on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to address the increased burden that maintaining the health and hygiene of infants and toddlers places on families in need, the resultant adverse health effects on children and families, and the limited child care options available for infants and toddlers who lack sufficient diapers, and for other purposes.</official-title></form><legis-body id="HFBFF6208DEFC4D278FB07553887DEF81" style="OLC"><section id="H4BB16E44C85346919C786A4C070487BA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Diaper Need Act of 2021</short-title></quote>.</text></section><section id="H4BB4F2893D884270BD70E28490EDEA4E"><enum>2.</enum><header>Diaper distribution demonstration project</header><text display-inline="no-display-inline">Part P of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g">42 U.S.C. 280g</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block id="H6DA9C12AABEC48EEA41B5707772316EB" style="OLC"><section id="H1F3B8693A3184FF695308AFEE4A79FDF"><enum>399V–7.</enum><header>Diaper distribution demonstration program</header><subsection id="HF4D03C051F4F40C29D67D9B8EE78A796"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall make grants to assist eligible entities to conduct demonstration projects that implement and evaluate strategies to help low-income families to address the diaper needs of infants and toddlers.</text></subsection><subsection id="H0D80878305EB4E03A62F3402153EB856"><enum>(b)</enum><header>Design of program</header><text>In carrying out the grant program under subsection (a), the Secretary shall—</text><paragraph id="HA40FDAB7ACC74075AC2B7F15C6EFBB28"><enum>(1)</enum><text>consult with relevant stakeholders, including agencies, professional associations, and nonprofit organizations, on the design of the program; and</text></paragraph><paragraph id="HAA03AAFF1772433EAE99D2ED00EC9779"><enum>(2)</enum><text>design the program in such a way that the program—</text><subparagraph id="H3336B71DE6574BAFB880CFF715385A7D"><enum>(A)</enum><text>decreases diaper need in low-income families and meets the unmet diaper needs of infants and toddlers in such families through—</text><clause id="HC8B6EEEFDB18431C8256BF29FD294E9B"><enum>(i)</enum><text>the distribution of free diapers and diapering supplies;</text></clause><clause id="H64968238AD1F49608C05CDBBB01D764F"><enum>(ii)</enum><text>community outreach to assist in participation in existing diaper distribution programs; or</text></clause><clause id="H98DD853260294CD98E71B898E1ED36DF"><enum>(iii)</enum><text>improving access to diapers and diapering supplies as part of a comprehensive service; and</text></clause></subparagraph><subparagraph id="H36C765DABF67474D9D8E6011E3FFD81D"><enum>(B)</enum><text>increases the abilities of communities and low-income families in those communities to provide for the diaper needs of infants and toddlers in those communities.</text></subparagraph></paragraph></subsection><subsection id="H6BEA113BA86D46CBB6C4F0DA2C8AA0B8"><enum>(c)</enum><header>Eligible entities</header><text>To be eligible for a grant under this section, an entity shall—</text><paragraph id="H8006347A0C1B4D0292814D62A01CEB5E"><enum>(1)</enum><text>be a State or local governmental entity, an Indian Tribe or tribal organization (as defined in section 4 of the Indian Self-Determination and Education Assistance Act), or a nonprofit organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code;</text></paragraph><paragraph id="HE0F423D765F74024B5D3EDC0349F8D0A"><enum>(2)</enum><text>have experience in the area of—</text><subparagraph id="H42CB4F3521DB41A6A503274A732AB6A5"><enum>(A)</enum><text>community distributions of basic need services, including experience collecting, warehousing, and distributing basic necessities such as diapers, food, or menstrual products;</text></subparagraph><subparagraph id="HD9607CBC945C466BB17829695633E8E7"><enum>(B)</enum><text>child care;</text></subparagraph><subparagraph id="H1A33388F284A413DB016525B29E9D610"><enum>(C)</enum><text>child development activities in low-income communities; or</text></subparagraph><subparagraph id="HFA8A3EA98B8B40F3881FB8B8B544AF00"><enum>(D)</enum><text display-inline="yes-display-inline">motherhood, fatherhood, or parent-education efforts serving low-income parents of young children;</text></subparagraph></paragraph><paragraph id="H3ACF27B4419D4A5AB8EE5581FDBDE8C3"><enum>(3)</enum><text>demonstrate competency to implement a project, provide fiscal accountability, collect data, and prepare reports and other necessary documentation;</text></paragraph><paragraph id="H06A61B5B600B4E2DA5A5D93C2F3BDE3C"><enum>(4)</enum><text>demonstrate a willingness to share information with researchers, practitioners, and other interested parties; and</text></paragraph><paragraph id="HF57559795EA94639AE2516CF303E9D57"><enum>(5)</enum><text display-inline="yes-display-inline">submit to the Secretary a description of the design of the evaluation to be carried out under subsection (d)(2) and receive the Secretary’s approval of such design based on a determination that such design is rigorous and is likely to yield information that is credible and will be useful to other States.</text></paragraph></subsection><subsection id="H404418EEEE3B4739877962965793ED7F"><enum>(d)</enum><header>Use of Funds</header><text display-inline="yes-display-inline">Amounts provided through a grant under this section shall be used to conduct a demonstration project to implement and evaluate strategies to help low-income families to address the diaper needs of infants and toddlers, which use may include any of the following:</text><paragraph id="H6F3ECA5A008B4B4FBBA39C820C36BC64"><enum>(1)</enum><text>To pay for the purchase of diapers and diapering supplies and fund diaper distribution demonstration projects that serve low-income families with one or more children 3 years of age or younger.</text></paragraph><paragraph id="HEBF2222AEA834CCAA74D1D157E1CA89E"><enum>(2)</enum><text>Using not more than 25 percent of the funds received by the grantee under this section, to evaluate the effect of activities under paragraph (1) on mitigating the health and developmental risks of unmet diaper need among infants, toddlers, and other family members in low-income families, including the risks of diaper dermatitis, urinary tract infections, and parental and child depression and anxiety.</text></paragraph><paragraph commented="no" id="H4E74CE438D4F46B482C1DFC1745AFFC3"><enum>(3)</enum><text>To integrate activities under paragraph (1) with other basic needs assistance programs serving eligible children and their families, including the following:</text><subparagraph commented="no" id="H3F593F77C73845DD85DC5E1D03CA784C"><enum>(A)</enum><text>Programs funded by the Temporary Assistance for Needy Families program, including its State maintenance of effort provisions.</text></subparagraph><subparagraph commented="no" id="HDA9630D02F184213BE83EC494C441153"><enum>(B)</enum><text display-inline="yes-display-inline">Programs designed to support the health of eligible children, such as the Children’s Health Insurance Program under title XXI of the Social Security Act, the Medicaid program under title XIX of such Act, or State-funded health care programs.</text></subparagraph><subparagraph commented="no" id="H2D9FC01EA8DD4406A117A9D549266403"><enum>(C)</enum><text>Programs funded through the Special Supplemental Nutrition Program for Women, Infants, and Children.</text></subparagraph><subparagraph commented="no" id="H09E704C3393F4653836EEAEA2AB09EE5"><enum>(D)</enum><text>Programs that offer early home visiting services, including the Nurse-Family Partnership and the Maternal, Infant, and Early Childhood Home Visiting (MIECHV) Program (including the Tribal Home Visiting Program).</text></subparagraph><subparagraph commented="no" id="H4030B721062B4E9F812C30026AC9A586"><enum>(E)</enum><text>Programs to provide improved and affordable access to child care, including programs funded through the Child Care and Development Fund, the Temporary Assistance for Needy Families program, or a State-funded program.</text></subparagraph></paragraph></subsection><subsection id="HD756F6AFEB9F49609A70F359F709358C"><enum>(e)</enum><header>No effect on other programs</header><text>Any assistance or benefits received by a family as a result of a project established pursuant to this section shall be disregarded for purposes of determining the family’s eligibility for, or amount of, benefits under any other Federal needs-based programs.</text></subsection><subsection id="H8E272BE918074314B69211322E5E5941"><enum>(f)</enum><header>Reports</header><text>As a condition of receiving a grant under this section for a fiscal year, the grantee shall submit to the Secretary, not later than 6 months after the end of the fiscal year, a report that specifies, by month and fiscal year, the following:</text><paragraph id="H173D4633467947AE88EF5838FD5C6688"><enum>(1)</enum><text>The number of infants and toddlers and the age of the infant and toddlers who received assistance from the grantee’s diaper distribution project.</text></paragraph><paragraph id="H4356C45AAD0D4E30B1AFAA43AFF115C0"><enum>(2)</enum><text>The number of families that have received assistance from the grantee’s diaper distribution project.</text></paragraph><paragraph id="H98E90376AAFB49678301D83B2378F002"><enum>(3)</enum><text>The number of diapers, and the number of each type of diapering supply, distributed under the grantee’s diaper distribution project.</text></paragraph><paragraph id="H977E0213DEA14390B7F868DE16606E12"><enum>(4)</enum><text>The ZIP Code or ZIP Codes where the grantee distributed diapers and diaper supplies.</text></paragraph><paragraph id="HEC734DF417824DB3850FE8E825E260E0"><enum>(5)</enum><text>The method or methods the grantee uses to distribute diapers and diapering supplies.</text></paragraph><paragraph id="H643B1719B16448738446C76F1AECBD30"><enum>(6)</enum><text>Such other information as the Secretary may specify.</text></paragraph></subsection><subsection id="H327CB22778B549A38BB3D25A6076A1EA"><enum>(g)</enum><header>Evaluation</header><text>The Secretary, in consultation with each grantee under this section, shall—</text><paragraph id="H9AA13889F386410B8D84C0F392F7DD02"><enum>(1)</enum><text>not later than 2 years after the date of enactment of the <short-title>End Diaper Need Act of 2021</short-title>—</text><subparagraph id="H777F354658A14A9A9F4174320224D8CE"><enum>(A)</enum><text>complete an evaluation of the effectiveness of the program carried out pursuant to this section;</text></subparagraph><subparagraph id="H208AEFC0BA744103A7C079A149865023"><enum>(B)</enum><text>submit to the relevant congressional committees a report on the results of such evaluation; and</text></subparagraph><subparagraph id="H8426EA348D414E85AA27D516A4D626CF"><enum>(C)</enum><text>publish the results of the evaluation on the internet website of the Department of Health and Human Services; and</text></subparagraph></paragraph><paragraph id="H814292C3741E4974A248483B99AE175F"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H11DC121B9F1B4427999741CE93DF6B60"><enum>(A)</enum><text>not later than 3 years after the date of enactment of the <short-title>End Diaper Need Act of 2021</short-title>, update the evaluation required by paragraph (1)(A); and</text></subparagraph><subparagraph id="H383CC2B94BEA4FE0A7EE7C0A7DEA9888" indent="up1"><enum>(B)</enum><text>not later than 90 days after completion of the updated evaluation under subparagraph (A)—</text><clause id="H5B104CE00D3E407D9384C9780332781A"><enum>(i)</enum><text>submit to the relevant congressional committees a report describing the results of such updated evaluation; and</text></clause><clause id="H792DBA04620344EDB74C5B85573D38D5"><enum>(ii)</enum><text>publish the results of such evaluation on the internet website of the Department of Health and Human Services.</text></clause></subparagraph></paragraph></subsection><subsection id="HE8A6EC86AF8F43038F160CA83ED326AA"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HC0702AE19A8C467DB4002059B2F17D45"><enum>(1)</enum><header>Diaper</header><text>The term <term>diaper</term> means an absorbent garment that—</text><subparagraph id="H350397B629B74EBB8D8BD0BEDB215FE0"><enum>(A)</enum><text>is washable or disposable that may be worn by an infant or toddler who is not toilet-trained; and</text></subparagraph><subparagraph id="H6F3E26BE10D744C58D269A5A10AB19D4"><enum>(B)</enum><text>if disposable—</text><clause id="H8495CB98915A496AB48D55E7C59AA2D1"><enum>(i)</enum><text>does not use any latex or common allergens; and</text></clause><clause id="HCA4654222E044D7CA6CEF07EDD4CA027"><enum>(ii)</enum><text>meets or exceeds the quality standards for diapers commercially available through retail sale in the following categories:</text><subclause id="H001B96D9904648DAAE564FBEBD875A84"><enum>(I)</enum><text>Absorbency (with acceptable rates for first and second wetting).</text></subclause><subclause id="H30AAD944897C4C219F462544C567BED4"><enum>(II)</enum><text>Waterproof outer cover.</text></subclause><subclause id="HC72F6DEF37904AF385C920A8DF823996"><enum>(III)</enum><text>Flexible leg openings.</text></subclause><subclause id="H969A96FE30264B608041F7B7BD72176C"><enum>(IV)</enum><text>Refastening closures.</text></subclause></clause></subparagraph></paragraph><paragraph id="H6B31AB298C274394914BA6058A34E98F"><enum>(2)</enum><header>Diapering supplies</header><text>The term <term>diapering supplies</term> means items, including diaper wipes and diaper cream, necessary to ensure that a child using a diaper is properly cleaned and protected from diaper rash.</text></paragraph><paragraph id="H25D8702781A94021BFA10551E3EE3B9B"><enum>(3)</enum><header>Eligible child</header><text>The term <term>eligible child</term> means a child who—</text><subparagraph id="H4C7A36F7B28945728F60369EDF1377D1"><enum>(A)</enum><text>has not attained 4 years of age; and</text></subparagraph><subparagraph id="HFA90957F2CE94D7CBDE3421F563D9579"><enum>(B)</enum><text>is a member of a family whose self-certified income is not more than 200 percent of the Federal poverty line.</text></subparagraph></paragraph><paragraph id="H92D82A669C6E4590B4F0D175A82630CD"><enum>(4)</enum><header>Federal poverty line</header><text>The term <term>Federal poverty line</term> means the Federal poverty line as defined by the Office of Management and Budget and revised annually in accordance with section 673(2) of the Omnibus Budget Reconciliation Act of 1981 applicable to a family of the size involved.</text></paragraph><paragraph id="H7DDA06FF37CA4DD5B18D91358A312F2B"><enum>(5)</enum><header>Low-income</header><text>The term <term>low-income</term>, with respect to a family, means a family whose self-certified income is not more than 200 percent of the Federal poverty line.</text></paragraph></subsection><subsection id="H95AE80095045457B935F7A06E41E7A22"><enum>(i)</enum><header>Authorization of appropriations</header><paragraph id="HC4CA76AC12F8452585F427EDE78C4EA0"><enum>(1)</enum><header>In general</header><text>To carry out this section, there is authorized to be appropriated $100,000,000 for each of fiscal years 2022 through 2025.</text></paragraph><paragraph id="HA4A3402FF6E54E37B9CB907F99550A8B"><enum>(2)</enum><header>Availability of funds</header><text>Funds provided to a grantee under this section for a fiscal year may be expended by the grantee only in such fiscal year or the succeeding fiscal year.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="H96DE783E189E45498ED8985EFCEB42D3"><enum>3.</enum><header>Improving access to diapers for medically complex children</header><text display-inline="no-display-inline">Section 1915(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396n">42 U.S.C. 1396n(c)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H1EAC85172F8348CA87C1AB7534C2AA85" style="OLC"><paragraph id="H8777940A77054B7FA45681835AB7CE70" indent="up1"><enum>(11)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HD057B9F373E5441DB4FE6023CE4F486A"><enum>(A)</enum><text display-inline="yes-display-inline">In the case of any waiver under this subsection that provides medical assistance to a medically complex child who has been diagnosed with bowel or bladder incontinence, a bowel or bladder condition that causes excess urine or stool (such as short gut syndrome or diabetes insipidus), or a severe skin condition that causes skin erosions (such as epidermolysis bullosa), such medical assistance shall include, for the duration of the waiver, the provision of 200 medically necessary diapers per month and diapering supplies. Such medical assistance may include the provision of medically necessary diapers in amounts greater than 200 if a licensed health care provider (such as a physician, nurse practitioner, or physician assistant) specifies that such greater amounts are necessary for such medically complex child.</text></subparagraph><subparagraph id="H50597F21990B487A9116B1F86114430E" indent="up1"><enum>(B)</enum><text>For purposes of this paragraph—</text><clause id="H30AC37E6B49F4296AD843F2863B038FB"><enum>(i)</enum><text>the term <term>medically complex child</term> means an individual who is at least three years of age and for whom a licensed health care provider has provided a diagnosis of one or more significant chronic conditions;</text></clause><clause id="HFA455CC9669A49D6BB957F3C73EFA46C"><enum>(ii)</enum><text display-inline="yes-display-inline">the term <term>medically necessary diaper</term> means an absorbent garment that is—</text><subclause id="H8613E94E29B7474BA2ED1983C2EF0904"><enum>(I)</enum><text>washable or disposable; and</text></subclause><subclause id="HEF9EA224F3E1490DBABA3DFA5154BA38"><enum>(II)</enum><text>worn by a medically complex child who has been diagnosed with a condition described in subparagraph (A) and needs such garment to correct or ameliorate such condition; and</text></subclause></clause><clause id="HF1E0BF02DBFD4741A1C27D8C140DD81B"><enum>(iii)</enum><text display-inline="yes-display-inline">the term <term>diapering supplies</term> means items, including diaper wipes and diaper creams, necessary to ensure that a medically complex child who has been diagnosed with a condition described in subparagraph (A) and uses a medically necessary diaper is properly cleaned and protected from diaper rash.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8BA1F26EFDA848C3810E59EAA70B0BB7"><enum>4.</enum><header>Inclusion of diapers and diapering supplies as qualified medical expenses</header><subsection id="HFE1A8F1E36234075A87E5269C71EDA25"><enum>(a)</enum><header>Health savings accounts</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/223">Section 223(d)(2)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H12DF5D5387AA411A876DF689F464CAB7"><enum>(1)</enum><text>by adding at the end of subparagraph (A) the following: <quote>For purposes of this subparagraph, amounts paid for medically necessary diapers and diapering supplies shall be treated as paid for medical care.</quote>; and</text></paragraph><paragraph id="HBBE4E7E72E394836A6FF36174390A325"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block id="H13082E7C054040F38082DD5D25F6E7BD" style="OLC"><subparagraph id="H4D5A0A688A304EE39E5A667AD1568610"><enum>(E)</enum><header>Medically necessary diapers and diapering supplies</header><text>For purposes of this paragraph—</text><clause id="H267BFDCC9E9442B3855191391C672780"><enum>(i)</enum><header>Medically necessary diapers</header><text>The term <term>medically necessary diaper</term> means an absorbent garment that is washable or disposable worn by an individual needs diapers because they are medically necessary, serve a preventative medical purpose, or are needed to correct or ameliorate defects or physical or mental illnesses or conditions which are diagnosed by a licenced health care provider.</text></clause><clause id="HA94E122CDBF44F7883125B85C11E47C4"><enum>(ii)</enum><header>Diapering supplies</header><text>The term <term>diapering supplies</term> means items, including diaper wipes and diaper creams necessary to ensure that a child using a medically necessary diaper is properly cleaned and protected from diaper rash.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9FAE9A76E5DE4EC9946B67B10B4509A1"><enum>(b)</enum><header>Archer MSAs</header><text>Section 220(d)(2)(A) of such Code is amended by adding at the end the following: <quote>For purposes of this subparagraph, amounts paid for medically necessary diapers and diapering supplies (as defined in section 223(d)(2)(D)) shall be treated as paid for medical care.</quote>.</text></subsection><subsection id="H336336DFD1194EF0B9628027CE5E8AC5"><enum>(c)</enum><header>Health flexible spending arrangements and health reimbursement arrangements</header><text>Section 106 of such Code is amended by adding at the end the following new subsection:</text><quoted-block id="H6384D287FEB24F4AA2CA6976C142EE33" style="OLC"><subsection id="HFD7EB159165342BF9777AEBB0993CE27"><enum>(h)</enum><header>Reimbursements for medically necessary diapers and diapering supplies</header><text>For purposes of this section and section 105, expenses incurred for medically necessary diapers and diapering supplies (as defined in section 223(d)(2)(D)) shall be treated as incurred for medical care.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD6C3EC05DBE84FF2A3A10E501C0191EA"><enum>(d)</enum><header>Effective dates</header><paragraph id="HFAA6531ABD084069BF4EED5D143CF3E5"><enum>(1)</enum><header>Distributions from health savings accounts</header><text>The amendments made by subsections (a) and (b) shall apply to amounts paid after December 31, 2021.</text></paragraph><paragraph id="H73281F93A6AF4A1DAC6E61677FD2AEDA"><enum>(2)</enum><header>Reimbursements</header><text>The amendment made by subsection (c) shall apply to expenses incurred after December 31, 2021.</text></paragraph></subsection></section></legis-body></bill>
