R. 2691</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210420">April 20, 2021</action-date><action-desc><sponsor name-id="H001088">Mr. Hagedorn</sponsor> (for himself, <cosponsor name-id="B001306">Mr. Balderson</cosponsor>, <cosponsor name-id="C001053">Mr. Cole</cosponsor>, <cosponsor name-id="S001195">Mr. Smith of Missouri</cosponsor>, <cosponsor name-id="L000569">Mr. Luetkemeyer</cosponsor>, <cosponsor name-id="N000190">Mr. Norman</cosponsor>, <cosponsor name-id="V000129">Mr. Valadao</cosponsor>, <cosponsor name-id="W000812">Mrs. Wagner</cosponsor>, <cosponsor name-id="B001298">Mr. Bacon</cosponsor>, <cosponsor name-id="E000298">Mr. Estes</cosponsor>, <cosponsor name-id="F000470">Mrs. Fischbach</cosponsor>, <cosponsor name-id="L000578">Mr. LaMalfa</cosponsor>, <cosponsor name-id="M001213">Mr. Moore of Utah</cosponsor>, <cosponsor name-id="H001084">Ms. Herrell</cosponsor>, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, <cosponsor name-id="M001159">Mrs. Rodgers of Washington</cosponsor>, <cosponsor name-id="C001051">Mr. Carter of Texas</cosponsor>, <cosponsor name-id="B001295">Mr. Bost</cosponsor>, <cosponsor name-id="T000467">Mr. Thompson of Pennsylvania</cosponsor>, <cosponsor name-id="J000292">Mr. Johnson of Ohio</cosponsor>, <cosponsor name-id="G000579">Mr. Gallagher</cosponsor>, <cosponsor name-id="S001212">Mr. Stauber</cosponsor>, and <cosponsor name-id="V000133">Mr. Van Drew</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to permit 529 plans to be used for certain non-degree technical training certificate programs and apprenticeship programs.</official-title></form><legis-body id="H883161AEE8F54745A31BEA5167215D83" style="OLC"><section id="H80812B3B13A54F3DA97ED494276E2ABC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Workforce Empowerment Act</short-title></quote>.</text></section><section id="H2E57F067085348E99AA28B28186DCB41"><enum>2.</enum><header>529 account funding for non-degree technical training certificate programs and apprenticeship programs</header><subsection id="HE816A42229864FD8956F847147462DD4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (8) of <external-xref legal-doc="usc" parsable-cite="usc/26/529">section 529(c)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HB13B73016346411E9620EAB93B1718FE" style="OLC"><paragraph id="HB3262336C3A64C96964D59C16801E922"><enum>(8)</enum><header>Treatment of certain expenses associated with technical training certificate programs and registered apprenticeship programs</header><text>Any reference in this subsection to the term <quote>qualified higher education expense</quote> shall include a reference to expenses for fees, books, supplies, tools, and equipment required for the participation of a designated beneficiary in— </text><subparagraph id="H656E27D002E542A6AC3D4C457F13F335"><enum>(A)</enum><text display-inline="yes-display-inline">an apprenticeship program registered and certified with the Secretary of Labor under section 1 of the National Apprenticeship Act (<external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50</external-xref>), and</text></subparagraph><subparagraph id="H44CCEADD924C42BA919EAE171685BC40"><enum>(B)</enum><text display-inline="yes-display-inline">a recognized postsecondary credential as defined under section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>), including testing and other fees required by the organization issuing the recognized postsecondary credential as a condition of obtaining or maintaining the credential.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="H98E64794168F41FCACB6141AFBD1C30B"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to expenses paid or incurred after the date of the enactment of this Act for programs beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
