Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide grants for the conduct of demonstration projects designed to provide education and training for eligible individuals to enter and follow a career pathway in the field of pregnancy or childbirth, under the health profession opportunity grant program under section 2008 of the Social Security Act.</official-title></form><legis-body id="HF54B3307E4864CD3B239C163586870D5" style="OLC"><section id="H382F149193B04546B412E40F994B5EE7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Opportunities to Support Mothers and Deliver Children Act</short-title></quote>.</text></section><section id="H2AC60ACFEAAF4FE1BAC08D1C595AA573"><enum>2.</enum><header>Grants for demonstration projects to provide career pathways in the field of pregnancy or childbirth</header><text display-inline="no-display-inline">Section 2008 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397g">42 U.S.C. 1397g</external-xref>) is amended by redesignating subsection (d) as subsection (e) and inserting after subsection (c) the following:</text><quoted-block display-inline="no-display-inline" id="HEE2C350617324024AEA23CFBE3D1DE5A" style="OLC"><subsection id="H9EC5A46AAA244FADA694025D91CDFF9C"><enum>(d)</enum><header>Demonstration projects To provide career pathways in the field of pregnancy or childbirth</header><paragraph id="H162E7FA4DF2940C98ABB1B98258A7A65"><enum>(1)</enum><header>Grant authority</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Labor and the Secretary of Education, shall award grants in accordance with this subsection to eligible entities to conduct demonstration projects for the purpose of providing education and training for eligible individuals to enter and follow a career pathway in the field of pregnancy or childbirth, in a State that recognizes doulas or midwives as health care providers and that provides payment for services provided by doulas or midwives, as the case may be, under the State plan approved under title XIX.</text></paragraph><paragraph id="H3D59A3CE00E44BB48FB1E8EF7D761433"><enum>(2)</enum><header>Duration</header><text>A demonstration project shall be conducted under this subsection for not less than 3 years.</text></paragraph><paragraph id="H3566B16CA029468A826DBE14690C5F69"><enum>(3)</enum><header>Application requirements</header><text display-inline="yes-display-inline">An applicant seeking a grant under this subsection for a demonstration project shall submit to the Secretary an application for the grant, that includes the following:</text><subparagraph id="H2BAA8A33990B43409807720323BCB872"><enum>(A)</enum><text>A description of the partnerships, strategic staff hiring decisions, tailored program activities, or other programmatic elements of the project that are designed to support a strong career pathway in pregnancy, birth, or post-partum services.</text></subparagraph><subparagraph id="H2CBD69BAE4F148EB892C0FE5900D731F"><enum>(B)</enum><text display-inline="yes-display-inline">A demonstration that the State in which the project is to be conducted recognizes and permits doulas and midwives to practice in the State.</text></subparagraph><subparagraph id="HD0E01F93FFE24760A35880311E335FF9"><enum>(C)</enum><text>A demonstration that the applicant has experience working with low-income populations, or a description of the plan of the applicant to work with a partner that has the experience.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H04F28A048484400290CEE1178D3E988F"><enum>(4)</enum><header>Evaluations</header><text display-inline="yes-display-inline">The Secretary shall, by grant, contract, or interagency agreement, conduct rigorous and well-designed evaluations of the demonstration projects for which a grant is made under this section, which shall include identification of successful activities for creating opportunities for developing and sustaining, particularly with respect to low-income individuals and other entry-level workers, a doula-to-midwife workforce career pathway that has accessible entry points, that meets high standards for education, training, certification, and professional development, and that provides increased wages and affordable benefits, including health care coverage, that are responsive to the needs of the workforce.</text></paragraph><paragraph id="H918F155A99A44609AA6C1CAA842D74B6"><enum>(5)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph display-inline="no-display-inline" id="HDD5ACE10E47543FDA4E2552C9F88B2D4"><enum>(A)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means any of the following entities that demonstrates in an application submitted under this subsection that the entity has the capacity to fully develop and administer the demonstration project described in the application:</text><clause id="HD5DD58EA67E043889F2FCC61E5B19957"><enum>(i)</enum><text>A local workforce development board established under section 107 of the Workforce Innovation and Opportunity Act.</text></clause><clause id="HF9BEBB5462D0492AA87F9C7EFA7CD23C"><enum>(ii)</enum><text display-inline="yes-display-inline">A State or territory, a political subdivision of a State or territory, or an agency of a State, territory, or such a political subdivision.</text></clause><clause id="H0646C23EDC8E427D83471D8FE2BD06ED"><enum>(iii)</enum><text display-inline="yes-display-inline">An Indian tribe, a tribal organization, or a tribal college or university.</text></clause><clause id="HC255407AFE344AAEAB6C4F9927855357"><enum>(iv)</enum><text>An institution of higher education (as defined in the Higher Education Act of 1965).</text></clause><clause id="H5D510D94C37044DA9BE3BF2EF223829C"><enum>(v)</enum><text>A hospital (as defined in section 1861(e)).</text></clause><clause id="H63C83A97152242FDA3846ABD26FED1C8"><enum>(vi)</enum><text display-inline="yes-display-inline">A skilled nursing facility (as defined in section 1819(h)(1)(A)).</text></clause><clause id="H9B6B2EFEB85B45DEA379D85066D866E4"><enum>(vii)</enum><text>A Federally qualified health center (as defined in section 1861(aa)(4)).</text></clause><clause id="HB256E5B9008147B69C8DBC964FB904B9"><enum>(viii)</enum><text display-inline="yes-display-inline">A nonprofit organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986, a labor organization, or an entity with shared labor-management oversight, that has a demonstrated history of providing health profession training to eligible individuals.</text></clause><clause id="HE57ABCA9EEE24AE8AF2500AC36815D02"><enum>(ix)</enum><text display-inline="yes-display-inline">An entity recognized by a State, Indian tribe, or tribal organization as qualified to train doulas or midwives, if midwives or doulas, as the case may be, are permitted to practice medicine in the State involved.</text></clause><clause id="HE091D4E630CE4CD68345BA9E215F94ED"><enum>(x)</enum><text>An opioid treatment program (as defined in section 1861(iii)(2)).</text></clause></subparagraph><subparagraph id="HF83A542D6F2D4324B6E9789C57804893"><enum>(B)</enum><header>Eligible individual</header><text>The term <term>eligible individual</term> means an individual whose income does not exceed 138 percent of the Federal poverty level.</text></subparagraph><subparagraph id="HEF946E55F3C140A0833AA6AD5CE66AAF"><enum>(C)</enum><header>Midwife</header><text>The term <term>midwife</term> means a certified midwife, certified professional midwife, licensed midwife, and tribally-recognized midwife.</text></subparagraph><subparagraph id="HE0850565E82C456CBF670AB5116A42B3"><enum>(D)</enum><header>Certified midwife</header><text>The term <term>certified midwife</term> means an individual who is certified by the American Midwifery Certification Board to practice midwifery.</text></subparagraph><subparagraph id="H675693E8F0CD42E2B915A5D5CC5D699B"><enum>(E)</enum><header>Certified professional midwife</header><text>The term <term>certified professional midwife</term> means an individual who—</text><clause id="H77EEE5BD83AB491DBA0E7C5BF80E485D"><enum>(i)</enum><text>is certified by the North American Registry of Midwives to practice midwifery for normal, low-risk pregnancies and childbirths; and</text></clause><clause id="H81E03E5C54E94567899BD9BBA36FA472"><enum>(ii)</enum><text>has completed—</text><subclause id="H622915D3EE0F4388843642AF9859FB9C"><enum>(I)</enum><text>a midwifery education program accredited by the Midwifery Education and Accreditation Council or any other entity recognized by the Department of Education; or</text></subclause><subclause id="HC40E1ED3C022430FB6AEC649731F8F2B"><enum>(II)</enum><text>the requirements to obtain a Midwifery Bridge Certificate from the North American Registry of Midwives, and maintains the certification by completing any required continuing education for the certification.</text></subclause></clause></subparagraph><subparagraph id="H5899C8E8EA7F40B0AC0293FB52465A2F"><enum>(F)</enum><header>Licensed midwife</header><text>The term <term>licensed midwife</term> means, with respect to a State, an individual who is licensed under State law to practice midwifery.</text></subparagraph><subparagraph id="H496CF23679484269950BB70307CC0119"><enum>(G)</enum><header>Tribally-recognized midwife</header><text>The term <term>tribally-recognized midwife</term> means an individual who is recognized by an Indian tribe (as defined in section 4 of the Indian Health Care Improvement Act) to practice midwifery for the tribe.</text></subparagraph></paragraph><paragraph id="H6B770B4B19FE4C439751D973E50018A6"><enum>(6)</enum><header>Appropriation</header><text>Out of any funds in the Treasury of the United States not otherwise appropriated, there are appropriated to the Secretary to carry out this subsection $10,000,000 for fiscal year 2022.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H27359166328044D1866B78B8B3C0BB4B"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendment made by this Act shall take effect on October 1, 2021.</text></section></legis-body></bill>
