which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit law enforcement officers from using chemical weapons on minors in the course of policing activities, and for other purposes.</official-title></form><legis-body id="HE27B367A3CC14F789C591CAAFDDF953E" style="OLC"><section id="HCA547B021B1449CDB2424D59A323C18C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Children from Chemical Weapons Act</short-title></quote>.</text></section><section id="H6B8419B6629544439197E6BC6DB02973"><enum>2.</enum><header>Prohibition on law enforcement officer use of chemical weapons</header><subsection id="H6BF644ECE5604A358D55D8D010305C61"><enum>(a)</enum><header>Federal law enforcement officers</header><text display-inline="yes-display-inline">No Federal law enforcement officer may use a chemical weapon on an individual that the officer knows or has reason to believe is a minor in the course of policing activities in the United States. </text></subsection><subsection id="H73D086AF2151403993F11413963D066B"><enum>(b)</enum><header>State and local law enforcement officers</header><text display-inline="yes-display-inline">Beginning in the first fiscal year that begins after the date of enactment of this Act, in order to be eligible to receive funds under subpart 1 of part E of title 1 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151</external-xref> et seq.) and part Q of title I of such Act (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref> et seq.), a State or unit of local government shall have in place a law or policy, and be in substantial compliance with such law or policy, prohibiting law enforcement officers in that jurisdiction from using a chemical weapon on an individual that the officer knows or has reason to believe is a minor in the course of policing activities. </text></subsection></section><section id="HFA1E228FB3A448C98D00D4C07BF82090"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H21E43E2BF78E4A35BE4C41D1C5E3AC2B"><enum>(1)</enum><text>The term <term>chemical weapon</term> means the following, together or separately: </text><subparagraph id="H4F393D83FFBE4C299C5532E71507426A"><enum>(A)</enum><text display-inline="yes-display-inline">A toxic chemical and its precursors, and includes oleoresin capsicum spray. </text></subparagraph><subparagraph id="H861162F13F7C4760BF42B47429040208"><enum>(B)</enum><text>A munition or device, specifically designed to cause death or other harm through toxic properties of those toxic chemicals specified in subparagraph (A), which would be released as a result of the employment of such munition or device.</text></subparagraph><subparagraph id="HA1A9170853EC445A81803869094FA394"><enum>(C)</enum><text>Any equipment specifically designed for use directly in connection with the employment of munitions or devices specified in paragraph (2).</text></subparagraph></paragraph><paragraph id="HAAB189E3E1A2419FB982684CAC947318"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>law enforcement officer</term> means any officer of the United States, a State, or unit of local government, who is empowered by law to conduct investigations of, or make arrests because of, offenses against the United States, the District of Columbia, a State, or a political subdivision of a State, and includes a member of the Armed Forces (including any reserve component) under orders to act in a policing capacity in the United States. </text></paragraph><paragraph id="H4E68E7D13BE942778E6E3C38FD5ACA02"><enum>(3)</enum><text>The terms <term>precursor</term> and <term>toxic chemical</term> have the meanings given such terms in section 229F of title 18, United States Code.</text></paragraph><paragraph id="H1C18DCD4C9004603A4BCF7380CDAC313"><enum>(4)</enum><text>The terms <term>State</term> and <term>unit of local government</term> have the meanings given such terms in section 901 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251</external-xref>).</text></paragraph><paragraph id="H0F843EF53D934B208497913564862A6F"><enum>(5)</enum><text>The term <term>minor</term> means an individual who is younger than 18 years of age. </text></paragraph></section></legis-body></bill>
