which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To increase transparency with respect to financial services benefitting state sponsors of terrorism, human rights abusers, and corrupt officials, and for other purposes.</official-title></form><legis-body id="H9C99A90D61EB4B8291221012FD724F3B" style="OLC"><section commented="no" id="H765F3B38DAFF4A96B60D305512D608F9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Banking Transparency for Sanctioned Persons Act of 2021</short-title></quote>.</text></section><section id="H2B009CAD66124B64B02D548365ED7BFD" section-type="subsequent-section"><enum>2.</enum><header>Report on financial services benefitting state sponsors of terrorism, human rights abusers, and corrupt officials</header><subsection id="H9FA7D68906BA49B4B0D8DCFDC70C71F7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and every 180 days thereafter, the Secretary of the Treasury shall issue a report to the Committees on Financial Services and Foreign Affairs of the House of Representatives and the Committees on Banking, Housing, and Urban Affairs and Foreign Relations of the Senate that includes—</text><paragraph id="H632DF69E51724288835A766A2A3F26FB"><enum>(1)</enum><text display-inline="yes-display-inline">a copy of any license issued by the Secretary in the preceding 180 days that authorizes a financial institution to provide financial services benefitting a state sponsor of terrorism; and</text></paragraph><paragraph id="HC646A4FCC23F4EFA81B3C2BCB49CEB8E"><enum>(2)</enum><text display-inline="yes-display-inline">a list of any foreign financial institutions that, in the preceding 180 days, knowingly conducted a significant transaction or transactions, directly or indirectly, for a sanctioned person included on the Department of the Treasury’s Specially Designated Nationals And Blocked Persons List who—</text><subparagraph id="HECB9301187914ABFB3B7F8B54E42D763"><enum>(A)</enum><text display-inline="yes-display-inline">is owned or controlled by, or acts on behalf of, the government of a state sponsor of terrorism; or</text></subparagraph><subparagraph id="H7D5BF68DF78B445898256EFABA082E4C"><enum>(B)</enum><text>is designated pursuant to any of the following:</text><clause id="HEDF4D44B3ECF42718AC52BFB8899A502"><enum>(i)</enum><text>Section 404 of the Russia and Moldova Jackson-Vanik Repeal and Sergei Magnitsky Rule of Law Accountability Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/208">Public Law 112–208</external-xref>).</text></clause><clause id="H089A0934CDA44927AD536E5196AEAC6D"><enum>(ii)</enum><text display-inline="yes-display-inline">Subtitle F of title XII of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>, the Global Magnitsky Human Rights Accountability Act).</text></clause><clause id="HC7E2FCDEB6534FD5AE55B286742958A1"><enum>(iii)</enum><text>Executive Order No. 13818.</text></clause></subparagraph></paragraph></subsection><subsection id="HB0F0BFBCBE25467C97CF5929DFDF5332"><enum>(b)</enum><header>Form of report</header><text display-inline="yes-display-inline">The report required under subsection (a) shall be submitted in unclassified form but may contain a classified annex.</text></subsection></section><section id="H527763F69FE8479BA624CCB3298DDF0D"><enum>3.</enum><header>Waiver</header><text display-inline="no-display-inline">The Secretary of the Treasury may waive the requirements of section 2 with respect to a foreign financial institution described in paragraph (2) of such section—</text><paragraph id="H158F203A7F0E4061BB07E46B8C418E24"><enum>(1)</enum><text>upon receiving credible assurances that the foreign financial institution has ceased, or will imminently cease, to knowingly conduct any significant transaction or transactions, directly or indirectly, for a person described in subparagraph (A) or (B) of such paragraph (2); or</text></paragraph><paragraph id="HB2C4A74665B44642B59F928EC32ED2E0"><enum>(2)</enum><text display-inline="yes-display-inline">upon certifying to the Committees on Financial Services and Foreign Affairs of the House of Representatives and the Committees on Banking, Housing, and Urban Affairs and Foreign Relations of the Senate that the waiver is important to the national interest of the United States, with an explanation of the reasons therefor.</text></paragraph></section><section id="H0D92C90D43614CFDBBE33D48C7341C4B"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text><paragraph id="H5D0C69F041ED4AB08608ACE33A6744FD"><enum>(1)</enum><header>Financial institution</header><text display-inline="yes-display-inline">The term <quote>financial institution</quote> means a United States financial institution or a foreign financial institution.</text></paragraph><paragraph id="HEF27FEBD2E5E4C8AA0A9192A5A53F593"><enum>(2)</enum><header>Foreign financial institution</header><text>The term <quote>foreign financial institution</quote> has the meaning given that term under section 561.308 of title 31, Code of Federal Regulations.</text></paragraph><paragraph id="HB3BF9310EC84408E9976CAE8CA1128E7"><enum>(3)</enum><header>Knowingly</header><text display-inline="yes-display-inline">The term <quote>knowingly</quote> with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, the circumstance, or the result.</text></paragraph><paragraph id="H9D0DDE4570E04EF5B949017B65EC330A"><enum>(4)</enum><header>United States financial institution</header><text>The term <quote>United States financial institution</quote> has the meaning given the term <quote>U.S. financial institution</quote> under section 561.309 of title 31, Code of Federal Regulations.</text></paragraph></section><section id="HDD4939E4E8174088A4F3E3CDA66A243D"><enum>5.</enum><header>Sunset</header><text display-inline="no-display-inline">The reporting requirement under this Act shall terminate on the date that is the end of the 7-year period beginning on the date of the enactment of this Act.</text></section></legis-body></bill>
