<section id="H8525CF16AF79438B97E3C2B6761C5A62" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Environments, Soils, Trees, and Operations to develop the Rural Economy Act of 2021</short-title></quote> or the <quote><short-title>RESTORE Act of 2021</short-title></quote>.</text> </section> <section id="H65BC056F1F76464BB669641857D88325"><enum>2.</enum><header>Forest landscape projects</header> <subsection id="H4A01BF2ACEA14029B3C78AEA035083D3"><enum>(a)</enum><header>Establishment</header> <paragraph id="H08BEE89ED48B4E0BB1F1606648DF974F"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary shall, at the request of a Governor of a State, select a forest landscape in the State on which to conduct a forest landscape project described in subsection (b)(1).</text></paragraph> 
<paragraph id="H92D494E33B594C60A012C2B659D1E59E"><enum>(2)</enum><header>Process</header> 
<subparagraph id="HBB1DF408988D47AAAB4332EC7AAF5DCE"><enum>(A)</enum><header>Proposals</header><text display-inline="yes-display-inline">To request a forest landscape project be carried out in a State under paragraph (1), the Governor of such State may submit to the Secretary a proposal for a forest landscape project in such State.</text></subparagraph> <subparagraph id="H3242294F23204C8DA66DDF94B59D1C9B" commented="no"><enum>(B)</enum><header>Selection</header><text display-inline="yes-display-inline">The Secretary may only select a proposal submitted under subparagraph (A) if the proposal will be conducted on a forest landscape.</text></subparagraph></paragraph> 
<paragraph id="HB9065A611F3341C7BD5A6C7FB9FAFFBE"><enum>(3)</enum><header>Applicability of NEPA</header><text display-inline="yes-display-inline">The selection of a forest landscape under this subsection shall not be subject to the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text></paragraph></subsection> <subsection id="H3F8E709AA1D747C5840EC406928DA4C3"><enum>(b)</enum><header>Forest landscape projects</header> <paragraph id="HFA9BF018064445E6892C177459E33F39"><enum>(1)</enum><header>In general</header><text>A forest landscape project carried out by the Secretary under this section is a project—</text> 
<subparagraph id="H0D8802C2D932444B8469D395FDC97BE6"><enum>(A)</enum><text>for which the Secretary carries out 1 or more covered management activities described in paragraph (2); and</text></subparagraph> <subparagraph id="HD346A40494FF43BFBCA5B9032E291EEB"><enum>(B)</enum><text>that takes place—</text> 
<clause id="HBCD3A4FBE4CF4BD8922D19EEB0D40EC0"><enum>(i)</enum><text>on a forest landscape; and</text></clause> <clause id="H600DEB5FB56C40DBA949EC2E2EAF06C0"><enum>(ii)</enum><text>on not more than 75,000 acres of—</text> 
<subclause id="H14B97D202A164C5DB8E3E346310BA2DD"><enum>(I)</enum><text>Federal land; or</text></subclause> <subclause id="H1AA09F5E66054C8FB8B4645EFE0AFFAD"><enum>(II)</enum><text>non-Federal land adjacent to Federal land on which the project is also carried out.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HC08FB8D125B94588BC66D675C7013F87" display-inline="no-display-inline"><enum>(2)</enum><header>Covered management activity</header><text>A covered management activity described in this paragraph is a forest management activity to—</text> <subparagraph id="H896AD7F1B64A42A19BE16F00DF7A4417"><enum>(A)</enum><text>install fuel breaks (including shaded fuel breaks) not more than <fraction>1/2</fraction>-mile wide across a forest landscape in a strategic system that maximizes the reduction of wildfire risk to communities or watersheds;</text></subparagraph> 
<subparagraph id="H930AEFB4B4484973AFE673879ABB6C72"><enum>(B)</enum><text>carry out mechanical thinning (including restoration thinning) of a forest landscape to clear—</text> <clause id="HC0A5788E0E1945539F0CC71E9420A23B"><enum>(i)</enum><text>surface fuels, such as slash;</text></clause> 
<clause id="H4DF620AD2ADD4324B43A28D41758A53C"><enum>(ii)</enum><text>ladder fuels, such as small and medium diameter trees and shrubs; or</text></clause> <clause id="HFDFB9CE6008B448A9F5F9621699C8565"><enum>(iii)</enum><text>both of the fuels described in clauses (i) and (ii); </text></clause></subparagraph> 
<subparagraph id="H3424B664D9764A3381AF96AE3BDE2D3F"><enum>(C)</enum><text>conduct controlled burns; and</text></subparagraph> <subparagraph id="H39664D6698804B4BAB3C1F7C8A0DFF27"><enum>(D)</enum><text>remove dead trees, dying trees, or trees at high-risk of dying. </text></subparagraph></paragraph> 
<paragraph id="HCE86A7F6B5F14467B450575A97170FAF"><enum>(3)</enum><header>Requirements</header><text>In carrying out a covered management activity under a forest landscape project, the Secretary—</text> <subparagraph id="H951EE8652B5645DC84652EFF6E5ED109"><enum>(A)</enum><text>shall—</text> 
<clause id="H4C80814C8E634CA9801457321F9BAB93"><enum>(i)</enum><text>maximize the retention of old-growth stands and large trees, as appropriate for the forest type, to the extent that the trees promote stands that are resilient to wildfire and increased average temperature; and</text></clause> <clause id="H29FA6C43DCBB4C2DA658667DA277AA33"><enum>(ii)</enum><text>consider the best available scientific information to maintain or restore the ecological integrity of the forest landscape; and</text></clause></subparagraph> 
<subparagraph id="H85109F431FDD4CADBAEE2439AC79D021"><enum>(B)</enum><text>may not establish a permanent road.</text></subparagraph></paragraph></subsection> <subsection id="H82E17EDE66F241B08895BE894A5A64AC"><enum>(c)</enum><header>Environmental analysis</header> <paragraph id="H4AB90763E9EE49F7857409DACDA1A52A"><enum>(1)</enum><header>Application to certain environmental assessments and environmental impact statements</header><text display-inline="yes-display-inline">This subsection shall apply in any case in which the Secretary prepares an environmental assessment or an environmental impact statement pursuant to section 102(2) of the National Environmental Policy Act of 1969 (42 U.S.C.4332(2)) for a forest landscape project—</text> 
<subparagraph id="H16121F4886DC446EADEF53FC80E97A24"><enum>(A)</enum><text>that—</text> <clause id="HC46B7CA608404138B4D7D24C83E7ADE7"><enum>(i)</enum><text>is developed through a collaborative process; or</text></clause> 
<clause id="HBC3322A1E17A4A1C97C792F049614E4C"><enum>(ii)</enum><text>is covered by a community wildfire protection plan; and</text></clause></subparagraph> <subparagraph id="H3F28A8F8267240CE9A5A761FA40F0238"><enum>(B)</enum><text>the primary purpose of which is—</text> 
<clause id="H6CEB00E2BBFA405AA85D9E070F9310C4"><enum>(i)</enum><text>to reduce the risk of wildfire in the forest landscape; </text></clause> <clause id="H3F118ED99CAE46F395F450A4F0CCC183"><enum>(ii)</enum><text>to restore ecological health to the forest landscape; or</text></clause> 
<clause id="HC13CF5CC230F4EA594DE31CE7EC266D9"><enum>(iii)</enum><text>to adapt the forest landscape to the increased risk of wildfire due to climate change.</text></clause></subparagraph></paragraph> <paragraph id="H2777962FAF8C42E1B0FCCBDC2216541C"><enum>(2)</enum><header>Consideration of alternatives</header><text display-inline="yes-display-inline">In an environmental assessment or an environmental impact statement described in paragraph (1), the Secretary shall study, develop, and describe only the following alternatives:</text> 
<subparagraph id="H6B8EFD1C0C7947AEAC6F3BABC7461B82"><enum>(A)</enum><text>The proposed agency action.</text></subparagraph> <subparagraph id="H71FC6271E07B4E6895FBCF76C4314658"><enum>(B)</enum><text>The alternative of no action.</text></subparagraph></paragraph> 
<paragraph id="HD7FF94C8E6A54F2DA57ABD16DD410D8D"><enum>(3)</enum><header>Waiver</header><text display-inline="yes-display-inline">In preparing an environmental impact statement for a forest landscape project described in paragraph (1), the Secretary shall not be required to comply with section 1502.11(g) or 1502.17 of title 40, Code of Federal Regulations (or successor regulations).</text></paragraph></subsection> <subsection id="HB9C45136BDD34A26ADD6B75037A8066E"><enum>(d)</enum><header>Judicial review in United States District Courts</header> <paragraph id="HDA6AF7829FA9429EBC9CEE57A19A152F"><enum>(1)</enum><header>Venue</header><text>Notwithstanding section 1391 of title 28, United States Code, or other applicable law, a forest landscape project for which an environmental assessment or an environmental impact statement is prepared shall be subject to judicial review only in—</text> 
<subparagraph id="HEFCD27D7843B4F958067DA06C37B4DEF"><enum>(A)</enum><text>the United States district court for a district in which the Federal land to be treated under the forest landscape project is located; or</text></subparagraph> <subparagraph id="H6F5165574E3A484194F68F91F91060E3"><enum>(B)</enum><text>the United States district court for the District of Columbia.</text></subparagraph></paragraph> 
<paragraph id="HFCB6F671820A48B195A7B2BA3D2AACCE"><enum>(2)</enum><header>Expeditious completion of judicial review</header><text>In the judicial review of an action challenging a forest landscape project described in paragraph (1), Congress encourages a court of competent jurisdiction to expedite, to the maximum extent practicable, the proceedings in the action with the goal of rendering a final determination on jurisdiction, and, if jurisdiction exists, a final determination on the merits, as soon as practicable after the date on which a complaint or appeal is filed to initiate the action.</text></paragraph></subsection> <subsection id="H00392D6876744D0EB6AED025404DCE5D"><enum>(e)</enum><header>Exclusions</header><text display-inline="yes-display-inline">The authorities provided under this section may not apply to—</text> 
<paragraph id="H71C0729DEBF04C6AA70FCFBBD68DAD74"><enum>(1)</enum><text display-inline="yes-display-inline">any component of the National Wilderness Preservation System, except with respect to wilderness study areas determined, before the date of the enactment of this Act, to not be suitable for wilderness designation; </text></paragraph> <paragraph id="HCFC5FE8A17984F16845757E526DB8DEF"><enum>(2)</enum><text>any congressionally designated wilderness study area; </text></paragraph> 
<paragraph id="H67D4324317B444DDAEA4D7B8E0CAB285"><enum>(3)</enum><text>National Forest System lands—</text> <subparagraph id="H5E28F8D3FDAD4B2F95835ADF3D3CFD61"><enum>(A)</enum><text>on which the removal of vegetation is prohibited by Act of Congress;</text></subparagraph> 
<subparagraph id="H0080DD3BD92146E7B22D334F90EB798D" commented="no"><enum>(B)</enum><text>that are located within a national or State-specific inventoried roadless area established by the Secretary through regulation, unless—</text> <clause id="HD2375A84E55E45EAB66D974597E696B9" commented="no"><enum>(i)</enum><text>the forest management activity to be carried out under such authority is consistent with the forest plan applicable to the area; </text></clause> 
<clause id="H85BC853824A94F08801EE88E0A296040" commented="no"><enum>(ii)</enum><text>the Secretary determines the forest management activity is permissible under the applicable roadless rule governing such lands; or</text></clause> <clause id="H9AFC25C079894455A8E9B974328B9963"><enum>(iii)</enum><text display-inline="yes-display-inline">the inventoried roadless area was not recommended for wilderness designation as a result of—</text> 
<subclause id="HA31A1C6A921E4A25A357679D883A1B91"><enum>(I)</enum><text>the second roadless area review and evaluation program (RARE II); or</text></subclause> <subclause id="HCCD0803B6F7F48928420A2503793AA8C"><enum>(II)</enum><text>a subsequent revision of a land and resources management plan under section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>); or</text></subclause></clause></subparagraph> 
<subparagraph id="H17910522536F48449D1EE80A458A0907" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>on which timber harvesting for any purpose is prohibited by Federal statute.</text></subparagraph></paragraph></subsection> <subsection id="H463066955EB546CA8B33E67900AC9433"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HAF48C44FA1FA4A6696C86D17E421D965" display-inline="no-display-inline"><enum>(1)</enum><header>Collaborative process</header><text>The term <term>collaborative process</term> means a collaborative process described in section 4003(b)(2) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/16/7303">16 U.S.C. 7303(b)(2)</external-xref>).</text></paragraph> <paragraph id="HA01D07D19AEF4FEDAAC9E421A50B65F5"><enum>(2)</enum><header>Forest landscape</header><text>The term <term>forest landscape</term> means an area that—</text> 
<subparagraph id="H47D5CE7C4B5144D2ABE93CC52E9A7F5D"><enum>(A)</enum><text>primarily or entirely contains land that has a high or very high wildfire hazard potential;</text></subparagraph> <subparagraph id="H71CF5FA7060A4703BA1FBEFB911AE87A"><enum>(B)</enum><text>due to a fuel management activity in the area, would have a reduced risk, as determined by the Secretary—</text> 
<clause id="HE6FDEC3C2E124A04B1230ADE66DE40CA"><enum>(i)</enum><text>of wildfire endangering a nearby at-risk community (as defined in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>));</text></clause> <clause id="H63793D1281BD4E8D81856F301CDC3495"><enum>(ii)</enum><text>of wildfire damaging a municipal watershed or infrastructure that serves an at-risk community described in clause (i); or</text></clause> 
<clause id="HBF61879C5E514C038EA4F97DDD795E78"><enum>(iii)</enum><text>of the transmission of a high intensity wildfire from the applicable wildland-urban interface or forest landscape to a nearby community; and</text></clause></subparagraph> <subparagraph id="H67123AA53A5649DA9A2FD1A684E4A713"><enum>(C)</enum><text>to the extent practicable, is conducive to the development and implementation of projects relating to wildfire resilience and forest health or removal of dead or dying trees that are carried out through a collaborative process.</text></subparagraph></paragraph> 
<paragraph id="H95F56046F60A4F048A9C1821BD8FE2A1"><enum>(3)</enum><header>Forest landscape project</header><text>The term <term>forest landscape project</term> means a project described in subsection (b)(1). </text></paragraph> <paragraph id="H0D48087962D14E3798C88E32D4C317D1"><enum>(4)</enum><header>Forest plan</header><text display-inline="yes-display-inline">The term <term>forest plan</term> means a land and resource management plan prepared by the Forest Service for a unit of the National Forest System pursuant to section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>).</text></paragraph> 
<paragraph id="HA2FEF076251C4008980B1BD4DE7CC181"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection> <subsection id="HB4E7882884184F9A9FF305BA2A966BDC"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $200,000,000 for fiscal year 2021 and each fiscal year thereafter.</text></subsection></section>
