R. 2690</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210420">April 20, 2021</action-date><action-desc><sponsor name-id="G000558">Mr. Guthrie</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Trade Commission Act to require annual reports to Congress regarding the status of investigations of unfair or deceptive acts or practices in or affecting commerce.</official-title></form><legis-body id="H81B25F09D7774F4D9AAE45EB7F959838" style="OLC"><section id="H3DD282375C6B4969A946BD4E8D9C6F63" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clarifying Legality and Enforcement Action Reasoning Act</short-title></quote> or the <quote><short-title>CLEAR Act</short-title></quote>.</text></section><section id="HDC293FE1B16F44B88B41400C823B9C89" section-type="subsequent-section"><enum>2.</enum><header>Annual reporting on the status of investigations</header><text display-inline="no-display-inline">Section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H45EA65042D3A461C93D7F65A61A6E9BB" style="traditional"><subsection id="H61625702C9EF4917B0B5896EAF068052"><enum>(o)</enum><header>Report on investigations</header><paragraph id="HD9C9964D031348C7B1C59A81C2D50979"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall, on an annual basis, transmit a report to Congress on investigations with respect to unfair or deceptive acts or practices in or affecting commerce (within the meaning of subsection (a)(1)), detailing—</text><subparagraph id="H8CF262FE2CBC4DFC89BED0019E1EFC2B"><enum>(A)</enum><text>the number of such investigations the Commission has commenced;</text></subparagraph><subparagraph id="HF78E44D6D50A41E9A2F38B1A7C3E1F89"><enum>(B)</enum><text>the number of such investigations the Commission has closed with no official agency action;</text></subparagraph><subparagraph id="H4EECFB39610D4732A9E208F65603D542"><enum>(C)</enum><text>the disposition of such investigations, if such investigations have concluded and resulted in official agency action; and</text></subparagraph><subparagraph id="H68B2580A6B7D42879EAA8F3CDF47933C"><enum>(D)</enum><text>for each such investigation that was closed with no official agency action, a description sufficient to indicate the legal analysis supporting the Commission’s decision not to continue such investigation, and the industry sectors of the entities subject to each such investigation.</text></subparagraph></paragraph><paragraph id="H50377CBA165F4322A2822D7476078BCD"><enum>(2)</enum><header>Privacy protection</header><text display-inline="yes-display-inline">The description required under paragraph (1)(D) shall not include the identity of the person who is the subject of an investigation or any other information that identifies the person.</text></paragraph><paragraph id="H700CC128CFB94103B958A9E63130C255"><enum>(3)</enum><header>FTC website posting</header><text>The Commission shall make the most recent report required under this subsection publicly available on the Commission’s website, and maintain such report on such website until the next report is transmitted to Congress.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
