which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, <committee-name committee-id="HII00">Natural Resources</committee-name>, <committee-name committee-id="HAG00">Agriculture</committee-name>, <committee-name committee-id="HBA00">Financial Services</committee-name>, <committee-name committee-id="HED00">Education and Labor</committee-name>, and <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide direct funding to local, Tribal, and territorial governments to establish Green New Deal programs and initiatives, and for other purposes.</official-title></form><legis-body id="H65307D1F94F94B1991E7561020C8914D" style="OLC"><section id="HA3633C874D564C61B6BA705C5299AEC3" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H6C2BA14807B740718A262BB6499CD9C5"><enum>(1)</enum><header>Climate mitigation</header><text>The term <quote>climate mitigation</quote> means policies and activities intended to reduce the greenhouse gas forcing of the climate system. </text></paragraph><paragraph id="HF062F73EF43444D690110F0B517F82B3"><enum>(2)</enum><header>FPIC</header><text display-inline="yes-display-inline">The term <quote>FPIC</quote> means free, prior, and informed consent.</text></paragraph><paragraph id="HFCD1BA5495484B33968D18744716325D"><enum>(3)</enum><header>Frontline community</header><text>The term <quote>frontline community</quote> means a community with significant representation of communities of color, low-income communities, deindustrialized communities, fossil fuel communities, or Tribal and indigenous communities, that experiences, or is at risk of experiencing, higher or more adverse climate change, human health, or environmental effects, as compared to other communities.</text></paragraph><paragraph id="H7C161CE67D254C6DB2FA6373370B204E"><enum>(4)</enum><header>Local government</header><text display-inline="yes-display-inline">The term <quote>local government</quote> means a territory or any unit of local government within a State or territory, including a county, borough, municipality, city, town, township, parish, local public authority, transit agency (including multistate transit agencies), special district, school district, intrastate district, council of governments, any other instrumentality of local government. </text></paragraph><paragraph id="H90BBD6688E884D4F8F98112715F19B67"><enum>(5)</enum><header>Local Green New Deal program proposal</header><text>The term <quote>local Green New Deal program proposal</quote> means a proposal of a local government or a Native American Nation that commits—</text><subparagraph id="HB5888D9060A04A4B817366339C88A879"><enum>(A)</enum><text>to achieve zero greenhouse gas emissions, by 2030, through a fair and just transition for all communities and workers;</text></subparagraph><subparagraph id="H7790200C82E44A5F84696709A2DD49B4"><enum>(B)</enum><text>to create hundreds of good, high-wage jobs and ensure prosperity and economic security for all people of the local government or Native American Nation;</text></subparagraph><subparagraph id="HCF21A67E0478437A84BF69C695E74B9A"><enum>(C)</enum><text>to invest in the infrastructure and industry of the local government to sustainably meet the challenges of the 21st century;</text></subparagraph><subparagraph id="H6016C395E9EA4F1198CF5640143E091E"><enum>(D)</enum><text>to secure for all people of the United States for generations to come—</text><clause id="H1FAA646B6E1142F2B38A1C85E2DA70CC"><enum>(i)</enum><text>clean air and water;</text></clause><clause id="H5ADCE7FB0C9C4DCA9EAFBEE256FDF2CA"><enum>(ii)</enum><text>climate and community resiliency;</text></clause><clause id="H9E9C6CCFE0B8414CA64C67630B0EA255"><enum>(iii)</enum><text>healthy and sustainably produced food;</text></clause><clause id="H15177C031C7F495CB6DDC942D71CF36E"><enum>(iv)</enum><text>access to nature; and</text></clause><clause id="H078A7D3BEAF349A9B05012C03BA8BAE8"><enum>(v)</enum><text>a sustainable environment; and</text></clause></subparagraph><subparagraph id="HDBCA7A7488BB44A68D8921E68C91E0E7"><enum>(E)</enum><text>to promote justice and equity by stopping current, preventing future, and repairing historic oppression of indigenous peoples, communities of color, migrant communities, deindustrialized communities, depopulated rural communities, the poor, low-income workers, women, the elderly, the unhoused, people with disabilities, incarcerated communities, and communities experiencing police violence and youth.</text></subparagraph></paragraph><paragraph id="HCCCBFC5EAFC74070B274C123090AB27B"><enum>(6)</enum><header>Native American Nation</header><text display-inline="yes-display-inline">The term <quote>Native American Nation</quote> means—</text><subparagraph id="H680172C935D0478EA3B40C0E739246EA"><enum>(A)</enum><text>the governing body of any individually identified and federally recognized Indian or Alaska Native Tribe, band, nation, pueblo, village, community, affiliated tribal group, or component reservation in the list published pursuant to section 104(a) of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131(a)</external-xref>); </text></subparagraph><subparagraph id="HA8DBF3AE96CF4E04BDCF59DA50A3CD27" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the governing body of any individually identified Indian or Alaska Native Tribe, band, nation, pueblo, village, community, affiliated tribal group, or component reservation, excluding tribal corporations; and</text></subparagraph><subparagraph id="HE39AC1BBBA0A4163AEF6C729A78A9987"><enum>(C)</enum><text>a State recognized Tribe.</text></subparagraph></paragraph></section><title id="H26228F66F8A644F3B3C4DD984584402D"><enum>I</enum><header>Green New Deal for cities, counties, States, Tribes, and territories</header><section id="H7AECD8EE22DF4FCD83E8208975A91BC6" section-type="subsequent-section"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Green New Deals for Cities Act of 2021</short-title></quote>.</text></section><section id="HAB1DB170A00A4FD8BB8D2910C0CE4804"><enum>102.</enum><header>Green New Deal for cities, towns, and Native American Nations</header><subsection id="H3097C62D409243DAAD86555CD0B4B916"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From amounts appropriated to carry out this title, the Secretary of Housing and Urban Development, in coordination with the Secretary of Energy, the Secretary of Labor, and the Office of Domestic Climate Policy, shall be allocated directly to eligible local or State entities in the same manner as amounts appropriated under sections 602 and 603 of title VI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801</external-xref> et seq.), as applicable, to carry out eligible Green New Deal projects. </text></subsection><subsection id="H074A7E6B7D4D4A779AA675AD206271C8"><enum>(b)</enum><header>Use of funds</header><text>An eligible local or State entity receiving an allocation under this section—</text><paragraph id="H56B6FCE931E3478583CFB8DE0BA44B15"><enum>(1)</enum><text>may use such funds to carry out an eligible Green New Deal project;</text></paragraph><paragraph id="HC82A7BF2B8594199B5DCC9F1DF631FAA"><enum>(2)</enum><text>shall allocate not less than 50 percent of such allocation for projects related to climate mitigation;</text></paragraph><paragraph id="H5A2028D1D94B44A1B271C659D0D10E8B"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to an eligible local or State entity that includes at least 1 frontline community, shall ensure not less than 50 percent of such allocation is invested in frontline communities; and</text></paragraph><paragraph id="HA521996E63094EE0AAB4423A0601306D"><enum>(4)</enum><text>may not use such funds for—</text><subparagraph id="H84CC8578920F4676B55241233FCA0E89"><enum>(A)</enum><text display-inline="yes-display-inline">fossil fuel procurement, development, infrastructure repair that would in anyway extend lifespan or production capacity, or any related subsidy;</text></subparagraph><subparagraph id="HF1F2317FD2DE4FE4BC3A0C71195A8485"><enum>(B)</enum><text>carbon capture and storage (CCS) or carbon capture, utilisation, and storage (CCUS);</text></subparagraph><subparagraph id="H45E813944DC242BC8CFDE5C315999292"><enum>(C)</enum><text>direct air capture;</text></subparagraph><subparagraph id="HAFC6321164814923BB88DFBC742A92A0"><enum>(D)</enum><text>the procurement of nuclear power;</text></subparagraph><subparagraph id="H15341D14A6BE4F23A09E3BE1585CE929"><enum>(E)</enum><text>research and development;</text></subparagraph><subparagraph id="H44600020D596454DAA67FFBDCDD40012"><enum>(F)</enum><text>the establishment or advancement of carbon markets, including cap and trade; </text></subparagraph><subparagraph id="H032044AE6A4144B096083532D356863A"><enum>(G)</enum><text>geoengineering;</text></subparagraph><subparagraph id="HF4811A6FBDA94A69A2496ED460FEAA33"><enum>(H)</enum><text>highway expansion;</text></subparagraph><subparagraph id="H5B01D9BDCE9941F58ACFFF7E52B419C0"><enum>(I)</enum><text>road improvements or automobile infrastructure, other than electric vehicle charging stations; </text></subparagraph><subparagraph id="HC148A712190A4447AEB241B7E4C657A7"><enum>(J)</enum><text>industrial scale bioenergy, including biofuels, biomass, and biogas, development or any related subsidy; or</text></subparagraph><subparagraph id="H8F2C7B81D4264B1AA8D5227229D748E9"><enum>(K)</enum><text display-inline="yes-display-inline">any investments or projects supporting law enforcement, immigration detention centers, and prisons, including buildings and vehicles under the control of law enforcement or a prison.</text></subparagraph></paragraph></subsection><subsection id="H8941512822B6410B80E85D0DB9B4AEFC"><enum>(c)</enum><header>Requirement</header><text>As a condition of accepting an allocation provided under this section, an eligible local or State entity shall agree to take steps, in consultation with community groups and tenant advocates, to secure existing housing in neighborhoods receiving benefits from an allocation under this section, including through the use of rent control, rent stabilization, and other methods to prevent gentrification and stabilize property values.</text></subsection><subsection id="H69C6CE539CED435E96B82991B1F5C1DF" commented="no"><enum>(d)</enum><header>Consultation</header><text>In carrying out the program established under subsection (a), the Secretary shall consult with Administration of the Environmental Protection Agency, the Assistant Secretary of the Bureau of Indian Affairs, and the Council on Environmental Quality.</text></subsection><subsection id="HC313807FBCAE4714946E16AF260EF06B"><enum>(e)</enum><header>Native American FPIC</header><text>Prior to the authorization of any project on land that may affect a Native American Nation, the Secretary shall ensure that such Nation has given FPIC.</text></subsection><subsection id="H3E2F69C1C0DA4930BDCAC39C8187EC7D"><enum>(f)</enum><header>Material requirement</header><text display-inline="yes-display-inline">In carrying out any eligible Green New Deal project that uses renewable energy materials, an eligible local or State entity shall use only renewable energy materials from Initiative for Responsible Mining Assurance (IRMA) certified mines.</text></subsection><subsection id="HED3538EAAECE41D6BFDAD923A62780CA"><enum>(g)</enum><header>Community involvement</header><text>In carrying out any eligible Green New Deal project, an eligible local or State entity shall develop a public participation plan to establish steps for ensuring decision-making inclusion of frontline communities for such eligible Green New Deal project. </text></subsection><subsection id="H5F5B556DB8BB455CAF0BE91D3274960C"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HAEA2ECE4853748FAA8775BF931BEC414"><enum>(1)</enum><header>Eligible local or State entity</header><text>The term <quote>eligible local or State entity</quote> means a State, local government, or Native American Nation that has a local Green New Deal program proposal.</text></paragraph><paragraph id="HC30970FB7E2944C59F635E6814637BB1"><enum>(2)</enum><header>Eligible Green New Deal project</header><text display-inline="yes-display-inline">The term <quote>eligible Green New Deal project</quote> includes a project and associated labor—</text><subparagraph id="H8BACC7F74D2F4126BF3E51D592EC6843"><enum>(A)</enum><text display-inline="yes-display-inline">for solar power procurement, installation, maintenance, and operations;</text></subparagraph><subparagraph id="H08834A76AF2A40538E17CDB6F8AB93DD"><enum>(B)</enum><text>for wind power procurement, installation, maintenance, coating, and operations;</text></subparagraph><subparagraph id="H466B266BF89C44A892C484A09CC2ACDF"><enum>(C)</enum><text display-inline="yes-display-inline">to carry out an American Society of Heating, Refrigerating, and Air Conditioning Engineers (ASHRAE) level II audit for commercial buildings;</text></subparagraph><subparagraph id="H6916CC9F127544378536AE88FAECB782"><enum>(D)</enum><text>to procure dialysis machines or other equipment known to save lives of the most vulnerable populations in extreme weather events that may cause power outages;</text></subparagraph><subparagraph id="HBD8A594F37D04F7BB348EF8EFFC8B15C" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">to provide grants for acquisition of private lands by Native American Land Trusts, nations, and Tribes; </text></subparagraph><subparagraph id="H66C2937CDB6E4E6BA5619D28906C0AD9"><enum>(F)</enum><text>to build electrification for heating, hot water, and cooking;</text></subparagraph><subparagraph id="H4CE7E155EBB547CFBE6D9C926EF6CFC9" display-inline="no-display-inline"><enum>(G)</enum><text>for public electric vehicle procurement;</text></subparagraph><subparagraph id="H1B2642F7AF4C4F658A0B86C6F0765F6B"><enum>(H)</enum><text>to build capacity for communities to endure extreme weather events, such as investments to cooling and heating centers and disaster preparedness; </text></subparagraph><subparagraph id="H652A7EF58AB7424593DAA14723829CC1"><enum>(I)</enum><text>for community farming initiatives that promote and foster food sovereignty; </text></subparagraph><subparagraph id="H17EC0A1906644CD2884F4214508FFB56"><enum>(J)</enum><text>to procure, install, and operate geothermal power;</text></subparagraph><subparagraph id="H58D80C1933194447AE3958D8166AFA43"><enum>(K)</enum><text>for phasing out existing fossil fuel infrastructure;</text></subparagraph><subparagraph id="H2C8AB04B7E044E36B264B22A6831D724"><enum>(L)</enum><text>for testing of soils and waters in parks, playgrounds, and other sites for hazardous and radioactive wastes as well as dangerous chemicals, including PFAS;</text></subparagraph><subparagraph id="H19BF7A4AECF74B9BA38974F8BA609209"><enum>(M)</enum><text>for the establishment of local Worker and Community Protection Funds (WCPF) to support fossil fuel workers, families of such workers, and impacted communities in the energy transition;</text></subparagraph><subparagraph id="H81BB77933C4E4E8CA2ABF58C4709B4AD"><enum>(N)</enum><text>to repair gas pipeline leaks and cover orphan wells, so long as such pipelines and wells in no way expand fossil fuel production;</text></subparagraph><subparagraph id="H6F31584C36094541BAD9BBE27103463D"><enum>(O)</enum><text>to build, expand, and maintain public parks, trails, forests, and recreation sites; </text></subparagraph><subparagraph id="HAAD774EFD5734C8999A0164A45A04146"><enum>(P)</enum><text>for installation of weatherization and efficiency measures, including reflecting coatings;</text></subparagraph><subparagraph id="HD166C35360C44C8FBD61BE1F8429279C"><enum>(Q)</enum><text>for adaptation measures; </text></subparagraph><subparagraph id="H1F61845C4A3F4CFBB5B2FAD6B39BDCDF"><enum>(R)</enum><text>to procure and install electric vehicle charging stations;</text></subparagraph><subparagraph id="H4DA6A0F1E53E439BAB78D8ED1189104B"><enum>(S)</enum><text>to remediate lead paint, mold, and asbestos; </text></subparagraph><subparagraph id="H36B319FF073F424DA532F3E0AFA48388" commented="no"><enum>(T)</enum><text>to support reparations programs for Black and Indigenous people and communities;</text></subparagraph><subparagraph id="H6A903B187641444ABE103C5AAB5C2FA8"><enum>(U)</enum><text>for investment in new or improved public green space, parks, playgrounds, or community gardens; </text></subparagraph><subparagraph id="HAF6F22B94366488992D773B71A2A071C"><enum>(V)</enum><text>for the zero energy construction or improvement of public or rent-secured housing or community land trusts;</text></subparagraph><subparagraph id="H58BE26EE372C4B62B34D926F8528C4BB"><enum>(W)</enum><text>to provide, electrify, improve, expand, maintain, or operate public transit and public school buses;</text></subparagraph><subparagraph id="H1FD6543A68AD4F49882B3499A0ADCE5B"><enum>(X)</enum><text display-inline="yes-display-inline">for remediation of a brownfield;</text></subparagraph><subparagraph id="HACF453E5F1B14CC496D7187C7780F341"><enum>(Y)</enum><text>for air quality monitoring; </text></subparagraph><subparagraph id="H8F2C462F0C0C429B8B2C57531D3673F1"><enum>(Z)</enum><text>for pollution cleanup; </text></subparagraph><subparagraph id="H3FA6957FD44B47E8B6997774ED97A967"><enum>(AA)</enum><text>to procure, install, and maintain clean drinking water infrastructure piping and transmission lines, including replacing lead pipelines;</text></subparagraph><subparagraph id="H71FE544B667A40338BAE8BE92208D56A"><enum>(BB)</enum><text>for public utility procurement, modernization, and decarbonization;</text></subparagraph><subparagraph id="HDA029AA9ADBE4B1FA526291EC62E3678"><enum>(CC)</enum><text>for wetland, forest, and public land revitalization and other climate adaptation measures; </text></subparagraph><subparagraph id="HDA1CD995FC3B48B0BAD099C2AABC2675"><enum>(DD)</enum><text>for public sanitation, broadband, and utility expansion for frontline communities;</text></subparagraph><subparagraph id="H1284E53FF7A141BBA501EC9CACA83075"><enum>(EE)</enum><text>for community solar power; </text></subparagraph><subparagraph id="H5C1390646196487DB06D12FB32019FBA"><enum>(FF)</enum><text display-inline="yes-display-inline">to construct and improve bike and pedestrian infrastructure, including bus stops and any improvements to transit infrastructure to comply with the Americans With Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101</external-xref> et seq.); </text></subparagraph><subparagraph id="HD7CB6D30055943B598C32C9521FB3116"><enum>(GG)</enum><text display-inline="yes-display-inline">for restoring public lands, watersheds, coastal areas, wildlife corridors, and other critical ecosystems, including investment in county and city parks and Tribal management of public lands; </text></subparagraph><subparagraph id="H0212E5A6BEF84C8A92014E6E7F70FACA"><enum>(HH)</enum><text>for temporary housing for low-income families receiving housing improvements; or</text></subparagraph><subparagraph id="H97674D3FB951401292EADBC569B14257"><enum>(II)</enum><text display-inline="yes-display-inline">for conservation projects on family farms, including water conservation projects, shelterbelts, and ecosystem restoration efforts. </text></subparagraph></paragraph></subsection></section><section id="H5EB9166946E049BCA144DA6AB9C9C672"><enum>103.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">For purposes of carrying out this title, there is authorized to be appropriated out of the general fund of the Treasury—</text><paragraph id="H10A4C7C4920B40B3AF4A540158C1CD30"><enum>(1)</enum><text>$400,000,000,000 for fiscal year 2022;</text></paragraph><paragraph id="H46305BABF5B44F0693E346F8369EF551"><enum>(2)</enum><text>$300,000,000,000 for fiscal year 2023;</text></paragraph><paragraph id="HE175CE297F6444968749836B834DD40C"><enum>(3)</enum><text display-inline="yes-display-inline">$200,000,000,000 for fiscal year 2024; and </text></paragraph><paragraph id="H1B6E9075BC1048399E301D1279F7AD76"><enum>(4)</enum><text>$100,000,000,000 for fiscal year 2025. </text></paragraph></section></title><title id="HE452459686F446968521B64973EDCF2E"><enum>II</enum><header>Labor standards</header><section id="H942EBE679E9942BA8EC917181F6B51F7"><enum>201.</enum><header>Labor standards requirements</header><subsection id="HCBDD4924000A4AB5BA6AFF2264FF95F4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Labor shall require an eligible local or State entity under section 102, as a condition of receiving a grant under such section, to satisfy each of the following requirements:</text><paragraph id="H5A5CB38E05B64856987DD9B17021ECA4"><enum>(1)</enum><text>The entity shall ensure that all laborers and mechanics employed by contractors and subcontractors in the performance of any applicable project shall be paid wages at rates not less than those prevailing on projects of a similar character in the locality as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code (commonly known as the <quote>Davis-Bacon Act</quote>).</text></paragraph><paragraph id="HD06D6F8B2DFA41B4936CC093A63F8E70"><enum>(2)</enum><text>The entity shall give preference to local and equitable hiring and contracting that creates opportunities for—</text><subparagraph id="H2073CB69EEF14D6793107AF0EF91D96A"><enum>(A)</enum><text>people of color;</text></subparagraph><subparagraph id="H1F2673D926FD40C2814D954A6BDB651F"><enum>(B)</enum><text>immigrants, regardless of immigration status;</text></subparagraph><subparagraph id="H12CDF591DCA84A2EA5599BC67C2330A3"><enum>(C)</enum><text>formerly incarcerated individuals;</text></subparagraph><subparagraph id="HF07F3CDAC29A42858AF39B5C2BA69E56"><enum>(D)</enum><text>women;</text></subparagraph><subparagraph id="HBC522F7AF8ED4965BBC7620D8AE138FF"><enum>(E)</enum><text>LGBTQIAP+ individuals;</text></subparagraph><subparagraph id="HD09E64AF7C604FD8B73592D566EAE8AE"><enum>(F)</enum><text>disabled and chronically ill individuals; </text></subparagraph><subparagraph id="H2562970CCD1C4C27BDA680A3863D060F"><enum>(G)</enum><text>marginalized communities; and</text></subparagraph><subparagraph id="HB5353F68CEF34A08A781D4779B44F0A2"><enum>(H)</enum><text>BIPOC employee-owned businesses and co-ops. </text></subparagraph></paragraph><paragraph id="H8F52310B540A4635BDC2D08C0041956F"><enum>(3)</enum><text display-inline="yes-display-inline">The entity shall be a party to, or require contractors and subcontractors in the performance of any applicable project to consent to, a covered project labor agreement, as long as the entity demonstrates that such agreement protects or furthers its proprietary interest in the project.</text></paragraph><paragraph id="H59029245E96C4E7CAF03F571FCC65A90"><enum>(4)</enum><text display-inline="yes-display-inline">The entity, and all contractors and subcontractors in performance of any applicable project, shall abide by prevailing wage standards, prioritize Project Labor Agreements, and prioritize local hiring and targeted hiring provisions.</text></paragraph><paragraph id="HA0F8A304D8F747BBB22D506579778487"><enum>(5)</enum><text>The entity, and all contractors and subcontractors in the performance of any applicable project, shall not require mandatory arbitration for any dispute involving a worker engaged in a service for the entity.</text></paragraph><paragraph id="HA9B07533B2074BF19F1DC2541BA52B71"><enum>(6)</enum><text>The entity, and all contractors and subcontractors in the performance of any applicable project, shall consider an individual performing any service in such performance as an employee (and not an independent contractor) of the entity, contractor, or subcontractor, respectively, unless—</text><subparagraph id="HC2E79CCBBC5B47398F72DC39B3CE1327"><enum>(A)</enum><text>the individual is free from control and direction in connection with the performance of the service, both under the contract for the performance of the service and in fact;</text></subparagraph><subparagraph id="H7313155D30674303AD2A69B94255895F"><enum>(B)</enum><text>the service is performed outside the usual course of the business of the entity, contractor, or subcontractor, respectively; and</text></subparagraph><subparagraph id="HBA534013355C4780BEA67B9A6FE123D8"><enum>(C)</enum><text>the individual is customarily engaged in an independently established trade, occupation, profession, or business of the same nature as that involved in such service.</text></subparagraph></paragraph><paragraph id="HCD3FF3D753574C30A2ADEE922D5AC74E"><enum>(7)</enum><text>The entity shall prohibit the employees of all contractors and subcontractors in the performance of any applicable project from hiring employees through a temporary staffing agency unless the relevant State workforce agency certifies that temporary employees are necessary to address an acute, short-term labor demand. The entity may not prohibit the use of certified union hiring halls. </text></paragraph><paragraph id="H50E11FD727E74F7588A5176777E31587"><enum>(8)</enum><text>The entity shall require all contractors, subcontractors, successors in interest of the entity, and other entities that may acquire the entity, in the performance or acquisition of any applicable project, to have—</text><subparagraph id="HEAEDCB3C09AF4255A95593D9FDACB9CC"><enum>(A)</enum><text>an explicit policy of neutrality with regard to—</text><clause id="H4EE90C5BB1C64976A8149E9924CC2871"><enum>(i)</enum><text display-inline="yes-display-inline">labor organizing for the employees of the contractor or subcontractor employed in the performance of the eligible project; and</text></clause><clause id="HB27F28A63D8E45DDA0A46E1B294B9AB0"><enum>(ii)</enum><text display-inline="yes-display-inline">such employees’ choice to form and join labor organizations; and </text></clause></subparagraph><subparagraph id="H96FF7B8223384EBC8DF3E28F8908C078"><enum>(B)</enum><text>policies that require—</text><clause id="H9823C9AA2A0C4471BD05956A052BE704"><enum>(i)</enum><text display-inline="yes-display-inline">the posting and maintenance of notices in the workplace to such employees of their rights under the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151</external-xref> et seq.); and</text></clause><clause id="H34BC370D0C6A48D29CC08D1171106B66"><enum>(ii)</enum><text display-inline="yes-display-inline">that such employees are, at the beginning of their employment in the performance of the eligible project, provided notice and information regarding the employees’ rights under such Act.</text></clause></subparagraph></paragraph><paragraph id="H98C543009F664B63B7B311BDA52D2D2E"><enum>(9)</enum><text>The entity shall, for each skilled craft employed on any applicable project, demonstrate an ability to use and commit to use individuals enrolled in a Department of Labor registered apprenticeship program under subpart A of part 29 of title 29, Code of Federal Regulations, which such individuals shall, to the greatest extent practicable, constitute not less than 20 percent of the individuals working on such project.</text></paragraph><paragraph id="H8A29C3E270E7480090C0B47670399132"><enum>(10)</enum><text>The entity shall fund and utilize, and, where appropriate, establish, a robust pre-apprenticeship and workforce development program, to serve BIPOC communities, in consultation with appropriate labor organizations. </text></paragraph><paragraph id="HA66EBA557B45410F8567409AC48EFBD6"><enum>(11)</enum><text>The entity, and all contractors and subcontractors in the performance of any applicable project, shall not request or otherwise consider the criminal history of an applicant for employment before extending a conditional offer to the applicant, unless—</text><subparagraph id="H9230ED077062432190C2E3A8F4B8DD5F"><enum>(A)</enum><text>a background check is otherwise required by law; or</text></subparagraph><subparagraph id="HC775D1CE6E8D462D8D608E14152A0E92"><enum>(B)</enum><text>the Secretary, in consultation with the Secretary of Energy, certifies that precluding criminal history prior to the conditional offer would pose a threat to national security.</text></subparagraph></paragraph><paragraph id="HA6C1CB82311F449293C76F9B8DE29F90"><enum>(12)</enum><text display-inline="yes-display-inline">The entity shall exclude companies that have been found guilty of wage theft or Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651</external-xref> et seq.) safety violations. </text></paragraph></subsection><subsection id="HFE4E6352E5B3462190046294FDF48591"><enum>(b)</enum><header>Davis-Bacon act</header><text>The Secretary of Labor shall have, with respect to the labor standards described in subparagraph (A)(i), the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and section 3145 of title 40, United States Code.</text></subsection></section><section id="HFCCC558FA99E42399356B4E6B10316E1"><enum>202.</enum><header>Buy America requirements</header><subsection id="HB34E7B8996314EECAD112682696157EF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For all goods and materials an entity purchases in whole or in part with funds provided by this Act, the entity shall be required to comply with, and ensure compliance by all contractors, subcontractors, and suppliers of contractors of, the domestic content provisions of the section 5323(j) of title 49, United States Code, and all applicable Federal labor and employment laws.</text></subsection><subsection id="HFFEF4F8FA21F4387A407475CD1FD3DBB"><enum>(b)</enum><header>Inclusive procurement policies</header><text>Notwithstanding any federal laws or regulations to the contrary, the entity may adhere to an inclusive procurement policy for all goods and materials that are part of any project funded in whole or in part by this Act that includes any of the following:</text><paragraph id="HE2A6675FB2DD4CAB894DB4554DE82769"><enum>(1)</enum><text>Greater domestic content than is required by Federal law.</text></paragraph><paragraph id="H2822116078E4466F83CE8E14273412EB"><enum>(2)</enum><text>A disclosure and evaluation of the embedded carbon emissions of all industrial products.</text></paragraph><paragraph id="H22EA3BBA736146D997FF42F0E4AF1A5A"><enum>(3)</enum><text>Requirements for disclosure by the contractors, subcontractors, and suppliers of contractors of—</text><subparagraph id="H1893E34B6C2D4B10B15514A4FC33F4F1"><enum>(A)</enum><text>wages and benefits of employees of the contractor, subcontractor, and suppliers;</text></subparagraph><subparagraph id="HD287D3F78D7C43C2978F06F237D6AF70"><enum>(B)</enum><text>training program commitments for employees and potential employees; and</text></subparagraph><subparagraph id="H0FF7B664C28F4A2CA3A154399B0CFC92"><enum>(C)</enum><text>targeted hiring commitments for members of disadvantaged communities, including veterans, women, low-income populations, and formerly incarcerated individuals.</text></subparagraph></paragraph><paragraph id="H49165B0486604B2E8CEB2EAD9813790D"><enum>(4)</enum><text>Job quality evaluation and incentives.</text></paragraph><paragraph id="H53F620EBD6CC4FED8D557624D6ABCC17"><enum>(5)</enum><text>Job quality commitment enforcement, including contract enforcement provisions for adherence to job quality commitments. </text></paragraph><paragraph id="HD2727CA8CEF44E16AB3CC45441D85E99"><enum>(6)</enum><text>Transparency to the public of job quality commitments and adherence to such commitments. </text></paragraph></subsection></section></title></legis-body></bill>
