which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, <committee-name committee-id="HAS00">Armed Services</committee-name>, and <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Committee on Foreign Investment in the United States to review any purchase or lease of real estate near a military installation or military airspace in the United States by a foreign person connected to, or subsidized by, the Russian Federation, the People’s Republic of China, the Islamic Republic of Iran, or the Democratic People’s Republic of Korea, and for other purposes.</official-title></form><legis-body id="HBF5BAC960D8541849DF6C26C7D343855" style="OLC"><section id="H55B8932CB0434F38959F025C3058B719" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Military Installations from Foreign Espionage Act</short-title></quote>.</text></section><section id="HB61140D9087C4AB3AE8FF25499ED0962"><enum>2.</enum><header>Review by Committee on Foreign Investment in the United States of real estate purchases or leases near military installations or military airspace</header><subsection id="H062FEE79390C44FE84EC82B2D5D7D60A"><enum>(a)</enum><header>Inclusion in definition of covered transaction</header><text display-inline="yes-display-inline">Section 721(a)(4) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(a)(4)</external-xref>) is amended—</text><paragraph id="H88E2EA92B5E94F21A86AAE2F3F88CC1F"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><subparagraph id="HEA168F2AB85E4997BE72FBA2283F485F"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="HD7D036DF4ACD476A90CA5A2E7CAC9EBD"><enum>(B)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H3B1E5FFC1A404018B24EDB3812250032"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H91404A08C37346E8AC9F9B1B9F0DCF91"><clause id="H2E1C6754DD47456198758B7B04771F32"><enum>(iii)</enum><text display-inline="yes-display-inline">any transaction described in subparagraph (B)(vi) that is proposed, pending, or completed on or after the date of the enactment of the Protecting Military Installations from Foreign Espionage Act.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H2B22FC0719D144A480161262DDD94A37"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB55DEB041AD74AEDB7702581F2FF9E4E"><clause id="HAB6ADF49663D40CDA5373B5FC4CC067F"><enum>(vi)</enum><text>Notwithstanding clause (ii) or subparagraph (C), the purchase or lease by, or a concession to, a foreign person of private or public real estate—</text><subclause id="HDF337BB4BD9C43DF8C828FA79BD93F3C"><enum>(I)</enum><text>that is located in the United States and within—</text><item commented="no" display-inline="no-display-inline" id="HB9CB7C3DB3ED454294A6A75408F4BDB4"><enum>(aa)</enum><text display-inline="yes-display-inline">100 miles of a military installation (as defined in section 2801(c)(4) of title 10, United States Code); or </text></item><item commented="no" display-inline="no-display-inline" id="H2CD44E2A586E4D81B2DAACBACA0D488F"><enum>(bb)</enum><text display-inline="yes-display-inline">50 miles of—</text><subitem commented="no" display-inline="no-display-inline" id="H2CB901490A764E79892E3255A86BA8C8"><enum>(AA)</enum><text display-inline="yes-display-inline">a military training route (as defined in section 183a(h) of title 10, United States Code);</text></subitem><subitem commented="no" display-inline="no-display-inline" id="H80D4A0CB472044BB845D4767AE7D0490"><enum>(BB)</enum><text display-inline="yes-display-inline">airspace designated as special use airspace under part 73 of title 14, Code of Federal Regulations (or a successor regulation), and managed by the Department of Defense; </text></subitem><subitem commented="no" display-inline="no-display-inline" id="HAF34B5630D9B4559BA8824ACC677DAC9"><enum>(CC)</enum><text display-inline="yes-display-inline">a controlled firing area (as defined in section 1.1 of title 14, Code of Federal Regulations (or a successor regulation)) used by the Department of Defense; or</text></subitem><subitem display-inline="no-display-inline" commented="no" id="H17D11912A1A144ACAAA0CE8808E3FA7F"><enum>(DD)</enum><text>a military operations area (as defined in section 1.1 of title 14, Code of Federal Regulations (or a successor regulation)); and</text></subitem></item></subclause><subclause display-inline="no-display-inline" commented="no" id="HE03E8820C1BB438E85D287CFAF3229BD"><enum>(II)</enum><text>if the foreign person is owned or controlled by, is acting for or on behalf of, or receives subsidies from—</text><item display-inline="no-display-inline" commented="no" id="H3E319845450A4846A4CA5058F3B26E12"><enum>(aa)</enum><text>the Government of the Russian Federation;</text></item><item display-inline="no-display-inline" commented="no" id="H69CAFA66A3614FCCB2A3E20B55C51B44"><enum>(bb)</enum><text>the Government of the People’s Republic of China;</text></item><item display-inline="no-display-inline" commented="no" id="H825FE3ECD2DD4CAF93E631AF0939714C"><enum>(cc)</enum><text>the Government of the Islamic Republic of Iran; or</text></item><item display-inline="no-display-inline" commented="no" id="H3AE98F814A394696B1B788B5ABE8EB2D"><enum>(dd)</enum><text>the Government of the Democratic People’s Republic of Korea.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBF4A575085B64703B7774E612448E74D"><enum>(b)</enum><header>Mandatory unilateral initiation of reviews</header><text>Section 721(b)(1)(D) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(b)(1)(D)</external-xref>) is amended—</text><paragraph id="HDD9B3C09DFF143D69CD2DA14F3879FD3"><enum>(1)</enum><text>in clause (iii), by redesignating subclauses (I), (II), and (III) as items (aa), (bb), and (cc), respectively, and by moving such items, as so redesignated, 2 ems to the right;</text></paragraph><paragraph id="HBDDFFEE01E93445FAFECF6BACA49CF19"><enum>(2)</enum><text>by redesignating clauses (i), (ii), and (iii) as subclauses (I), (II), and (III), respectively, and by moving such subclauses, as so redesignated, 2 ems to the right;</text></paragraph><paragraph id="H5FF1BF6A96F44A5DA5144E4EB6289CCA"><enum>(3)</enum><text>by striking <quote>Subject to</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H14A3FE4BBA0B422A8A4D6ABE1771D42F"><clause id="H611A9B612C394ECFA2622D9DB3F4AD21"><enum>(i)</enum><header>In general</header><text>Subject to</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HE4C74D76809E4AA28285E97BFA8556FD"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC201A19CF58D47DEAF9996A64CA68439"><clause id="HBE480FA52A3E4D358A7076BBCD511834"><enum>(ii)</enum><header>Mandatory unilateral initiation of certain transactions</header><text>The Committee shall initiate a review under subparagraph (A) of a covered transaction described in subsection (a)(4)(B)(vi).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H47D2D363135148488CAF8A3B17B3CECC"><enum>(c)</enum><header>Certifications to Congress</header><text>Section 721(b)(3)(C)(iii) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(b)(3)(C)(iii)</external-xref>) is amended—</text><paragraph id="H904E0FD8615A4DCFBC649DB247DB3E68"><enum>(1)</enum><text>in subclause (IV), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="H29422E8546C747639AAEC6A6E618ECC7"><enum>(2)</enum><text>in subclause (V), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H41C899470CFF44B68B03C772EAAF40FC"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA19706A66B2F4682AECFE946CB742295"><subclause id="H7E87450D9B67417AB530A9BDD154113C"><enum>(VI)</enum><text>with respect to covered transactions described in subsection (a)(4)(B)(vi), to the members of the Senate from the State in which the military installation, military training route, special use airspace, controlled firing area, or military operations area is located, and the member from the Congressional District in which such installation, route, airspace, or area is located.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HCC57E19016E043E5961D6AD92E677E9F"><enum>3.</enum><header>Limitation on approval of energy projects related to reviews conducted by Committee on Foreign Investment in the United States</header><subsection id="H106617D2C1E245009067E61B67C266DF"><enum>(a)</enum><header>Review by Secretary of Defense</header><text display-inline="yes-display-inline">Section 183a of title 10, United States Code, is amended—</text><paragraph id="H7F35626C627647B6BBDC3ECE501AA419"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (f), (g), and (h) as subsections (g), (h), and (i), respectively; and</text></paragraph><paragraph id="H563E8C7D9EB942EAB9679D8A080EF2B0"><enum>(2)</enum><text>by inserting after subsection (e) the following new subsection (f):</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC83DF05A111D4C968649A380E615E06F"><subsection id="HC531A7220D4848C89E2F7180FEC8C3AF"><enum>(f)</enum><header>Special rule relating to review by Committee on Foreign Investment of the United States</header><paragraph commented="no" display-inline="yes-display-inline" id="H5482A174E8ED412C90CEE7D12A0BBEA4"><enum>(1)</enum><text>If, during the period during which the Department of Defense is reviewing an application for an energy project filed with the Secretary of Transportation under section 44718 of title 49, the purchase, lease, or concession of real property on which the project is planned to be located is under review or investigation by the Committee on Foreign Investment in the United States under section 721 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565</external-xref>), the Secretary of Defense—</text><subparagraph id="HD3338C1603C94531A87FAA00A8BEA94A" indent="up1"><enum>(A)</enum><text>may not complete review of the project until the Committee concludes action under such section 721 with respect to the purchase, lease, or concession; and</text></subparagraph><subparagraph id="H0AA8709129F34A7DAD00C8CD73FF1F0F" indent="up1"><enum>(B)</enum><text>shall notify the Secretary of Transportation of the delay.</text></subparagraph></paragraph><paragraph id="H50F31E3CEF434A0C8FE489A93300F3F0" indent="up1"><enum>(2)</enum><text>If the Committee on Foreign Investment in the United States determines that the purchase, lease, or concession of real property on which an energy project described in paragraph (1) is planned to be located threatens to impair the national security of the United States and refers the purchase, lease, or concession to the President for further action under section 721(d) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(d)</external-xref>), the Secretary of Defense shall—</text><subparagraph id="HCDD5C3D343BD43E38E964A7BB65917F7"><enum>(A)</enum><text>find under subsection (e)(1) that the project would result in an unacceptable risk to the national security of the United States; and</text></subparagraph><subparagraph id="H9AE0D481FC6C4BAF96DDB424A6B6CF6F"><enum>(B)</enum><text>transmit that finding to the Secretary of Transportation for inclusion in the report required under section 44718(b)(2) of title 49.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9738F7A73FE649198E6E980885CF42F2"><enum>(b)</enum><header>Review by Secretary of Transportation</header><text>Section 44718 of title 49, United States Code, is amended—</text><paragraph id="H5C7830B7BCD94D61B4D2292153D19B8C"><enum>(1)</enum><text>by redesignating subsection (h) as subsection (i); and</text></paragraph><paragraph id="H47D3B877BE244086A41A5D166A2F80AF"><enum>(2)</enum><text>by inserting after subsection (g) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE467807F63E84505975170500D05A7C2"><subsection id="H8C4A99D87E234A6184A0A46E8070591B"><enum>(h)</enum><header>Special rule relating to review by Committee on Foreign Investment of the United States</header><text>The Secretary of Transportation may not issue a determination pursuant to this section with respect to a proposed structure to be located on real property the purchase, lease, or concession of which is under review or investigation by the Committee on Foreign Investment in the United States under section 721 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565</external-xref>) until—</text><paragraph id="HB18CB773BB7A41D2B1BB1DBD54679AB5"><enum>(1)</enum><text>the Committee concludes action under such section 721 with respect to the purchase, lease, or concession; and</text></paragraph><paragraph id="H30E9268496BE496F9BAADAE594E97A1F"><enum>(2)</enum><text>the Secretary of Defense—</text><subparagraph id="H3DF7751554264527B44D97EFFE049648"><enum>(A)</enum><text>issues a finding under section 183a(e) of title 10; or </text></subparagraph><subparagraph id="H8CA7399170A548EBBFE0DC30022D46D0"><enum>(B)</enum><text>advises the Secretary of Transportation that no finding under section 183a(e) of title 10 will be forthcoming.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
