Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Debt Collection Practices Act to extend the provisions of that Act to cover a debt collector who is collecting debt owed to a State or local government, to index award amounts under such Act for inflation, to provide for civil injunctive relief for violations of such Act, and for other purposes.</official-title></form><legis-body id="H07A7DB6F281E43FD86828651FF4E5AD2" style="OLC"><section id="H8461557925FE49EFA2551668262FF9E3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Debt Collection Practices Harmonization Act</short-title></quote>.</text></section><section id="H883506D52DD14E05A1B39C623CAC875E"><enum>2.</enum><header>Preventing deceptive and harassing practices when collecting debt owed to a State or local government</header><text display-inline="no-display-inline">Section 803(5) of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692a">15 U.S.C. 1692a(5)</external-xref>) is amended—</text><paragraph id="H6900B15C886340969EEFD3450E05D110"><enum>(1)</enum><text>by striking <quote>money arising out</quote> and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="H0AC3CD59F9584858B4A107903FF11666" style="OLC"><text>money—</text><subparagraph id="H9CD3A721E93D4D4A9357A7E0795CEE38"><enum>(A)</enum><text display-inline="yes-display-inline">arising out</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HB3E24A18729D4054A9736330CF3EAC85"><enum>(2)</enum><text>by striking <quote>judgment.</quote> and inserting <quote>judgment; or</quote>; and</text></paragraph><paragraph id="HF4288E6F41E34980BF939D24670884F9"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H872E967073364E489D628BB39F9634EA" style="OLC"><subparagraph id="H603886FE9FF04E66BF133B69FC318E4D"><enum>(B)</enum><text display-inline="yes-display-inline">owed to a State.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HE61293CC75A94A6C9166F78033370386"><enum>3.</enum><header>Award of damages</header><subsection id="H2180F864EFFC4EB491E7A54CD00BCB0A"><enum>(a)</enum><header>Additional damages indexed for inflation</header><paragraph id="HBF8C9F9E4C314AB5A83126FB2D49E956"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 813 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692k">15 U.S.C. 1692k</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HB062708FFBED49938A01124BCF5DEAF4" style="OLC"><subsection id="H68E59A54ACA745D79976DF93289ACB88"><enum>(f)</enum><header>Adjustment for inflation</header><paragraph id="HDFCA2FAE87134E7B92D124FE8F0AD311"><enum>(1)</enum><header>Initial adjustment</header><text>Not later than 90 days after the date of the enactment of this subsection, the Bureau shall provide a percentage increase (rounded to the nearest multiple of $100 or $1,000, as applicable) in the amounts set forth in this section equal to the percentage by which—</text><subparagraph id="H9D4DFF16A4664D3E9515A4D3B08A52D1"><enum>(A)</enum><text>the Consumer Price Index for All Urban Consumers (all items, United States city average) for the 12-month period ending on the June 30 preceding the date on which the percentage increase is provided, exceeds</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD0C4046373DB4290BBA629D7FD96E755"><enum>(B)</enum><text>the Consumer Price Index for the 12-month period preceding January 1, 1978.</text></subparagraph></paragraph><paragraph id="H0E263EB9B64D41C29F507F2AC186E792"><enum>(2)</enum><header>Annual adjustments</header><text>With respect to any fiscal year beginning after the date of the increase provided under paragraph (1), the Bureau shall provide a percentage increase (rounded to the nearest multiple of $100 or $1,000, as applicable) in the amounts set forth in this section equal to the percentage by which—</text><subparagraph id="H89797EC3285548CBA13E9A9C62F15342"><enum>(A)</enum><text>the Consumer Price Index for All Urban Consumers (all items, United States city average) for the 12-month period ending on the June 30 preceding the beginning of the fiscal year for which the increase is made, exceeds</text></subparagraph><subparagraph id="HA7B657EE76C549198472F64F41611BDC"><enum>(B)</enum><text>the Consumer Price Index for the 12-month period preceding the 12-month period described in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H01073E45D357489A85F3680A45ABE9AB"><enum>(2)</enum><header>Applicability</header><text>The increases made under section 813(f) of the Fair Debt Collection Practices Act, as added by paragraph (1) of this subsection, shall apply with respect to failures to comply with a provision of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601</external-xref> et seq.) occurring on or after the date of enactment of this Act.</text></paragraph></subsection><subsection id="H1BBABD9E0D2E4E8DAAAE0FD3AABA8331"><enum>(b)</enum><header>Injunctive relief</header><text>Section 813(d) of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692k">15 U.S.C. 1692k(d)</external-xref>) is amended by adding at the end the following: <quote>In a civil action alleging a violation of this title, the court may award appropriate relief, including injunctive relief.</quote>.</text></subsection></section><section id="H7A46B6BDAFB14D85AF114D7785640B00"><enum>4.</enum><header>Prohibition on the referral of emergency individual assistance debt</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/3">Chapter 3</external-xref> of title 31, United States Code, is amended—</text><paragraph id="H0A691AC25C86404A87833002B6D1D381"><enum>(1)</enum><text>in subchapter II, by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0808E25774DF46C191103DAC83F5068E" style="USC"><section id="H2260880AD1A9455CB497B378E9C02621"><enum>334.</enum><header>Prohibition on the referral of emergency individual assistance debt</header><text display-inline="no-display-inline">With respect to any assistance provided by the Federal Emergency Management Agency to an individual or household pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref> et seq.), if the Secretary of the Treasury seeks to recoup any amount of such assistance because of an overpayment, the Secretary may not contract with any debt collector or other private party to collect such amounts, unless the overpayment occurred because of fraud or deceit and the recipient of such assistance knew or should have known about such fraud or deceit.</text></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H6B5523B4416547D58279EE4C450652DD"><enum>(2)</enum><text>in the table of contents for such chapter, by inserting after the item relating to section 333 the following:</text><quoted-block display-inline="no-display-inline" id="H357981A47E75448C85656130D19791CD" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">334. Prohibition on the referral of emergency individual assistance debt.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
