which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Election Campaign Act of 1971 to provide for a limitation on the time for the use of contributions or donations by candidates for election for Federal office, to prohibit candidates from using campaign funds to make contributions to charitable organizations which are owned or controlled by the candidate or immediate family members of the candidate, and for other purposes.</official-title></form><legis-body id="H24687A730A764483A0D5A986BC8DAF36" style="OLC"><section id="H38A7886293AB4569A2E5EDF91793D0FA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Let It Go Act</short-title></quote>.</text></section><section id="HAF1792671AE047F8B948F84B0776DA37"><enum>2.</enum><header>Timeframe for and prioritization of disposal of contributions or donations by candidates</header><subsection id="HC20822FF239040509073A204E0DDDC4F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 313 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114</external-xref>) is amended—</text><paragraph id="H6FC6F5C51DA5468DBEF6B0ED9D4503B6"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph><paragraph id="H39790D0C076947D89C6AEEF17C333FB8"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HDA3579DB1FE9452CBF8AF1718E0BDB86" style="OLC"><subsection id="H88F9D18D85974CBEB9437D3D4F010369"><enum>(c)</enum><header>Disposal</header><paragraph id="H5CB64AE5C0354DE09CDC270908E77BCA"><enum>(1)</enum><header>Timeframe</header><text display-inline="yes-display-inline">Contributions or donations described in subsection (a) may only be used—</text><subparagraph id="HA15E4423FFF54AD398CBE721935D7E68"><enum>(A)</enum><text>in the case of an individual who is not a candidate with respect to an election for any Federal office for a 6-year period beginning on the day after the date of the most recent such election in which the individual was a candidate for any such office, during such 6-year period; or</text></subparagraph><subparagraph id="HC4521D3768E844F79576F47F6BE1D944"><enum>(B)</enum><text>in the case of an individual who becomes a registered lobbyist under the Lobbying Disclosure Act of 1995, before the date on which such individual becomes such a registered lobbyist.</text></subparagraph></paragraph><paragraph id="H7869CFFF13CC4F238E4F3BA8E5D88F19"><enum>(2)</enum><header>Means of disposal; prioritization</header><text>Beginning on the date the 6-year period described in subparagraph (A) of paragraph (1) ends (or, in the case of an individual described in subparagraph (B) of such paragraph, the date on which the individual becomes a registered lobbyist under the Lobbying Disclosure Act of 1995), contributions or donations that remain available to an individual described in such paragraph shall be disposed of, not later than 30 days after such date, as follows:</text><subparagraph id="H7C075E44869A4694BF2F00B0535BF071"><enum>(A)</enum><text display-inline="yes-display-inline">First, to pay any debts or obligations owed in connection with the campaign for election for Federal office of the individual.</text></subparagraph><subparagraph id="H9BACC431F172496D90A3201DD8BE890B"><enum>(B)</enum><text display-inline="yes-display-inline">Second, to the extent such contribution or donations remain available after the application of subparagraph (A), through any of the following means of disposal (or a combination thereof), in any order the individual considers appropriate:</text><clause id="H3314DC0D06174C788A47D868B2E5179E"><enum>(i)</enum><text>Returning such contributions or donations to the individuals, entities, or both, who made such contributions or donations.</text></clause><clause id="HFCD717A520D64C8E8E5653F52244C5BA"><enum>(ii)</enum><text display-inline="yes-display-inline">Making contributions to an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/170">section 170(c)</external-xref> of the Internal Revenue Code of 1986.</text></clause><clause id="HA1CFF3A0EEC94FFF928A0B8396DDA3C3"><enum>(iii)</enum><text display-inline="yes-display-inline">Making transfers to a national, State, or local committee of a political party.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H50062A9E1EC64697BC5E8405759BBA59"><enum>(b)</enum><header>1-Year transition period for certain individuals</header><paragraph id="H23B4152C6FFB4968BE19CCA130AB8EAD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of an individual described in paragraph (2), any contributions or donations under section 313(a) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114(a)</external-xref>) remaining available to the individual as of the date of the enactment of this Act shall be disposed of—</text><subparagraph id="HF42F2A437E0E4551BB13DBB904836882"><enum>(A)</enum><text>not later than one year after the date of the enactment of this Act; and</text></subparagraph><subparagraph id="H7149D05AEC7040F6913D1FC66D13CE26"><enum>(B)</enum><text>in accordance with the prioritization specified in subparagraphs (A) through (B) of subsection (c)(2) of section 313 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114</external-xref>), as amended by subsection (a).</text></subparagraph></paragraph><paragraph id="H0A05A9AC1FE241C39A13E1240CFE0769"><enum>(2)</enum><header>Individuals described</header><text display-inline="yes-display-inline">An individual described in this paragraph is an individual who, as of the date of the enactment of this Act—</text><subparagraph id="H526EAFB96D5B4CA2B89D69E5FD0419A5"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H253FAD7181154A4B9372A8D1545DB95D"><enum>(i)</enum><text>is not a candidate with respect to an election for any Federal office for a period of not less than 6 years beginning on the day after the date of the most recent such election in which the individual was a candidate for any such office; or</text></clause><clause id="H6328865840F24650BA1DC1642EB737B1" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">is an individual who becomes a registered lobbyist under the Lobbying Disclosure Act of 1995; and</text></clause></subparagraph><subparagraph id="H146358A81F834625BE98A540484CA900"><enum>(B)</enum><text>would be in violation of subsection (c) of section 313 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114</external-xref>), as amended by subsection (a).</text></subparagraph></paragraph></subsection></section><section id="H0E5780E0B216443FA753A214CED6F231"><enum>3.</enum><header>Prohibiting donation of campaign funds to charitable organizations owned or controlled by candidate or immediate family members</header><subsection id="H47BE049D91A04FD691019AF1F7510034"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 313(b) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114(b)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H2D8A5DE4E29348168106D6128572D755" display-inline="no-display-inline"><paragraph id="H8E6DF493CE8641769C3FEDAE00CCC448"><enum>(3)</enum><header>Prohibiting contributions to charitable organizations owned or controlled by candidate or immediate family members</header><text display-inline="yes-display-inline">A contribution or donation described in subsection (a) may not be used for a contribution to an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/170">section 170(c)</external-xref> of the Internal Revenue Code of 1986 if the candidate or an immediate family member of the candidate (as defined in subsection (c)(3)(B)) is an employee of the organization or a member of the organization’s board of directors, or (in the case of an organization which is a corporation) the candidate and immediate family members of the candidate in the aggregate own a majority of the corporation’s voting shares.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H188FF98C9F024667844D84341CE7035E"><enum>(b)</enum><header>Conforming amendments</header><text>Section 313 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114</external-xref>) is amended—</text><paragraph id="H2DFD0A93D7A449F79835577281B6E14A"><enum>(1)</enum><text>in subsection (a)(3), by striking <quote>for contributions</quote> and inserting <quote>except as provided in subsection (b)(3), for contributions</quote>; and</text></paragraph><paragraph id="H5EE94A2C9FFA42208B6F9B1764C35FE2"><enum>(2)</enum><text>in subsection (c)(2)(B)(ii), as amended by section 2, by striking <quote>Making contributions</quote> and inserting <quote>Except as provided in subsection (b)(3), making contributions</quote>.</text></paragraph></subsection><subsection id="H445F49360A684F38A2863665ADEB8510"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to contributions made on or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
