0E0B"><enum>(3)</enum><header>Transfer of funds authority</header><text>For fiscal years 2022 through 2024, the Director shall transfer any funds appropriated to the Directorate to any other directorate or office of the Foundation for activities directly related to the key technology focus areas.</text></paragraph> <paragraph id="HA2FD1A5C2FA54131B39148B4EE9423F0"><enum>(4)</enum><header>No new awards</header><text>The Director shall not make any new awards for the activities described in this section for any fiscal year in which the total amount appropriated to the Foundation (not including amounts appropriated for the Directorate) is less than the total amount appropriated to the Foundation (not including such amounts), adjusted by the rate of inflation, for the previous fiscal year.</text></paragraph>
<paragraph id="HD7A96C3D7EDA4390BB41F1D3D4F7E799"><enum>(5)</enum><header>No funds for construction</header><text>No funds provided under this section shall be used for construction. </text></paragraph></subsection> <subsection id="H5D576232BA0E40488436D8FAD58BB0EA"><enum>(h)</enum><header>Rules of construction</header><text>Nothing in this section or any other amendments made to this Act by the <short-title>Endless Frontier Act</short-title> shall be construed to alter the mission of any directorate of the Foundation existing prior to the date of enactment of such Act, or to alter the award selection methods or criteria used by such directorates.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H6071EDE8984F4A38889F3773910DDBE0"><enum>(c)</enum><header>Chief diversity officer</header><text display-inline="yes-display-inline">The National Science Foundation Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/42/1861">42 U.S.C. 1861</external-xref> et seq.), as amended by subsection (b), is further amended by inserting after section 8A the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H6F57DE50ED7F4D589CDF0982E557A499"> <section id="HC24E6AC440444317BDD13620C2FFE368"><enum>8B.</enum><header>Chief Diversity Officer</header> <subsection id="H0D775FDA20164EA39805A003D1C30B98"><enum>(a)</enum><header>Chief diversity officer</header> <paragraph id="HB09F45F398E64C2D9E94424AD3F7663A"><enum>(1)</enum><header>Appointment</header><text>The Director shall appoint a Chief Diversity Officer of the National Science Foundation.</text></paragraph>
<paragraph id="HC57DD113D358431189CCD1306A52FC94"><enum>(2)</enum><header>Qualifications</header><text>The Chief Diversity Officer should have significant experience with diversity and inclusion, in particular within the Federal Government and science community.</text></paragraph> <paragraph id="H85AB8E9511954C01858DB7E994AA888B"><enum>(3)</enum><header>Oversight</header><text>The Chief Diversity Officer shall report directly to the Director in the performance of the duties of the Chief Diversity Officer under this section.</text></paragraph></subsection>
<subsection id="H7278E8EB0A9C4297BD390F3E73A7CF37"><enum>(b)</enum><header>Duties</header><text>The Chief Diversity Officer is responsible for providing advice on policy, oversight, guidance, and coordination with respect to matters of the National Science Foundation related to diversity and inclusion. Other duties may include—</text> <paragraph id="HBB42AF921CD5434DB97098D53A6317CF"><enum>(1)</enum><text>establishing and maintaining a strategic plan that publicly states a diversity definition, vision, and goals for the National Science Foundation;</text></paragraph>
<paragraph id="H13813A01D8E542D5BBDD7A51FB15C3C3"><enum>(2)</enum><text>defining a set of strategic metrics that are—</text> <subparagraph id="H7F7B96CAC37F4DDA83AE2BA5C4779350"><enum>(A)</enum><text>directly linked to key organizational priorities and goals; </text></subparagraph>
<subparagraph id="HA1EF17E8BF0A4C9880F07442CA59A92D"><enum>(B)</enum><text>actionable; and </text></subparagraph> <subparagraph id="H8FB5AF24484B459EA70FA13F336C654B"><enum>(C)</enum><text>actively used to implement the strategic plan under paragraph (1);</text></subparagraph></paragraph>
<paragraph id="H66E6CCD8AF5E4CDE9099AC4596440C8F"><enum>(3)</enum><text>advising in the establishment of a strategic plan for diverse participation by institutions of higher education, including community colleges, historically Black colleges and universities, Tribal colleges or universities, and other minority-serving institutions (as such terms are defined in section 8A(a)), and individuals;</text></paragraph> <paragraph id="HA1E80B8CC9F9462C9175A90865855B80"><enum>(4)</enum><text>advising in the establishment of a strategic plan for outreach to, and recruiting from, untapped locations and underrepresented populations; and</text></paragraph>
<paragraph id="H24268CF839CB4F448B43CAB2BC88C950"><enum>(5)</enum><text>performing such additional duties and exercise such powers as the Director may prescribe.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HC10B4BDEE6064D02978D91F60C701C18" commented="no"><enum>(d)</enum><header>Annual report on unfunded priorities</header> <paragraph id="H2BF41592C42E49B580AB914C46AB8625"><enum>(1)</enum><header>Annual report</header><text>Not later than 10 days after the date on which the budget of the President for a fiscal year is submitted to Congress pursuant to section 1105 of title 31, United States Code, the National Science Board shall submit to the President and to Congress a report on the unfunded priorities of the National Science Foundation.</text></paragraph>
<paragraph id="HCA78339AA8BB4A97812FA5DA2711FD2C"><enum>(2)</enum><header>Elements</header><text>Each report submitted under paragraph (1) shall provide—</text> <subparagraph id="HC034A1CC0BF7477CB7DD774F21006BCA"><enum>(A)</enum><text>for each directorate of the National Science Foundation for the most recent, fully completed fiscal year—</text>
<clause id="HE4C708B5E1B94A3EA2A7D4A455992CA9"><enum>(i)</enum><text>the proposal success rate;</text></clause> <clause id="HCF8112EFCF704445AF46869FC06301ED"><enum>(ii)</enum><text>the percentage and total funding of proposals that were not funded and that met the criteria for funding; and</text></clause>
<clause id="H296FEB28D83E4CE7981188EBDABFC95F"><enum>(iii)</enum><text>the most promising research areas covered by proposals described in clause (ii); and</text></clause></subparagraph> <subparagraph id="H14E9BEEBE2504522AD4688CBD09E36DE" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>a list, in order of priority, of the next activities approved by the National Science Board to be undertaken in the Major Research Equipment and Facilities Construction account. </text></subparagraph></paragraph></subsection>
<subsection id="HD2164A88224D495EAF53DEE867C17568"><enum>(e)</enum><header>Pilot program</header>
<paragraph id="H95834EA285A441B49D46BED54D387BD1"><enum>(1)</enum><header>In general</header><text>The Director, acting through the Directorate, shall establish a 5-year pilot program for awarding grants to eligible partnerships to build research and education capacity at emerging research institutions to enable such institutions to contribute to programs run by the Directorate. </text></paragraph> <paragraph id="H87AF5C8CE2504B47B74B21CAE322D2A1"><enum>(2)</enum><header>Applications</header><text>An eligible partnership seeking a grant under this subsection shall submit an application to the Director at such time, in such manner, and containing such information as the Director may reasonably require, including a statement of how the partnership will use the funds awarded through the grant to achieve a lasting increase in the research and education capacity of each emerging research institution included in the eligible partnership.</text></paragraph>
<paragraph id="HB48CA3737A5C44BDA2EE6950C5780648"><enum>(3)</enum><header>Activities</header><text>An eligible partnership receiving a grant under this subsection may use the funds awarded through such grant for—</text> <subparagraph id="H0AE12D481ED3417B9256FFBE571F9DB6"><enum>(A)</enum><text>faculty salaries and training;</text></subparagraph>
<subparagraph id="H1D69E68A778B4FAAB46A6D64704EA469"><enum>(B)</enum><text>research experiences for undergraduate and graduate students;</text></subparagraph> <subparagraph id="H3576B3F295664E1D98E32C03AC650876"><enum>(C)</enum><text>maintenance and repair of research equipment and instrumentation; and </text></subparagraph>
<subparagraph id="H6F31F499A94F492EB39B6F0225BC0AD6"><enum>(D)</enum><text>any other activities the Director determines appropriate. </text></subparagraph></paragraph> <paragraph id="HB8050F92E49942CBBF784253DEA6F488"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph id="H0F65202F32CD4F18985C4B858194E353"><enum>(A)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the National Science Foundation.</text></subparagraph> <subparagraph id="H6874FC442CCA47368917F60008882A04"><enum>(B)</enum><header>Directorate; emerging research institution</header><text>The terms <term>Directorate</term> and <term>emerging research institution</term> have the meanings given such terms in section 8A(a) of the National Science Foundation Act of 1950, except that, with respect to the term <quote>emerging research institution</quote>, the reference in paragraph (4) of such section to an award under section 8A of that Act shall be deemed a reference to a grant under this subsection.</text></subparagraph>
<subparagraph id="H556C812AED534AE78004BD1BFA96247C"><enum>(C)</enum><header>Eligible partnership</header><text>The term <term>eligible partnership</term> means a partnership of—</text> <clause id="H90B952371CEF4B9C9D9057859A507DAA"><enum>(i)</enum><text>at least 1 emerging research institution; and</text></clause>
<clause id="H2F25DF18E8C84F41AEEDBDD71FC18F01"><enum>(ii)</enum><text>at least 1 institution classified as a very high research activity by the Carnegie Classification of Institutions of Higher Education. </text></clause></subparagraph></paragraph></subsection></section> <section id="H33EADFF80B2E48B18C1E27A2F354C8BC"><enum>4.</enum><header>Endless Frontier Fund</header> <subsection id="H461C414675DB4A929A8ADE29931A8844"><enum>(a)</enum><header>In general</header><text>There is authorized to be appropriated a total of $112,410,000,000 for fiscal years 2022 through 2026 for the implementation of this Act and the amendments made by this Act. Such funds shall be available for the implementation of this Act and the amendments made by this Act, and shall be administered by the Director of the Office of Science and Technology Policy (referred to in this section as the <quote>Director</quote>).</text></subsection>
<subsection id="H9F1B50CCCDFB48699F1E593F60291835"><enum>(b)</enum><header>Use of funds</header>
<paragraph id="HAD108161D89A4529A01F8AFF369A359C"><enum>(1)</enum><header>Submission of annual allocation</header><text>Until the date on which all of the amounts in the Fund described in subsection (a) are expended, the Director shall annually submit to Congress, together with the annual budget of the United States, a list of allocations to agencies and departments to implement this Act and the amendments made by this Act that includes a detailed description of each program proposed to be funded, including the estimated expenditures from the Fund for the program for the applicable fiscal year.</text></paragraph> <paragraph id="HA30454DA05684317958C07EE9456DB2B"><enum>(2)</enum><header>Alternate allocation</header> <subparagraph id="H660AD2898D354B62BB1E751AA1E86E88"><enum>(A)</enum><header>In general</header><text>The Commerce, Justice, Science, and Related Agencies Appropriations Act for the relevant fiscal year may provide for alternate allocation of amounts made available under this section.</text></subparagraph>
<subparagraph id="H59BB467D8A364CD797834F09C77E9A10"><enum>(B)</enum><header>Allocation by president</header>
<clause id="H89D9A4128E2D454AACDAABB40AB41D10"><enum>(i)</enum><header>No alternate allocations</header><text>If Congress has not enacted legislation establishing alternate allocations as described in subparagraph (A) by the date on which the Act making full-year appropriations for Commerce, Justice, Science, and Related Agencies for the applicable fiscal year is enacted into law, amounts made available under this section shall be allocated by the Director.</text></clause> <clause id="H9C586412AE9940739704DE4B2671597E"><enum>(ii)</enum><header>Insufficient alternate allocation</header><text>If Congress enacts legislation establishing alternate allocations for amounts made available under this section that are less than the full amount authorized to be appropriated to the Fund for that fiscal year under subsection (a), the difference between the amount authorized to be appropriated and the alternate allocation shall be allocated by the Director.</text></clause></subparagraph></paragraph></subsection>
<subsection id="HA3533976314949538CC9F2B336E5CA39"><enum>(c)</enum><header>Limitation</header><text>No funds provided under this section shall be used for construction, except in the case of infrastructure projects described in section 28(b)(1)(B) of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="public-law" parsable-cite="pl/96/480">Public Law 96–480</external-xref>), as added by section 7(a) of this Act.</text></subsection> <subsection id="HA66FE2962A9F4A91977FF1E5619CC740"><enum>(d)</enum><header>Sense of Congress</header><text>It is the sense of Congress that, during the period of fiscal years 2022 through 2026, the Director shall make available, from amounts made available under subsection (a)—</text>
<paragraph id="H62375B1AD0F943DABB2BACE49B838E65"><enum>(1)</enum><text>$9,425,000,000 to the regional technology hub program under section 28 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="public-law" parsable-cite="pl/96/480">Public Law 96–480</external-xref>), as added by section 7 of this Act;</text></paragraph> <paragraph id="H861BF19D9D10401D9B6FC4FE9B36C3FB"><enum>(2)</enum><text>$575,000,000 to the comprehensive regional technology strategy grant program under section 29 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="public-law" parsable-cite="pl/96/480">Public Law 96–480</external-xref>), as added by section 8 of this Act, of which $100,000,000 shall be made available for each of fiscal years 2022 and 2023 and $125,000,000 shall be made available for each of fiscal years 2024 through 2026; </text></paragraph>
<paragraph id="H51993F9D34044FA28FB0484664FC7C9D" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>$100,000,000,000 to the Directorate for Technology and Innovation of the National Science Foundation, of which $5,000,000,000 shall be made available for fiscal year 2022, $10,000,000,000 shall be made available for fiscal year 2023, $20,000,000,000 shall be made available for fiscal year 2024, $30,000,000,000 shall be made available for fiscal year 2025, and $35,000,000,000 shall be made available for fiscal year 2026; and</text></paragraph> <paragraph id="H4C990FB3183D4DFEA7002E30341C2A7D"><enum>(4)</enum><text display-inline="yes-display-inline">$2,410,000,000 for the period of fiscal years 2022 through 2026 to the Manufacturing USA Program for activities described under section 9 of this Act.</text></paragraph></subsection></section>
<section id="H3369A91AFDD54F318BBC0954660B1012"><enum>5.</enum><header>Strategy and report on economic security, science, research, and innovation to support the National Security Strategy</header>
<subsection id="H41A2C1A882A14C78A3CBE7CED8B1C169"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H6CAC1BB67D22401EA6E9EFD8883452F9"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text>
<subparagraph id="H08C284DB3E864AFFA803224C11A3E291"><enum>(A)</enum><text>the Committee on Agriculture, Nutrition, and Forestry, the Committee on Appropriations, the Committee on Armed Services, the Committee on Banking, Housing, and Urban Affairs, the Committee on the Budget, the Committee on Commerce, Science, and Transportation, the Committee on Energy and Natural Resources, the Committee on Finance, the Committee on Foreign Relations, the Committee on Health, Education, Labor, and Pensions, the Committee on Homeland Security and Governmental Affairs, the Committee on the Judiciary, and the Select Committee on Intelligence of the Senate; and</text></subparagraph> <subparagraph id="H2C21049BFFF342D495BB1CC141FFE02F"><enum>(B)</enum><text>the Committee on Agriculture, the Committee on Appropriations, the Committee on Armed Services, the Committee on the Budget, the Committee on Education and Labor, the Committee on Energy and Commerce, the Committee on Financial Services, the Committee on Foreign Affairs, the Committee on Homeland Security, the Committee on the Judiciary, the Committee on Oversight and Reform, the Committee on Science, Space, and Technology, the Committee on Ways and Means, and the Permanent Select Committee on Intelligence of the House of Representatives. </text></subparagraph></paragraph>
<paragraph id="HF7767A1594384B03B724BD77DC18F5DF" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Key technology focus area</header><text display-inline="yes-display-inline">The term <term>key technology focus area</term> means an area included on the most recent list under section 8A(d)(2) of the National Science Foundation Act of 1950. </text></paragraph> <paragraph id="HFCCAC1FA25704A0F948A7B74C8A4D1EC"><enum>(3)</enum><header>National security strategy</header><text>The term <term>national security strategy</term> means the national security strategy required by section 108 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3043">50 U.S.C. 3043</external-xref>).</text></paragraph></subsection>
<subsection id="HD346321F2F474D1C99FCAA6879BDD73C"><enum>(b)</enum><header>Strategy and report</header>
<paragraph id="HACD256E4E2844E0D8B7CD8E4C1A542A0"><enum>(1)</enum><header>In general</header><text>In 2021 and in each year thereafter before the applicable date set forth under paragraph (2), the Director of the Office of Science and Technology Policy, in coordination with the Director of the National Economic Council, the Director of the National Science Foundation, the Secretary of Commerce, the Secretary of Energy, the National Security Council, the United States Patent and Trademark Office, and the heads of other relevant Federal agencies and in consultation with relevant nongovernmental partners, shall—</text> <subparagraph id="HD92E330B70FA446BA70EFABE2485C6B2"><enum>(A)</enum><text>review such strategy, programs, and resources as the Director of the Office of Science and Technology Policy determines pertain to United States national competitiveness in science, research, innovation, and technology transfer, including patenting and licensing, to support the national security strategy;</text></subparagraph>
<subparagraph id="HC20F77F6D58C4F93A840F2825E4D57C8"><enum>(B)</enum><text>develop or revise a strategy for the Federal Government to improve the national competitiveness of the United States in science, research, and innovation to support the national security strategy; and</text></subparagraph> <subparagraph id="H51C12C7CC9EF4A1C976656B8F4E0B0DC"><enum>(C)</enum><text>submit to the appropriate committees of Congress—</text>
<clause id="HFBA1747387674B10922A42286FD61357"><enum>(i)</enum><text>a report on the findings of the Director with respect to the review conducted under subparagraph (A); and</text></clause> <clause id="H01AA4F8221364904BDD3BFF3A7F4F5A6"><enum>(ii)</enum><text>the strategy developed or revised under subparagraph (B). </text></clause></subparagraph></paragraph>
<paragraph id="HC800E52676FE42A293A8E57D01733B63"><enum>(2)</enum><header>Applicable dates</header><text>In each year, the applicable date set forth under this paragraph is as follows:</text> <subparagraph id="H057C1FC78FAA471DB1EA66233F7F7F11"><enum>(A)</enum><text>In 2021, December 31, 2021.</text></subparagraph>
<subparagraph id="H332622A7C67146F6AC9435C78545CEFC"><enum>(B)</enum><text>In 2022 and every year thereafter—</text> <clause id="HEE9023B3CC4C4FB78082A0E8452603D4"><enum>(i)</enum><text>in any year in which a new President is inaugurated, October 1 of that year; and</text></clause>
<clause id="H3663C1501B6449AC89320DAB7E0A096E"><enum>(ii)</enum><text>in any other year, the date that is 90 days after the date of the transmission to Congress in that year of the national security strategy. </text></clause></subparagraph></paragraph></subsection> <subsection id="HBA31630865E846FFB835D593FA43E877"><enum>(c)</enum><header>Elements</header> <paragraph id="H62650FD8776C4BA6872E6C1D1BF46200"><enum>(1)</enum><header>Report</header><text>Each report submitted under subsection (b)(1)(C)(i) shall include the following:</text>
<subparagraph id="H62AF745B332B4AB89E5132670B7ABAA7"><enum>(A)</enum><text>An assessment of public and private investment in civilian and military science and technology and its implications for the geostrategic position and national security of the United States.</text></subparagraph> <subparagraph id="H22712CC497BF49828B15CB28AD090A0A"><enum>(B)</enum><text>A description of the prioritized economic security interests and objectives, including domestic job creation, of the United States relating to science, research, and innovation and an assessment of how investment in civilian and military science and technology can advance those objectives. </text></subparagraph>
<subparagraph id="H4A50DB62ABF64C978004A3B8A107AA79"><enum>(C)</enum><text>An assessment of how regional efforts are contributing and could contribute to the innovation capacity of the United States, including—</text> <clause id="H3E456FBB0F84432DB67796459D62A9DD"><enum>(i)</enum><text>programs run by State and local governments; and</text></clause>
<clause id="H6312682117904E9FBF51712CCB0027F8"><enum>(ii)</enum><text>regional factors that are contributing or could contribute positively to innovation.</text></clause></subparagraph> <subparagraph id="H377385DF0A3540B5AD29034C12DDE598"><enum>(D)</enum><text>An assessment of—</text>
<clause id="HD5C8B7471E824F3B83BBF188A53F7EB4"><enum>(i)</enum><text>workforce needs for competitiveness and national security in key technology areas; and</text></clause> <clause id="HE0D135BD185740E19C17F446456463D9"><enum>(ii)</enum><text>Federal support needed—</text>
<subclause id="HA2FB2CBD08374F91857B63EE50D5A3F1"><enum>(I)</enum><text>to expand domestic and international student pathways into key technology areas; and</text></subclause> <subclause id="H433CC0FF36E84877B1A742E44A707464"><enum>(II)</enum><text>to improve workforce development and employment systems, as well as programs and practices to upskill incumbent workers. </text></subclause></clause></subparagraph>
<subparagraph id="H8DDF686A57914BCBB119A8CCCDC54DD4"><enum>(E)</enum><text>An assessment of barriers to competitiveness in key technology focus areas and barriers to the development and evolution of start-ups, small and mid-sized business entities, and industries in key technology focus areas.</text></subparagraph> <subparagraph id="H73B9D77E651D46078084D7C6CDDCACFF"><enum>(F)</enum><text>An assessment of the effectiveness of the Federal Government, federally funded research and development centers, and national labs in supporting and promoting technology commercialization and technology transfer, including an assessment of the adequacy of Federal research and development funding in promoting competitiveness and the development of new technologies.</text></subparagraph>
<subparagraph id="H37E739CB5694403F86BA1CAC7ED1B0B6"><enum>(G)</enum><text>An assessment of manufacturing capacity, logistics, and supply chain dynamics of major export sectors, including access to a skilled workforce, physical infrastructure, and broadband network infrastructure.</text></subparagraph> <subparagraph id="H5AF42ABE6F6C4FF48DD6FFDE77F76AC7"><enum>(H)</enum><text>An assessment of how the Federal Government is increasing the participation of underrepresented populations in science, research, innovation, and manufacturing.</text></subparagraph>
<subparagraph id="HEA333F5B06184CFABF11868CACA756E1"><enum>(I)</enum><text>An assessment of the effectiveness of the Federal Government, Federally funded research and development centers, and national laboratories in transitioning technologies and processes that emerge from Federally funded research to new domestic manufacturing growth and job creation across sectors in the United States.</text></subparagraph></paragraph> <paragraph id="H346A323147E8438693844030C2DF3811"><enum>(2)</enum><header>Strategy</header><text>Each strategy submitted under subsection (b)(1)(C)(ii) shall include the following:</text>
<subparagraph id="H052523129F5449C29062990A980E0961"><enum>(A)</enum><text>A plan to utilize available tools to address or minimize the leading threats and challenges and to take advantage of the leading opportunities, particularly in regards to technology areas central to competition between the United States and China, including the following:</text> <clause id="H66AED95167A4461AA377CB73C66F818F"><enum>(i)</enum><text>Specific objectives, tasks, metrics, and milestones for each relevant Federal agency.</text></clause>
<clause id="H4ACF6E82AE3E4E4A9D054FE2CF49C9DF"><enum>(ii)</enum><text>Specific plans to support public and private sector investment in research, technology development, education and workforce development, and domestic manufacturing in key technology focus areas supportive of the national economic competitiveness of the United States and to foster the prudent use of public-private partnerships.</text></clause> <clause id="HE29687926138412B92BCD14FB6885E5A"><enum>(iii)</enum><text>Specific plans to promote environmental stewardship and fair competition for United States workers.</text></clause>
<clause id="H7832522734BC4D52ADF039349E8C5EE9"><enum>(iv)</enum><text>A description of—</text> <subclause id="H0565573881E0417F91FFB43BAFE6A5E7"><enum>(I)</enum><text>how the strategy submitted under subsection (b)(1)(C)(ii) supports the national security strategy; and</text></subclause>
<subclause id="H3394678BE56B4A97B47B7A5D8FC6B798"><enum>(II)</enum><text>how the strategy submitted under such subsection is integrated and coordinated with the most recent national defense strategy under section 113(g) of title 10, United States Code.</text></subclause></clause> <clause id="H291AB259BC6A4B0A80295BB269B52F93"><enum>(v)</enum><text>A plan to encourage the governments of countries that are allies or partners of the United States to cooperate with the execution of the strategy submitted under subsection (b)(1)(C)(ii), where appropriate.</text></clause>
<clause id="H7420DC4D99854A92903173D7D34F755C"><enum>(vi)</enum><text>A plan to encourage certain international and multilateral organizations to support the implementation of such strategy.</text></clause> <clause id="H2127B54D5F054BA9B37024EC7A26D9EA"><enum>(vii)</enum><text>A plan for how the United States should develop local and regional capacity for building innovation ecosystems across the Nation by providing Federal support.</text></clause>
<clause id="HC78492B23B874251BA9AE329CCB38946"><enum>(viii)</enum><text>A plan for strengthening the industrial base of the United States.</text></clause></subparagraph> <subparagraph id="H10C8EAB2E52A46948EE373B03918A1B6"><enum>(B)</enum><text>An identification of additional resources, administrative action, or legislative action recommended to assist with the implementation of such strategy.</text></subparagraph></paragraph></subsection>
<subsection id="H9051306140054806BDBAD33D0E3C764C" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Form of reports and strategies</header><text>Each report and strategy submitted under subsection (b)(1)(C) shall be submitted in unclassified form, but may include a classified annex. </text></subsection></section> <section id="HD13CD5D1AE4E4A9FB8EC74D2B8290F2D"><enum>6.</enum><header>Supply chain resiliency program</header> <subsection id="H92303396CED14764A9C8D038A205CB8E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HB0AD49A56CC148929DE9FB73520DF77C"><enum>(1)</enum><header>Critical industry</header><text>The term <term>critical industry</term> means—</text> <subparagraph id="H4A1F1E2D191F42D1AB0020163B7E3348"><enum>(A)</enum><text>key technology focus areas, as defined in section 8A(a) of the National Science Foundation Act of 1950, as added by section 3(b) of this Act; and</text></subparagraph>
<subparagraph id="H7FA19CB287D34EA7BDBF4F439D6BED39"><enum>(B)</enum><text>areas identified by the report in subsection (f).</text></subparagraph></paragraph> <paragraph id="H1480B6D70C204393A4AAE616E387D253"><enum>(2)</enum><header>Critical infrastructure</header><text>The term <term>critical infrastructure</term> has the meaning given the term in the Critical Infrastructures Protection Act of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c</external-xref>). </text></paragraph>
<paragraph id="HCA47375568034CE5818E4BEAABB1848B"><enum>(3)</enum><header>Foreign entity</header><text>The term <term>foreign entity</term>—</text> <subparagraph id="H7313272C941146BF963FF050EB9431F0"><enum>(A)</enum><text>means—</text>
<clause id="H7AF6711FA442426892F636D28427256F"><enum>(i)</enum><text>the government of a foreign country;</text></clause> <clause id="H371BB350C6F94C3AACDACFD34E093277"><enum>(ii)</enum><text>a foreign political party;</text></clause>
<clause id="H659BAE433C204E099FFC3C8B71C2C9E2"><enum>(iii)</enum><text>an individual who is not a protected individual (as defined in section 274B(a)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324b">8 U.S.C. 1324b(a)(3)</external-xref>)); or </text></clause> <clause id="HFB0CC15DBA374BDFBE4717A69085E89A"><enum>(iv)</enum><text>a partnership, association, corporation, organization, or other combination of persons organized under the laws of, or having its principal place of business in, a foreign country; and</text></clause></subparagraph>
<subparagraph id="H9205B91FA14B4BBA9CEAB25CB1A97C68"><enum>(B)</enum><text>includes—</text> <clause id="HCFA97B063D7C40BC8CFCFBD8CC3EC571"><enum>(i)</enum><text>any person owned by, controlled by, or subject to the jurisdiction or direction of, a person described in subparagraph (A);</text></clause>
<clause id="H23D46FB5DFF344BFB00BEF554D4597F0"><enum>(ii)</enum><text>any person, wherever located, that acts as an agent, representative, or employee of a person described in subparagraph (A);</text></clause> <clause id="HE49AF91009A14426BC8C1B18A14BC254"><enum>(iii)</enum><text>any person that acts in any other capacity at the order or request, or under the direction or control, of— </text>
<subclause id="H27BAD48BA4E84A678263E0D16972A650"><enum>(I)</enum><text>a person described in subparagraph (A); or </text></subclause> <subclause id="HA353B7D784EB410DA99D58BBF84B75EF"><enum>(II)</enum><text>a person, the activities of which are directly or indirectly supervised, directed, controlled, financed, or subsidized in whole or in majority part by a person described in subparagraph (A);</text></subclause></clause>
<clause id="H8F328503930941BBBA6F79CC74778AEC"><enum>(iv)</enum><text>any person that directly or indirectly through any contract, arrangement, understanding, relationship, or otherwise owns not less than 25 percent of the equity interests of a person described in subparagraph (A);</text></clause> <clause id="H8F3B63602D1E45CB8D3AFFB467B727EA"><enum>(v)</enum><text>any person with significant responsibility to control, manage, or direct a person described in subparagraph (A);</text></clause>
<clause id="HF4371680F5244828883B1C84D69B19A1"><enum>(vi)</enum><text>any individual, wherever located, who is a citizen or resident of a country controlled by a person described in subparagraph (A); and</text></clause> <clause id="H3AF9872A455E4FD3B61982AE28C7A5C7"><enum>(vii)</enum><text>any corporation, partnership, association, or other organization organized under the laws of a country controlled by a person described in subparagraph (A).</text></clause></subparagraph></paragraph>
<paragraph id="HFC7BD67424664F8F9C1804117BB9877C"><enum>(4)</enum><header>Foreign entity of concern</header><text>The term <term>foreign entity of concern</term> means a foreign entity that is—</text> <subparagraph id="H3887440D6D9A4F0D8B622C2F2E86575E"><enum>(A)</enum><text>designated as a foreign terrorist organization by the Secretary of State under section 219(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189(a)</external-xref>);</text></subparagraph>
<subparagraph id="HACBB921F06A845408361C71F7883DF70"><enum>(B)</enum><text>included on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Assets Control of the Department of the Treasury (commonly known as the <quote>SDN list</quote>);</text></subparagraph> <subparagraph id="HD6899D6BBD22412AAFE53C7ABE91FA40"><enum>(C)</enum><text>owned by, controlled by, or subject to the jurisdiction or direction of a government of a foreign country that is a covered nation (as defined in section 2533c(d) of title 10, United States Code);</text></subparagraph>
<subparagraph id="H02D9E3A41C374A1385BA8E1571DF3509"><enum>(D)</enum><text>alleged by the Attorney General to have been involved in activities for which a conviction was obtained under—</text> <clause id="H16E57E17785149DEABDAF3C67BE22AF5"><enum>(i)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/37">chapter 37</external-xref> of title 18, United States Code (commonly known as the <quote>Espionage Act</quote>);</text></clause>

<subparagraph id="HB5C94DBF908344D39C9F2FB15FDEF006" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>determined by the Secretary, in consultation with the Secretary of Defense and the Director of National Intelligence, to be engaged in unauthorized conduct that is detrimental to the national security or foreign policy of the United States. </text></subparagraph></paragraph> <paragraph id="HA6DACB40D36C4A80976A9893C4075B04"><enum>(5)</enum><header>Labor organization</header><text>The term <term>labor organization</term> has the meaning given such term in section 8A(a) of the National Science Foundation Act of 1950.</text></paragraph>
<paragraph id="HFE43F2620EA2402FBEA7D67A8E368A83"><enum>(6)</enum><header>Program</header><text>The term <term>program</term> means the supply chain resiliency and crisis response program established under subsection (b).</text></paragraph> <paragraph id="H09B48576925C42F79B1A81F749B8C664"><enum>(7)</enum><header>Relevant committees of Congress</header><text>The term <term>relevant committees of Congress</term> means— </text>

<subsection id="HFE9CE1AABFA742EA98844E9B9933CBCD"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish in the Department of Commerce a supply chain resiliency and crisis response program to carry out the activities described in subsection (d).</text></subsection> <subsection id="H9B756FF9401B41879763019FCC13FA90"><enum>(c)</enum><header>Mission and priorities</header> <paragraph id="HABE2F037FDFA4A9498D7FE12C77F1DCF"><enum>(1)</enum><header>Mission</header><text>The mission of the program is to— </text>
<subparagraph id="H5BD9371BBF3C4CA09E039E125A51C0C6"><enum>(A)</enum><text>ensure the leadership of the United States with respect to industries that are essential to mid-term and long-term national security and economic competitiveness; </text></subparagraph> <subparagraph id="H44A1FFB2D86B435AB85936ABF6BBC4A7"><enum>(B)</enum><text>promote, in partnership with the private sector and other relevant stakeholders, the resiliency of supply chains of the United States and allied or partner countries; and </text></subparagraph>
<subparagraph id="H941E773EDBE447988EF843724D690876"><enum>(C)</enum><text>encourage partnerships between the Federal Government and industry, labor organizations, and State, local, territorial, and Tribal governments in order to better respond to supply chain crises.</text></subparagraph></paragraph> <paragraph id="HFF77CB060B4F4B0DB5FF9AC888990197"><enum>(2)</enum><header>Priorities</header><text>The program shall—</text>
<subparagraph id="H5CD32D428CC04CFDA849570F8D786958"><enum>(A)</enum><text>in partnership with the private sector, build resilient and secure supply chains (including through the mid-term and long-term diversification of key supply chains, which shall include the support of small- and medium-sized businesses) that can ensure the access of the United States to critical goods and services in the face of shocks, including pandemic and biological threats, cyberattacks, extreme weather events, terrorist and geopolitical attacks, great power conflict, and other threats to national security, with key parts of such resilience being—</text> <clause id="H90B9D48C86E54E79B5098F5FA7955F4C"><enum>(i)</enum><text>the diversification of key supply chains with allies or key partners; and </text></clause>
<clause id="H5B65D2DE176A4E25A9D2E6C040E32229"><enum>(ii)</enum><text>working with allies or key partners through agreements and other commitments; and</text></clause></subparagraph> <subparagraph id="H3E3D931EBE444FD5802DA58D4EC61F65"><enum>(B)</enum><text>support collaboration with allies or key partners to collectively build and strengthen resilient global supply chains, including through identifying supply chain vulnerabilities, expanding productive capacity, and stockpiling essential goods. </text></subparagraph></paragraph></subsection>
<subsection id="HBFDB21A2ED5242DBB85E09FC0C55ADAC"><enum>(d)</enum><header>Activities</header><text>Under the program, the Secretary, acting through 1 or more bureaus or other divisions of the Department of Commerce as appropriate, shall carry out activities—</text> <paragraph id="H39483767C7654E9AACBB1EEE61FB2B76"><enum>(1)</enum><text>to map and monitor key supply chains and to identify current and future key supply chain gaps and vulnerabilities in critical industries; </text></paragraph>
<paragraph id="H50CBBC343A7A4B29B46C6DACD8F1FECA"><enum>(2)</enum><text>to develop or identify opportunities to build domestic capacity, and cooperate with allies or key partners, to address supply chain gaps and vulnerabilities in critical industries; </text></paragraph> <paragraph id="HF2C8755190164C3F9490A07542C36A0E"><enum>(3)</enum><text>to consult and collaborate with the Director of the Office of Management and Budget, the Secretary of Defense, the Secretary of Homeland Security, the Secretary of the Treasury, the Secretary of Energy, the Secretary of Transportation, the Secretary of Agriculture, the Secretary of State, the Director of National Intelligence, the Director of the Office of Science and Technology Policy, and, as appropriate, the heads of other Federal departments and agencies to invest in urgent supply chain gaps;</text></paragraph>
<paragraph id="H331DBFE579B8400182F57815A8CE9F90"><enum>(4)</enum><text>to encourage partnerships between the Federal Government and industry, labor organizations, and State, local, territorial, and Tribal governments to better respond to crises;</text></paragraph> <paragraph id="H31BBF66722004E92A77C3B371C94ED3D"><enum>(5)</enum><text>to support the distribution of critical resources to areas that have the greatest needs during crises; </text></paragraph>
<paragraph id="H1926F2A651A1474CA3B1F30AEA5C871C"><enum>(6)</enum><text>to develop contingency plans to ensure a resilient supply chain response for potential crises;</text></paragraph> <paragraph id="HE779926C49FD443C98179A177E311E78"><enum>(7)</enum><text>to ensure that allies and key partners have supply chains that are capable of supporting critical industries; and</text></paragraph>
<paragraph id="HE1576E6C7017435285D5DDFC0ACAF373"><enum>(8)</enum><text>to enter into agreements and partnerships with allied or partner governments to promote diversified and resilient supply chains that ensure supply of critical goods to both the United States and allied companies. </text></paragraph></subsection> <subsection id="H97A6D4EF705A4F9C8ADC756DE237F128"><enum>(e)</enum><header>Authorities</header><text>The Secretary may—</text>
<paragraph id="HA4493475194A4958820F51A48C595E9A"><enum>(1)</enum><text>establish a unified coordination group to serve as the primary method for coordinating between and among Federal departments and agencies in response to known supply chain risks as well as for integrating private sector partners into efforts, as appropriate, to—</text> <subparagraph id="H5007A2D72BE744DC8BA6CD92342166C0"><enum>(A)</enum><text>study technical, engineering, and operational data acquired on a voluntary basis from the private sector, in a manner that ensures any data provided by the private sector is kept confidential and as required under section 552 of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>); </text></subparagraph>
<subparagraph id="H6C0199AAB5B44311B2971F217ACCFFA5"><enum>(B)</enum><text>directly receive whistleblower complaints with appropriate protection; and</text></subparagraph> <subparagraph id="HCE4FADA990134339BF26A2459CBD0F95"><enum>(C)</enum><text>identify key competitiveness challenges in critical industries; </text></subparagraph></paragraph>
<paragraph id="HA00727605C254E24ADEC589D8334712B"><enum>(2)</enum><text>enter into agreements with allied or partner governments regarding supply chain security assurances; </text></paragraph> <paragraph id="H10FE9A86878C424E95D1825D21BE7594"><enum>(3)</enum><text>coordinate with other divisions of the Department of Commerce and other Federal departments and agencies to leverage existing authorities, as of the date of enactment of this Act, to strengthen supply chain resilience; and </text></paragraph>
<paragraph id="H15C77D97C9D14BECADFF1AB544C85B4A"><enum>(4)</enum><text>with the approval of the Committee on Appropriations of the Senate and the Committee on Appropriations of the House of Representatives, transfer funds to, or receive funds from, other departments and agencies to implement the program. </text></paragraph></subsection> <subsection id="H6DCE84279BA040E49AAACC48C5F7A4F3"><enum>(f)</enum><header>Report on supply chain resiliency and domestic manufacturing</header><text>Not later than 180 days after the date of enactment of this Act, and not less frequently than every 2 years thereafter, the Secretary shall submit to the relevant committees of Congress a review, in coordination with other relevant Federal departments and agencies—</text>
<paragraph id="H65FB757B248E4F2F9E460885BF44E073"><enum>(1)</enum><text>identifying—</text> <subparagraph id="HEF023DDAC3D74D05B08F38803200B1D4"><enum>(A)</enum><text>technologies critical to economic competitiveness and national security; and</text></subparagraph>
<subparagraph id="HCD7E20F3261C4D9C80A25E9D7B3A394D"><enum>(B)</enum><text>supplies critical to the crisis preparedness of the United States, such as medical supplies, personal protective equipment, disaster response necessities, electrical generation technology, materials essential to critical infrastructure operation or repair and renovation, and other supplies identified by the Secretary;</text></subparagraph></paragraph> <paragraph id="H8C9B5CA90DC14C8EA4D0BC64E9C3996B"><enum>(2)</enum><text>describing—</text>
<subparagraph id="H9F5C915B22D24FB397CA2C172398CFE9"><enum>(A)</enum><text>the current domestic manufacturing base and supply chains for those technologies and supplies, including raw materials, production equipment, and other goods essential to the production of those technologies and supplies; and</text></subparagraph> <subparagraph id="H452518AD50EE4385B1B4F522A72A4533"><enum>(B)</enum><text>the ability of the United States to maintain readiness and to surge produce those technologies and supplies in response to an emergency;</text></subparagraph></paragraph>
<paragraph id="HEE8ECFEA1DE447B4862AD4C518A96E5C"><enum>(3)</enum><text>identifying defense, intelligence, homeland, economic, domestic labor supply, natural, geopolitical, or other contingencies that may disrupt, strain, compromise, or eliminate the supply chain for those technologies and supplies;</text></paragraph> <paragraph id="H1FA05C46F856444D8902820315136BA3"><enum>(4)</enum><text>assessing the resiliency and capacity of the domestic, allied, and partner manufacturing base, supply chains, and workforce to support the need for those technologies and supplies, including any single points of failure in those supply chains;</text></paragraph>
<paragraph id="H7AA939C079AC4EC887458BC7AB2EFB4E"><enum>(5)</enum><text>assessing flexible manufacturing capacity available in the United States in cases of emergency;</text></paragraph> <paragraph id="HDD1751489ED740D28898AF2C739A2B18"><enum>(6)</enum><text>making specific recommendations to improve the security and resiliency of manufacturing capacity and supply chains by—</text>
<subparagraph id="H5822408C96234B2FB724B5B9B7A4C3A9"><enum>(A)</enum><text>developing long-term strategies;</text></subparagraph> <subparagraph id="H57FA750BCB964846BA6581C7D2B256CB"><enum>(B)</enum><text>increasing visibility throughout multiple supplier tiers;</text></subparagraph>
<subparagraph id="H3CAFE60A6074486481505671B59B3CB3"><enum>(C)</enum><text>identifying and mitigating risks, including the financial and operational risks of a supply chain, vulnerabilities to extreme weather events, cyberattacks, pandemic and biological threats, terrorist and geopolitical attacks, and other emergencies, and exposure to gaps in domestic sourcing and import exposure;</text></subparagraph> <subparagraph id="H7C0553BCFE114823AB444D54D16CD626"><enum>(D)</enum><text>identifying enterprise resource planning systems that are compatible across supply chain tiers and are affordable for small and medium-sized businesses;</text></subparagraph>
<subparagraph id="H611FFD427DBF48B1954C76B94EACB620"><enum>(E)</enum><text>understanding the total cost of ownership, total value contribution, and other best practices that encourage strategic partnerships throughout the supply chain;</text></subparagraph> <subparagraph id="HCDC1EA80DEB94DB08BC8A8894330B45E"><enum>(F)</enum><text>understanding Federal procurement opportunities to increase resiliency of supply chains for goods and services and fill gaps in domestic purchasing; </text></subparagraph>
<subparagraph id="H434344F52FBA4D0E91AA68C29AF26570"><enum>(G)</enum><text>identifying policies to maximize domestic job retention and creation, including workforce development programs;</text></subparagraph> <subparagraph id="H25EAEFFC55BB42FCA5F0558A12C3C053"><enum>(H)</enum><text>identifying and mitigating risks associated with allied or key partner countries in building more resilient supply chains; and </text></subparagraph>
<subparagraph id="H6AAA7E4093EF43B6BD07CE1EFC067A17"><enum>(I)</enum><text>identifying such other services as the Secretary considers necessary;</text></subparagraph></paragraph> <paragraph id="H2DE74D806E65404DA014D6CFCD08228A"><enum>(7)</enum><text>providing guidance on technologies and supplies to be prioritized for assistance and other activities under the Department of Commerce, the National Science Foundation, and other relevant Federal agencies;</text></paragraph>
<paragraph id="H8FC36BC1AA1647E2A9AE1A3578DEE950"><enum>(8)</enum><text>reviewing and, if appropriate, expanding the sourcing of goods associated with critical technology areas from allies or key partners, including recommendations for coordination with allies or key partners on sourcing critical products; and</text></paragraph> <paragraph id="HB25B5309D61346FCB2DECE888A8B771D"><enum>(9)</enum><text>monitoring and strengthening the financial and operational health of small and medium enterprises in domestic, allied, and partner supply chains to mitigate risks and ensure diverse, competitive supplier markets that are less vulnerable to single points of failure.</text></paragraph></subsection>
<subsection id="H4BD93463BF5948008BFC1F584C9A34CE"><enum>(g)</enum><header>Additional hiring authority</header>
<paragraph id="H5A08F5E97AA144DFA3820831E9729113"><enum>(1)</enum><header>In general</header><text>To the extent needed to carry out the program, the Secretary may— </text> <subparagraph id="H0727C6FCB3AA4B6D820FBD79F01B9761"><enum>(A)</enum><text>utilize hiring authorities under section 3372 of title 5, United States Code, to staff the program with employees from other Federal agencies, institutions of higher education, and other organizations as described in that section with relevant experience in supply chain management and investment in the same manner and subject to the same conditions that apply to such individuals utilized to accomplish other missions of the Department of Commerce;</text></subparagraph>
<subparagraph id="HDD0E8D2966C447D7BB026D55411384D7"><enum>(B)</enum><text>appoint and fix the compensation of such temporary personnel as may be necessary to implement the requirements of this section relating to the program, without regard to the provisions of title 5, United States Code, governing appointments in the competitive service; and</text></subparagraph> <subparagraph id="H57C0E0C7F4A942C4A8C79D702ECCC0AC"><enum>(C)</enum><text>appoint an individual appointed under subparagraph (B), after serving continuously for not less than 2 years, to a position in the Department of Commerce in the same manner that an employee serving in a position in the competitive service may be transferred, reassigned, or promoted.</text></subparagraph></paragraph>
<paragraph id="H4258A429D63D4DFCAB7AC6CDE0975939" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>No reimbursement</header><text>Any assignment provided under paragraph (1)(A) shall be made without reimbursement.</text></paragraph> <paragraph display-inline="no-display-inline" commented="no" id="HD129A59EC6D74AF6873E9B57CB7E26CB"><enum>(3)</enum><header>Effect of appointment</header><text>An individual appointed as described in paragraph (1)(C) shall be considered to be appointed under a career-conditional appointment, unless the individual, as of the date on which the individual is appointed, has completed a sufficient amount of creditable service to attain a permanent career appointment.</text></paragraph></subsection>
<subsection display-inline="no-display-inline" commented="no" id="HA87A21A4B0F04C73A578BAE68D8C6212"><enum>(h)</enum><header>Semiconductor incentives</header>
<paragraph display-inline="no-display-inline" commented="no" id="HCF34A04E9E4A46F7AF09DE87200B45C3"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out the program established under section 9902 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) as part of the program.</text></paragraph> <paragraph display-inline="no-display-inline" commented="no" id="HAED2B75FCE334901928354F5E7012948"><enum>(2)</enum><header>Technical and conforming amendment</header><text>Section 9902(a)(1) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) is amended by striking <quote>in the Department of Commerce</quote> and inserting <quote>as part of the program established under section 6 of the <short-title>Endless Frontier Act</short-title></quote>.</text></paragraph></subsection>
<subsection display-inline="no-display-inline" commented="no" id="HEF0E6FEC113D43FC8B5F08DF3B2BBEC1"><enum>(i)</enum><header>Report to Congress</header><text>Concurrent with the annual submission by the President of a budget under section 1105 of title 31, United States Code, the Secretary shall submit to the relevant committees of Congress a report that contains a summary of all activities carried out under this section for the year covered by the report.</text></subsection> <subsection id="HA05ADC3A489B48B0B2B1D09D8EB30498"><enum>(j)</enum><header>Coordination</header><text>The Secretary of Commerce shall, as appropriate, coordinate with the heads of other Federal departments and agencies, including the Secretary of State and the United States Trade Representative, in the implementation of this program. </text></subsection>
<subsection id="H4830894CBAE1428DA975DCAA021AD4BB"><enum>(k)</enum><header>Rule of construction regarding private entities</header><text>Nothing in this section shall be construed to require any private entity—</text> <paragraph id="H1222E28E70684746BF0ED1484B01623F"><enum>(1)</enum><text>to request assistance from the Secretary; or</text></paragraph>
<paragraph id="H6E1B13B6960C4196BCFF7A792A340AAA"><enum>(2)</enum><text>that requested such assistance from the Secretary to implement any measure or recommendation suggested by the Secretary. </text></paragraph></subsection> <subsection id="HA48C7943D7434D3C955E2B91C42F76A4"><enum>(l)</enum><header>Funding</header> <paragraph id="HE89DE18130B1494EAEB80DD829495298"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary such sums as may be necessary to carry out this section, which shall remain available until expended.</text></paragraph>
<paragraph id="HBC2E819186B74E4BBFF774FEA30BF0AC"><enum>(2)</enum><header>Inspector General funding</header><text>Of the amounts made available in a fiscal year to carry out this section, not more than 2 percent of those amounts shall be available to the Inspector General of the Department of Commerce to conduct oversight activities with respect to the program.</text></paragraph> <paragraph id="H5B64C38489F04DEB9033FE03A09B488B" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Transfers</header><text>Of the amounts made available in a fiscal year to carry out this section, the Secretary may transfer not more than 5 percent of those amounts to the account under the heading <quote>Department of Commerce—Salaries and Expenses</quote> to provide for administration and oversight activities relating to the program. </text></paragraph></subsection></section>
<section id="HECB38910FAC44CD5B2EE1FE1020408A5"><enum>7.</enum><header>Regional technology hub program</header>
<subsection id="H34DC1483A6FC45E49F07C64D53C80124"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="public-law" parsable-cite="pl/96/480">Public Law 96–480</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/15/3701">15 U.S.C. 3701</external-xref> et seq.) is amended—</text> <paragraph id="H6FFDC1BB0DFB4C77803A431799218F15"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 28 as section 30; and</text></paragraph>

<subparagraph commented="no" id="H98A1B4CF735A4B939FDA8872A87A1BA8"><enum>(B)</enum><text>the Committee on Science, Space, and Technology, the Committee on Transportation and Infrastructure, and the Committee on Appropriations of the House of Representatives.</text></subparagraph></paragraph> <paragraph id="H87053BD1876446EB9B5363D03758CDBD"><enum>(2)</enum><header>Cooperative extension</header><text>The term <term>cooperative extension</term> has the meaning given the term <quote>extension</quote> in section 1404 of the Food and Agriculture Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>).</text></paragraph>
<paragraph id="HE5AC3138B0FC418180187527B6177D46" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Key technology focus areas</header><text display-inline="yes-display-inline">The term <term>key technology focus areas</term> means the areas included on the most recent list under section 8A(d)(2) of the National Science Foundation Act of 1950. </text></paragraph> <paragraph id="H08C11BCC2AC748DABDBA3A9E35F19BBF"><enum>(4)</enum><header>Labor organization</header><text>The term <term>labor organization</term> has the meaning given such term in section 8A(a) of the National Science Foundation Act of 1950.</text></paragraph>
<paragraph id="H6B796CE8461A43EABA8924A101A2559A"><enum>(5)</enum><header>Large metropolitan communities</header><text>The term <term>large metropolitan community</term> means a metropolitan statistical area with a population of more than 500,000. </text></paragraph> <paragraph id="HF551396EAA3540B6A1B400C4AFA9B8B8"><enum>(6)</enum><header>Manufacturing extension center</header><text>The term <term>manufacturing extension center</term> has the meaning given the term <quote>Center</quote> in section 25(a) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278k">15 U.S.C. 278k(a)</external-xref>). </text></paragraph>
<paragraph id="HDD07FF23306C41C48EDE282880310348"><enum>(7)</enum><header>Manufacturing USA institute</header><text>The term <term>Manufacturing USA institute</term> means an Manufacturing USA institute described in section 34(d) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(d)</external-xref>).</text></paragraph> <paragraph id="H87259B8FEE83403FA9D54E4A29CB3FC9"><enum>(8)</enum><header>Mid-sized metropolitan communities</header><text>The term <term>mid-sized metropolitan community</term> means a metropolitan statistical area with a population of more than 200,000 and not more than 500,000. </text></paragraph>
<paragraph id="H828780789B5A4CF79822890622881E84"><enum>(9)</enum><header>Other technology and innovation sectors critical to national and economic security</header><text>The term <term>other technology and innovation sectors critical to national and economic security</term> means other technology and innovation sectors that the Secretary determines are critical to national and economic security.</text></paragraph> <paragraph id="H1E0D6AB2567242E78E93688EF8AADB4D"><enum>(10)</enum><header>Small and rural communities</header><text>The term <term>small and rural community</term> means a noncore area, a micropolitan area, or a small metropolitan statistical area with a population of not more than 200,000. </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6DD37EBE1013480A9207675AFFB86C0F"><enum>(11)</enum><header display-inline="yes-display-inline">Venture development organization</header><text display-inline="yes-display-inline">The term <term>venture development organization</term> means a State or nonprofit organization focused primarily toward strengthening regional economic development through innovation by—</text> <subparagraph id="HCE5E3671E6024F41B31C3FF6B9CEF211"><enum>(A)</enum><text>accelerating the commercialization of research and technology;</text></subparagraph>
<subparagraph id="HD8C67FEFA54C42489A8B2C823FA59EE1"><enum>(B)</enum><text>strengthening the competitive position of startups and industry through the development, commercial adoption, or deployment of technology;</text></subparagraph> <subparagraph id="HFA067A81629842D29311FCDEAD5A5E0E"><enum>(C)</enum><text>providing financial grants, loans, or direct investment to commercialize technology;</text></subparagraph>
<subparagraph id="HAC8835F400C44D21BD83596FD9602FD0"><enum>(D)</enum><text>pairing direct financial assistance under subparagraph (C) with entrepreneurship, technological, or business assistance to maximize the likelihood of success for a venture and increased employment growth for the region or a sector; and</text></subparagraph> <subparagraph id="HF44F042F315948EFBCC8D975A8A0F75C"><enum>(E)</enum><text>returning any proceeds gained from direct financial assistance made using organization funds to the organization for future reinvestment, entrepreneurial assistance, and support of operations. </text></subparagraph></paragraph></subsection>
<subsection id="H75B514EC0060439FABC55241A6496C0A"><enum>(b)</enum><header>Regional technology hub program</header>
<paragraph id="H3A0BAB9DA03D48DA96D66E3B86EF1798"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out a program—</text> <subparagraph id="H01DB19F0A0D1471282E28CA926C7D000"><enum>(A)</enum><text>to designate eligible consortia as regional technology hubs that create the conditions, within a region, to facilitate activities that—</text>
<clause id="H769F9B738D48469399F7F11EC1BE935A"><enum>(i)</enum><text>enable United States leadership in a key technology focus area, complementing the Federal research and development investments under section 8A of the National Science Foundation Act of 1950, or other technology and innovation sectors critical to national and economic security;</text></clause> <clause id="H8E4DABFD886B41F0A14C96C1AB25EAF6"><enum>(ii)</enum><text>support regional economic development that diffuses innovation around the United States, enabling better broad-based growth and competitiveness in key technology focus areas;</text></clause>
<clause id="H8192FE1CC61740258A7F583E32D6AFBF"><enum>(iii)</enum><text>support domestic job creation; and</text></clause> <clause id="HC9FBFEB56CF4425CAFD3CFFF81B8971F"><enum>(iv)</enum><text>otherwise support the purposes set forth under paragraph (2);</text></clause></subparagraph>
<subparagraph id="H977153F32C794D7DBE69C8574102C3D6"><enum>(B)</enum><text>to support regional technology hubs designated under subparagraph (A); and</text></subparagraph> <subparagraph id="H5BCE1232BB7B4EDF8F93F0CF7C5BE59E"><enum>(C)</enum><text>to conduct ongoing research, evaluation, analysis, and dissemination of best practices for regional development and competitiveness in technology and innovation. </text></subparagraph></paragraph>
<paragraph id="H90035D5214ED42AB83A840FD164A4E39"><enum>(2)</enum><header>Purposes</header><text>The purposes of the program carried out under paragraph (1) are as follows:</text> <subparagraph id="HF348AC3F39EF496BAE0B6ACE415374B4"><enum>(A)</enum><text>To designate eligible consortia as regional technology hubs throughout the United States that create the conditions within a region to facilitate activities that establish the global competitive edge of the United States in the 21st century across a range of technology and innovation sectors critical to national and economic security, including to encourage lower-cost but economically viable technology hubs in the United States to reduce technology offshoring. </text></subparagraph>
<subparagraph id="H623927BA2B20495A854EDAC08A14B047"><enum>(B)</enum><text>To encourage new and constructive collaboration among local, State, and Federal government entities, academia, private industry, and labor organizations to mobilize investment, talent, entrepreneurship, and innovation for research, development, deployment, and manufacturing in a range of technology and innovation sectors critical to national and economic security.</text></subparagraph> <subparagraph id="HC97813EEB1314381A630A9A7A5FA0AE1"><enum>(C)</enum><text>To assist regions across the United States, including small cities and rural areas—</text>
<clause id="HA1927E67FB1845ADB92F2E038B799B37"><enum>(i)</enum><text>to develop and implement strategies through technology-based economic development practices, including infrastructure and workforce development, entrepreneurship and commercialization support, increasing access to capital, and building networks and systems to help bring ideas and businesses to market, and other relevant activities;</text></clause> <clause id="HAE437FCC75F14E2CB907FDF17FD1BF1B"><enum>(ii)</enum><text>to improve domestic supply chains in technology and innovation sectors; and</text></clause>
<clause id="HEBFA5AC019954BC0AC6CC80F3735486F"><enum>(iii)</enum><text>to enable broad-based economic growth, job creation and competitiveness in the United States. </text></clause></subparagraph></paragraph> <paragraph id="HA3605B3E939B45C9B35B8A125F3DA0EF"><enum>(3)</enum><header>Administration</header><text>The Secretary shall carry out this section through the Assistant Secretary of Commerce for Economic Development, in coordination with the Under Secretary of Commerce for Standards and Technology. </text></paragraph></subsection>
<subsection id="H040E33A86FCB487FBDF5161C82E67EBC"><enum>(c)</enum><header>Eligible consortia</header><text display-inline="yes-display-inline">For purposes of this section, an eligible consortium is a consortium that—</text> <paragraph id="H52B3BC5B87ED403FB033937BF5ADC7E2"><enum>(1)</enum><text>includes 1 or more—</text>
<subparagraph id="H3C6E123F518C4469A9B33357F632C9E0"><enum>(A)</enum><text>institutions of higher education;</text></subparagraph> <subparagraph id="H8A7D393498044D52AC1E33570FAAA175" commented="no"><enum>(B)</enum><text>local or Tribal governments or other political subdivisions of a State;</text></subparagraph>
<subparagraph id="HE6056C51225046D599215BC58422D15C" commented="no"><enum>(C)</enum><text>State governments represented by an agency designated by the governor of the State or States that is representative of the geographic area served by the consortia;</text></subparagraph> <subparagraph id="H5B806084AC8547D2AE8C4340EBFF49AF"><enum>(D)</enum><text>economic development organizations or similar entities that are focused primarily on improving science, technology, innovation, or entrepreneurship;</text></subparagraph>
<subparagraph id="HB74115300067441E8B56DBD869863271"><enum>(E)</enum><text>industry or firms in relevant technology or innovation sectors;</text></subparagraph> <subparagraph id="HE710E3C93B8B4E3A877E6CBC9D831BB0"><enum>(F)</enum><text>labor organizations; and</text></subparagraph>
<subparagraph id="HDD9E5B12FE0C4E4D968B88FF68794B3C"><enum>(G)</enum><text>workforce training organizations, including State and local workforce development boards as established under section 101 of the Workforce Investment and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref>); and </text></subparagraph></paragraph> <paragraph id="H02FA08B28016465EBB6CD8DEAA817D1A"><enum>(2)</enum><text>may include 1 or more—</text>
<subparagraph id="HF57BA91463A143EDA3C1F6B737227F41"><enum>(A)</enum><text>nonprofit economic development entities with relevant expertise, including a district organization (as defined in section 300.3 of title 13, Code of Federal Regulations, or successor regulation);</text></subparagraph> <subparagraph id="H1E921996C68A4BE8889846D2FB17F585"><enum>(B)</enum><text>for-profit entities with relevant expertise;</text></subparagraph>
<subparagraph id="HC1DC3E0BC5B04EE98018E2B10709F2FA"><enum>(C)</enum><text>venture development organizations;</text></subparagraph> <subparagraph id="H158F7B71C83D47B08B3A49A7A9C5CA65"><enum>(D)</enum><text>financial institutions and investment funds;</text></subparagraph>
<subparagraph id="H889F1373D114407591B637CFEDF534FC"><enum>(E)</enum><text>primary and secondary educational institutions, including career and technical education schools;</text></subparagraph> <subparagraph id="H57E87F89F664466EBD693D1809D82115"><enum>(F)</enum><text>industry and industry associations;</text></subparagraph>
<subparagraph id="H654E9D595AD64D98820660D7F7DB75C2"><enum>(G)</enum><text>National Laboratories (as defined in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>));</text></subparagraph> <subparagraph id="H91DAC1A34065414E86CD3CE9966C81C7"><enum>(H)</enum><text>Federal laboratories;</text></subparagraph>
<subparagraph id="HF7A7BF2C776342319A3D25582CD8E879"><enum>(I)</enum><text>manufacturing extension centers;</text></subparagraph> <subparagraph id="HDD05029DBA3D4C3DB9D7BC45D9098BE6"><enum>(J)</enum><text>Manufacturing USA institutes;</text></subparagraph>
<subparagraph id="H23EBCB87964E4DB2A78CABF409E72E5C"><enum>(K)</enum><text>institutions receiving an award under paragraph (6) or (7) of section 8A(d) of the National Science Foundation Act of 1950; and</text></subparagraph> <subparagraph id="H957D03D79C194BC8AABD4F4D9BB062E6"><enum>(L)</enum><text>a cooperative extension.</text></subparagraph></paragraph></subsection>
<subsection id="HE22BCBFE60A04301A539A65FB6C42A6A"><enum>(d)</enum><header>Designation of regional technology hubs</header>
<paragraph id="H6BC42BC7F73F4F1C8B74F7D9B11DD241"><enum>(1)</enum><header>In general</header><text>The Secretary shall use a competitive process for the designation of regional technology hubs under subsection (b)(1)(A).</text></paragraph> <paragraph id="H2F47E9E1BC0845A0AE31CEBCB2F552C0"><enum>(2)</enum><header>Number of regional technology hubs</header><text>During the 5-year period beginning on the date of the enactment of the <short-title>Endless Frontier Act</short-title>, the Secretary shall designate not fewer than 10 and not more than 15 eligible consortia as regional technology hubs under subsection (b)(1)(A), if the Secretary has received a sufficient number of qualified applications and appropriations to carry out this section.</text></paragraph>
<paragraph id="H60AD370EEE7C4ECCB45E2503177057DA"><enum>(3)</enum><header>Geographic distribution</header><text>In conducting the competitive process under paragraph (1), the Secretary shall ensure geographic distribution in the designation of regional technology hubs by—</text> <subparagraph id="HF086FC6CCEC34057AB28218CA57D7340"><enum>(A)</enum><text>aiming to designate regional technology hubs in as many regions of the United States as possible; and</text></subparagraph>
<subparagraph id="H29E38DD812D64FA995696AB18FE0D579"><enum>(B)</enum><text>focusing on localities that have clear potential and relevant assets for developing a self-sustaining competitive position in a technology or innovation sector but have not yet become leading technology centers.</text></subparagraph></paragraph> <paragraph id="H8A5A496403FE4588B82F5AE6E1E53033"><enum>(4)</enum><header>Eligible consortia that serve small and rural communities</header><text>Under subsection (b)(1)(A), the Secretary shall designate at least 3 eligible consortia that—</text>
<subparagraph id="HE312B3AC59EA431C9A4D294B1B244F2E"><enum>(A)</enum><text>serve small and rural communities; and</text></subparagraph> <subparagraph id="H6A27371640F44F4BBE5521C6DEA62C67"><enum>(B)</enum><text>have received a grant under section 29.</text></subparagraph></paragraph>
<paragraph id="HD7663FAA417E4ADE8B62ACB5E6BD04FA"><enum>(5)</enum><header>EPSCoR</header><text>The Secretary shall ensure that, of the eligible consortia designated as regional technology hubs under subsection (b)(1)(A), not fewer than 5 of such consortia include at least 1 State that is eligible to receive funding from the Established Program to Stimulate Competitive Research of the National Science Foundation.</text></paragraph> <paragraph id="H83537BBDE2354C078D924FB14CAC8DB0"><enum>(6)</enum><header>Relation to certain grant awards</header><text>The Secretary may not require an eligible consortium to receive a grant under section 29 in order to be designated as a regional technology hub under subsection (b)(1)(A) of this section.</text></paragraph></subsection>
<subsection id="H2399E3F8BB09426FB34556348926AD2A"><enum>(e)</enum><header>Grants and cooperative agreements</header>
<paragraph id="H33A3BA93B52E4C9A8BCD77D7E653F5B8"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out subparagraph (B) of subsection (b)(1) through the award of grants or cooperative agreements to eligible consortia designated under subparagraph (A) of such subsection.</text></paragraph> <paragraph id="HD59F81AF841A4E32AFDA91A23BAA9DB9"><enum>(2)</enum><header>Term</header> <subparagraph id="H430946EFA4804FC29C39EE8D5EF9AB53"><enum>(A)</enum><header>In general</header><text>The term of a grant or cooperative agreement awarded under paragraph (1) shall be for such period as the Secretary considers appropriate.</text></subparagraph>
<subparagraph id="H9CD461970D8049CA91A38CC0A6E08AE5"><enum>(B)</enum><header>Renewal</header><text>The Secretary may renew a grant or cooperative agreement awarded to an eligible consortia under paragraph (1) as the Secretary considers appropriate if the Secretary determines pursuant to subsection (i) that the performance of the eligible consortia is satisfactory.</text></subparagraph></paragraph> <paragraph id="HBF683752DBC44013937D0CE957C99CA3"><enum>(3)</enum><header>Matching required</header> <subparagraph id="H6B3466BEEAA0416B9E945B5D1A70A991"><enum>(A)</enum><header>In general</header><text>Except in the case of an eligible consortium described in subparagraph (B), the total Federal financial assistance awarded in a given year to an eligible consortium in support of the eligible consortium's operation as a regional technology hub under this section shall not exceed amounts as follows:</text>
<clause id="HD0544B2D6C444CB09CF41D9DDC3D1A0E"><enum>(i)</enum><text>In first year of the grant or cooperative agreement, 90 percent of the total operating and maintenance costs of the regional technology hub in that fiscal year.</text></clause> <clause id="H43B4764AC2CD42A2A90C02CBB4AA1CE2"><enum>(ii)</enum><text>In second year of the grant or cooperative agreement, 85 percent of the total operating and maintenance costs of the regional technology hub in that fiscal year. </text></clause>
<clause id="H3076ECA30472451EB12BCAF0F10CA488"><enum>(iii)</enum><text>In third year of the grant or cooperative agreement, 80 percent of the total operating and maintenance costs of the regional technology hub in that fiscal year. </text></clause> <clause id="H1263110C54A14288BA6087909A0082CE"><enum>(iv)</enum><text>In fourth year of the grant or cooperative agreement and each year thereafter, 75 percent of the total operating and maintenance costs of the regional technology hub in that fiscal year. </text></clause></subparagraph>
<subparagraph id="HF21FCE7061C14A19B9FEF8A1BF9EF77A"><enum>(B)</enum><header>Small and rural communities and Indian tribes</header>
<clause id="HB26E4AD11693427CA9223E67F6FB0730"><enum>(i)</enum><header>In general</header><text>The total Federal financial assistance awarded in a given year to an eligible consortium in support of the eligible consortium's operation as a regional technology hub under this section shall not exceed amounts as follows:</text> <subclause id="H415398EC7B4D4EA59DD9C560AF94DC27"><enum>(I)</enum><text>In the case of an eligible consortium that represents a small and rural community, in a fiscal year, 90 percent of the total funding of the regional technology hub in that fiscal year.</text></subclause>
<subclause id="H86183686C7B146959E1B654833C78639"><enum>(II)</enum><text>In the case of an eligible consortium that is led by a Tribal government, in a fiscal year, 100 percent of the total funding of the regional technology hub in that fiscal year.</text></subclause></clause> <clause id="HF1A699A7BD3B4B54954FE81C94B75041"><enum>(ii)</enum><header>Minimum threshold or rural representation</header><text>The Secretary shall establish a minimum threshold of rural representation for purposes of clause (i)(I).</text></clause></subparagraph>
<subparagraph id="HE65D36F30E4C49FDB5174EE5F549FA28"><enum>(C)</enum><header>In-kind contributions</header><text>For purposes of this paragraph, in-kind contributions may be used for part of the non-Federal share of the total funding of a regional technology hub in a fiscal year.</text></subparagraph></paragraph> <paragraph id="H53C307EE2B70429A9B071910C8E7B2FF"><enum>(4)</enum><header>Use of grant and cooperative agreement funds</header><text>The recipient of a grant or cooperative agreement awarded under paragraph (1) shall use the grant or cooperative agreement for multiple activities determined appropriate by the Secretary, including—</text>
<subparagraph id="H0930C73DE0924B6DB4B56EF0E8183F78"><enum>(A)</enum><text>the permissible activities set forth under section 27(c)(2); and</text></subparagraph> <subparagraph id="HF60E46704D5742EE97C21B993B4D1BC3"><enum>(B)</enum><text>activities in support of key technology focus areas and other technology and innovation sectors critical to national and economic security—</text>
<clause id="H73EE7D39D295442BA8E54B241C56E237"><enum>(i)</enum><text>to develop regional strategies for infrastructure and site development in support of the regional technology hub’s plans and programs;</text></clause> <clause id="HC9D03EA39FFE4C15AFC6245B6AAFE74B"><enum>(ii)</enum><text>to support business activity that makes domestic supply chain more resilient and encourages the growth of coordinated multiparty systems in the United States and creation and growth of business entities;</text></clause>
<clause id="H0BE89F9DA2B94AE79F4C06C1CF12592E"><enum>(iii)</enum><text>to attract new private, public, and philanthropic investment in the region for developing innovation capacity, including establishing regional venture and loan funds, including through venture development organizations, for financing technology commercialization, new business formation, and business expansions;</text></clause> <clause id="HDA8F28233C63461BBDE387AAB4AE1A9A"><enum>(iv)</enum><text>to further the development, deployment, and domestic manufacturing of technologies in the key technology focus areas and other technology and innovation sectors critical to national and economic security, including innovations derived from research conducted at institutions of higher education or other research entities, including research conducted by federally-funded research and development centers, National Laboratories, Federal laboratories, Manufacturing USA institutes, university technology centers established under paragraph (6) of section 8A(d) of the National Science Foundation Act of 1950, the program established under paragraph (7) of such section 8A(d), test beds established and operated under paragraph (8) of such section 8A(d), or other Federal research entities, through activities that may include—</text>
<subclause id="HFE1616B9E37E41B3A436D453BC1A0091"><enum>(I)</enum><text>proof-of-concept development and prototyping;</text></subclause> <subclause id="H22A40DDFF3D748D8B0B34DFC8B65FD2F"><enum>(II)</enum><text>technology transfer and commercialization, including patenting and licensing;</text></subclause>
<subclause id="H273312657ED34AEA8CDDBC381E90874F"><enum>(III)</enum><text>public-private partnerships in order to reduce the cost, time, and risk of commercializing new technologies;</text></subclause> <subclause id="HC074866D354A4BB18CFE112791A6788A"><enum>(IV)</enum><text>creating and funding competitions to allow entrepreneurial ideas to illustrate their commercialization and domestic job creation potential;</text></subclause>
<subclause id="H8D76BC009DDA4F9AAD8678A7CD0AADB4"><enum>(V)</enum><text>facilitating relationships between local and national business leaders and potential entrepreneurs to encourage successful commercialization;</text></subclause> <subclause id="HB2BBB4DA25FD40E58897B51C8065ECC5"><enum>(VI)</enum><text>creating and funding not-for-profit entities that could enable researchers at institutions of higher education and other research entities to further develop new technology, through patient funding, advice, staff support, or other means;</text></subclause>
<subclause id="H59F1C5A131784D968FBEC7B6783965D9"><enum>(VII)</enum><text>providing facilities for start-up companies where technology maturation could occur; and</text></subclause> <subclause id="HD95293E0F80B4BB98EB0103168C065DA"><enum>(VIII)</enum><text>commercialization, deployment, and adoption of the technologies that lead to domestic manufacturing of such technologies;</text></subclause></clause>
<clause id="H575B8CCEA265403BBAEDD565A42EB4D1"><enum>(v)</enum><text>to develop the region’s skilled workforce through the training and retraining of workers, partnerships with labor organizations, and skills-based education, including the alignment of career technical training and educational programs in the region’s elementary and secondary schools and institutions of higher education; and </text></clause> <clause id="HC723EBDAABFA4717B3A60596143B4069"><enum>(vi)</enum><text>to carry out such other activities as the Secretary considers appropriate to improve United States competitiveness and regional economic development to support a key technology focus area and that would further the purposes of this section. </text></clause></subparagraph></paragraph>
<paragraph id="HF1D75EBA17AB4FEF9D3615F4B3137C98"><enum>(5)</enum><header>Grants for infrastructure</header><text>Any grant or cooperative agreement awarded under paragraph (1) to support the construction of physical infrastructure shall be awarded pursuant to section 201 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3141">42 U.S.C. 3141</external-xref>) and subject to the provisions of such Act, except that subsection (b) of such section and sections 204 and 301 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3144">42 U.S.C. 3144</external-xref>, 3161) shall not apply. </text></paragraph></subsection> <subsection id="HF2DC77E5396848F9A05E6157A965B88A"><enum>(f)</enum><header>Applications</header><text>An eligible consortium seeking designation as a regional technology hub under subparagraph (A) of subsection (b)(1) and support under subparagraph (B) of such subsection shall submit to the Secretary an application therefor at such time, in such manner, and containing such information as the Secretary may specify.</text></subsection>
<subsection id="H0DE42B60E66542A4AD17EDC7786A1773"><enum>(g)</enum><header>Considerations for designation and award of grants and cooperative agreements</header>
<paragraph id="H4DF235CE515E41B191C50D60D9618440"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In selecting an eligible consortium that submitted an application under subsection (f) for designation and support under subsection (b)(1), the Secretary shall consider, at a minimum, the following:</text> <subparagraph id="H44FB72FA5C0D49DE9EEAEEB6D5E4567D"><enum>(A)</enum><text>The potential of the eligible consortium to advance the research, development, deployment, and domestic manufacturing of technologies in a key technology focus area or other technology or innovation sector critical to national and economic security.</text></subparagraph>
<subparagraph id="HF7201836761F48B59F31484EF50C917A"><enum>(B)</enum><text>The likelihood of positive regional economic effect, including increasing the number of high wage domestic jobs, and creating new economic opportunities for economically disadvantaged and underrepresented populations.</text></subparagraph> <subparagraph id="HD2CAC8EB996C408B833F1DD1842E68FC"><enum>(C)</enum><text>How the eligible consortium plans to integrate with and leverage the resources of 1 or more federally-funded research and development centers, National Laboratories, Federal laboratories, Manufacturing USA institutes, Hollings Manufacturing Extension Partnership centers, university technology centers established under paragraph (6) of section 8A(d) of the National Science Foundation Act of 1950, the program established under paragraph (7) of such section 8A(d), test beds established and operated under paragraph (8) of such section 8A(d), or other Federal research entities. </text></subparagraph>
<subparagraph id="HA33D7C9218474E269E1E01B9B56E6673"><enum>(D)</enum><text>How the eligible consortium will engage with the private sector, including small- and medium-sized businesses to commercialize new technologies and improve the resiliency of domestic supply chains in a key technology focus area or other technology or innovation sector critical to national and economic security.</text></subparagraph> <subparagraph id="H761D4EDBCAE7488AA49DC707175FF90D"><enum>(E)</enum><text>How the eligible consortium will carry out workforce development and skills acquisition programming, including through partnerships with entities that include State and local workforce development boards, institutions of higher education, including community colleges, historically Black colleges and universities, Tribal colleges and universities, and minority serving institutions, labor organizations, and workforce development programs, and other related activities authorized by the Secretary, to support the development of a key technology focus area or other technology or innovation sector critical to national and economic security.</text></subparagraph>
<subparagraph id="H7E562EFB3316437FAE475CC0BA607BEB"><enum>(F)</enum><text>How the eligible consortium will improve science, technology, engineering, and mathematics education programs in the identified region in elementary and secondary school and higher education institutions located in the identified region to support the development of a key technology focus area or other technology or innovation sector critical to national and economic security.</text></subparagraph> <subparagraph id="HDF8E91F8DBB34E0CBA6266866FEE7ACC"><enum>(G)</enum><text>How the eligible consortium plans to develop partnerships with venture development organizations and sources of private investment in support of private sector activity, including launching new or expanding existing companies, in a key technology focus area or other technology or innovation sector critical to national and economic security.</text></subparagraph>
<subparagraph id="HB572CC693CDB490EB3E046018229FF60"><enum>(H)</enum><text>How the eligible consortium plans to organize the activities of regional partners across sectors in support of the proposed regional technology hub, including the development of necessary infrastructure improvements and site preparation.</text></subparagraph> <subparagraph id="HEE18CA4E7DE141D49BE8BD2004B33296"><enum>(I)</enum><text>How the eligible consortium will ensure that growth in technology and innovation sectors produces broadly shared opportunity across the identified region, including for economic disadvantaged and underrepresented populations and rural areas.</text></subparagraph>
<subparagraph id="H2D488EDEEEBA4578BED455FA7B23E862"><enum>(J)</enum><text>The likelihood that the region served by the eligible consortium will be able to become a self-sustaining globally leading technology hub once Federal support ends.</text></subparagraph></paragraph> <paragraph id="H58314C6BB049450D93ED2BE98448E44A"><enum>(2)</enum><header>Findings based on comprehensive regional technology strategies</header><text>The Secretary may use a comprehensive regional technology strategy supported by a grant under section 29 as the basis for making findings under paragraph (1) of this subsection.</text></paragraph></subsection>
<subsection id="HD973615E07DB4BF8BEDA3F09EAD037D9"><enum>(h)</enum><header>Coordination and collaboration</header>
<paragraph id="HC312F494AA8849E8997C2637563ADE7C"><enum>(1)</enum><header>Coordination with National Institute of Standards and Technology programs</header>
<subparagraph id="H0759666866214944857131A40253AC74"><enum>(A)</enum><header>Coordination required</header><text>The Secretary shall coordinate the activities of regional technology hubs designated under this title, the Hollings Manufacturing Extension Partnership, and the Manufacturing USA Program with each other to the degree that doing so does not diminish the effectiveness of the ongoing activities of a manufacturing extension center or a Manufacturing USA institute.</text></subparagraph> <subparagraph id="HCDED0CCF071F4F0B8ED04DEA9FACA54C"><enum>(B)</enum><header>Elements</header><text>Coordination by the Secretary under subparagraph (A) may include the following:</text>
<clause id="HE5BCFD1A188E497F99B26D22915AE7DD"><enum>(i)</enum><text>The alignment of activities of the Hollings Manufacturing Extension Partnership with the activities of regional technology hubs designated under this subsection, if applicable.</text></clause> <clause id="H6643137446B745D5B68DDF68075C1EAD"><enum>(ii)</enum><text>The alignment of activities of the Manufacturing USA Program and the Manufacturing USA institutes with the activities of regional technology hubs designated under this subsection, if applicable.</text></clause></subparagraph></paragraph>
<paragraph id="H12CEDA64767B45CCB11012ACE7674621"><enum>(2)</enum><header>Coordination with Department of Energy programs</header><text>The Secretary shall, in coordination with the Secretary of Energy, coordinate the activities and selection of regional technology hubs designated under subsection (b)(1)(A) with activities at the Department of Energy and the National Laboratories that were in effect on the day before the date of the enactment of the <short-title>Endless Frontier Act</short-title>, to the degree that doing so does not diminish the effectiveness of the ongoing activities or mission of the Department of Energy and the National Laboratories. </text></paragraph> <paragraph id="H9AE375CA32CC415E8411A083500C5D32"><enum>(3)</enum><header>Interagency collaboration</header> <subparagraph id="H725532A980DD4DA497ACC9687F07D897"><enum>(A)</enum><header>In general</header><text>In selecting and assisting regional technology hubs designated under subsection (b)(1)(A), the Secretary—</text>
<clause id="HE4396B3FC0DC4D18ABB7BD33BFEF8815"><enum>(i)</enum><text>shall collaborate, to the extent possible, with the interagency advisory committee established under subparagraph (B);</text></clause> <clause id="H1E81232E0B5145DB8005EEE52F4B71B9"><enum>(ii)</enum><text>shall collaborate with Federal departments and agencies whose missions contribute to the goals of the regional technology hub; and</text></clause>
<clause id="HB92AD58EA7D14D4CBDF4CAB329918723"><enum>(iii)</enum><text>may accept funds from other Federal agencies to support grants and activities under this title.</text></clause></subparagraph> <subparagraph id="H1DD350BD3AEA44E9B9DF4FB103494D2E"><enum>(B)</enum><header>Interagency coordinating council</header> <clause id="HE7325CFC90924F1798122279C421ADB8"><enum>(i)</enum><header>Establishment</header><text>The Secretary shall establish an interagency coordinating council to coordinate with the Secretary in the designation of regional technology hubs under subparagraph (A) of subsection (b)(1) and in the selection of eligible consortia to receive support under subparagraph (B) of such subsection.</text></clause>

<subclause id="HBB761DCD10824C0FAF227CB623EC5C93"><enum>(IV)</enum><text>The Deputy Secretary for Housing and Urban Development.</text></subclause> <subclause id="H954D09ABE77C48E1B3508E041C46B9B7"><enum>(V)</enum><text>The Director of the Community Development Financial Institution Fund.</text></subclause>

<clause id="HE24B19738715470BA244D74D41024CC1"><enum>(iii)</enum><header>Chairperson</header><text>The Secretary shall be the chairperson of the interagency coordinating council established under clause (i).</text></clause></subparagraph></paragraph> <paragraph id="HF4C445E687CD496286BF87E3A42D2836" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Setting goals for Federally funded regions served by research in regional technology hubs</header> <subparagraph commented="no" display-inline="no-display-inline" id="H26D66FE91C184ECA91F7AD6156363830"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Office of Science and Technology Policy and the Director of the Office of Management and Budget shall coordinate with the each head of a Federal agency that conducts research to set goals for at least doubling the amount of Federally-funded research awarded, as in effect on the day before the date of the enactment of the <short-title>Endless Frontier Act</short-title>, to regions served by regional technology hubs designated under subsection (b)(1)(A).</text></subparagraph>
<subparagraph display-inline="no-display-inline" commented="no" id="HCDF33A1444464088A895DB274D2643B9"><enum>(B)</enum><header>Annual reports</header><text>Not less frequently than once each year, the Director of the Office of Science and Technology Policy and the Director of the Office of Management and Budget shall submit to the appropriate committees of Congress an annual report on progress made relating to the goals set under subparagraph (A).</text></subparagraph></paragraph></subsection> <subsection id="H91C9AA65C7E1442399F10B366CACC34B"><enum>(i)</enum><header>Performance measurement, transparency, and accountability</header> <paragraph id="H8C0F172B2C3F4C7C813AD7EE18F3EC2F"><enum>(1)</enum><header>Metrics, standards, and assessment</header><text>For each grant and cooperative agreement awarded under subsection (e)(1) for a regional technology hub, the Secretary shall—</text>
<subparagraph id="HCD983927DC4449ECAC4634DCBE45FC54"><enum>(A)</enum><text>develop metrics to assess the effectiveness of the activities funded in making progress toward the purposes set forth under subsection (b)(2), which may include—</text> <clause id="HCD2CE19950F04BD18FD05A0CBB11A8EE"><enum>(i)</enum><text>research supported in a key technology focus area;</text></clause>
<clause id="HFC5E6CF5655045F185DADF91103364F2"><enum>(ii)</enum><text>commercialization activities undertaken by each regional technology hub that is designated and supported under subsection (b)(1);</text></clause> <clause id="H9B26A08F49884F6CA90E734586C673B8"><enum>(iii)</enum><text>educational and workforce development improvements undertaken by each regional technology hub that is designated and supported under subsection (b)(1);</text></clause>
<clause id="HC7BE88037DD645E4889770AE60CF1A47"><enum>(iv)</enum><text>sources of matching funds for each regional technology hub that is designated and supported under subsection (b)(1); and</text></clause> <clause id="H5297EE27CA7147E6B41029FDCE9173FB"><enum>(v)</enum><text>domestic job creation, patent awards, and business formation and expansion relating to the activities of the regional technology hub that is designated and supported under subsection (b)(1);</text></clause></subparagraph>
<subparagraph id="HCF601B52AC1445DC93F56EB4F1C1D9AD"><enum>(B)</enum><text>establish standards for the performance of the regional technology hub that are based on the metrics developed under subparagraph (A); and</text></subparagraph> <subparagraph id="H014900529384478ABB51544C68F09AE5"><enum>(C)</enum><text>4 years after the initial award under subsection (e)(1) and every 2 years thereafter until Federal financial assistance under this section for the regional technology hub is discontinued, conduct an assessment of the regional technology hub to confirm whether the performance of the regional technology hub is meeting the standards for performance established under subparagraph (B) of this paragraph.</text></subparagraph></paragraph>
<paragraph id="HA1B5B2F31E664049AB764AE2DB9496AC"><enum>(2)</enum><header>Final reports by recipients of assistance</header>
<subparagraph id="H55321194EA844D5DA31835AE233F4C78"><enum>(A)</enum><header>In general</header><text>The Secretary shall require each eligible consortium that receives a grant or cooperative agreement under subsection (e)(1) for support of a regional technology hub, as a condition of receipt of such grant or cooperative agreement, submit to the Secretary, not later than 90 days after the last day of the term of the grant or cooperative agreement, a report on the activities of the regional technology hub supported by the grant or cooperative agreement.</text></subparagraph> <subparagraph id="H7340D833BE36415FBC837F6492718749"><enum>(B)</enum><header>Contents of report</header><text>Each report submitted by an eligible consortium under subparagraph (A) shall include the following:</text>
<clause id="HAE007E43767E4C82B9D24BB127FA58EB"><enum>(i)</enum><text>A detailed description of the activities carried out by the eligible consortium using the assistance described in subparagraph (A), including the following:</text> <subclause id="H4BE597828554417696A865A3EB6362E6"><enum>(I)</enum><text>A description of each project the eligible consortium completed using such assistance.</text></subclause>
<subclause id="HAA6DC4D98A8B498FBCDB4F2968A3A3C3"><enum>(II)</enum><text>An explanation of how each project described in subclause (I) achieves a specific goal under this section in the region of the regional technology hub of the eligible consortium with respect to—</text> <item id="H4467D36C5B9E4169B4E4C33DB51BEAD3"><enum>(aa)</enum><text>the resiliency of a supply chain;</text></item>
<item id="H7DAA712FE75147E798928E0427CDFD1F"><enum>(bb)</enum><text>research, development, and deployment of a critical technology;</text></item> <item id="H7699534155F140DFACA83C7D3D8A7FC6"><enum>(cc)</enum><text>workforce training and development;</text></item>
<item id="H1888B774BF524F6D84FE99D4CFA6A3C4"><enum>(dd)</enum><text>domestic job creation; or</text></item> <item id="HD27C1498588945CAA5F0963FE277901E"><enum>(ee)</enum><text>entrepreneurship.</text></item></subclause></clause>
<clause id="H75EBF469D6DC4D558C15D5637AE8ECC5"><enum>(ii)</enum><text>A discussion of any obstacles encountered by the eligible consortium in the implementation of the regional technology hub and how the eligible entity overcame those obstacles.</text></clause> <clause id="HAA4E0527A19B4F9BAF295E03201332B1"><enum>(iii)</enum><text>An evaluation of the success of the projects supported by the eligible consortium to implement the regional technology hub using the performance standards and measures established under paragraph (1), including an evaluation of the planning process and how the project contributes to carrying out the comprehensive strategy for the regional technology hub if the regional technology hub has such a strategy.</text></clause>
<clause id="H9A8DD847336245438EB7FC0B07B7A969"><enum>(iv)</enum><text>The effectiveness of the eligible consortium in ensuring that, in the region of the eligible consortium's regional technology hub, growth in technology and innovation sectors produces broadly shared opportunity across the region, including for economic disadvantaged and underrepresented populations and rural areas.</text></clause> <clause id="H71CF7986B5C144BCB1CE900CE39E5222"><enum>(v)</enum><text>Information regarding such other matters as the Secretary may require.</text></clause></subparagraph></paragraph>
<paragraph id="H24BF64FEDA9C41909193893E63147403"><enum>(3)</enum><header>Interim reports by recipients of assistance</header><text>In addition to requiring submittal of final reports under paragraph (2)(A), the Secretary may require an eligible consortium described in such paragraph to submit to the Secretary such interim reports as the Secretary considers appropriate. </text></paragraph> <paragraph id="HB6278759C2FF4CE9A224D04F1676F063" commented="no"><enum>(4)</enum><header>Annual reports to Congress</header><text>Not less frequently than once each year, the Secretary shall submit to the appropriate committees of Congress an annual report on the results of the assessments conducted by the Secretary under paragraph (1)(C) during the period covered by the report.</text></paragraph></subsection>
<subsection id="H2C1CFBDCE9F24CA49678FAE0C4C63729" commented="no" display-inline="no-display-inline"><enum>(j)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section $9,425,000,000 for the period of fiscal years 2022 through 2026. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H7FE5952E3233409C9DEB6D8E83F40DAE"><enum>(b)</enum><header>Initial designations and awards</header> <paragraph id="H7084D5CEDFDB4FC68B1E75C3405218F1"><enum>(1)</enum><header>Competition required</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Commerce shall commence a competition under subsection (d)(1) of section 28 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="public-law" parsable-cite="pl/96/480">Public Law 96–480</external-xref>), as added by subsection (a).</text></paragraph>
<paragraph id="HDF4CF5CB6C874B218A1B07D2D2F1DCAF"><enum>(2)</enum><header>Designation and award</header><text>Not later than 1 year after the date of the enactment of this Act, if the Secretary has received at least 1 application under subsection (f) of such section from an eligible consortium whom the Secretary considers suitable for designation under subsection (b)(1)(A) of such section, the Secretary shall—</text> <subparagraph id="H796408CFBDAE4B8890DAE037978F51CF"><enum>(A)</enum><text>designate at least 1 regional technology hub under subsection (b)(1)(A) of such section; and</text></subparagraph>
<subparagraph id="H0486BE6A0AD84919865D8B4DFFBE0E82" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>award a grant or cooperative agreement under subsection (e)(1) of such section to each regional technology hub designated pursuant to subparagraph (A) of this paragraph. </text></subparagraph></paragraph></subsection></section> <section id="H6986C89876D54EE4BDE637A235B19755"><enum>8.</enum><header>Comprehensive regional technology strategy grant program</header><text display-inline="no-display-inline">The Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="public-law" parsable-cite="pl/96/480">Public Law 96–480</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/15/3701">15 U.S.C. 3701</external-xref> et seq.), as amended by section 7, is further amended, by inserting after section 28, as added by such section, the following:</text>

<section id="H45DB7444FE574F7CB4ED08E84FFB3524"><enum>29.</enum><header>Comprehensive regional technology strategy grant program</header>
<subsection id="HF0C792F1DEA64B9C98718E861186C25C"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HD511874B75E84C708822E1BC2A95D3C7"><enum>(1)</enum><header>Labor organization</header><text>The term <term>labor organization</term> has the meaning given such term in section 8A(a) of the National Science Foundation Act of 1950.</text></paragraph>
<paragraph id="HA13E813B678741549FEF6EC94C182BCB"><enum>(2)</enum><header>Regional technology hub</header><text>The term <term>regional technology hub</term> means a consortium designated as a regional technology hub under section 28(b)(1)(A). </text></paragraph> <paragraph id="HC373568E22DE4C0597FB7ACA2705EE4F"><enum>(3)</enum><header>Small and rural communities; mid-sized metropolitan communities; large metropolitan communities</header><text>The terms <term>small and rural communities</term>, <term>mid-sized metropolitan communities</term>, and <term>large metropolitan communities</term> have the meanings given such terms in section 28(a).</text></paragraph>
<paragraph id="HE908681F0C574EFE975ADF060FBBFB42"><enum>(4)</enum><header>Technology and innovation sectors critical to national and economic security</header><text>The term <term>technology and innovation sectors critical to national and economic security</term> means technology and innovation sectors that the Secretary determines are critical to national and economic security. </text></paragraph></subsection> <subsection id="H5BE073EDC53140ACB5040E2C464DC7B3"><enum>(b)</enum><header>Grant program required</header><text>The Secretary shall establish a program to award grants to eligible consortia to carry out projects—</text>
<paragraph id="HB087E8BC86E4435880397AF21E12ACB9"><enum>(1)</enum><text>to coordinate locally defined planning processes, across jurisdictions and agencies, relating to developing a comprehensive regional technology strategy;</text></paragraph> <paragraph id="HA61DB051F89649469C28F3FD8E207568"><enum>(2)</enum><text>to identify regional partnerships for developing and implementing a comprehensive regional technology strategy;</text></paragraph>
<paragraph id="HF1CC9EC7F4064CF49FD9FF9E8EC6B32B"><enum>(3)</enum><text>to conduct or update assessments to determine regional needs and promote economic and community development related to the resiliency of a domestic supply chains, competitiveness of the region, and domestic job creation in technology and innovation sectors critical to national and economic security;</text></paragraph> <paragraph id="H78EB28CE51004A279D40F2752DDB8068"><enum>(4)</enum><text>to develop or update goals and strategies to implement an existing comprehensive regional plan related to enhancing the resiliency of domestic supply chains, competitiveness of the region, and domestic job creation in technology and innovation sectors critical to national and economic security; and</text></paragraph>
<paragraph id="HB1406433E4A2420D9D5DBEB19DC2DD69"><enum>(5)</enum><text>to identify local zoning and other code changes necessary to implement a comprehensive regional technology strategy, including promoting sustainable development within the identified region.</text></paragraph></subsection> <subsection id="HD1C9D300D72744229D3C5031D928F70D"><enum>(c)</enum><header>Eligible consortia</header><text>For purposes of this section, an eligible consortium is any consortium described by section 28(c). </text></subsection>
<subsection id="HBF87C10CF5294B03A7BBFF2EAA2F4282"><enum>(d)</enum><header>Grants</header>
<paragraph id="H67506CE1ACA84EBD8D8436F28D6C2330"><enum>(1)</enum><header>Diversity of recipients</header><text>In awarding grants under this section, the Secretary shall ensure geographic diversity among, and adequate representation from, each of the following:</text> <subparagraph id="H34E39AA083D54CA5BEFD53082CFC6363"><enum>(A)</enum><text>Small and rural communities.</text></subparagraph>
<subparagraph id="H919648B41B1E45B8820372CEB71FFEFD"><enum>(B)</enum><text>Mid-sized metropolitan communities.</text></subparagraph> <subparagraph id="HB9591F54E28B420FA6E7785D88D2CFC5"><enum>(C)</enum><text>Large metropolitan communities.</text></subparagraph></paragraph>
<paragraph id="H2C4BAD0BA17344F9A2143A3E11BBEFAC"><enum>(2)</enum><header>Awards to small and rural communities</header>
<subparagraph id="H0EF05C87B745402A980E9B9D529A4EEA"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Secretary shall—</text> <clause id="H04B3F8C0CC72474C9596B20621F17293"><enum>(i)</enum><text>award not less than 25 percent of the funds under this section to eligible consortia that represent all or part of a small and rural community; and</text></clause>
<clause id="H6012875F56244D3CA46BEEF4BF3C6884"><enum>(ii)</enum><text>ensure diversity among the geographic regions and the size of the population of the communities served by recipients of grants that are eligible consortia that represent all or part of a small and rural community.</text></clause></subparagraph> <subparagraph id="H85E1FA0DC74046F390FD0604F551059F"><enum>(B)</enum><header>Insufficient applications</header><text>If the Secretary determines that an insufficient number of sufficient quality applications for grants under this section have been submitted by eligible consortia that represent all or part of a small and rural community, the Secretary may reduce the percentage threshold set forth in subparagraph (A)(i).</text></subparagraph></paragraph>
<paragraph id="H316E4D6C9B6E43A682437EDA6386D0DA"><enum>(3)</enum><header>Federal share</header>
<subparagraph id="H6304B19209F3466B8F9AA1FD0A6FC91A"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Federal share of the cost of a project carried out using a grant awarded under this section may not exceed 80 percent.</text></subparagraph> <subparagraph id="HDA073A11022C4BE6B4791CB72231B3EA"><enum>(B)</enum><header>Exceptions</header> <clause id="H3100E289DBAA46AF8FAA089EEAADE36A"><enum>(i)</enum><header>Small and rural communities</header><text>In the case of an eligible consortium that represents all or part of a small and rural community, the Federal share of the cost of a project carried out using a grant awarded under this section may be up to 90 percent of the total cost of the project.</text></clause>
<clause id="HFC889F80FCA44E3FAE9C429DF8C7A951"><enum>(ii)</enum><header>Indian Tribes</header><text>In the case of an eligible consortium that is led by a Tribal government, the Federal share of the cost of a project carried out using a grant under the grant awarded under this section may be up to 100 percent of the total cost of the project.</text></clause></subparagraph> <subparagraph id="HA7384FA6383B47049693B5F43A319133"><enum>(C)</enum><header>Non-Federal share</header> <clause id="H413EC45582F149AF80C33950754E2528"><enum>(i)</enum><header>In-kind contributions</header><text>For the purposes of this paragraph, in-kind contributions may be used for all or part of the non-Federal share of the cost of a project carried out using a grant awarded under this section.</text></clause>
<clause id="H063DF498E36043C2809B80070E55263E"><enum>(ii)</enum><header>Other Federal funding</header><text>Federal funding from sources other than a grant awarded under this section may not be used for the non-Federal share of the cost of a project carried out using a grant under this section.</text></clause></subparagraph></paragraph> <paragraph id="H5CE894CE84DE432F86AF7B5F93CC7F1F"><enum>(4)</enum><header>Availability and obligation of grant amounts</header> <subparagraph id="H8BD8BCDF0A284365A8DC96924B9580EA"><enum>(A)</enum><header>In general</header><text>An eligible consortium that receives a grant under this section shall, as a condition on receipt of grant amounts—</text>
<clause id="HE46FDF1F5F8F43CD90A8C6E4D3FCD284"><enum>(i)</enum><text>obligate any grant amounts received under this section not later than 1 year after the date on which the eligible consortium enters into an agreement under subsection (g); and</text></clause> <clause id="H71180D6D82674D95A9401B36FE754AE5"><enum>(ii)</enum><text>expend any grant amounts received under this section not later than 2 years after the date on which the eligible consortium enters into an agreement under subsection (g).</text></clause></subparagraph>
<subparagraph id="HDE02BD255DE24CE694E25934016A3B75"><enum>(B)</enum><header>Unobligated amounts</header><text>After the date described in subparagraph (A)(i), any amounts awarded to an eligible consortium under this section that remain unobligated by the eligible consortium shall be returned to the Secretary and made available to the Secretary for the award of grants to other eligible consortia under this section.</text></subparagraph></paragraph></subsection> <subsection id="H6A71DFCEE904410DA7C23A0C79116BD0"><enum>(e)</enum><header>Application</header> <paragraph id="H98CDC191B6E84AA3BF5DB232EAB625DE"><enum>(1)</enum><header>In general</header><text>An eligible consortium seeking a grant under this section shall submit to the Secretary an application therefor at such time and in such manner as the Secretary shall prescribe.</text></paragraph>
<paragraph id="H1099E3DA57644BF7A0F44A4ECC0F302D"><enum>(2)</enum><header>Contents</header><text>Each application submitted under paragraph (1) shall include the following:</text> <subparagraph id="H81917F6C53BA40DD92AACA7490FC320C"><enum>(A)</enum><text>A description of the boundaries of the region served by the eligible consortium.</text></subparagraph>
<subparagraph id="H36C6279C1DF54B3AAD1EF4CB4435CB9F"><enum>(B)</enum><text>A description of the research, technology development, or manufacturing concentration of the eligible consortium.</text></subparagraph> <subparagraph id="H6A4079F1453948E2AEFBBD2EC5A87919"><enum>(C)</enum><text>A general assessment of the local industrial ecosystem of the region described in subparagraph (A), which may include assessment of workforce and training, including partnerships with labor organizations, supplier network, research and innovation, infrastructure and site development, trade and international investment, operational improvements, and capital access components needed for manufacturing activities in such region.</text></subparagraph>
<subparagraph id="H3862F19ADDC64933850FC1BFD2A0D598"><enum>(D)</enum><text>A description of how a grant under this section may assist in developing components of such local industrial ecosystem (selected by the consortium), including descriptions of—</text> <clause id="HAC7B589C90F34FDE8D65158F68230757"><enum>(i)</enum><text>investments to address gaps in such ecosystem; and</text></clause>
<clause id="HD215CD18D10643AAAED4BF6922C9D107"><enum>(ii)</enum><text>how to make the research, technology development, and manufacturing of the region of the consortium uniquely competitive.</text></clause></subparagraph> <subparagraph id="H44CF550F15264FC29DA630E77A2664DE"><enum>(E)</enum><text>A description of the process by which a comprehensive regional technology strategy will be developed by the eligible consortium to address gaps in such local industrial ecosystem and to strengthen the resiliency of supply chains, competitiveness of the identified region, and domestic job creation in technology and innovation sectors critical to national and economic security.</text></subparagraph>
<subparagraph id="HC71F5702E53348218AAA4506B0505870"><enum>(F)</enum><text>A budget for the projects that the eligible consortium plans to carry out using grant amounts awarded under this section, including the anticipated Federal share of the cost of each project and a description of the sources of the non-Federal share.</text></subparagraph> <subparagraph id="H3232B4BF295940D38313F4291174E590"><enum>(G)</enum><text>The designation of a lead agency or organization, which may be the eligible consortium, to receive and manage any funds received by the eligible consortium under this section.</text></subparagraph>
<subparagraph id="H345FF07F7B6E4AB0B9E01CC0FD2CFA4E"><enum>(H)</enum><text>A signed copy of a memorandum of understanding among members of the eligible consortium that demonstrates—</text> <clause id="H5D6BDEF4BFD44EA9A6B9CBC1CAEE540D"><enum>(i)</enum><text>the creation of an eligible consortium;</text></clause>
<clause id="H2C88B4D6453A435B914D07F5C888F231"><enum>(ii)</enum><text>a description of the nature and extent of planned collaboration between members of the eligible consortium; and</text></clause> <clause id="H7E63A4A81AFB441BAF35F77E67CCC11F"><enum>(iii)</enum><text>a commitment to develop a comprehensive regional technology strategy.</text></clause></subparagraph>
<subparagraph id="HF4A33247BB054EABA361E817C9D6A657"><enum>(I)</enum><text>Such other matters as the Secretary considers appropriate.</text></subparagraph></paragraph> <paragraph id="H1F7E5801187F4EA69F58092A6EBEBDC1"><enum>(3)</enum><header>Evaluation of applications</header><text>The Secretary shall evaluate each application received under paragraph (1) to determine whether the applicant demonstrates—</text>
<subparagraph id="H14DBA82B8EF349E0B698B53D9D710F3D"><enum>(A)</enum><text>a significant level of regional cooperation in their proposal; </text></subparagraph> <subparagraph id="HA3AD2DBE380D4FCB9C9A94AF191C9581"><enum>(B)</enum><text>a focus on building a regional ecosystem to attract and build upon research investment to develop, deploy, and manufacture domestically critical technologies that improve the resiliency of supply chains, competitiveness of the identified region, and the creation of quality jobs;</text></subparagraph>
<subparagraph id="HA60033BA029B4CBDAB238B1D9D1CE958"><enum>(C)</enum><text>the extent to which the consortium has developed partnerships throughout an entire region, including, as appropriate, partnerships with federally funded research and development centers, National Laboratories, Federal laboratories, Manufacturing USA institutes described in section 34(d) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(d)</external-xref>), university technology centers established under paragraph (6) of section 8A(d) of the National Science Foundation Act of 1950, the program established under paragraph (7) of such section 8A(d), test beds established and operated under paragraph (8) of such section 8A(d), or other Federal research entities;</text></subparagraph> <subparagraph id="H8D7B464C593449329C3A1F5D75E5E2DB"><enum>(D)</enum><text>integration with local efforts in inclusive economic development and job creation;</text></subparagraph>
<subparagraph id="H5FB9CC67FAA545A599C267C41AA4096D"><enum>(E)</enum><text>a plan for implementing a comprehensive regional technology strategy through regional infrastructure, workforce, and supply chain investment plans and local land use plans;</text></subparagraph> <subparagraph id="HDF91128C12464EA3B8B1CAB6D9EF4C64"><enum>(F)</enum><text>diversity among the geographic regions and the size of the population of the communities served by recipients of grants under this section;</text></subparagraph>
<subparagraph id="HAD26990007D84878B736C3E2BEDC7185"><enum>(G)</enum><text>a commitment to seeking substantial public input during the planning process and public participation in the development of the comprehensive regional plan;</text></subparagraph> <subparagraph id="H4C7D367FC6404470BD2C9F15CC2F8519"><enum>(H)</enum><text>a plan to support the creation and growth of new companies; and</text></subparagraph>
<subparagraph id="HA03481153A15478995BD6AF87E8180C1"><enum>(I)</enum><text>such other qualities as the Secretary considers appropriate.</text></subparagraph></paragraph></subsection> <subsection id="H484AF145450B4455BD4DF4D297175C43"><enum>(f)</enum><header>Use of grant funds</header><text>An eligible consortium that receives a grant under this section shall use the amount of such grant to carry out a project that includes 1 or more of the following activities:</text>
<paragraph id="H6E8C5CAA6D314FD98B2796BE30324240"><enum>(1)</enum><text>Coordinating locally defined planning processes across jurisdictions and agencies.</text></paragraph> <paragraph id="HB820D908925245EC908735DC47EE82F1"><enum>(2)</enum><text>Identifying potential regional partnerships for developing and implementing a comprehensive regional technology strategy.</text></paragraph>
<paragraph id="H1316D1809DA748EFB43E2A8DB82B7D69"><enum>(3)</enum><text>Conducting or updating assessments to determine regional needs, which may include—</text> <subparagraph id="H6616A0A4FA27439FB4491B1F5C647639"><enum>(A)</enum><text>workforce development;</text></subparagraph>
<subparagraph id="H40F9A1BAA04A43FFA9D7C5AB91F36AA0"><enum>(B)</enum><text>supply chain development;</text></subparagraph> <subparagraph id="H8D55A16014A44D788E3EA296FFCD2B22"><enum>(C)</enum><text>increasing innovation readiness, including expanding research and technology development facilities and developing the local science, technology, engineering, and mathematics workforce;</text></subparagraph>
<subparagraph id="HFB916CC0822A4AC98EB9543F1A77D8E3"><enum>(D)</enum><text>site preparation;</text></subparagraph> <subparagraph id="H4EC5F9DE6763459C89243BDCB75CA608"><enum>(E)</enum><text>community and economic development to start new companies and to attract and support workers and firms; and</text></subparagraph>
<subparagraph id="HAB2832BD56164922B75D05EC230B1512"><enum>(F)</enum><text>and other such needs as determined by the consortium.</text></subparagraph></paragraph> <paragraph id="HB520436293654095864C106B867C2E64"><enum>(4)</enum><text>Developing or updating—</text>
<subparagraph id="H0EAFC4CCBE4B40D8B4D6B98AF23EC8D8"><enum>(A)</enum><text>a comprehensive regional plan; or</text></subparagraph> <subparagraph id="HAFF78F1478034BE997E5CF2F58B9AA0F"><enum>(B)</enum><text>goals and strategies to implement an existing comprehensive regional plan for the purposes of strengthening domestic supply chain resiliency, competitiveness, and job creation in critical technology and innovation sectors for national and economic security.</text></subparagraph></paragraph>
<paragraph id="H9E8931D0972547ECABECEF5D13A683A9"><enum>(5)</enum><text>Implementing local zoning and other code changes necessary to implement a comprehensive regional plan and promote sustainable development.</text></paragraph></subsection> <subsection id="H3E3915674F1F482580DC6DF542DFC864"><enum>(g)</enum><header>Grant agreement</header><text>Each eligible consortium that receives a grant under this section shall, as a condition on receipt of grant amounts, agree to establish, in coordination with the Secretary, performance measures, reporting requirements, and such other requirements as the Secretary determines are necessary, that must be met at the end of each year in which the eligible consortium receives funds under this section.</text></subsection>
<subsection id="H66465C6916BB4F51A200E3BCF37A5A94"><enum>(h)</enum><header>Reports by recipients of grants</header>
<paragraph id="H68F72B300C434DFEBB04E64FA096AF1C"><enum>(1)</enum><header>Final reports</header><text>Not later than 90 days after the date on which a grant agreement into which an eligible consortium entered under subsection (g) expires, the eligible consortium shall submit to the Secretary a final report on the project the eligible consortium carried out under subsection (f) using the amounts of the grant awarded to the eligible consortium under this section.</text></paragraph> <paragraph id="HBB87FEB3D5C848D2AC4BEEFDA8C3B4E7"><enum>(2)</enum><header>Contents</header><text>Each report submitted under paragraph (1) shall include the following:</text>
<subparagraph id="H739BEC4711244E56A6B3DB7E9E2EC16E"><enum>(A)</enum><text>A detailed explanation of the activities undertaken using the grant, including an explanation of how the comprehensive regional technology strategy of the eligible consortium may achieve specific improvements in domestic supply chain resiliency, research, development, and deployment of critical technologies, workforce development, domestic job creation, and entrepreneurship goals within the region served by the eligible consortium.</text></subparagraph> <subparagraph id="H698882E8F0E444D6AE7E4789409EB9C7"><enum>(B)</enum><text>A discussion of any obstacles encountered in the planning process of the eligible consortium and how the eligible consortium overcame the obstacles.</text></subparagraph>
<subparagraph id="H9086F560228B4CBD8D7B99ED0F5A51FC"><enum>(C)</enum><text>An evaluation of the success of the project using the performance standards and measures established under subsection (g), including an evaluation of the planning process and how the project contributes to carrying out the comprehensive regional technology strategy.</text></subparagraph> <subparagraph id="HBEA00EDB71C74D5095B6671BF951394F"><enum>(D)</enum><text>The progress of the region identified by the consortium toward becoming a regional technology hub.</text></subparagraph>
<subparagraph id="H085F62D2D2824C799441F14CE1D3ECEB"><enum>(E)</enum><text>The effectiveness of the region identified by the consortium in ensuring that growth in innovation sectors produces broadly shared opportunity in the region.</text></subparagraph> <subparagraph id="HD697D1B7E29A4B70BA21F85A0070C103"><enum>(F)</enum><text>Such other information as the Secretary may require.</text></subparagraph></paragraph>
<paragraph id="HC5DD30FE3DE445F48CF32115B737AB88"><enum>(3)</enum><header>Interim reports</header><text>The Secretary may require, as a condition on receipt of a grant under this section, an eligible consortium to submit an interim report, before the date on which a project for which a grant is awarded under this section is completed.</text></paragraph></subsection> <subsection id="HAB9F706A3C8C4B62AE0D13316BAC6630"><enum>(i)</enum><header>Technical assistance for grant recipients and applicants</header><text>The Secretary may—</text>
<paragraph id="HEED6871767D64FFAB6B58CEBE9102B60"><enum>(1)</enum><text>coordinate with other Federal agencies to establish interagency and multidisciplinary teams to provide technical assistance to recipients of, and prospective applicants for, grants under this section;</text></paragraph> <paragraph id="H566EA60B1470481C97B16B315B83F178"><enum>(2)</enum><text>by Federal interagency agreement, transfer funds to another Federal agency to facilitate and support the provision of such technical assistance; and</text></paragraph>
<paragraph id="H20D4BC935E9541C0B46FB2C0E03ABCD1"><enum>(3)</enum><text>enter into contracts with third parties to provide technical assistance to grant recipients and prospective applicants for grants under this section. </text></paragraph></subsection> <subsection id="HE05116229EAA4CA6B88E9BBB737A0F41"><enum>(j)</enum><header>Authorization of appropriations</header> <paragraph id="HAC8A0D3C9C1A4937A4E50069A0A0482B"><enum>(1)</enum><header>Authorization</header><text>There are authorized to be appropriated to the Secretary for the award of grants under this section, to remain available until expended, amounts as follows:</text>
<subparagraph id="H7AF0733D081C460FBD54EC047A21DCCF"><enum>(A)</enum><text>$100,000,000 for each of fiscal years 2022 and 2023.</text></subparagraph> <subparagraph id="H2C1E32F54EF34EDF9089C8945CF1F5F0"><enum>(B)</enum><text>$125,000,000 for each of fiscal years 2024 through 2026.</text></subparagraph></paragraph>
<paragraph id="H4F4CD549A434484AA57A7134DFDD3745" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Technical assistance</header><text>The Secretary may use not more than 5 percent of the amounts made available under this subsection for a fiscal year for technical assistance under subsection (i).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H6C5697D5A06A42A79EDD0A99BA96DD59"><enum>9.</enum><header>Manufacturing USA Program</header> <subsection id="HBA3F3FF7EF6343CC9D178BB147525581"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H94048FDDA3214023AEE8300BA07FB929"><enum>(1)</enum><header>Historically Black college or university</header><text>The term <term>historically Black college or university</term> has the meaning given the term <quote>part B institution</quote> in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>). </text></paragraph> <paragraph id="H7BBBC9CF9D9A413DBD26F0DBF0331817"><enum>(2)</enum><header>Labor organization</header><text>The term <term>labor organization</term> has the meaning given such term in section 8A(a) of the National Science Foundation Act of 1950.</text></paragraph>
<paragraph id="H2153D5F13CCA492989B4427F31FD4006"><enum>(3)</enum><header>Manufacturing USA center</header><text>The term <term>Manufacturing USA center</term> means an institute described in section 34(d)(3)(B) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(d)(3)(B)</external-xref>) and recognized by the Secretary under such section for purposes of participation in the Manufacturing USA Network. </text></paragraph> <paragraph id="HA9D0A939FE59449DB6472E43CD578F22"><enum>(4)</enum><header>Manufacturing USA institute</header><text>The term <term>Manufacturing USA institute</term> means an institute described in section 34(d) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(d)</external-xref>) that is not a Manufacturing USA center.</text></paragraph>
<paragraph id="HED366685A43C4BDA827F305D20EBED4A"><enum>(5)</enum><header>Manufacturing USA Network</header><text>The term <term>Manufacturing USA Network</term> means the network established under section 34(c) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(c)</external-xref>).</text></paragraph> <paragraph id="H1EB90C8952414A379015A9FDC5C163DD"><enum>(6)</enum><header>Manufacturing USA Program</header><text>The term <term>Manufacturing USA Program</term> means the program established under section 34(b)(1) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(b)(1)</external-xref>).</text></paragraph>

<paragraph id="H3BF536B1D233455398CD717AD872DE48"><enum>(9)</enum><header>Tribal college or university</header><text>The term <term>Tribal college or university</term> has the meaning given the term in section 316(b)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)(3)</external-xref>). </text></paragraph></subsection> <subsection id="H4C9E753FB0AA4457B3ABE6B08D8835B0"><enum>(b)</enum><header>Authorization of appropriations To enhance and expand Manufacturing USA Program and support innovation and growth in domestic manufacturing</header> <paragraph id="HAE25440E111B4615A0801E6A5C611E03"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated $2,410,000,000 for the period of fiscal years 2022 through 2026 for the Secretary of Commerce, acting through the Director of the National Institute of Standards and Technology and in coordination with the Secretary of Energy, the Secretary of Defense, and the heads of such other Federal agencies as the Secretary of Commerce considers relevant, to carry out the Manufacturing USA Program and to expand such program to support innovation and growth in domestic manufacturing.</text></paragraph>
<paragraph id="H08D16F5B94E64E399C651AA8B162A47D"><enum>(2)</enum><header>Manufacturing USA institutes</header>
<subparagraph id="H6994034C64F447049EF87B9B726C3422"><enum>(A)</enum><header>In general</header><text>Of the amounts appropriated pursuant to the authorization of appropriations in paragraph (1), $1,190,000,000 shall be available to support the establishment of new Manufacturing USA institutes during the period described in such paragraph.</text></subparagraph> <subparagraph id="H0D13B1C75C0B442E9119105D069E636E"><enum>(B)</enum><header>Financial assistance</header><text>The Secretary shall support the establishment of Manufacturing USA institutes under subparagraph (A) through the award of financial assistance under section 34(e) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(e)</external-xref>).</text></subparagraph>
<subparagraph id="H70EC061CB7B44513A3E8592C97A04518"><enum>(C)</enum><header>Assignment of Manufacturing USA institutes to Federal agency sponsors</header><text>Following an open topic competition organized by the Director of the National Institute of Standards and Technology, the Secretary of Commerce, in consultation with the Secretary of Energy, the Secretary of Defense, and other relevant Federal agencies, may select an alternative Federal agency to sponsor a selected Manufacturing USA institute based on its technology and may transfer the appropriate funds to that alternative Federal agency for operation and programming of the selected Manufacturing USA institute.</text></subparagraph> <subparagraph id="H5969F76569774822909B16532E820D4E"><enum>(D)</enum><header>Coordination with existing Manufacturing USA institutes</header> <clause id="HE43F60A7FC834C96BB8C2AF561175A88"><enum>(i)</enum><header>Coordination required</header><text>In establishing new Manufacturing USA institutes under subparagraph (A), the Secretary of Commerce shall coordinate with the Secretary of Energy and the Secretary of Defense to ensure there is no duplication of effort or technology focus between new Manufacturing USA institutes and Manufacturing USA institutes that were in effect before the establishment of the new Manufacturing USA institutes.</text></clause>
<clause id="HE6AAC8A90FF44A65A3FE0D742FA5047E"><enum>(ii)</enum><header>Consultation with existing Manufacturing USA institutes authorized</header><text>In carrying out coordination under clause (i), the Secretary of Commerce may consult with Manufacturing USA institutes that were in effect before the establishment of new Manufacturing USA institutes under subparagraph (A) to inform the Department of Commerce of additional new Manufacturing USA institutes necessary to fill gaps in the support of innovation and growth in domestic manufacturing.</text></clause> <clause id="H61EE69A725F344359B6C3958FD50E5D1"><enum>(iii)</enum><header>Involvement of existing Manufacturing USA institutes authorized</header><text>In coordination with the Secretary of Energy and the Secretary of Defense, the Secretary of Commerce may involve Manufacturing USA institutes that were in effect before the establishment of new Manufacturing USA institutes under subparagraph (A) in the planning and execution of the new Manufacturing USA institutes. </text></clause></subparagraph></paragraph>
<paragraph id="HF6D5360DED0A471E97A16644863D3F3C"><enum>(3)</enum><header>Manufacturing USA centers and public service grants</header><text>Of the amounts appropriated pursuant to the authorization of appropriations in paragraph (1), $375,000,000 shall be available for the period described in such paragraph—</text> <subparagraph id="HE2B46DF6764E48C290B6B57449CB1A08"><enum>(A)</enum><text>for the Secretary, acting through the Director and in consultation with the Secretary of Energy, the Secretary of Defense, and the heads of such other Federal agencies as the Secretary of Commerce considers relevant, to recognize additional institutes as Manufacturing USA institutes under section 34(d)(3)(B) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(d)(3)(B)</external-xref>), giving particular consideration to partnerships and coordination with the Manufacturing USA institutes that were already in effect, when practicable; and</text></subparagraph>
<subparagraph id="HEAAA198657DA47A0ACB0B1A8CE90C494"><enum>(B)</enum><text>to support the activities of Manufacturing USA institutes and Manufacturing USA centers through the award of grants under section 34(f) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(f)</external-xref>). </text></subparagraph></paragraph> <paragraph id="H8835AF71772B438D8BFC3FD9C9103183"><enum>(4)</enum><header>Commercialization, workforce training, and supply chain investment</header><text>Of the amounts appropriated pursuant to the authorization of appropriations in paragraph (1), $100,000,000 shall be available for the period described in such paragraph to support such programming for commercialization, workforce training, and supply chain activities across the Manufacturing USA Network as the Secretary considers appropriate in consultation with the Secretary of Energy, the Secretary of Defense, and the heads of such other Federal agencies as the Secretary of Commerce considers relevant.</text></paragraph>
<paragraph id="H1F444546EB9B454D86319A42FDE8EA40"><enum>(5)</enum><header>Ongoing support for existing Manufacturing USA institutes</header>
<subparagraph id="HFEF0521AE97444C790EE6D73BC2280C0"><enum>(A)</enum><header>In general</header><text>Of the amounts appropriated pursuant to the authorization of appropriations in paragraph (1), $725,000,000 shall be available for the period described in such paragraph to support Manufacturing USA institutes that were in effect on the day before the date of the enactment of this Act, of which $5,000,000 shall be available (without cost share) to each such Manufacturing USA institute each year for such period for ongoing operation of the institutes, including operational overhead, workforce training, and supply chain activities.</text></subparagraph> <subparagraph id="H46B6213BCAC945E9955CF72E644E5A22"><enum>(B)</enum><header>Additional support</header> <clause id="H258B45FB71C648BABC17C961D84A5F08"><enum>(i)</enum><header>In general</header><text>Of the amounts specified in subparagraph (A), amounts shall be available for financial assistance awards to conduct projects as follows:</text>
<subclause id="HE3595B1F1AF04EB6ACC182F6D656CA4F"><enum>(I)</enum><text>$100,000,000 shall be available for Manufacturing USA institutes that were established under section 34(e) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(e)</external-xref>) and that were in effect on the day before the date of the enactment of this Act.</text></subclause> <subclause id="HEA87666242F944BD91F8802F693C8F49"><enum>(II)</enum><text>$10,000,000 shall be available each year for the period described in such paragraph for each Manufacturing USA institute that is not receiving Manufacturing USA Program funding from any other Federal agency. </text></subclause></clause>
<clause id="HA443C43769A440999F2A6E7444ECDBE9"><enum>(ii)</enum><header>Federal funds matching requirement</header><text>A recipient of financial assistance for a project under clause (i) shall agree to make available to carry out the project an amount of non-Federal funds that is equal to or greater than 20 percent of the total cost of the project. </text></clause></subparagraph> <subparagraph id="H4ED70179CB264FF497B0743476EE703F"><enum>(C)</enum><header>Renewal requirements</header><text>Receipt of ongoing support under subparagraph (A) shall be subject to the requirements of section 34(e)(2)(B) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(e)(2)(B)</external-xref>).</text></subparagraph>
<subparagraph id="HAA5161FA37E7448192E36F0C491B9584"><enum>(D)</enum><header>No cost share requirement</header><text>The Secretary shall not impose any cost share or matching requirement on receipt of ongoing support under subparagraph (A).</text></subparagraph></paragraph> <paragraph id="H030657AC36F241998487AD401C558AE5"><enum>(6)</enum><header>Management of interagency solicitations and ongoing management</header><text>Of the amounts appropriated pursuant to the authorization of appropriations in paragraph (1), $20,000,000 shall be available annually for the period described in such paragraph for the National Program Office to coordinate the activities of the Manufacturing USA Network and manage interagency solicitations.</text></paragraph></subsection>
<subsection id="HA45CA4EB4B67466FA7F9B2DCD5200140"><enum>(c)</enum><header>Coordination between Manufacturing USA Program and Hollings Manufacturing Extension Partnership</header><text>The Secretary shall coordinate the activities of the Manufacturing USA Program and the activities of Hollings Manufacturing Extension Partnership with each other to the degree that doing so does not diminish the effectiveness of the ongoing activities of a Manufacturing USA institute or a Center (as the term is defined in section 25(a) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278k">15 U.S.C. 278k(a)</external-xref>), including Manufacturing USA institutes entering into agreements with a Center (as so defined) that the Secretary considers appropriate to provide services relating to the mission of the Hollings Manufacturing Extension Partnership, including outreach, technical assistance, workforce development, and technology transfer and adoption assistance to small- and medium-sized manufacturers.</text></subsection> <subsection id="H73163B0EEDA848D59D5372B15AFF7611"><enum>(d)</enum><header>Worker advisory council for Manufacturing USA Program</header> <paragraph id="HBFE4ECE9D93241CAA2F71FFBCFDEF880"><enum>(1)</enum><header>Establishment</header> <subparagraph id="H1B659BDE2D2742D28141A427D474D98A"><enum>(A)</enum><header>In general</header><text>The Secretary of Commerce shall, in coordination with the Secretary of Labor, the Secretary of Defense, the Secretary of Energy, and the Secretary of Education, establish an advisory council for the Manufacturing USA Program on the development and dissemination of techniques, policies, and investments for high-road labor practices, worker adaptation and success with technological change, and increased worker participation across the Manufacturing USA Network.</text></subparagraph>
<subparagraph id="H9043D25BBC5840469C0F27B5945B430B"><enum>(B)</enum><header>Membership</header><text>The council established under subparagraph (A) shall be composed of not fewer than 15 members appointed by the Secretary of Commerce, of whom—</text> <clause id="HD05D65CFDB0E4D62B6F7BEF52D44EBBE"><enum>(i)</enum><text>four shall be from labor organizations;</text></clause>
<clause id="H3F9A061F482B47ABA12095DE10DDF005"><enum>(ii)</enum><text>four shall be from educational institutions;</text></clause> <clause id="H80E2471A973B4F9D91DBF9ACA7C19B1C"><enum>(iii)</enum><text>four shall be from labor-management training, workforce development, and nonprofit organizations, including those that focus on workforce diversity and inclusion; and</text></clause>
<clause id="H4EC0A3208D1B4204A209F6F32D47B090"><enum>(iv)</enum><text>three shall be from industry organizations or manufacturing firms, including small- and medium-sized manufacturers.</text></clause></subparagraph> <subparagraph id="HE34C30D58BEB498B815D36A3772FE0B6"><enum>(C)</enum><header>Period of appointment; vacancies</header> <clause id="H7B3B4B97381943F5BC59DD4A1EF10143"><enum>(i)</enum><header>In general</header><text>Each member of the council established under subparagraph (A) shall be appointed for a term of 3 years with the ability to renew the appointment for no more than 2 terms.</text></clause>
<clause id="H01E6A948385C4904BCCCA1C773D4A75E"><enum>(ii)</enum><header>Vacancies</header><text>Any member appointed to fill a vacancy occurring before the expiration of the term for which the member’s predecessor was appointed shall be appointed only for the remainder of that term. A member may serve after the expiration of that term until a successor has been appointed.</text></clause></subparagraph> <subparagraph id="H769905BA36694974BAE3F41697A0F704"><enum>(D)</enum><header>Meetings</header> <clause id="H7C282860D3F941038AE1CCA020EEBDE8"><enum>(i)</enum><header>Initial meeting</header><text>Not later than 180 days after the date of enactment of this Act, the council established under subparagraph (A) shall hold the first meeting.</text></clause>
<clause id="H420DFD3CD8514A0BA9293082EBBCE7B8"><enum>(ii)</enum><header>Additional meetings</header><text>After the first meeting of the council, the council shall meet upon the call of the Secretary, and at least once every 180 days thereafter.</text></clause> <clause id="H94F8D81A877141ED900BECEAC256EEF6"><enum>(iii)</enum><header>Quorum</header><text>A majority of the members of the council shall constitute a quorum, but a lesser number of members may hold hearings.</text></clause></subparagraph>
<subparagraph id="H2CAE6D3C765D4945B95B29950A79FFFA"><enum>(E)</enum><header>Chairperson and vice chairperson</header><text>The Secretary shall elect 1 member of the council established under subparagraph (A) to serve as the chairperson of the council and 1 member of the council to serve as the vice chairperson of the council.</text></subparagraph></paragraph> <paragraph id="H1097C4B7125C42339B2E7C9B3097A647"><enum>(2)</enum><header>Duties of the council</header><text>The council established under paragraph (1)(A) shall provide advice and recommendations to the Secretary of Commerce on matters concerning investment in and support of the manufacturing workforce relating to the following:</text>
<subparagraph id="H2FFE5B0556BE4C6A9000C20143846BC1"><enum>(A)</enum><text>Worker participation, including through labor organizations, in the planning and deployment of new technologies across an industry and within workplaces.</text></subparagraph> <subparagraph id="HDBC4D1A5B76C4DFB80F7BCEE43B3EAF2"><enum>(B)</enum><text>Policies to help workers adapt to technological change, including training and education priorities for the Federal Government and for employer investments in workers.</text></subparagraph>
<subparagraph id="H59F484C3AA6445E49A9A3D16D48F1853"><enum>(C)</enum><text>Assessments of impact on workers of development of new technologies and processes by the Manufacturing USA institutes.</text></subparagraph> <subparagraph id="H98B19ECEB00441C5882DF2941E50563B"><enum>(D)</enum><text>Management practices that prioritize job quality, worker protection, worker participation and power in decision making, and investment in worker career success.</text></subparagraph>
<subparagraph id="H6A7B41E3BF5747A19BA2EC984F4131CE"><enum>(E)</enum><text>Policies and procedures to prioritize diversity and inclusion in the manufacturing and technology workforce by expanding access to job, career advancement, and management opportunities for underrepresented populations.</text></subparagraph> <subparagraph id="H2E556989A9774DDBBF3956BD00D4726D"><enum>(F)</enum><text>Assessments of technology improvements achieved by the Manufacturing USA institutes and the degree of domestic deployment of each new technology.</text></subparagraph>
<subparagraph id="H3AA37D2F8A754319A1A16D6BBCC862D5"><enum>(G)</enum><text>Such other matters as the Secretary considers appropriate.</text></subparagraph></paragraph> <paragraph id="H361A26362061470DBD0D89FA5839A207"><enum>(3)</enum><header>Report</header> <subparagraph id="H04950698EBD64C19B4484B96B757A137"><enum>(A)</enum><header>Appropriate committees of Congress defined</header><text>In this paragraph, the term <term>appropriate committees of Congress</term> means—</text>
<clause id="HD46544FD653F46E2A9BB0B2FAD5FCC23"><enum>(i)</enum><text>the Committee on Health, Education, Labor, and Pensions, the Committee on Commerce, Science, and Transportation, the Committee on Energy and Natural Resources, the Committee on Armed Services, and the Committee on Appropriations of the Senate; and</text></clause> <clause id="HFD5A3738EB17456DA6CD721E54CF6E84"><enum>(ii)</enum><text>the Committee on Education and Labor, the Committee on Science, Space, and Technology, the Committee on Energy and Commerce, the Committee on Armed Services, and the Committee on Appropriations of the House of Representatives.</text></clause></subparagraph>
<subparagraph id="HF19C95FA38764FF48AAE0731E80DF112"><enum>(B)</enum><header>Report required</header><text>Not later than 180 days after the date on which the council established under paragraph (1)(A) holds its initial meeting under paragraph (1)(D)(i) and annually thereafter, the council shall submit to the appropriate committees of Congress a report containing a detailed statement of the advice and recommendations of the council pursuant to paragraph (2).</text></subparagraph></paragraph> <paragraph id="H5E328D1603E44575BB0D95A1E8C39C99"><enum>(4)</enum><header>Compensation</header> <subparagraph id="H7D49237EAC02493B827BF5E9CFC102DB"><enum>(A)</enum><header>Prohibition of compensation</header><text>Members of the Council may not receive additional pay, allowances, or benefits by reason of their service on the Council.</text></subparagraph>
<subparagraph id="H962EDC08DA5949F4B9A2D0D4EE86105C"><enum>(B)</enum><header>Travel expenses</header><text>Each member shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subparagraph></paragraph> <paragraph id="H4C8F1EA579DA4D6EB097A8E1E5A3CF1E"><enum>(5)</enum><header>FACA applicability</header> <subparagraph id="H383F8A7F96324BC89BEF4C4E5AC9C4F8"><enum>(A)</enum><header>In general</header><text>In discharging its duties under this subsection, the council established under paragraph (1)(A) shall function solely in an advisory capacity, in accordance with the Federal Advisory Committee Act (5 U.S.C. App.).</text></subparagraph>
<subparagraph id="H26F93C7AA3C14C4789A3840A0AC4CF6A"><enum>(B)</enum><header>Exception</header><text>Section 14 of the Federal Advisory Committee Act shall not apply to the Council.</text></subparagraph></paragraph></subsection> <subsection id="HA9424E84E65B4C628F7F181659873F15"><enum>(e)</enum><header>Participation of minority-Serving institutions, historically Black colleges and universities, and Tribal colleges and universities</header> <paragraph id="H4BB37CE771984D01A446024C59769C83"><enum>(1)</enum><header>In general</header><text>The Secretary of Commerce, in coordination with the Secretary of Energy, the Secretary of Defense, and the heads of such other Federal agencies as the Secretary of Commerce considers relevant, shall coordinate with existing and new Manufacturing USA institutes to integrate covered entities as active members of the Manufacturing USA institutes, including through the development of preference criteria for proposals to create new Manufacturing USA institutes or renew existing Manufacturing USA institutes that include meaningful participation from a covered entity or that are led by a covered entity.</text></paragraph>
<paragraph id="H9B2D755C2B504E61ABFDA7E569EF5F3B"><enum>(2)</enum><header>Covered entities</header><text>For purposes of this subsection, a covered entity is—</text> <subparagraph id="H78BF7069105D4A6AB12CE374C462D193"><enum>(A)</enum><text>a minority-serving institution;</text></subparagraph>
<subparagraph id="HCB32236DB3F540EB9B60BA2ACA2393E4"><enum>(B)</enum><text>an historically Black college or university; or</text></subparagraph> <subparagraph id="H74F67FBCD551410AA50CA334DA8466CD"><enum>(C)</enum><text>a Tribal college or university.</text></subparagraph></paragraph></subsection>
<subsection id="H2C22B9F0D3C0444EBF1BA00A8E4FD672"><enum>(f)</enum><header>Department of Commerce policies To promote domestic production of technologies developed under Manufacturing USA Program</header>
<paragraph id="H43BC92EF68A2433EBBB5FEA08D9F31BA"><enum>(1)</enum><header>Definition of domestic</header><text>In this subsection, the term <term>domestic</term>, with respect to development or production means development or production by, or with respect to source means the source is, a person incorporated or formed in the United States—</text> <subparagraph id="H4447FF7418CA48D0977173F3377E6734"><enum>(A)</enum><text>that is not under foreign ownership, control, or influence (FOCI) as defined in section 847 of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>);</text></subparagraph>
<subparagraph id="H05CE567F55F045AE9076D4978B342324"><enum>(B)</enum><text>whose beneficial owners, as defined in section 847 of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>), are United States persons;</text></subparagraph> <subparagraph id="H6F1D8438548445B4BFF549A41F022FDF"><enum>(C)</enum><text>whose management are United States citizens;</text></subparagraph>
<subparagraph id="H42F4B80F5E2644778D8DFEA887A83661"><enum>(D)</enum><text>whose principal place of business is in the United States; and</text></subparagraph> <subparagraph id="H47660809E94D43898A4C679F87251B54"><enum>(E)</enum><text>who is not—</text>
<clause id="HC7FA66D15B9C46FBB0451F225DC28603"><enum>(i)</enum><text>a foreign incorporated entity that is an inverted domestic corporation or any subsidiary of such entity; or</text></clause> <clause id="H83F21A84D22A4ED39FB648F8904FF1D3"><enum>(ii)</enum><text>any joint venture if more than 10 percent of the joint venture (by vote or value) is held by a foreign incorporated entity that is an inverted domestic corporation or any subsidiary of such entity.</text></clause></subparagraph></paragraph>
<paragraph id="H5339397CB61E48CE8FC1BAF5EFA47F6A"><enum>(2)</enum><header>Policies</header>
<subparagraph id="HBFA6502F5CA3463D93D368982700216D"><enum>(A)</enum><header>In general</header><text>The Secretary of Commerce, in consultation with the Secretary of Energy, the Secretary of Defense, and the heads of such other Federal agencies as the Secretary of Commerce considers relevant, shall establish policies to promote the domestic production of technologies developed by the Manufacturing USA Network.</text></subparagraph> <subparagraph id="H5D9DCBB6B95446608312D00D470E794F"><enum>(B)</enum><header>Elements</header><text>The policies developed under subparagraph (A) shall include the following:</text>
<clause id="H6D4380D53F404589A5B70553BE4E482B"><enum>(i)</enum><text>Measures to partner domestic developers of goods, services, or technologies by Manufacturing USA Network activities with domestic manufacturers and sources of financing.</text></clause> <clause id="H1EEE433C2C26489483FCCEF94F94732B"><enum>(ii)</enum><text>Measures to develop and provide incentives to promote transfer of intellectual property and goods, services, or technologies developed by Manufacturing USA Network activities to domestic manufacturers.</text></clause>
<clause id="H5DE03FAF1CA44903B722FBF74A5E734D"><enum>(iii)</enum><text>Measures to assist with supplier scouting and other supply chain development, including the use of the Hollings Manufacturing Extension Partnership to carry out such measures.</text></clause> <clause id="HDD866088734247008A3F1AB85184FE95"><enum>(iv)</enum><text>A process to review and approve or deny membership in a Manufacturing USA institute by foreign-owned companies, especially from countries of concern, including the People’s Republic of China.</text></clause>
<clause id="H5EC47ED0F28F4E1CA33ADF4BCC5A07F9"><enum>(v)</enum><text>Measures to prioritize Federal procurement of goods, services, or technologies developed by the Manufacturing USA Network activities from domestic sources, as appropriate.</text></clause></subparagraph> <subparagraph id="H5577C25852CA4B86AC314AB7C736CE02"><enum>(C)</enum><header>Processes for waivers</header><text>The policies established under this paragraph shall include processes to permit waivers, on a case by case basis, for policies that promote domestic production based on cost, availability, severity of technical and mission requirements, emergency requirements, operational needs, other legal or international treaty obligations, or other factors deemed important to the success of the Manufacturing USA Program.</text></subparagraph></paragraph>
<paragraph id="H23E89DEF80B94ED8B53A069441DE40E3"><enum>(3)</enum><header>Prohibition</header>
<subparagraph id="H10363A8D4B9D467384F825F39ABA56BB"><enum>(A)</enum><header>Company defined</header><text>In this paragraph, the term <term>company</term> has the meaning given such term in section 847(a) of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2509">10 U.S.C. 2509</external-xref> note).</text></subparagraph> <subparagraph id="H1887491C29434BC3875A9210AD9F8933" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>In general</header><text>A company of the People’s Republic of China may not participate in the Manufacturing USA Program or the Manufacturing USA Network without a waiver, as described in paragraph (2)(C).</text></subparagraph></paragraph></subsection></section>
<section id="H7A0308EBFCC846EDA2D9CD0749020AE4" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>10.</enum><header>Technology commercialization review</header>
<subsection id="H707FC40206B7478B95163F97E544075D" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Key technology focus areas defined</header><text display-inline="yes-display-inline">In this section, the term <term>key technology focus areas</term> means the areas included on the most recent list under section 8A(d)(2) of the National Science Foundation Act of 1950. </text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H8E29CCFB5A074FC5A293DA8781900B7A"><enum>(b)</enum><header>Review and recommendations required</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of the Office of Science and Technology Policy, in consultation with the Director of the National Science Foundation and the Director of the National Institute of Standards and Technology, shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HB251186EE3D64BB182EA0964F4F428EF"><enum>(1)</enum><text display-inline="yes-display-inline">review—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H76640DD4C52E461A8BC1869C9236A064"><enum>(A)</enum><text display-inline="yes-display-inline">the structure of current technology research and commercialization arrangements with regard to public-private partnerships; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HCCDFD6CE67934A708424166F57DAC963"><enum>(B)</enum><text display-inline="yes-display-inline">the extent to which intellectual property developed with Federal funding—</text> <clause commented="no" display-inline="no-display-inline" id="H93962549F4604DAE96E83BE3D9D832C1"><enum>(i)</enum><text display-inline="yes-display-inline">has been used by foreign business entities;</text></clause>
<clause display-inline="no-display-inline" commented="no" id="HFFDE3D06BC3C4F6A81F0E0DFA399E087"><enum>(ii)</enum><text>is being used to manufacture in the United States rather than in other countries; and</text></clause> <clause display-inline="no-display-inline" commented="no" id="H406675124906473C8A1FFA9789A2D060"><enum>(iii)</enum><text>is being used by foreign business entities domiciled or by foreign business entities affiliated with or subsidiary to foreign business entities in the People's Republic of China.</text></clause></subparagraph></paragraph>
<paragraph display-inline="no-display-inline" commented="no" id="H7F04F67351254670947C3C9D1ECCA880"><enum>(2)</enum><text>develop recommendations for such legislative or administrative action as may be necessary—</text> <subparagraph display-inline="no-display-inline" commented="no" id="H48FA6430C03940E3AA1863DA8C856428"><enum>(A)</enum><text>to further incentivize industry participation in public-private partnerships for the purposes of accelerating technology research and commercialization, including alternate ways of accounting for in-kind contributions and value of partially manufactured products;</text></subparagraph>
<subparagraph display-inline="no-display-inline" commented="no" id="H2F1CA9F7E6AA40098D89B6D995139B33"><enum>(B)</enum><text>to ensure that intellectual property developed with Federal funding is commercialized in the United States; and</text></subparagraph> <subparagraph id="H41F13BBCC08241B0844DF1A1F002796E"><enum>(C)</enum><text>to ensure that intellectual property developed with Federal funding is not being used by foreign business entities or by foreign business entities affiliated with or subsidiary to foreign business entities domiciled in the People’s Republic of China; and </text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H77BA62F1E0C24277B9B291E49E8C9BA2"><enum>(3)</enum><text display-inline="yes-display-inline">submit to the Secretary of Commerce and Congress—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HD4E98C3F3E5249038C0CFD6B5D765287"><enum>(A)</enum><text display-inline="yes-display-inline">the findings of the Director of the Office of Science and Technology Policy with respect to the reviews conducted under paragraph (1); and</text></subparagraph>
<subparagraph id="HFA1E8A8123644673A2163097CDEABD37" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the recommendations developed under paragraph (2). </text></subparagraph></paragraph></subsection></section> <section id="H80CA5E9F0BA34396914CF1DDF1FD404C"><enum>11.</enum><header>Study on emerging science and technology challenges faced by the united states and recommendations to address them</header> <subsection id="HB18003DB4940402A9FF6897216FA673E"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote><short-title>National Strategy to Ensure American Leadership Act of 2021</short-title></quote> or the <quote><short-title>National SEAL Act of 2021</short-title></quote>.</text></subsection>
<subsection id="H3D2E55FC42B841DCAD92364E2464263A"><enum>(b)</enum><header>Study</header>
<paragraph id="HFDE2C6AE4A7846BF9F582685A3225FF0"><enum>(1)</enum><header>In general</header><text>The Secretary of Commerce (referred to in this section as the <quote>Secretary</quote>) shall seek to enter into an agreement with the National Academies of Sciences, Engineering, and Medicine to conduct a study—</text> <subparagraph id="HB94D12CB746B4EE3A3B0E73AC5F4C288"><enum>(A)</enum><text>to identify the 10 most critical emerging science and technology challenges facing the United States; and</text></subparagraph>
<subparagraph id="HEE378FE34B3D4E9D91180D4750E570B0"><enum>(B)</enum><text>to develop recommendations for legislative or administrative action to ensure United States leadership in matters relating to such challenges.</text></subparagraph></paragraph> <paragraph id="H79CBC77BDDB1463E8772D1F455732965"><enum>(2)</enum><header>Elements</header><text>The study conducted under paragraph (1) shall include identification, review, and evaluation of the following:</text>
<subparagraph id="H58428E83047C45FDA3D673CE799FA4BA"><enum>(A)</enum><text>Matters pertinent to identification of the challenges described in paragraph (1)(A).</text></subparagraph> <subparagraph id="HF88710D263954AC8A298A37B84351C27"><enum>(B)</enum><text>Matters relating to the recommendations developed under paragraph (1)(B), including with respect to education and workforce development necessary to address each of the challenges identified under paragraph (1)(A).</text></subparagraph>
<subparagraph id="H84735D2C123B48F98E1A051B97E5B7FC"><enum>(C)</enum><text>Matters related to the review of key technology areas by the Directorate for Technology and Innovation of the National Science Foundation under section 8A(d) of the National Science Foundation Act of 1950.</text></subparagraph> <subparagraph id="H603C2E9728CB4CCAADA9746C3ECE451D"><enum>(D)</enum><text>An assessment of the current relative balance in leadership in addressing the challenges identified in paragraph (1)(A) between the United States, allies or key partners of the United States, and the People’s Republic of China. </text></subparagraph></paragraph>
<paragraph id="H70916A7CA43941E187B4DDECB4D93B00"><enum>(3)</enum><header>Timeframe</header>
<subparagraph id="HB215834179174342991A806BDAC74EC7"><enum>(A)</enum><header>Agreement</header><text>The Secretary shall seek to enter into the agreement required by paragraph (1) on or before the date that is 60 days after the date of enactment of this Act.</text></subparagraph> <subparagraph id="H8BF0DDD03BE6430992C733F62A96E27C"><enum>(B)</enum><header>Findings</header><text>Under an agreement entered into under paragraph (1), the National Academies of Sciences, Engineering, and Medicine shall, not later than 1 year after the date on which the Secretary and the National Academies enter into such agreement, transmit to the Secretary the findings of the National Academies with respect to the study conducted pursuant to such agreement.</text></subparagraph></paragraph></subsection>
<subsection id="H7F1FBA1D7D4147DDAD5708F0FA505E32"><enum>(c)</enum><header>Report</header>
<paragraph id="H85ADA39F6B3543B68D8A184DF926AF7F"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date on which the Secretary receives the findings of the National Academies of Sciences, Engineering, and Medicine with respect to the study conducted under subsection (b), the Secretary shall submit to Congress a <quote>Strategy to Ensure American Leadership</quote> report on such study.</text></paragraph> <paragraph id="H5735869FEA8F41DEA193A291DBAA6706"><enum>(2)</enum><header>Contents</header><text>The report submitted under paragraph (1) shall include the following:</text>
<subparagraph id="H6B22DC432782413980D72747917407FD"><enum>(A)</enum><text>The findings of the National Academies of Sciences, Engineering, and Medicine with respect to the study conducted under subsection (b).</text></subparagraph> <subparagraph id="HB8341D622B1848D18EC5F4561AE09E2F"><enum>(B)</enum><text>The conclusions of the Secretary with respect to such findings.</text></subparagraph>
<subparagraph id="H0E05A402AEE8407AA77F4FF0C9620C9D"><enum>(C)</enum><text>The recommendations developed under subsection (b)(1)(B).</text></subparagraph> <subparagraph id="HC57D84653DCE4B1399262F0607975490"><enum>(D)</enum><text>Such other recommendations for legislative or administrative action as the Secretary may have with respect to such findings and conclusions.</text></subparagraph></paragraph>
<paragraph id="H941DFDE67692456ABB18A97AAA0412B1"><enum>(3)</enum><header>Classified annex</header><text>The report submitted under paragraph (1) shall be submitted in unclassified form, but may include a classified annex if the Secretary determines appropriate. </text></paragraph></subsection> <subsection id="HCEE6F45AE6154C7D923368C0F85CA91F"><enum>(d)</enum><header>Information from federal agencies</header> <paragraph id="HF41C84C5C12A4EDF9BF5E708D317F97C"><enum>(1)</enum><header>In general</header><text>The National Academies of Sciences, Engineering, and Medicine may secure directly from a Federal department or agency such information as the National Academies of Sciences, Engineering, and Medicine consider necessary to carry out the study under subsection (b).</text></paragraph>
<paragraph id="H600F19CD2EAC45DFAC3AC904CC2A32DB" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Furnishing information</header><text>On request of the National Academies of Sciences, Engineering, and Medicine for information, the head of the department or agency shall furnish such information to the National Academies of Sciences, Engineering, and Medicine. </text></paragraph></subsection> <subsection id="H24ADE30DAB164021AC3F3A39F94FDC57"><enum>(e)</enum><header>Consultation</header><text>The Secretary of Defense and the Director of National Intelligence shall provide support upon request from the Secretary of Commerce or the National Academies to carry out this section.</text></subsection>
<subsection id="HFDECC2DD093B4F7C8D5E25E8F518191F"><enum>(f)</enum><header>Non-Duplication of effort</header><text>In carrying out subsection (b), the Secretary shall, to the degree practicable, coordinate with the steering committee established under section 236(a) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>).</text></subsection></section> <section id="H2E98AFD5C0F8454E8CBAA34CC1D54C78"><enum>12.</enum><header>Coordination of activities</header><text display-inline="no-display-inline">The Director of the Office of Science and Technology Policy, the Director of the National Economic Council, the Director of the Office of Management and Budget, the Director of the National Science Foundation, the Secretary of Commerce, and the Secretary of Energy shall, as applicable, coordinate with respect to activities of—</text>
<paragraph id="H6AF6E18E05B84625BF39162DC3B3E22D"><enum>(1)</enum><text display-inline="yes-display-inline">the university technology centers established under section 8A(d)(6) of the National Science Foundation Act of 1950;</text></paragraph> <paragraph id="HCF4D78C959AD409AB4AE06A85E3180FB"><enum>(2)</enum><text display-inline="yes-display-inline">the regional technology hubs under section 28 of the Stevenson-Wydler Technology Innovation Act of 1980, as added by section 7;</text></paragraph>
<paragraph id="HF24B86EE6BAB46939D5182E5C493533F"><enum>(3)</enum><text>the Manufacturing USA Program established under section 34(b)(1) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(b)(1)</external-xref>);</text></paragraph> <paragraph id="HD0E8065802D24D718552727DF86A2207"><enum>(4)</enum><text>Federally funded research and development centers;</text></paragraph>
<paragraph id="HD23BA6506DC446798EEA575D5F924D2C"><enum>(5)</enum><text>National Laboratories, as defined in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>); and</text></paragraph> <paragraph id="HDAF3F369C61243EBA3BBD93187C84C50"><enum>(6)</enum><text>Federal laboratories, as defined in section 4 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3703">15 U.S.C. 3703</external-xref>). </text></paragraph></section>
<section id="HCE7E3073D42E4EFEBEC293560A116FA2"><enum>13.</enum><header>Person or entity of concern prohibition</header><text display-inline="no-display-inline">No person published on the list under section 1237(b) of the Strom Thurmond National Defense Authorization Act for Fiscal Year 1999 (<external-xref legal-doc="public-law" parsable-cite="pl/105/261">Public Law 105–261</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) or entity identified under section 1260H of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) may receive or participate in any grant, award, program, support, or other activity under—</text> <paragraph id="H9DBFB6B2790A42549C6FBB3B0B1313A5"><enum>(1)</enum><text>section 8A of the National Science Foundation Act of 1950 (<external-xref legal-doc="public-law" parsable-cite="pl/81/507">Public Law 81–507</external-xref>), as added by section 3;</text></paragraph>
<paragraph id="H3C5EC6999399407A930319E556241CAD"><enum>(2)</enum><text>the Endless Frontier Fund under section 4;</text></paragraph> <paragraph id="H5F0C8FFFDDF14F95992138052B0F5FBD"><enum>(3)</enum><text>the supply chain resiliency program under section 6;</text></paragraph>
