R. 2722</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210421">April 21, 2021</action-date><action-desc><sponsor name-id="C001090">Mr. Cartwright</sponsor> (for himself, <cosponsor name-id="K000391">Mr. Krishnamoorthi</cosponsor>, <cosponsor name-id="K000389">Mr. Khanna</cosponsor>, <cosponsor name-id="C001110">Mr. Correa</cosponsor>, <cosponsor name-id="M001163">Ms. Matsui</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, and <cosponsor name-id="C001068">Mr. Cohen</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to require local educational agencies to implement a policy on allergy bullying in schools, and for other purposes.</official-title></form><legis-body id="HF9D61FA1576B4192808B2065ACF8213D" style="OLC"><section id="H1BE990453E4E400787B29F88EA3D433B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alerting Local Leaders and Ensuring Responsible Guidelines for Youth Act</short-title></quote> or the <quote><short-title>ALLERGY Act</short-title></quote>.</text></section><section id="H70949C201B9840FF81C61FABB705B61A"><enum>2.</enum><header>Requirement for policies on allergy-related bullying</header><text display-inline="no-display-inline">Part F of title VIII of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7901">20 U.S.C. 7901</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HC52A951CF00044898BA8AC72BA263515" style="OLC"><subpart id="H68416B40FFD44D73B79D809E4D836E75"><enum>6</enum><header>Policies on Allergy Bullying</header><section id="HD92F2C3297BF472CAA72FE90AAD1ED01"><enum>8581.</enum><header>Requirements</header><subsection id="H5FA24427095B4E6EB459B54D59C5A160"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">As a condition of receiving funds under this Act, a local educational agency shall establish and implement a policy on allergy bullying in the schools served by the local educational agency, which, at a minimum, requires that each such school—</text><paragraph id="HD7253E75FF1F49EF927B659F6DCA5EDB"><enum>(1)</enum><text display-inline="yes-display-inline">educate students, school personnel, and parents about allergy bullying, and that such bullying is against the rules of the school;</text></paragraph><paragraph id="H5588D3AEBEBB4167ADE09952F6BABEBE"><enum>(2)</enum><text>clearly define what the punishment or response may be for a violation of the rule against allergy bullying, which may include a therapeutic response, where appropriate;</text></paragraph><paragraph id="HAABB895439B34D268E912F45D69BF6A6"><enum>(3)</enum><text>have in effect policies and procedures that encourage each victim of allergy bullying to report such bullying to school personnel; and</text></paragraph><paragraph id="H65EC1517724E4FF094AAC4A95B429D19"><enum>(4)</enum><text>in carrying out the requirements of paragraphs (1) through (3), is in compliance with the requirements of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400</external-xref> et seq.) and the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101</external-xref> et seq.).</text></paragraph></subsection><subsection commented="no" id="HCEB59D7A253842F59AF2A08DDD0E4F53"><enum>(b)</enum><header>Certification</header><text>As a condition of receiving funds under this Act, a local educational agency shall certify in writing not later than October 1 of each year to the State educational agency involved that the local educational agency has established and implemented the policy described in subsection (a). The State educational agency shall report to the Secretary not later than November 1 of each year a list of those local educational agencies that have not filed a certification or against which complaints have been made to the State educational agency that the local educational agency is not in compliance with this section.</text></subsection><subsection id="H84E1291A405641B2A6137DA7B59EC0BC"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>allergy bullying</term> means unwanted, aggressive behavior by a student toward another student with an allergy and includes—</text><paragraph id="H4CB295C08CBE49479B2DEFE8733C5FD6"><enum>(1)</enum><text>a real or perceived imbalance of power due to such other student’s allergy, such as physical strength, access to embarrassing information, or popularity, to control or harm such other student; and</text></paragraph><paragraph id="H14BC16B5B4A84B2885AC28754C7CCB97"><enum>(2)</enum><text>actions such as making threats, spreading rumors, physical or verbal attacks, and excluding such other student from a group on purpose.</text></paragraph></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1296D408108847A3BCDB7B6C03A07FD6"><enum>3.</enum><header>Table of contents</header><text display-inline="no-display-inline">The table of contents for the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301</external-xref> et seq.) is amended by inserting after the item relating to section 8574, the following:</text><quoted-block display-inline="no-display-inline" id="HD1D97081533E48E4AD47D94CF6A3F231" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="subpart">Subpart 6—Policies on Allergy Bullying </toc-entry><toc-entry level="section">Sec. 8581.
