which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Federal Communications Commission to establish a program to make grants to States for the deployment of broadband service in underserved areas by small business broadband providers, and for other purposes.</official-title></form><legis-body id="H6C63416CE5D94A51AAC359C57F9FBD72" style="OLC"><section id="H10A1CA7B36054F8AAFD782B59A996BC3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Local Telecom Expansion Act of 2021</short-title></quote>.</text></section><section id="HA2B95C90B84D427F98687A1B72EFA2EA"><enum>2.</enum><header>Small business broadband provider grant program</header><subsection id="HA21CE84FC16A465AA905630101C1E2A5"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Commission shall establish a program to make grants on a competitive basis to States for the deployment of broadband service in underserved areas by small business broadband providers.</text></subsection><subsection id="H424180B3D3EE436C8CAF4557269947C4"><enum>(b)</enum><header>Eligibility of States</header><text display-inline="yes-display-inline">The Commission may only award a grant under this section to a State that—</text><paragraph id="H2A509E86433645CF965D5209D8C5F7B2"><enum>(1)</enum><text>meets such eligibility criteria as the Commission may establish; and</text></paragraph><paragraph id="HD5D5EC9009B84480A9FA3C666D9E0717"><enum>(2)</enum><text>submits an application at such time, in such form, and with such information and assurances as the Commission may require.</text></paragraph></subsection><subsection id="H68A00658AB024ED4B22D72486B551589"><enum>(c)</enum><header>Subgrants to small business broadband providers</header><text>A State that receives a grant under this section shall use the grant funds to make subgrants to small business broadband providers to enable such providers to deploy broadband service in underserved areas in the State.</text></subsection><subsection id="H0294CFFCCD40446A9CE1A84993066081"><enum>(d)</enum><header>Use of subgrant funds</header><text>A small business broadband provider that receives a subgrant from a State under subsection (c) shall use the subgrant funds to deploy, in underserved areas in the State, broadband service with—</text><paragraph id="H8213D0DD266C4D90AE06E57C97EE4154"><enum>(1)</enum><text>a download speed of at least 25 megabits per second;</text></paragraph><paragraph id="H64BAA1B91F564EACBBB5262262B0B465"><enum>(2)</enum><text>an upload speed of at least 10 megabits per second; and</text></paragraph><paragraph id="H298FF68C2A3D46B29E0518732C2F9417" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">latency that is sufficiently low to allow real-time, interactive applications.</text></paragraph></subsection><subsection id="HB67E5839F9A44C95B86374344C2CF08F"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H87E4F8908BF8467FB36AF87E5A8B6B58" commented="no"><enum>(1)</enum><header>Broadband service</header><text>The term <quote>broadband service</quote> means broadband internet access service (as defined in section 8.1(b) of title 47, Code of Federal Regulations (or any successor regulation)).</text></paragraph><paragraph id="H47F8528E41314D84B09DED2F9028D89B"><enum>(2)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Communications Commission.</text></paragraph><paragraph id="H12A8553F783242E8A5D22931655F5588" commented="no"><enum>(3)</enum><header>Small business broadband provider</header><text display-inline="yes-display-inline">The term <quote>small business broadband provider</quote> means a provider of broadband service that is a small business concern (as defined under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)).</text></paragraph><paragraph id="HF86F23CE49B14DCE98C48831A66556AA" commented="no"><enum>(4)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each State of the United States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph><paragraph id="H1D97FBE07B9049E1820EA58FAA8268FB"><enum>(5)</enum><header>Underserved area</header><text display-inline="yes-display-inline">The term <quote>underserved area</quote> means an area in which only 1 provider of broadband service offers broadband service with—</text><subparagraph id="HBD77893CB12F4B03A2C744C829A6BA63"><enum>(A)</enum><text display-inline="yes-display-inline">a download speed of at least 25 megabits per second and not more than 99 megabits per second;</text></subparagraph><subparagraph id="H60622D1016834714BDC57C9576689C61"><enum>(B)</enum><text>an upload speed of at least 10 megabits per second; and</text></subparagraph><subparagraph id="HAAB56CB138834EE9A4C1893540FA7B81"><enum>(C)</enum><text>latency that is sufficiently low to allow real-time, interactive applications.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
