subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ensure that certain loan programs of the Small Business Administration are made available to cannabis-related legitimate businesses and service providers, and for other purposes.</official-title></form><legis-body id="HFC6EA7DDA4D74C1F8A1A12B509A9745F" style="OLC"><section commented="no" id="HB11D8E200D0443C999C80A06CE09314C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Safe Capital Access for All Small Businesses Act of 2021</short-title></quote>.</text></section><section id="HE0FAA58BF61F4E76AD1C9530E15293A5"><enum>2.</enum><header>Decriminalization of cannabis</header><subsection id="H4E9E8529B2B94418B4C0E49764D36DF5"><enum>(a)</enum><header>Cannabis removed from schedule of controlled substances</header><text>Subsection (c) of schedule I of section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812</external-xref>) is amended—</text><paragraph id="HC63F013B3EA340F5B366AB376FDA1813"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (10) (relating to marihuana); and</text></paragraph><paragraph id="HA629E2593AF24C50ACB7F8EAEF4E98F5"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (17) (relating to terahydrocannabinols).</text></paragraph></subsection><subsection id="H4779E27FB50240DBAC9409873FC3CFFA"><enum>(b)</enum><header>Conforming amendments to Controlled Substances Act</header><text>The Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.) is amended—</text><paragraph id="H6468FD1B2A304AEABCDD9D9927D30BA6"><enum>(1)</enum><text>in section 102(44) (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(44)</external-xref>), by striking <quote>marihuana,</quote>;</text></paragraph><paragraph id="HF84A429681EA4004A3C3A1B3E464BECE"><enum>(2)</enum><text>in section 401(b) (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)</external-xref>)—</text><subparagraph id="HBCBE9447AAB74571A9351AD1EB6DADEB"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H81E8FC972580445E814098BED6C8F50B"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="H0236FB6025E141858C84BC52BF48F5FB"><enum>(I)</enum><text>in clause (vi), by inserting <quote>or</quote> after the semicolon;</text></subclause><subclause id="H32D66A159BFB4A9CAC666D407BCA1663"><enum>(II)</enum><text>by striking (vii); and</text></subclause><subclause id="H66D4BB653B414A5A8627E013C7A95125"><enum>(III)</enum><text>by redesignating clause (viii) as clause (vii);</text></subclause></clause><clause id="H5D1AFBA6F5D44612A903C8574C16230F"><enum>(ii)</enum><text>in subparagraph (B)—</text><subclause <quote>marihuana,</quote>;</text></paragraph><paragraph id="H13CD8841B4CB4E0FBFF2FE89BE5B90E4"><enum>(4)</enum><text>in section 403(d)(1) (<external-xref legal-doc="usc" parsable-cite="usc/21/843">21 U.S.C. 843(d)(1)</external-xref>), by striking <quote>marihuana,</quote>;</text></paragraph><paragraph id="HAC1CD925764149D189CFA2FC1045251C"><enum>(5)</enum><text>in section 418(a) (<external-xref legal-doc="usc" parsable-cite="usc/21/859">21 U.S.C. 859(a)</external-xref>), by striking the last sentence;</text></paragraph><paragraph id="HD06EC45DC2804A1387A8FE4CCC1F8C52"><enum>(6)</enum><text>in section 419(a) (<external-xref legal-doc="usc" parsable-cite="usc/21/860">21 U.S.C. 860(a)</external-xref>), by striking the last sentence;</text></paragraph><paragraph id="H2EF736D81D4742FBA4828061C927EBB5"><enum>(7)</enum><text>in section 422(d) (<external-xref legal-doc="usc" parsable-cite="usc/21/863">21 U.S.C. 863(d)</external-xref>)—</text><subparagraph id="H723BD882105F42FEBF0AA319419651E2"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>marijuana,</quote>; and</text></subparagraph><subparagraph id="HB691B59521A9467FBBCFCEE650E088AD"><enum>(B)</enum><text>in paragraph (5), by striking <quote>, such as a marihuana cigarette,</quote>; and</text></subparagraph></paragraph><paragraph id="HB54AA3E0D52F47BDB159D6B012B6DA1D"><enum>(8)</enum><text>in section 516(d) (<external-xref legal-doc="usc" parsable-cite="usc/21/886">21 U.S.C. 886(d)</external-xref>), by striking <quote>section 401(b)(6)</quote> each place the term appears and inserting <quote>section 401(b)(5)</quote>.</text></paragraph></subsection><subsection id="HB2334ABBCA5E461C8069EAA1F0F58047"><enum>(c)</enum><header>Other conforming amendments</header><paragraph id="H7EA09DBBB3AB4D54B89FF44C1E159E17"><enum>(1)</enum><header>National Forest System Drug Control Act of 1986</header><text>The National Forest System Drug Control Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/559b">16 U.S.C. 559b</external-xref> et seq.) is amended—</text><subparagraph id="H1A71DB3053934816BF86E4138E0991CB"><enum>(A)</enum><text>in section 15002(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/559b">16 U.S.C. 559b(a)</external-xref>) by striking <quote>marijuana and other</quote>;</text></subparagraph><subparagraph id="H666F56CF8C9F4B7DB88625FBC40AA779"><enum>(B)</enum><text>in section 15003(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/559c">16 U.S.C. 559c(2)</external-xref>) by striking <quote>marijuana and other</quote>; and</text></subparagraph><subparagraph id="H380830795B294746B6B871A4EF47D384"><enum>(C)</enum><text>in section 15004(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/559d">16 U.S.C. 559d(2)</external-xref>) by striking <quote>marijuana and other</quote>.</text></subparagraph></paragraph><paragraph id="H43322AF46B264A33A967B75CA7BB1033"><enum>(2)</enum><header>Interception of communications</header><text>Section 2516 of title 18, United States Code, is amended—</text><subparagraph id="H29E082B1D80647EA854F725CF297C646"><enum>(A)</enum><text>in subsection (1)(e), by striking <quote>, marihuana,</quote>; and</text></subparagraph><subparagraph id="H571FE3C902964FC7ADA51BC96712FA8C"><enum>(B)</enum><text>in subsection (2) by striking <quote>marihuana</quote>.</text></subparagraph></paragraph></subsection></section><section id="HED6E2CC946F747B2964ED3A4F5BB91D2" section-type="subsequent-section"><enum>3.</enum><header>7<enum-in-header>(a)</enum-in-header> loans to cannabis-related legitimate businesses and service providers</header><text display-inline="no-display-inline">Section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H4D188848F853474E9390A3D8D2039827" style="OLC"><paragraph id="H25BCC81DD93343C1A6ADEA207D13F94C"><enum>(38)</enum><header>Loans to cannabis-related legitimate businesses and service providers</header><subparagraph id="H2659AA185B65474E85BE0BED77F154DE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may not decline to provide a guarantee for a loan under this subsection, and a lender may not decline to make a loan made under this subsection, to an otherwise eligible small business concern solely because such concern is a cannabis-related legitimate business or service provider.</text></subparagraph><subparagraph id="H0C500A85CE734F1EAA012C01B0B625C2"><enum>(B)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="HC5F4D931041C4C1A85762BE01B46BC4F"><enum>(i)</enum><header>Cannabis</header><text display-inline="yes-display-inline">The term <term>cannabis</term> has the meaning given the term <term>marihuana</term> in section 102 of the Controlled Substances Act.</text></clause><clause id="H67E3E6542D41479889E32A97A94D5230"><enum>(ii)</enum><header>Cannabis product</header><text>The term <term>cannabis product</term> means any article which contains cannabis, including an article which is a concentrate, an edible, a tincture, a cannabis-infused product, or a topical.</text></clause><clause id="HC100848780F749DF81A1040DBAA747A0"><enum>(iii)</enum><header>Cannabis-related legitimate business</header><text display-inline="yes-display-inline">The term <term>cannabis-related legitimate business</term> means a manufacturer, producer, or any person or company that is a small business concern and that—</text><subclause id="HAD66327180BF43C3BB490A30380BD08A"><enum>(I)</enum><text>engages in any activity described in subclause (II) pursuant to a law established by a State or a political subdivision of a State, as determined by such State or political subdivision; and</text></subclause><subclause id="HAA28C0C1858B4983B5B82CE275E2D08B"><enum>(II)</enum><text>participates in any business or organized activity that involves handling cannabis or cannabis products, including cultivating, producing, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing cannabis or cannabis products.</text></subclause></clause><clause id="H2FFA2241DDAB4A3EB899CD6F63533FCE"><enum>(iv)</enum><header>Manufacturer</header><text display-inline="yes-display-inline">The term <term>manufacturer</term> means a person who manufactures, compounds, converts, processes, prepares, or packages cannabis or cannabis products.</text></clause><clause id="H7111DA9A26F04CAFA88D3280B280F922"><enum>(v)</enum><header>Producer</header><text>The term <term>producer</term> means a person who plants, cultivates, harvests, or in any way facilitates the natural growth of cannabis.</text></clause><clause id="HA54EF2C9A8A04BA28B2C7E5942691845"><enum>(vi)</enum><header>Service provider</header><text display-inline="yes-display-inline">The term <term>service provider</term>—</text><subclause id="H313A1CF1630A41BA87B16E81AD113172"><enum>(I)</enum><text>means a business, organization, or other person that—</text><item id="H8370807C9E9C4A038249132E8AE389E1"><enum>(aa)</enum><text>sells goods or services to a cannabis-related legitimate business; or</text></item><item id="H3C763D06BE2641329E1E8A1AE831B931"><enum>(bb)</enum><text>provides any business services, including the sale or lease of real or any other property, legal or other licensed services, or any other ancillary service, relating to cannabis; and</text></item></subclause><subclause id="H3F0D21019C5F4862BBDBB24F455A9352"><enum>(II)</enum><text>does not include a business, organization, or other person that participates in any business or organized activity that involves handling cannabis or cannabis products, including cultivating, producing, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing cannabis or cannabis products.</text></subclause></clause><clause id="H607B6A495A964BA4AB00D5DBDE617979"><enum>(vii)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, Puerto Rico, and any territory or possession of the United States.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H141E3809240B44B2811BDF16D5225BFF"><enum>4.</enum><header>Disaster loans to cannabis-related legitimate businesses and service providers</header><text display-inline="no-display-inline">Section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) is amended by inserting after paragraph (15) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H79A40D2B5EEE4D65913CD34ECF5EB99B" style="OLC"><paragraph id="HF7FC2963084A42B2805938756F8E738D"><enum>(16)</enum><header>Assistance to cannabis-related legitimate businesses and service providers</header><text display-inline="yes-display-inline">The Administrator may not decline to provide assistance under this subsection to an otherwise eligible borrower solely because such borrower is a cannabis-related legitimate business or service provider (as defined in subsection (a)(38)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H29DADEC8CE84411D9AABE03CDE101D40"><enum>5.</enum><header>Microloans to cannabis-related legitimate businesses and service providers</header><text display-inline="no-display-inline">Section 7(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)(13)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H53A49D23FD3E41C5B58D9B414E6E5D65" style="OLC"><paragraph id="HE21CFF7E3A1640249EA9AA87DD58A1FD"><enum>(14)</enum><header>Assistance to cannabis-related legitimate businesses and service providers</header><text display-inline="yes-display-inline">The Administrator may not decline to make a loan or a grant under this subsection, and an eligible intermediary may not decline to provide assistance under this subsection to an otherwise eligible borrower, eligible intermediary, or eligible nonprofit entity (as applicable) solely because such borrower, intermediary, or nonprofit entity is a cannabis-related legitimate business or service provider (as defined in subsection (a)(38)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3142C9B0D84B477DB48597C63156A3E4"><enum>6.</enum><header>Small business investment company debentures to finance cannabis-related legitimate businesses and service providers</header><text display-inline="no-display-inline">Part A of title III of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/681">15 U.S.C. 681</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="HB9C2910FE8344E538BEA80E3DF8F7A95" display-inline="no-display-inline"><section id="HEF21D76D06DD437FACF11CE5ED3599AA"><enum>321.</enum><header>Debentures to finance cannabis-related legitimate businesses and service providers</header><subsection id="H6AAE333964E041D981447B8416295D35"><enum>(a)</enum><header>Guarantees</header><text display-inline="yes-display-inline">The Administrator may not decline to purchase or guarantee a debenture made under this title to an otherwise eligible small business investment company solely because such small business investment company provides financing to an entity that is a cannabis-related legitimate business or service provider (as defined in section 7(a)(38) of the Small Business Act).</text></subsection><subsection id="H1015FF74173C4C698005BB2921298036"><enum>(b)</enum><header>Other assistance</header><text display-inline="yes-display-inline">A small business investment company may not decline to provide assistance under this title to an otherwise eligible small business concern solely because such small business concern is a cannabis-related legitimate business or service provider (as defined in section 7(a)(38) of the Small Business Act).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H20C856920540438EB36B49C9E3404CDA"><enum>7.</enum><header>State or local development company loans to finance cannabis-related legitimate businesses and service providers</header><text display-inline="no-display-inline">Title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HD8EDEFBEF05743E387F998C551514273" style="OLC"><section id="H2D5863FA946B4BE69B592F2979DA0704"><enum>511.</enum><header>Loans to finance cannabis-related legitimate businesses and service providers</header><subsection id="HD29E38E5790B40DDBEAD142E04F254B7"><enum>(a)</enum><header>Loans and loan guarantees</header><text display-inline="yes-display-inline">The Administrator may not decline to make or provide a guarantee for a loan under this title to an otherwise eligible qualified State or local development company solely because such qualified State or local development company provides financing to an entity that is a cannabis-related legitimate business or service provider (as defined in section 7(a)(38) of the Small Business Act).</text></subsection><subsection id="HF8A7B7B96992425895D0342C6DA98AC0"><enum>(b)</enum><header>Other assistance</header><text display-inline="yes-display-inline">A qualified State or local development company may not decline to provide assistance under this title to an otherwise eligible small business concern solely because such small business concern is a cannabis-related legitimate business or service provider (as defined in section 7(a)(38) of the Small Business Act).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="H21A8936EAFFD4536971AC16D93511DA0"><enum>8.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, the Administrator of the Small Business Administration shall issue or amend any rules, standard operating procedures, other legal or policy guidance necessary to carry out the requirements of this Act and the amendments made by this Act.</text></section></legis-body></bill>
