R. 2607</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210415">April 15, 2021</action-date><action-desc><sponsor name-id="T000483">Mr. Trone</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HAS00">Armed Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to establish in the Department of Veterans Affairs procedures to determine presumptions of service connection based on toxic exposure, and for other purposes.</official-title></form><legis-body id="H6040E75684BC417DBBA134C5A1B23A2D" style="OLC"><section id="HFEF8209931F64486A92E2D91C7375D84" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairly Assessing Service-related Toxic Exposure Residuals Presumptions Act</short-title></quote> or the <quote><short-title>FASTER Presumptions Act</short-title></quote>.</text></section><section id="H391E203803454E96936F7E77373A4892" section-type="subsequent-section"><enum>2.</enum><header>Improvements to ability of Department of Veterans Affairs to establish presumptions of service connection based on toxic exposure</header><subsection id="H33ACA64796064128807D46B1B5A2BB1B"><enum>(a)</enum><header>Advisory committees, panels, and boards</header><paragraph id="H27C7EFF1CD91446D820092E8FD0903DD"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">Chapter 11</external-xref> of title 38, United States Code, is amended by adding at the end the following new subchapter:</text><quoted-block style="USC" id="HBABB388C6F60487EB4E7F6819DED2796" display-inline="no-display-inline"><subchapter id="H393066D1BCFE4BD280B285FEC6B43CA0"><enum>VII</enum><header>Research and determinations relating to presumptions of service connection based on toxic exposure</header><section id="HF20AB56461BB44DC95DEBCD8087730D0"><enum>1171.</enum><header>Procedures to determine presumptions of service connection based on toxic exposure; definitions</header><subsection id="H9B7F81B4AAB9461E8DD7434F7A4FD46C"><enum>(a)</enum><header>Procedures</header><text display-inline="yes-display-inline">The Secretary shall determine whether to establish, or to remove, presumptions of service connection based on toxic exposure pursuant to this subchapter, whereby—</text><paragraph id="H84BFF49DCB6F45A9A63E675D5FBA404E" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the Formal Advisory Committee on Toxic Exposure under section 1172 assesses research regarding veterans who, during active military, naval, or air service, were exposed to toxic substances, commissions additional research, and provides nominations for the Science Review Board to evaluate the research;</text></paragraph><paragraph id="H6BBB2912F9604A898FE0502109006CCB"><enum>(2)</enum><text>the Science Review Board under section 1173 evaluates research nominated by the Formal Advisory Committee on Toxic Exposure and determines the strength of evidence supporting a positive association between exposure to a toxic substance and an illness;</text></paragraph><paragraph id="HDBD3C076BC524049A58F24C246C7A474" commented="no"><enum>(3)</enum><text>the Working Group under section 1174 evaluates the conclusions of the Science Review Board and recommends to the Secretary whether to establish or modify a presumption of service connection; and</text></paragraph><paragraph id="H37250E42370F448AA9C20F376395CF8B"><enum>(4)</enum><text>the Secretary prescribes regulations under section 1175.</text></paragraph></subsection><subsection id="HA96450ED247D458AB615426ACC0AC744"><enum>(b)</enum><header>Illness defined</header><text display-inline="yes-display-inline">In this subchapter, the term <quote>illness</quote> includes a disease or other condition affecting the health of an individual. </text></subsection><subsection id="H5AF6F7FF08D245BBB61DB34B6D447B6F"><enum>(c)</enum><header>Nonapplication of sunset requirements</header><text display-inline="yes-display-inline">Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to an entity established under this subchapter.</text></subsection></section><section id="H84DC7431CE5140D6835DD52E7389D532"><enum>1172.</enum><header>Formal Advisory Committee on Toxic Exposure</header><subsection id="H2AE63ECFA96240B38B130A5D8CF17213"><enum>(a)</enum><header>Establishment</header><paragraph commented="no" display-inline="yes-display-inline" id="H28094F363ABB4839AD7335775BBDCE81"><enum>(1)</enum><text display-inline="yes-display-inline">There is in the Veterans Benefits Administration of the Department the Formal Advisory Committee on Toxic Exposure (in this section referred to as the <quote>Committee</quote>).</text></paragraph><paragraph id="H234DA2B28DED4D53AB94A576E33808F1" display-inline="no-display-inline" indent="up1" commented="no"><enum>(2)</enum><text>The Secretary shall appoint not more than 10 members to the Committee, of which—</text><subparagraph id="H07C04D4A359845BBB3C9B3E52D5DBA60" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">at least one member shall be appointed from among individuals who are officials or employees of the Veterans Benefits Administration or the Veterans Health Administration;</text></subparagraph><subparagraph id="H4B36CBE3C8D74DC5B4FABB20BA876F28" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">at least one member shall be appointed from among individuals who are officials or employees of other departments or agencies of the Federal Government, including the Department of Defense and the Agency of Toxic Substances and Disease Registry of the Centers for Disease Control and Prevention;</text></subparagraph><subparagraph id="H0F3469C228D64AD684731009BE7608B4" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">at least three members shall be appointed from among individuals who are representatives of disabled veterans; and</text></subparagraph><subparagraph id="HE9A8F57AA9B54DFEB99AE189BB4F0108" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">at least one member shall be appointed from among individuals in the private sector, State or local government, or academia, who are experts in toxicology and epidemiology.</text></subparagraph></paragraph><paragraph id="H90C27B7A4A7A43FFBC0C277805701997" indent="up1" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary shall determine the pay and allowances of the members, including with respect to any additional pay and allowances for members who are officials or employees of the Federal Government.</text></paragraph><paragraph id="HEDA468548BEB4AE9BC725B900D0C3292" indent="up1" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">Each member of the Committee shall be appointed for a two-year term, and may serve not more than three successive terms.</text></paragraph><paragraph id="HA9E2651F7688473688C922A211F66B9C" indent="up1" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">A vacancy in the Committee shall be filled in the manner in which the original appointment was made.</text></paragraph></subsection><subsection id="H0D0F286372CA49A899202CBFDEF01BB9"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Secretary may consult with, and seek the advice of, the Committee with respect to disability-related questions relating to veterans who, during active military, naval, or air service, are suspected of having been exposed to toxic substances.</text></subsection><subsection id="HC3D1D19A532E497084E9FF2DC7C59BFD"><enum>(c)</enum><header>Assessments</header><paragraph commented="no" display-inline="yes-display-inline" id="HA6942C755DFB449199C4AAD55BEA0C9E"><enum>(1)</enum><text display-inline="yes-display-inline">The Committee shall assess the exposure of veterans to toxic substances that occurred during active military, naval, or air service.</text></paragraph><paragraph id="HE116144E72264CD5B5E4A55FC70C8903" indent="up1" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">The assessments under paragraph (1) shall cover suspected and known toxic exposures occurring during active military, naval, or air service, including by identifying and evaluating new and emerging exposures that are not recognized under existing presumptions of service connection.</text></paragraph><paragraph id="H6F67844B43264B10B1D4B7B46B9509AC" indent="up1" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The Committee may conduct an assessment under paragraph (1) in response to a recommendation by the Science Review Board pursuant to section 1173(c)(2)(B) of this title or the Working Group under section 1174(c)(1)(B).</text></paragraph><paragraph id="H52F761D0A11E42DDACD1A7922AC6B3C1" indent="up1"><enum>(4)</enum><text>In assessing the exposure of veterans to toxic substances under paragraph (1), the Commission shall determine whether—</text><subparagraph id="HB00B87E129A54AB4B242C619AA89E313"><enum>(A)</enum><text>under subsection (d), further research into the exposure is warranted;</text></subparagraph><subparagraph id="HEEFA7C8949E04131ADC956866FC6EA27"><enum>(B)</enum><text>under subsection (e), the existing research being assessed is sufficient to nominate to the Science Review Board under section 1173 of this title for evaluation;</text></subparagraph><subparagraph id="H5701F402E58B486EBC5DC7C3C38B7F7F" commented="no"><enum>(C)</enum><text>under subsection (f), there is sufficient evidence regarding an existing presumption of service connection for review by the Science Review Board or Working Group under section 1174 of this title, as the case may be; or</text></subparagraph><subparagraph id="HE108A79770B745EEAA8261DF49266BCC" commented="no"><enum>(D)</enum><text>no further action is warranted. </text></subparagraph></paragraph></subsection><subsection id="H53E6D8871A194DE2A5D9CE9A40020474"><enum>(d)</enum><header>Research</header><paragraph commented="no" display-inline="yes-display-inline" id="H195EE35D60444AC79FFB1B9C7234338B"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H9E115B7D86F84D50897DA3772ECC4F63"><enum>(A)</enum><text display-inline="yes-display-inline">Following an assessment of the exposure of veterans to toxic substances that occurred during active military, naval, or air service under subsection (c), the Committee may commission an appropriate entity (including an element of the Department, an academic entity, or a private-sector entity) to conduct additional research into the exposure and the health effects of the exposure, including such research to be conducted in response to data and analyses provided by the Secretary of Defense or the Secretary of Veterans Affairs relating to suspected toxic exposure occurring during such service.</text></subparagraph><subparagraph id="H1BE166EAC5444940B31F30F29C79B05D" indent="up2"><enum>(B)</enum><text>In carrying out subparagraph (A), the Committee shall determine whether additional research is needed with respect to the following:</text><clause id="H32F41CB37BF64D2F89DB2A55CAB4E3E9"><enum>(i)</enum><text>Identification of the composition of suspected toxic substances.</text></clause><clause id="HE8EEC4898E2C4D458680944299E1FA32"><enum>(ii)</enum><text>Exposure assessments.</text></clause><clause id="H4066B6B5E43846799E59D87E8D2C27D7"><enum>(iii)</enum><text>Epidemiological studies.</text></clause><clause id="H2B6A5C7054E044CA99FBBAC6FC6E8070"><enum>(iv)</enum><text>Toxicology and mechanistic studies.</text></clause></subparagraph><subparagraph id="H6B412E1563694F1D91735C070C9789C7" indent="up2" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">In carrying out subparagraph (A), the Committee shall consider the following information:</text><clause id="H5D25F1818D414B4184FD21F8C25BDA1D" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">All available health tracking data.</text></clause><clause id="HEAE8C172CD7F4FAB9372921BEC12474F" commented="no"><enum>(ii)</enum><text>All available surveillance data.</text></clause><clause id="H8460AFA8C8404A0C95A1F6CD56B58B1B" commented="no"><enum>(iii)</enum><text>All germane research previously considered by the Committee.</text></clause></subparagraph></paragraph><paragraph id="H0EC59E0ED2854E279632C079C96F3B4D" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In assessing the suitability of topics for additional research pursuant to subparagraph (A), the Committee shall consider the following:</text><subparagraph id="H8A5A543E4E894D74B1F761685BC1B026"><enum>(A)</enum><text display-inline="yes-display-inline">Conditions of service in the active military, naval, or air service, known or suspected exposure to agents, and circumstances of exposure. </text></subparagraph><subparagraph id="H7199559E9B8E44F5A1F705D103BB8614"><enum>(B)</enum><text display-inline="yes-display-inline">Existing evidence of a connection between illnesses and service in the active military, naval, or air service, and the size or ability to define the group of affected veterans.</text></subparagraph><subparagraph id="H8A7A3DC49A0543F8A7499EF5EC91C827"><enum>(C)</enum><text>In accordance with subsection (g), input from persons who may be affected by the actions of the Committee.</text></subparagraph><subparagraph id="H42789E8506AC4CC8AF2B0909BC9CF857"><enum>(D)</enum><text>Exposure assessments, including data on activities of the Armed Forces or exposures that may be classified.</text></subparagraph><subparagraph id="H1F915A61CFFB48A598C6D65F7EC10D14"><enum>(E)</enum><text display-inline="yes-display-inline">Existing health tracking and surveillance, including veterans and members of the active military, naval, or air service, such as the burn pit registry established under section 201 of the Dignified Burial and Other Veterans' Benefits Improvement Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/260">Public Law 112–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/527">38 U.S.C. 527</external-xref> note).</text></subparagraph><subparagraph id="H960F9840EEB84A41842E371A851B03C4"><enum>(F)</enum><text display-inline="yes-display-inline">Research, including laboratory research discoveries and findings from studies of members of the active military, naval, or air service and civilian workers who were exposed to toxic substances.</text></subparagraph><subparagraph id="H6ECCD01292DE4F09B9E4EE8AD8685AAC"><enum>(G)</enum><text>The effect of sex, gender, age, race, and ethnicity on health outcomes.</text></subparagraph></paragraph><paragraph id="HB3E7D095F72048DAB98C62911E25C423" indent="up1" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The Committee shall ensure that the research commissioned under paragraph (1) is tailored to produce results or conclusions necessary for the Science Review Board to make a fully informed assessment.</text></paragraph></subsection><subsection id="H87AF00DDB0044B4F8C7BCE9397C07B02"><enum>(e)</enum><header>Nomination</header><text display-inline="yes-display-inline">If the Committee determines further action is appropriate with respect to an assessment of the exposure of veterans to toxic substances that occurred during active military, naval, or air service under subsection (c), the Committee may nominate the Science Review Board to evaluate either or both, as the case may be—</text><paragraph id="H9489C808D5AE4DC98B01385665BE40AC"><enum>(1)</enum><text>the existing research included in the assessment; or</text></paragraph><paragraph id="H37F7011F23684314BBBF1F5912B7A1CB"><enum>(2)</enum><text>the further research conducted pursuant to subsection (d).</text></paragraph></subsection><subsection id="HD4CBCC928B64462F9E8AF2C66BC994ED" commented="no"><enum>(f)</enum><header>Review of existing presumptions</header><paragraph commented="no" display-inline="yes-display-inline" id="H46B9408087C54B1DAB7E2A27D52E81C0"><enum>(1)</enum><text display-inline="yes-display-inline">Upon receipt of evidence suggesting that previous findings supporting a positive association between an exposure and an illness are no longer valid, the Committee may nominate such exposure or illness for review by the Science Review Board.</text></paragraph><paragraph id="H3A87831EBC3D49B2BF3A4D73BC3043CC" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Upon receipt of evidence suggesting that previous findings regarding the periods and locations of exposure covered by an existing presumption of service connection are no longer supported, the Committee may nominate such evidence for evaluation by the Working Group to modify the periods and locations.</text></paragraph></subsection><subsection id="HD94D302C04694D8BB237AB9CA648C641"><enum>(g)</enum><header>Input</header><paragraph commented="no" display-inline="yes-display-inline" id="H9664D0A7A523431FBE6645A3DD87E3D5"><enum>(1)</enum><text>Not less than quarterly, the Committee shall provide an opportunity for persons described in paragraph (2) to present written or oral comments to the Committee.</text></paragraph><paragraph id="HC67924E70C264466B3C3724688F88827" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The persons described in this paragraph are persons who may be affected by the actions of the Committee, including—</text><subparagraph id="HBE8F4CA33F9348088E0F3BBFEF456E39"><enum>(A)</enum><text>veterans, the families of veterans, veterans service organizations and representatives, researchers, and other members of the general public; and</text></subparagraph><subparagraph id="HDC8A03065C7A48F98B00E51DE65DF166"><enum>(B)</enum><text>departments and agencies of the Federal Government.</text></subparagraph></paragraph></subsection><subsection id="H1EB56F6AE5FF4F13BDBFD936805CB5D8"><enum>(h)</enum><header>Reports to Congress</header><text>On a biennial basis, the Committee shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate, and make publicly available, a report on the actions of the Committee. Each such report shall include, with respect to the period covered by the report, the following:</text><paragraph id="H6FBC135DF52C4349B1A672FB2EC58B5E"><enum>(1)</enum><text>A description of—</text><subparagraph id="HA3FE066D4B424C91A1F1D5E197727FAF"><enum>(A)</enum><text display-inline="yes-display-inline">the exposure and evidence considered by the Committee;</text></subparagraph><subparagraph id="H5B808418848948F9A7DD416C9DA679A4"><enum>(B)</enum><text>any research commissioned by the Committee; and</text></subparagraph><subparagraph id="H656AA2A887DB428D87DC11D082DA3261"><enum>(C)</enum><text>the rationale of the nominations made by the Committee to the Science Review Board for further evaluation. </text></subparagraph></paragraph><paragraph id="H130F8501D12246EC951F5561BCB1455B"><enum>(2)</enum><text display-inline="yes-display-inline">A description of each specific action recommended by the Committee described in subsection (c)(3).</text></paragraph><paragraph id="H049708BC68A44481AB099D06CCE8FD0E" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Each report received by the Committee under section 1173(c)(2) of this title.</text></paragraph></subsection></section><section id="HC4D79119723B4F83A259DDA55E208FBC"><enum>1173.</enum><header>Science Review Board</header><subsection id="H32A5D80C07DA437196B745BAFAF878E9"><enum>(a)</enum><header>Establishment</header><paragraph commented="no" display-inline="yes-display-inline" id="H3EE67B7638904F99AC3AD9BB838B6E4C"><enum>(1)</enum><text>There is in the Department the Science Review Board (in this section referred to as the <quote>Board</quote>).</text></paragraph><paragraph id="H0FCC680E56094250AD2544CF83F23E4D" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H7DE3B40BBB6D4506A453F2743661F12B"><enum>(A)</enum><text display-inline="yes-display-inline">The members of the Board shall be appointed by the Secretary from the general public from among individuals who are distinguished in the fields of medicine, biological sciences, or health administration.</text></subparagraph><subparagraph id="HE400281CC8D946D6819E82D2C6EDB0D5" indent="up1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">An individual may not concurrently serve on the Board and the Formal Advisory Committee on Toxic Exposure under section 1172 of this title.</text></subparagraph><subparagraph id="H77BDD32D726D4A3BAD5002992AAFF8D8" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary shall determine the number, terms of service, and pay and allowances of members of the Board appointed by the Secretary.</text></subparagraph></paragraph></subsection><subsection id="H6677E360425245AC9E0FC93AAFB3B4CE" commented="no"><enum>(b)</enum><header>Duties</header><paragraph commented="no" display-inline="yes-display-inline" id="H9A86FEDB4BBD47A28FF8210AA19E99C3"><enum>(1)</enum><text display-inline="yes-display-inline">Upon receiving a nomination for the evaluation of research on the health effects of exposure of members of the active military, naval, or air service to toxic substances made by the Formal Advisory Committee on Toxic Exposure pursuant to section 1172 of this title, the Board shall—</text><subparagraph id="HD7805F0AEF92407DB61A661022FB5500" indent="up1" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">evaluate the likelihood that an illness is associated with an exposure to a toxic substance while serving in the active military, naval, or air service; and</text></subparagraph><subparagraph id="H53C83936D48E45598B69ECB3ED54D09F" indent="up1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">assess the exposures and illnesses identified by the Committee and determine whether the evidence supports a finding of a positive association between the exposure and the illness.</text></subparagraph></paragraph><paragraph id="H76B815CF2E99499AAEBA1FBDB783C295" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">In carrying out paragraph (1)(B), the Board shall review all relevant data to determine, with respect to the strength of evidence for a positive association, that there is—</text><subparagraph id="H6280D1E857254F749ECB3739C51C1976"><enum>(A)</enum><text>sufficient evidence of an association;</text></subparagraph><subparagraph id="HCD8A317CB0C341ADBF0AF5A2E0970DEA"><enum>(B)</enum><text>limited or suggestive evidence of an association;</text></subparagraph><subparagraph id="H118E4699B6BA4266857359E7916D4E80"><enum>(C)</enum><text>inadequate or insufficient evidence to determine an association; or</text></subparagraph><subparagraph id="HB2590C43451244A7BD125C2D064442D7"><enum>(D)</enum><text>limited or suggestive evidence of no association.</text></subparagraph></paragraph><paragraph id="HAC26FDD252494AFDBDDE0A5854784E9F" indent="up1" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">With respect to an evaluation conducted under this subsection, if the Board determines that the evidence for a positive association is inadequate or insufficient to determine an association as described in paragraph (2)(C), the Board shall develop a recommendation as to whether additional data gathering and research are necessary.</text></paragraph></subsection><subsection id="H1E1A8739AEFC441983140998503B35D7" commented="no"><enum>(c)</enum><header>Reports</header><paragraph commented="no" display-inline="yes-display-inline" id="H26BA8650994F45308D284AB8C2449C7F"><enum>(1)</enum><text display-inline="yes-display-inline">For each evaluation conducted under subsection (b) where the Board determines that the evidence for a positive association is either sufficient or limited or suggestive of an association, as described in subparagraph (A) or (B) of paragraph (2) of such subsection, the Board shall submit to the Secretary, the Working Group under section 1174 of this title, and to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report identifying the evidence found to reach such positive association determinations.</text></paragraph><paragraph id="HC3716D592179416CABA4305F52EC84B5" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For each evaluation conducted under subsection (b) where the Board determines that the evidence for positive association is inadequate or insufficient to determine an association as described in paragraph (2)(C) of such subsection, the Board shall submit to the Secretary, the Formal Advisory Committee on Toxic Exposure, and to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report—</text><subparagraph id="H5261B5D47B8B4B019237DF0F03CE90A0"><enum>(A)</enum><text>identifying the evidence found to reach such positive association determinations; and</text></subparagraph><subparagraph id="H4528D8C9799A478C9D987B9E0A4778A7" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">containing the recommendations under subsection (b)(3) as to whether additional data gathering and research are necessary and an outline of a report request proposal for such additional data and research.</text></subparagraph></paragraph></subsection></section><section id="HCC898952C7CD427E8A238D27786C4F34"><enum>1174.</enum><header>Working group on presumptions of service connection</header><subsection id="H637C88D881A34097B1CD5ECC6BF92C76"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a working group (in this section referred to as the <quote>Working Group</quote>) to—</text><paragraph id="H648830D9C9F84D9C89F95F4B22215CDC"><enum>(1)</enum><text>evaluate—</text><subparagraph id="HB3B50C9669564FD897119A490D78C95F"><enum>(A)</enum><text>the conclusions of the Science Review Board contained in each report submitted under section 1173(c)(1) of this title; and</text></subparagraph><subparagraph id="H69A7FBC385F34CC39F3FB5C1027CA61B" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">evidence nominated by the Formal Advisory Committee on Toxic Exposure under section 1172(f)(2) regarding the periods and locations of exposure covered by an existing presumption of service connection; and</text></subparagraph></paragraph><paragraph id="H417FED8DC020453E968EBDA3D95FB0F7" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">make a recommendation to the Secretary with respect to whether to—</text><subparagraph id="HE4DEE60B53114E2095514CC7C61FF435" commented="no"><enum>(A)</enum><text>establish a presumption of service connection for the toxic exposure and illness covered by the report described in subparagraph (A) of paragraph (1); or</text></subparagraph><subparagraph id="H8C83D28027D04D6CB234CD08DF6E8068" commented="no"><enum>(B)</enum><text>modify an existing presumption of service connection described in subparagraph (B) of such paragraph.</text></subparagraph></paragraph></subsection><subsection id="H96F9063938F048FE8DBF18F89D47B5A4"><enum>(b)</enum><header>Evaluations</header><paragraph commented="no" display-inline="yes-display-inline" id="H4E0B193D22C548B2B4C51D89287085DD"><enum>(1)</enum><text>In evaluating the conclusions of the Science Review Board, the Working Group shall consider factors, in addition to the conclusions of the Board, that the Working Group determines appropriate.</text></paragraph><paragraph id="H50E8CA19C1C34186B81D0D2C45F0E262" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The Working Group shall provide a period of not fewer than 60 days for persons described in <internal-xref idref="HC67924E70C264466B3C3724688F88827" legis-path="1172.(g)(2)">section 1172(g)(2)</internal-xref> of this title to present written comments to the Working Group with respect to each evaluation made under this section.</text></paragraph></subsection><subsection id="H872F7F820B774CCA8367CE29569385F3"><enum>(c)</enum><header>Recommendations</header><paragraph commented="no" display-inline="yes-display-inline" id="H8DA76803F7B94996BEE73CBB901A9AD0"><enum>(1)</enum><text display-inline="yes-display-inline">In making a recommendation under subsection (a)(2), the Working Group shall—</text><subparagraph id="H0C2CA96F17EF4708BC09381F630FE2E4" indent="up1" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">in cases where the evidence for a positive association is either sufficient or limited or suggestive of an association, as described in subparagraph (A) or (B) of section 1173(b)(2) of this title, weigh heavily in favor of establishing a presumption of service connection; and</text></subparagraph><subparagraph id="H726AFB16721845B4917355873450A8CF" indent="up1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">if the Working Group determines that additional research, studies, or reports are appropriate before making a final recommendation with respect to establishing or modifying a presumption of service connection, submit to the Formal Advisory Committee a description of such appropriate additional research, studies, or reports.</text></subparagraph></paragraph><paragraph id="HED97CDB5039545078EAE20A860A2E301" display-inline="no-display-inline" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Not later than 60 days after the date on which the comment period under subsection (b)(2) ends with respect to an evaluation made under this section, the Working Group shall submit to the Secretary and to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a description of the recommendation made under subsection (a)(2).</text></paragraph></subsection></section><section id="H4048B65F30EF4D2A84E323584ADED957"><enum>1175.</enum><header>Regulations regarding presumptions of service connection based on toxic exposure</header><subsection id="H1243A87718D84656B50B8D4FF5F8D4FF"><enum>(a)</enum><header>Action upon Working Group recommendation</header><text display-inline="yes-display-inline">Not later than 60 days after the date on which the Secretary receives a recommendation to establish or modify a presumption of service connection under section 1174(c)(2) of this title—</text><paragraph id="HA02ABA66F531483286255752C059E525"><enum>(1)</enum><text display-inline="yes-display-inline">if the Secretary determines that the presumption, or modification, is warranted, the Secretary shall issue proposed regulations setting forth the presumption or revise regulations to carry out such modification; or</text></paragraph><paragraph id="H643FC23D8D7B41CEB1FE809990C0538F"><enum>(2)</enum><text display-inline="yes-display-inline">if the Secretary determines that the presumption, or modification, is not warranted, the Secretary shall publish in the Federal Register a notice of the determination, including the reasons supporting the determination.</text></paragraph></subsection><subsection id="H940DBBC4B050410F8D93724C39761AD5"><enum>(b)</enum><header>Final regulation</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the Secretary issues any proposed regulations under subsection (a)(1), the Secretary shall issue final regulations. Such regulations shall be effective on the date of issuance.</text></subsection><subsection id="H17A055EF55DE42BB8994E375B87849C6" commented="no"><enum>(c)</enum><header>Removal of presumption</header><paragraph commented="no" display-inline="yes-display-inline" id="H1881FA3B50B341A98A9F3AF397EC90DF"><enum>(1)</enum><text>The Secretary may issue regulations to remove an illness from a presumption of service connection previously established pursuant to a regulation issued under subsection (b).</text></paragraph><paragraph id="H38563CB48C964F158D735D75F1FBD505" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Whenever an illness is removed from regulations pursuant to paragraph (1), or the periods and locations of exposure covered by a presumption of service connection are modified under subsection (a)—</text><subparagraph id="HB243179FF65D442CBC523B85BCF13F61" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a veteran who was awarded compensation for such illness on the basis of the presumption provided under such regulations before the effective date of the removal or modification shall continue to be entitled to receive compensation on that basis; and</text></subparagraph><subparagraph id="HBDA6282166954240B4A6F4FD71E2EB80" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a survivor of a veteran who was awarded dependency and indemnity compensation for the death of a veteran resulting from such illness on the basis of such presumption shall continue to be entitled to receive dependency and indemnity compensation on such basis.</text></subparagraph></paragraph></subsection></section><section id="H9B4805A7254744E6A3C9936D30361288"><enum>1176.</enum><header>Expert Advisory Panel on Constrictive Bronchiolitis</header><subsection id="HDC424058ED0E4F20B55A53A6C27DDBAF"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is in the Department the Expert Advisory Panel on Constrictive Bronchiolitis (in this section referred to as the <quote>Panel</quote>).</text></subsection><subsection id="HA8B50A90FA1246C49D65F198FFC862D0"><enum>(b)</enum><header>Membership</header><paragraph commented="no" display-inline="yes-display-inline" id="H1610A265087E40F79CB42C7C243829B8"><enum>(1)</enum><text display-inline="yes-display-inline">The Panel shall be appointed by the Secretary from the general public from among individuals who are—</text><subparagraph id="HCC131890EC7E4F26BDF8CFF26B4DCB9B" indent="up1"><enum>(A)</enum><text>experts in pulmonary pathology;</text></subparagraph><subparagraph id="H6530A74BD62548A9B4307C500DFD96A7" display-inline="no-display-inline" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">experts in other fields the Secretary determines appropriate, such as pulmonary medicine, toxicology, epidemiology, exposure assessment, and radiology; and</text></subparagraph><subparagraph id="H95E608EDF6614B8A866A62B5C86394B1" indent="up1"><enum>(C)</enum><text>individuals representing the veterans community.</text></subparagraph></paragraph><paragraph id="HC1435FA3423A43168253B6323F073E2F" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall determine the number, terms of service, and pay and allowances of members of the Panel appointed by the Secretary.</text></paragraph></subsection><subsection id="H65D73E2E101147D2B5250316DA61B765"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">The panel shall develop specific guidelines for research conducted by the Department of symptomatic veterans who served in the active military, naval, or air service in the Southwest Asia theater of operations whom the differential diagnosis includes bronchiolitis. The Panel shall—</text><paragraph id="HEE99755D62E54270BEB4CAEA87260DFD"><enum>(1)</enum><text display-inline="yes-display-inline">determine the adequacy of lung biopsy approaches and recommend to the Secretary best practices;</text></paragraph><paragraph id="H873F6FBB4E54462EA4645AF4B9972242"><enum>(2)</enum><text>make recommendations to the Secretary for processing, handling, and storing lung biopsies;</text></paragraph><paragraph id="HC643A95BB1EA4471813508C6B409F5F7"><enum>(3)</enum><text>establish histologic and pathology criteria for confirming diagnoses; and</text></paragraph><paragraph id="HEE2CC165FB2A4F3CB47F0068D0EABAD1" commented="no"><enum>(4)</enum><text>submit to the Secretary and to the Committees on Veterans’ Affairs of the House of Representatives and the Senate reports on the findings and results of such research.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HBEFC3F5855174B6C9596FBA4FA0A1912"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1163 the following new items:</text><quoted-block style="USC" id="HB1500DEF64DF4931B8B68F1E56FBF49C" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="subchapter">Subchapter VII—Research and determinations relating to presumptions of service connection based on toxic exposure </toc-entry><toc-entry level="section">1171. Expert Advisory Panel on Constrictive Bronchiolitis.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1B328904532D4FC3A9AABDA05FD9941B"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">Chapter 11</external-xref> of title 38, United States Code, is amended as follows:</text><paragraph id="H66D507A5B705477AA2F8B2D70533C063"><enum>(1)</enum><text>Section 1116 is amended—</text><subparagraph id="HF0D9234D21D54DB4A1A6172EA7AC30BB"><enum>(A)</enum><text>by striking subsections (b), (c), (d), and (e);</text></subparagraph><subparagraph id="H02F9C963F99348E6BAAEB948F1AF206B" commented="no"><enum>(B)</enum><text>by inserting after subsection (a) the following new subsection (b):</text><quoted-block style="USC" id="HA43F3475FC6C44D29CD40ABE04C7BCCC" display-inline="no-display-inline"><subsection id="H097D0BF245E54E69A796476A8A27CF9A" commented="no"><enum>(b)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that any determination made on or after the date of the enactment of the FASTER Presumptions Act regarding a presumption of service connection based on exposure to an herbicide agent under this section is made pursuant to subchapter VII of this chapter, including with respect to assessing reports received by the Secretary from the National Academy of Sciences under section 3 of the Agent Orange Act of 1991 (<external-xref legal-doc="public-law" parsable-cite="pl/102/4">Public Law 102–4</external-xref>).</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HF74FFAA266B240D6818435D8C789BF50"><enum>(C)</enum><text>by redesignating subsection (f) as subsection (c).</text></subparagraph></paragraph><paragraph id="H147344790FA942CABB6D1A0B12CD2719" commented="no"><enum>(2)</enum><text>Section 1116B(b)(2)(A) is amended by inserting <quote>pursuant to subchapter VII of this chapter,</quote> before <quote>the Secretary determines</quote>.</text></paragraph><paragraph id="HEA957265D90C4C2ABD3B05D1415E044A" commented="no"><enum>(3)</enum><text>Section 1118 is amended—</text><subparagraph id="H063598E780FB421199B254CBEB834757" commented="no"><enum>(A)</enum><text>by striking subsections (b), (c), (d), and (e); and</text></subparagraph><subparagraph id="H6C0975383E8C4768AD5A124F5DE1512E" commented="no"><enum>(B)</enum><text>by inserting after subsection (a) the following new subsection (b):</text><quoted-block style="USC" id="H2FBEDD1346FA476AAC06F0C045958A4C" display-inline="no-display-inline"><subsection id="H42013608281D477E8C267F65274C5661" commented="no"><enum>(b)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that any determination made on or after the date of the enactment of the FASTER Presumptions Act regarding a presumption of service connection based on exposure to a toxic substance under this section is made pursuant to subchapter VII of this chapter.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HBE16747E7F344787AE213412AF11F9DF" commented="no"><enum>(c)</enum><header>Access to health care</header><text>Section 1710(e) of title 38, United States Code, is amended—</text><paragraph id="H94E98EA628184844BA6C9936F400649F" commented="no"><enum>(1)</enum><text>in paragraph (1), by adding at the end the following new subparagraph:</text><quoted-block style="USC" id="H526A431590654DDDAB507195A4FF93EE" display-inline="no-display-inline"><subparagraph id="H81E5CB68A4C94726820BD887540EF752" indent="up1" commented="no"><enum>(G)</enum><clause commented="no" display-inline="yes-display-inline" id="HA8B03A6C444A4C4BB1EA36AD0571B255"><enum>(i)</enum><text display-inline="yes-display-inline">Subject to paragraph (2), as determined appropriate by the Secretary, a toxin-exposed veteran is eligible for hospital care and medical services under subsection (a)(2)(F) for any diagnosed illness that the Secretary determines is covered by, or reasonably could be covered by, pending research during the period beginning on the date on which the Formal Advisory Committee on Toxic Exposure begins assessing such research under section 1172(c) of this title and ending on the date specified in clause (ii).</text></clause><clause id="HB97B52530E3E47DAA3A26E83E5E41A32" indent="up1" commented="no"><enum>(ii)</enum><text>The date specified in this clause is the following:</text><subclause id="HB5913B624FBA4B568136A13EB360669F" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">In cases of pending research for which the Secretary determines under section 1175(a)(1) of this title that a presumption of service connection is warranted, the date on which the toxin-exposed veteran is otherwise eligible for hospital care and medical services pursuant to this section by reason of regulations issued under such section 1175.</text></subclause><subclause id="HEDDB6DEC9D1041FEBCCE7AD73346733C" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">In cases of pending research for which the Secretary determines under section 1175(a)(2) that a presumption of service connection is not warranted, the date, if any, that the Secretary determines appropriate.</text></subclause></clause><clause id="H8113495BA66D448CB891239E27550EEA" indent="up1" commented="no"><enum>(iii)</enum><text>In this subparagraph:</text><subclause id="H3FD4E049A7A84B32B89843EFDB16212D" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">The term <quote>pending research</quote> means research assessed or commissioned by the Formal Advisory Committee on Toxic Exposure under section 1172 regarding the exposure of veterans to toxic substances.</text></subclause><subclause id="HCF47BC5335CF4C9C986F4750B1D89DB4" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">The term <quote>toxin-exposed veteran</quote> means a veteran—</text><item id="H021E3B3F662F4E1C86AAB34107DD7261"><enum>(aa)</enum><text>whose service in the active military, naval, or air service is covered by pending research; and</text></item><item id="HC81C9D03B97641938724610C4B92B5B2"><enum>(bb)</enum><text display-inline="yes-display-inline">who is not otherwise eligible for hospital care and medical services pursuant to this paragraph.</text></item></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HDE21884EE2BB4C38ADE264DB9F694754" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)(B), by striking <quote>or (F)</quote> and inserting <quote>(F), or (G)</quote>. </text></paragraph></subsection></section><section id="H796C8992F672484F836EDF777ABA4E34"><enum>3.</enum><header>Improvements to data collection and use</header><subsection id="H4110926B5C08408BB8A39674BB0704CA"><enum>(a)</enum><header>Plan</header><text display-inline="yes-display-inline">The Secretary of Defense, in consultation with the Secretary of Veterans Affairs, shall develop and implement a plan to strengthen the data collection with respect to members of the Armed Forces, including members of the reserve components, who are exposed to toxic substances while serving in the Armed Forces. The plan shall provide for the following:</text><paragraph id="H8F9D8F9D74AE4A8DB71599B15C9D4E3B"><enum>(1)</enum><text display-inline="yes-display-inline">Detailing methods of continuous in-service surveillance, including data collection and analysis, of such exposures and the physical and mental health of the members.</text></paragraph><paragraph id="H92172FC30CBD4D90B7B9FFC78AB738B8"><enum>(2)</enum><text display-inline="yes-display-inline">Surveilling such exposures and the health of members from accession through separation, including, where possible, through the use of wearable and portable devices to assess health outcomes, and extend such surveillance indefinitely post-separation for those veterans with suspected exposure to toxic substances.</text></paragraph><paragraph id="HD54736C9495E42069035C2A7109E2C74"><enum>(3)</enum><text display-inline="yes-display-inline">Ensuring consistent surveillance efforts across the Armed Forces.</text></paragraph><paragraph id="H669C2759ED76414D9879DCBBDEBAF67F"><enum>(4)</enum><text display-inline="yes-display-inline">Determining the feasibility of collecting biological samples and the means by which such collection could be accomplished, including, at a minimum, through use of wearable and portable devices and the collection of blood and urine, to measure exposure in deployed environments.</text></paragraph><paragraph id="H1C3D666C8B4F420D9E1CFFB98677BEFA"><enum>(5)</enum><text display-inline="yes-display-inline">Maintaining a repository of data and biological samples available for prospective research.</text></paragraph><paragraph id="H2BE0F4DEA2DE4F25870012A8C17721C6"><enum>(6)</enum><text>With respect to each member, tracking the military occupational specialty, deployment history, disease risk factors, sex, gender, age, race, and ethnicity.</text></paragraph></subsection><subsection id="HA49B027DA5D944F98DC75C9DCE8730EA"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit to the Committees on Veterans’ Affairs and the Committees on Armed Services of the House of Representatives and the Senate, and annually thereafter for five years, a report containing the plan developed under subsection (a) and the status of implementing the plan.</text></subsection><subsection id="HC0BB72D638F04664989BC350D86BB5C1" commented="no"><enum>(c)</enum><header>Integration</header><text display-inline="yes-display-inline">The Secretary of Defense shall integrate research access considerations of the plan developed under subsection (a) into the electronic health record modernization program and the individual longitudinal exposure record program.</text></subsection><subsection id="HBBE6D77C55144D3B8E996A93A74AB1F7"><enum>(d)</enum><header>Determinations</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs, in consultation with the Formal Advisory Committee on Toxic Exposure established under section 1172 of title 38, United States Code, as added by section 2, shall determine—</text><paragraph id="H055653E4435040AAA5665EFAEBDF5D59"><enum>(1)</enum><text display-inline="yes-display-inline">whether studies of respiratory health outcomes from other countries, including Australia, Canada, France, Poland, Sweden, and the United Kingdom, provide useful data, and whether the structure of these studies could be emulated in the United States to improve participation rates; and</text></paragraph><paragraph id="H5F0509B1272D43D1B8AD312654270490"><enum>(2)</enum><text display-inline="yes-display-inline">whether the health records of veterans from health care systems other than the Department of Veterans Affairs, including private-sector health providers, the Centers for Medicare &amp; Medicaid Services, and the TRICARE program, can be accessed for research purposes.</text></paragraph></subsection><subsection id="HD96C67463C5E4ECCB1C85A5BC3F2B11E"><enum>(e)</enum><header>Sharing of information</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall provide to the Formal Advisory Committee on Toxic Exposure and the Science Review Board established under section 1173 of title 38, United States Code, as added by section 2, the results of surveillance conducted pursuant to the plan developed under subsection (a), including data collection and analysis.</text></subsection></section><section id="H587201182E7A4001B0D11AFD6535B97B"><enum>4.</enum><header>Studies relating to veterans who served in Southwest Asia</header><subsection id="H77A08A11D2BE4C57A315A08628CD3AD0"><enum>(a)</enum><header>Analysis</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall initiate or sponsor an updated analysis of total and respiratory disease mortality in covered veterans. The study shall include, to the extent practicable—</text><paragraph id="H9F3314BFF81B48CB8BE8F1C1A69220FC"><enum>(1)</enum><text display-inline="yes-display-inline">metrics of airborne exposures;</text></paragraph><paragraph id="H5DEAD10FCB0C41D0971ABB9804A457A9"><enum>(2)</enum><text>the location and timing of deployments;</text></paragraph><paragraph id="H35314AB6681E4769A450E2AEF0966EB5"><enum>(3)</enum><text>the military occupational specialty;</text></paragraph><paragraph id="H154925E7D1804921ABC380F037639DE7"><enum>(4)</enum><text>the Armed Force in which the veteran served;</text></paragraph><paragraph id="HE6DD60F5CBD94A4EB53E5BDB3E385719"><enum>(5)</enum><text>pre-existing health status, including with respect to asthma; and</text></paragraph><paragraph id="H561609F1DEA145DD865553E6C678064E"><enum>(6)</enum><text>relevant personal information, including cigarette and e-cigarette smoking history, diet, sex, gender, age, race, and ethnicity.</text></paragraph></subsection><subsection id="H3FAFE39133F542EE8064BC3F209F4444"><enum>(b)</enum><header>Epidemiological study</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall sponsor an epidemiological study of covered veterans that uses the following:</text><paragraph id="H7862166CE8DB4263AAA82A6F84451197"><enum>(1)</enum><text display-inline="yes-display-inline">Improved spatio-temporal estimates of ambient air pollution exposures using advances in retrospective exposure assessment.</text></paragraph><paragraph id="H12009F5058244DCEAABC9CC9A99B0821"><enum>(2)</enum><text display-inline="yes-display-inline">Detailed information on the study subjects obtained through medical records, administrative data, and other existing sources, that include—</text><subparagraph id="HF9A711C4F0F74478BE81007B8FF41AFE"><enum>(A)</enum><text display-inline="yes-display-inline">personal characteristics, including cigarette and e-cigarette smoking history, diet, sex, gender, age, race, and ethnicity;</text></subparagraph><subparagraph id="H816BC2E1F7CB4BF38BEE3F8CCF60BB5B"><enum>(B)</enum><text>deployment history, including locations, periods, and number of deployments;</text></subparagraph><subparagraph id="HA4E5AFC3143B437990CBD3250003EC68"><enum>(C)</enum><text>biospecimen data; and</text></subparagraph><subparagraph id="H1E9176894C96446D8542496462E70F5E"><enum>(D)</enum><text>supplementary health status and outcomes data, including imaging and physiological parameters.</text></subparagraph></paragraph></subsection><subsection id="HCE4D23C9C5C042BABCC448444D5B792D"><enum>(c)</enum><header>Toxicology study</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall sponsor a toxicology study to include variability to replicate exposures of healthy, young members of the Armed Forces, as well as potentially susceptible members, with preexisting health conditions. The study shall—</text><paragraph id="H683FA7DCCEB549C3AAF7A3E323A84395"><enum>(1)</enum><text display-inline="yes-display-inline">analyze the study results for mechanistic markers and clinically relevant outcomes; and</text></paragraph><paragraph id="HEC4408B5B8A44E5194F3089E3111A784"><enum>(2)</enum><text display-inline="yes-display-inline">validate serum, tissue, and other biomarkers of exposure, susceptibility, or effect.</text></paragraph></subsection><subsection id="H0210CC73B91947358FE4A6F92D82E262"><enum>(d)</enum><header>Covered veteran defined</header><text>The term <quote>covered veteran</quote> means any veteran who—</text><paragraph id="H76E222F3675847879B1E79C9CC9C4F8E"><enum>(1)</enum><text display-inline="yes-display-inline">on or after August 2, 1990, served on active duty in—</text><subparagraph id="HD826573145CB4DE49D83C09E02D1D869"><enum>(A)</enum><text>Bahrain;</text></subparagraph><subparagraph id="HCF6C9788650348C58B0C098809C9778E"><enum>(B)</enum><text>Iraq;</text></subparagraph><subparagraph id="H4265343B028D44F9AFA2B9E66F2F76AD"><enum>(C)</enum><text>Kuwait;</text></subparagraph><subparagraph id="HAF6E328964B84C589381D375BEB7AAA2"><enum>(D)</enum><text>Oman;</text></subparagraph><subparagraph id="H61F670B736624AD88DFFA1A2706442C9"><enum>(E)</enum><text>Qatar;</text></subparagraph><subparagraph id="H8881260685F2430B850CBF8DD350BDD4"><enum>(F)</enum><text>Saudi Arabia; </text></subparagraph><subparagraph id="H802B4E7B86B848F2B1AC6BE6D211B6E5"><enum>(G)</enum><text>Somalia; or</text></subparagraph><subparagraph id="H438F20F263214C1AAFB7DD48B3E5DB22"><enum>(H)</enum><text>United Arab Emirates; or</text></subparagraph></paragraph><paragraph id="HFEB6E2A014304AB2B27830FCDD3224DF"><enum>(2)</enum><text display-inline="yes-display-inline">on or after September 11, 2001, served on active duty in—</text><subparagraph id="H2CCB2EC47F0D4D37B70F02B470202B92"><enum>(A)</enum><text>Afghanistan;</text></subparagraph><subparagraph id="HA24E035AFDCC45D99E56AFCF3DD906B5"><enum>(B)</enum><text>Djibouti;</text></subparagraph><subparagraph id="H11B1C4228055457D95C936E340AB99F3"><enum>(C)</enum><text>Egypt;</text></subparagraph><subparagraph id="H87A2C5A86A044BDDB1D7568447729AEB"><enum>(D)</enum><text>Jordan;</text></subparagraph><subparagraph id="H4A3FE253F9DC433DA311A89F714B236A"><enum>(E)</enum><text>Lebanon;</text></subparagraph><subparagraph id="HA89C69899C2E4978898BE32964EF3F86"><enum>(F)</enum><text>Syria; or</text></subparagraph><subparagraph id="H585D55172794474D86359CACFB82BDF9"><enum>(G)</enum><text>Yemen.</text></subparagraph></paragraph></subsection></section><section id="HB9A81765DABA47CF94B87CCE8759074D"><enum>5.</enum><header>Training to improve claims adjudications</header><subsection id="H9449BA2B5EE74414BD56C6F203694DB7"><enum>(a)</enum><header>Training on adjudication</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall provide training to each covered employee to improve the handling of claims for compensation and pension benefits that relate to toxic exposure. The Secretary shall provide such training annually and, in addition to the annual training, when the Secretary determines that a significant development has occurred in law or regulation with respect to such claims, such as the Secretary establishing a new presumption of service connection.</text></subsection><subsection id="HE4E1296257474C279AD89C943361BFE2"><enum>(b)</enum><header>Matters included</header><paragraph id="H14ABC0C4976F4829B125791F43880D6D"><enum>(1)</enum><header>All trainees</header><text display-inline="yes-display-inline">The training under subsection (a) shall include the following explanations with respect to claims relating to toxic exposure:</text><subparagraph id="H48E23343E5384130B03D878FCF3C4E44"><enum>(A)</enum><text>A lack of a presumption of service connection is not by itself sufficient to determine that service connection does not exist.</text></subparagraph><subparagraph id="HFCE4703637A340A29498333A46E0C9DE" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">The claims adjudicator shall always consider whether direct service connection is applicable and request, as needed, an advisory medical opinion under section 5109 of title 38, United States Code.</text></subparagraph><subparagraph id="H1F761F39C3DD442F84B5F4C0BD2D10EB" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">While information included in the individual longitudinal exposure record program of the Department of Veterans Affairs may be used to corroborate assertions of toxic exposure, a lack of such information, or a lack of other corroborating evidence of toxic exposure, is not by itself sufficient to determine that such exposure did not occur or sufficient to deny the claim.</text></subparagraph></paragraph><paragraph id="HA96E18384C464BAB8F30B3FDBF236418"><enum>(2)</enum><header>Veterans Service Representatives</header><text display-inline="yes-display-inline">In addition to the matters under paragraph (1), the Secretary shall ensure that each employee described in subsection (d)(1) receives an individualized assessment of—</text><subparagraph id="H2B7C031669CD4A93A8E70A207FCBDAEC"><enum>(A)</enum><text>the ability of the employee to identify claims qualifying for presumptive service connection; and</text></subparagraph><subparagraph id="H077DDB3220F84217AB0A50390932ACCC"><enum>(B)</enum><text>the compliance of the employee with standardized development requirements.</text></subparagraph></paragraph><paragraph id="H94D1E231D06F49CBB5D12680BA3E09B3"><enum>(3)</enum><header>Rating Veterans Service Representative</header><text display-inline="yes-display-inline">In addition to the matters under paragraph (1), the Secretary shall ensure that each employee described in subsection (d)(2) receives an individualized assessment of—</text><subparagraph id="HFAF9C6282C7D4AFEA616C8DAF919F300"><enum>(A)</enum><text>the ability of the employee to identify claims qualifying for presumptive service connection; and</text></subparagraph><subparagraph id="H3B579E1F60514DC9B9CFECB8187CFE6D"><enum>(B)</enum><text>the compliance of the employee with the schedule of ratings for disabilities adopted under section 1155 of title 38, United States Code.</text></subparagraph></paragraph><paragraph id="HF272651D018646C399A4F3504F995D05"><enum>(4)</enum><header>Compensation and pension medical examiners</header><text display-inline="yes-display-inline">In addition to the matters under paragraph (1), the Secretary shall ensure that each employee described in subsection (d)(3) receives an individualized assessment of—</text><subparagraph id="HEA39D11E4C4647089A54634141F13DC0"><enum>(A)</enum><text>the ability of the employee to identify claims qualifying for presumptive service connection; and</text></subparagraph><subparagraph id="H674C1ED172E34B5A9185A7CD5721F96E"><enum>(B)</enum><text display-inline="yes-display-inline">the compliance of the employee with standardized examination and medical opinion procedures.</text></subparagraph></paragraph></subsection><subsection id="H8F49F4D23E2C4002ABDAB8770F1FDB73"><enum>(c)</enum><header>Provision of training</header><text display-inline="yes-display-inline">With respect to employees described in paragraph (1) or (2) of subsection (d), the Secretary shall—</text><paragraph id="H1A4118F82C1E4D5F8E8FC0B8218C4CC7"><enum>(1)</enum><text>ensure that the training under subsection (a) is provided as part of the initial training program for such employees;</text></paragraph><paragraph id="HD73209430222434D9FCEB866F32CEB95" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">place each employee under a second signature review period for claims relating to toxic exposure until the employee meets the required grade scale level quality standard for such claims; and</text></paragraph><paragraph id="H531392177D8747C58F4375163C0FA5CE" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">using the Systematic Technical Accuracy Review program, or such successor program, conduct a nationwide, quarterly, randomized review of the quality of adjudication of claims relating to toxic exposure.</text></paragraph></subsection><subsection id="HDF239C4AE30047AEABE1A69D91CC3753"><enum>(d)</enum><header>Covered employee defined</header><text display-inline="yes-display-inline">In this section, the term <quote>covered employee</quote> means employees of the Department of Veterans Affairs who handle claims for compensation and pension benefits, including—</text><paragraph id="HD1EED74615B04FFA89A8867FDA2BCF06" commented="no"><enum>(1)</enum><text>employees who adjudicate claims;</text></paragraph><paragraph id="HCEDE2D9755784B1397F41CBD0AE68133" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">employees who apply the schedule of ratings for disabilities adopted under section 1155 of title 38, United States Code, and prepare rating decisions; and</text></paragraph><paragraph id="H8B5E7E2279D94EB8B3B254E35F9A3305" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">employees or contractors who provide medical examinations or medical opinions pursuant to section 5103A(d) of such title.</text></paragraph></subsection></section></legis-body></bill>
