<section id="HBB64AA7FAF864D6FBA52AB3B96550417"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H3AF0E7749EBC47E8809AEB7C6BA3AF0A"><enum>(1)</enum><header>Afforestation</header><text display-inline="yes-display-inline">The term <term>afforestation</term> means a project or activity to establish a forest or stand of native trees in an ecosystem where there is not a forest or tree cover, consistent with the best available science.</text></paragraph> 
<paragraph id="H3CA2D624851745DFA923B5F3437C5465"><enum>(2)</enum><header>Forest carbon flux</header><text display-inline="yes-display-inline">The term <term>forest carbon flux</term> means the net annual change in carbon residing within forest carbon pools and in forest carbon stock.</text></paragraph> <paragraph id="H0377D51E236945D1B993F688326F1E56"><enum>(3)</enum><header>Forest carbon pools</header><text display-inline="yes-display-inline">The term <term>forest carbon pools</term> means the individual, nonoverlapping categories where forest carbon resides and includes—</text> 
<subparagraph id="H016C3D130AA440178806C4A40AF909B4"><enum>(A)</enum><text>aboveground biomass, belowground biomass, dead wood, litter, and mineral and organic soils in forest ecosystems, woodlands, and trees outside forests including urban trees; and</text></subparagraph> <subparagraph id="H409564793262432FAB460A93F3876299"><enum>(B)</enum><text>harvested wood products (in use or in solid waste disposal sites).</text></subparagraph></paragraph> 
<paragraph id="H293FEEBA6B8C480F8151FCAB18A847D7"><enum>(4)</enum><header>Forest carbon stock</header><text>The term <term>forest carbon stock</term> means the absolute quantity of carbon stored within all forest carbon pools. </text></paragraph> <paragraph id="HE93B451713694145867E16CA5FD9A9C4"><enum>(5)</enum><header>Forest plan</header><text>The term <term>forest plan</term> means—</text> 
<subparagraph id="HAAAA0E208FA5444B872F6E783356C720"><enum>(A)</enum><text>a land use plan prepared by the Bureau of Land Management for public lands pursuant to section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>); or</text></subparagraph> <subparagraph id="HD3B9C5FBB29546C7BD3F4A2DCFE6C670"><enum>(B)</enum><text>a land and resource management plan prepared by the Forest Service for a unit of the National Forest System pursuant to section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>). </text></subparagraph></paragraph> 
<paragraph id="HE4A14C46BFC048158C5F9BC4AF4FBE40"><enum>(6)</enum><header>Forest management activity</header><text>The term <term>forest management activity</term> means a project or activity carried out by the Secretary concerned on National Forest System lands or public lands consistent with the forest plan covering the lands.</text></paragraph> <paragraph id="HABBCA9BC19E249348101420487166C85"><enum>(7)</enum><header>National forest system</header><text>The term <term>National Forest System</term> has the meaning given that term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph> 
<paragraph id="H0E698563CCCF478AA7D063A3A58C2826"><enum>(8)</enum><header>Public lands</header><text>The term <term>public lands</term> has the meaning given that term in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text></paragraph> <paragraph id="HB5AA623DAE8E4BDE89D899CEB497E44D"><enum>(9)</enum><header>Reforestation</header><text display-inline="yes-display-inline">The term <term>reforestation</term> means the act of renewing tree cover by establishing young trees through natural regeneration, natural regeneration with site preparation, or planting.</text></paragraph> 
<paragraph id="H69E439EFD23E4C99BB7E0A6F773AFDE1"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph> <paragraph id="H07319A2D87154227AA7C295D92D04D0C"><enum>(11)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text> 
<subparagraph id="H49E1C63CD2794807A870B4DBBDB3C3C0"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to National Forest System lands; and</text></subparagraph> <subparagraph id="HE8B9F76B50344428BD989D283E45A688"><enum>(B)</enum><text>the Secretary of the Interior, with respect to public lands.</text></subparagraph></paragraph> 
<paragraph id="H90E04108CE694FF4BB40689EF24138C4"><enum>(12)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means the Secretary of Agriculture and the Secretary of Interior.</text></paragraph></section> <title id="H12B96A79BB65427DBB8285116AAAB4A6"><enum>I</enum><header>Carbon Sequestration Through Reforestation Activities</header> <subtitle id="H5E6A3825C7964E80A9623D7C69507452"><enum>A</enum><header>Reforestation Goals</header> <section id="H4D1A50BB9DE94A22A52657B142BDBE08"><enum>101.</enum><header>National forest carbon stock targets</header> <subsection id="HAF00A8269395442C90E43143EA84AE3E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Secretary shall set targets for increased forest carbon stock for the purposes of sequestering and storing carbon while meeting other resource management objectives. Such targets shall—</text> 
<paragraph id="H53DB3526702D46C388608A87CC3C7A24"><enum>(1)</enum><text>be based on the best available scientific information;</text></paragraph> <paragraph id="H769522E0027C425F98799AD69D1CEEE8"><enum>(2)</enum><text>consider both natural and artificial regeneration, with an emphasis on the regeneration of native species;</text></paragraph> 
<paragraph id="H3671D53C72BC446CA63B30DBBEE48ED5"><enum>(3)</enum><text>be established at levels, consistent with other statutory management purposes on Federal lands, which represent the optimal feasible and sustainable increase in the forest carbon stock private, State, Tribal, and Federal landowners can achieve by January 1, 2030, and every 10 years thereafter through January 1, 2100;</text></paragraph> <paragraph id="HD8CD93687B93490D80D16551988DF7FA"><enum>(4)</enum><text>be informed by the report provided by the Trillion Trees Task Force established in section 102;</text></paragraph> 
<paragraph id="HBFFDF6FC83C941638A1ECA7409630A85"><enum>(5)</enum><text>incorporate data from the forest inventory and analysis program under section 3(e) of the Forest and Rangeland Renewable Resources Research Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/1642">16 U.S.C. 1642(e)</external-xref>) and other applicable Federal agency data;</text></paragraph> <paragraph id="H4A122BAC94F2465AB9CAF83803E55281"><enum>(6)</enum><text>be consistent with multiple use and sustained yield requirements, policies, and objectives on National Forest, State, Tribal, and other public or private land;</text></paragraph> 
<paragraph id="HBF308562A9D1413EA548A46A4040E64E"><enum>(7)</enum><text display-inline="yes-display-inline">be consistent with other benefits related to forest function and health including soil health and productivity, wildlife habitat and biodiversity, improved air and water quality, job creation, outdoor recreation, and forest products and byproducts;</text></paragraph> <paragraph id="H0A8C5B9FD53A4DD395C22E906ECB64F3"><enum>(8)</enum><text>be established at levels that account for—</text> 
<subparagraph id="HB37CFA1210FE4B5980A2DCB2FBA0E2CE"><enum>(A)</enum><text>long-term and short-term carbon sequestration and storage; </text></subparagraph> <subparagraph id="H2B7B13DB75504A43B374A16C91510B25"><enum>(B)</enum><text>forest carbon flux; and</text></subparagraph> 
<subparagraph id="HD4476F4E32854322B8A223EA371AEACB"><enum>(C)</enum><text>assessments of existing forested acres, considering variations in landscape;</text></subparagraph></paragraph> <paragraph id="HC9ADCF3D91C6467EA8CD3222661104BE"><enum>(9)</enum><text>incorporate input from State, Tribal, and local stakeholders and members of the public; and</text></paragraph> 
<paragraph id="H4748959F5BD447778EFC948EEAB89890"><enum>(10)</enum><text>be published in the Federal Register, together with a statement of the basis and justification for such targets.</text></paragraph></subsection> <subsection id="H5BF9B2451B08427F876898C7FA396B3A"><enum>(b)</enum><header>Natural regeneration</header><text>In this subsection, the term <term>natural regeneration</term> means the establishment of a tree or tree age class from natural seedling, sprouting, or suckering, in accordance with the management objectives of an applicable forest plan.</text></subsection> 
<subsection id="HD08C333F2BB84D5E8D1238A611B0279A"><enum>(c)</enum><header>Clarification</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to establish any requirements with respect to private landowners.</text></subsection></section> <section id="H33609A1052A5412CB35F62C4B935C17E"><enum>102.</enum><header>Trillion Trees Task Force</header> <subsection id="H96821A67578A4829BEBF8F3D553C7C7E"><enum>(a)</enum><header>Establishment</header><text>Not later than 6 months after the date of the enactment of this section, the Secretary shall establish the Trillion Trees Task Force (in this section referred to as the <quote>task force</quote>) to assist the Secretary with meeting the targets and purposes established under section 101(a).</text></subsection> 
<subsection id="H7A00F12D70E7411BA5124718D78B1344"><enum>(b)</enum><header>Duties of the task force</header> 
<paragraph id="HF095B3897EA842D6980A4F13C6B45783"><enum>(1)</enum><header>Report</header><text>Not later than 1 year after the date the task force is established under subsection (a), the task force shall submit to the Secretary a report that includes—</text> <subparagraph id="HA3B566FF6AD343C381A6008B9415FC4D"><enum>(A)</enum><text>recommendations for the national forest carbon stock targets established under section 101;</text></subparagraph> 
<subparagraph id="HFCB9EE66E372482AB1D61BB829A3D29B"><enum>(B)</enum><text>plant growth targets, including long-term growth targets, required to achieve the national forest carbon stock targets established under section 101, taking into account—</text> <clause id="H27C71AD9A4874310B254C00533A5F03A"><enum>(i)</enum><text>forest carbon flux;</text></clause> 
<clause id="H87E83315771346D58CB69CBC384BC48D"><enum>(ii)</enum><text>multiple use and sustained yield requirements, policies, and objectives;</text></clause> <clause id="HDEFAE7E437A848C792A765B4139953C3"><enum>(iii)</enum><text>natural regeneration;</text></clause> 
<clause id="HD32F3D9A54B24AFCB9157A282FBF2948"><enum>(iv)</enum><text>adverse natural and anthropogenic disturbances; and</text></clause> <clause id="H2CA180F9D69E44B58B61738981D62C6B"><enum>(v)</enum><text>other factors impacting domestic forestlands; and</text></clause></subparagraph> 
<subparagraph id="H7CFED94896394D4D97B5667597F7BD08"><enum>(C)</enum><text>program and policy recommendations designed to achieve the national forest carbon stock targets established under section 101, while—</text> <clause id="H287683BEFEC548DE9C447A0D0BB110DD"><enum>(i)</enum><text>still maintaining sustainable levels of board feet harvested from public lands;</text></clause> 
<clause id="HC3000922E2184771B3618672A967A996"><enum>(ii)</enum><text>promoting forest products markets, including for new and innovative forest products and byproducts; and</text></clause> <clause id="HD865D1AADF584831983FC31DEA5515E2"><enum>(iii)</enum><text>improving the natural regeneration of public and private forests (with an emphasis on the regeneration of native species) through active forest management.</text></clause></subparagraph> </paragraph> 
<paragraph id="H25B0EF5E13CE4B5A9D4A387445CC9A94"><enum>(2)</enum><header>Oversight</header><text>Following the submission of the report described in paragraph (1), the task force shall provide continued oversight of the implementation of the national forest carbon stock targets, and provide the Secretary with—</text> <subparagraph id="H6E80529FDD494F39B13355C7ADD73574"><enum>(A)</enum><text>yearly reports on the progress made towards achieving the national forest carbon stock targets established under section 101; and</text></subparagraph> 
<subparagraph id="H8B51279A59D641A1BBE50BE60269135E"><enum>(B)</enum><text>ongoing program and policy recommendations designed to achieve the national forest carbon stock targets established under section 101.</text></subparagraph></paragraph> <paragraph id="HF675BCBF8B9F4CF7B5CDC145DF34D37F"><enum>(3)</enum><header>Reports to Congress</header><text>The task force shall—</text> 
<subparagraph id="HBEE609F3ED27438DA2EC3F4B676CD13D"><enum>(A)</enum><text>submit to Congress a copy of the report under paragraph (1); and</text></subparagraph> <subparagraph id="HD29EE71458264E0A9CD8E41FDFB9E9FF"><enum>(B)</enum><text>not later than 2 years after the report under paragraph (1) is submitted to the Secretary and Congress, and every 5 years thereafter, submit a report to Congress on the implementation of, and progress towards meeting, the targets set under section 101.</text></subparagraph></paragraph></subsection> 
<subsection id="HABD39EF161234FACA984666E315DB380"><enum>(c)</enum><header>Membership</header> 
<paragraph id="H736EC2146C3D4DCF90C47D4D79F7AD1A"><enum>(1)</enum><header>Appointment</header><text>The task force shall consist of 15 ex officio members and 15 discretionary members.</text> <subparagraph id="H1B9E58A723B94F4EABBC3683DE7FFA99"><enum>(A)</enum><header>Ex officio members</header><text>The President shall appoint 15 representatives from the executive branch.</text> </subparagraph> 
<subparagraph id="H78D4BFF986394793BA85D058F6FEB015"><enum>(B)</enum><header>Discretionary members</header><text>The Secretary shall appoint 1 discretionary member from each of the following:</text> <clause id="H8BEBB71C2F3E47758388AA53BE0ACFD3"><enum>(i)</enum><text>A State land management agency.</text></clause> 
<clause id="HAC35F1F04AB64F059D53482A308BA918"><enum>(ii)</enum><text>A private forest landowner with total land holdings of greater than 1,000,000 acres.</text></clause> <clause id="H1817A2668B0547D48D07F0127FC61DFB"><enum>(iii)</enum><text>A private forest landowner with total land holdings of less than 1,000,000 acres.</text></clause> 
<clause id="HA301C17C35C74B0281F47885878663CD"><enum>(iv)</enum><text>A family forest landowner.</text></clause> <clause id="H66F172471AD8451DB574D1D443D1C205"><enum>(v)</enum><text display-inline="yes-display-inline">A pulp or paper manufacturer which receives wood fiber directly or indirectly from Federal timber for a portion of their fiber supply.</text></clause> 
<clause id="H34E544EA547044489852CA20D0416BF8"><enum>(vi)</enum><text>A sawmill or engineered wood producer which relies on the sale of Federal timber for at least 25 percent of their fiber supply.</text></clause> <clause id="H5C31BA5441F243F492DCE04EF194C919"><enum>(vii)</enum><text>An energy company, cooperative, pellet fuel producer, or utility which provides customers with energy at least partially derived from the combustion of wood biomass.</text></clause> 
<clause id="H4E78EEFEDF414D588BF8FCCC99EEA843"><enum>(viii)</enum><text>A land conservation nonprofit with previous experience in collaborative forestland restoration projects greater than 100,000 acres.</text></clause> <clause id="H50DD1B9DB1A04B1F9E9A35A9E32E5348"><enum>(ix)</enum><text>A Tribal land management agency or resource management organization with previous experience managing Tribal timberland.</text></clause> 
<clause id="HEBB0C0D0FBC546E4899A1AFDFAA78404"><enum>(x)</enum><text>A wildlife conservation nonprofit with previous experience in collaborative forestland restoration projects greater than 100,000 acres.</text></clause> <clause id="HB25F18E1B32E4F7BB319185253939F22"><enum>(xi)</enum><text>An entity with experience in wildlife habitat restoration projects less than 100,000 acres.</text></clause> 
<clause id="HA8E9AFDD6D564837BA37971CA2F792B8"><enum>(xii)</enum><text>An urban or community resource conservation organization, with previous experience in urban and community reforestation projects.</text></clause> <clause id="HFCE5337DCFDF48BCBF30B05B0E163742"><enum>(xiii)</enum><text>An organization with previous experience in projects of any size that increase public access or outdoor recreation opportunities on National Forest System lands.</text></clause> 
<clause id="HB5113DDF9F124B42A9145179B46FF243"><enum>(xiv)</enum><text>A company or organization with experience in sustainable buildings or mass timber construction.</text></clause> <clause id="H2C0E120297464BCCB402D720AF7B9FE1"><enum>(xv)</enum><text>An academic or scientific institution with experience researching forest carbon stock in domestic forests.</text></clause></subparagraph></paragraph> 
<paragraph id="H4E0003A8716145E7AB6D3D929C12F6E7"><enum>(2)</enum><header>Discretionary member terms</header> 
<subparagraph id="H76043FECF86749BEAF3FA91582455271"><enum>(A)</enum><header>Appointment and removal</header><text>Each discretionary member appointed to the task force under paragraph (1)(B) may be appointed and removed at the discretion of the Secretary.</text></subparagraph> <subparagraph id="H7994E46FBFD348E1A19C4A402B6FB761"><enum>(B)</enum><header>Vacancy</header><text>A discretionary member that is removed under subparagraph (A) shall be replaced not later than 6 months after such removal.</text></subparagraph></paragraph> 
<paragraph id="HD65C0A01D69D41FFAB28E8D8DCBDA65C"><enum>(3)</enum><header>Quorum</header> 
<subparagraph id="H0F6C6A6D346543DFAF3E5AF8D0D99B54"><enum>(A)</enum><header>In general</header><text>A quorum shall consist of 10 ex officio members and 10 discretionary members of the task force.</text></subparagraph> <subparagraph id="HAC86434CF7B447ACB780F23E4D9FDC43"><enum>(B)</enum><header>Decisions</header><text>Decisions of the task force shall be made by majority vote, a quorum being present.</text></subparagraph></paragraph> 
<paragraph id="H726F48A5F61F48A3BB6EBE7C93EB3EF0"><enum>(4)</enum><header>Preservation of public advisory status</header><text>No individual may be appointed to the task force as a discretionary member under paragraph (1)(B) while serving as an officer or employee of the Federal Government.</text></paragraph> <paragraph id="H2C6A786D3E2D4ADD9FBE4C59D2EA44AB"><enum>(5)</enum><header>Pay and expenses</header> <subparagraph id="H4C7D593F55FD4315970F3F1498DB5641"><enum>(A)</enum><header>Compensation</header> <clause id="H78D51B5C508B4DB880824D03E7157261"><enum>(i)</enum><header>Federal employee members</header><text>All members of the task force who are officers or employees of the United States shall serve without compensation in addition to that received for their services as officers or employees of the United States.</text></clause> 
<clause id="H286E08BE5A90497A8ABE818472F06AE1"><enum>(ii)</enum><header>Non-Federal employee members</header><text>All members of the task force not described in clause (i) shall serve without compensation. </text></clause></subparagraph> <subparagraph id="H9A25DB7A09834AF7A4FA3080828DA787"><enum>(B)</enum><header>Reimbursement</header><text>A member of the task force may be reimbursed for travel and lodging incurred while attending a meeting of the task force or any other meeting of members approved for reimbursement by the task force in the same amounts and under the same conditions as Federal employees under section 5703 of title 5, United States Code.</text></subparagraph> 
<subparagraph id="H6F73EF6B3CC54F3F8E0B8126A552906A"><enum>(C)</enum><header>Expenses</header><text>The expenses of the task force that the Secretary determines to be reasonable and appropriate shall be paid by the Secretary.</text></subparagraph></paragraph> <paragraph id="H8D4008335CAF436EB1C663B59456A806"><enum>(6)</enum><header>Administrative support, technical services, and staff support</header><text>The Secretary shall make personnel of the Department of Agriculture available to the task force for administrative support, technical services, and staff support that the Secretary determines necessary to carry out this section.</text></paragraph> </subsection> 
<subsection id="H0A85350FB6F44FC494EFDBC7F89FB5E1"><enum>(d)</enum><header>Federal Advisory Committee Act</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the task force.</text></subsection></section> <section id="HB863E05AD8E348088E36BDC74562C401"><enum>103.</enum><header>Philanthropic Reforestation Advisory Council</header> <subsection id="HC32F2506DB8846EDB4F9C7D9C3E882B7"><enum>(a)</enum><header>Establishment</header><text>There is hereby established the Philanthropic Reforestation Advisory Council (in this section referred to as the <quote>Advisory Council</quote>) to advise the Secretary on—</text> 
<paragraph id="H769316B62B6D42F0BCDB5198709E9B28"><enum>(1)</enum><text>increasing private charitable investment in reforestation and afforestation activities; and</text></paragraph> <paragraph id="HFA47EC8AF25D4C789BA89631134FA35F"><enum>(2)</enum><text>tracking private charitable reforestation and afforestation pledges and metrics.</text></paragraph></subsection> 
<subsection id="HD3E6A45AA5134AAE822D2109C8C24000"><enum>(b)</enum><header>Duties of the Advisory Council</header> 
<paragraph id="HFA78763589904A2E9DBAE04EAE92B344"><enum>(1)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this section, the Advisory Council shall submit to the Secretary a report that includes recommendations for—</text> <subparagraph id="H004483B4CD4547CC9284D8BC01A1BAC7"><enum>(A)</enum><text>increasing and encouraging private charitable investments in reforestation and afforestation activities; and</text></subparagraph> 
<subparagraph id="HC3866EF61AEE4DA5B537D89C778A6D6E"><enum>(B)</enum><text>developing a platform to track private charitable tree planting pledges and metrics.</text></subparagraph></paragraph> <paragraph id="H8F26E046833345D7B341DC6326224CFA"><enum>(2)</enum><header>Consultation</header><text>The Secretary shall consult with the Advisory Council when developing the list of projects to be funded from the Trillion Trees Challenge Fund established under section 104.</text></paragraph> 
<paragraph id="HA7A0CF848479476086E840B794F71779"><enum>(3)</enum><header>Reports to Congress</header><text>The Advisory Council shall annually submit to Congress—</text> <subparagraph id="HB4E0E6FBD3FA4B748541213E885828E0"><enum>(A)</enum><text>a copy of the report under paragraph (1); and</text></subparagraph> 
<subparagraph id="H8D28E601872243A18CD4910A99270620"><enum>(B)</enum><text>a list of projects the Advisory Council recommended be funded under paragraph (2) and whether or not those projects were funded.</text></subparagraph></paragraph></subsection> <subsection id="H156F189FA1B24DD1A76071D67B3D6F3E"><enum>(c)</enum><header>Membership</header> <paragraph id="HF77EE074714D4D88844858C20B4A428A"><enum>(1)</enum><header>Appointment</header><text>The Advisory Council shall consist of 2 ex officio members and 15 discretionary members.</text> 
<subparagraph id="HC27FEC2ACB80459C80E6A99F03D5D524"><enum>(A)</enum><header>Ex officio members</header><text>The ex officio members of the Advisory Council, or their designees, are—</text> <clause id="H25CF894A518C4ED38F489F583EB7E0B7"><enum>(i)</enum><text>the Secretary of Agriculture; and</text></clause> 
<clause id="HDDAC21D761054AB3AB95E61BE68DE5C2"><enum>(ii)</enum><text>the Secretary of the Interior. </text></clause></subparagraph> <subparagraph id="H4A8448EB7220402F895E4128619E6448"><enum>(B)</enum><header>Discretionary members</header><text>The Secretary shall appoint discretionary members from each of the following:</text> 
<clause id="H87F0C51D15AD4985AA820AB273569EBC"><enum>(i)</enum><text>One from each of not more than 5 companies or corporations that have made public charitable tree planting pledges.</text></clause> <clause id="H576AA911FE764544B24C8060EBD238CB"><enum>(ii)</enum><text>One from each of not more than 5 philanthropic organizations with experience in financing reforestation and afforestation activities.</text></clause> 
<clause id="HC287839CDEBB4D5596EE78EC657BBB3A"><enum>(iii)</enum><text>One from each of not more than 5 non-profit organizations with experience in reforestation and afforestation activities.</text></clause></subparagraph></paragraph> <paragraph id="H1C95D9ED93E1405787A7250CF52CD6BA"><enum>(2)</enum><header>Discretionary member terms</header><text>Each discretionary member appointed to the Advisory Council under paragraph (1)(B) may be appointed and removed at the discretion of the Secretary.</text></paragraph> 
<paragraph id="HF3B634384F0341F7A12E2B7AB2BCF487" display-inline="no-display-inline"><enum>(3)</enum><header>Quorum</header>

App.) shall not apply to Advisory Council.</text></paragraph></subsection></section> <section id="H4F2DD52660FD4289B64EE1C340B0E433"><enum>104.</enum><header>Trillion Trees Challenge Fund</header> <subsection id="HBE92DF3B36674B508CDA875118C703A4" commented="no"><enum>(a)</enum><header>Establishment</header> <paragraph id="H2C84ACF882CD46CC94077544B610CC10" commented="no"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury a fund to be known as the <quote>Trillion Trees Challenge Fund</quote>.</text></paragraph> 
<paragraph id="HC33FA9A464D6424480999073780B503C" commented="no"><enum>(2)</enum><header>Deposits</header><text>For each of fiscal years 2021 through 2030, there is appropriated, out of any money in the Treasury not otherwise appropriated, $10,000,000, which shall be deposited into the Trillion Trees Challenge Fund and remain available until expended. </text></paragraph> <paragraph id="H5611FACCCB5E4E5293E15BFBDD8CBACF" commented="no"><enum>(3)</enum><header>Use of funds</header><text>Amounts deposited into the Trillion Trees Challenge Fund—</text> 
<subparagraph id="H96B6196700604DBCA1D04FECC4082C2D" commented="no"><enum>(A)</enum><text>shall be used by the Secretary to make grants, in consultation with the Philanthropic Reforestation Advisory Council, to eligible entities to carry out eligible projects described in subsection (b)(1); and</text></subparagraph> <subparagraph id="H7A71C86DAE734897AAC5E9320877CB95" commented="no"><enum>(B)</enum><text>may only be used if matched by the eligible entity carrying out the eligible project, on at least a 1-to-1 basis, by non-Federal funds.</text></subparagraph></paragraph> 
<paragraph id="H2F03DE449F624BA6AEA6A5CB95303232" commented="no"><enum>(4)</enum><header>Public donations</header> 
<subparagraph id="HF73B71DDDA0945A9978BF05DF4BBF740" commented="no"><enum>(A)</enum><header>In general</header><text>For purposes of making grants under this section, the Secretary may accept cash or in-kind donations.</text></subparagraph> <subparagraph id="H353E97380FEC4CE4B7B5F066B40EDDFF" commented="no"><enum>(B)</enum><header>Credits to fund</header><text>Any cash donation accepted pursuant to subparagraph (A) shall be credited to, and form a part of, the Fund. </text></subparagraph></paragraph></subsection> 
<subsection id="H48D6E039672E4145A7A8A6EAA9464ABB" commented="no"><enum>(b)</enum><header>Eligible Projects</header> 
<paragraph id="HA8917CF52CC64A3188BA38EAE34A298A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible project described in this paragraph is an activity carried out by an eligible entity related to reforestation or conserving, managing, maintaining, and monitoring trees on State, Tribal, municipal, or private lands for the purpose of increasing forest carbon stock.</text> </paragraph> <paragraph id="HC3470C1063CE43D0B4BE59D06F7DD37E" commented="no"><enum>(2)</enum><header>List</header><text>The Secretary shall—</text> 
<subparagraph id="H5692C3153D90439296FE3E49C6E34C29" commented="no"><enum>(A)</enum><text>annually develop a list of eligible projects to be funded from the Trillion Trees Challenge Fund, in consultation with the Philanthropic Reforestation Advisory Council; and</text></subparagraph> <subparagraph id="HBC5404B1AF284784AD00EA798F1FABC3" commented="no"><enum>(B)</enum><text>submit the list developed pursuant to subparagraph (A) to—</text> 
<clause id="H428772C1BB8C4DEAA5DB4B777EB3A4A8"><enum>(i)</enum><text>the Committees on Agriculture, Nutrition, and Forestry and Energy and Natural Resources of the Senate; and</text></clause> <clause id="HC5ED7A24CE34434B9839EF0FF2B1EF22"><enum>(ii)</enum><text>the Committees on Agriculture and Natural Resources of the House of Representatives; and</text></clause></subparagraph> 
<subparagraph id="H7BDA744855D740479F844D519FBB9425"><enum>(C)</enum><text>publish such list annually in the Federal Register.</text></subparagraph></paragraph> <paragraph id="H89601324740F4CB6B4B9753299A88773" commented="no"><enum>(3)</enum><header>Updates</header><text>The Secretary may add an eligible project to the list described in subparagraph (A) of paragraph (2) and submit such addition in accordance with subparagraph (B) of such paragraph.</text></paragraph> 
<paragraph id="H5D5BBC1E5A0F40B9BE58B4B32181C1E1" commented="no"><enum>(4)</enum><header>Proposals</header><text>To be eligible to receive funding under this section, an eligible entity shall submit to the Secretary a proposal at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph></subsection> <subsection id="HFE6D2F19B8D24A6C950A892D258EF2B4" commented="no"><enum>(c)</enum><header>Summary to Congress</header><text>The Secretary shall include in the budget materials submitted to Congress in support of the President’s annual budget request (submitted to Congress pursuant to section 1105 of title 31, United States Code) for each fiscal year a summary of the status and funding of eligible projects under this section.</text></subsection> 
<subsection id="HF54F029F9A4940A39AB805352870B623" commented="no"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text> <paragraph id="HE15532892D26471B8F4F587738C73E61" commented="no"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text>

<subsection id="HFD7F2DD840C347B2A31657B3BA1FCA79"><enum>(b)</enum><header>Renewable resource program</header><text display-inline="yes-display-inline">Section 4 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1602">16 U.S.C. 1602</external-xref>) is amended—</text> <paragraph id="HC1A25BEE379E4600975F3C95F620B5E2"><enum>(1)</enum><text>in the first sentence—</text>

<clause id="HDFC0B687D7BA4117998EFFB7962187FE"><enum>(ii)</enum><text>investments required to support existing policies and programs and those required to create and implement new policies and programs; and</text></clause></subparagraph> <subparagraph id="H8208CC83804A4227BD43A4BA1179C45B"><enum>(B)</enum><text>identifies—</text> 
<clause id="H430DABEF4359463EB1793AFD5879FA78"><enum>(i)</enum><text>Federal and State policies that, if left unchanged in the succeeding 50 years, would create undesirable impacts on forests and communities; and</text></clause> <clause id="H4A2D64FC26A04FC1B03A634006E4E33A"><enum>(ii)</enum><text>alternatives to the policies described in clause (i) that if implemented in the 10 succeeding years would mitigate such undesirable impacts;</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>

<subsection id="HC78B61673BF542EE87588FFA5A1443F2"><enum>(c)</enum><header>Lifecycle analysis</header> 
<paragraph id="H6F687665DF464425A1C601DB5BA0467B"><enum>(1)</enum><header>Lifecycle storage model</header><text>As a part of the assessment established under section 3 of the Forest and Rangeland Renewable Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1601">16 U.S.C. 1601</external-xref>) the Secretary shall develop interdisciplinary computational models using all available data to—</text> <subparagraph id="H62FBC0C9322C4A09B1C48FBB892EF7A8"><enum>(A)</enum><text>evaluate the lifecycle forest carbon stock potential associated with domestic forestland; and</text></subparagraph> 
<subparagraph id="H69C6AF7501D34504BF376173DD165AB9"><enum>(B)</enum><text>provide projections, scenario planning, and policy options associated with such models.</text></subparagraph></paragraph> <paragraph id="H81A448B0061B4AAAAD98DDC251D9767A"><enum>(2)</enum><header>Considerations</header><text>In developing the model under paragraph (1), the Secretary shall consider—</text> 
<subparagraph id="H616B9B09EE424F60A41C5EB5C373285B"><enum>(A)</enum><text>the best available science;</text></subparagraph> <subparagraph id="H9A38658F83254FE387EDB250106A3BA2"><enum>(B)</enum><text display-inline="yes-display-inline">data collected through the forest inventory and analysis program under section 3(e) of the Forest and Rangeland Renewable Resources Research Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/1642">16 U.S.C. 1642(e)</external-xref>);</text></subparagraph> 
<subparagraph id="HFB9ABC41FAF14E039FB1BEDD737DC51A"><enum>(C)</enum><text>forest carbon stock and the rate of carbon storage and sequestration in forest carbon pools;</text></subparagraph> <subparagraph id="H12E7C3886CBB4540809E1995BF801AA1"><enum>(D)</enum><text>the net carbon storage and sequestration of active forest management;</text></subparagraph> 
<subparagraph id="H5BF4F59A1F674A0DA2576BF80E77DF73"><enum>(E)</enum><text>the rate of carbon storage and sequestration in varying forests based on the climate the forest is located in, the average age of stands, and rate of tree mortality;</text></subparagraph> <subparagraph id="HB7E85F11CFBF43BCA76657D83A43106A"><enum>(F)</enum><text>the net amount of carbon released through catastrophic wildfire, disease and insect infestations, and other disturbances that result in tree mortality;</text></subparagraph> 
<subparagraph id="HE820F0E0F6D54BE7B2A50CF671AF34F6"><enum>(G)</enum><text>the net carbon stored and sequestered through the manufacture of harvested wood products;</text></subparagraph> <subparagraph id="HB3CFE6577F9A4B27A093618A3FFAF5DC"><enum>(H)</enum><text>the net carbon stored and sequestered through a sustainable cycle of harvest and regeneration;</text></subparagraph> 
<subparagraph id="H21E1FC43398B43A9BDAE18F044B81002"><enum>(I)</enum><text>forest carbon flux; and</text></subparagraph> <subparagraph id="H67DDE919CC6146A0BA10698B9BBB55CD"><enum>(J)</enum><text>other factors as determined by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H2BEDDBDDF6674ABDACF7D1104E9CA98D"><enum>(3)</enum><header>Validation program</header> 
<subparagraph id="H2BF6C6A5372641989FECB26E2FE23017"><enum>(A)</enum><header>In general</header><text>The Secretary shall carry out a program for validation and independent testing of the lifecycle models developed under paragraph (1).</text></subparagraph> <subparagraph id="HEC4676F12B504B83B963124C9B3EDC10"><enum>(B)</enum><header>Requirements</header><text>In carrying out the validation program under subparagraph (A), the Secretary shall—</text> 
<clause id="H4E048D0F758D4CF4A4FFCC664D0D7939"><enum>(i)</enum><text>regularly perform retrospective assessments comparing model predictions to field data on the carbon stored in forests; and</text></clause> <clause id="H362A5BE29FFF49A387CAB9D4224DCE51"><enum>(ii)</enum><text>require independent evaluation and comparison of lifecycle models developed under paragraph (1) against existing models, and enable empirical testing of hypotheses regarding the net effects on land and atmospheric carbon stocks and other greenhouse gas impacts.</text></clause></subparagraph></paragraph> 
<paragraph id="H14BED601482542CC94358E8F00DD945E"><enum>(4)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter, the Secretary shall submit to Congress a report that includes—</text> <subparagraph id="H622FDDE521AA4761AB49238ABC06ACA5"><enum>(A)</enum><text>the findings of the analysis conducted using the model developed under paragraph (1);</text></subparagraph> 
<subparagraph id="H4EBF7406B2B54B15B51E62A735E3A686"><enum>(B)</enum><text display-inline="yes-display-inline">recent trends and current forest carbon stock, forest carbon pools, and forest carbon flux as well as projections of forest carbon stock, forest carbon pools, and forest carbon flux for the succeeding 50 years; and</text></subparagraph> <subparagraph id="H394C3D9D2152431ABF2A22843606F593"><enum>(C)</enum><text display-inline="yes-display-inline">scenario planning for Federal, State, Tribal, local, and private landowners that analyzes different policy options and their associated effects on lifecycle forest carbon stock. </text></subparagraph></paragraph></subsection></section> 
<section id="H6EC8E55C7D12460681BEC31AD5A99E0D"><enum>106.</enum><header>Forest inventory and analysis</header> 
<subsection id="H66D6E31D7A85482E9A4A6F750D4026FE" commented="no"><enum>(a)</enum><header>5-Year reports</header><text display-inline="yes-display-inline">Section 3(e)(3) of the Forest and Rangeland Renewable Resources Research Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/1642">16 U.S.C. 1642(e)(3)</external-xref>) is amended—</text> <paragraph id="HFAFFB52CFFD84561887F6D5D29CB0816" commented="no"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></paragraph>

<paragraph id="HA37A9BD397D94E2D892A8A80FF02B2B4" commented="no"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block id="HCE2D1D589E0F4329877470F211E0400D" style="OLC"> <subparagraph id="HBF05681B256F48B3881EDF0E0EF5F9D3" commented="no"><enum>(D)</enum><text>demonstrates the Agency’s efforts to—</text> 
<clause id="HFBF12C25E41841DC9FDA4DA084FC033B" commented="no"><enum>(i)</enum><text>conduct a strategic national forest inventory by measuring a statistically designed consistent historical series of field plots in combination with advanced technology to improve data, information, and estimates of precision; and</text></clause> <clause id="H6C7BE31BC9EC4F6EA3CF0E6C789B09D8" commented="no"><enum>(ii)</enum><text>use advanced geospatial technologies to improve such area and volume estimates, especially for sub-State regions and smaller areas.</text></clause></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB29B81A481DD4F3AA05993CE8116503B" commented="no"><enum>(b)</enum><header>Memoranda of understanding</header><text display-inline="yes-display-inline">In preparing, publishing, and making available reports under section 3(e)(3) of the Forest and Rangeland Renewable Resources Research Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/1642">16 U.S.C. 1642(e)(3)</external-xref>), as amended by subsection (a), the Secretary may enter into memorandums of understanding with other Federal agencies or departments to improve the use and integration of advanced remote sensing and geospatial technologies in the forest inventory and analysis program under such section. </text></subsection></section> <section id="H2895CC1C7C6146B09902055D326ED47D" commented="no"><enum>107.</enum><header>National Forest Foundation activities</header> <subsection id="HF0167C6ADCFB47EEB53D7D88709BFF61" commented="no"><enum>(a)</enum><header>Adding forest carbon stock to the purposes of the national forest foundation</header><text>The National Forest Foundation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/583j">16 U.S.C. 583j</external-xref> et seq.) is amended—</text>

<subsection id="H7D1595D1647846E5A00B644B4D1D81CB" commented="no"><enum>(b)</enum><header>Number of awards</header><text>The Foundation shall award the National Medal for Forest Restoration at least once a year.</text></subsection> <subsection id="H7188166630A24687869200765831C25E" commented="no"><enum>(c)</enum><header>Levels of awards</header><text>The Foundation shall, in consultation with Secretary of Agriculture, establish multiple levels of awards reflecting the considerations specified in subsection (e).</text></subsection> 
<subsection id="H35C10C23CB7A4673917A8962860F51DE" commented="no"><enum>(d)</enum><header>Administration of award</header><text>The Foundation shall administer the awards under this section, including by—</text> <paragraph id="H8D6F3E0673DD4151978415A81AD98999"><enum>(1)</enum><text>developing a website and media presence to highlight recipients of such awards; and</text></paragraph> 
<paragraph id="H8DB8C5B2E5B54E99B0970CDD90C2C0DC"><enum>(2)</enum><text>tracking the contribution of such recipients towards the targets for increased forest carbon stock established under section 101 of the Trillion Trees Act.</text></paragraph></subsection> <subsection id="HAAD2402BD6B54C72B73DC17FE6387912" commented="no"><enum>(e)</enum><header>Considerations</header><text>In awarding the National Medal for Forest Restoration under this section to an entity described in subsection (a), the Foundation shall consider—</text> 
<paragraph id="H0E09F0108E1E441DBE71251B6AB944D9" commented="no"><enum>(1)</enum><text>the number of acres planted or restored by such entity;</text></paragraph> <paragraph id="H597A6544A4694E70967107089541F59D" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">the total increase in forest carbon stock (as defined in section 2 of the Trillion Trees Act) resulting from reforestation (as defined in section 2 of the Trillion Trees Act) activities of such entity;</text></paragraph> 
<paragraph id="HCBD11F0B46A348ED8D82254A1B5ACA61" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">the educational impact of the reforestation (as defined in section 2 of the Trillion Trees Act) activities of such entity; and</text></paragraph> <paragraph id="H0F65FAD060C84E7CA1F53B17A366DBF4" commented="no"><enum>(4)</enum><text>the total value of any donations by such entity to the Foundation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB6C50E01C9B84167B5BF94BF0EDC933D" commented="no"><enum>(b)</enum><header>Fifth grade forestry challenge</header><text display-inline="yes-display-inline">The National Forest Foundation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/583j">16 U.S.C. 583j</external-xref> et seq.), as amended by subsection (a), is further amended by inserting after section 410 the following:</text> <quoted-block style="OLC" id="H18465690F7ED49CB9F0F194351A90CC1" display-inline="no-display-inline"> <section id="HBCF6BE6E306643FFAA7A6DE2C9A12591"><enum>411.</enum><header>Fifth grade forestry challenge</header> <subsection id="HD27B1B21A67B4A959817FED2D0220504" commented="no"><enum>(a)</enum><header>Establishment</header><text>The Foundation shall establish an educational grant program, in consultation with the Secretary, to be known as the <quote>5th Grade Forestry Challenge</quote> to make grants to eligible recipients to—</text> 
<paragraph id="H492CA6427D3D47FC9988A3576867A349" commented="no"><enum>(1)</enum><text>provide 5th grade students with a seedling to plant;</text></paragraph> <paragraph id="H9F290FFAE6FC46619698F0E87C2FF921" commented="no"><enum>(2)</enum><text>educate students about forestry, forest management, active stewardship, and carbon storage; and</text></paragraph> 
<paragraph id="H98913961247E44678BA3B6A527466AD9" commented="no"><enum>(3)</enum><text>encourage, accept, and administer private gifts of money, technical expertise, and of real and personal property for the benefit of this program.</text></paragraph></subsection> <subsection id="H82A7C4222E88477A89529A50C75B92F3" commented="no"><enum>(b)</enum><header>Eligible recipients</header><text>The following entities are eligible to receive a grant under this section:</text> 
<paragraph id="HAF68510417E943849D9336425E8C8391" commented="no"><enum>(1)</enum><text>A local educational agency. </text></paragraph> <paragraph id="H92B3BFC228064EAE8608EF44399584A1" commented="no"><enum>(2)</enum><text>A nonprofit entity that the Secretary determines has a demonstrated history of community engagement and education on natural resource issues.</text></paragraph> 
<paragraph id="HE616F3E0850B439283D057CD6403F60B" commented="no"><enum>(3)</enum><text>Other recipients as the Secretary determines to be appropriate.</text></paragraph></subsection> <subsection id="H29CE1E65A82D40098BB3C31F88A485E4" commented="no"><enum>(c)</enum><header>Coordination</header><text>In carrying out the program required by this section, the Foundation may coordinate on an ongoing basis with appropriate Federal, State, Tribal, and local resource management departments, local educational agencies, nonprofit organizations, private citizens, and corporations to—</text> 
<paragraph id="H6021CC93674847448F4D2AE4D2E17206" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">identify lands suitable for reforestation (as defined in section 2 of the Trillion Trees Act);</text></paragraph> <paragraph id="H96525AD070564E818EDEC9E0C79F2B5C" commented="no"><enum>(2)</enum><text>encourage, accept, and administer private gifts of money, technical expertise, and of real and personal property for the benefit of such program;</text></paragraph> 
<paragraph id="H586DEB5303BF417FA837247B5F7B8AAC" commented="no"><enum>(3)</enum><text>manage and maintain reforested lands; and</text></paragraph> <paragraph id="HA7E7A70C52F0453A98D3835F9656B0B8" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">further educate students and the public about forestry and forest carbon stock (as defined in section 2 of the Trillion Trees Act).</text></paragraph></subsection> 
<subsection id="H9135BB6995E045FD8AA8FD30D40B83EC" commented="no"><enum>(d)</enum><header>Report required</header><text>Not later than 2 years after the date on which the Foundation establishes the grant program under this section, the Secretary shall submit to the relevant committees a report on the determination of the Secretary as to whether the grant program is a financially effective means to educate students in the fields described in subsection (a)(2).</text></subsection> <subsection id="HD54E11BE22AB45C9A9DD37053278624E" commented="no"><enum>(e)</enum><header>Definitions</header><text>In this subsection:</text> 
<paragraph id="H5CDDC9BBB8B14D5E93C191226E2471B0"><enum>(1)</enum><header>Local educational agency</header><text>The term <term>local educational agency</term> has the meaning given that term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> <paragraph id="HC8D44B7F9B7E4816A363A9CC2D6C6590"><enum>(2)</enum><header>Relevant committees</header><text>The term <term>relevant committees</term> means—</text>

<subclause id="H35D8975E8DE0473F9BFCDED2004D7E07"><enum>(II)</enum><text display-inline="yes-display-inline">promote reforestation (as defined in section 2 of the Trillion Trees Act) on priority land;</text></subclause> <subclause id="HF10E499FB54F4C6BBA6361C5F2A02E8D"><enum>(III)</enum><text>deliver measurable progress and cost-effective results;</text></subclause> 
<subclause id="H82EE8787E8824F56972F79EA0290B1B6"><enum>(IV)</enum><text display-inline="yes-display-inline">increase forest carbon stock (as defined in section 2 of the Trillion Trees Act) in a sustainable manner; and</text></subclause> <subclause id="H9A437431898C489AB7254E57ABEF86E5"><enum>(V)</enum><text display-inline="yes-display-inline">provide additional benefits relating to forest function and health, soil health and productivity, wildlife habitat and biodiversity, improved air and water quality, job creation, enhanced outdoor recreation, and forest products and byproducts.</text></subclause></clause></subparagraph> 
<subparagraph id="H33021CC59B224C3BB20D042E00B5BF87"><enum>(B)</enum><header>Priority land defined</header><text>In this paragraph, the term <term>priority land</term> means National Forest System land that, due to an unplanned adverse disturbance (including a wildfire, ice storm, blowdown, flooding, insect infestation, disease, volcanic activity, or seismic event)—</text> <clause id="H6D4B5FDFA7944547882B9A3BF4AC2ACB"><enum>(i)</enum><text>does not meet the conditions for appropriate forest cover described in paragraph (1);</text></clause> 
<clause id="H31465846A7E3442D85D024F3CFB4CE16"><enum>(ii)</enum><text display-inline="yes-display-inline">requires reforestation (as defined in section 2 of the Trillion Trees Act) to meet the objectives of an applicable forest plan; and</text></clause> <clause id="H54AA77F97A6D4A398BE6579F9005DBB6"><enum>(iii)</enum><text display-inline="yes-display-inline">is unlikely to experience natural regeneration without assistance.</text></clause> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph>

<section id="H7A6F6581EC0247558CCA652952412510"><enum>113.</enum><header>Solving shortages for seedlings</header> 
<subsection id="HEE0DAC262FE14A28A346903B542C1A89"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the Secretary, acting through the Chief of the Forest Service, shall develop and implement a national strategy to increase the capacity of Federal, State, Tribal, and private nurseries to address the nationwide shortage of tree seedlings.</text></subsection> <subsection id="H22738A76D0974ED5B1A1BCBBF5C5A0EB"><enum>(b)</enum><header>Elements</header><text>The strategy required under subsection (a) shall—</text> 
<paragraph id="H1811354034914927AEE8690DD895B60E"><enum>(1)</enum><text>be based on the best available science and data; and</text></paragraph> <paragraph id="H48AA33A5A49E44C98C791595FC214AC0"><enum>(2)</enum><text>identify and address—</text> 
<subparagraph id="H2817DD24786C48328F658D8AB1AD1F67"><enum>(A)</enum><text display-inline="yes-display-inline">regional seedling shortages of bareroot and container tree seedlings;</text></subparagraph> <subparagraph id="HA30D185290DE468D96308F5F7DAB88F6"><enum>(B)</enum><text>regional reforestation opportunities and the seedling supply necessary to fulfill such opportunities; </text></subparagraph> 
<subparagraph id="H17A10F78508C4EA9B760F3444CA8A5D3"><enum>(C)</enum><text>opportunities to enhance seedling diversity and close gaps in seed inventories; and</text></subparagraph> <subparagraph id="H716D2E9E56354AFBB8065132483179E3"><enum>(D)</enum><text>barriers to expanding, enhancing, or creating new infrastructure to increase nursery capacity.</text></subparagraph></paragraph></subsection> 
<subsection id="H46A2BD62349D475AA20973E76BD7CB9E"><enum>(c)</enum><header>Federal nurseries</header><text>Section 2 of the Act of June 9, 1930 (<external-xref legal-doc="usc" parsable-cite="usc/16/576a">16 U.S.C. 576a</external-xref>; commonly known as the <quote>Knutson-Vandenberg Act</quote>), is amended by striking <quote>each fiscal year after year ending June 30, 1934, not to exceed $400,000,</quote> and inserting <quote>each of fiscal years 2021 through 2030, $25,000,000,</quote>.</text></subsection> <subsection id="H46E84FBFA5184EAA93EDC9C87E3C1E87"><enum>(d)</enum><header>Loan program for State, Tribal, and private nurseries</header> <paragraph id="HF969791A197F4AA9A8EA5382F10505B1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall carry out a loan program to make or guarantee qualified nursery loans to eligible entities under this subsection.</text></paragraph> 
<paragraph id="HB78BDEABF14548FC872B6AD5AC94941E"><enum>(2)</enum><header>Application</header><text>To be eligible to receive a qualified nursery loan or loan guarantee under this subsection, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a plan to maintain the genetic and physical quality of seedlings of the eligible entity.</text></paragraph> <paragraph id="HD5F26F8B151F4F76B8BB4612A85CA072"><enum>(3)</enum><header>Priority</header><text>In making qualified nursery loans or loan guarantees under this subsection, the Secretary shall give priority to eligible entities that—</text> 
<subparagraph id="HDD84D63E16F04E5BAAFDFA1F7D5AA6E1"><enum>(A)</enum><text>are small businesses, in particular small businesses located in rural areas;</text></subparagraph> <subparagraph id="HDACB87678A354DFFA0AE87E1BBAA9529"><enum>(B)</enum><text>create or support jobs, particularly in rural areas; and</text></subparagraph> 
<subparagraph id="H0DB940089FDA45CAB4E43F1B79E52569"><enum>(C)</enum><text>serve regions with high demand for reforestation. </text></subparagraph></paragraph> <paragraph id="H855E6036352540C1A03775D305A6B4EC"><enum>(4)</enum><header>Qualified nursery project</header><text>A loan or loan guarantee under this subsection may only be used to carry out a qualified nursery project to—</text> 
<subparagraph id="H20595E0BDAF841CEBD02F24D21AA2925"><enum>(A)</enum><text>develop, expand, enhance, or improve nursery capacity or infrastructure;</text></subparagraph> <subparagraph id="HA5A234E640E9449B9EA176C81D804128"><enum>(B)</enum><text>establish nurseries; or</text></subparagraph> 
<subparagraph id="H0D7FE518A7C94682A49B0A0A60B8A751"><enum>(C)</enum><text>develop or implement quality control measures at nurseries.</text></subparagraph></paragraph> <paragraph id="HAD7C0F416AA64623B1259ACD77D88EA1"><enum>(5)</enum><header>Loan and loan guarantee terms</header> <subparagraph id="HA5D8EFE711A0431FACC20947DF8D7BE5"><enum>(A)</enum><header>Amount guaranteed</header><text>The portion of a loan that the Secretary may guarantee under this subsection may not be greater than 80 percent of the principal amount of such loan.</text></subparagraph> 
<subparagraph id="H4825353F0B6D4C1E91C31CCBC40931E5"><enum>(B)</enum><header>Repayment</header><text>The period of repayment for a loan made under this subsection shall not exceed 20 years.</text></subparagraph></paragraph> <paragraph id="H139AD19784314373AB961506678E7A64"><enum>(6)</enum><header>Administrative provisions</header> <subparagraph id="HDB3429EA898C44B3B14FCEA6AEFA8EFE"><enum>(A)</enum><header>Limitation on authority</header><text>The total amount of qualified nursery loans made or guaranteed under this subsection by the Secretary may not exceed $1,000,000,000.</text></subparagraph> 
<subparagraph id="HDAFE458D5D82492B99445B6BC36646A6"><enum>(B)</enum><header>Distribution</header><text>The Secretary shall ensure, to the maximum extent practicable, that loans made or guaranteed under this subsection are distributed across diverse geographic regions.</text></subparagraph></paragraph> <paragraph id="HCB843C1C90244B02A55EDBDFB5AAC66B"><enum>(7)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="H6D9D5D29776E45A9B38B820AA69D7A47"><enum>(A)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text> <clause id="H2805467585204353BB631260D8E53D2B"><enum>(i)</enum><text>a State, Tribal, or local government; or </text></clause> 
<clause id="H51A2A93787BD4AA48372C505C32CBA30"><enum>(ii)</enum><text>a domestic private, non-profit, or cooperative organization. </text></clause></subparagraph> <subparagraph id="HD199D80B3CD84188A4A47D1FD1933870"><enum>(B)</enum><header>Nursery</header><text>The term <term>nursery</term> means a State, Tribal, or local government or privately-owned facility that grows, stores, extracts, or monitors bareroot or container tree seedlings.</text></subparagraph> 
<subparagraph id="H206B8864473A448681DCFB47E12C47DE"><enum>(C)</enum><header>Qualified nursery loan</header><text display-inline="yes-display-inline">The term <term>qualified nursery loan</term> means a low-interest loan, the proceeds of which are used to cover the costs to the borrower of carrying out a qualified nursery project described in paragraph (4).</text></subparagraph></paragraph> </subsection></section> <section id="HA11CEF5BA33C43108F42D56323EF0B55"><enum>114.</enum><header>Healthy forest reserve program</header> <subsection id="H1DE54CFC16994F5CB13BDB6CD113F269"><enum>(a)</enum><header>Establishment</header><text>Section 501(a) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6571">16 U.S.C. 6571(a)</external-xref>) is amended—</text>

<subsection id="H2A8850E2936A492C8EF05723AF1FA76F"><enum>(b)</enum><header>Enrollment priority</header><text>Section 502(f)(1) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6572">16 U.S.C. 6572</external-xref>) is amended to read as follows:</text> <quoted-block id="H5FB3A7F4B45B4443B6950F951A9DF54E" style="OLC"> <paragraph id="H200565D5D0EB438AA29C729EA6F565DF"><enum>(1)</enum><header>In general</header><text>The Secretary of Agriculture shall give priority to the enrollment of land that—</text> 
<subparagraph id="HB7954B3429934563BDC40F65567B756D"><enum>(A)</enum><text>provides the greatest conservation benefit to—</text> <clause id="HB395BA17DE074F5E94CA5AB46781B74E"><enum>(i)</enum><text>primarily, species listed as endangered or threatened under section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>); and</text></clause> 
<clause id="H4A0B9A0ACD7D47468854598AFF9E106F"><enum>(ii)</enum><text>secondarily, species that—</text> <subclause id="H699B3A67F7B24CD7826C00680223A887"><enum>(I)</enum><text>are not listed as endangered or threatened under section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>); but</text></subclause> 
<subclause id="H645D2F71A7BF4D7EA72827D1E9DC11A9"><enum>(II)</enum> 
<item id="H2C2994DA774244229AA0CB18A5A7C7E8" display-inline="yes-display-inline"><enum>(aa)</enum><text>are candidates for such listing, State-listed species, or special concern species; or</text></item> <item id="HB1CE3EBBADBB4389B95640116DBBA9AE" indent="up1"><enum>(bb)</enum><text>are deemed a species of greatest conservation need under a State wildlife action plan; or</text></item> </subclause></clause></subparagraph> 
<subparagraph id="HDC1CA95730D1442EA5A24E9805F67996"><enum>(B)</enum><text>promotes the restoration of marginal farmland or degraded forestland into healthy forest ecosystems.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H3A36745DEB31407AAE08D63EE7E23C95"><enum>(c)</enum><header>Restoration plans</header><text>Section 503(b)(4) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6573">16 U.S.C. 6573(b)</external-xref>) is amended to read as follows:</text>

<paragraph id="H7897F19496204FBABAF8FAC6B9344B10"><enum>(4)</enum><text>Practices to increase forest carbon stock (as defined in section 2 of the Trillion Trees Act) over a period of at least 20 years, including through reforestation of degraded forestland and afforestation (as such terms are defined in such section) of marginal farmland.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H350FF96CE56041A0A12356AB9CD2D397"><enum>(d)</enum><header>Cost sharing</header><text>Section 504 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6574">16 U.S.C. 6574</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H9CE357CA26504AE4AA4BF57D09E74D4D"><enum>(e)</enum><header>Cost-Share permitted</header><text display-inline="yes-display-inline">In the case of land enrolled in the healthy forest reserve program for the purpose of promoting the restoration of marginal farmland or degraded forestland into healthy forest ecosystems, the Secretary of Agriculture may pay up to 75 percent for the cost of practices determined necessary for restoration or afforestation (as defined in section 2 of the Trillion Trees Act) of such land.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="HBA4EB853F0804B1B96EE51BA4B4C1D2F"><enum>115.</enum><header>Forestry education and workforce development grant program</header> <subsection id="HB40FE40A67A94C8790834BA3BCE6B5E6"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a competitive grant program to make grants to eligible institutions to carry out forestry education and workforce development programs to prepare students for careers in forestry. </text></subsection> 
<subsection id="H9B17339FF9814A8A96BDB059A14EFE25"><enum>(b)</enum><header>Proposal</header><text>To be eligible to receive a grant under this section, an eligible institution shall submit to the Secretary a proposal at such time, in such manner, and containing such information as the Secretary may require.</text></subsection> <subsection id="HC7B93492482D4D938CD6BCC2726B7C19"><enum>(c)</enum><header>Equitable awards</header><text>For each fiscal year for which grants are awarded under this section, the amount of grant funds awarded to eligible institutions described in paragraph (1) of subsection (f) shall be equal to the amount of grant funds awarded to eligible institutions described in paragraphs (2) and (3) of such subsection.</text></subsection> 
<subsection id="H7877799C56334200A17CF7D761FB9DE1"><enum>(d)</enum><header>Use of grant funds</header> 
<paragraph id="H6083DABE6E5E4D9C893F16F5399A40CA"><enum>(1)</enum><header>In general</header><text>Grants made under this section shall be used to—</text> <subparagraph id="H8B0C336E765547F48AC2FE2CD53AB214"><enum>(A)</enum><text>award scholarships to students enrolled in the eligible institution and pursuing degrees in forestry, including students historically underrepresented in the field of forestry;</text></subparagraph> 
<subparagraph id="H7604C4E366A54BB4BB0E32B803F08397"><enum>(B)</enum><text>expand, enhance, or improve forestry educational capacities of the eligible institution, including libraries, curriculum, faculty, and scientific instrumentation;</text></subparagraph> <subparagraph id="H69FD4FE2188C4C3CA56CFDDABE5B28B4"><enum>(C)</enum><text>recruit and retain—</text> 
<clause id="HF9B5E73BA5BA4E818C0DC8CAF387E408"><enum>(i)</enum><text display-inline="yes-display-inline">secondary school or undergraduate students to pursue certifications in forestry or acquire training in technical forestry skills, including students historically underrepresented in the field of forestry; or</text></clause> <clause id="H3AEAB1EA9A88418DBAB2F5F92FFEFCA5"><enum>(ii)</enum><text display-inline="yes-display-inline">undergraduate and graduate students to pursue degrees in forestry, including students historically underrepresented in the field of forestry;</text></clause></subparagraph> 
<subparagraph id="H2E66F972B08A4E3594AE60DDAD8BBE38"><enum>(D)</enum><text>design and develop resources or programs that prepare students enrolled in the eligible institution for careers in forestry, including internship and apprenticeship programs;</text></subparagraph> <subparagraph id="H178ABA4187304F4A9B935CC0D1F89CB1"><enum>(E)</enum><text>provide hands-on training and research opportunities for such students; or</text></subparagraph> 
<subparagraph id="H4D3ECE67EE804DABB60ACA1424FF8466"><enum>(F)</enum><text>carry out any other activity the Secretary determines appropriate.</text></subparagraph></paragraph> <paragraph id="H1EC856D2C346415C9D7A4EE6E61653F9"><enum>(2)</enum><header>Clarification of forestry education</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the terms <term>degrees in forestry</term>, <term>certifications in forestry</term>, and <term>training in technical forestry skills</term> include degrees, certifications, and training in forestry, forest sciences, natural resources management, or other related educational disciplines. </text></paragraph></subsection> 
<subsection id="H1B1BD21A5E7E4EC182C7F03B468F93C9"><enum>(e)</enum><header>Payment of non-Federal share</header><text display-inline="yes-display-inline">As a condition of receiving a grant under this section, the Secretary shall require the recipient of the grant to provide funds or in-kind support from non-Federal sources in an amount that is specified by the Secretary and based on assessed institutional needs.</text></subsection> <subsection id="H991186785CDA45469040B2DC08090DD6"><enum>(f)</enum><header>Eligible institution defined</header><text>In this section, the term <term>eligible institution</term> means—</text> 
<paragraph id="H78A3DB240B5C4CC4A2BB05BBEA7F1218"><enum>(1)</enum><text>a land grant college or university, including an institution eligible to receive funding under—</text> <subparagraph id="HAE893D5FB3204308800186853CB24EC9"><enum>(A)</enum><text>the Act of July 2, 1862;</text></subparagraph> 
<subparagraph id="HB0DA948C881143FDA840743FB50758E2"><enum>(B)</enum><text>the Act of August 30, 1890, including Tuskegee University;</text></subparagraph> <subparagraph id="HD5AB21AB35574A84B38CDC0D88D26690"><enum>(C)</enum><text display-inline="yes-display-inline">Public Law 87–788 (commonly known as the <quote>McIntire-Stennis Act of 1962</quote>); or</text></subparagraph> 
<subparagraph id="H6BD797B614E74E7AA14DADC9ED9FCA6B"><enum>(D)</enum><text>the Equity in Educational Land-Grant Status Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301</external-xref> note); </text></subparagraph></paragraph> <paragraph id="H67C2CD8A9CF644F89417015C68FFA6EA"><enum>(2)</enum><text display-inline="yes-display-inline">a community college or area career and technical education school (as defined in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>)); or</text></paragraph> 
<paragraph id="H00DCBBFD48F042E9A8A9D87CA086FBA0"><enum>(3)</enum><text>an institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)).</text></paragraph></subsection> <subsection id="H6BC4418760604CBD9BA218D1780FFC47"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary $20,000,000 for each of fiscal years 2021 through 2030 to carry out this section.</text></subsection></section> 
<section id="HFFDB97C8C6E645E6BB4ABBDD2BCB2E42" commented="no"><enum>116.</enum><header>Civilian Conservation Centers reforestation activities</header><text display-inline="no-display-inline">Section 147(d) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3197">29 U.S.C. 3197(d)</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H7833D52DFE9C4A6BBB408AEACD28371D" style="OLC"> <paragraph id="H559F606C6AB04FBAB040BDE3091DF912" commented="no"><enum>(4)</enum><header>Reforestation activities</header><text display-inline="yes-display-inline">Enrollees in Civilian Conservation Centers may provide assistance in carrying out priority reforestation (as defined in section 2 of the Trillion Trees Act) projects in accordance with subsection (e)(3)(A)(ii) of section 3 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1601">16 U.S.C. 1601</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC4537DC43A4D4FFB9BA4B951A2CD3EC9"><enum>117.</enum><header>Forest technology enhancements for conservation and habitat improvement</header> 
<subsection id="H5AF5FAA0440D4E4BA118DF7AD2A6B52D"><enum>(a)</enum><header>Establishment of pilot program</header><text>Not later than 180 days after the date of the enactment of this section, the Secretary, in consultation with the Secretary of the Interior, shall either establish a research, development, and testing pilot program or expand an applicable existing program to—</text> <paragraph id="H7E8B890126484AFAA6A29EA1EEFBC54D"><enum>(1)</enum><text>assess new technologies, including unmanned aircraft system, geospatial, or remote sensing technologies, across all reforestation activities; </text></paragraph> 
<paragraph id="HFDACC939F6A840E8826919CEC904207A"><enum>(2)</enum><text>accelerate the deployment and integration of such technologies into the operations of the Secretaries; and</text></paragraph> <paragraph id="HC50FAD87E7C84F059C3EECD1669F4E19"><enum>(3)</enum><text>collaborate and cooperate with State, Tribal, and private geospatial information system organizations with respect to such technologies. </text></paragraph></subsection> 
<subsection id="H416FEAB530DB43219E60C61D0B3D4C5F"><enum>(b)</enum><header>Expanding use of unmanned aircraft systems</header><text>Not later than 1 year after the date of enactment of this section, the Secretaries shall enter into an agreement to develop consistent protocols and plans for the use of unmanned aircraft system technologies for reforestation activities.</text></subsection> <subsection id="H425E96E4E5704550ABEDB3638455AA2F"><enum>(c)</enum><header>Domestic manufacture requirement</header><text display-inline="yes-display-inline">Any unmanned aircraft system technology or component of unmanned aircraft system technology used under this section shall be made and manufactured in the United States.</text></subsection> 
<subsection id="H00AE1A754D3344CCBCA513E8C2309868"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed as prohibiting the Secretary of Agriculture from using unmanned aircraft systems technologies in effect on the date of the enactment of this section. </text></subsection> <subsection id="HA70EE3F437104E339D7D8C261F7CA2FD"><enum>(e)</enum><header>Unmanned aircraft system defined</header><text>In this section, the term <term>unmanned aircraft system</term> has the meaning given the term in section 44801 of title 49, United States Code.</text></subsection> 
<subsection id="H5D9DC96A5DCD432282CAEAD236A5B93D"><enum>(f)</enum><header>Sunset</header><text>The authority to carry out this section shall terminate on the date that is 5 years after the date of the enactment of this section.</text></subsection></section></subtitle> <subtitle id="H0D2A321E0AAC4729BB5380C54092AC9D"><enum>C</enum><header>Urban Forests</header> <section id="H52A5CBA555144D3486C5B7A2E8E5B887"><enum>121.</enum><header>Urban and community forestry assistance</header> <subsection id="H81CF435DCC624E30B2A6CA7A0F446E08"><enum>(a)</enum><header>Tree City USA Grant Program</header><text display-inline="yes-display-inline">Section 9 of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105</external-xref>) is amended—</text> 
<paragraph id="HCB4DA845150243469C347135062F77AD"><enum>(1)</enum><text>by redesignating subsections (h) and (i) as subsections (j) and (k), respectively; and</text></paragraph> <paragraph id="H1A4DB938EFB14D6699092CD21B809629"><enum>(2)</enum><text>by inserting after subsection (g) the following;</text>

<paragraph id="H4145500BB10E40EC8B6F8A7F536BA3F2"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a grant program to be known as the <quote>Tree City USA Grant Program</quote> to provide competitive grants to eligible entities to enhance and maintain urban forests.</text></paragraph> <paragraph id="HE7907DF0B6494CF28279B826828D0F36" commented="no"><enum>(2)</enum><header>Application</header> <subparagraph id="H053F7CA408574663A483EA103A57B13A"><enum>(A)</enum><header>In general</header><text>To be eligible to be awarded a grant under paragraph (1), an eligible entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including a proposal to enhance and maintain urban forests.</text></subparagraph> 
<subparagraph id="H908017BE1D4E458EACCEA0C2B9698D98"><enum>(B)</enum><header>Application assistance</header><text display-inline="yes-display-inline">A non-profit organization that partners with an eligible entity may submit an application under subparagraph (A) on behalf of such eligible entity.</text></subparagraph></paragraph> <paragraph id="H12CF8FA19054474DB7516620CF6A32D9"><enum>(3)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under paragraph (1), the Secretary shall give priority to eligible entities that submit proposals under paragraph (2)(A) that—</text> 
<subparagraph id="H34A313B596CB4513A23E2706C39CD6CB"><enum>(A)</enum><text>enhance, maintain, or improve access to urban forests in—</text> <clause id="H0E89774113024EFBBF8403623F7448C3"><enum>(i)</enum><text>typically underserved areas; or</text></clause> 
<clause id="H671C4F84C430470090A82B5C7C7BD629"><enum>(ii)</enum><text>areas with low tree or environmental equity;</text></clause></subparagraph> <subparagraph id="H292DC473EAC642559D52F855C6E50A56"><enum>(B)</enum><text>further a statewide assessment or local government initiative to enhance and maintain urban forests;</text></subparagraph> 
<subparagraph id="H6FC4543694B54F75BBCBDD8731C728CD"><enum>(C)</enum><text>include a plan to mitigate risks from insects, disease, and non-native invasive species; and</text></subparagraph> <subparagraph id="H35EC75A54A0843D3A8FFEF514155F3B9"><enum>(D)</enum><text>include a plan to monitor and maintain new and existing trees.</text></subparagraph></paragraph> 
<paragraph id="HAEE5B5CD448543FEB85C02F2F53E7160"><enum>(4)</enum><header>Technical assistance</header><text>The Secretary may provide technical assistance to local governments to assist such local governments with—</text> <subparagraph id="H57650FCF8218438F8B722E0F2867121C"><enum>(A)</enum><text>becoming eligible entities; and</text></subparagraph> 
<subparagraph id="H40F05D8EDA2F48D688EDC7DDE7ED7728"><enum>(B)</enum><text>proposals under paragraph (2)(A).</text></subparagraph></paragraph> <paragraph id="H4199724C35584A5F96BEC0024594F955"><enum>(5)</enum><header>Matching funds</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this subsection shall contribute an amount of non-Federal funds (in cash or in kind) that is at least equal to the amount of the Federal funds received.</text></paragraph> 
<paragraph id="H8862D742A1FE4871A6D63D4BEEB48DB4" commented="no"><enum>(6)</enum><header>Premier tree city</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of the Trillion Trees Act, and annually through 2030 thereafter, the Secretary shall designate as a <quote>Premier Tree City</quote> one eligible entity awarded a grant under this subsection to recognize the superior efforts of such eligible entity in enhancing and maintaining urban forests. </text></paragraph> <paragraph id="H3EC17449B6824D0DB6F7F9DC799F9703"><enum>(7)</enum><header>Authorization of appropriations</header><text>In addition to the amounts authorized under subsection (k), there are authorized to be appropriated $1,000,000 for each of fiscal years 2021 through 2030 to carry out this subsection. </text></paragraph> 
<paragraph id="HA1561C748BD04BC3A045E06C803C2850"><enum>(8)</enum><header>Eligible entity defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>eligible entity</term> means a local government that—</text> <subparagraph id="H45FF71390BC149E88EBC2E96152A00B5"><enum>(A)</enum><text>serves an urban and community area; and</text></subparagraph> 
<subparagraph id="H1E74A5E1650944DAAF98B5534C808E87"><enum>(B)</enum><text>a tree planting non-profit organization recognizes as having—</text> <clause id="H986E1C6566EE4AF48055314554DEE65C" display-inline="no-display-inline"><enum>(i)</enum><text>a tree board or department;</text></clause> 
<clause id="H3ED69F56B2944C7FBE45F49CF002680E"><enum>(ii)</enum><text>a tree care ordinance;</text></clause> <clause id="H1BF27C73B799449F8423009FE722CD34" display-inline="no-display-inline"><enum>(iii)</enum><text>a community forestry program with an annual budget of at least $2 per capita; and</text></clause> 
<clause id="H4212313C02FC4979A1FFE2AAED9F550C" display-inline="no-display-inline"><enum>(iv)</enum><text>an Arbor Day observance and proclamation.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H88A7DF6ACD684384BC431012A596DA23"><enum>(b)</enum><header>Cooperative agreements for urban wood utilization</header><text>Section 9 of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105</external-xref>), as amended by subsection (a), is further amended by inserting after subsection (h) the following:</text>

<subsection id="HF1338ED127C4493EA5694F97082C7FF2"><enum>(i)</enum><header>Pilot project for cooperative agreements for urban wood utilization</header> 
<paragraph id="H68518A2AB2544B0FB983003D5CD04D42"><enum>(1)</enum><header>Cooperative agreements</header><text>The Secretary may enter into cooperative agreements with State and local governments, institutions of higher education, private or non-profit organizations, and other entities that support projects that create wood products from dead and fallen trees in urban and community areas.</text></paragraph> <paragraph id="H2DCB54350EC845D1BB22E884B25A6E81"><enum>(2)</enum><header>Prioritization</header><text>The Secretary shall prioritize entering into cooperative agreements that—</text> 
<subparagraph id="H0D8C0907BA4741088077F39D01E2DF57"><enum>(A)</enum><text>support local job creation;</text></subparagraph> <subparagraph id="H1083B42A384445BEB26E68A09459D952"><enum>(B)</enum><text>are located in typically underserved areas or areas with low tree or environmental equity;</text></subparagraph> 
<subparagraph id="HFF05A69B7FD748BEB24CBF32767737F5"><enum>(C)</enum><text>develop new uses for dead and fallen trees; and</text></subparagraph> <subparagraph id="H8A0785ADF44A42808C2B47393079419A"><enum>(D)</enum><text>improve urban forest health and resiliency. </text></subparagraph></paragraph> 
<paragraph id="H1E0D45E3CF6044708D259DDED9B7ED8B"><enum>(3)</enum><header>Technical and financial assistance</header><text>The Secretary may provide technical or financial assistance to entities that enter into a cooperative agreement under paragraph (1) to facilitate—</text> <subparagraph id="H334DDFE67CB74269815C7DEFBCC35AB7"><enum>(A)</enum><text>research on new uses for dead and fallen trees in urban and community areas; and</text></subparagraph> 
<subparagraph id="H71B49E71DC284A40806648BA14162DE1"><enum>(B)</enum><text>market expansion opportunities for products made from dead and fallen trees in urban and community areas.</text></subparagraph></paragraph> <paragraph id="H0C90CD65DA1E4E619D83B1E2B62221EE"><enum>(4)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of the Trillion Trees Act, the Secretary shall provide a report to the relevant committees on—</text>

<paragraph id="H8C928F3F6E1A46FFACC19D7931F6E2E7"><enum>(5)</enum><header>Definitions</header><text>In this subsection—</text> <subparagraph id="HFF164D4532254C8D809E681CC0CE7A79"><enum>(A)</enum><header>Dead and fallen trees</header><text>The term <term>dead and fallen trees</term> means trees that—</text> 
<clause id="H1B8724C1413447959331155D4775E769"><enum>(i)</enum><text>are dying or have died;</text></clause> <clause id="H8B16848D06D9467BACA15DBED2EE8360"><enum>(ii)</enum><text>have partially or completely fallen over; or</text></clause> 
<clause id="HA49909088279459E805572DF83AF14A4"><enum>(iii)</enum><text>have been negatively impacted by insects, disease, or weather-related disturbances.</text></clause></subparagraph> <subparagraph id="H4E6EAEBA9BBE4280BC87CA4EA354C811"><enum>(B)</enum><header>Relevant committees</header><text>The term <term>relevant committees</term> means—</text>

<section id="H7B9A62A1282D486595E1FCBC8BFDA43C"><enum>122.</enum><header>Civilian Conservation Center urban forestry demonstration program</header><text display-inline="no-display-inline">Section 147(d) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3197">29 U.S.C. 3197(d)</external-xref>), as amended by section 116, is further amended by adding at the end the following:</text> <quoted-block style="OLC" id="HD8E0AA2254DC4E3FB901598F2D520196" display-inline="no-display-inline"> <paragraph id="HD5FF2E9DEE79464395C6B98F157E912E"><enum>(5)</enum><header>Urban forestry</header><text display-inline="yes-display-inline"></text> 
<subparagraph id="H5A0D70C1ADBE4C17919E9D660A75E8A9"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this paragraph, the Secretary of Agriculture and the Secretary of Labor shall jointly establish Civilian Conservation Centers in urban and community areas (as defined in subsection (j) of section 9 of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105</external-xref>)).</text></subparagraph> <subparagraph id="HCE042C02F4B04F56A17FE3021FF14180"><enum>(B)</enum><header>Focus</header><text>In addition to the training and skills required under paragraph (1), the Civilian Conservation Centers established pursuant to subparagraph (A) shall provide training on urban forestry issues, including urban forest conservation, management, maintenance, and monitoring.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HD70C2AF03AE34F5989868C9E203C80B2" commented="no"><enum>123.</enum><header>Memorandum of understanding to coordinate urban forestry programs</header><text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary shall enter into a memorandum of understanding with the Secretaries of Health and Human Services, Housing and Urban Development, Interior, Labor, and Transportation and the Administrator of the Environmental Protection Agency to—</text> <paragraph id="HFE43FF0851F2438C95F30EF09F41361B" commented="no"><enum>(1)</enum><text>identify strategies to increase equitable access to urban forests through existing programs and authorities;</text></paragraph> 
<paragraph id="H561FA68D3E6B42EBB552B1D1B85F560B" commented="no"><enum>(2)</enum><text>coordinate existing urban forestry programs;</text></paragraph> <paragraph id="HDF6B92C74F274E7E9C0C57E4B2BED99F" commented="no"><enum>(3)</enum><text>conduct research on the benefits of urban forests for air quality, heat island mitigation, energy burden reduction, and enhanced shading for heat-resilient housing and active transit; and</text></paragraph> 
<paragraph id="HDA78CAA438484C67ACA396514694AE7E" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">conduct research on improving coordination between the agencies to address insects, disease, and non-native invasive species in urban and community areas. </text></paragraph></section></subtitle> <subtitle id="H805C9357ECFA4C65A6159CBFC9B526E0"><enum>D</enum><header>International Forests</header> <section id="HFC59F79436E34EA9AB0375F2C70306E5"><enum>131.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="H935310AB24AA4054B1F7BF8CAD5091B1"><enum>(1)</enum><text>the Trillion Trees Initiative established by the World Economic Forum should be supported;</text></paragraph> <paragraph id="H4416B42B6AEB48D6BBADDA8C7C61489D"><enum>(2)</enum><text>under such Trillion Trees Initiative, countries, corporations, and individuals around the globe will contribute to conserving, restoring, and growing one trillion trees;</text></paragraph> 
<paragraph id="HE0705B1142D84CABB1E4F568AF59C364"><enum>(3)</enum><text>one trillion new trees globally would sequester a significant amount of atmospheric carbon and constitute a pragmatic step towards addressing global carbon emissions; and</text></paragraph> <paragraph id="H196F60E829A340CEA63502BBA0B69B9A"><enum>(4)</enum><text>under this Act, the United States will—</text> 
<subparagraph id="H0A6DF216707F4F3682F0AD5C3EC7D350"><enum>(A)</enum><text>take a leadership role in conserving, restoring, and growing one trillion trees globally;</text></subparagraph> <subparagraph id="H89FBED0129C94A90B35967D0E5D69866"><enum>(B)</enum><text>use the vast natural assets, robust forest products market, and technical expertise of the United States, to conserve, regenerate, manage, and utilize domestic forestland; and</text></subparagraph> 
<subparagraph id="HF9BC9614F8074A579F69CFA72DB2761F"><enum>(C)</enum><text>incentivize the use of sustainable building products to store carbon.</text></subparagraph></paragraph></section> <section id="H672F501141824CD3889222DCA4C67F7D"><enum>132.</enum><header>International Forest Foundation</header> <subsection id="H17E940ACFB234DF5BDCD641F156BF7DF"><enum>(a)</enum><header>Establishment</header><text>The Administrator of the United States Agency for International Development may enter into an agreement with a non-profit organization to establish an <quote>International Forest Foundation</quote> (in this section referred to as the <quote>Foundation</quote>), which shall not be an agency or instrumentality of the United States Government.</text></subsection> 
<subsection id="H87C177A01DF1429C9E5A29D94075360D"><enum>(b)</enum><header>Purposes</header><text>The purposes of the Foundation shall be—</text> <paragraph id="H54A5485C685F496BB60E0485671826E0"><enum>(1)</enum><text>to encourage, accept, and administer private gifts of money and of real and personal property for the benefit of, or in connection with, the activities and services carried out by the United States Agency for International Development to promote reforestation, afforestation, and the prevention of deforestation around the world;</text></paragraph> 
<paragraph id="H1CAD1389195A4FCB9C4F0897DD0ECA38"><enum>(2)</enum><text>to use private funds to support, undertake, and conduct activities that further the goals established under section 101; and</text></paragraph> <paragraph id="HEF7B7BBFAC224511B1C1B774ACD0B91A"><enum>(3)</enum><text>to undertake, conduct, and encourage educational, technical, and other assistance and other activities that support international goals to increase global carbon capture and storage through the promotion of healthy forests and responsible forest management.</text></paragraph></subsection> 
<subsection id="HF9D1AF56DC014D26AF953E824116291B"><enum>(c)</enum><header>Transfer of funds; liability</header> 
<paragraph id="HA8FCDDDE4F434A7BAD9EFC63AE86AA3C"><enum>(1)</enum><header>Transfer of funds</header><text>The Administrator may authorize, pursuant to an agreement entered into in accordance with this section, the transfer of funds of the United States Agency for International Development to a nonprofit organization for the purpose of offsetting any administrative costs of the Foundation.</text></paragraph> <paragraph id="HB6F8060C1E3D4BB995E7FE354CE60A9A"><enum>(2)</enum><header>Liability</header><text>The United States shall not be liable for any debts, defaults, acts, or omissions of the Foundation. The full faith and credit of the United States shall not extend to any obligations of the Foundation.</text></paragraph></subsection></section> 
<section id="H550C720845494CA68FDCA61F44D96C64"><enum>133.</enum><header>International engagement</header> 
<subsection id="HFA6C721BC2234266AB5FE2EA278BB134"><enum>(a)</enum><header>In general</header><text>To the maximum extent practicable, the Administrator of the United States Agency for International Development shall prioritize programs to support reforestation and afforestation, and to prevent deforestation, in developing countries and in regions that have experienced significant levels of deforestation or whose biodiversity, local economy, and stability would be significantly impacted by deforestation or loss of forest canopy cover around the world.</text></subsection> <subsection id="HAF9027A0B37043CC9A460E1CE8262A89"><enum>(b)</enum><header>Coordination</header><text>In carrying out the programs prioritized in accordance with subsection (a), the Administrator shall, to the maximum extent practicable, make use of public-private partnerships to facilitate engagement by nonprofit organizations and industry partners.</text></subsection></section> 
<section id="HC8DEB97614AE49DEA7DB8E0F35CED497"><enum>134.</enum><header>Global climate change program</header> 
<subsection id="H0044DA8ECAAF457093E4C355E45A159B"><enum>(a)</enum><header>Forestry included</header><text>Section 2402(c)(2) of the Global Climate Change Prevention Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6701">7 U.S.C. 6701(c)(2)</external-xref>) is amended by inserting <quote>and forestry</quote> after <quote>agriculture</quote>.</text></subsection> <subsection id="H01B917E1BF44411E8099F28763DBA53F"><enum>(b)</enum><header>Study of global climate change, agriculture, and forestry</header><text>Section 2403(b) of the Global Climate Change Prevention Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6702">7 U.S.C. 6702(b)</external-xref>) is amended—</text>

<subparagraph id="H3A35CCC20A6F4F3598BEFC181159B833"><enum>(C)</enum><text>the area is covered by an existing programmatic environmental impact statement applicable to such covered projects.</text></subparagraph></paragraph> <paragraph id="HDBBC11E3E0344C0DA732FFDECB2B419F"><enum>(2)</enum><header>Effect of identification</header><text>The Secretary shall prioritize review under section 102(2)(C) of the National Environmental Policy Act of covered projects in a priority area over the completion of any other review under such section.</text></paragraph> 
<paragraph id="H02522EC2F5AA46E580D48771AE0393F2"><enum>(3)</enum><header>Deadline for identification</header><text>The Secretary shall establish the priority areas required under paragraph (1)—</text> <subparagraph id="H48B67278E3DA44E3819124684359451D"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of priority areas for watershed protection projects, critical infrastructure protection projects, or wildlife habitat restoration projects, not later than 60 days after the date of the enactment of this section; and </text></subparagraph> 
<subparagraph id="HDB116CF03A15467F92BD03051345305F"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of priority areas for wildland-urban interface protection projects, not later than 60 days after the programmatic environmental impact statement required under subsection (b) is completed. </text></subparagraph></paragraph> <paragraph id="HC48B3A742B954930AF03C7B0C4D9939D"><enum>(4)</enum><header>Review and modification</header> <subparagraph id="H90996D14328F439997B2762499FA313D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except with respect to areas subject to review under subparagraph (B), not later than 5 years after the date of the enactment of this section and not less than once every 5 years thereafter, the Secretary shall review the priority areas established under paragraph (1) and modify, add, or remove such priority areas.</text></subparagraph> 
<subparagraph id="HC5F410F5476F4A67BC81D89F4F006BE0"><enum>(B)</enum><header>Wildland-urban interface protection priority areas</header><text display-inline="yes-display-inline">Not later than 5 years after the date on which the programmatic environmental impact statement required by subsection (b) is complete and not less than once every 5 years thereafter, the Secretary shall review the priority areas established under paragraph (1) and covered by such statement and modify, add, or remove such priority areas.</text></subparagraph></paragraph></subsection> <subsection id="HC3E7DE79A3634C519FB0E1E4D8716C67" commented="no"><enum>(b)</enum><header>Programmatic environmental impact statement for wildland-Urban interface protection projects</header><text display-inline="yes-display-inline">Not later than 5 years after the date of the enactment of this section, the Secretary shall complete a programmatic environmental impact statement in accordance with section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) for wildland-urban interface protection on public lands, including with respect to—</text> 
<paragraph id="H6CC291F4380E4E938C220A0876FBCFE8" commented="no"><enum>(1)</enum><text>lands classified as high or very high risk of wildfire; and</text></paragraph> <paragraph id="H5F616AF5C47A4BC6BB498607777FB3D8" commented="no"><enum>(2)</enum><text>areas with at-risk communities (as defined in section 101 of the Healthy Forest Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>)).</text></paragraph></subsection> 
<subsection id="H71486DBEC9FF489187F60DE461441CFC" commented="no"><enum>(c)</enum><header>Compliance with the National Environmental Policy Act</header> 
<paragraph id="H72221ADD9E254642AD5B3D31A5F9CCFC" commented="no"><enum>(1)</enum><header>In general</header><text>The requirements of section 102(2)(C) of National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref> with respect to a major Federal action taken under this section shall be deemed to be met—</text> <subparagraph id="HC85214C38C8D4452955121DF58848786" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">for wildland-urban interface protection projects proposed after the date of completion of the programmatic environmental impact statement required by subsection (b), by supplementing such programmatic environmental impact statement and incorporating relevant additional regional analyses that have been completed by Federal agencies since such statement was finalized; </text></subparagraph> 
<subparagraph id="H928792A95ECA4959A78FCAF1B2AFFBF2" commented="no"><enum>(B)</enum><text>for watershed protection projects, by supplementing the programmatic environmental impact statement entitled <quote>National Forest System Land Management Planning</quote> published in January 2012 and incorporating relevant additional regional analyses that have been completed by Federal agencies since such statement was finalized;</text></subparagraph> <subparagraph id="H14C48957661A45A790070074EB5361BE" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">for critical infrastructure protection projects, by supplementing the programmatic environmental impact statement entitled <quote>Designation of Energy Corridors on Federal Land in the 11 Western States (DOE/EIS–0386)</quote> published on November 28, 2008 and incorporating relevant additional regional analyses that have been completed by Federal agencies since such statement was finalized; and</text></subparagraph> 
<subparagraph id="H62D70A88964C419CBCABD76A43F5D425" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">for wildlife habitat restoration projects, by supplementing the programmatic environmental impact statement entitled <quote>National Forest System Land Management Planning</quote> published in January 2012 and incorporating relevant additional regional analyses that have been completed by Federal agencies since such statement was finalized.</text></subparagraph></paragraph> <paragraph id="H36ED6A4C64884867B294257985012F2C" commented="no"><enum>(2)</enum><header>Coordination and consultation</header><text>In developing a supplement under subparagraphs (A) through (D) of paragraph (1), the Secretary shall consult and coordinate with—</text> 
<subparagraph id="H47EE1EDDAEBD4C058882B33505E0A0D6" commented="no"><enum>(A)</enum><text>appropriate State, Tribal, and local governments;</text></subparagraph> <subparagraph id="H60F2F8F25ACA4674BF27FC6C8319D3C7" commented="no"><enum>(B)</enum><text>transmission infrastructure and water infrastructure owners, operators, and developers; and</text></subparagraph> 
<subparagraph id="HCF6B4C061B734D69BE5649E2E0730D85" commented="no"><enum>(C)</enum><text>other appropriate entities.</text></subparagraph></paragraph></subsection> <subsection id="H8A530D781DC948518F3D06F8904FD5E9" commented="no"><enum>(d)</enum><header>Environmental review in priority areas</header> <paragraph id="H7170E16F5C7A429DA2EE54149A69CE26" commented="no"><enum>(1)</enum><header>In general</header><text>If the Regional Forester determines that a proposed covered project has been sufficiently analyzed by a previously completed programmatic environmental impact statement, such statement shall be deemed to fulfill the requirements of section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) with respect to such project. The applicable Regional Forester shall publish any such determinations on a publicly available website.</text></paragraph> 
<paragraph id="HD0D68736A48E4155A68089A5B54123FD" commented="no"><enum>(2)</enum><header>Additional environmental review</header><text>If the Regional Forester determines that a proposed covered project has not been sufficiently analyzed under paragraph (1) and additional environmental review under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) is necessary, the applicable Regional Forester shall rely on analysis in previously completed environmental reviews under such Act in analyzing the potential impacts of the proposed covered project.</text></paragraph></subsection> <subsection id="HF045E07C1BDB4DB1BE320CF2BDE1DC89"><enum>(e)</enum><header>Reports to Congress</header><text>Not later than February 1 of the first fiscal year beginning after the date of the enactment of this section, and each February 1 thereafter, the Secretary shall submit to the relevant committees a report that includes—</text> 
<paragraph id="HF117866B82A841EAA11E40A3AC1C8CC8"><enum>(1)</enum><text>a description, with respect to the preceding year, of the progress of covered projects in priority areas established under this section; and</text></paragraph> <paragraph id="HD9C108FEC69C4E5E8F555F324B3DD467"><enum>(2)</enum><text>projections for how such covered projects will reduce the risk and severity of carbon emissions from wildfires and tree mortality.</text></paragraph></subsection> 
<subsection id="H6D13FE51540B4C9899924515682559B3"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H37EF29F3C95E4983B492F59B3ACAB7B3"><enum>(1)</enum><header>Covered land</header><text>The term <term>covered land</term> means National Forest System lands that are not excluded from forest management activities as a result of—</text> 
<subparagraph id="HFBE914704B9E4A1B85F6FD4902A024AA"><enum>(A)</enum><text>an applicable forest plan;</text></subparagraph> <subparagraph id="HB6D846F27A8343679EACF2A53B0E6F11"><enum>(B)</enum><text>inclusion in the National Wilderness Preservation System;</text></subparagraph> 
<subparagraph id="HF73DE3632BE34F68885865C7F098DEAD"><enum>(C)</enum><text>inclusion within a National or State-specific inventoried roadless area established by the Secretary, unless—</text> <clause id="HC9AD106233AD4085908A04203373730F"><enum>(i)</enum><text>the forest management activity to be carried out is consistent with the forest plan applicable to the area; and</text></clause> 
<clause id="H43066D2258984AC1A6C6C90AC52A1259"><enum>(ii)</enum><text>the Secretary, or their designee, determines the forest management activity is allowed under the roadless rule governing such lands; or</text></clause></subparagraph> <subparagraph id="HFA0898D66BBA48E689BD9B564DDD610B"><enum>(D)</enum><text>any other Federal law.</text></subparagraph></paragraph> 
<paragraph id="H7DCC30AA3340476891292E4DD867856C"><enum>(2)</enum><header>Covered projects</header><text>The term <term>covered projects</term> means critical infrastructure protection projects, watershed protection projects, wildland-urban interface protection projects, and wildlife habitat restoration projects.</text></paragraph> <paragraph id="HBE465376B63C4D8E8C9ADCB782FC978F"><enum>(3)</enum><header>Critical infrastructure protection project</header><text>The term <term>critical infrastructure protection project</term> means a forest or rangeland management project with the primary objective of—</text> 
<subparagraph id="HDE2508B00A7E4267A51F74DBD288D824"><enum>(A)</enum><text>reducing the risk of wildfire ignition within or adjacent to—</text> <clause id="H47531CEFA7CD4BC2ACE97F2794A50C9B"><enum>(i)</enum><text>a utility infrastructure right-of-way; or</text></clause> 
<clause id="H3A2B11142346413DB98A19FAE8DA352F"><enum>(ii)</enum><text>public transportation infrastructure;</text></clause></subparagraph> <subparagraph id="HF4410FE5D177430085C81564B9526AD0"><enum>(B)</enum><text>protecting public infrastructure from wildfire; or</text></subparagraph> 
<subparagraph id="H8E9E8DFA776B412AB2BDC48DD29204ED"><enum>(C)</enum><text>removing hazard trees and or other hazardous fuels from a utility infrastructure right-of-way.</text></subparagraph></paragraph> <paragraph id="H947D3B6CE8E647CBBC3EC1C6D9E82276"><enum>(4)</enum><header>Relevant committees</header><text>The term <term>relevant committees</term> means—</text> 
<subparagraph id="HEF096EB4CC2F45E6BA9DB1C478BCDE2F"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Agriculture, Nutrition, and Forestry of the Senate;</text></subparagraph> <subparagraph id="H833E558C2E634B988C3D5B4D161CE4C6"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></subparagraph> 
<subparagraph id="H4FEC65284A81476791AFFDCFA9FE7E13"><enum>(C)</enum><text>the Committee on Agriculture of the House of Representatives; and</text></subparagraph> <subparagraph id="H0209041F3DBA460AB76D1E5C7F7D8B20"><enum>(D)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph> 
<paragraph id="H1D85302BEE6F4C5CB86CB70AAE3FF554"><enum>(5)</enum><header>Watershed protection project</header><text>The term <term>watershed protection project</term> means a forest or rangeland management project with the objective of—</text> <subparagraph id="H48C2DCE5BFCE4D3EB3F5CAE3D484D2B7"><enum>(A)</enum><text>protecting a municipal or Tribal water source from damage or destruction caused by wildfire;</text></subparagraph> 
<subparagraph id="H5978E8708A104C20A1AC46ED76E8BD1D"><enum>(B)</enum><text>improving, maintaining, or restoring water quality or yield; or</text></subparagraph> <subparagraph id="HD071C420D3FA4CABAF268904524CA3A2" commented="no"><enum>(C)</enum><text>any combination of the purposes specified in subparagraphs (A) through (B). </text></subparagraph></paragraph> 
<paragraph id="H406C787768E9497C85359CF9D0E94E62"><enum>(6)</enum><header>Wildland-urban interface protection project</header><text display-inline="yes-display-inline">The term <term>wildland-urban interface protection project</term> means a forest or rangeland management project which takes place within the boundaries of, or adjacent to, an at-risk community (as defined in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>)). </text></paragraph> <paragraph id="H2803EE25C1C54C78B83450C68072844B"><enum>(7)</enum><header>Wildlife habitat restoration project</header><text>The term <term>wildlife habitat restoration project</term> means a forest or rangeland management project with the primary objective of—</text> 
<subparagraph id="H82DA0DCF09744A9D9AD1DC723DAF7E2A"><enum>(A)</enum><text>protecting, improving, maintaining, or restoring wildlife habitat; or</text></subparagraph> <subparagraph id="H9E34F01EF3E0452CBEC7CB7A055753B4"><enum>(B)</enum><text>protecting, improving, maintaining, restoring, or enhancing management with respect to critical habitat (as defined in section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1532">16 U.S.C. 1532</external-xref>)).</text></subparagraph></paragraph></subsection></section> 
<section id="H09DAEA929B634055BB8D328F321F88DD"><enum>202.</enum><header>Forest carbon stock on State and private forests</header> 
<subsection id="H6FBF252AE24047C7AF21A211FB1DD7C5"><enum>(a)</enum><header>Adding increasing forest carbon stock as a priority</header><text>Section 2(b) of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2101">16 U.S.C. 2101</external-xref>) is amended—</text> <paragraph id="HE07AC51963944894AC2C74F32EF262B8"><enum>(1)</enum><text>by redesignating subparagraphs (6) through (10) as subparagraphs (7) through (11), respectively; and</text></paragraph> 
<paragraph id="H061F70D722B5430ABD7C6993FA6AA372"><enum>(2)</enum><text>by inserting after paragraph (5) the following:</text> <quoted-block id="H3AA77D6FF53145E390F7F6AF8CC0D225" style="OLC"> <paragraph id="HC4D53FEE9AC44BA0969FFDA048C3394A"><enum>(6)</enum><text display-inline="yes-display-inline">the encouragement of afforestation (as defined in section 2 of the Trillion Trees Act), reforestation, management, and related optimizations of forest carbon stock (as such terms are defined in such section) for climate and other ecological benefits;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD9FFF2CB3FE74DB5B9708456FA27D9F6"><enum>(b)</enum><header>Support for State assessments and strategies for forest resources when considering carbon emissions</header><text>Section 2A(a)(1) of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2101a">16 U.S.C. 2101a(a)(1)</external-xref>) is amended—</text> <paragraph id="HBE7A7E2DAAA14BC284128142CC30644B"><enum>(1)</enum><text>by redesignating subparagraph (C) and (D) as subparagraphs (D) and (E), respectively; and</text></paragraph> 
<paragraph id="H078DADDC63594BE4AA0A6252FE25DA99"><enum>(2)</enum><text>by inserting after subparagraph (B) the following:</text> <quoted-block id="H392F203BF5164F6DADEDB096EB531EF4" style="OLC"> <subparagraph id="H7F524D1E45D0462F989A148BDE87196A"><enum>(C)</enum><text display-inline="yes-display-inline">the current amount of forest carbon stock (as defined in section 2 of the Trillion Trees Act and incorporating data from the forest inventory and analysis program under section 3(e)) on State lands and opportunities for increased forest carbon stock;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H7F21F0B1F103442E839E28C4D2AB21FC"><enum>(c)</enum><header>Increasing forest carbon stock through the forest stewardship program</header><text>Section 5(d)(1) of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2103a">16 U.S.C. 2103a(d)</external-xref>) is amended by inserting <quote>carbon sequestration and storage</quote> before <quote>and the aesthetic</quote>.</text></subsection> <subsection id="H5AC920F427DC410EB595F46F49ACA5E4"><enum>(d)</enum><header>Increasing forest carbon stock through the community forest and open space conservation program</header><text>Section 7A(c)(1)(B)(ii) of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2103d">16 U.S.C. 2103d(c)(1)(B)(ii)</external-xref>) is amended by inserting <quote> increasing forest carbon stock (as defined in section 2 of the Trillion Trees Act) and promoting,</quote> after <quote>including</quote>.</text></subsection> 
<subsection id="HC38C7BF390834642B7C6A7C2B8BFBE23"><enum>(e)</enum><header>Increasing forest carbon stock through the promotion of forest health</header><text>Section 8(a) of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2104">16 U.S.C. 2104(a)</external-xref>) is amended—</text> <paragraph id="H82C3AD9839B14BC3A6E6BAF4B9382F7A"><enum>(1)</enum><text>by redesignating paragraphs (4) through (6) as paragraphs (5) through (7); and</text></paragraph> 
<paragraph id="H909C14053DBF47A895243B2521860ADF"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text> <quoted-block id="H68C982E9C33A4DCFBE54A6AC2E995573" style="OLC"> <paragraph id="H1BED82A6556E41A5828DC8D58268CC01"><enum>(4)</enum><text display-inline="yes-display-inline">protect or enhance forest carbon stock (as defined in section 2 of the Trillion Trees Act) on healthy forestland;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6B3BCA0B69A543C98288032CCD27E240"><enum>(f)</enum><header>Increasing forest carbon stock through the reduction of catastrophic wildfire</header><text>Section 10A(b)(1) of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2106c">16 U.S.C. 2106c(b)(1)</external-xref>) is amended—</text> <paragraph id="HCC2C860BC3A64439ABCF59BDE37EAD03"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H2F6F9D8DCAB64477A54F01A7A32CF3C3"><enum>(2)</enum><text>in subparagraph (D), by striking the period and inserting <quote>and</quote> at the end; and</text></paragraph> <paragraph id="H8CE99663D7A1428E95DD35CC4EF0D9F9"><enum>(3)</enum><text>by inserting at the end the following:</text>

<paragraph id="H978A1DD6A4554DF0BF3CBCB7F62671B7"><enum>(1)</enum><text>in subsection (e)—</text> <subparagraph id="H825B51FD1FEC4BFC88AD361C228BC4AA"><enum>(A)</enum><text>in paragraph (6), by striking <quote>and</quote> at the end;</text></subparagraph>

<clause id="HA6F671C6308C4AC1B70262C41BBAFA4B"><enum>(iii)</enum><text display-inline="yes-display-inline">activities to increase forest carbon stock (as defined in section 2 of the Trillion Trees Act), including reforestation (as defined in such section) activities; </text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H5239BE2E45B746B39543740654AA9974"><enum>(D)</enum><text>in clause (iv), as so redesignated, by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph> 
<subparagraph id="HDCFDE308AE494A8685D5C1DE44B94FD8"><enum>(E)</enum><text>by adding at the end the following: </text> <quoted-block style="OLC" id="HB144E5665DFD4A709AA8C4E255C9D9BE" display-inline="no-display-inline"> <clause id="H203C8388443343F5BC51EAA97AA2FE94"><enum>(v)</enum><text display-inline="yes-display-inline">any combination of activities specified in clauses (i) through (iv). </text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H17D987969F30460A9BDCFC593F5F87A1"><enum>(2)</enum><text>in subsection (b)(1), by adding at the end of the following:</text> <quoted-block id="HEF877EE455004D6EA4CF5150C92C29E7" style="OLC"> <subparagraph id="HE65869F229BD4DA29C8B323B35D428A3"><enum>(C)</enum><header>Reforestation priority</header><text>With respect to forest, rangeland, and watershed restoration services described in subsection (a)(4)(A)(iii), the Secretary of Agriculture may enter into good neighbor agreements under this section in accordance with the priorities specified in subsection (e)(3)(A)(ii) of section 3 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1601">16 U.S.C. 1601</external-xref>).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HE5954AC5CD7947379D66BECEEE0C41F9"><enum>(3)</enum><text>in subsection (b)(2), by amending subparagraph (C) to read as follows:</text> <quoted-block id="H697E58D1137244A39EBAD34A883464E2" style="OLC"> <subparagraph id="H4FEF67E00C4A47BD9C8E9E3BB10C12A3"><enum>(C)</enum><header>Treatment of revenue</header><text>Funds received from the sale of timber by a Governor of a State under a good neighbor agreement shall be retained and used by the Governor—</text> 
<clause id="HFA77E3627DE941AEB4979D6910E167E6"><enum>(i)</enum><text>to carry out authorized restoration services under such good neighbor agreement; and</text></clause> <clause id="H9206DC69575B4E1A8A326EAA3FF63BF1"><enum>(ii)</enum><text>if funds are remaining after carrying out the services under clause (i), to carry out authorized restoration services within the State under other good neighbor agreements. </text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HA5284186DA01476BB031F433E5C0C5ED"><enum>204.</enum><header>Research and development programs</header><text display-inline="no-display-inline">Section 3 of the Forest and Rangeland Renewable Resources Research Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/1642">16 U.S.C. 1642</external-xref>) is amended—</text> <paragraph id="HAEC6FBC791BA47779DFDC1F03AF99898"><enum>(1)</enum><text>in subsection (a), by adding at the end the following:</text>

<paragraph id="H47B21654BCFD4CA4898E8402E011BBC3"><enum>(6)</enum><text display-inline="yes-display-inline">Renewable resource assessment research shall also include, as appropriate, research activities related to the sequestration of carbon, including the increased carbon storage through afforestation (as defined in section 2 of the Trillion Trees Act), reforestation (as defined in such section), forest and rangeland management, and the utilization of wood and other materials derived from forest and rangeland renewable resources to store carbon in building materials, industrial and consumer products.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H588C96C6B37A4754B4BE3491EFA3DEB1"><enum>(2)</enum><text>in subsection (d)(2), by adding at the end the following:</text>

<subparagraph id="HC73A53D009C4458F95FFB7F439F7B15B"><enum>(F)</enum><text>Carbon sequestration.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title> <title id="H9FA178B727EC487FB080DFC459EDDAA9"><enum>III</enum><header>Market Incentives for Carbon Sequestration</header> <section id="H32FDACD7045149E8B69F3E1431F7F572"><enum>301.</enum><header>Biochar demonstration project and grant program</header> <subsection id="HCDF35C70624E41BAB5FD0E26D29831C4" display-inline="no-display-inline"><enum>(a)</enum><header>Demonstration projects</header><text display-inline="yes-display-inline"></text> 
<paragraph id="H531D317FC000428F87F4C7BE34CFB3A6"><enum>(1)</enum><header>Establishment</header> 
<subparagraph id="H2CB0BBE5380A4A78A4C2405F06CD94FA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this section, the Secretaries shall establish a program to enter into partnerships with eligible entities to carry out demonstration projects to support the development and commercialization of biochar in accordance with this subsection.</text></subparagraph> <subparagraph id="H1E8EA803F4224018A282CF4E21EFA867"><enum>(B)</enum><header>Location of demonstration projects</header><text>The Secretaries shall, to the maximum extent practicable, establish at least one biochar demonstration project in each Forest Service region. </text></subparagraph></paragraph> 
<paragraph id="HCF004C457ED0401095BA48D1A0303DA9"><enum>(2)</enum><header>Proposals</header><text>To be eligible to enter into a partnership to carry out a biochar demonstration project under paragraph (1)(A), an eligible entity shall submit to the Secretaries a proposal at such time, in such manner, and containing such information as the Secretaries may require.</text></paragraph> <paragraph id="HCCE3DA5236A44E05BF51D8BD63F48FD9"><enum>(3)</enum><header>Priority</header><text>In selecting proposals under paragraph (2), the Secretaries shall give priority to partnering with eligible entities that submit proposals to carry out biochar demonstration projects that—</text> 
<subparagraph id="HD4DAC687B80440A4B2E809147DB756EB"><enum>(A)</enum><text>have the most carbon sequestration potential;</text></subparagraph> <subparagraph id="H7A5387D2BC644A4B8D2F3451E1B45029"><enum>(B)</enum><text>will create new jobs and contribute to local economies, particularly in rural areas;</text></subparagraph> 
<subparagraph id="HABFDE90999364E4698CE61B70B7038FC"><enum>(C)</enum><text>will demonstrate—</text> <clause id="H49D013E9328D48FAAAE28EE40A673427"><enum>(i)</enum><text>new and innovative uses of biochar;</text></clause> 
<clause id="HEAD188DD0EFC4289AD08DE514DAE52A3"><enum>(ii)</enum><text>viable markets for cost-effective biochar-based products;</text></clause> <clause id="HB99A225CA1CF49CAB4250808E96A3C2A"><enum>(iii)</enum><text>the ecosystem services of biochar;</text></clause> 
<clause id="HA8758339BB9641AFAE559D3BFD6F6F3A"><enum>(iv)</enum><text>the benefits of biochar to restore forest heath and resiliency, including for forest soils and watersheds; or</text></clause> <clause id="HBD837580DB92480FAB84328AABD24EEA"><enum>(v)</enum><text>any combination of purposes specified in clauses (i) through (iv);</text></clause></subparagraph> 
<subparagraph id="HF7988F6B32F9475B895DB11403C0B583"><enum>(D)</enum><text>are located in local markets that have the greatest need for the biochar production units due to—</text> <clause id="H6FF35B8A9EBD4D0CBBD72FC06B7B8F5C"><enum>(i)</enum><text>nearby lands identified as having high or very high or extreme risk of wildfire;</text></clause> 
<clause id="HE389B441D50C4A859B2D58AF458E3F43"><enum>(ii)</enum><text>availability of sufficient quantities of feedstocks; or</text></clause> <clause id="HB33EE8574E9A4C418A67CD01BAFD1F2F"><enum>(iii)</enum><text>a high level of demand for biochar or other commercial byproducts of biochar; or</text></clause></subparagraph> 
<subparagraph id="H3D0D6EF6110846C3851CCE0B968EAADB"><enum>(E)</enum><text>any combination of purposes specified in subparagraphs (A) through (D).</text></subparagraph></paragraph> <paragraph id="H00AA02E614944E879DD2062E577F302A"><enum>(4)</enum><header>Use of funds</header><text>In carrying out the program established under paragraph (1)(A), the Secretaries may enter into partnerships and provide funding to carry out demonstration projects that—</text> 
<subparagraph id="H55DC56D7794E45EDA78C75B2162A8976"><enum>(A)</enum><text>acquire and test various feedstocks and their efficacy;</text></subparagraph> <subparagraph id="HE022BF8FC30D42B18DF0DBB46E02B4F7"><enum>(B)</enum><text>develop and optimize commercially and technologically viable biochar production units, including mobile and permanent units;</text></subparagraph> 
<subparagraph id="H231AEEB060A840B7879782C970122EE4"><enum>(C)</enum><text display-inline="yes-display-inline">demonstrate the production of biochar from forest residues and the use of biochar to restore forest health and resiliency;</text></subparagraph> <subparagraph id="HE285583CCB4A4E35A9AA8438977F0DE0"><enum>(D)</enum><text>build, expand, or establish biochar facilities;</text></subparagraph> 
<subparagraph id="HED5738D88AB446838C4A87DFB96CE190"><enum>(E)</enum><text display-inline="yes-display-inline">conduct research on new and innovative uses of biochar or demonstrate cost-effective market opportunities for biochar and biochar-based products;</text></subparagraph> <subparagraph id="HC862BC104C6B4E6B9943442CBB703473"><enum>(F)</enum><text>carry out any other activities the Secretaries determine appropriate; or</text></subparagraph> 
<subparagraph id="H0401C0949CFF43D58744FB63D609B722"><enum>(G)</enum><text display-inline="yes-display-inline">any combination of the purposes specified in subparagraphs (A) through (F). </text></subparagraph></paragraph> <paragraph id="H9BFC99CED1DB4BB6A403F049B30B05BA"><enum>(5)</enum><header>Feedstock requirements</header><text>To the maximum extent practicable, a biochar demonstration project under this subsection shall, with respect to the feedstock used under such project, derive at least 50 percent of such feedstock from forest thinning and management activities, including mill residues, conducted on National Forest System lands.</text></paragraph> 
<paragraph id="HEDBF2504C3AF4F05B8BAA01B240547EE"><enum>(6)</enum><header>Review of biochar demonstration</header> 
<subparagraph id="H0F399043AB3C4EA496352FC5BFF7EEEA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretaries shall conduct regionally-specific research, including economic analyses and life-cycle assessments, on the biochar produced from the demonstration projects under this subsection, including—</text> <clause id="H8874BE57DC8749A7AF3E8E28911014CD"><enum>(i)</enum><text>the effects of such biochar on—</text> 
<subclause id="H9198F70943E44EEE9897AA9A188220F9"><enum>(I)</enum><text>forest health and resiliency;</text></subclause> <subclause id="HC52F61D76A4B4C70A50EE86878FDB498"><enum>(II)</enum><text>carbon capture and sequestration, including increasing soil carbon in the short-term and long-term;</text></subclause> 
<subclause id="HCF6E2529DC1D4548A1BFD60EB5691822"><enum>(III)</enum><text>productivity, reduced input costs, and water retention in agricultural practices;</text></subclause> <subclause id="HC5E2765DC4D843E8A55064CD9BE25DAE"><enum>(IV)</enum><text>soil and grassland health for grazing activities, including grazing activities on Federal land;</text></subclause> 
<subclause id="H6CC5960672904A928AB0D155BCF54B66"><enum>(V)</enum><text>environmental remediation activities, including abandoned mine land remediation; and</text></subclause> <subclause id="H45DEFC51061B410D9848E5A1E4C5E3A6"><enum>(VI)</enum><text display-inline="yes-display-inline">other ecosystem services of biochar;</text></subclause></clause> 
<clause id="H7BDA5082A030497CA96859A05D7D3A16"><enum>(ii)</enum><text display-inline="yes-display-inline">the efficacy of biochar as a co-product of biofuels or in biochemicals; and </text></clause> <clause id="H186286EEBAD542959BC1A950DF830416"><enum>(iii)</enum><text>whether biochar can effectively be used to produce any other technologically and commercially viable outcome.</text></clause></subparagraph> 
<subparagraph id="HE43173659E614A2C9CEE4730A31CE5A4"><enum>(B)</enum><header>Coordination</header><text>The Secretaries shall, to the maximum extent practicable, provide data, analysis, and other relevant information collected under subparagraph (A) to eligible institutions conducting research and development activities on biochar pursuant to receiving a grant under subsection (b).</text></subparagraph></paragraph> <paragraph id="HE11BC04BC75D4CB9A91BC483B41FBF2D"><enum>(7)</enum><header>Limitation on funding for establishing biochar facilities</header><text>In the case of an eligible entity that enters in to a partnership to carry out a biochar demonstration project under this subsection and seeks to establish a biochar facility under such demonstration project, the Secretaries may not provide funding to such eligible entity in an amount greater than 35 percent of the capital cost of establishing such biochar facility. </text></paragraph> </subsection> 
<subsection id="HE4DBD269A7864378BCC207412BF295C6"><enum>(b)</enum><header>Biochar research and development grant program</header> 
<paragraph id="H2C7C6C5EA76A4FD4924923770718776E"><enum>(1)</enum><header>Establishment</header><text>The Secretary of Agriculture shall establish an applied biochar research and development grant program to make competitive grants to eligible institutions to carry out the activities described in paragraph (3).</text></paragraph> <paragraph id="H2C59E5D8686846A4933693BB521C2A74"><enum>(2)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this subsection, an eligible entity shall submit to the Secretary a proposal at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph> 
<paragraph id="HF10F60E66B914BF1ADF84555980C84B5"><enum>(3)</enum><header>Use of funds</header><text>An eligible institution that receives a grant under this subsection shall use the grant funds to conduct applied research on—</text> <subparagraph id="H497948D5EAFD44E5BB5DE36C0B713A7D"><enum>(A)</enum><text>the effect of biochar on forest health and resiliency, accounting for variations in biochar, soil, climate, and other factors;</text></subparagraph> 
<subparagraph id="H80B5E5BBE1824EA9A7A263388FB986DC"><enum>(B)</enum><text display-inline="yes-display-inline">the effect of biochar on soil health and water retention, accounting for variations in biochar, soil, climate, and other factors;</text></subparagraph> <subparagraph id="HFAA5623B30F04521954595F56FAE709B"><enum>(C)</enum><text>the long-term carbon sequestration potential of biochar;</text></subparagraph> 
<subparagraph id="H387FF198BEBB4CD5AED27C26E038C9B0"><enum>(D)</enum><text>the best management practices of biochar and biochar based-products to—</text> <clause id="HF88E6BAC91AE4B6199679E1BA02CE6DA"><enum>(i)</enum><text>maximize carbon sequestration benefits; and</text></clause> 
<clause id="H7918B907BFA54D7E83A72D992CB81C9F"><enum>(ii)</enum><text>maximize the commercial viability and application of such products in forestry, agriculture, environmental remediation, water quality improvement, and other uses;</text></clause></subparagraph> <subparagraph id="H21FB95D6DABA4ECAB0906966BAB92337"><enum>(E)</enum><text>the regional uses of biochar to increase productivity and profitability, including—</text> 
<clause id="HBB9BCDFCB1FD4B3099549C2CC814769A"><enum>(i)</enum><text>uses in agriculture and environmental remediation; and</text></clause> <clause id="HA46E441635204600A9EA24DC9BE06AC2"><enum>(ii)</enum><text>use as a co-product in fuel production;</text></clause></subparagraph> 
<subparagraph id="H2CA0B98B474E4B24AAFDDC4A826009F1"><enum>(F)</enum><text>new and innovative uses from biochar byproducts; and</text></subparagraph> <subparagraph id="HF370889D031546B78DAB27F2F80843EB"><enum>(G)</enum><text>opportunities to expand markets for biochar and create jobs, particularly in rural areas.</text></subparagraph></paragraph></subsection> 
<subsection id="HAAB992D9F42B4065BB47AF6A91BB2188"><enum>(c)</enum><header>Reports</header> 
<paragraph id="HE0B0485FB68B456A95C53FC93009D6EC"><enum>(1)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this section, the Secretaries shall submit a report to Congress that—</text> <subparagraph id="HD06E05D521FA4700AA2DE15AF1C73CC3"><enum>(A)</enum><text display-inline="yes-display-inline">includes policy and program recommendations to improve the widespread use of biochar;</text></subparagraph> 
<subparagraph id="H6B02CD8683814DFEAF1C18316FC7B4DA"><enum>(B)</enum><text>identifies the areas of research needed to advance biochar commercialization; and</text></subparagraph> <subparagraph id="H6A930D2B73844F6AA0A0FA2DB452DF70"><enum>(C)</enum><text display-inline="yes-display-inline">identifies barriers to further biochar commercialization, including permitting and siting considerations.</text></subparagraph></paragraph> 
<paragraph id="H1F5A290E518C4BDC94F25F96530F3141"><enum>(2)</enum><header>President’s annual budget request</header><text display-inline="yes-display-inline">Beginning 2 years after the date of the enactment of this section and annually until the date described in subsection (d), the Secretaries shall include in the budget materials submitted to Congress in support of the President’s annual budget request (submitted to Congress pursuant to section 1105 of title 31, United States Code) for each fiscal year a report on the status of the demonstration projects carried out under subsection (a) and the research and development grants carried out under subsection (b).</text></paragraph></subsection> <subsection id="H4710D0F770F3437BA3B30B20668CF2CF"><enum>(d)</enum><header>Sunset</header><text>The authority to carry out this section shall terminate on the date that is 10 years after the date of the enactment of this section.</text></subsection> 
<subsection id="HBD3B4D6B0E844C0986B6FCED1AE8B696"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H2C9A656698E0402A9A4AE11D046EE7EC"><enum>(1)</enum><header>Biochar</header><text display-inline="yes-display-inline">The term <term>biochar</term> means carbonized biomass produced by converting feedstock through reductive thermal processing for non-fuel uses.</text></paragraph> 
<paragraph id="HF231D1CB7EC345A4A7FFC11C04E9E838"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> <subparagraph id="H4845BEED97B14C28B0BDAEF2E66F74BF"><enum>(A)</enum><text>State, local, and Tribal governments;</text></subparagraph> 
<subparagraph id="HE11EFE61C3E64067B08D751E19AF0005"><enum>(B)</enum><text>eligible institutions; and</text></subparagraph> <subparagraph id="H897FE9E0D0C14A10A4D9754456917F9F"><enum>(C)</enum><text>private, non-private, or cooperative entities.</text></subparagraph></paragraph> 
<paragraph id="H61D4518187914E6A9F2CB66657F5C51B"><enum>(3)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means land-grant colleges and universities, including institutions eligible for funding under the—</text> <subparagraph id="HBE1E26D20E52493FB3E8DED9263CA252"><enum>(A)</enum><text>Act of July 2, 1862;</text></subparagraph> 
<subparagraph id="H44973F6C3B8C4DE3B60F14A1B9F26CAF"><enum>(B)</enum><text>Act of August 30, 1890, including Tuskegee University;</text></subparagraph> <subparagraph id="H4C277A3995A74DF19527E381C4FB6EE7"><enum>(C)</enum><text display-inline="yes-display-inline">Public Law 87–788 (commonly known as the <quote>McIntire-Stennis Act of 1962</quote>); or</text></subparagraph> 
<subparagraph id="HB190C770054B4CE7B15B8B18766FDECE"><enum>(D)</enum><text>Equity in Educational Land-Grant Status Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301</external-xref> note). </text></subparagraph></paragraph> <paragraph id="H2E61A6FFA121486D913D0D8F92DE0FF5"><enum>(4)</enum><header>Feedstock</header><text>The term <term>feedstock</term> means excess biomass in the form of plant matter or materials that serves as the raw material for the production of biochar.</text></paragraph> 
<paragraph id="H9EE14CFF26884A27BD19752F66AEE4AA"><enum>(5)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means—</text> <subparagraph id="HC7346A46EB2349C3B0178FE8FFCD39F9"><enum>(A)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service; and</text></subparagraph> 
<subparagraph id="H5A2E0BC703484576873C9E106461C20F"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Energy, acting through the Director of the Office of Science.</text></subparagraph></paragraph></subsection> <subsection id="HA68BF933D6194B128D93700E433C5D3A"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $50,000,000 for each of fiscal years 2021 through 2023 to carry out this section. </text></subsection></section> 
<section id="H977BA16C25AE457CB93A7B8BB739F56A" section-type="subsequent-section"><enum>302.</enum><header>Sustainable building and residence credit</header> 
<subsection id="HE7BAB2E8DE024A0F88644D2F571293E7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart B of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text> <quoted-block style="OLC" id="H7027D9F92B0F40418A86E0923BFB0DA6" display-inline="no-display-inline"> <section id="HBA1F0FE7353444BD88E50D0C3C28888C"><enum>30E.</enum><header>Sustainable building and residence credit</header> <subsection id="H23D6F7820C874EA18F5529CABD2F53A1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There shall be allowed as a credit against the tax imposed by this chapter for the taxable year an amount equal to the sustainability percentage of—</text> 
<paragraph id="HC4F34BD2A035458BB52BF1B673DF6A18"><enum>(1)</enum><text>the taxpayer’s purchase price of a qualifying building or residence, and</text></paragraph> <paragraph id="H020132AF8DA7407683FD0F8892AE2367"><enum>(2)</enum><text display-inline="yes-display-inline">the taxpayer’s remodeling price of a building or structure described in subsection (c)(3)(B). </text></paragraph></subsection> 
<subsection id="H5C28AA33396C4F67B9FF428D122BF109"><enum>(b)</enum><header>Sustainability percentage</header><text display-inline="yes-display-inline">For purposes of this section:</text> <paragraph id="HEF031C23D62C4B68B40CE110189D4CE1"><enum>(1)</enum><header>In general</header> <subparagraph id="HE8D24100221B4B05941FC9DA5EA9F16E"><enum>(A)</enum><header>Purchase price</header><text>The sustainability percentage with respect to the purchase price of any qualifying building or residence shall be a percentage equal to the lesser of—</text> 
<clause id="HD4EFB2944F0E4577A58B6A7316551EB5"><enum>(i)</enum><text>the percentage by which the sustainability score for such qualifying building or residence exceeds the average sustainability score for the class to which such building or residence belongs, or</text></clause> <clause id="HDB01E4D0E17D4CE798AA75CE7A60EB8B"><enum>(ii)</enum><text>25 percent.</text></clause></subparagraph> 
<subparagraph id="H6AEFC2047A2147778A90D947B0C0DEFF"><enum>(B)</enum><header>Remodeling price</header><text display-inline="yes-display-inline">The sustainability percentage with respect to the remodeling price of a building or structure shall be a percentage equal to the lesser of—</text> <clause id="HAAF846301BD94329A63D640697909891"><enum>(i)</enum><text display-inline="yes-display-inline">the percentage by which, after remodeling, the sustainability score for such building or structure exceeds the average sustainability score for the class to which such building or structure belongs, or</text></clause> 
<clause id="H5C0147B28CA44FE794290C751F08453C"><enum>(ii)</enum><text>12.5 percent.</text></clause></subparagraph></paragraph> <paragraph id="H69313F7596CC47ED93568ACF5296B217"><enum>(2)</enum><header>Sustainability scoring</header> <subparagraph id="HDC17F80E57464F77A0F276BE0DF17E71"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the Secretary (in consultation with the Secretary of Energy) shall establish—</text> 
<clause id="H89B50B85E3D04DD2A53B477D0EB4A632"><enum>(i)</enum><text>a certification process for determining a sustainability score with respect to any building for purposes of the credit allowed under this section, and</text></clause> <clause id="HFC0620CA32AF4F879CC0EF72A0212CB2"><enum>(ii)</enum><text>an average sustainability score for different classes of buildings for purposes of the comparison under subsection (b)(1)(A)(i) or subsection (b)(1)(B)(i).</text></clause></subparagraph> 
<subparagraph id="H21511798AA0C4F8598AC6EF3DEB3425A"><enum>(B)</enum><header>Factors for score</header><text>Such score shall at least take into account the following factors:</text> <clause id="H1F3F092E9FBF4D61923352B6D793F861"><enum>(i)</enum><text display-inline="yes-display-inline">The net carbon emitted during the production and delivery of materials used in construction of the building. </text></clause> 
<clause id="HC0768C692A87490094BDCB1B6A878C76"><enum>(ii)</enum><text>The net carbon emitted during the operation of the building on a yearly basis. </text></clause> <clause id="H0E184A2B802240C3AA388338C460489B"><enum>(iii)</enum><text>The amount of carbon retained by the building, taking into account building construction materials and processes and continuing use or disposal of carbon in connection with the use of the building. </text></clause> 
<clause id="HA2BFDBAFB930417B9B58D23CF148195F"><enum>(iv)</enum><text>The climate in which the building is located.</text></clause></subparagraph> <subparagraph id="HAEFFFB298F774B71B6950083CECDF846"><enum>(C)</enum><header>Average sustainability</header><text>The classes for which average sustainability scores are determined shall at least take into account the following distinguishing characteristics:</text> 
<clause id="HD008C00C1F1943C7838CD83C5BBD3187"><enum>(i)</enum><text>Residential and commercial buildings.</text></clause> <clause id="H925A379799254AC88A5B58F3277EE234"><enum>(ii)</enum><text>Multi-family and single-family residential.</text></clause> 
<clause id="H1D9C07FCB17D4606940B1A6665F4C4F3"><enum>(iii)</enum><text>The size, volume, and intended use of the building.</text></clause></subparagraph> <subparagraph id="H3B8A5953493F49F9B18C7379B2C2973F"><enum>(D)</enum><header>Updates</header><text display-inline="yes-display-inline">The Secretary (in consultation with the Secretary of Energy) shall update the sustainability scoring and the sustainability score averages established under subparagraph (A) not less frequently than once every 5 calendar years.</text></subparagraph> 
<subparagraph id="H1D63A3F008824A0082CC78B06398404B"><enum>(E)</enum><header>Advisory board</header><text>The Secretary shall establish a volunteer board that advises the Secretary on the sustainability score development and updates. Such board shall be appointed at the discretion of the Secretary and shall include experts in relevant fields, including energy, construction, transportation, agriculture, and labor.</text></subparagraph></paragraph></subsection> <subsection id="HCAB6A2DD9B344DB780FBE7E40791BD4D"><enum>(c)</enum><header>Other definitions and special rules</header> <paragraph id="H49A29A53C0A4473BA655224B8C461FA6"><enum>(1)</enum><header>Purchase price</header><text>The term <term>purchase price</term> means so much of the adjusted basis of the property as is not attributable to land.</text></paragraph> 
<paragraph id="HDD27274C4B5747D9A6286E5042D24A58"><enum>(2)</enum><header>Remodeling price</header><text display-inline="yes-display-inline">The term <term>remodeling price</term> means the price of remodeling or expansion of a property, as defined by the Secretary after consultation with the Secretary of Energy. </text></paragraph> <paragraph id="HDDDCACCA755D4C87B58FE9CD5D7DF4EF"><enum>(3)</enum><header>Qualifying building or residence</header><text>The term <term>qualifying building or residence</term> means, with respect to a taxpayer—</text> 
<subparagraph id="H03C94D03B7D64498AA8BAC42BBE689D3"><enum>(A)</enum><text>any dwelling unit first used as a residence by the taxpayer, or</text></subparagraph> <subparagraph id="H65677C8A90AC4D6F9E80940A019FD0DD"><enum>(B)</enum><text>any other building or structure of a character subject to the allowance for depreciation and first placed in service by the taxpayer.</text></subparagraph></paragraph> 
<paragraph id="HF43287020796424EB27CA6DEB4A701D8"><enum>(4)</enum><header>Construction</header><text>Any qualifying building or residence constructed by the taxpayer shall be treated as purchased by the taxpayer on the date the taxpayer first occupies the residence, or places such building in service, as the case may be.</text></paragraph> <paragraph id="HA985C970883749CCBC835E1DD12651BD"><enum>(5)</enum><header>Transfer of credit</header> <subparagraph id="H7B035D85E78F4CF78E88CDA78EAC2357" display-inline="no-display-inline"><enum>(A)</enum><header>In general</header><text>If a taxpayer elects the application of this paragraph for any taxable year, the amount of credit determined under this section for such year which would (but for this paragraph) be allowable to the taxpayer shall be allowable to the person designated by the taxpayer. The person so designated shall be treated as the taxpayer for purposes of this title.</text></subparagraph> 
<subparagraph id="H82288CB53DDC4333884AE57D98F8AC18"><enum>(B)</enum><header>Treatment of amounts paid for assignment</header><text>If any amount is paid to the person who assigns the credit determined under this section, then no portion of such amount shall be includible in such person’s gross income.</text></subparagraph></paragraph> <paragraph id="H13A004A158374BBE8EF9BDCCA8A4DA1A"><enum>(6)</enum><header>Basis adjustment</header><text>For purposes of this subtitle, if a credit is allowed under this section with respect to any qualified building or residence, the basis of such building or residence shall be reduced by the amount of the credit so allowed.</text></paragraph> 
<paragraph id="H05BEB88EB4CF4CB1B5C8FF1469E417D8"><enum>(7)</enum><header>Application without credits</header> 
<subparagraph id="H571C37D22BB84B3880B4F7134242478E"><enum>(A)</enum><header>Business credit treated as part of general business credit</header><text display-inline="yes-display-inline">So much of the credit which would be allowed under subsection (a) for any taxable year (determined without regard to this paragraph) that is attributable to property of a character subject to an allowance for depreciation shall be treated as a credit listed in section 38(b) for such taxable year (and not allowed under subsection (a)).</text></subparagraph> <subparagraph id="H3F2D1D7DF42445AFAB0E221C9AA5A042"><enum>(B)</enum><header>Personal credit</header><text>For purposes of this title, the credit allowed under subsection (a) for any taxable year (determined after application of subparagraph (A)) shall be treated as a credit allowable under subpart A for such taxable year.</text></subparagraph></paragraph> 
<paragraph id="H6637E4330F974AEBB2AC45B4C9AD5955"><enum>(8)</enum><header>Carbon storage certification</header><text>Under the certification process established under subsection (b)(2)(A), the Secretaries shall additionally establish a process for certifying to the taxpayer the amount of carbon dioxide stored by a building or residence as determined under (b)(2)(B)(iii).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HF880EE44D0F54C259217EAC1E5B27A22"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subpart B of part IV of subchapter A of chapter 1 of such Code is amended by adding at the end the following new item:</text>

<toc-entry level="section">Sec. 30E. Sustainable building and residence credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCE70C1C561A847F49298F89DB9382BAF"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to property purchased after December 31, 2020.</text></subsection></section> <section id="H4AD078F3A2804FA495AC3970F36E4CDC"><enum>303.</enum><header>Clarification of research and development program for cellulosic biochemical and bioplastics</header> <subsection id="HD9E30CCC4EC34CD4A9E96E1F95B6224E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Research and Development deputy area and the State and Private Forestry deputy area of the Forest Service, shall conduct performance-driven research and development and provide for education and technical assistance for the purpose of facilitating the use of cellulosic biochemical and bioplastics products in the United States.</text></subsection> 
<subsection id="HB9FD1BD008EF4D2FB96210D3126C8748"><enum>(b)</enum><header>Activities</header><text>In carrying out subsection (a), the Secretary shall—</text> <paragraph id="H32487749F9064E7BBB727697DF0A2DAB"><enum>(1)</enum><text>after collaboration with the forest products industry, conservation organizations, and institutions of higher education, conduct research and development and provide for education and technical assistance at the Forest Products Laboratory or through the State and Private Forestry deputy area that meets measurable performance goals for the achievement of the priorities listed in subsection (c); and</text></paragraph> 
<paragraph id="H7C49636CAFE44DB39B6E6FE733940ED0"><enum>(2)</enum><text>after coordination and collaboration with the entities referred to in paragraph (1), make competitive grants to institutions of higher education for such institutions to conduct research and development and carry out educational programs and provide technical assistance.</text></paragraph></subsection> <subsection id="HC772ABAEA5324044B92D42051A40B193"><enum>(c)</enum><header>Priorities</header><text>In awarding grants under subsection (b)(2), the Secretary shall give priority to applications from institutions of higher education proposing projects—</text> 
<paragraph id="H98A2BC846EA44827A1A67BE956CA1213"><enum>(1)</enum><text>to address ways to improve the commercialization of cellulosic biochemical and bioplastics products;</text></paragraph> <paragraph id="HD4D4604613E4402EA2C45CD8BA86ACA7"><enum>(2)</enum><text>for the conduct of applied research, including projects designed—</text> 
<subparagraph id="HBB9E98C1AFAC44E6B1044FD7E0CD109F"><enum>(A)</enum><text>to bring products from benchtop to production scale; and</text></subparagraph> <subparagraph id="H9FF333BB2A0A44A79CDBFD6400A1B0E1"><enum>(B)</enum><text>for end-of-life reuse, recycling, and disposal of the project;</text></subparagraph></paragraph> 
<paragraph id="H3BE7444192CA4769AEC927BB463C826C"><enum>(3)</enum><text>which, based upon the lifecycle analysis of forest carbon stock developed under section 105(c), will lead to an increase in forest carbon stock through the extraction of raw materials through the manufacture of biochemical and bioplastics products; or</text></paragraph> <paragraph id="H6E0B903208FC45FB9526493B0C231047"><enum>(4)</enum><text>to address one or more other research areas identified by the Secretary, in consultation with conservation organizations, institutions of higher education, and the forest products industry.</text></paragraph></subsection> 
<subsection id="HA296349FD80647318DF9D141DF521FC8"><enum>(d)</enum><header>Timeframe</header><text>To the maximum extent practicable, the measurable performance goals for the research and development, education, and technical assistance under subsection (a) shall be achievable within 5 years.</text></subsection> <subsection id="H367C47FEAD1348E286206720C2912FF7"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HBBAF42AA1E784AC4B09BB048DB5DCF4C"><enum>(1)</enum><header>Cellulosic biochemical product</header><text>The term <term>cellulosic biochemical product</term> means any biochemical, including bioethanol and its derivatives, that is derived from wood or plant cellulose fiber.</text></paragraph> <paragraph id="HC5F104E0AA51458186DCAA9BAA9CAB70"><enum>(2)</enum><header>Cellulosic bioplastics product</header><text>The term <term>cellulosic bioplastics product</term> means any bioplastic that is derived from wood or plant cellulose fiber.</text></paragraph> 
<paragraph id="HA352159C708E496790208FE4DF27D1BD" commented="no"><enum>(3)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given such term in of sections 101 and 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref> and 1002). </text></paragraph> </subsection></section> <section id="H352E359A86604D2B9AC8D8F591B2F464"><enum>304.</enum><header>Tribal and Alaska Native biomass demonstration project extension</header> <subsection id="H8F14F412437D44299F2C38A54B5A8396"><enum>(a)</enum><header>Tribal biomass</header><text display-inline="yes-display-inline">Section 3(a) of the Tribal Forest Protection Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/25/3104">25 U.S.C. 3104</external-xref> note) is amended by striking <quote>fiscal years 2017 through 2021</quote> and inserting <quote>fiscal years 2021 through 2025</quote>. </text></subsection>
