congressional review of the imposition of duties and other trade measures by the executive branch, and for other purposes.</official-title></form><legis-body id="H45C28A7464E843DE9E36BA92EE6D3CF1" style="OLC"><section id="HD153DB225AAA41AE8C99793C6D08F7CD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Global Trade Accountability Act of 2021</short-title></quote>.</text></section><section id="HD36B026E9155425FA8CE03A0D6E00F3A"><enum>2.</enum><header>Congressional review of unilateral trade actions</header><subsection id="H6F33D91B450D4D448481186655A41155"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 5 of title I of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2191">19 U.S.C. 2191</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF99EF9439EF748E28003AC3E80524F66" style="OLC"><section id="H24BBBBB48B714656B95C9C32F66CBC6B"><enum>155.</enum><header>Congressional review of unilateral trade actions</header><subsection id="HCDE689E879FB4087B17BE9878F56E040"><enum>(a)</enum><header>Unilateral trade action defined</header><paragraph id="H6F14637A1CE94F42B97578FF46F16FD5"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>unilateral trade action</term> means any of the following actions taken with respect to the importation of an article pursuant to a provision of law specified in paragraph (2):</text><subparagraph commented="no" id="HB66CB21B9B32481AA68D461308846117"><enum>(A)</enum><text>A prohibition on importation of the article.</text></subparagraph><subparagraph id="H503D2FF205A54927B0D602C6B13B10EE"><enum>(B)</enum><text>The imposition of or an increase in a duty applicable to the article.</text></subparagraph><subparagraph id="HD9E24B3B385D4486A44A7D67E62814CD"><enum>(C)</enum><text>The imposition or tightening of a tariff-rate quota applicable to the article.</text></subparagraph><subparagraph id="H57778C50C4404AD4984666EFB6A8E586"><enum>(D)</enum><text>The imposition or tightening of a quantitative restriction on the importation of the article.</text></subparagraph><subparagraph id="H500F9EA116E14B5780FE5C29EEC4F190"><enum>(E)</enum><text>The suspension, withdrawal, or prevention of the application of trade agreement concessions with respect to the article.</text></subparagraph><subparagraph id="H058103BB333F4C6EA5F6C5C3141EFCDE"><enum>(F)</enum><text>Any other restriction on importation of the article.</text></subparagraph></paragraph><paragraph id="HEE557597F30244F0B280D50D0AEB62E0"><enum>(2)</enum><header>Provisions of law specified</header><text>The provisions of law specified in this paragraph are the following:</text><subparagraph id="H81020F6D06A140DEAF355240ABCC81E4"><enum>(A)</enum><text>Section 122.</text></subparagraph><subparagraph id="HD3CC334640F244CAA0BC562311C02771"><enum>(B)</enum><text>Title III.</text></subparagraph><subparagraph commented="no" id="H756945B4C3194708A36CB8837299C292"><enum>(C)</enum><text>Sections 406, 421, and 422.</text></subparagraph><subparagraph commented="no" id="H49639E9BE9E04C5AA93B937D29F22A21"><enum>(D)</enum><text>Section 338 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1338">19 U.S.C. 1338</external-xref>).</text></subparagraph><subparagraph id="H67D8604E67454740BCBE39C64997CEF1"><enum>(E)</enum><text>Section 232 of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862</external-xref>).</text></subparagraph><subparagraph commented="no" id="HFA2AC0E80ECC4C918F5F7F4AE34FF3DE"><enum>(F)</enum><text>Section 103(a) of the Bipartisan Congressional Trade Priorities and Accountability Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/19/4202">19 U.S.C. 4202(a)</external-xref>).</text></subparagraph><subparagraph commented="no" id="HFA618A980198468E9B199CE3AA46EB5F"><enum>(G)</enum><text>The Trading with the Enemy Act (<external-xref legal-doc="usc" parsable-cite="usc/50/4301">50 U.S.C. 4301</external-xref> et seq.).</text></subparagraph><subparagraph id="H267D3268CA8C4215BBF1AB7FB277F998"><enum>(H)</enum><text>The International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.).</text></subparagraph><subparagraph id="H426699711AEC466EBECB2FEE51BB589B"><enum>(I)</enum><text>Any provision of law enacted to implement a trade agreement to which the United States is a party.</text></subparagraph></paragraph><paragraph id="H365C75E6895644DA8AD5062E3994544F"><enum>(3)</enum><header>Exception for technical corrections to Harmonized Tariff Schedule</header><text>A technical correction to the Harmonized Tariff Schedule of the United States shall not be considered a unilateral trade action for purposes of this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H48A0D71BB7934BBBA6EC5A7E27DF5E4F"><enum>(b)</enum><header display-inline="yes-display-inline">Congressional approval required</header><text display-inline="yes-display-inline">Except as provided by subsection (d), a unilateral trade action may not take effect unless—</text><paragraph commented="no" display-inline="no-display-inline" id="HCF0E7EB7B00E4DD3842334846FC46FBA"><enum>(1)</enum><text display-inline="yes-display-inline">the President submits to Congress and to the Comptroller General of the United States a report that includes—</text><subparagraph id="HC5DCD0D663204C3DB18A8587BB4786A1"><enum>(A)</enum><text>a description of the proposed unilateral trade action;</text></subparagraph><subparagraph id="HC26D0240085B408C82B8942FC0D2D276"><enum>(B)</enum><text>the proposed effective period for the action;</text></subparagraph><subparagraph id="H44F72B715AC74DE7AB287517FC67E75C"><enum>(C)</enum><text>an analysis of the action, including whether the action is in the national economic interest of the United States;</text></subparagraph><subparagraph id="H122846F497854FF5875D5991604B75D4"><enum>(D)</enum><text>an assessment of the potential effect of retaliation from trading partners affected by the action; and</text></subparagraph><subparagraph id="H0AF841355D8D4F9E872B585B194264F8"><enum>(E)</enum><text>a list of articles that will be affected by the action by subheading number of the Harmonized Tariff Schedule of the United States; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H05235E9852594AFF945E73DAE00BCF04"><enum>(2)</enum><text display-inline="yes-display-inline">a joint resolution of approval is enacted pursuant to subsection (e).</text></paragraph></subsection><subsection id="HAABD2B0133584257901A399CAFF94F67"><enum>(c)</enum><header>Report of Comptroller General</header><text>Not later than 15 days after the submission of the report required by subsection (b)(1) with respect to a proposed unilateral trade action, the Comptroller General shall submit to Congress a report on the proposed action that includes an assessment of the compliance of the President with the provision of law specified in subsection (a)(2) pursuant to which the action would be taken.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H7142F09B84C04F3589E03D02B39339E7"><enum>(d)</enum><header>Temporary authority</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, a unilateral trade action may take effect for one 90-calendar-day period (without renewal) if the President—</text><paragraph commented="no" display-inline="no-display-inline" id="H3832C453248846EB95E38F7CDDCA3AEC"><enum>(1)</enum><text display-inline="yes-display-inline">determines that is necessary for the unilateral trade action to take effect because the action is—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF7B0E8E8511B43718787993E57F1703A"><enum>(A)</enum><text display-inline="yes-display-inline">necessary because of a national emergency;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H711ADDBB9E67417D88A632D338FC0249"><enum>(B)</enum><text display-inline="yes-display-inline">necessary because of an imminent threat to health or safety;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2044B16DD0C84FDF8BC07182B87D4DBC"><enum>(C)</enum><text display-inline="yes-display-inline">necessary for the enforcement of criminal laws; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8CE6DEC35E25417E8265CE4BFD4122B2"><enum>(D)</enum><text display-inline="yes-display-inline">necessary for national security; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H703B3724F1074B79B65311CD6C881D40"><enum>(2)</enum><text display-inline="yes-display-inline">submits written notice of the determination to Congress.</text></paragraph></subsection><subsection id="H347D6F0C5CD3401DA0C52B13E3179619"><enum>(e)</enum><header>Procedures for joint resolution</header><paragraph commented="no" display-inline="no-display-inline" id="HE0BC1E9B45004E49AF1C14E09029237D"><enum>(1)</enum><header display-inline="yes-display-inline">Joint resolution defined</header><text>For purposes of this subsection, the term <term>joint resolution</term> means only a joint resolution of either House of Congress, the matter after the resolving clause of which is as follows: <quote>That Congress approves the action proposed by the President under section 155(b) of the Trade Act of 1974 in the report submitted to Congress under that section on _______.</quote>, with the blank space being filled with the appropriate date.</text></paragraph><paragraph id="H5FF58A73089E424A87959AE5289A6DD9"><enum>(2)</enum><header>Introduction</header><text>After a House of Congress receives a report under subsection (b)(1) with respect to a unilateral trade action, the majority leader of that House (or his or her respective designee) shall introduce (by request, if appropriate) a joint resolution—</text><subparagraph id="H926303F6CFF84B059845563115958D04"><enum>(A)</enum><text>in the case of the House of Representatives, within 3 legislative days; and</text></subparagraph><subparagraph id="HAF34CA5951254255BF0E0108724BCAD0"><enum>(B)</enum><text>in the case of the Senate, within 3 session days.</text></subparagraph></paragraph><paragraph id="H0C85414534434B958F4CF9BF20E6BC1A"><enum>(3)</enum><header>Application of section 152</header><text>The provisions of subsections (b) through (f) of section 152 shall apply to a joint resolution under this subsection to the same extent those provisions apply to a resolution under section 152.</text></paragraph></subsection><subsection id="H2C40892297174DD58DA6A4EE856D0C7C"><enum>(f)</enum><header>Report by the United States International Trade Commission</header><text>Not later than 12 months after the date of a unilateral trade action taken pursuant to this section, the United States International Trade Commission shall submit to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives a report on the effects of the action on the United States economy, including a comprehensive assessment of the economic effects of the action on producers and consumers in the United States.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2D82C1D44E5B439F957F40990FC729C0"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Trade Act of 1974 is amended by inserting after the item relating to section 154 the following:</text><quoted-block display-inline="no-display-inline" id="HE6AC3D78E45E4DBC82B4104375848186" style="OLC"><toc><toc-entry bold="off" level="section">Sec. 155. Congressional review of unilateral trade actions.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE05CD54E0AC04CCCAD9C4F93DBC651DD"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="H19898382C9234F1696417972D01D474E"><enum>(1)</enum><header>Balance-of-payments authority</header><text>Section 122 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2132">19 U.S.C. 2132</external-xref>) is amended—</text><subparagraph id="HE51601A07A28456193E3C32C94156A5F"><enum>(A)</enum><text>in subsection (a), in the flush text following paragraph (3), by inserting <quote>and subject to approval under section 155</quote> after <quote>Congress)</quote>;</text></subparagraph><subparagraph id="H732F94DB788F464BA0CBD7931AABBCE3"><enum>(B)</enum><text>in subsection (c), in the flush text following paragraph (2), by inserting <quote>and subject to approval under section 155</quote> after <quote>Congress)</quote>; and</text></subparagraph><subparagraph id="HB5D4D5C4C1504DC798C16750080CAC88"><enum>(C)</enum><text>in subsection (g), by inserting <quote>and subject to approval under section 155</quote> after <quote>of this section</quote>.</text></subparagraph></paragraph><paragraph id="H7216D5DA5AD143B493B51E1BD4A39C9E"><enum>(2)</enum><header>Rules of House and Senate</header><text>Section 151(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2191">19 U.S.C. 2191(a)</external-xref>) is amended—</text><subparagraph id="H2798BF6E879545EA9E455C3863CFDABA"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>and 153</quote> and inserting <quote>, 153, and 155</quote>; and</text></subparagraph><subparagraph id="H50FAD1726121410888C58CC4637779D0"><enum>(B)</enum><text>in paragraph (1), by striking <quote>and 153(a)</quote> and inserting <quote>, 153(a), and 155(e)</quote>.</text></subparagraph></paragraph><paragraph id="H8777018970914789BF0F3002A0DF0F3D"><enum>(3)</enum><header>Enforcement of rights under trade agreements</header><text>Title III of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411</external-xref> et seq.) is amended—</text><subparagraph id="H88C7A2E732FD4998951A770E526D283A"><enum>(A)</enum><text>in section 301—</text><clause id="H36C3D60A94D54447B7D202A87DA1A7D0"><enum>(i)</enum><text>in subsection (a), in the flush text, by inserting <quote>to approval under section 155 and</quote> after <quote>subsection (c), subject</quote>; and</text></clause><clause id="H30ECCC2232344CD0AE4968E341483AEC"><enum>(ii)</enum><text>in subsection (b)(2), by inserting <quote>to approval under section 155 and</quote> after <quote>subsection (c), subject</quote>;</text></clause></subparagraph><subparagraph id="HF739DC2F4CF648E89CF1044DDAA10C43"><enum>(B)</enum><text>in section 305(a)(1), by inserting <quote>to approval under section 155 and</quote> after <quote>section 301, subject</quote>; and</text></subparagraph><subparagraph id="H4C9CCD5EE6094EBC97D20870B1A90D57"><enum>(C)</enum><text>in section 307(a)(1), in the matter preceding subparagraph (A), by inserting <quote>to approval under section 155 and</quote> after <quote>any action, subject</quote>.</text></subparagraph></paragraph><paragraph commented="no" id="H3BF5E2D6E12848C8883124D98E2F77E9"><enum>(4)</enum><header>Market disruption</header><text>Section 406 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2436">19 U.S.C. 2436</external-xref>) is amended—</text><subparagraph commented="no" id="H7B7D6AE843A34B229889FA12279B904E"><enum>(A)</enum><text>in subsection (b), in the matter preceding paragraph (1), by striking <quote>With respect to</quote> and inserting <quote>Subject to approval under section 155, with respect to</quote>; and</text></subparagraph><subparagraph commented="no" id="H80C49D8AB3FD4176BB3A6D90489BBB4E"><enum>(B)</enum><text>in subsection (c), in the second sentence, by striking <quote>If the President</quote> and inserting <quote>Subject to approval under section 155, if the President</quote>.</text></subparagraph></paragraph><paragraph commented="no" id="HF157153AF16C4F2D8AFAE9D57F58730F"><enum>(5)</enum><header>Action to address market disruption</header><text>Section 421 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2451">19 U.S.C. 2451</external-xref>) is amended—</text><subparagraph commented="no" id="H9C2829C1614E465B930C0ADE7F0E8BC1"><enum>(A)</enum><text>in subsection (a), by inserting <quote>and subject to approval under section 155</quote> after <quote>of this section</quote>;</text></subparagraph><subparagraph commented="no" id="H864309AE0A75412FB8A897EBEA26D12E"><enum>(B)</enum><text>in subsection (i)(4)(A), by inserting <quote>, subject to approval under section 155,</quote> after <quote>provisional relief and</quote>;</text></subparagraph><subparagraph commented="no" id="HD8ABB75F483F447A8523D40535F18B8B"><enum>(C)</enum><text>in subsection (k)(1), by striking <quote>Within 15 days</quote> and inserting <quote>Subject to section 155, within 15 days</quote>;</text></subparagraph><subparagraph commented="no" id="H6E137AB327C44952BBC9DBCBAA06111A"><enum>(D)</enum><text>by striking subsection (m) and by redesignating subsections (n) and (o) as subsections (m) and (n), respectively;</text></subparagraph><subparagraph commented="no" id="H0B29521AB0D84A6D82EE5C3FE8DCD10A"><enum>(E)</enum><text>in subsection (m), as redesignated by subparagraph (D)—</text><clause commented="no" id="HB6022712FFE94C73818C4799CFFEADFF"><enum>(i)</enum><text>in paragraph (1), by striking <quote>subsection (m)</quote> and inserting <quote>this section</quote>; and</text></clause><clause commented="no" id="H22CAE3809DE14E6B9DC3743D195411BB"><enum>(ii)</enum><text>in paragraph (2), by inserting <quote>and subject to approval under section 155</quote> after <quote>paragraph (1)</quote>; and</text></clause></subparagraph><subparagraph commented="no" id="HFDFF1EEB02FF4F4792B0E7DA470FE515"><enum>(F)</enum><text>in paragraph (3) of subsection (n), as redesignated by subparagraph (D), by striking <quote>subsection (m)</quote> and inserting <quote>this section</quote>.</text></subparagraph></paragraph><paragraph commented="no" id="H3A6F0FB97C294B1497416688F03273E7"><enum>(6)</enum><header>Action in response to trade diversion</header><text>Section 422(h) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2451a">19 U.S.C. 2451a(h)</external-xref>) is amended by striking <quote>Within 20 days</quote> and inserting <quote>Subject to approval under section 155, within 20 days</quote>.</text></paragraph><paragraph commented="no" id="HDA29EDCDB2024B78A8F692524502CA2F"><enum>(7)</enum><header>Discrimination by foreign countries</header><text>Section 338 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1338">19 U.S.C. 1338</external-xref>) is amended—</text><subparagraph commented="no" id="H7CBB9F331B4C462CBCF25BDF6308ADC5"><enum>(A)</enum><text>in subsection (a), in the matter preceding paragraph (1), by inserting <quote>, subject to approval under section 155 of the Trade Act of 1974,</quote> after <quote>by proclamation</quote>;</text></subparagraph><subparagraph commented="no" id="H1CA0BF01D61E4926941A097ACECEA2DA"><enum>(B)</enum><text>in subsection (b), by inserting <quote>subject to approval under section 155 of the Trade Act of 1974 and</quote> after <quote>hereby authorized,</quote>;</text></subparagraph><subparagraph commented="no" id="H3F1F66AD6D5444D7BB9EDA0810BAF86D"><enum>(C)</enum><text>in subsection (c), by striking <quote>Any proclamation</quote> and inserting <quote>Subject to approval under section 155 of the Trade Act of 1974, any proclamation</quote>;</text></subparagraph><subparagraph commented="no" id="HB877C4216C3A4B1FAC09F9FD2460FD2C"><enum>(D)</enum><text>in subsection (d), by inserting <quote>subject to approval under section 155 of the Trade Act of 1974 and</quote> after <quote>he shall,</quote>; and</text></subparagraph><subparagraph commented="no" id="H438B46A8A263440FA1965CDE8764B31A"><enum>(E)</enum><text>in subsection (e), by inserting <quote>subject to approval under section 155 of the Trade Act of 1974 and</quote> after <quote>he shall,</quote>.</text></subparagraph></paragraph><paragraph commented="no" id="HB18106C6B9B947D4A9E3AC87E4B42E7E"><enum>(8)</enum><header>Safeguarding national security</header><text>Section 232(c)(1)(B) of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862(c)(1)(B)</external-xref>) is amended by inserting <quote>, subject to approval under section 155 of the Trade Act of 1974,</quote> after <quote>shall</quote>.</text></paragraph><paragraph commented="no" id="H476AED8ED8A445FD9697F0D9A6D8DC01"><enum>(9)</enum><header>Bipartisan Congressional Trade Priorities and Accountability Act of 2015</header><text>Section 103(a) of the Bipartisan Congressional Trade Priorities and Accountability Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/19/4202">19 U.S.C. 4202(a)</external-xref>) is amended—</text><subparagraph commented="no" id="H77717ED3096D4D84A57024A6042BD514"><enum>(A)</enum><text>in paragraph (1)(B), by inserting <quote>and approval under section 155 of the Trade Act of 1974</quote> after <quote>paragraphs (2) and (3)</quote>;
