read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20220927">September 27, 2022</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, with amendments</action-desc><action-instruction>Omit the part struck through and insert the part printed in italic</action-instruction></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend section 1115 of title 31, United States Code, to amend the description of how performance goals are achieved, and for other purposes.</official-title></form><legis-body id="H5279770499644FBC8A42C855028A59B5" style="OLC"><section id="HE0B6E7C44E244F2099F4E29CFB7E904A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Performance Enhancement Reform Act</short-title></quote>.</text></section><section id="H0A42443F09FE485A9D616C604AEE23A9"><enum>2.</enum><header>Amendment</header><text display-inline="no-display-inline">Section 1115 of title 31, United States Code, is amended—</text><paragraph id="H336116309A7B4EECBD7AD56C42D97A20"><enum>(1)</enum><text>by amending subsection (b)(5) to read as follows:</text><quoted-block style="USC" id="H3ECDCE07DF104A9091C628EE0FD7C35B" display-inline="no-display-inline"><paragraph id="HD0338814A2394A52AE7FDA7F036A447E"><enum>(5)</enum><text display-inline="yes-display-inline">provide a description of how the performance goals are to be achieved, including—</text><subparagraph id="H1CD4F797773A4554ADF9588B7681756B"><enum>(A)</enum><text>the human capital, training, data and evidence, information technology, and skill sets required to meet the performance goals;</text></subparagraph><subparagraph id="H8BFD59788CF94C01AC57EE7A4D4798D2"><enum>(B)</enum><text display-inline="yes-display-inline">the technology modernization investments, system upgrades, staff technology skills and expertise, stakeholder input and feedback, and other resources and strategies needed and required to meet the performance goals;</text></subparagraph><subparagraph id="H7D0792EE748940B195E77B0EECC17FF6"><enum>(C)</enum><text>clearly defined milestones;</text></subparagraph><subparagraph id="HB7C16FA4C0954DE18FBE7FA60BCB9A9F"><enum>(D)</enum><text display-inline="yes-display-inline">an identification of the organizations, program activities, regulations, policies, operational processes, and other activities that contribute to each performance goal, both within and external to the agency;</text></subparagraph><subparagraph id="H315E110AF28C4337A036FDF206312F23"><enum>(E)</enum><text>a description of how the agency is working with other agencies and the organizations identified in subparagraph (D) to measure and achieve its performance goals as well as relevant Federal Government performance goals; and</text></subparagraph><subparagraph id="HBAE2A49F9A8547A2B5091812633EE94B"><enum>(F)</enum><text>an identification of the agency officials responsible for the achievement of each performance goal, who shall be known as goal leaders;</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HE32F39034E4C45AAAB6E9494BFECAC72"><enum>(2)</enum><text>by amending subsection (g) to read as follows:</text><quoted-block style="OLC" id="HB1D5B73DE98A460ABDFE99242BB8AA87" display-inline="no-display-inline"><subsection id="H1FA14583B4074BF1A136C904230388F2" commented="no"><enum>(g)</enum><header>Preparation of performance plan</header><text display-inline="yes-display-inline">The <deleted-phrase reported-display-style="strikethrough">Chief</deleted-phrase> Performance Improvement <deleted-phrase reported-display-style="strikethrough">Office</deleted-phrase><added-phrase reported-display-style="italic">Officer of each agency</added-phrase> (or the functional equivalent) shall collaborate with the Chief Human Capital Officer (or the functional equivalent), the Chief Information Officer (or the functional equivalent), the Chief Data Officer (or the functional equivalent), and the Chief Financial Officer (or the functional equivalent) <added-phrase reported-display-style="italic">of that agency</added-phrase> to prepare that portion of the annual performance plan described under subsection (b)(5) <added-phrase reported-display-style="italic">for that agency</added-phrase>. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H59146F87288D4C68A40AE40971A651B8"><enum>3.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go-Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the <deleted-phrase reported-display-style="strikethrough">House</deleted-phrase><added-phrase reported-display-style="italic">Senate</added-phrase> Budget Committee, provided that such statement has been submitted prior to the vote on passage. </text></section></legis-body><endorsement><action-date date="20220927">September 27, 2022</action-date><action-desc>Reported with amendments</action-desc></endorsement></bill>
