which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to establish a program to track potential sources of airborne debris to prevent the collision of aircraft with such debris, and for other purposes.</official-title></form><legis-body id="H53A80E4886374BB7891FF33D84F541D7" style="OLC"><section id="H367ACDDFCD6B43769EF632F7374F9E6B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Aerospace Debris Safety Act</short-title></quote>.</text></section><section id="HD7BF8716847B4D79BF8634E3ACF6F4C2"><enum>2.</enum><header>Airborne debris collision avoidance</header><subsection id="H2D06A04E705147CCBEA2DB25C28DAAD1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">Chapter 447</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HC010A901A7D649E7B3C4A72C0542BFE4" display-inline="no-display-inline"><section id="H41448D6D53DE4B74BD87403B4C08E634"><enum>44744.</enum><header>Airborne debris collision avoidance</header><subsection id="HD9C586BE25F04838A71B9EF00B66E1A7"><enum>(a)</enum><header>In general</header><text>The Secretary of Transportation, in coordination with the Administrator of the Federal Aviation Administration, shall—</text><paragraph id="HBC85B083C6224B1CBF5909C3020E4589"><enum>(1)</enum><text>establish a program to track objects that are potential sources of covered airborne debris;</text></paragraph><paragraph id="HB48AFA44CD0A472FACD6B35508543B92"><enum>(2)</enum><text>establish a database containing data and information on such objects;</text></paragraph><paragraph id="H012ADD6631964B3EB268040E0F2EFC1A"><enum>(3)</enum><text>utilize existing tools and methods, including communication with the owners or operators of such objects, to determine on an ongoing basis the likelihood and the circumstances, including the time and location, under which such objects may reenter the Earth’s atmosphere in a controlled or uncontrolled manner;</text></paragraph><paragraph id="H9C510D9CAFF84D6EB32FDBE062272FA2"><enum>(4)</enum><text display-inline="yes-display-inline">assess the potential of a reentry of each such object to create covered airborne debris and the risk such debris may pose to aircraft or individuals and property on the ground; and</text></paragraph><paragraph id="H2FC817E4395B4A04AB9EDCCBAAE5ACBF"><enum>(5)</enum><text>establish a system, in consultation with the Chief Operating Officer for the air traffic control system, by which—</text><subparagraph id="H536E21419A5F4AA3A64C2CBB5875F83C"><enum>(A)</enum><text>airspace may be identified for possible control or restrictions when risks are present due to the presence or expected presence of covered airborne debris; and</text></subparagraph><subparagraph id="H181EE027DE8F4049A0805AFEF99EFB58"><enum>(B)</enum><text>aircraft at risk of being impacted by covered airborne debris can be expeditiously notified and redirected.</text></subparagraph></paragraph></subsection><subsection id="H3C49BCC9ACB940BB86B2DB4659143EC0"><enum>(b)</enum><header>Tracking program</header><text>In establishing the program under subsection (a)(1), the Secretary may—</text><paragraph id="H613BFDAA84D4474B9F69A9B9605DE1CF"><enum>(1)</enum><text>acquire or establish facilities and equipment to directly track objects that are potential sources of covered airborne debris; and</text></paragraph><paragraph id="HACCC23C70102422AA7A93231D6EE6186"><enum>(2)</enum><text>contract for, or utilize reliable sources of, data and information relating to such objects from other Federal agencies or any eligible entity, including by using the authority provided in section 106(l)(6).</text></paragraph></subsection><subsection id="H8FD127227A7D4A5B9374B46504B0066E"><enum>(c)</enum><header>Data and information agreements</header><paragraph id="H7D9F9A737C484417B73C97F50AB1162F"><enum>(1)</enum><header>Federal agreement</header><text display-inline="yes-display-inline">Prior to receiving data and information from a Federal agency under subsection (b)(2), or using such data and information for any purpose under this section, the Secretary shall enter into an agreement with the head of such Federal agency that—</text><subparagraph id="HC21C446EF4B24EA5895B6B35892A7E85"><enum>(A)</enum><text>details the purposes for which the Secretary is authorized to use such data and information;</text></subparagraph><subparagraph id="HDBCC569D5F02455B9F2DD775959E1C02" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">describes the conditions under which data and information may not be released, including a list of eligible entities or categories of eligible entities that are not permitted to receive such data and information;</text></subparagraph><subparagraph id="HAF1E4669CA7944E89B2813381749766E" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">ensures that such data or information is safety-related and unclassified;</text></subparagraph><subparagraph id="HD13F595A4085403D986461ED3251C4D5"><enum>(D)</enum><text display-inline="yes-display-inline">designates the Secretary as the sole or primary Federal distributor of such data and information to an eligible entity; and</text></subparagraph><subparagraph id="H4882C6E0D99047F1822EFA996EE90555" commented="no"><enum>(E)</enum><text>contains any other condition or restriction as the Secretary and the head of such Federal agency consider appropriate.</text></subparagraph></paragraph><paragraph id="H95F0867F8A034BED904B05AAB34299B7"><enum>(2)</enum><header>Exceptions</header><subparagraph id="H58477E2BA2A44B5895C4D0D7C3F5B25A"><enum>(A)</enum><header>In general</header><text>The Secretary may not enter into an agreement with the head of a Federal agency under this subsection that restricts the ability of the Secretary to provide the minimum data and information necessary to an eligible entity to effectively provide services described under subsection (d).</text></subparagraph><subparagraph id="H8AC4630259054F8890B2CDA12C82D577"><enum>(B)</enum><header>Classified data or information</header><text display-inline="yes-display-inline">If the Secretary and the head of a Federal agency determine that the sharing of classified data or information from such Federal agency under subsection (b)(2) is necessary or otherwise appropriate, the Secretary and the head of the Federal agency shall include in an agreement under this subsection any procedures and policies that are necessary to manage the use of such classified data or information without compromising the national security interests of the United States.</text></subparagraph></paragraph><paragraph id="HCA95AC7CEA6F4D799A29044AE6D0BD5B"><enum>(3)</enum><header>Non-Federal agreement</header><text display-inline="yes-display-inline">Prior to receiving data and information from an eligible entity under subsection (b)(2), or using such data and information for any purpose under this section, the Secretary shall enter into an agreement with the eligible entity governing the management and dissemination of such data and information. Such agreement may contain such conditions or restrictions as the Secretary considers appropriate.</text></paragraph><paragraph id="H1A34BB13805C4AF49594C8165FB1625C"><enum>(4)</enum><header>Disclosure</header><subparagraph id="H5D888AE4588F4F199E144DD53BC9A427"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Pursuant to section 552(b)(3)(B) of title 5, the Secretary may not disclose to the public any data or information received pursuant an agreement under this subsection.</text></subparagraph><subparagraph id="HC096771EA0584973A0521A22E8D26E2B"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary may disclose data or information under this section that qualifies for an exemption under section 552(b)(4) of title 5, or is designated as confidential by the person or head of the Federal agency providing the data or information, only if the Secretary decides withholding the data or information is contrary to the public or national interest. </text></subparagraph><subparagraph id="H8E75B2E2107B45FB856CFABE16BBE6DD"><enum>(C)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this paragraph shall be construed to prohibit the Secretary from using or releasing such data and information pursuant to the terms of an agreement under this subsection.</text></subparagraph></paragraph></subsection><subsection id="H283019CFB7D94922913F0F9A9DFABDAC"><enum>(d)</enum><header>Safety of airspace and aircraft</header><paragraph id="HB3806098CEF04982A77A8239BB13B898"><enum>(1)</enum><header>United States airspace</header><text>The Secretary shall provide the service described under subsection (a)(5) to aircraft operating in United States airspace or airspace assigned to the United States at no charge.</text></paragraph><paragraph id="H24A41237AC554D1F9D4AFCC9F3408083"><enum>(2)</enum><header>Foreign agreements</header><text>The Secretary may enter into an agreement with a foreign air navigation service provider for the Secretary to provide the services described in subsection (a)(5)(B) to the foreign air navigation service provider, provided that the foreign air navigation service provider—</text><subparagraph id="H1FC97F101E504F29B02EF42296FF5823"><enum>(A)</enum><text display-inline="yes-display-inline">remunerates the Secretary at a rate that is reasonably related to the cost of providing such services, as determined by the Secretary; and</text></subparagraph><subparagraph id="H7BB2FC33A40B4AD69B9AF65B263B2468"><enum>(B)</enum><text>agrees to indemnify and hold the United States Government harmless from any claim related to the provision of such services and any related action or omission.</text></subparagraph></paragraph></subsection><subsection id="HEA3D47142E9F46278E642BA30B5098DF" commented="no"><enum>(e)</enum><header>Other uses of data and information; other services</header><paragraph id="HDBC851539D2044DFB588D4167AB73BC3" commented="no"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary, in coordination with appropriate entities within the Department of Transportation and in consultation with the heads of other relevant Federal agencies—</text><subparagraph id="HCA43B10BCA274B369389A6001515DD8F" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">shall carry out a program to improve the collection, processing, and dissemination of space situational awareness data and information (including information contained in the database established under subsection (a)(2)) and to provide services relating to such data and information;</text></subparagraph><subparagraph id="HC0F0312D35E54ED88778D44C5162B208" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">subject to paragraph (2), may provide such data, information, and services to an eligible entity; and</text></subparagraph><subparagraph id="H5CC11FE4ADAB49AD9D3D630C86062FE5" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">may obtain such data, information, and services from an eligible entity.</text></subparagraph></paragraph><paragraph id="H48B80B9861344F5CB524F890770D1734" commented="no"><enum>(2)</enum><header>Type of information provided</header><subparagraph id="H34A9FF0347F543029FE297D22FFC654C" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Data and information provided to an eligible entity under paragraph (1)(B) shall be safety-related and unclassified.</text></subparagraph><subparagraph id="HDE89FB3222BC4621B90F74AECC092028" commented="no"><enum>(B)</enum><header>Interests of the United States</header><text display-inline="yes-display-inline">The Secretary, in consultation with the head of a Federal agency with which the Secretary has entered into an agreement under subsection (c), shall develop a policy to determine the type of information that may be provided under paragraph (1) without compromising the national security interests of the United States. </text></subparagraph></paragraph><paragraph id="H54A1A08CC0404450B05BA8ACCAC9484D" commented="no"><enum>(3)</enum><header>Public services</header><subparagraph id="HF950922B66254E958C10DCB641F7B73B" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall designate a basic level of data, information, and services described in paragraph (1) to be provided at no charge to an eligible entity and public services to be provided at no charge, including—</text><clause id="H6CE813B0EE814613B8DE2E4628AAD986" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">a public catalog of objects that are potential sources of covered airborne debris and other tracked space objects;</text></clause><clause id="H2670F9CBB8834E3B9EC6282CE002A99E" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">emergency conjunction notifications for objects described in clause (i); and</text></clause><clause id="H5952BD84BE8E4A60BAE4D471E32C5F23" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">any other data, information, or services (excluding services that may be provided pursuant to an agreement under subsection (d)(2)) that the Secretary considers—</text><subclause id="H9E606ECAFD0C42EF8A809B354B52B421"><enum>(I)</enum><text>necessary for safety; or </text></subclause><subclause id="HD002FE97E83440CF9AF0E93FB12E3610"><enum>(II)</enum><text>appropriate.</text></subclause></clause></subparagraph><subparagraph id="HC623ABBF4F3C476CBDFC1ED35436034F" commented="no"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary may not provide data, information, or services under subparagraph (A)(iii)(II) that compete with products offered by United States commercial entities.</text></subparagraph></paragraph><paragraph id="H5C5137C3A0BB4DE49E40FF4992BD7B37" commented="no"><enum>(4)</enum><header>Advanced services</header><text display-inline="yes-display-inline">The Secretary may undertake activities to promote the creation and provision of more advanced levels of data, information, and services described in paragraph (1) to foster the public and private enhancement of transportation safety.</text></paragraph><paragraph id="HDCE88749305D47BFAC746DB804F8C571" commented="no"><enum>(5)</enum><header>Procedures</header><text display-inline="yes-display-inline">The Secretary shall establish procedures by which the authority under this subsection shall be carried out.</text></paragraph><paragraph id="HC6AD88F708C947779FE0902071075537" commented="no"><enum>(6)</enum><header>Immunity</header><text>The United States, any agencies and instrumentalities thereof, and any individuals, firms, corporations, and other persons acting for the United States, shall be immune from any suit in any court for any cause of action arising from the provision or receipt data, information, or services described in paragraph (1) whether or not provided in accordance with this section, or any related action or omission.</text></paragraph></subsection><subsection id="H7605A7070876492ABCFD7373044A07CC"><enum>(f)</enum><header>Non-Delegation</header><text>Except as provided in subsection (e)(5), the authority under this section may only be delegated by the Secretary of Transportation to an officer or employee of the Department of Transportation, including the Federal Aviation Administration.</text></subsection><subsection id="H48E4BC25BB2544AA8A1E4B2B0250CF34" commented="no"><enum>(g)</enum><header>Funding</header><text display-inline="yes-display-inline">Out of amounts made available under section 106(k)(2)(D) of title 49, United States Code, $15,000,000 for each of fiscal years 2022 and 2023 may be expended by the Secretary to carry out this section.</text></subsection><subsection id="HAF9024F3BB824CFB90552CA253D9377F"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H386D8891C31C4DC7B598F8470E1E24D0"><enum>(1)</enum><header>Covered airborne debris</header><text>The term <term>covered airborne debris</term> means any human-made object that—</text><subparagraph id="H116FE78D493A4EFE935752980F7BC1D6"><enum>(A)</enum><text>was previously in Earth orbit;</text></subparagraph><subparagraph id="H1D4ADA6906B14B27AD4E55F82EB68452"><enum>(B)</enum><text>is in the atmosphere;</text></subparagraph><subparagraph id="HFE207D57475A4706AABADB8292C23A16"><enum>(C)</enum><text>is uncontrolled; and</text></subparagraph><subparagraph id="H7FDD1D7A5591487EB5071A113FC6E4CB"><enum>(D)</enum><text>poses a potential risk to the safe flight of civil aircraft in air commerce.</text></subparagraph></paragraph><paragraph id="H53481C33D0104058BA8D8F3602DE26BD"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means any non-Federal entity, including any of the following:</text><subparagraph id="HEAE619028D5F4C34BACA21CF88FD5A2D"><enum>(A)</enum><text>A State.</text></subparagraph><subparagraph id="H95F6351ACF7445B19DCE986521306B93"><enum>(B)</enum><text>A political subdivision of a State.</text></subparagraph><subparagraph id="H557813CD114343A8AF38CC207F7F3C3D"><enum>(C)</enum><text>A United States commercial entity.</text></subparagraph><subparagraph id="H7A88D92F0A3F40948696572350A28CCC"><enum>(D)</enum><text>The government of a foreign country.</text></subparagraph><subparagraph id="HACECCF7A04DA4D3A8FC696A8AF784592"><enum>(E)</enum><text>A foreign commercial entity.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HED0830479D5A4E6E85874E3D364DCE66" display-inline="no-display-inline" commented="no"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">chapter 447</external-xref> of title 49, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HD37F63DCDA0C43A5A480313F0E09C906"><toc regeneration="no-regeneration"><toc-entry level="section">44744.
