<subsection id="H1EF7A8B9F6844C1FB184B60824FCE070"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Combating Sexual Harassment in Science Act</short-title></quote>.</text></subsection> <subsection id="HE2BA884C76E64009A06A834EBB8AC5D0"><enum>(b)</enum><header>Table of contents</header><text>The table of contents for this Act is as follows:</text>

<section id="H06C1118AFF21422485D5519CC39CC73A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> <paragraph id="H3D1CC3E52D1946618A4895F1A0191177"><enum>(1)</enum><text display-inline="yes-display-inline">According to the report issued by the National Academies of Sciences, Engineering, and Medicine in 2018 entitled <quote>Sexual Harassment of Women: Climate, Culture, and Consequences in Academic Sciences, Engineering, and Medicine</quote>—</text>
<subparagraph id="H19E2509136BE4515971BD8597D92B1D4"><enum>(A)</enum><text>sexual harassment is pervasive in institutions of higher education;</text></subparagraph> <subparagraph id="HF608226FEFA5446BBC1012ECA4D80D07"><enum>(B)</enum><text display-inline="yes-display-inline">the most common type of sexual harassment is gender harassment, which includes verbal and nonverbal behaviors that convey insulting, hostile, and degrading attitudes about members of one gender;</text></subparagraph>
<subparagraph id="HA35D288CB4C7477487AC62406F4CECE0"><enum>(C)</enum><text>58 percent of individuals in the academic workplace experience sexual harassment, the second highest rate when compared to the military, the private sector, and Federal, State, and local government;</text></subparagraph> <subparagraph id="HAD96EB7D39794A6795F78ED2EF3BCBF7"><enum>(D)</enum><text>women who are members of racial or ethnic minority groups are more likely to experience sexual harassment and to feel unsafe at work than White women, White men, or men who are members of such groups;</text></subparagraph>
<subparagraph id="HE233259358064B0383775515F07DBC29"><enum>(E)</enum><text>the training for each individual who has a doctor of philosophy in the science, technology, engineering, and mathematics fields is estimated to cost approximately $500,000; and</text></subparagraph> <subparagraph id="H0740A13E7B204D5A8BEA79F3871E3A2F"><enum>(F)</enum><text>attrition of an individual so trained results in a loss of talent and money.</text></subparagraph></paragraph>
<paragraph id="HB77416DFA4F146C4A6E894DB10420519"><enum>(2)</enum><text>Sexual harassment undermines career advancement for women.</text></paragraph> <paragraph id="H16A6FBFBBD8145209D637AC76918B447"><enum>(3)</enum><text display-inline="yes-display-inline">According to a 2017 University of Illinois study, among astronomers and planetary scientists, 18 percent of women who are members of racial or ethnic minority groups and 12 percent of White women skipped professional events because they did not feel safe attending.</text></paragraph>
<paragraph id="HBA92B6CB1FDE45249FDD8FAEC2FC6AEE"><enum>(4)</enum><text>Many women report leaving employment at institutions of higher education due to sexual harassment.</text></paragraph> <paragraph id="H71624056803C4106B9D722C492055244"><enum>(5)</enum><text display-inline="yes-display-inline">Research shows the majority of individuals do not formally report experiences of sexual harassment due to a justified fear of retaliation or other negative professional or personal consequences.</text></paragraph>
<paragraph id="HC964F2050CD849D2A481E443FFEE33A6"><enum>(6)</enum><text>Reporting procedures with respect to such harassment are inconsistent among Federal science agencies and have varying degrees of accessibility.</text></paragraph> <paragraph id="H38F274A7C53743AFA507B9D2CCC8405F"><enum>(7)</enum><text>There is not adequate communication among Federal science agencies and between such agencies and grantees regarding reports of sexual harassment, which has resulted in harassers receiving Federal funding after moving to a different institution.</text></paragraph></section>
<section id="HD4181B14BAFA430CA08F0819BB42E660"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HFEAA494B78524DC3AA84144D91443C6B"><enum>(1)</enum><header>Academies</header><text>The term <term>Academies</term> means the National Academies of Sciences, Engineering, and Medicine.</text></paragraph>
<paragraph id="H9888292BD57E4016B03B9F4552AFF5D9"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the National Science Foundation.</text></paragraph> <paragraph id="HA133716090464664A077870785AB714C"><enum>(3)</enum><header>Federal science agency</header><text>The term <term>Federal science agency</term> means any Federal agency with an annual extramural research expenditure of over $100,000,000.</text></paragraph>
<paragraph id="H1DC958C10D3041E9B83A710A982E6CB0"><enum>(4)</enum><header>Finding or determination</header><text>The term <quote>finding or determination</quote> means the final disposition of a matter involving a violation of organizational policies and processes, to include the exhaustion of permissible appeals, or a conviction of a sexual offense in a criminal court of law.</text></paragraph> <paragraph id="H1272247369204EE8ABACC384637D8B4E"><enum>(5)</enum><header>Gender harassment</header><text>The term <quote>gender harassment</quote> means verbal and nonverbal behaviors that convey hostility, objectification, exclusion, or second-class status about one’s gender, gender identity, gender presentation, sexual orientation, or pregnancy status.</text></paragraph>
<paragraph id="H38AC56B9A34C4294B1809818CBB5D4D0"><enum>(6)</enum><header>Grantee</header><text display-inline="yes-display-inline">The term <term>grantee</term> means the legal entity to which a grant is awarded and that is accountable to the Federal Government for the use of the funds provided.</text></paragraph> <paragraph id="H08F9015DFB2E4BADA2BB9A3D29EBF4EA"><enum>(7)</enum><header>Grant personnel</header><text display-inline="yes-display-inline">The term <term>grant personnel</term> means principal investigators, co-principal investigators, postdoctoral researchers and other employees supported by a grant award, cooperative agreement, or contract under Federal law.</text></paragraph>
<paragraph id="HAC7D0D6C9A8143BE9CFFE363BFE52008"><enum>(8)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph> <paragraph id="H037BF55FD905460BADFB5B812C5740CB"><enum>(9)</enum><header>Sexual harassment</header><text>The term <term>sexual harassment</term> means conduct that encompasses—</text>
<subparagraph id="HDA41978CB9A9499D953992CB6C26E55E"><enum>(A)</enum><text>unwelcome sexual advances;</text></subparagraph> <subparagraph id="H3C68A34488A244548248454E7D1C88AF"><enum>(B)</enum><text>unwanted physical contact that is sexual in nature, including assault;</text></subparagraph>
<subparagraph id="H1CF18E1A0FC445EBB64FD1182AD6473D"><enum>(C)</enum><text>unwanted sexual attention, including sexual comments and propositions for sexual activity;</text></subparagraph> <subparagraph id="H2AAD0CB16C4C4023831B2979FB7AA46C"><enum>(D)</enum><text>conditioning professional or educational benefits on sexual activity; and</text></subparagraph>
<subparagraph id="HD6988E09F8C4449CB0D325DAF9C488BA"><enum>(E)</enum><text>retaliation for rejecting unwanted sexual attention.</text></subparagraph></paragraph> <paragraph id="H026D89713AA54F5D9A3ACAD97672C3A1"><enum>(10)</enum><header>Stem</header><text>The term <quote>STEM</quote> means science, technology, engineering, and mathematics, including computer science.</text></paragraph></section>
<section id="H1FFA878266C74D27A8D818CDE54A5325"><enum>4.</enum><header>Research grants</header>
<subsection id="H1243C94EB9C0476AA644C5E9EC3E970B"><enum>(a)</enum><header>In general</header><text>The Director shall establish a program to award grants, on a competitive basis, to institutions of higher education or nonprofit organizations (or consortia of such institutions or organizations)—</text> <paragraph id="H559744F72E2B4D8C8091154334CC9BE0"><enum>(1)</enum><text display-inline="yes-display-inline">to expand research efforts to better understand the factors contributing to, and consequences of, sexual harassment and gender harassment affecting individuals in the STEM workforce, including students and trainees; and</text></paragraph>
<paragraph id="HC936BA03C6E04AEB8C61CB9A7FFA936A"><enum>(2)</enum><text>to examine interventions to reduce the incidence and negative consequences of such harassment.</text></paragraph></subsection> <subsection id="H41926F0AB54D4688B23345E4874B65B1"><enum>(b)</enum><header>Use of funds</header><text>Activities funded by a grant under this section may include—</text>
<paragraph id="H77F59B0C668348EC85DB79A5655F09C6"><enum>(1)</enum><text display-inline="yes-display-inline">research on the sexual harassment and gender harassment experiences of individuals in underrepresented or vulnerable groups, including racial and ethnic minority groups, disabled individuals, foreign nationals, sexual- and gender-minority individuals, and others;</text></paragraph> <paragraph id="H536EA3794E744595A5F365219B3D988F"><enum>(2)</enum><text display-inline="yes-display-inline">development and assessment of policies, procedures, trainings, and interventions, with respect to sexual harassment and gender harassment, conflict management, and ways to foster respectful and inclusive climates;</text></paragraph>
<paragraph id="H26FFAF5BF8524D5EB2B9C212CB15D19F"><enum>(3)</enum><text>research on approaches for remediating the negative impacts and outcomes of such harassment on individuals experiencing such harassment;</text></paragraph> <paragraph id="H7A2C0F50FA884A4CB9A59C8E0A30E7D7"><enum>(4)</enum><text display-inline="yes-display-inline">support for institutions of higher education to develop, adapt, and assess the impact of innovative, evidence-based strategies, policies, and approaches to policy implementation to prevent and address sexual harassment and gender harassment;</text></paragraph>
<paragraph id="H0F6BAD2B5216462F856B68A991E352D6"><enum>(5)</enum><text display-inline="yes-display-inline">research on alternatives to the hierarchical and dependent relationships, including but not limited to the mentor-mentee relationship, in academia that have been shown to create higher levels of risk for sexual harassment and gender harassment; and</text></paragraph> <paragraph id="HEF78A06F1739445EB4295E73AE0EFFB8"><enum>(6)</enum><text>establishing a center for the ongoing compilation, management, and analysis of campus climate survey data.</text></paragraph></subsection></section>
<section id="H200D536BF1BE47798BDA6C012A4F7715"><enum>5.</enum><header>Data collection</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Director shall convene a working group composed of representatives of Federal statistical agencies—</text> <paragraph id="H97AE002D27D048CCB46D398E75825395"><enum>(1)</enum><text display-inline="yes-display-inline">to develop questions on sexual harassment and gender harassment in STEM departments to gather national data on the prevalence, nature, and implications of sexual harassment and gender harassment in institutions of higher education; and</text></paragraph>
<paragraph id="H69F10A2EC3C1444EBD056A0EC3A5C238"><enum>(2)</enum><text display-inline="yes-display-inline">to include such questions as appropriate, with sufficient protections of the privacy of respondents, in relevant surveys conducted by the National Center for Science and Engineering Statistics and other relevant entities.</text></paragraph></section> <section id="HB91C36BEBF05434988604FE517387274"><enum>6.</enum><header>Responsible conduct guide</header> <subsection id="H9611AB73EB894FF7AF78862C73154FDD"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Director shall enter into an agreement with the Academies to update the report entitled <quote>On Being a Scientist: A Guide to Responsible Conduct in Research</quote> issued by the Academies. The report, as so updated, shall include—</text>
<paragraph id="HC42B35B2D7E1470782C16FAD40AB6B2D"><enum>(1)</enum><text>updated professional standards of conduct in research;</text></paragraph> <paragraph id="H919E3C66DA0243FC96E0A60750BDA195"><enum>(2)</enum><text>standards of treatment individuals can expect to receive under such updated standards of conduct;</text></paragraph>
<paragraph id="HF5237775C10E4FC8A7ECF1B948598F42"><enum>(3)</enum><text display-inline="yes-display-inline">evidence-based practices for fostering a climate intolerant of sexual harassment and gender harassment;</text></paragraph> <paragraph id="H5010FF0806134444888E5076C7D30F43"><enum>(4)</enum><text display-inline="yes-display-inline">methods, including bystander intervention, for identifying and addressing incidents of sexual harassment and gender harassment; and</text></paragraph>
<paragraph id="H1681F34BA6B04C1B81DDDAFFD1B84F19"><enum>(5)</enum><text display-inline="yes-display-inline">professional standards for mentorship and teaching with an emphasis on preventing sexual harassment and gender harassment.</text></paragraph></subsection> <subsection id="H16602974C48240D499F42A2DDA8D276D"><enum>(b)</enum><header>Recommendations</header><text display-inline="yes-display-inline">In updating the report under subsection (a), the Academies shall take into account recommendations made in the report issued by the Academies in 2018 entitled <quote>Sexual Harassment of Women: Climate, Culture, and Consequences in Academic Sciences, Engineering, and Medicine</quote> and other relevant studies and evidence.</text></subsection>
<subsection id="H843AC400034246718C27F20D693DA976"><enum>(c)</enum><header>Report</header><text>Not later than 18 months after the effective date of the contract under subsection (a), the Academies, as part of such agreement, shall submit to the Director and the Committee on Science, Space, and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate the report referred to in such subsection, as updated pursuant to such subsection.</text></subsection></section> <section id="HE940244FF5734B228C928C4085113042"><enum>7.</enum><header>Interagency working group</header> <subsection id="H76C640A305494C9C969403C298673993"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Office of Science and Technology Policy, acting through the National Science and Technology Council, shall establish an interagency working group for the purpose of coordinating Federal science agency efforts to reduce the prevalence of sexual harassment and gender harassment involving grant personnel. The working group shall be chaired by the Director of the Office of Science and Technology Policy (or the Director’s designee) and shall include a representative from each Federal science agency with annual extramural research expenditures totaling over $1,000,000,000, a representative from the Department of Education, and a representative from the U.S. Equal Employment Opportunity Commission.</text></subsection>
<subsection id="H0DB012317C5C46389BE30D370F3F2634"><enum>(b)</enum><header>Responsibilities of working group</header><text>The interagency working group established under subsection (a) shall coordinate Federal science agency efforts to implement the policy guidelines developed under subsection (c)(2).</text></subsection> <subsection id="HE89AF2FEAE6545759487E36A474F5CCF"><enum>(c)</enum><header>Responsibilities of OSTP</header><text>The Director of the Office of Science and Technology Policy shall—</text>
<paragraph id="HD8DCBEEFF59A48219D68C987CFD745BC"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 90 days after the date of the enactment of this Act, submit to the Committee on Science, Space, and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate an inventory of policies, procedures, and resources dedicated to preventing and responding to reports of sexual harassment and gender harassment at Federal agencies that provide legal definitions to which institutions of higher education must comply; and</text></paragraph> <paragraph id="H73DBE24C400747329AF9867C06993576"><enum>(2)</enum><text>not later than 6 months after the date on which the inventory is submitted under paragraph (1)—</text>
<subparagraph id="H1CB9A6EB1A954D44961643FE94546B98"><enum>(A)</enum><text display-inline="yes-display-inline">in consultation with outside stakeholders and Federal science agencies, develop a uniform set of policy guidelines for Federal science agencies; and</text></subparagraph> <subparagraph id="H551618C92AF54E3FABEA6266AF731B2F"><enum>(B)</enum><text>submit a report to the committees referred to in paragraph (1) containing such guidelines;</text></subparagraph></paragraph>
<paragraph id="HDB916D841F1A405B9EC0CCAD4F91AE0E"><enum>(3)</enum><text display-inline="yes-display-inline">encourage and monitor efforts of Federal science agencies to develop or maintain and implement policies based on the guidelines developed under paragraph (2), including the extent to which Federal science agency policies depart from the uniform policy guidelines;</text></paragraph> <paragraph id="HC6989988E184485FABCBE7F59E2B0DA7"><enum>(4)</enum><text>not later than 1 year after the date on which the inventory under paragraph (1) is submitted, and every 5 years thereafter, the Director of the Office of Science and Technology Policy shall report to Congress on the implementation by Federal science agencies of the policy guidelines developed under paragraph (2); and</text></paragraph>
<paragraph id="H9DDDE73046D84BFC8007E1AB8DBC8E48"><enum>(5)</enum><text>update such policy guidelines as needed.</text></paragraph></subsection> <subsection id="H43B3E04019D9462AB5D3396D726818EE"><enum>(d)</enum><header>Requirements</header><text>In developing policy guidelines under subsection (c)(2), the Director of the Office of Science and Technology Policy shall include guidelines that require—</text>
<paragraph id="H2C4BBD24912844C8BA9DF5A70A619AF4"><enum>(1)</enum><text>grantees to submit to the Federal science agency or agencies from which the grantees receive funding reports relating to—</text> <subparagraph id="HA053F391C24C4C68B1225CCAB837FED6"><enum>(A)</enum><text display-inline="yes-display-inline">administrative action, related to an allegation against grant personnel of any sexual harassment or gender harassment, as set forth in organizational policies or codes of conduct, statutes, regulations, or executive orders, that affects the ability of grant personnel or their trainees to carry out the activities of the grant; and</text></subparagraph>
<subparagraph id="H2AE0C4BB8940465F838B9857ABF92A0D"><enum>(B)</enum><text display-inline="yes-display-inline">findings or determinations against grant personnel of sexual harassment or gender harassment, as set forth in organizational policies or codes of conduct, statutes, regulations, or executive orders, including any findings or determinations related to reports submitted under subparagraph (A) and any disciplinary action that was taken;</text></subparagraph></paragraph> <paragraph id="H272E23D9CFEA4502BCDEE76CA3FA2342"><enum>(2)</enum><text display-inline="yes-display-inline">the sharing, updating, and archiving of reports of sexual harassment and gender harassment from grantees submitted under paragraph (1)(B) with relevant Federal science agencies on a quarterly basis; and</text></paragraph>
<paragraph id="H82698A663D6A457A852D4A7A03198760"><enum>(3)</enum><text display-inline="yes-display-inline">to the extent practicable, ensure consistency among Federal agencies with regards to the policies and procedures for receiving reports submitted pursuant to paragraph (1), which may include the designation of a single agency to field reports so submitted.</text></paragraph></subsection> <subsection id="HFD79ADABD1B043768A1A142FA7DAC881"><enum>(e)</enum><header>Considerations</header><text display-inline="yes-display-inline">In developing policy guidelines under subsection (c)(2), the Director of the Office of Science and Technology Policy shall consider guidelines that require or incentivize—</text>
<paragraph id="HA2E62F8873054AAB80F0ECAC3D488FF9"><enum>(1)</enum><text display-inline="yes-display-inline">grantees to periodically assess their organizational climate, which may include the use of climate surveys, focus groups, or exit interviews;</text></paragraph> <paragraph id="H2A205C21BB9143B9AAA2CB122F1781FB"><enum>(2)</enum><text display-inline="yes-display-inline">grantees to publish on a publicly available internet website the results of assessments conducted pursuant to paragraph (1), disaggregated by gender and, if possible, race, ethnicity, disability status, and sexual orientation;</text></paragraph>
<paragraph id="H6326D6AD3D1B41D882C0C1BA6F6EE84D"><enum>(3)</enum><text display-inline="yes-display-inline">grantees to make public on an annual basis the number of reports of sexual harassment and gender harassment at each such institution;</text></paragraph> <paragraph id="H9279B22BAD9843EB93D50D93351675F5"><enum>(4)</enum><text display-inline="yes-display-inline">grantees to regularly assess and improve policies, procedures, and interventions to reduce the prevalence of sexual harassment and gender harassment;</text></paragraph>
<paragraph id="HAC6E4ADFF7264138AEDCCC2C16050E70"><enum>(5)</enum><text display-inline="yes-display-inline">each grantee to demonstrate in its proposal for a grant award, cooperative agreement, or contract that a code of conduct is in place for maintaining a healthy and welcoming workplace for grant personnel and their trainees;</text></paragraph> <paragraph id="HE330A785099C435BA20BFB00EBA550D0"><enum>(6)</enum><text display-inline="yes-display-inline">the diffusion of the hierarchical and dependent relationships between grant personnel and their trainees;</text></paragraph>
<paragraph id="HAB05DD930E01477DBAFD74F41BF3EAE2"><enum>(7)</enum><text>each grantee and Federal science agency to have in place mechanisms for the re-integration of individuals who have experienced sexual harassment and gender harassment; and</text></paragraph> <paragraph id="HE7E84D84B04943A287C91444A21AE698"><enum>(8)</enum><text display-inline="yes-display-inline">grantees to work to create a climate intolerant of sexual harassment and gender harassment.</text></paragraph></subsection>
<subsection id="H1D035000143C4A56A69CABBF5AF616F1"><enum>(f)</enum><header>Federal science agency implementation</header><text display-inline="yes-display-inline">Each Federal science agency shall—</text> <paragraph id="HE7027B7DF2BC4E9D9758329C5361C4CD"><enum>(1)</enum><text display-inline="yes-display-inline">develop or maintain and implement policies with respect to sexual harassment and gender harassment that are consistent with policy guidelines under subsection (c)(2) and that protect the privacy of all parties involved in any report and investigation of sexual harassment and gender harassment, except to the extent necessary to carry out an investigation; and</text></paragraph>
<paragraph id="H9E6CA04CCA954601B3690634D7407E74"><enum>(2)</enum><text display-inline="yes-display-inline">broadly disseminate such policies to current and potential recipients of research grants, cooperative agreements, or contracts awarded by such agency.</text></paragraph></subsection> <subsection id="HC63196600E8440D0BCE5D4FB4D645382"><enum>(g)</enum><header>FERPA</header><text>The Director of the Office of Science and Technology Policy shall ensure that such guidelines and requirements are consistent with the requirements of section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>) (commonly referred to as the <quote>Family Educational Rights and Privacy Act of 1974</quote>).</text></subsection>
<subsection id="HA230713797F34D88B67C7EACBC9037E5"><enum>(h)</enum><header>Sunset</header><text>The interagency working group established under subsection (a) shall terminate on the date that is 7 years after the date of the enactment of this Act.</text></subsection></section> <section id="H113B1E230D6C4F3B92AA674CCADD0DEB"><enum>8.</enum><header>National academies assessment</header> <subsection id="HBEB06A5B158F4BF5A5D927D5E4665E57"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><italic></italic>Not later than 3 years after the date of enactment of this Act, the Director shall enter into an agreement with the Academies to undertake a study of the influence of sexual harassment and gender harassment in institutions of higher education on the career advancement of individuals in the STEM workforce. The study shall assess—</text>
<paragraph id="H7F3519E07A104A3AB83DBE06A62A334F"><enum>(1)</enum><text display-inline="yes-display-inline">the state of research on sexual harassment and gender harassment in such workforce;</text></paragraph> <paragraph id="H757C8D6A96244E4AAA7E765E1D0472A1"><enum>(2)</enum><text>whether research demonstrates a change in the prevalence of sexual harassment and gender harassment in such workforce;</text></paragraph>
<paragraph id="H75C0284141D2427C9015C0A313FCB62A"><enum>(3)</enum><text>the progress made with respect to implementing recommendations promulgated in the Academies consensus study report entitled <quote>Sexual Harassment of Women: Climate, Culture, and Consequences in Academic Sciences, Engineering, and Medicine</quote>; and</text></paragraph> <paragraph id="HC52EFA612E8142109A2A8F80D64DCA56"><enum>(4)</enum><text display-inline="yes-display-inline">where to focus future efforts with respect to decreasing sexual harassment and gender harassment in such institutions.</text></paragraph></subsection></section>
