R. 2640</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210419">April 19, 2021</action-date><action-desc><sponsor name-id="H001058">Mr. Huizenga</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Labor-Management Reporting and Disclosure Act of 1959 to require the authorization of members of a labor organization before such organization may make certain political expenditures, and for other purposes.</official-title></form><legis-body id="H2185BFD4D7424903B2564D1BD02B7BB3" style="OLC"><section id="H90875F5712F94B49B01D24F96782A26D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Union Member Protection Act</short-title></quote>.</text></section><section id="H582390F116A34F7896D6C2D1CF4694BB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H72EA32B455D640C4846209FE66874FA4"><enum>(1)</enum><text>Labor unions make significant political contributions and expenditures that directly or indirectly influence the election of candidates and support or oppose political causes. Decisions to use union dues for political contributions and expenditures are usually made by union leadership and management, rather than union membership.</text></paragraph><paragraph id="H2DB7B6350B854675B6EFF8E636E584D9"><enum>(2)</enum><text>Unions, acting through their management, should be obligated to conduct business in the best interests of their membership.</text></paragraph><paragraph id="H6FAADFC71235498E85CDAE9A716028CA"><enum>(3)</enum><text>Historically, union members have not had a way to know, or to influence, the political activities of unions that are supposed to represent them. Union members and the public have a right to know how unions are spending members’ dues to make political contributions or expenditures benefitting candidates, political parties, and political causes.</text></paragraph><paragraph id="HB3931936720D461C9B4A9A978E27ACBA"><enum>(4)</enum><text>Unions should be accountable to their membership in making political contributions or expenditures affecting Federal governance and public policy. Requiring the express approval of a union’s membership for political contributions or expenditures will establish necessary accountability.</text></paragraph></section><section id="HBBB669D78105464FA4FD1E0EC5C31D4C"><enum>3.</enum><header>Disclosure and approval of certain political expenditures</header><subsection id="HD721D377047841A8B0BF91B142337383"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title II of the Labor-Management Reporting and Disclosure Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/29/431">29 U.S.C. 431</external-xref> et seq.) is amended by inserting after section 201 the following:</text><quoted-block display-inline="no-display-inline" id="H05A040A51DB94DDFBCCA88AEC935C7E5" style="OLC"><section id="H70F9925344B2450A93AC0AC756B6CFAC"><enum>201A.</enum><header>Disclosure and approval of certain political expenditures by labor organizations</header><subsection id="HBEA7E679E8B04470ABD5C788C8AC9891"><enum>(a)</enum><header>Disclosure</header><text display-inline="yes-display-inline">The report required under section 201 shall contain, in a clear and simple format—</text><paragraph id="H930870ABB7FC402DA126A79B16BBD866"><enum>(1)</enum><text>a description of the specific nature of any expenditures for political activities proposed to be made by the labor organization for the forthcoming fiscal year, to the extent the specific nature is known to the labor organization and including the total amount of such proposed expenditures; and</text></paragraph><paragraph id="H950582C21563416BB3BA148F2C7097C9"><enum>(2)</enum><text display-inline="yes-display-inline">a disclosure of how each officer of the labor organization voted to authorize or not to authorize each expenditure for political activities made by the labor organization during the preceding fiscal year.</text></paragraph></subsection><subsection id="H63600EDA4209486DB80C83F78AE9F7BA"><enum>(b)</enum><header>Restriction on expenditures</header><text display-inline="yes-display-inline">No labor organization shall make any expenditure for political activities in any fiscal year unless—</text><paragraph id="H206DBF06D2CB4CE4AB6A7D80FF5BAA54"><enum>(1)</enum><text display-inline="yes-display-inline">such expenditure is of the nature of those proposed by the labor organization pursuant to subsection (a); and</text></paragraph><paragraph id="H72A746D97CA9462D83E3E2A5ACC41660"><enum>(2)</enum><text display-inline="yes-display-inline">the full, free, and written authorization for such expenditures has been granted by a majority of the members of the labor organization.</text></paragraph></subsection><subsection id="H53D44925070D4D82B2C70D856BB56C5D"><enum>(c)</enum><header>Mechanism for obtaining authorization</header><text>Not later than 1 year after the date of enactment of the <short-title>Union Member Protection Act</short-title>, every labor organization shall adopt a mechanism for obtaining, by secret ballot, the authorization of its members as required under subsection (b)(2).</text></subsection><subsection id="H019DF18FD7754F4283DF1AF8580D38DD"><enum>(d)</enum><header>Liability</header><text display-inline="yes-display-inline">The officers of a labor organization who authorize an expenditure without first obtaining the authorization of members required under subsection (b)(2) shall be jointly and severally liable in any action brought in any court of competent jurisdiction to any member of the labor organization or class of members for the amount of dues paid by such member or class of member during the 1-year period prior to the date that such expenditure was made.</text></subsection><subsection id="H3A01CA6D04334AD59AAD7AA3B047D9F8"><enum>(e)</enum><header>Definition of expenditure for political activities</header><text display-inline="yes-display-inline">As used in this section:</text><paragraph id="H9A3D5B6DF5064C83A05AC1129B1D00D7"><enum>(1)</enum><text>The term <term>expenditure for political activities</term> means—</text><subparagraph id="HAA090BDD3BF645ABAE6938B9911592DB"><enum>(A)</enum><text>an independent expenditure, as such term is defined in section 301(17) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/431">2 U.S.C. 431(17)</external-xref>);</text></subparagraph><subparagraph id="H27FAFD5C003A4C4B90143899FE56C5F8"><enum>(B)</enum><text>contributions to any political party, committee, or electioneering communication, as such term is defined in section 304(f)(3)(A) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434(f)(3)(A)</external-xref>); and</text></subparagraph><subparagraph id="HB088FAEE36244BC898BBC836192AA0AF"><enum>(C)</enum><text>dues or other payments to trade associations or other tax exempt organizations that are, or could reasonably be anticipated to be, used for the purposes described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HB5D3424B486840C0A4CE6949774C84A9"><enum>(2)</enum><text>Such term shall not include—</text><subparagraph id="H7B7F61BC635D4F7BB0E36B582847B14B"><enum>(A)</enum><text>direct lobbying efforts through registered lobbyists employed or hired by the labor organization;</text></subparagraph><subparagraph id="H791B8DA7399B421A9464A3D68B53586C"><enum>(B)</enum><text display-inline="yes-display-inline">communications by a labor organization to its members and executive or administrative personnel and their families; or</text></subparagraph><subparagraph id="H7C585CC3F1EF43078D25D48D7B4221DF"><enum>(C)</enum><text display-inline="yes-display-inline">the establishment, administration, and solicitation of contributions to a separate segregated fund to be utilized for political purposes by a labor organization.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1E9C4F457E47466D9FF5B7B2FB187D82"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="H3CFEC362586F4E81B0119F27813BAE1D"><enum>(1)</enum><text>Section 201(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/431">29 U.S.C. 431(c)</external-xref>) is amended by striking <quote>make available the information required to be contained in</quote> and inserting <quote>provide</quote>.</text></paragraph><paragraph id="H810ACA94DF14463EBC73597A3AE01715"><enum>(2)</enum><text>Section 209(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/439">29 U.S.C. 439(a)</external-xref>) is amended by inserting <quote>other than section 201A</quote> after <quote>this title</quote>.</text></paragraph></subsection></section><section id="H26E451D6622247A5AE9D20048F96E783"><enum>4.</enum><header>Requirement of vote by principal officers</header><text display-inline="no-display-inline">Section 201 of the Labor-Management Reporting and Disclosure Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/29/431">29 U.S.C. 431</external-xref>) is further amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HA183FBD0C317410398B7300B20A063A6" style="traditional"><subsection id="HA77C550DB8BB489AACB19F2B9B754388"><enum>(f)</enum><text display-inline="yes-display-inline">The bylaws required under this section shall expressly provide for a vote of the principal officers of the labor organization on any individual expenditure for political activities (as such term is defined in section 201A(e)) in excess of $50,000. A labor organization shall make publicly available the individual votes of principal officers required by the preceding sentence within 48 hours of the vote, including in a clear and conspicuous location on the Internet website of the labor organization.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HEF90579B7EBD44DFA33FA39E5DB63AF3"><enum>5.</enum><header>Report</header><text display-inline="no-display-inline">The Comptroller General of the United States shall annually conduct a study on the compliance with the requirements of this Act and the amendments made by this Act by labor organizations and their management. Not later than April 1 of each year, the Comptroller General shall submit to Congress a report of such study.</text></section><section id="HBE80EC6636B94891ACEB5ADBF2B43C8B"><enum>6.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the later of—</text><paragraph id="H26FBD161EF2648B69550D697DEE838F6"><enum>(1)</enum><text>the date of enactment of this Act; and</text></paragraph><paragraph id="H6B45D8669AD74117BE922E58277C2B38"><enum>(2)</enum><text>the date that the bill H.R. 1087, introduced in the House of Representatives during the 117th Congress, is enacted into law.</text></paragraph></section></legis-body></bill>
