committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc><action-instruction>For text of introduced bill, see copy of bill as introduced on April 20, 2021</action-instruction></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Trade Commission Act to affirmatively confirm the authority of the Federal Trade Commission to seek permanent injunctions and other equitable relief for violations of any provision of law enforced by the Commission.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HIF00" reported-display-style="italic" id="H1B158F4162254134924C624AA1A064C1"><section id="HC58B140F79D14707B3B0513F835D5B54" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Consumer Protection and Recovery Act</short-title></quote>. </text></section><section id="H8E3E96627D9A43299A0A52ED6F09A9D3"><enum>2.</enum><header>FTC authority to seek permanent injunctions and other equitable relief</header><subsection id="H313436E763164AED85E1C4810AA12DB6"><enum>(a)</enum><header>Permanent injunctions and other equitable relief</header><text>Section 13 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/53">15 U.S.C. 53</external-xref>) is amended—</text><paragraph id="HA42984BAD4FA42698417A4ACC5D4A153"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H00903F657A7F4A9983C8FF3A4CC96DCB"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>has violated,</quote> after <quote>corporation</quote>;</text></subparagraph><subparagraph id="H07C0DD0FF1B8432AB6DC535F4C216FB3"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="HAC8F0FA5CAA34871A660561D2DFEB1EF" commented="no"><enum>(i)</enum><text>by striking <quote>that</quote> and inserting <quote>that either (A)</quote>; and</text></clause><clause id="HE76D44213F894CE3AE6322DF3A3CF9FB"><enum>(ii)</enum><text>by striking <quote>final,</quote> and inserting <quote>final; or (B) the permanent enjoining thereof or the ordering of equitable relief under subsection (e),</quote>; and</text></clause></subparagraph><subparagraph id="H79147EFC70914B78993259A17F2CE8F1"><enum>(C)</enum><text>in the matter following paragraph (2)—</text><clause id="HA9853008D84E4B63B4E904FE06B6EE6E"><enum>(i)</enum><text>by striking <quote>to enjoin any such act or practice</quote>;</text></clause><clause id="HA8A25BDA14E740E895CF11AF6008CE46"><enum>(ii)</enum><text>by striking <quote>Upon</quote> and inserting <quote>In a suit under paragraph (2)(A), upon</quote>; </text></clause><clause id="H1260499C97CC4FAF88739C8E4941E37B"><enum>(iii)</enum><text>by striking <quote>without bond</quote>;</text></clause><clause id="H2D70216FFF8A4CB98A24C4FC17EA83DD"><enum>(iv)</enum><text>by striking <quote>proper cases</quote> and inserting <quote>a suit under paragraph (2)(B)</quote>;</text></clause><clause id="H6BBD42B6B9204F4DB6310260851B60AC"><enum>(v)</enum><text>by striking <quote>injunction.</quote> and inserting <quote>injunction, equitable relief under subsection (e), or such other relief as the court determines to be just and proper, including temporary or preliminary equitable relief.</quote>;</text></clause><clause id="H341575A1535B44B79E8AFE089285325E"><enum>(vi)</enum><text>by striking <quote>Any suit</quote> and inserting <quote>Any suit under this subsection</quote>; and</text></clause><clause id="H17FEBE1DFDD245A2BB9525383F0CE380"><enum>(vii)</enum><text display-inline="yes-display-inline">by striking <quote>In any suit under this section</quote> and inserting <quote>In any such suit</quote>; and</text></clause></subparagraph></paragraph><paragraph id="H33AB6A426C8A4740852843B4BE7354A7"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HC604CFADC0A74EBEAE7E763E5FF55098" style="OLC" changed="added" reported-display-style="italic" committee-id="HIF00"><subsection id="H7BFFC053367B4D499BACF9749A3F42D2"><enum>(e)</enum><header>Equitable relief</header><paragraph id="H1DE7353F04D14B51818E2E245AEB1D53" commented="no"><enum>(1)</enum><header>Restitution; contract rescission and reformation; refunds; return of property</header><text display-inline="yes-display-inline">In a suit brought under subsection (b)(2)(B), the Commission may seek, and the court may order, with respect to the violation that gives rise to the suit, restitution for losses, rescission or reformation of contracts, refund of money, or return of property.</text></paragraph><paragraph id="HB842C97C4DAD4D90B513F27B243C4CA7"><enum>(2)</enum><header>Disgorgement</header><text>In a suit brought under subsection (b)(2)(B), the Commission may seek, and the court may order, disgorgement of any unjust enrichment that a person, partnership, or corporation obtained as a result of the violation that gives rise to the suit.</text></paragraph><paragraph id="H543D8990B437431C9070C64925F32ABB"><enum>(3)</enum><header>Calculation</header><text>Any amount that a person, partnership, or corporation is ordered to pay under paragraph (2) with respect to a violation shall be offset by any amount such person, partnership, or corporation is ordered to pay, and the value of any property such person, partnership, or corporation is ordered to return, under paragraph (1) with respect to such violation. </text></paragraph><paragraph id="H96EB47EC886E4737B7D14EFD0B6F176C" commented="no"><enum>(4)</enum><header>Limitations period</header><subparagraph id="H52E7F189F2C0440A92BF0173990CD5B5" commented="no"><enum>(A)</enum><header>In general</header><text>A court may not order equitable relief under this subsection with respect to any violation occurring before the period that begins on the date that is 10 years before the date on which the Commission files the suit in which such relief is sought.</text></subparagraph><subparagraph id="H779972E7F6C54FB89A87C0E6E15092F0" commented="no"><enum>(B)</enum><header>Calculation</header><text>For purposes of calculating the beginning of the period described in subparagraph (A), any time during which an individual against which the equitable relief is sought is outside of the United States shall not be counted.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HEFDF7D766BF742E9A472538D55E96D5E"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 16(a)(2)(A) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/56">15 U.S.C. 56(a)(2)(A)</external-xref>) is amended by striking <quote>(relating to injunctive relief)</quote>.</text></subsection><subsection id="HFDDECE5E844249F7ADC9A0D813450621"><enum>(c)</enum><header>Applicability</header><text>The amendments made by this section shall apply with respect to any action or proceeding that is pending on, or commenced on or after, the date of the enactment of this Act.</text></subsection></section></legis-body><endorsement display="yes"><action-date>July 16, 2021</action-date><action-desc>Reported from the Committee on Energy and Commerce with an amendment</action-desc><action-date>July 16, 2021</action-date><action-desc>Committee on the Judiciary discharged;
