which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to include certain landlocked releases of petroleum, and for other purposes.</official-title></form><legis-body id="H1A20F1E20F2544AAA811055B520E5255" style="OLC"><section id="HBCC92258D5664E15BE9ECCC75DE38946" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CERCLA Liability Expansion and Accountability for Negligent and Unjust Pollution Act</short-title></quote> or the <quote><short-title>CLEANUP Act</short-title></quote>.</text></section><section id="H3AD1C941391144AE965522CA848CEFD1" section-type="subsequent-section"><enum>2.</enum><header>Coverage of landlocked releases of petroleum</header><subsection id="HAC882F83BF0E48958317327D4B19076F"><enum>(a)</enum><header>Hazardous substances defined</header><text display-inline="yes-display-inline">Section 101(14) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601(14)</external-xref>) is amended—</text><paragraph id="H5F67D524F2994937AADCA3918D434629"><enum>(1)</enum><text>by striking <quote>and (F)</quote> and inserting <quote>(F)</quote>;</text></paragraph><paragraph id="H1E511B870B2F4480B968034962320B93"><enum>(2)</enum><text>by inserting <quote>, and (G) petroleum products</quote> after <quote>Toxic Substances Control Act</quote>; and</text></paragraph><paragraph id="H7BCC752520B547ACB650DD5B009F4EEC"><enum>(3)</enum><text>by striking <quote>petroleum, including crude oil or any fraction thereof which is not otherwise specifically listed or designated as a hazardous substance under subparagraphs (A) through (F) of this paragraph, and the term does not include</quote>.</text></paragraph></subsection><subsection id="HA6205BEADC654391A16A85D36CFFD018"><enum>(b)</enum><header>Release defined</header><text>Section 101(22) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601(22)</external-xref>) is amended by striking <quote>and (D) the normal application of fertilizer</quote> and inserting <quote>(D) the normal application of fertilizer, and (E) the release of a petroleum product if liability for such release is established by any other Federal law</quote>.</text></subsection><subsection commented="no" id="HC6C2F3159E194E6FB892FCF1DCB695AB"><enum>(c)</enum><header>Definition of petroleum product</header><text display-inline="yes-display-inline">Section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF8B81E981C40440D877BEB9E8F5A7AE5" style="OLC"><paragraph commented="no" id="HEEF9599138324194A25EC15950F63BE6"><enum>(42)</enum><header>Petroleum product</header><text display-inline="yes-display-inline">The term <quote>petroleum product</quote> means petroleum or oil of any kind, in any form, or any fraction thereof, including fuel oil, sludge, oil refuse, and oil mixed with wastes other than dredged spoil.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9EEB778105714D0F8C2E797CF3D1B25B"><enum>(d)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 101(39)(D)(ii)(II)(aa) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601(39)(D)(ii)(II)(aa)</external-xref>) is amended by striking <quote>excluded from the definition of <quote>hazardous substance</quote> under section 101</quote>.</text></subsection></section></legis-body></bill>
